CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION VACATING CERTAIN PUBLIC EASEMENTS IN
THE PLAT OF EDEN PARK (PAQUIN PETITION)
WHEREAS, at a regular meeting of the City Council of the City of Lake Elmo,
Washington County, Minnesota, held December 7, 1976, a petition was presented by
Richard E. Paquin and Pearl M. Paquin, husband and wife, praying for the vacation
of certain public easements in the plat of Eden Park described as follows:
That part of Lots Six (6) and Seven (7), Block Two (2),EDEN PARK,
according to the plat thereof on file and of record inthe office
of the County Recorder, Washington County, Minnesota, described
as follows: The southerly 6.0 feet of said Lot Six (6) lying
easterly of the westerly 30.0 feet and, also, the northerly 6.0
feet of said Lot Seven (7) lying easterly of the westerly 30.0
feet,
which easements are utility and drainage easements.
WHEREAS, said petition came on for hearing before the City Council at a
regular meeting thereof held at 8:00 o'clock p.m. in the City Hall on January 18,
1977, pursuant to notice thereof published and posted as required by law; and
WHEREAS, the City Council of the City of Lake Elmo has heard all of the
evidence presented for said petition, there being no objection thereto or no
evidence presented against it, and after due consideration thereof, has deter-
mined that it is in the best interests of the public and the City of Lake Elmo
to vacate said easement for the following reasons:
1. The lands sought to be vacated as above described are of no use to the
City or the public, generally, because the Paquins' house has been located on the
easement and it would be impossible to use the easement for its intended purpose.
2. It is in the public interest to have such drainage utility easements re-
moved from the land records where they are of no actual value to the City and where,
such as here, the recorded easements may be of substantial detriment to private
property.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo,
that the following described lands:
That part of Lots Six (6) and Seven (7), Block Two (2), EDEN PARK,
according to the plat thereof on file and of record in the office
of the County Recorder, Washington County, Minnesota, described
as follows: The southerly 6.0 feet of said Lot Six (6) lying
easterly ofthe westerly 30.0 feet and, also, the northerly 6.0
feet of said Lot Seven (7) lying easterly of the westerly 30.0
feet,
be and the same hereby are vacated absolutely and forever for the reasons set
forth above herein.
IT IS FURTHER RESOLVED, that the City Council does hereby determine that
the City is deemed to benefit from said vacation for the reasons set forth above
and the same are sufficient consideration for the vacation thereof. Provided,
however, (1) that if required by the City Engineer, the Paquins shall, as a condi-
tion of this vacation, provide a new utility and drainage easement along the
southerly 6.0 feet of their property and shall secure a like easement of 6.0 feet
along the northerly 6.0 feet of the tract of land lying immediately to the south
of and adjacent to the Paquins' property; (2) that all the costs to the City of
this vacation proceeding shall be calculated by the Clerk and shall be paid by
the petitioners or their assigns to the Clerk. Upon payment of said costs by
the petitioners,and dedicating of a new easement if required by the City Engineer
or waiver thereof by the City Engineer, the Clerk shall cause notice to be served
on the County Auditor that this vacation proceeding has been concluded and shall
record a certified copy of this Resolution with the County Recorder, all as pro-
vided by and in accordance with Section 412.851 of the Minnesota Statutes.
Adopted by the City Council of the City of Lake Elmo, this 18th day of
January, 1977.

