Councilman Pott called the meeting to order at 6:40 u.m.
Councillors in attendance: Morgan, Mottaz, Novak, and Armstrong (6:45)
LEGION POND: The Council reviewed the petition from Thomas Deck, William
Peterson, and Rodney Toft to fill their lots and do all work
necessary to make their septic systems workable, according to
City standards, They asked. the Council to construct the improvement
and assess the cost against their property.
Mr. Burgoyne and Mr. Collyard, petitioners on: the test well
project, did not sign the current petition, Mr, Collyard stated
he is interested in fill the City has available; but will do his
own improvement.
The petitioners said they prefer fill work only, since their septic
systems are not presently endangered as are Burgoyne's and
Collyard's. They would be willing to have their systems improved
if problems arise after the fill has settled. ..Engineer Boh!r.er
questioned filling without septic improvements. Bohrer asked
about the City's responsibility if these systems should fail this
winter. He said oncethe fill is in place the current systems
will not conform to City standards; and technically, all five
systems are in violation of the Code.
One petitioner asked what the City's position is on the Burgoyne
house, which is presently empty because of their failed septic
system. Armstrong said the City will check the failed system and
condemn it, if necessary; to prohibit living in the house until
the system is improved.
Morgan suggested the test wells be pumped and the perc rates
checked, because he still believes pumping the pond might help.
Pott agreed with Morgan's suggestion and said the project should
be ordered assuming that the septic systems will be upgraded,
The Council agreed,
Armstrong moved, seconded by Mottaz, to adopt R-80-56, ordering:
1, the improvements on lots 8, 9, and 10, Mvron Elman Subdivision;
2, the Engineer to begin all studies and take all bids to
implement the filling project, Depending on the amount of
fill available at the City landfill, 1/4 of the amount will
be allocated to Collyard, with the remaining fill distributed
equally among the petitioners. Additional fill will be
purchased if the City fillis not adequate or if a less expensive
source is available;
3. the filling process to. begin immediately upon acceptance of
a low bidder (for hauling and/or supplying fill);
4. the Engineer to check the three systems within 7 months
and determine what additional -work may be.neeessary'to
bring the septic systems and drainfields into compliance
with the City Code;
5, an agreement to be signed between the City and the petitioners
before any work is begun holding the City harmless from any
liability that may arise out of the project or failure of
any septic tank or drainfield.

RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION AUTHORIZING CERTAIN IMPROVEMENTS OF PRIVATE,
PROPERTY ADJACENT TO LEGION POND IN THE CITY OF LAKE ELMO
WHEREAS, the City Council has reviewed the Petition from
Thomas Deck, William Petersen, and Rodney Toft to fill their
lots and do all work necessary to make their Septic Systems
workable and to bring those systems up to city standards;
and,
WHEREAS, the City Council is aware of the problem of fail-
ed Septic Systems of private homes adjacent to Legion Pond;
and,
WHEREAS, the land owners adjacent to Legion Pond have re-
quested the Council to order the improvements of the private
Septic Systems so as to enable the .improvement to be a cost
of the city and assessable against the benefited property;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Lake Elmo, as follows:
1. The city hereby authorizes the improve-
ment of the Septic Systems on lots 8, 9
and 10, Myron Elman Subdivision in said
city.
2.. The City Engineer shall begin all studies
necessitated by said improvement and
shall take bids to implement said filling
project. Depending upon the amount of
suitable fill available at the City of
Lake Elmo Landfill .it is understood that
one-fourth of the amount will be allocated
to Mr. Dan Collyard with the remaining fill
to be distributed equally among Mr. Thomas
Deck, Mr. William Petersen and Mr. Rodney
Toft. Any additional fill will be'purchased
if the city fill is inadequate or if a less
expensive source is available.

