HomeMy WebLinkAbout04-15-80 CCMCITY OF LAKE ELMO CITY COUNCIL MEETING, APRIL 15, 1980 In the absence of Mayor Armstrong, Councilman Pott convened the meeting at j•:0$ p.m. with Councillors Morgan. and Novak present. Administrator Whittaker also present. Mottaz (5:12) and Armstrong (5:45) AGENDA: Whittaker request the Council add an addition interview for the Planning Commission, schedule a hearing on the.Deneen Variance and add the following to the Administrator's Report: two additional Licenses, the Sign Ordinance, the Energy Coordinator, the 'question of a Church on the Lundquist Property at Co. 17 & Hwy. 36, and the State Conference. Pott requested the Council add the CB Radios under Council Reports. Morgan moved, seconded by Novak to approve the agenda as amended. Motion carried 3-0. MINUTES: Novak moved, seconded by Morgan, to approve the minutes of the April 1, 1980, City Council meeting with the following corrections: Paragraph E, page 6, the motion should read to adopt Ordinance 7909; under Paragraph F it should indicate that these taxes will be abated from 1973 on. Motion carried 4-0. Councillor Mottaz arrived at 5:12 p.m. CLAIMS: Morgan moved, seconded by Mottaz to approve Claims 80172 thru 80228. Motion carried 4-0. BACKHOE BIDS: The Council reviewed all the bids and discussed the options and decided the extend —a —hoe was a good investment in light of the bids. Mottaz moved, seconded by Novak, to accept the bid from Carlson Tractor and Equipment for a 1979, Ford 555, with extend —a —hoe, for $21,238 with a one year warranty. Motion carried 4-0. Mayor Armstrong arrived at 5:45 CABLE TV: Don Raleigh explained the service areas around Lake Elmo. He said because of Lake Elmo's sparse population only a portion of the City could be serviced within the next three to four years. He advised the Council that before making, any decision on Cable TV they should request a representative of the Minnesota Cable Board come out and explain the options. The Council agreed. The Administrator will send a letter to White Bear Lake stating Lake Elmo is not interested in joining any cable service area at this time. BROCKMAN ADDITION DITCH: Don Raleigh, Kelly Brockman, Larry Bohrer, and Larry Whittaker met to discuss solving the drainage ditch problem along Highway 5 (212). All agreed the ditch should be constructed. The Brookman developers will contact Mn/DOT and request they do the work ( the State has done all the surrounding ditch work in this area). If Mn/DOT will not do the ditching the developers will take responsibility. Any assistance the City can offer to encourage Mn/DOT to complete this work will be appreciated. Mr. Raleigh also stated when the City develops a Surface Water Plan, they expect this r work to be recognized as a contribution against any assessment. VALLEY BRANCH WATERSHED DISTRICT PETITION 1006: Councilman Pott restated his opposition to vote on any petition to the Watershed District. Councilman Pott left the meeting at 5:50 p.m. Armstrong briefly explained the project and stated Valley Branch has assured the petitioners no more than $30,000 will be spent to determine if this project will be, cost effective. LAKE ELMO CITY COUNCIL MEETING, APRIL 15, 1980 —2— VALLEY BRANCH WATERSHED — PROJECT 1006: Lake Elmo's share will be $6,000, Valley Branch Watershed District — $6,000, Washington County — $9;000, / West Lakeland — $3,000, and 3m - $6,000. Mottaz moved, seconded by Armstrong, to have Lake Elmo join the petition for Project 1006, with West Lakeland, A Washington County, and Valley Branch Watershed District, for an amount not to exceed $6,000 for Lake Elmo's share. Motion carried 3-0-1, with Morgan abstaining. Before Morgan would reconsider voting for a petition, he would like to see Valley Branch Watershed District put more effort into preventing water throughout the watershed from coming into Lake Elmo; also, some proposals projecting how potential water problems can be resolved if and when they arise. Armstrong urged Valley Branch to consider wetland storage areas and promote informing residents these areas can be removed from the tax rolls if they are retained as such. Also, all petitioners to be consulted prior to Valley Branchs° determining a method of assessment. Pott returned at 6:15 p.m. Novak would like to see Valley Branch execute their philosophy, by studying and, when possible, acquiring potential storage areas; so when the need arises, preliminary information is available. COUNCIL REPORTS: A. Park Rentals — The Council will consider the revised rate schedule at the next meeting. B. Tennis Courts and Park Shelter — These specs are now out for bid. C. Sunfish Park Gate — Morgan recommended the City negotiate with Mr. Ringwalski to continue the opening and closing of Sunfish Park gate. Morgan will talk with him. The Council had no objection. D. Seeler Property — The Administrator will call Mr. Seeler and see what the status of the land purchase is. E. CB Radios — Bids taken on the CB Radios were deemed