A RESOLUTION VACATING CERTAIN PUBLIC STREETS IN
BERGMANN'S ADDITION (MOTTAZ PETITION)
WHEREAS, at a regular meeting of the City Council of the City of Lake Elmo,
Washington County, Minnesota, held February 15, 1977, a petition was presented to
the City Council praying for the vacation of certain public streets in the plat
of Bergmann Addition described as follows:
All those streets and parts of streets dedicated as part of the
plat of BERGMANN ADDITION and described in said plat as follows:
"Alice Lane", "Violet Lane", and that portion of "Lucille Lane"
lying between the south boundary of Lot Six (6), Block Two (2)
and the north boundaries of the West 78.4 feet of Lot Fourteen
(14), Lot Thirteen (13) and the East 81.7 feet of Lot Twelve
(12), Block One (1), of said BERGMANN ADDITION,
WHEREAS, said petition came on for hearing before said City Council at a
regular meeting thereof held at 5:00 o'clock p.m. on March 15, 1977, pursuant to
notice thereof published and posted as required by law; and
WHEREAS, the City Council of the City of Lake Elmo has heard all the evidence
presented for said petition, there being no objection thereto, and no evidence pre-
sented against said vacation, and after due consideration thereof has determined
that it is in the best interests of the public and the City of Lake Elmo to vacate
said streets for the following reasons:
1. That the streets serve no purpose at this time and are not included as
part of the overall transportation system outlined in the City's Comprehensive Plan.
2. If the petition for vacation is granted it will preclude the potential
use of these streets by the public which use would be inconsistent with the trans-
portation plans of the City of Lake Elmo. Moreover, the vacation of said streets
would return the property included within their right-of-way to the tax rolls and
would enhance the value of the abutting property on the tax rolls all of which re-
sults in a benefit to the public.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo,
that the following described streets:

CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION EXPRESSING CONCERN AS DETRIMENTAL IMPACT OF
PROPOSED IMPROVEMENT TO TRUNK HIGHWAY (INTERSTATE) NO. 94
ON THE CITY OF LAKE ELMO
WHEREAS, the Commissioner of Transportation has presented to the City Council
of the City of Lake Elmo, certain preliminary plans for the improvement of Trunk
Highway (Interstate) No. 94 in the City of Lake Elmo which plans are designated.
as "Layout No. 26 SP 8282-28 (94=392) from TH 494-694 to St_ Croix River"; and
WHEREAS, said plans have been reviewed by the City's consultant planner
and consultant engineer; and
WHEREAS, it appears to the City Council that the said proposal will, in
several respects, have a detrimental environmental effect on the City of Lake
Elmo.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake
Elmo as follows:
I. That the attached reports prepared by Midwest Planning and Research,
Inc., as planning consultant to the City of Lake Elmo, and the attached report
of Bonestroo, Rosene, Anderiik & Associates, consultant engineers for the City
of Lake Elmo, are hereby adopted and made a part of this Resolution by reference.
2. That the said planner's report and the said engineer's report are hereby
determined to describe, at least in part, the detrimental environmental effect
of the plan on the City of Lake Elmo.
3. That the Minnesota Environmental Quality Council is hereby requested to:
(a) Give complete, careful and detailed consideration to the
said report; and, after consideration thereof,
(b) Make such orders as may be within the jurisdiction of the
Minnesota Environmental Quality Council to protect and
preserve the environment of the City of Lake Elmo against
the detrimental effects of said governmental action and
its adverse impact on present land use plans, road plans,
and other plans and policies heretofore established by the
City Council of the City of Lake Elmo for protection of the
health, safety and general welfare of the community, all of
which are more particularly described in the attached report.
Adopted by the City Council of the City of Lake Elmo, this day
of March, 1977.

A RESOLUTION GRANTING SPECIAL USE PERMIT TO
WILLIAM C. HJELMGREN PERMITTING HOME OCCUPATION
WHEREAS, William C. Hjelmgren has applied for a special use
permit to conduct a home occupation at 10899 32nd Street North in
the City (which property is owned by his father William K. Hjelm-
gren); and
WHEREAS, it appears that under the provisions of Section
7.03 of the City's zoning ordinance relating to home occupations
a special use Zermit is necessary because the proposed home occupa-
tion - upholstery work - would take place in a detached garage; and
WHEREAS, it appears that a public hearing has been held by
the City Planning Commission and the Planning Commission has
recommended its approval of the special use permit application on
the conditions hereinafter set forth; and
WHEREAS, it appears to the City Council that under the condi-
tions hereinafter set forth said home occupation can be conducted
without detrimental effect on adjacent property or to the public
generally:
NOW, THEREFORE, BE IT RESOLVED, that said William C. Hjelmgren
be granted a special use permit to conduct an upholstery business
in a detached garage at 10899 32nd Street North in the City of Lake
Elmo on the following conditions:
1. No on -premise advertising of any kind shall be used.
2. The hours of operation shall be between 7:00 o'clock a.m.
and 9:00 o'clock p.m. on weekdays, 7:00 o'clock a.m. and 5:00 o'clock
p.m. on Saturdays and no operation on Sundays.
3. All reasonable efforts shall be made by the permittee to
discourage customers from coming to his shop (it being understood
that it is customary in the upholstery business for the upholsterer
to go to the homes of the prospective customer to pick up orders
and to deliver the finished goods to the home of the customer.
4. Since the detached garage is air conditioned all windows
shall be shut when the hacker or other noisy equipment is used.

RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION RELATING TO TRAFFIC REGULATION,
TRAFFIC HAZARDS AND REQUESTING SPEED ZONE STUDIES
WHEREAS, the City police officer has called to the attention of
the City Council certain traffic hazards within the City - namely:
(1) In the opinion of the City police officer the no parking
zones on the North side of DeMontreville Trail create a traffic
hazard because it does not leave any adequate place for cars to
pull off the road and in recent weeks there has been a need for
parking because of cars used by construction crews working on houses
in the area.
(2) The City police officer reported that the speed limits on
Olson Lake Trail from Lake Jane Trail North, on DeMontreville Trail
North and on Hidden Bay Trail are too high and as a result, vehicles
are permitted to travel at unsafe speeds on those streets. He reported
that the same may be true of Lake Elmo Avenue North between 20th Street
North and State Highway 212 and on State Highway 212 itself within a
half mile in either direction from its intersection with Lake Elmo
Avenue North and 15th Street from County Road 13 West; and
WHEREAS, The City Council feels that it is necessary and impor-
tant for the safety of the public that action be taken immediately to
reduce or eliminate such traffic hazards:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Lake Elmo as follows:
1. That the no parking signs on the North side of DeMontreville
Trail be removed by the City`s maintenance department as soon as is
reasonably possible.
2. That the Washington County Highway Department and the State
of Minnesota be, and the same hereby are, requested to make all neces-

RESOLUTION CALLING FOR HEARING ON STREET IMPROVEMENTS
BE IT RESOLVED by the City Council of the City of Lake
Elmo, as follows:
1. The City Council deems it necessary and expedient
that the City of Lake Elmo conduct certain street improve-
ments, all as more particularly described in and in accordance
with preliminary plans and specifications and report prepared
by its consulting engineers, Bonestroo, ROsene, Anderlik &
Associates, Inc.
2. The Council has been advised by the consulting
engineers that the proposed improvements are feasible and
should best be made as proposed, and the consulting engineers'
report to this effect has heretofore been received by the Council.
3. A public hearing will be held in the City of Lake Elmo
in the City Hall on the 4th day of October, 1977, at 7:30 o'clock
P.M. to consider the improvements described in the Notice of
Hearing attached 'hereto.
4. The nature of the improvements, the estimated cost
thereof, and the areas proposed to be assessed therefor are
described in the form of Notice of Hearing attached hereto.

TO HIGHWAY 12 ALIGNMENT FOR I-94
RESOLVED, that the City of Lake Elmo, acting through its duly
elected Council in response to the requests of a substantial number
of its citizens, does hereby declare its intention to join in a
formal judicial (and/or administrative) challenge of the selection
of the present Highway 12 alignment for I-94, and agrees to the
expenditure of up to $5,000.00 of the City's general revenue funds
for such purpose, provided that unless additional commitments are
received by July 1, 1977, from Washington County, other municipalities,
corporate and/or individual donors which, when aggregated with Lake
Elmo's above commitment, will total at least $50,000 (the amount
expected to be sufficient to carry such challenge through the trial
court stage) this authorization shall be void; and
RESOLVED FURTHER, that Councilmen Lloyd Shervheim and Francis
J. Pott be and each hereby is authorized to represent the City in
this effort, to sign on behalf of the City such pleadings and docu-
ments in form satisfactory to the City Attorney, as may in their
judgment be necessary or desirable in connection therewith, and to
authorize the disbursement of City monies therefor with the limits
hereinabove stated.

