MINUTES-LARE ELMO CITY COUNCIL MEETING, OCTOBER 3, 1978. Meeting called to order at 7:30 p.m., by Mayor Armstrong. Present: Mayor Armstrong, CouncilwomanLyonsand Councilmen Pott, �J Morgan and Shervheim Agenda: Include pumping water at 8:30 p,m. Motion by Mayor Armstrong 2nd by Councilman Morgan to approve agenda as amended. Carried 5-0. Schwartz Variance: Sewer Inspector Wier presentee) the facts. As it now stands they are requesting a variance to permit the septic system 60' rather than 75' from the high flood. Bottom of the drainfield would be 891.8 and top of the bed 894.8. Based on the lot and house as they now stand, Mr. Wier stated he felt this was the best possible system. Motion by Councilman Pott 2nd by Councilmw, Shervheim to approve variance to install septic system O ft. rather than 75 ft. from high flood.on lot at 3141 Klon4ike.Ave... A letter should also be sent to ANR for approval (they have 30 days to respond). 1DNR should Also be asked to resolve definition of backwater a,s-it-relates to lake...Why is,,backwater different than lake when two are connected. Carried 5-0. Mrs. Sol Fisher: Felt she was being double charged, $30.00 for the SUP and $4.00 each for licenses for her 8 dogs. It was explained th4t the $30.00 fee was the initial fee and renewal would be $5.00 per year. Motion by Councilman Morgan 2nd by Mayor Armstrong to draft a resolution establishing a third category of dog licenses for kennel confined dogs. They will be rated at the lower neutered dog rate. Carried 5-0 Question raised relative to retention of kennel sign. Motion by Councilman Shervheim 2nd by Councilman Pott to delete the reference to signs in the SU agreement. Carried 5-0. Assessment Levy: Administrative Assistant and Clerk reviewed all the parcels in assessment area and came up with total number of parcels, byowner not by -plate number, in the affected area. The amount of each assessment was adjusted so as to include all of the assessmentis over the total number of parcels. *Copy of formula and revised assessment roll attached. Councilman Morgan offered Resolution R78-38, a Resolution approving the new assessment role for the 1976 Flood Assess- ment, and asked for council approval. Second by Councilman Shervheim. Council Meeting Nov. 7: This meeting conflicts with the election.. Since council has to meet within days after the election to canvas the election, it was suggested that the first meeting in November be rescheduled for Nov. 8, 1978. Motion by Mayor Armstrong, 2nd by Councilman Shervheim to reschedule the November 7 regular council meeting to Wednesday, November 8, 1978 at 7:30 p.m., in the council chambers. Carried 5-0. 194-Engineer Report: Councilman Pott offered Resolution:R78*-39, a Resolution Approving Plans for 194 (So Called Southern Route) Subject to Certain Conditions and Accepting Ownership and Maintenance Responsibility for Frontage Roads and Bicycle Trails. 2nd® by Councilmanr Shervhei.m. Carried 4-0. Mayor Armstrong abstained not because he objected to the.Southern Route.but.because he objected to,reservations in the•Res6lution. Tartan Park Drainage: 3M-Tartan Park has -proposed installation of a 24" culvert between 10th. and llth, fairway. A control device will.be installed to regulate flow or storage. DNR has given intent to approve if they get approval. from the affected units of government. Motion by Mayor Armstrong 2nd by Councilman Shervheim_ to approve Tartan Park culvert installation per sub- mitted .specs. Carried 5-0. 208 Sewer Alternatives: Engineer and-Adm. Ass't/--)lave not been able to meet with proper MWC and-PCA'offioials to determine grant availability. Tentative meeting dates are 10/16 10/17/78 which should enable council to discuss sewer options for old village area. Water pumping: Source of water to.pump is not adequate to keep the pump flowing. A trench from-deoper water`to pump area is necessary. Current level is 921.9 permit allows us to coo to 921. Pumping will be stopped for 2 days to allow water to build up and allow crew to complete other duties.. Method of opening trench not resolved. 37022-3750: The subject parcel, 50'x2971, was -acquired by the city on a tax delinquency basis. Request has been received to purchase this parcel so adjacent owner can combine and make 1, 2001x2971 lot. Park Committee indicated no interest in this parcel.. ;Mayor Armstrong offered Resolution R78-40', A Resolution Releasing lot identified as 37022-3750 to Washington County, indicating city has no need for this property for public purpose and authorize said county to dispose of property. This could have con- siderable affect on Lake Elmo and other communities. Mr. Whittaker to write MWC»Metro Council requesting an extension to allow us to further consider proposal copy of letter to council. Administrator Ordinance: Council requested time to review, will take action at Council Meeting, 10/17/78. Liquor Licenses: Counsel Marshall advised that Lake Elmo as a community of over 5000 population is entitled to 6 on sale licenses. Currently city has 4 On Sale, one of which can be considered as a club license and is not counted against quota. Off sale licenses are not limited. Dog Catcher: Councilman Shervheim offered Resblution R78�-41 continuing the Lake Elmo -Oakdale dog catcher contract for an indefinite term. Second by Mayor Armstrong. Carried 540. Administrator transition: Since Mr. Whittaker Will have added`responsi- bility, because of clerks resignation, for balance of year council on a motion by Councilman Shervheim 2nd by Mayor Armstrong approved secretary assistance. Carried 5-0. Deputy Clerk: Motion by Councilman Shervheim 2nd by Mayor Armstrong to appoint Marilyn Banister Deputy Clerk with authority to sign checks for the city. Carried 5-0. LAKE ELMO REVISES ASSESSMENTS AFTER FLOOD OF COMPLAINTS i The final hearing on assessments for 1976 flood control brought out a flood of those complaints from property owners who said the formula penalizedVwith small acreage on many lots. So, the Lake Elmo City Council instructed. the City staff. -to re- combine continguous lots for assessment purposee; and prepare a revised roster for action on October 3, 1978. The "formula" has two factors parcel size and. imperviousness (the degree to which a parcel "sheds" water). All parcels fall into rangest 0.5 acres to 2.5 acres, 2.5 acres to 10 acres, etc. However, any parcel less than 0.5 acres was assessed a minimum amount. And, owners of several small parcels were as- sessed the "minimum" several times - even if the total area they own fit into a lower range than several "minimum" lots might add. up to. The new assessment roster treats these many small parcels, which are under one ownership and.are a continguous part of one piece of property, as one parcel for purposes of assigning the "minimum" assessment. It reveals that there are only 11.71 properties to be assessed; and, using the formula, just 772.660 assess- ment units.; The effect of this adjustment is to increase the cost per assessment unit from $28.4.1 per unit to $33.61 per. unit. In other words, the total cost of the project remains the same; but, the shares of the cost are more fairly dis- tributed.. With these new numbers, a person with one acre of undeveloped property will pay $42.01. A person with a developed one -acre site will pay $63.52. Previously, a person with, say, three parcels that equal one acre would have paid, three "minimums"; which equaled $85.23 for undeveloped land. All property owners with standard, parcels will now, of course, pay a slightly higher assessment, as the cost is divided. over fewer total parcels. The assessment for that same one -acre parcel will go from $53„69 to $63,52 for developed land. Revised. Flood Assessment, page two The City, in computing the revised assessments, had to re-evaluate 217 parcels and redistribute the cost to all 471 new parcels. They hope this effort will result in a more equitable distribution of the cost for providing this emergency service, The City has also petitioned. the County to recombine these parcels permanently; so that these types of adjustments will not have to be made for every assessment in the future.