void due to FCC Regulations on selling 23 channel equipment. New bids were secured on the salable units. Mottaz moved, seconded by Armstrong, to accept the high bid of $51.50 for the CB Radios. Motion carried 5-0. AG PRESERVE BILL: Armstrong reported this bill has been signed into law. The Administrator has contacted Representative Levi for a copy of the bill. PLANNING COMMISSION APPOINTMENT: The Council interviewed Mr. Dick Hesse and Mr. Leroy Forsblad. Birger Olson and Scotty Lyle will be interviewed at the next Council meeting. All candidates will be sent an application form and be interviewed before the Council makes a decision. Mr. Forsblad requested the Council install a weather warning siren at Cimarron. The Council took this under advisement. PUBLIC INQUIRIES: A. Dan Collyard — Legion Pond — Dan Collyard, resident on Legion Avenue N., asked the Council what progress has been made towards diminishing the flooding on Legion Pond. Several septic systems are threatened. LAKE ELMO CITY COUNCIL MEETING, APRIL 15, 1980 —3— Legion Pond — The Council said that a feasibility study will be necessary before any action to alleviate the problem can be taken. The cost of such a study would have to be paid for by Legion Avenue residents.- Mr. Collyard indicated this would be agreeable. Armstrong said.the City sent several residents notice in 1976, to relocate their septic systems�•beoause of the water problem. Mr. Collyard said due to the tccgqtal saturation of the ground this would not solve their current probl6,ms. Collyard's attorney would like on record whether or not the City plans to solve this problem. Armstrong said any improvement would be done on the basis of assessing property owners in that area; and, presently the City has no short term solution. Residents would have to request such an improvement. MrV Collyard requested the City consider pumpin4 such as was done on Lake Jane. Armstrong moved, seconded by Morgan, to authorize the Engineer to survey the problem on Legion Pond, and see if there is a visible solution; and, if not, prepare a cost estimate for an improvement project. Motion carried 5-0. B. Roger Meyer — Purchase of City Pro ert — The Meyers agreed to grant an easement for an ft. walking path from Lake Elmo Avenue to the City parking lot, provided the City remove the condition to share in any profit over $65,000 within the next five years. Mottaz moved, seconded by Pott, to sell the old "Down Halle site to Meyer Merchantile, for $3,500 plus costs. The profit—sharing condition will be deleted in lieu of an 8 ft. wide pedestrain walkway from Lake Elmo Avenue to the City parking lot. The walkway will be placed on the south edge of the property or otherwise located by mutual agreement of the City and Meyers. Motion carried 5-0. PLANNING COMMISSION REPORTS: A. Amend Section tL.. OV1�y - The Council reviewed the Planning.Commission recommendation to approve this amendment. Pott expressed concern that there are no controls on buildings or use in areas over 20A. The Council agreed to amend the Zoning Ordinance as recommended by the Planning Commission with a building in Ag being limited to an agricultural building and agricultural use. B. Amend Section 301.090B - Grandfather in lA lots platted before October 16, 1979 - The Council agreed with the Planning Commission recommendation to amend the Zoning Ordinance to include this provision. C. Amend Section 301.130, Zoning Ordinance, Restricting Mobile Homes for Non -Residential Use - The Council agreed with the Planning Commission recommendation to amend the Zoning Ordinance and include this provision. The Council instructed the Administrator to draft Ordinance 7910 amending the City Code as follows: Section 301.1300, Limiting the Number of Accessory Buildings, r Section 301.090B, Grandfathering in lA lots platted before October 16, 1979 \_ Section 301.130 and Section 402.010, Restricting Mobile Homes for Non -Residential Use. D. LAKE ELMO CITY COUNCIL MEETING, APRIL 15, 1980 -4- D.- Co..Road 15 - Mottaz did not see any need to.include this now since e a. y as no road plan. The Council discussed County 13, Keats_ Avenue,, and County 15 as future collector streets. Pott moved, seconded -by Novak9 to adopt Resolution R-80-24, incorporating proposed County 15 into the Major Element of Trans- portation System of the Comprehensive Plan. Motion carried 4-1. Armstrong moved, seconded by Morgan to adopt Resolution 80-21, granting a permanent drainage easement to Washington County to reconstruct County Road 6. Motion carried 5-0. C. DeMontreville Lake Access Hearing - Morgan moved, seconded by Armstrong, to set a hearing May 6, 8:30 p.m. on the Lake DeMontreville Access. Motion carried 5-0. D. Variance for Steven Larson - Armstrong moved, seconded by Morgan, to set a hearing for Steven Larson, variance request, for May 6, 8:15 P.M. Motion carried 5-0. E. Authorize League of Minnesota Cities to apply for Temporary Data Classification - The Administrator reviewed the League memo with the