3. The filling process shall begin immed-
iately upon acceptance of the low bid-
der for hauling and supplying said fill.
A. The City Engineer shall check the three
systems within seven months to determine
what additional. work may be necessary to
bring these Septic Systems and Drain
Fields into compliance with the applicable
city ordinances.
5. The city and the petitioners shall enter
into a Hold Harmless Agreement prior to
commencing any work and said agreement
shall provide the City of Lake Elmo shall
be held harmless from any liability that
may arise out of the project or the fail-
ure of any Septic System or Drain Field
which is a part of this project.
Adopted by the City Council, City of Lake Elmo, this 7th
day of October, 1980.

Methane Fuel for Landfill. Delete - Well #2 and Tennis Court
Resurfacing.
Morgan moved, seconded by Pott, to approve the Agenda as amended.
Motion carried 5-0.
MINUTES: September 2, 1980 - Pott moved., seconded by Mottaz, to
approve the minutes of September 2, 1980, with the following
amendmentr:to page 5,' item I. Park Commission: The Council
reviewed the minutes of the Park Commission meeting of August 28,
1980. Before the Commission initiates any action on the Beaubien
land purchase or the land lease in Sunfish Park the Council
would like to review these items. Administrator Whittaker will
contact Ed Nielsen and Dave Morgan,
Motion carried 4-0- 1. Morgan abstained.
September 16, 198G - Mottaz moved, seconded by Armstrong, to
approve the minutes of September 16, 1980. Motion carried 5-0.

Armstrong moved, seconded by Novak, to pay George Ringwalski $60
per month for 1980, for opening and closing the gate at Sunfish
Park. Motion carried 5-0.

licenses: Jerome Bearth, Jer-Hen Builders, Inc., 1690 Hewitt Ave.,
St, Paul; Olsons Sewer Service, 17638 Lyons St., Forest Lake; and,
Lyle Rotvold, American Burner Service, 601 Prior Avenue, St. Paul.

ELECTION JUDGES: Armstrong moved, seconded by Mottaz, to approve the
recommended Election Judges and. Counters with the exception of
Laura Fraser. motion carried 5-0. (see attached list of names)
CLEAN-UP DAYS: Pott moved, seconded by Mottaz, to set October 18, 1980,
as Lake Elmo Clean -Up Days. Motion carried 5-0.
15TH STREET VACATION: - PUBLIC HEARING: Mayor Armstrong opened the
hearing at 7:45 p.m. There was no one in the audience to speak
on the vacation.
Mottaz moved, seconded by Armstrong, to continue the public hearing
until October 21, 1980, at 8 p.m. Motion carried 5-0.
Armstrong closed the hearing at 7:45 p.m.
BUILDING INSPECTOR'S RKP`QRT:
A. City'�Offce ,Reef.Rpair- Inspector Rosenau reported that the

spring to avoid major damage inside. The entire roof should be
removed and replaced. He received one quote for $1500 to remove
and replace the existing roof.

replaced and insulation put in both roof areas.
TKDA has offered to assist the Inspector in writing up the specs.
The Inspector requested the Council authorize him to work with
the Engineer.
Morgan moved, seconded by Mottaz, to authorize the Building
Inspector to solicit bids for repair and insulation work on the
City Office roof, the garage roof to be bid as an alternate.
The Engineer is authorized to work with the Building Inspector
in drafting the specifications at a cost not to exceed $300.
Motion carried 5-0. The roofing work will conform with future
remodeling of the 'City Office.
Mayor Armstrong said the Council will call a special meeting to
review and award the low bid so that this work can be completed
before winter.

bars will be needed in the restrooms.
Morgan moved, seconded by Armstrong, to appropriate $180 for
grab -bars in the restrooms of the Park Shelter. Mention carried
5-0.

