HomeMy WebLinkAbout10-29-80 CCMSPECIAL LAKE ELMO CITY COUNCIL MEETING, OCTOBER 29, 1980 Councilman Pott called the meeting to order at 6;30 p.m. Councillors in attendance: Novak, Morgan, Mottaz (7:05) and Mayor Armstrong (6:35) PARK TRAIL BIDS: The Council reviewed the bid tab sheet for the park trails. The lowest total bid was that of Ridge Blacktop, Inc., for $11,400. However, the unit price per lineal foot was written out consistantly as,$12,60, this would amount to $114,000 extended. This bid was to be awarded on the unit costs. So, the $11,400, although the lowest total bid, was not a responsible bid. Armstrong moved, seconded by Morgan, to award the bid for park trails to the lowest responsible bidder, Mogren Bros. Although Ridge Blacktop, Inc, appeared to be the low bidder the Council determined this was not the lowest responsible bid because of the discrepency in the unit and the total price. Motion carried 4-0. Mottaz absent. Morgan will walk the trails with the contractor. The contractor will furnish the staking material, as stated in the bid. Engineering time will be billed against the grant money, JAMACA GATE: The Engineer distributed the final design for the Jamaca Gate. He received two bids to construct and install the gate. Both bids were in excess of $1,900, which exceeds the cost limitation set for the project. Pott moved, seconded by Novak, to reject all bids and table this matter. Motion carried 4-0. The Administrator will give the proposed plan to the Maintenance Foreman and see if the maintenance crew can construct and install a similar structure, GARAGE LANDSCAPING: The Engineer talked to Mr. Mogren and he indicated he cannot do this work until after November 5. CITY OFFICE ROOF: The Council reviewed the bids. The Building Inspector recommended the City accept the bid from Curran J. Nielsen, Co., the highest bidder. His recommendation was based on the durability and 10 year guarantee on more substantial material than was specified in the bid. Morgan moved, seconded by Pott, to accept the low bid for reroofing the City Office roof, only, from Ettel & Franz. Motion carried 4-0. The Council decided to delay reroofing the upper roof. That will be done when the City Office remodeling is done. BROOK'S NON INTOXICATING MALT LIQUOR LICENSE: The Administrator reported that the Sheriff has no objection to licensing Brooks; the State does not license them; and it is a City decision. Armstrong moved, seconded by Pott, to grant an Off -Sale Non - Intoxicating Malt Liquor License to Brook's Superette. Motion carried 3-1. Novak opposed. SPECIAL LAKE ELMO CITY COUNCIL MEETING, OCTOBER 29, 1980 -2- LEGION POND: The Building Inspector has inspected the septic systems along Legion Avenue that were threatened by the pond. The Code r states that systems that do not meet the regulations must be l up -graded within 90 days after.notification. When the Legion Pond Project was ordered the petitioning residents were given seven months to bring their systems into compliance; if it was deemed necessary. The Council agreed the residents should still be given an.extension. Morgan moved, seconded by Armstrong, to grant a variance from the Code requirement that septic systems not complying with the City Code must be upgraded within 90 days; and extend the repair time to July 1, 1981 to those systems on Legion Pond that are functioning and do not pose a health hazard. This extension will not apply to Jeff Burgoyne, whose system was deemed not functional and a health hazard by the Building Inspector. Motion carried 4-0-1. Mottaz arrived at 7:05 and abstained on the vote. LICENSES: Armstrong moved, seconded by Novak, to approve the following licenses: Gene Swanson, Pulumbing, 2572 7th St., North St. Paul; and Spring Heating, 10350 St. Croix Tr., Stillwater. Motion carried 5-0. LITTLE SUNFISH: Engineer Bohrer reviewed the petition, the feasibility study, the potential problems, his recommendations and Cimarron's action to prevent flooding of the Cimarron treatment plant. He reviewed the action of the City Council to lower Little Sunfish; and reported Valley Branch voted to table any action -on -the City's-permit—application until a joint meeting was held between all concerned bodies. The Engineer outlined three proposed pumping projects with varying time frames including a $15,750, 25 day project to pump the water along County 70 the the West Lakeland Storage Site #1. The City has sevured permission from property owners west of County 15 to place water on their land. John McPherson, West Lakeland Supervisor, does not think the storage pit can handle the 60 acre feet of water. Discussion followed on the water quality of the water going downstream. Dave Swanson, West Lakeland Board Chairman, said the -people downstream are going to be flooded out; and if the water is pumped into Horseshoe it will be diasterous to nearby residents. Steven Taylor, Cimarron, reitterated his statements on water quality now vs quality if the plant floods. Cimarron can do nothing more "today" to prevent flooding in the spring of 1981, when sewage will mix with Sunfish Lake. The Council offered to store additional water on Eagle Point to offset the 60 acre feet proposed to be pumped downstream. This met with mixed reaction. Mr. Taylor said they have explored additional storage areas on - site. These can be developed next spring; but will be of no benefit for the 1981 run-off; also, these sites will not hold the 60 acre feet necessary to insure the plant will not flood. Mr. Rosas, Valley Branch, said this answers the Board's question on what Cimarron can do to store