Council and explained the necessity for this action. Morgan moved, seconded by Mottaz, to adopt Resolution 80-22, authorizing the League of Minnesota Cities to apply for a Temporary Data Classification for Lake Elmo. Motion carried 5-0. E. Responsible Authority - Data Practices Act - Mottaz moved, seconded by Morgan, to adopt Resolution 80-23, appointing Laurence E. Whittaker, City Administrator, the Responsible Authority per Data Practices Act. Motion carried 5-0. C. May 6 CitZ Council Meeti - Armstrong moved, seconded by Morgan, to start the May 6 Council meeting at 6:30 p.m. with no dinner break. Motion carried 5-0. H. Deneen Variance - Armstrong moved, seconded by Pott, to set a hearing for Dennis Deneen, variance request, for May 6 at 8:45 p.m. Motion carried 5-0. ADMINISTRATOR'S REPORT: A. Dues: Mottaz moved, seconded by Armstrong, to authorize payment of dues tothe Lake Elmo Business Association @ $25.00/yr. Pott amended the motion,'seconded by Morgan, to include the Tri-Lakes Association and the Cimarron Association. Amended carried 5-0. Motion as amended carried 5-0. TKDA - MAINTENANCE BUILDING: The Council reviewed the letter dated April 11, 1980. They find much of the detailed design work (Item D) was performed without Council authorization. The architect should not have prepared a final design for a building 80% over budget, nor expend fees in excess of 11% of the estimated project cost. The Administrator will contact TKDA and see what compromise can be worked out. The Council agreed to the expenses incurred for Items A thru C. of the letter. R80-23 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, M:INNESOTA A RESOLUTION APPOINTING A RESPONSIBLE AUTHORITY AND ASSIGNING DUTIES WHEREAS, the Minnesota Government Data Practices Act, Minnesota Statutes, Sections 15.1611 to 1.5.1698 as amended, requires that this city appoint one person as the Responsible Authority to administer the requirements for collection, storage, use and dissemination of data on indivi- duals, government data, and summary data, within this city and, WHEREAS, the city council is concerned with the responsible use of city data and wishes to satisfy this con- cern by immediately appointing an administratively qualified Responsible Authority as required under the Act and assign- ing duties to that person; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LAKE ELMO, MINNESOTA: 1. The city council of Lake Elmo, Minnesota, appoints Laurence Whittaker as the Responsible Authority for the pur- poses of meeting all requirements of the Minnesota Government Data Practices Act, Minnesota Statutes, Section 15.1611 through 15.1698, as amended. 2. The Responsible Authority may designate a city employee or employees to assist in the administration and en- forcement of the duties of the Responsible Authority and to be in charge of individual files or systems containing government: data and to receive and comply with requests for government data. If the Responsible Authority appoints a designee or designees, this appointment must be in writing, and the city council shall be provided a copy of the appointment. If desig- nees are appointed, the Responsible Authority shall instruct the designees in the requirements of administering and enforc- i,ng the Minnesota Government Data Practices Act. 3. The duties of the Responsible Authority and designees are as follows: a. The Responsible Authority shall keep records containing government- data :in such an arrangement and condition as to make them easily accessible for convenient use by the pub- lic. Photographic, photostatic, microphotographic, or micro- filmed records shall be considered as accessible for convenient use regardless of the size of these records. b. The Responsible Authority shall establish pro- tedures to :insure that requests for government: data are re- ceived and complied with in, an appropriate and prompt manner. rt8q�?.3 c. The Responsible Authority or designee shall., upon request by any person, permit that person to inspect and copy government data during the normal business hours of the city and at places provided by the Responsible Authority, and if the person requests, that person shall be informed of the dat.a's meaning. The Responsible Authority or designee shall provide copies of government data upon request. The Responsible Authority or designee shall require the requesting person to pay the actual cost of making, certifying and compiling the copies. If the Responsible Authority or designee is not able to provide copies at the time a request is made, the Responsible Authority or designee shall. supply copies as soon as reasonably possible. If the Responsible Authority or designee determines that the requested government data is classified so as to deny the requesting person access, the Responsible Authority or desig- nee shall so inform the requesting person orally at the time of: the request, and in. writing as soon thereafter as possible, and shall cite the statute, temporary