HomeMy WebLinkAbout07-29-80 CCMSPECIAL LAKE E]:,MO CITY COUNCIL MEETING, JULY 29, 1980 Mayor Armstrong called the meeting to order at 5:15 p.m. CIMARRON NPDES PERMIT: The Council reviewed the letter to Pollution Control from Valley Branch, dated July 29, 1980. The Council agreed Valley Branch covered all the concerns of the City. Pott moved, seconded by Morgan, to have the Administrator write Mn/PCA supporting the Valley Branch Watershed District comments concerning Cimarron"s NPDES Permit No. Mn. 0050636. Motion carried 5-0. ENGINEER'S REPORT: A. MSA Project #1 - The low bid to complete the project was $114,000, Before work can commence the City will have to acquire the necessary r-o w and resolve the question of the 40 mph curves, required by the State. (The City submitted a design calling for 30 mph curves.) Engineer Bohrer recommended the Council delay awarding the contract until after he meets with Mn/DOT. Mottaz moved, seconded by Pott, to hold awarding the MSA contract until after negotiations with Pin/DOT. Motion carried 5-0. Maynard Eder suggested the City investigate a reduced speed zone (30 mph) on Lake Jane Trail. He also requested that when the City meets with the Highway Department, affected property owners also,be present. The Council opposes the large amount of agricultural land the 40 mph curve would require and agreed 40 mph would exceed a safe sped for this area. Also, the new DNR boat launch on Lake Jane Trail should be taken into consideration for the reduced speed zone, The Council instructed the City Engineer and City Attorney to see if Lake Jane Trail (old 45th St.) meets the statutory requirement for 30 mph, due to its urban density. Armstrong moved seconded by Morgan, to adopt Resolution 80-46, requesting the Commissioner of Transportation to establish a speed zone on Lake Jane Trail, 45th Julep and 46th Streets. Motion carried 5-0. B. Derrick Land Simple Lot Division - The Engineer reported there is 1 acre of dry land on each site large enough for two drainfields. lie also found no problems with the perc test rates or soil borings. Morgan moved, seconded by Pott, to adopt Resolution 80-41, subdividing Lot 8, Block 1, DeMontreville highlands 6th .Ad- dition. Motion carried 5,0. As such time a permit is applied for, the Building Inspector will determine the lots will be adequate to handle the size of the home. BALL TOURNAMENT LIQUOR LICENSE - HIDDEN VALLEY LOUNGE: The present Ordinance makes it illegal to grant a temporary liquor license in a public park. R-80-47 RESOLUTION CITY OIL LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION GRANTING A SIMPLE LOT DIVISION FOR DERRICK LAND COMPANY IN DEMONTREVILI.E HIGHLANDS 6TH ADDITION WHEREAS, Roger Derrick, on behalf of Derrick Land Company, has made application to the City of. Lake Elmo for a simple lot division on the following described real estate located in the City of Lake Elmo, Washington County, Minnesota, legally described as follows, to -wit: Parcel A: The East 228.00 feet of Lot 8, Block 1,, DEMONTREVILLE HIGHLANDS 6TH ADDITION according to the plat; on file in the Office of the Registrar: of Titles, Washington County, Minnesota, P41010] Parcel B: All that part. of Lot 8, Block 1., { DEMONTRIVI.LLE HIGHLANDS 6TH ADDITION according to the plat on file in the Office of the Registrar of Titles, Washington County, Minnesota, lying west of the east 228.00 feet thereof:, WHEREAS, there does not appear to be any .reason related to the public health, safety and welfare which would require a denial of the proposed simple lot division for said property; and WHEREAS, the City Planning Commission considered the proposed simple lot division on July 14, 1980, and recommended the approval thereof; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo as follows: The application of Derrick Land Company for a simple lot division for the above. -described real. estate .is hereby granted' subject to the following condit.i.ons: 1. The applicant shall provide the City with a Certificate of Survey for the parcels being divided. Said Certificate of Survey shall contain an accurate legal description of the real estate in question. 2, Both parcels shall be at least one and one-half (10 acres in size. 3. Both parcels moat have at least one (l) acre of dry land suitable for a dza1ofield and both parcels most have sufficient area for two draiuf1eld sites. 4. Armstrong, Mayor -2- R-80-45- RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION REDUCING THE DEVELOPERS PERFORMANCE BOND FOR THE PLATS OF DEMONTREVILLE HIGHLANDS 5TH ADDITION AND DEMONTREVIL13E HIGHLANDS 6TH ADDITION WHEREAS, the Developers of Demontreville Highlands 5th Addition and Demontreville Highlands 6th Addition have completed a substantial amount of the improvements required for final approval by the City; and WHEREAS, the Developers have requested a reduction in the Performance Bond for said subdivisions; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo as follows, to -wit: 1. The Developers Performance Bond for the plats of Demontreville Highlands 5th Addition and Demontreville High. - lands 6th Addition be, and the same hereby are, reduced to the sum of $5,000.00. 2. Said Developers shall complete, as soon as possible, the work required in the City of Lake Elmo Engineer's Punch List forwarded to said Developers' Engineer on Tuly 21, 1980. Armstrong, Mayor ATTEST: .4 Laurence Whittaker City Administrator SPECIAL LAKE ELMO CITY COUNCIL MEETING, JULY 29, 1980 -2- BALL TOURNAMENT: Armstrong moved, seconded by Novak, to adopt Ordinance 7918,, amending the Zoning Ordinance to allow the City to issue a temporary "on -sale" license for the sale of non -intoxicating malt liquor on or off school grounds, in and out of school houses and buildings, and in or out of public parks. Motion carried 4,1. Mottaz opposed. Novak moved, seconded by Pott, to approve a temporary liquor license to the Hidden Valley Lounge for a ball tournament August 22, 23, 24, 1980, Motion carried 5-0. CENSUS n PRELIMINARY DATA: Lake Elmo"s preliminary estimate is 51150, up 100 from 1979. Morgan moved, seconded by Armstrong, authorizing the Administrator to return the preliminary figures stating Lake Elmo has no questions on the preliminary estimates. Motion carried 5-0. LICENSES: Morgan moved, seconded by Armstrong, to approve the licenses for the following contractors: All Construction, Inc,, 10740 110th.Street N „ Stillwater, Mn. Scott Corp,, 2345 Rice Street, Suite`208, St. Paul, Mn, Ra-Mar Plumbing, 97 Golden Lake Road VT., Circle Pines, Mn. Motion carried 5-0, TABLYN PARK TENNIS COURTS: 500 yds of sod and a construction wheel- barrow are needed to complete construction of the tennis courts. These items are not authorized in the budget for the courts. Morgan moved, seconded by Pott, to approve a maximum of $500 to complete construction of the tennis courts in Tablyn Park. The purchase of the wheelbarrow to be charged 75% against the Maintenance Department, Motion carried 5-0. METER READER: Morgan moved, seconded by Armstrong, to authorize the payment of $0.50 per home be paid March Eichen (meter reader) this quarter, where she read both the inside and outside meters. Motion carried 5-0. Several descrepancies between outside and inside meter readings have been found, The Administrator suggested that those meters where over a 1,000 gal, descrepancy was found be pulled and calibrated. The Council decided to reread those meters with the large discrepancies the next quarter. If there is still a problem; then, pull and calibrate them. ADJOURNMENT: 6:00 p.m. Mayor Armstrong closed the Council meeting to the public for Council discussion of a pending legal suit.
