AGENDA: Additions: Administrator's Report - Other: Announcements Armstrong moved, seconded by Mottaz, to approve the Agenda as amended) Motion carried 4-0. MINUTES: August 5, 1980 - Approval at the next meeting. CLAIMS: Mottaz moved, seconded by Armstrong, to purchase four additional folding chairs.from Lake Elmo Hardwood. Motion carried 4-0. WAGES FOR ELECTION JUDGES: Pott moved, seconded by Armstrong, to set the wage for the Election Judges at $3.10 per hour. Motion carried 4-0. Mottaz moved, seconded by Armstronq,, to set the wage for the Head Election Judges`at.$3.60.per.hour. Motion carried.4-0. METER.READER: Mottaz moVed,.seconded,by Armstrong, to approve the followiincf policy for Meter Reader: 1.. Pav meter reader 354 per call. 2. If no reading, leave a,card for homeowner to read their own meter. 3. Require that every inside meter be read at least once each year (no later than September l), so that we have an accurate reading. 4. Pay the Meter Reader 50� whenever both inside and outside meters are read. (Once a year) Motion carried 4"0. RAILROAD ZONING: In the opinion of the City Attorney, there isno special zone necessary for the railroad to control refuse along the tracks. It assumes the present zoning of sur- roundinq property; and must meet all regulations for that district. RAILROAD DEBRIS: The Maintenance Foreman ,reported. that some of the debris along the tracks has been cleaned up. The Administrator and the Foreman will inspect the problem area and the Adminis- trator will notify_ the railroad 'what additional work is necessary. RAILROAD ASSESSMENT POLICY:. The Administrator reported that the railroad and Mn/Dot has been assessed for surface water projects in other areas. (Valley Branch assessed them. for Project 1005.) The Administrator has contacted the Chicago/Northwestern and Mn/Dot regarding Beutel Pond, and they indicated the.are willing to pay their share of the improvement costs. The Administrator will forward the improvement plan and the assessment formula. LAKE ELMO CITY COUNCIL MEETING, AUGUST 19, 1980 d.0 LARSON VARIANCE: The City Attorney presented the final agreement with one change. Dr. Machmier requested.that his assistant be authorized -to conduct the required yearly inspections. Mottaz moved, seconded by Armstrong, to approve the agreement with the revision requested by Dr..Machmier. Motion carried 4-0. The Larsons and the City signed the,approved agreement. FOXFIRE GATE: The City Attorney advised the Council, that closing,off the gate at the. -end of Jamaca is a,policy decision. The City.,has .an oblig4tion,to:maintai.n the gate, per the.Development Agreement;, but, does not have 'a legal obligation to retain the gate, providedemergency services are available to this section of the City. The City is not legally bound by a, time limit to provide services (ie. fire and police) to a particular area. Residents in Foxfire do have access and can recieve emergencv.services from that access. The gate.was a stipulation by the City to the.developer.' The Administrator gave background data concerning access proposed by the developer and the concerns of area residents. Mottaz expressed concern about the ,increase in time for emergency vehicles to reach Foxfre, using the access off Demontreville Tr. The Council discussed construction of a barri:cdde that could not be easily destroyed, as has been done to the current gate, Administrator Whittaker advised that blocking off Jamaca permanently is_not,.good`City policy. Novak, to:instruct the Administrator not to take any permanent measures to close off Jamaca Avenue and seek the City Engi.neer's opinion about construction a barricade that would prohibit through traffic, but permit emergency access. The Engineer is authorized up to $100 to research the problem. Motion carried 470. Councilman Morgan arrived at 6:00. RIED PARK:., The condemnation papers have been drawn up and are in the process of being executed. PAY PLAN:, The Council reviewed the salary increases recommended by the Administrator. The Council discussed individual increases (merit and cost of living), but did not agree with.'the step increase guideline.recommended in the current Pay Plan. After a lengthy discuss.i_oli the Council agreed •on an overall 10o salary increase over the 1980 salaries. They also agreed to declare December 24 a legal holiday. The Council reviewed the Administrator's salary request. Mottaz commended Administrator Whittaker on an outstanding job and recommended his salary increase should be more than 100. Armstrong moved, seconded by Morgan,, to grant the Administrator a 12% base salary increase for 1981, $800 allowance to attend the ICMA National Conference, and-$50/month expense allowance, Motion LAKE ELMO CITY COUNCIL MEETING, AUGUST 1�, 1980 -3- DINNER BREAK , Bents Elmo Inn ENGINEER'S REPORT: Engineer Bohrer was unable to attend, Administrator Whittaker reported on the following items: A.. MSA #1 - The Speed Limit Resolution has been prepared and sent out. The Engineer strongly recommends all the Council members contact the District Traffic Engineer and request the reduced speed zone. B. Legion Pond - The easements have been prepared and sent to