classification, or federal law upon which the determination is made. d. The Responsible Authority shall prepare a public document containing his name, title and address, and a description of each type of record, file, or process relating to private or confidential data on individuals retained by the city. Forms used to collect private and confidential data shall be included in this document. The Responsible Authority shall update the public document annually and make any changes necessary to maintain the accuracy of the document. e. The Responsible Authority shall establish pro- cedures to assure that all data on individuals is accurate,�com- plete, and current for the purposes for which it was collected; and establish appropriate security safeguards for all records containing data on individuals, f. The Responsible Authority or designee shall prepare summary data from private or confidential. data on in- dividuals upon the request of any person, provided that the re- quest is in writing and the cost of preparing the summary data is borne by the requesting person. The Responsible Authority may delegate the power to prepare summary data to the administra- tive officer responsible for any central repository of summary data; or to a person outside of the city if the person, in writ- ing, sets forth his purpose and agrees not to disclose, and the Responsible Authority reasonably determines that the access will not compromise private or confidential data on individuals. g. The Responsible Authority shall. prepare a public document setting forth the rights of the data subject pursuant to the Minnesota Government Date Practices Act and the specific, procedures in effect in the city for access by the data subjects to public or private data on individuals. h. The Responsible Authority or designee shall allow another Responsible Authority or designee access to data classi- fied as not public only when the access is authorized or required by statute or federal law. The Responsible Authority or designee when supplying government data under this provision may require the requesting Responsible Authority to pay the actual. cost of supplying the da.ta. RS0-23 i.. The Responsible Authority or designee shall comply immediate.l.y,if possible, with any request made by and individual under this paragraph, or within five days of the date of the request, excluding Saturdays, Sundays and legal holidays, if immediate compliance is riot possible. If the Responsible Authority or designee cannot comply with the request within that time,he shall so inform the individual, and may have an addition- al five days within which to comply with the request, excluding Saturdays, Sunday and legal holidays. k. If an individual contests the accuracy or com- pleteness of public or private data concerning himself, and notifies in writing the Responsible Authority decribing the nature of the disagreement, the Repsonsibl.e Authority shall within thirty days either correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or notify the individual that the Responsible Authority believes the data to be correct. Data which is in dispute shall be dis- closed only if the individual's statement of disagreement is included with the disclosed data. 4. WHEREAS, the City Council of the City of Lake Elmo did on September 5, 1978, adopt a Resolution providing for vacation of a street in the plat: of Tablyn Park known as Ridgeway Drive; and WHEREAS, said Resolution was conditioned upon the owners of the property abutting on said street each paying a proportion of the costs of said vacation proceeding; and, WHEREAS, although the City has .requested such payment from all of said owners that payment has not been forthcoming from all of said persons. NOW, THEREFORE, BE IT RESOLVED by the City of Lake Elmo that: 1. Resolution R-78-28 be, and the same hereby is, rescinded. Adopted by the City Council of the City of Lake Elmo this _ day of , 1980. R-8o-`6 'I t RESOLUTION u V CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION VACATING A PUBLIC STREET - A PORTION OF RIDGEWAY DRIVE - IN TABLYN PARK. WHEREAS, at a regular meeting of the City Council of the City of Lake Elmo, Washington County, Minnesota, held July 5, 1978, a Petition was presented to the City Council praying for the vacation of that certain public street in the plat of Tablyn Park described as follows: Ridgeway Drive, as described and dedicated in the plat of Tablyn Park which plat is on file and of record in the office of the County Recorder in and for Washington County, Minnesota. WHEREAS, said Petition come on for hearing before said City Council at a regular meeting thereof held at 7:30 p.m. on Tuesday, August 1.5, 1978, in the City Hall, pursuant to notice thereof published and posted as required by law; and WHEREAS, the City Council of. the City of Lake Elmo has conducted several additional. meetings and discussions relating to said vacation with the owners of the abutting property and has heard all the evidence presented for and against said Petition and after due consideration thereof has determined it is in the best interests of the public of the City of Lake Elmo to vacate a portion of said street for the following reasons: 1. The said street is unimproved and has never been used for any public purpose. 