show d be ready for winter occupancy.
AUDITORS CONTRACT: Tabled until October 21, 1980.
SPEED ZONE RESOLUTION ON DEMONTREVILLE TRAIL: Armstrong moved,
seconded by Mottaz, to adopt Resolution 80-57, a resolution
requesting Washington County to take whatever steps are necessary
to reduce the speed limit to 30•MPH, and post same; on
DeMontreville Tr. N.; 50th Street N., and Olson Lake Tr. N.
Motion carried 5-0.
PARK ITEMS: A. Hay Croi, Sunfish Lake Park - Morgan reported that
the Park Commission has decided they dommnot want to pursue renting
the land in Sunfish Park and will just cut the weeds.
Morgan moved, seconded by Mottaz, to instruct the Maintenance
Department to use the City mower and cut the weeds in Sunfish
Park. Motion carried 5-0.
B. Park Trails- Councilman Morgan has received two quotes for
constructionof gravel trails in Sunfish Park. Pebble Park, and
Tablyn Park. Both quotes were over $10,000.making it necessary
for the City to advertise for bids. Morgan stated this work
must be completed in 1980 or the City will loose the grant money.
Armstrong moved, seconded by Mottaz; to authorize the Engineer
to work with Councilman Morgan in preparing specifications and
advertising for bids for trails in Sunfish Park, Pebble Park,
and Tablyn Park. Bids should reflect that the project be completed
by December 1, 1980. Motion carried 5-0. (Note: Other park items
later in meeting.)

RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION BY THE CITY OF LAKE ELMO REQUESTING THE
COUNTY OF WASHINGTON TO REDUCE THE SPEED LIMIT ON
PORTIONS OF' DEMONTREVILLE TRAIL NORTH, 50th STREET
NORTH, OLSON LAKE TRAIL NORTH, AND COUNTY ROAD 13.
WHEREAS, the City of Lake Elmo is concerned about the
excessive speed of vehicular traffic on certain streets in the
city; and
WHEREAS, the city believes the present speed limits on the
following described streets to be too high, to -wit:
Demontreville Trail North
50th Street North
Olson Lake Trail North
County Road 13 from 38th Street North to State Highway 36,
and
WHEREAS, the City Council feels the appropriate speed limit
on these streets is 30 miles per hour;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Lake Elmo hereby requests the County of Washington
to proceed with whatever steps are necessary to lower the speed
limits on the above described streets to 30 miles per hour and
thereafter to post said speed limits on said streets.
Adopted by the City Council, City of Lake Elmo, this 7th day
of October, 1980.

opened the public hearing at 8:15 p.m„
Engineer Bohrer presented his Preliminary Report on Alterr.Lat.ives
to remove the flood waters from Little Sunfish and _protect the
Cimarron Treatment Pl.ant,. Alternatives include:
a flood protection dike around the treatment plant - estimated
cost $15,000;
2„ pumping the flood waters to Horseshoe Lake - estimated cost
$10,800;
3, construction of a controlled gravity outlet to Horseshoe
Lake - estimated cost $33,200.
The Engineer'stated several other alternatives were considered
but were not feasible. These are listed in his report.
The Engineer recommended Alternate 1 as an immediate means of
protecting the treatment plant this fall and Alternate 3 be
initiated in the spring of 1981 as a permanent measure, The
Engineer stated, without some improvement, the treatment plant
stands. a 90% chance of being flooded by the spring run-off.
Audience Comments:
Tom Noyes, Bonestroo and Associates, questioned the feasibility
of Alternate I and its impact with possible damage,on the
treatment tank if the water outside the dike surrounding the
plant were raised 5 ft. The Enuineer did not believe this would
be a problem unless the soil underneath the tank is saturateda
He does not believe this to be the case, :but, agreed this should
Pe.Studied.further. Noyes recommendM pumping be started, as
soon as possible.
Cimar.ron's position is that the City adopt Alternatives 2 and 3.
Mr. Taylor stated that if there is any possibility of getting
the pipe from Little Sunfish to Horseshoe in the ground before
winter it would be the best solution.
Mayor Armstrong said Alternate 3 cannot be initiated without
Valley Branch and DNR approval.
Mrs. Leslie asked where the additional nonding areas are in
Cimarron that were mentioned when the Citv considered using
Cimarron"s treatment plant? Mr. Noyes indicated he was not aware
of additional ponding areas on Cimarron's property. Additional
ponds were not considered necessary at the time.
Al Lehman, Civil Engineer, 3M - has been monitoring the water
levels on Tartan Park's property since 1975, He feels it will
be necessary to pump much more than the proposed 125 acre feet
because of ground water storage. Valley Branch has required
them to handle their excess water on -site and not discharge it
downstream. He expressed concern about damage to property in
West Lakeland,
Councilman Mottaz said he does not think permits from Valley
Branch and the DNR for Alternate 3 could be obtained before six
months.

