Minutes of the Lake Elmo City Council Meeting, February 7, 1978. Meeting called to order at 7:33 p.m., by Mayor Armstrong. Present: Mayor Armstrong, Councilmen Pott, Morgan and Shervheim (7:38) and. Councilwoman Lyons-(7:38). Also present: Adm. Ass't. Whittaker, Bldg. Inspector Mueller and Counsel Raleigh. Minutes: Motion by Councilman Morgan 2nd by Councilman Pott to accept the minutes of the Council Meeting of January 17, 1978 as submitted. Carried.3-0. Councilman Shervheim and Councilwoman Lyons not present. Administrative Policy: Motion by Councilman Pott 2nd by Councilman Morgan to adopt the following as administrative Policy. The City Council will meet on the first and third Tuesday of each month. The meeting on the first Tuesday will. commence at 7:30 p.m. and adjourn at 10:30 p.m. The meeting on the third Tuesday will commence at 5:00 p.m; break for dinner from 6:30 to 7:30 p.m, and adjourn -at 10:30 p.m. The agenda will be prepared by the city office (deputy clerk and administrative assistant) within the scheduled time frame. Only that portion between 5:00 and 6:30p.m. dh the Third Tuesday will be reserved. This period is exclusively for; A. Determining general direction for those groups advisory to the council (fire dept., Park Advisory Committee, Planning. -Zoning Committee, Sewer Committee, Assessment Committee, Police Committee or other committees that the council may appoint), and R. Meetings of the sub- committees of the council ( Animal Control, Public Safety, Roads, Building, Water and Sewer or other). At the beginning of each meeting the council will review and accept the agenda for that meeting. A regularly scheduled break of 5-10 minutes is to be in- cluded in the agenda after l 1/2 hours of continuous meet- ing. Any change to the adopted policy, -for and partiaallar meet- ing, must be a motion approved by a majority of the council members present at that meeting. Carried 5-0. Jerry Courselle--Senior in Architectural Engineering at U. of Minn. Suggested the use of the old village of Lake Elmo as a subject for his thesis. Council was receptive to ideas presented. Motion by Councilman Pott 2nd by Councilman Morgan to encourage the project and support it by picking up any expenses incurred up to $300.00. Carried 5-0. Iiome 443 Ashland -St. Paul 222-1948 School 376-3684 Richard Johnson: Councilman Shervheim offered Resolution R78-11 commend- ing Mr. Richard Johnson for his service to the city as a member of the PZC and asked for council confirmationa< Second by Mayor Armstrong. Carried 5-0. Minutes of the Lake Elmo City Council Meeting,February 7, 1978 -pg. 2 Minutesi- January 30, 1978e, Councilman Pott advised that the motion on repair of grader was omitted, it should be added. Motion by Councilman Shervheim 2nd by Councilman Pott to approve expenses of up to $3,500. for repair of grader. Carried 3-0. (Mayor Armstrong and Councilman Morgan were,,, -absent). Motion to approve minutes of January 30, 1978 special meeting of the council as amended, made by Councilman Shervheim 2nd by Councilwoman Lyons. Carried. 3-0. Mayor Armstrong and Councilman Morgan abstained. Speed Zones: Report from the Mn.Highway Dept, that our request for reduced speeds on Ideal Ave. N. were reviewed and the following changes made: Hwy. 212 to Hidden Flay Trail reduced to 45 mph. Hidden Bay Road to Cty. Hwy. 68 to 35 mph and Cty. Hwy. 68 to Hwy. 36, 30mph. The area South of 212 set at 35 mph. The 30 mph zone on Lake ElmoAve. No., had been moved a slight distance South of the Lohmann access road however sign is not strategically located. Clerk has requested Washington Cty. Hwy. Dept. to consider moving zone (sign) south of the curve so it is plainly visible. The request for speed zone study in Cimarron has been presented to the Attorney Generals office and we are awaiting a decision. Traffic sign: Clerk instructed to contact Washington County Hwy. Dept. and request a blind