Mayor Armstrong convened the meeting at 7:30 p.m., with the following Councillors answering the roll: Johnson, Morgan, Mottaz and Pott. Also present: Administrator Whittaker., Attorney Marshall. OATH OF OPPICB: The City Administrator administered the oath of office to Mayor -elect Thomas G„ Armstrong; and Councillors - elect Michael R. Johnson and Jess Mottaz. AGENDA: Armstrong moved, seconded by Morgan, to approve the Agenda with the following amendments: move I-94 lawsuit in after Ar,nda%approval; add claims and State highway aid resolution after Administrator's report; add Council reports after Mayors report, Motion carried 5-0. I-94 CHALLENGE COMMITTEE/LAWSUIT: Mottaz moved, seconded by Armstrong that the Council adopt Resolution 79-1 "A Resolution withdrawing Lake Elmo from the I-94 Challenge Committee Joint Powers Agreement and Lawsuit and calling for con- struction of I-94 on the "Southern Route". In discussion, Pott asked the proponents how the City would best be served by the Southern -Route; and said the words "'senseless and wasteful" troubled him. Armstrong said the northern route would take good farm land, open up land for development, create a dangerous curve at Crossroads Ford, and have a negative effect on the rural character of the community. Pott disagreed. Mottaz said the City did not need another super highway through. the City; that the south- ern route would confine development to an existing corridor; and that it would eliminate the need for the County to maintain two four -lane divided highways as service roads. Pott said the cost of maintaining those two roads would be less than building on the southern route. The Council. discussed the relative costs ofithe two routes. Hugh Madson and Councillor Johnson expressed their interest in having a better definition of "sense- less, wasteful and pointless; and felt the Resolution ought to better state the reasons for this change in City policy. Mottaz called the question. Vote: In favor: Armstrong, Morgan, Mottaz; Opposed: Johnson and Pott. Carried 3-2. NATIONAL JAYCEE WEEK: Jerome Bergmark asked the Council to consider a Proclamation for National Jaycee Week. Armstrong moved, seconded by Morgan, that the City Proclaim the week of January 21 through 27, 1979, as Jaycee Week and urge all citizens of our community to give full regard to the past community services of the Lake Elmo Jaycees. Motion carried 5-0. MINUTES, LARE ELMO CITY COUNCIL, January 2, 1979. Pg. 2 MINUTES: Morgan moved, seconded by Armstrong, to approve the minutes of the, December 19, 1978, City Council meeting. Motion carried 3-0--2, with Councillors Johnson and Mottaz abstaining, as they .were not in office at the time of this meeting. FRED BANISTER MINOR SUBDIVISION: Mayor Armstrong read the recommendation of the Planning Commission; and the Council discussed alternative ways of..meeting the P7.0 conditions. Armstrong moved, seconded by Pott, that plan for subdivision of. the Banister property dated January 2, 1979, with the follow- ing Variances; no public access to Lot 1, acceptance of the existing setback'£or the building on Lot 2, Lot 3 is slightly under one acre; subject to the owners entering into an agreement to maintain a perpetual easement for driveway access, to be recorded against all the property involved in the use of the'dr.:iveway access and covering maintenance and improvement of the said access; and subject to the owners providing a Certificate of Survey to the City and the County Surveyor. Said agreement to be approved by the City Attorney. Motion Carried 5-0, PETER SCHILTGEN/REID FARM DRAINAGE EASEMENT: Peter Schiltgen appeared before the Council representing Mrs. Reid, owner and him- self, tenant, of the property just east of Lake Elmo Ilardwood Lumber, to discuss alternative ways to main- taining the drainage -way through.that: property. After some discussion, Mr. Schiltgen agreed to plow a dead furrow along the present drainage way to maintain the channel; and improve the channel along the west edge of the property so that water can get to the drainage -way; and the Council agreed to stop proceedings to acquire a formal drainage easement to preserve this natural drainage -way. The Council also instructed the Building Inspector to inspect debris deposited on the Reid property by Lake Elmo Hardwoad Lumber; at Mr. Schiltgen's request. The Mayor and City Attorney were asked to check into a possible guardianship for Mrs. Reid. ANNUAL APPOINTMENTS: Morgan moved, seconded by Johnson, to name the State Ba - re Elmer.. W—ash—ngtov�ederal as official depositories. Motion carried 5-0. Mottaz moved, seconded by Morgan, to name the Stillwater Daily Gazette as official newspaper. Potion carried 5-0. Armstrong