LITTLE SUNFISH: Don Smith, Attorney for Homeowners Association
stated that the City is being asked to make available the vehicle
(pipe) for a permanent solution, after which the Watershed can
determine how and when it should be used He generally agreed
with the Engineers conclusion, that a temporary safeguard should
be instituted this fall... Failure of the plant would create a
health hazard.
Mottaz said the City cannot initiate any project without the
necessary permits. The immediate problem has to be taken care
of jAlternate 1), then, the necessary steps can be taken to
find a permanent solution.
Mrs Leslie asked if the Main Stem Project had a pipe running from
Sunfish to Horseshoe. She said Al Fandry, Barr Engineering,
indicated to her that he would prefer the pipe go down Minnehaha.
Birger Olson, Cimarron Iiomeowner President, said the primary
concern of the residents is the health hazard should the plant
wash out.
Jim Palmquist, 3M, suggested testing the plant and aet information
on the stability of the ground under the tank and determine the
condition of the tank.
Armstrong moved, seconded by Mottaz, to continue the hearing
until October 21, 1980, at 8:30 p.m, The Engineer is instructed ,
to continue to investigate the alternatives; contact the
Valley Branch Watershed District and the DNB to get their
reaction to the proposed alternatives; and,:id6terrftine-,if_ test wells
are necessary to decide whether diking is possible or if pumping
is necessary .
Mottaz moved, -seconded by..Ar4istrong, to amend the motion to include
sleeking temporary pumping permits, bogin the process
for Alternate 3, and seek permits for diking, if necessary.
Motion 6—ar-ied'5-0.
Discussion: Councilwoman Novak feels Cimarron should meet the
same requirements as other developers and find alternate ponding
areas on their property. The City should not pump water downstream
until the impact of such action is determined.
Mottaz said the issue is the City's responsibility to assure 1300
people a safe place to live. This problem was not caused by
Cimarron.,
Morgan said Valley Branch must provide storage up -stream as part
of resolving problems downstream.
Motion carried 5-9.

BROOKS SUPERETTE LIQUOR LICENSE: Mayor Armstrong recommended that
the Brooks representative contact the City Administrator on the
City''s licensing policy. (Note: this is not a State license. It
is a City license.)
RICHARD MILLER VARIANCE HEARING TO BUILD A GARAGE CLOSER TO THE
ROAD AT 11055 32ND STREET N.:
Mayor Armstrong opened the hearing at 9:45 p.m. Mr. Miller's
property is not wide enough to allow the garage to be placed next
to his residence. Access would be impossible to the south which
faces Lake Elmo.
The Building Inspector does not feel building the garage in this
location will cause any problems. Residents on either side of
Millers' sent letters indicating on objection. There was no one
in the audience for the hearing.
Armstrong moved, seconded by Mottaz, to approve a variance for
Richard Miller, 11055 32nd Street N., to build a garage in front
of the primary residence, 25 ft. from the road. Motion carried 5-0.

S. ODIN OLSON - VARIANCE HEARING TO BUILD. A GARAGE 88 SQ. FT MORE
THAN THE ORDINANCE ALLOWS AND AT A HEIGHT 2 FEET HIGHER'.. THAN PERMITTED,
AND LOCATED CLOSER TO THE ROAb THAN THE PRINCIPAL. BUILDING, AT 7920