,WHEREAS, The City Park Advisory Committee has recommended to the City Council
plans for cross-country ski trails

the recommendations of the Park Advisory Committee be approved and the construction
of approximately 3.5 miles of cross-country ski trails in the Sunfish Lake Park is
hereby ordered: The said ski trails shall be contained entirely within the
boundaries of the City property known as Sunfish Lake Park. The said ski trails
will be constructed and maintained by the City through its City employees and
volunteers.

and has unanimously adopted a budget setting forth in detail complete financial
plans of the City for the year 1978;
WHEREAS, the City Clerk/Treasurer at the direction of the Council has
computed the amount of taxes necessary and within statutory limits which must
be levied and collected during the year 1978 in order to provide the budgeted
funds; and
WHEREAS, the City Council of the City of Lake Elmo has considered the said
proposed levy and determined the same to be necessary and in the public interest;

REVISED COMPREHENSIVE SEWER PLAN FOR THE CITY
OF LAKE ELMO.
WHEREAS, the Metropolitan Council is presently studying
alternatives for waste water management in the Twin Cities
Metropolitan Area under the provisions of Section 208 of the
federal Water Pollution Control Act; and
WHEREAS, the September 19, 1977 report entitled Alternatives
for Waste Water Management in the Twin Cities Metropolitan
Area prepared by the Metropolitan Council presents some -
but not all - alternatives for waste water management in the
City of Lake Elmo and surrounding areas; and
WHEREAS, the alternatives considered in the said September,
1977 report (208 study) and the Lake Elmo-Tri-Lakes
Facility Plan prepared earlier by the Metropolitan Council, do
not solve the immediate sewer problem in the "old village"
area in the City of Lake Elmo; and
WHEREAS, neither the 208 reports nor the Tri-Lakes study
address the use of the existing Cimarron sewage disposal
plant, construction of a new municipal plant, use of the
Stillwater plant, nor service through the WOKE interceptor,
on an interim or permanent basis, as alternatives for solving
the sewage disposal problem in the "old village" of Lake
Elmo; and
WHEREAS, the City Council of the City of Lake Elmo find
that neither the September, 1977 (208 study) nor the Tri-
Lakes Facilities Plan presents, or should be considered as
presenting, the only alternatives available for waste water
management in the City of Lake Elmo at this time:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo as follows:
(A) To requer3t by this. Resolution that the Metropolitan
Council, as part of its 208 Planning Project, study the follow-
ing alternatives as potential solutions to the sewage
disposal problem in the City of Lake Elmo, including the
immediate problem in the "old village" area:
1. Sewering the "old village" to Cimarron on an
interim basis with and without improvements to
the plant.
2. Sewering all or part of the City of Lake Elmo
to Stillwater.
3. The efficacy of an independent municipal treat-
ment facility on an interim or permanent basis.
4. Temporary service to the WOKE interceptor for
the "old village" area and/or permanent
service to all or part of the City of Lake Elmo
through the WONE.
5. Service for the City of Lake Elmo to the Cottage
Grove facility.
6. Improvement of on -site systems or construction
of common on -site systems as an interim and/or
permanent solution to some or all problems in
the City.
(B) To request that the Metropolitan Council and the
Metropolitan Waste Control Commission withhold review, comment
and approval of the Lake Elmo-Tri-Lakes interceptor Facility
Planning Report until the City completes a "Comprehensive
Sewer Plan."

address the use of the existing Cimarron sewage disposal
plant, construction of a new municipal plant, use of the
Stillwater plant, nor service through the WONE interceptor,
on an interim or permanent basis, as alternatives for solving
the sewage'disposal problem in the "old village" of Lake
Elmo; and
WHEREAS, the City Council of the City of Lake Elmo find
that neither the September,.1977 (208 study) nor the Tri-
Lakes Facilities Plan presents, or should be considered as
presenting, the only alternatives available for waste water
management in the City of Lake Elmo at this time:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of .Lake Elmo as follows:
(A) To request.by this. Resolution.that the Metropolitan
Council, as part of its 208 Planning Project, study the follow-
ing alternatives as potential solutions to the sewage
disposal problem in the City of Lake Elmo, including the
immediate problem in the "old village" area:
1. Sewering the "old village'! to Cimarron on an
interim basis with and without improvements to
the plant.
2. Sewering all or part of the City of Lake Elmo
to Stillwater.