the affected property owners. Councilman Pott asked how the City would handle the assessments for those residents granting easements should they request reduced assessments or a fee for easement rights. Don Durand and Earl Goerss are large property owners involved with granting easements. He proposed, in order to expedite the test wells, the Council set a dollar amount and give the Administrator authority to handle such a situation should a request be made. This would be for well easements only. The Council discussed the value of the assessment vs the easement right, crop damage, miscellaneous property damage, etc., to try and determine an equitable amount. Durand will be asked for well and pipe easements; Goerss, only well. Morgan moved, seconded by Armstrong, to trade well and pipeline easements in lieu of assessment plus damages with Don Durand; and, offer Earl Goer.ss $I50 plus damages for a.well easement. Other residents who will have the pipeline cross their property would be offered the same proposition as Mr. Durand. Motion carried 4.-0-1. Novak abstaining. C. Eagle Point Permit - The Administrator reviewed the DNR permit 'stating the City can operate within the restrictions. The Engineer calculated no more than 20 acre feet of water can be stored in the two proposed ponding areas between Eagle Point and Lake Elmo. Additional permission and,.permits would be necessary should the City decide to pond in these areas.. Pott recommended discontinuing further consideration of such ponding. Morgan disagrees with the Engineer's cal- culations. He feels wherever possible, throughout the Watershed, water should be ponded. The Administrator will contact the County and the DNR and get their reaction and requirements to ponding between these two lakes. Novak agreed this should be pursued. Mottaz requested no action be taken until all Council members have an opportunity to look over the proposed ponding areas. The Council agreed. D. Landscaping, Maintenance Building - The reported that the ultimate drainage plan and landscaping around the building will require moving 4,000 yds. of dirt. (Landscaping around the building and the rough cut of the driveway can be done by the City Crew.) ,Morgan questioned that this amount -of dirt will have to be moved due to the design of the building. Whittaker stated the permanent driveway and drainage swale constitutes this work. The estimated cost is $5,000 to $6,000. This is indicated on the site plan. The Administrator felt the Council should be aware that this work will need. to be done, and consider budgeting for it. The Council will consider the matter after the building is comnlei-p_ LAKE ELMO CITY COUNCIL MEETING, AUGUST 19, 1980 -4- 'E. Klondike Turn -around .- The County is fencing in the Park, thereby,ang ut the City's to:rn-around for the snow pjows, grader, and school buses at the end of Klondike. The Administrator recommended asking the County for the right-of-way for the turn -around; or ask that they move their fence in 100' into the park, thereby, providing an adequate turn -around for City vehicles and buses. Novak briefed the Council on her contact with the County, as the County property runs in front of their home. She suggested the City get a deed for the street that is used as a City street. The City does not have clear title to the street. Armstrong moved, seconded by Pott, to authorize the Administrator to negotiate with.the County on placement of the fence and authorize up to $200 to cover the cost of the fence. Motion carried 4-0-1., Novak abstaining. F....Beute'f Pond - Councilman Pott reported that the new con- tractor's price is $3,500 ($1,500 less than. previously quoted). The State has responded, and are willing to participate in the cost of the project. The Engineer will inspect the old pipe,.determine what needs to be replaced, and order the pipe. The City may, be able to purchase the pipe under Washington County's contract. All work should be complete by the next meeting. ( The State and the railroad'11ave indicated they will share l in the cost. The Administrator will forward the plans to them. The Administrator informed the Council that a major portion of the Beutel Pond assessment area is in Green Acres. BUDGET RESERVES: The Council reviewed the table. A Parks Capital Projects Fund summary is not available yet. The Council generally agreed $20,000 per year is a realistic amount for. Maintenance equipment. The Council did not want the proposed plan to serve as an expenditure plan. The Council agreed that the $16,557.71, in Park Development Reserve, should be left in Reserves. All other Reserve transfers were alright with the Council. The Administrator will draft a resolution on 1981 Budget Reserves for the next meeting. FIRE DEPARTMENT RADIOS: Bruce Kuettner has three bids to purchase two band --held portable radios. Low bid i_s $1,120 per radio. This is budgeted under the Fire Department Capital Equipment Purchases for 1980. Morgan moved, seconded by Mottaz, to authorize the purchase of two hand-held radios, for the Fire Department, at a cost of $11120 each. Motion carried 5-0. BREAK C P.RELIMINARY BUDGET: Armstrong moved, seconded by Morgan, to