HomeMy WebLinkAbout06-26-79 Special CCMMinutes of the Lake Elmo City Council; Special Meet1mg; June 26, 1979 The meeting was delayed for lack of quorum until 5:58 p.m. Mayor -Armstrong convened the meeting at 5:58 p.m. with the following Councillors presente Pott and Mottaz. Morgan and Johnson had been excused. Administrator Whittaker and Engineer Bohrer were also present. PARK SHELTER BIDS The Council reviewed the bid of Herb Larson Construction Co, Rte. 3, Box 128A, North Branch, MN. for construction of a ParkShelterin Lions Park. They also reviewed the City Engineer's recommendation. Mottaz moved, seconded by Armstrong, to reject the bid because the bid was incomplete and because the bid exceeded the estimated cost.by more than 25 percent. Motion carried 3-0. Administrator is to advise bidder and return bid bond to Larson. The Council will consider readvertising and LAWCON funding.. FLOOD PLAIN MANAGEMENT ORDINANCES The Administrator explained the Ordinance briefly; and pointed out several minor changes requested by the StateDepartmentof Natural Resources. He explained that one ordinance amended the Zoning Code, one the Subdivision Code, and one tba obile,Home Code. Armstrong moved, seconded by Pott, the the City Council adopt Ordinances 7802, 7803, and 7804, amending the Subdivision, Mobile Home,.and Zoning Oranances to provide for Flood Plain Management which meets State and Federal guidelines. Motion carried 3-0. The Ordinances become effective upon their publication in the legal newspaper. MOTTAZ MINOR SUBDIVISION, Moratorium Appeal Mr. Mottaz addressed the questions and concerns raised by the Planning Commission. He said the Commission cannot assume "frontage" is only on roads that one also .has access from or to. It simply means frontage on a public street. He said the lot has an approved spetic system and well; and is, therefore, buildable. And, as a result of the City Attorney's opinion, approved by the City Council, there is no violation of City Ordinances — regarding the mobile home on the lot. He also indicated it is sold; and will be removed. He indicated both lots, after subdivision, will have 300 feet of frontage as he owns part of a street right—of—way on the remaining lot which brings the total frontage of that lot over 300 feet. He did not discuss the hardship; and asked the Council to take no action at this time. He said he wanted the Planning Commission advised of his comments. Mr. Pott indicated he felt all appeals to the moratorium ought to be granted. The Council took no action, referred it back to the Planning Commission; and asked that it be considered July 17, 1979• Herb Larson: Mr. Larson appeared; and the Mayor explained what had happened on the bids for the Park Shelter. MINUTES, Lake Elmo City Council; June 26, 1979 page two LAWCON APPLICATIONS Mr. Whittaker explained that LAWCON funds were not available for planning a park unless the grant covered development of the park also. The Park Commission had considered planning in Reid Park. The Council discussed application for funds to build the Park Shelter. Pott moved, seconded by Armstrong, that the City apply for LAWCON/LCMR funds to construct the shelter in Lions Park. Motion carried 3-0. CIVIL DEFENSE LICENSES The Mayor read a letter from a Cimarron resident complaining about the lack of shelters in that area; and requesting the Oak —Land School be opened for shelter. Mottaz said the City should, perhaps, require shelters in future mobile home parks. Pott suggested Don Mehsikomer might consider serving the City as Civil Defense Director. The Council instructed Whittaker to contact Mehsikomer; and, if he agrees to take the position, ask him to work with the residents of Cimarron and Oak —Land School. Armstrong moved, seconded by Mottaz, that the City grant the following licenses: general Contracting License GC-79-.1 for Vanman Construction Co. 258 Humboldt Ave., So., Mpls., Minn. and Heating Installer License H79-8 for Cool Air Mechanical, Inc. of 1441 Rice St., St. Paul, Minn. 55117 Motion carried 3-0. PEBBLE PARK, TENNIS COURT LIGHTS Pott moved, seconded by Armstrong, that the City pay Lightning Electric for installation of lights in Pebble Park, withholding 10%until the :Engineer and the Park Commission have approved the installation. Motion carried 3-0- PARKING ON 50TH STREET The Council agreed that the original resolution on parking indicated the City would post a "No Parking" zone on the south side of 50th street near Lake Olsen. However, the pavement is so narrow.,and the right —or — way is almost all under water; the Council agreed it should look into .restricting parking on both sides of the street. Mottaz pointed out, however, that the street right—of—way became too narrow going east to permit parking there; and that only a few cars would be able to park west of the lake. He also said he feels the public ought to have a right to fish off the street, even though there is no public access at this point. After much discussion, the Council decided to discuss the matter at a later meeting. MAINTENANCE BUILDING Mr. Pott said he was concerned about the architects fee. Mr. Mottaz said he would prefer a totally earth—she14ered building. Previous Council action was not changed. MINUTES, Lake Elmo City Council; June 26, 1979 page three TARTAN PARK The Council instructed the Administrator to write to the Valley Branch Watershed District expressing its,dsiretto see some action on the 3M plan for surface water improvements from Lake Elmo to West Lakeland. PROJECT 1005 The Council instructed the Administrator to write a letter advising the Valley Branch Watershed District of the City's costs from June 7, 1979, to the present; the daily rate for continued pumping; the elevation to which the City will pump into the park pond; that the City would not expect to pump beyond the 90 day lease it has for the pipe and pump; and requesting a calendar for the transition from a City run project to a District project. SURFACE WATER RUN—OFF, non —subdivision commercial property The Council instructed the Administrator to research Ordinances that control the amount of surface water run—off from commercial buildings when those buildings are not a part of a subdivision plan. Pott moved, seconded by Mottaz, that the meeting adjourn at 6;58 p.m. adjourned.