( Mayor Armstrong opened the hearing at 9:55 P.M.
l Mr. Olson proposes to build a 32' x 34' garage. He requests a variance from the
19000 sq ft. requirement for accessory buildings so that he can put his RV
k10/21/80 camper and other vehicles inside,* The garage will be 2 ft. higher than
the garagethe required 14 ft. to accomodate the RV, but will be lower than the house,
to be 2f t due to the terrain of the lot. Because of the configuration of the lot (1+ acres)
nigher thaitth Lake DeMontreville to the rear of the property, the garage cannot be
the max- placed behind or to the side of -the principal building. This house existed
Lmum 14f t before the current ordinance.
The Building Inspector recommended approving the three variances. There were
no audience comments. Letters from surrounding neighbors stated no objections.
Armstrong moved' seconded by Morgan, to approve the following variances for S.,
Odin Olson: variance for anyadditional 88 sq ft.; variance for the garage
to be 2 ft. above the required lit ft; and a variance to place a. garage in
front of the principal building. Motion carried 4-1. Pott opposed. Pott
objects to the 88 sit, ft. variance from the 1,000 sq. ft. allowed by Code.
RENATE PUALSEN - CIVIL DEFENSE: Mrs. Paulsen submitted her resume and a proposed
Civil Defense and Disaster Plan. The Council explained this is a voluntary,
part-time job, at this time. Mrs. Paulsen asked if the City would pay her
mileage. Mayor Armstrong indicated this would be agreeable. The City has paid
all expenses in the past. Mrs. Paulsen will work with the are Chief, the
Administrator and the office staff to coordinate a plan.
Armstrong moved, seconded by Mottaz, to appoint Renate Paulsen as the Civil
Defense Director of Lake Elmo. Motion carried 5-0.
RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ACCEPTING THE IMPROVEMENTS I'N THE PLAT
OF FOXFIRE ESTATES AND RELE4SING THE REMAINING DEVELOPERS
BOND.
WHEREAS, the developers of Foxfire Estates have completed
the improvements required under the Development Agreement
between the City and said developers dated October 27, 1978; and
WHEREAS, street improvements were accepted for winter
maintenance on December 20, 1979, and all other improvements
have been inspected by the City Engineer who has now recommended
a final. acceptance of all improvements required under the
Development Agreement with the City; and
WHEREAS, Section 401.510 D provides that the subdivider
shall warrant the said improvements for one (1) year after
their acceptance;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of. Lake Elmo as follows:
1. The street improvements, storm sewer improvements,
and entry monuments constructed by the developer be, and the
same hereby are, accepted by the City Council for maintenance
subject to the right of the City to require the developer to
perform any corrective work which may appear necessary to the
City Engineer for a period of one (1) year from the date of the
adoption of this Resolution.
2. The City acknowledges the installation of certain
utility improvements by the developer and various public utilities
in the plat of Foxfire Estates; however, the City accepts no
responsibility whatsoever for maintenance of these utility
improvements.
3. The developers bond or other security deposit which
was previously reduced to the sum of $5,000.00 is hereby released,

subject to the developer paying any remaining pass -through costs
owed to the City of Lake Elmo.
Adopted this 7th day of October, 1980, by the City Council
of the City of Lake Elmo, Washington County, Minnesota.

ENGINEPR'S REPORT: A. Foxfire Bond - 'The permanent; easements for the Foxfire
monuments have been secured; and the Engineer recommends releasing the remaining
developer's bond.
Armstrong moved, seconded by Pott, to adopt 13 80-58, a resolution releasing
the remaining developer's bond for Poxfire Estates, accepting the entry
monuments, and accepting the deeds. Motion carried 5-0,
B. Derrick Bond - Not ready
C. Jamaca Gate - The Engineer recommended the gate be 12 .ft. wide to allow the
City grader, plow, and fire trucks accessibility. The Council agreed with
the recommendation.
PARK BUSINESS: A. Cub Football - District 834 - District 834 has requested the
use of Lions Park three days a week. The Council had no objection to the days
or the times and agreed to waive the rental and clean-up fees.
B. Sunfish Park Security Light - The Council directed the Administrator to
notify NSP to,,,install a security light at the Sunfish Park entry gate.
C. Methane Gas - Morgan reported that funds are available to explore the use of
methane gas as fuel. He will pursue this as a possible fuel source for the
maintenance garage at the landfill.