2. It appears that as a result of the approval of the plat of Tablyn Park Second Addition immediately adjacent to ,said Ridgeway Drive that no public purpose would be served by improving or opening said street. In fact, the said street ` would be inconsistent with the newly approved plat. 3. The said Ridgeway Drive is small and ;Located so close to residential. developments that it could not reasonably be used for any public purpose without a high probability of a nuisance resulting. 4. The City would benefit by having said property returned to private use and maintained as part of the adjacent private holdings. 5. The City Council has been informed and understands that the owners of the .land contained within the newly approved plat of Tablyn Park Second Addition - namely, Top Twenty, Inc., a Minnesota corporation - have agreed and consented to conveying whatever interest they may have .in part of said road to the owners of the lands abutting said street on the Westerly side thereof. 6. It is understood and agreed that all of the Petitioners who own property abutting on the portion of Ridgeway Drive which is proposed to be vacated and the said Top Twenty, Inc. will join in the conveyance to the City of Lake Elmo of a ten foot utility easement in the .lands which are now part of said Ridgeway Drive which easement shall be located on the portion of said street immediately adjacent to the newly approved plat of Tablyn Park Second Addition. NOW, TttER.EFORE, BE IT RESOLVED by the City Council. of the City of Lake Elmo that the following described portion of Ridgeway Drive, to -wit: All that portion of Ridgeway Drive abutting Lots 14, 15, 16, 17, 1.8 and 19 all in Block 3 and Lot 3.2 of Block 1 as described and dedicated in the plat of Tablyn Park which plat is on file and of record in the office of the County Recorder .in and for Washington County, Minnesota, be, and the same hereby is vacated absolutely and forever for the reasons set forth herein. It is .further resolved that the City Council does hereby determine that the City is deemed to benefit from said vacation for the reasons set forth above and the same is sufficient consideration for the vacation thereof. Provided, however, that: 1. The utility easement required by the City as described.above be conveyed to the City by the Petitioners who own the property abutting the portion of the street being -2- �- vacated and the said Top Twenty, Inc. by instrument to be approved by the City Attorney. 2. That said Top Twenty, Inc. conveyed to the owners of the abutting land all that portion of said vacated street in which Top Twenty, Inc. may have an interest. 3. That the owners of the abutting lots of the street being vacated shall, pay the sum of $308.00 each toward payment of the costs to the City by paying said amount to the City Clerk. 9. Upon payment of such costs by the affected Petitioners, and performance of the other conditions above set forth, the Clerk shall cause notice that this vacation proceeding has been concluded to be served upon the County Auditor and shall record a certified copy of this Resolution with the County Recorder, all as provided by and in accordance with Section 412.851 of the Minnesota Statutes. Residents will be notified through the Newsletter to call the City Office with complaints concerning contractors working in the City. CHURCH — LUNDQUIST PROPERTY: The Council has no opposition to a church at this location (Co. 17 and Highway 36), provided sewer, drainage and parking can adequately be handled on the proposed acerage. ENERGY PROGRAM: Pott moved, seconded by Armstrong, to authorize $50 to send the Building Inspector to an Energy Seminar. Motion carried 5-0. MAINTENANCE GARAGE: TKDA has indicated the cost to earth shelter the maintenance building will not be paid out in energy savings. The Council instructed the Administrator to relate to TKDA they want a 50% earth sheltered structure for $175,000. SIGN ORDINANCE: Additional concerns have been expressed by the Business Association concerning the Sign Ordinance. They would like existing signs be granfsthered in and lighted signs be turned off at the discretion of the business unless they create a nuisance. They £eel.many of the lighted signs act as a security light. The Council agreed to extend the time —limit on non —conforming signs from three to five years; and; to allow only lighted signs that act as security lighting to exempt from ordinance. The Council instructed the Administrator to draft a final Sign Ordinance for Council approval. STATE CONFERENCE: Mottaz moved, seconded by Morgan, to authorize $140.03, conference fee, for the City Administrator to attend the State Managers Conference. Motion carried 5-0.