WHEREAS, the current 208 reports Present additional - but not all -

WHEREAS, neither the 208 reports not the Tri:--Lakes study address
the use of the Cimarron plant, a municipal plant, the Stillwater
plant, nor service through the WONE interceptor on a interim or
permanent basis; and,
WHEREAS, The City of Lake Elmo finds that neither the 208 nor
the Tri-Lakes plans should be represented as final alterntaives for
wastewater management for the City of Lake Elmo at this time;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the
City of Lake Elmo:
THAT, the Metropolitan Waste Control Commission withhold review,
comment, and referral of the LakeElmo-Tri Lake Interceptor Facility
Planning report until the City completes a "Comprehensive Sewer
Plan'; and,
THAT, the City of Lake Elmo hereby authorizes the Administrative
Assistant to work with the City Engineer to design a study which
will result in a "Comprehensive Sewer Plan" which considers, at
least, the following alternatives:
1. Sewering the "Old Village" to Cimarron on an interim
basis with and without improvements to the plant; and,
2. Sewering all or part of the City to Stillwater; and,
3. The efficacy of an independent municipal treatment
facility on an interim or permanent basis; and,
4. Temporary service to the WONE interceptor for the
'Old Village" and/or permanent service to all or part
of the City through the WONE; and,
5, Service for the City to the Cottage Grove facility; and,
6. Improvement of on -site systems as an interim and/or
permanent solution to some problems in the City.

A RESOLUTION ORDERING IMPROVEMENTS, APPROVEING PLANS AND SPECIFICATIONS
AND ORDERING ADVERTISEMENTS FOR BIDS.
WHEREAS,the City Council, after notice duly given in accordance
with Chapter 429 of the Minnesota Statutes, held a public hearing
on August 15, 1977, to consider the construction of the followin
street improvements:
The improvement of First Street and Immanuel Avenue
by grading, installation of gravel base, bituminous
surface and bituminous curb and a short section of
storm sewer to carry run-off to the low area North
of the East end of First Street; and
WHEREAS, it appears to the City Council that it would be in
the best interests of the City and of the property adjacent to said
streets to proceed with the said improvements:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Lake Elmo as follows:
1. Such improvement is hereby ordered to the following extent
only: the said streets shall be improved to an urban design
standard as proposed in the Council Resolution dated August 3, 1977,
and as described in the City Engineer's report presented at said
public hearing; provided, however, the bituminous surfacing on said
streets shall be only 32 feet wide and shall be without curbs or turf
restoration.
2. Plans and specifications prepared by the city engineer for
such improvements, copy of which plans and specifications is
attached hereto and made a part hereof, are hereby approved and shall
be filed with the City Clerk.
3. The City Clerk shall prepare and cause to be inserted in the
official paper and in the Construction Bulletin an advertisement for
bids upon the making of such improvement under such approved plans
and specifications.
4. The advertisement shall be published as required by law.

proposed Aviation Chapter of the Metropolitan Development Guide;

WHEREAS, the City remains opposed to any expansion of the Lake
Elmo Airport facility.
NOW, THEREFORE, BE IT RESOLVED, by City Council, City of Lake
Elmo, that the City hereby approves of the Classification of the
Lake Elmo Airport as a Minor Airport; and,
THAT, The City opposes any further expansion of the Lake Elmo
Airport except to improve safety for the current traffic level; and,
THAT, The City is in basic agreement with the proposed Aviation
Chapter, insofar as it does not conflict with this Resolution; and,
THAT, The City expresses its concerns in the following areas:
a. Proper zoning to avoid and control the development of
incompatible uses and activities on or adjacent to the
land which constitutes the Lake Elmo Airport.
b. Controls for the altitude of planes in the area adjacent
to the Lake Elmo Airport so as to prevent safety hazards,
noise or other nuisances adversely affecting property
adjacent to the Airport.
C. Installation of an appropriate control tower or other safety
devices for current levels of traffic at the Lake Elmo
Airport.
BE IT FURTHER RESOLVED, That the City Clerk is hereby instructed