hold a Special Budget Meeting August 28, 1980, at 1 p.m. Motion carried 5-0. The Council will meet at noon for lunch before the meeting. LAKE ELMO CITY COUNCIL MEETING, AUGUST 19, 1980. -5 - CCNSERVANCYf REGULATIONS: Mottaz does not think there is adequate deta:E.l, or defination in several areas of the regulation. He will give his comments to the Administrator for review by the Planner. SURFACE WATER USE/DNR ACCESS: The Administrator recommended the Council define the following issues at the Water Surface Use and public information hearing: 1. The Citys position on lake accesses and the ordinance that is recommended,to the public and 2. Ask the residents if the they want to go further in regulating themselves to control the general nuisance created by public accesses. The Council agreed. OFF ROAD VEHICLE ORDINANCE 7915: The Council reviewed the proposed . Snowmobile Ordinance. Pott suggested deleting the last sentence of the Intent. The Council would like the City .Attorney to define what part of the old Ordinance this re- places and if all the previous regulations are included. This will be considered at the next meeting. ADMINISTRATOR'S REPORT: A. Delinquent Bills - Verlin Hanson, Ridgeway Drive - The Council is required to hear Mr. Hanson before his assessment is attached to his tax statement. Armstrong moved, seconded by Morgan, to set a hearing for Mr. Verlin Hanson, at 7:45 p.m., on September 16, 1980. A hearing on his assessment for Ridgeway Drive Vacation. Motion carried 1-0. B. Revenue Sharing Budget Hearing: Morgan moved, seconded by Armstrong, to hold a hearing on Revenue Sharing Budget, at 8:00 p.m., on September 16, 1980. Motion carried 5-0., C. Quotes on Fire Hall Entrance - The Administrator will secure quotes front local blacktop driveway contractors. Armstrong moved, seconded by I,-Iorgan, to authorize up to $550 to pave the Fire Hall entrance. Motion carried 5-0. D. League of Cities Building - The Council will discuss this at the Budget meeting. E. Animal Control - North St. Paul has agreed to let Lake Elmo contract the use of their equipment provided the insurance question permitting Jerry Dalberg to use their truck and equipment is worked out. The Administrator will write North St. Paul requesting same. F. Seel.er Land Sale - No Council interest. G. Auditors Contract, 1981 - The Council recommended the Administrator secure quotes from other firms. This will be C discussed at the budget meeting. II. Civil Defense - No Civil Defense Director has been found. The Administrator recoimnends that the City meet wit: the Fire Chief, School District, Cimarron, and the Sheriff, and develop an evacuation plan. Cimarron is still Polli-nq 1 its residents on the siren. I. Public Waters - Several public waters need to be named. The Council will review the map, submit names, and return to the Administrator. J. Licenses - Armstrong moved, seconded by Morgan, to approve the fo-Ioinng licenses: Temporary 'Liquor License for Lowell Rieks, Jr. 4564 Kimbro Avenue for 8/23/80 and a Temporary Liquor License for 'Washington County Police Wives Assn, for 8/24/80. Motion ca.rri.ed.4-0-1 Novak abstained. K. Building Inspector - Mahtomedi Ratio.- Mahtomedi is anti- cipating exceeding the 1 3 share for the Building Inspector. They are willing to renegotiate and change the agreement for 1981. The Administrator recommended it should indicate that their share will be adjusted quarterly based on residential permits, total permits, and dollar value. Morgan moved, seconded by Armstrong, to accept the Administrac tor''s recommendation of the salary ratio for the Building Inspector. Motion carried 5-0. L. Others - Announcements 1. The Administrator reported on the special session with the governor on August 20,at 3 p.m, on Potential Cuts in State Aid Payments to Cities. The Administrator will attend. 2. The Metropolitan Council wants to hold its annual meeting in Lake Elmo September 25 at 7:30 p.m. The Council had no objection. 3. The Maintenance Building is on schedule. 4. Pk6 ect 1006 - The Council reviewed the proposed schedule for Project 1006. The Council expressed concern with magni- tude of this project cost, and their assessment projection. Armstrong moved, seconded by Pott, to instruct the Administra- tor to write Valley Branch and express Lake Elmo's concerns and reiterate the City's position that the project should be be built for toadys needs. Motion carried 5-0. COUNCIL REPORTS: Morgan-1.. ��Schxfsky estimatedr;the cost to,repair'.l,the courts at $5,000.to $6y000. 2. The lights at Pebble Park were broken intoandthe money stolen. The timer is still not working for the lights. The Administrator will call the electrician again. Mottaz - A definition of what the '";Tri-Lakes" area is, Recommended the City work with the Trig -Lakes Association to �, define where the Tri-lakes area is and possibly request them LAKE ELMO CITY COUNCIL MEETING, AUGUST 19, 1980 - 7- Mottaz cent - to change their by-laws to include membership in the wTiole Tr,Lakes area. The Administrator will send a letter to the Tri-Lakes Association. Pott - Second Well The City will be able to work out an arrangement on the second well with Joe Rogers.