moved, seconded by Pott, to reappoint. Earl Cberss the Energy Coordinator.. Motion carried 5-0. Armstrong moved, seconded by Pott, to appoint. Robert Dreher, Howard;Michels and Nancy Prince to thneee year terms on the Planning Commission. Motion carried 5-0. The Council instructed the Adminstrator to set up inter- views for an alternate member of the PAC. MINUTES, Lake Elmo City Council, January 2, 1979 Pg. 3 Annual. Appointments---cont'd. Armstrong moved, seconded by Morgan, to appoint Leo Gehlhoff to a one- year term on the Park Commission, Motion carried 5-0. Armstrong moved, seconded by Morgan, that the Council accept the recommen- dation of the Park Commission for appointments to the Commission. Motion carried 5-0. The following terms are hereby established. Bill Osborn ----- 3 years Ed Nielsen --- 2 years Tom Monette ----- 3 years Sue Dunn ----- 9 years Diane Trudeau --- 3 years Peter Werner-1 year Dave Morgan ----- 2 years Al Martens---1 year Morgan moved, seconded by Armstrong; that Elmer Richert and Bob Wier assistant weed inspectors. Motion carried 5-0. Morgan moved, seconded by Armstrong, that Fran Pott be appointed the acting Mayor, to preside when the Mayor is not present and assume all his responsibilities when the Mayor cannot serve. Motion carried 5-0. Mottaz moved, seconded by Pott, to reappoint Lawson, Raleigh and Marshall as City Attorney. In discussion, Morgan indicated he believed the f'itm should defer to another law firm when matters concerning members of the firm or their clients come before the Council, And, the Council instructed the Administrator to advise the Attorney when they need attend Council meetings. Motion carried 4-0--1. Armstrong abstained. Johnson moved, seconded by Pott, to appoint Bonestroo, Rosene, Anderlik & Associates, Inc. interim City Engineer until the prospective Engineer can be interviewed and appointed. Motion carried 5-0. ADMINISTRATOR°S REPORT: Whittaker advised the Council that bids for insurance and the truck would be ready for Council re- view January 16, 1979. POTT moved, seconded by Morgan, to authorize the Administrator to dispose of th surplus copier at the most favorable bid over. $300.00. Motion carried 5-0. CLAIMS: Morgan moved, seconded by Armstrong, to approve.Claims No, 78916 through 78939. Motion carried 5-0. Armstrong moved, seconded by Morgan that claim No. 78940. Motion carried 5-0. RESOLUTION 79-2: X.RESOLUTION ESTABLISHING MUNICIPAL STATE AID HIGhWAYS. Armstrong moved, seconded by Morgan, to adapt Resolution 79-2, "A Resolution establishing Municipal state Aid Highways." Motion carried 5-0. MINUTES, Lake Elmo City Council, January 2, 1979. pg. 4 MAYOR*'S REPORT; Armstrong reported the Metro Council is holding a meet- ing January 15, 1979, to discuss reservations communities along the I-94 corridor had about the plans for the Southern Rou.te:and--the frontage :roads. He suggested extra meetings to complete work on the Comprehensive Plan and the reviled zoning Ordinance. - MORATORIUM ON ZONING, SUBDIVISION: Armstrong moved,.seconded by Mottaz, that.the.Planning Commission be directed to consider a moratorium on zoning and subdivision of not longer than - six (6) months; hold a hearing on the proposed moratorium; all 4 1,ven that the City will set -a' goal- to, have -the Plann- . ing Commission,recommendations on -the zoninq ordinance and Comprehensive Plan map by the first meeting in June, 1979. In discussion, Pott said the schedule for the work to be done while a moratorium is in effect must be an integral part of any such action. Motion carried 5-0. COUNCIL BY-LAWS: Pott.moved, seconded.by Armstrong, to readopt the By-laws of the previous Council as the operatihq policy of this Council. Motion carried 5-0. ( A copy is attached to these minutes and hereby made a part'of the minutes.) COUNCIL REPORTS: Pott asked the Council to schedule the Fire Department for the January 16 meeting to discuss space requirements. The Council agreed. Morgan moved, seconded by Armstrong, to adopt RESOLUTION 79-3, "A Resolu- tion Commending Dale ruerstenberg and Gary Swanson for their fine service to the City as law enforcement officers.'I Motion carried 5-0. Copies are to be sent to retiring Sheriff':Westphal and Sheriff• Trudeau. The Council discussed a year, -around access to Lake Demontreville. The Council instructed the Administrator to inquire into the purchase of dictating equipment that could also serve as a recorder for. Council meet- ings. Morgan asked the Council to think about a future surface water drainage ( plan; and a petition to Valley Branch requesting the Board handle the I water coming into the City. i Ile also asked the Council to reconsider his proposal for a Council Advisory Committee.