A RESOLUTION REQUESTING THE ESTABLISHMENT OF SPEED
ZONES IN CIMARRON
WHEREAS, the City Council of the City of Lake Elmo has received a
petition signed by over 100 residents of the Cimarron Mobile Home Park
requesting that the City Council, pursuant to Minnesota Statutes 169.14
(5), requests the Commissioner of Highways to determine a reasonable and
safe speed limit for the perimeter street in Cimarron, upon the basis of
an engineering and traffic investigation; and
WHEREAS, it appears to the City Council that a substantial question
has been raised as to the appropriateness of the present 10 mile per
hour speed limit; and
WHEREAS, the City Council has some question as to whether or not
the speed limit established by Section 327.27 of the Minnesota
Statutes is applicable to the streets in Cimarron:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lake Elmo that the Commissioner of Highways be, and he is hereby,
requested to determine a reasonable and safe speed limit for the
streets in Cimarron, upon the basis of an engineering and traffic
investigation, all as provided by Section 169.14 (5) of the Minnesota
Statutes.

RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
WHEREAS, the City Council of the City of Lake Elmo has considered
the problem of sewage treatment and disposal in the "Old Village" area
of the City of Lake Elmo and has considered the report of its City Engineer
and the report and recommendations of its sewer study committee with
respect to that problem; and
WHEREAS, the City Council has determined:
I. That there is a substantial sewage disposal problem in
that part of the City of Lake Elmo known as the "Old Village area"
by reason of the fact that there are many failing or inadequate
sewer systems which cannot be replaced or made adequate on -site
because of the size of the lots and/or the condition of the soil on
the lots in the Old Village area;
2. That this problem can be solved by the installation of an
adequate sewage collection system to serve the Old Village area;
3. That the installation of a collection system in the Old
Village area to meet the needs of existing dwellings and other proper-
ties at a reasonable COst, without undue burden on the land or resi-
dents within that area, would require the availability of a sewage
treatment facility with sufficient capacity to serve the area
tributary to the Old Village as described in the City Engineer's
Report an Old Village Area Sanitary Sewer Service for Lake Elmo,
Minnesota, 1977, (see figure 1, Page 7 of said Report) thereby,
spreading the cost of the system.
4. That such capacity appears to be available only through
Metropolitan facilities and/or grants-in-aid approved by the
Metropolitan Council for construction of a sewage treatment facility
for the said Old Village area of Lake Elmo or for expansion of the
existing Cimmarron plant for that purpose;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Lake Elmo as follows:
1. That the Metropolitan Council is hereby urged and requested
to revise the Metropolitan Systems Statement for the City of Lake
Elmo to reflect the fact that there is a need for Metropolitan
sewage treatment facilities to serve the area tributary to the Old
Village as described in said engineer's report (see figure 1,
Page 7, thereof);

2. That the said Metropolitan Systems Statement for the City
of Lake Elmo be revised to provide for the inclusion of said Old
Village area within the Urban Service Area of the Metropolitan
Planning Guide, either by a loop in that line extended easterly
to include said Old Village area or by a detached "bubble"
whichever is deemed most appropriate by the Metropolitan Council;
3. That any such Metropolitan sewer facilities made available
to serve the Old Village area that any such Metropolitan sewer
facility made available to serve the Old Village area or any sewer
facility constructed with such grants-in-aid, shall be planned,
staged and controlled so as to prevent the necessity of extending
urban services, prematurely, beyond the said area tributary to the
Old Village.
BE IT FURTHER RESOLVED, that the City Administrator, with the
assistance of the City Engineer and City Attorney, is hereby authorized
and directed to present this Resolution, together with such additional
materials as may be appropriate, to the Metropolitan Council for the
purpose of securing the revision or amendment of the Metropolitan
Systems Statement for the City of Lake Elmo as requested by this Resolution.