approach sign on Demontreville''Rad prior to the Hilltop access road. Claims: Motion by Councilman Shervheim 2nd by Mayor to approve payment of claims 78058 thru 78110. Carried 5-0. Polices Received a communification from Duane Spoors.indicnting that the 1978 proposed contract for police protection will cost the City of Lake Elmo $24,884 (estimated). The final cost for 1977 was $37,419, $1,1667 over original estimate, Meeting to discuss contract sbadduled for 7;00 p.m. Fob. 9, 1978 in the Board Room of the Washing- ton County Co6rthouse, N. 0. tyall,.D. Morgan and L. Whittaker will probably attend for the City of Lake Elmo. August Construction: Minor subdivision —Lots 5 and 6 Demontreville Highlands 2nd Addition --House incorrectly placed on lot 5. August Construction has purchased lot 6 and is requesting a subdivision. Both lots will be in excess of the required acre size. Motion by Councilman Pott 2nd by Councilman Shervheim to approve minor subdivision of lots 5 and 6, Demontre- ville Highlands 2nd Addition (see certificate of survey on file in city office for special details). Carried 5-0. Noreen Variance: Motion by Councilman Shervheim 2nd by Councilman Pott to approve variance to a 20 ft. setback from Highland Trail No „ rather than required 301. Carried 5-0. R-78-t q CITY Or LAKE ELMO WASHINGTON COUNTY* MINNESOTA A Resolution Usteblishing Water Service Mates from Mad after January 1, 1978. WHEREAS, Section 601.080 of the Labe Elmo Municipal Code provides that the City Council shrill establish rates for water service by Resolution) and WHE:RBAS, it appears that it is necessary and proper to establish new rates for water service in the City of Lake Elmo In order to reimburse the City for the, cost of providing that service and to encourage conservation of water' and WHEREAS, the City council has determined that the following rates shall achieve those purposes: 14", 7.H RE)FORB, SL IT RESOLVED, by the City Council of the -.City of Lake .Elmo that from and after January 1, 1978, each user Shall be charged a "fixed expense charge" of $5.0o per quarter plus 3.40 (40 cents) for each thousand gallons of water used; provided, however, the minimum charge per quartor shall be 17.50. From and after January 1, 1979, each user shall be charged a "fixed expense charge" of $5.00 per quarter plus $.Go (60ccents) for each thousand gallons of water used; provided, however, the minimum charge per quarter shall be $7.50. Carried 5-0. Drainfields: Motion by Mayor Armstrong 2nd by Councilman Pott to approve Ordinance 7415 dated February 7, 1978 establishing 300 sq. ft. as the minimum drain field size in the City of Lake Elmo. Carried 5-0. John Arendt: Motion by Councilwoman Lyons offered Resolution R78-10, A Resolution Granting Special Use Permit to John Arendt and asked for council approval. Zhd. by Councilman Pott. Carried 5-0. Steve Mattson --Duran & Moody: Mr. Mattson explained the procedure of financing improvements for a developer. The cities interest, if any, would be the profit it might make on the project. A brief analysis of profit showed a figure of only a couple hundred dollars per year vs. almost comparable handling costs. Mr. Mattson offerdd his services if city wanted to pursue this or any financial project. Myra bbeck-.-Marilyn King: These ladies advised that an article was re- cently published stating that M. George was offering an item for special. state legislation increasing the size of the Washington County Board from 5 to 7 members. Indications are that this matter had not been presented to any of the Washington County Commi�nitdesifor Support or non-support. Council will consider possible action at the February 21,.1978.kneeting. Building Inspector: Motion by Councilman Shervheim 2nd by Councilman:Pott to authorize following expense for building inspector to attend meeting February .17,.1978.at Hastings;.$10.00 mileage plus reimbursement for I day lost salary.