additional water on -site. SPECIAL LAKE ELMO CITY COUNCIL MEETING, OCTOBER 29, 1980 -3- LITTLE SUNFISH: Lee Richert, West Lakeland resident, stated the storage site is a very critical area. Should the site not be adequate (overflow) wells and septic systems in that area will be damaged or polluted. Morgan,again, stressed the storage of water on Eagle Point. Engineer Bohrer explained how the dike on Eagle Point works; water can be stored here and released when it can be handled downstream. Kent Lokkesmoe, DNR, said the main problem would be that if the City should store this additional 60 acre feet, this is 60 acre feet less available storage next spring. The Council feels Eagle Point is capable of holding more water than the permit allows. Pott proposed the following: 1. pumping be limited to 60 acre feet from Little Sunfish into Horseshoe Lake; 2. during the pumping period the water level of the storage site would not rise more than 8"; 3. the City of Lake Elmo will agree to store 75 acre feet of water on Eagle Point Lake until May 15, 1981, or until Valley Branch, West Lakeland and Lake Elmo agree it should be released; 4. the rate of flow out of Horseshoe Lake will be maintained at a safe level, 211; 5. monitor the storage site to prevent any possibility of water breaking through. George Hedges, Valley Branch, said the water should get to the storage site as quickly as possible to permit immediate seepage SO that the water will not interfere with the spring run-off. Mr. Al Lehman, 3M, indicated that from the bottom of the storage pit to the over -flow the total capacity is 61 acre feet. Mr. Rosas said the higher the head the quicker the water is driven into the ground. Residents said that any large volume of water (4") flowing to the storage site will causeflooding to some residents. George Hedges said; based on what has been heard, the County 70 route may be the best alternative. Armstrong moved, seconded by Mottaz, to adopt Resolution 80-62, repealing Resolution 80-61, and ordering the following; pumping along County 70 to the West Lakeland Storage Site; pump a maximum of 60 acre feet; the water will be kept l foot below the overflow of the storage site; frequent monitoring of the site will be done; Lake Elmo will store an additional 75 acre feet of water on Eagle Point Lake until an agreement, within one year, between Lake Elmo, West Lakeland and Valley Branch is made to release this water downstream; Lake Elmo will meet with Valley Branch, West Lakeland, Oakdale, and Cimarron to work on additional storage sites. Motion carried 5-0. Verbal easements have been received. Documents are being drafted for easements to pump along County right-of-way where the pipeline will be laid. All necessary permits will be applied for. ADJOURNMENT 9:10 p.m. R-80-62 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION RESCINDING RESOLUTION R-80-61 AND ORDERING A PUMPING PROJECT FROM LITTLE SUNFISH LAKE ALONG COUNTY ROAD 70 TO A SITE IN WEST LAKELAND TOWNSHIP. WHEREAS, the City Council of the City of hake Elmo did on October 21, 1980, adopt. a Resolution for a pumping project from Little Sunfish Lake to horseshoe Lake; and WHEREAS, additional. evidence brought. to the attention of the City Council. indicates an alternative method exists to pump the excess surface water along County Highway 70 to an area known as the West Lakeland storage site. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo as follows, to -wit: 1. Resolution R-80-61 adopted October 21, 1980, is hereby t ' rescinded. 2. The City Council hereby directs the City Engineer to commence pumping a maximum of 60 acre feet of excess storm wager from Little Sunfish Lake along County Highway 70 to the West Lakeland storage site. 3. At all times during said project, the water being pumped into the West Lakeland storage site will be kept at least one (1) foot below the overflow level of the storage site. 9. The City will frequently monitor the site to determine the elevation of the pumping into the site. 5. The City of Lake Elmo will store an additional 75 acre feet of surface water on Eagle Point Lake until an agreement is reached between the City of Lake Elmo, the Valley Branch Watershed District and the Town of West Lakel.and,to allow for 9 the release of this water downstream and that hopefully, said agreement can be reached within one (1) year from the date hereof. 6. The City of Lake Elmo will meet with the Valley Branch Watershed District, the Town of West Lakeland, the City of Oakdale and the residents of Cimarron to work on additional storage sites and their acquisition. Armstrong, Mayor -2- R-80-63 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION REQUESTING THE MINNESOTA DEPARTMENT OF TRANSPORTATION TO ESTABLISH SPEED ZONES ON CERTAIN STREETS WITIiIN SAID CITY. WHEREAS, the City Council of the City of Lake Elmo is concerned about vehicular traffic on its streets and that said vehicular traffic should travel at speeds which are not excessive; and WHEREAS, it has come to the attention of the City Council that there currently is vehicular traffic on certain streets in the City which is traveling at excessive speeds; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo as follows, to -wit: 1. The City Council hereby requests the Minnesota ` Department of Transportation to establish a thirty (30) mile per hour speed zone for a portion of Lake Jane Trail between Ideal and Jamaca. 2. The City Council requests the Minnesota Department of Transportation to establish a thirty-five (35) mile per hour speed zone on a portion of Jamaca between Jane Road North and 45th Street North.
