RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY; MINNESOTA
A RESOLUTION COMMENDING MICHAEL JOHNSON FOR SERVICE TO
THE COMMUNITY AND THE CITY OF LAKE ELMO* AS A MEMBER
OF THE JAYCEES, THE PARK COMMISSION, AND THE CITY COUNCIL
WHEREAS, Michael Johnson served the community as a
member of the Lake Elmo JAYCEES from 1972 to the present,
and as an officer; and worked on many community improve-
ment projects; and,
WHEREAS, Michael Johnson was a charter member of the
Lake Elmo Park Advisory Committee and served on its
successor, the Lake Elmo Park Commission from May 17 1973
until December 31, 1978; and also served as an officer
thereof; and,
WHEREAS, Michael Johnson served on the Lake Elmo City
Council from January 1, 1979 until December 31, 1979;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the Cl y of Lake Elmo;
THAT, Michael Johnson be and is hereby commended for
his efforts on behalf of and service to the City of Lake
Elmo and the communitY; and,
THAT, this City Council award a "Certificate of
Appreciation" to Michael Johnson for his devotion to the
concerns of bhe"Community and the City from 1972 through'.
1979.
ADOPTED, this the 2nd day of January, 1980, by the City

CITY OF LAKE I:LMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION AUTHORIZING DISTRIBUTION OF THE
COUNTY EMS SUBSIDY AND DESIGNATING THE. CITY
OF STILLWATER AS RECEIVING GOVERNING BODY TO
DISTRIBUTE SAME,
WHEREAS. the Washington County Board of Commissioners
have provided $15,622 for distribution to the Emergency Ser-
vice Area cc;nprised of the communities that are a party of
this resolution? and
WHEREAS, Washington County required that the commun-
ities comprising the Emergency Service Area do agree to an
equitable distribution of this subsidy;
WHEREAS, the Emergency Service Area is comprised of
the following communities:
City of. Stillwater
City of Oak Park Freights
City of Bayport
City of Lake Elmo
West Lakeland Township
Stillwater Township
Grant Township
Baytown Township
NOW, THEREFORE, BE IT RESOLVED by the City of Lake Elmo
that the sum of $15,622 be distributed to the Stillwater Rescue,
Lake Elmo Rescue, Bayport Rescue and the Stillwater Ambulance
Service on a pro-rata basis in 1980 based upon the number of
runs by each service during the year 19791
That the City of Stillwater is hereby designated as the
receiving government body for these county funds and shall be
obligated to make distribution to the respective services pur-
suant to this resolutions "
That the City of Stillwater submit a year-end report to
the Washington County's Community Health Services office by
February 15, 1981 showing the manner in which the $15.622 was
distributed to each service provider.;

efficient manner of distributinq future Emergency Medical
Services subsidies,

TO THE LAKE.ELMO CITY COUNCIL
WHEREAS, Michael Johnson resiqned from the City-_
Council effective January 1, 1980; and,
WHEREAS, the term of Michael Johnson runs through
December 31, 1982; and
WEREAS, the Minnesota State Statutes provide that
the City Council shall appoint a person to fill the re-
mainder of the unexpired term when a vacancy occurs on
the City Council; and,
WHEREAS, Carol Jeanne Novak has applied for the
vacancy, is qualified to serve, and successfully inter-
viewed for the position with the City Council;
NOW, THEREFORE, BE IT' RESOLVED BY THE CITY COUNCIL
OF THE CITY OF LAKE ELM6:
THAT, Carol Jeanne Novak is appointed to fill the
vacancy on the City Council created by the resignation of
Michael Johnson; and
THAT, Carol Jeanne Novak shall serve from January 15,
1980, until December 31, 1982,
ADOPTEn this the 2nd, day of January, 1980, by the
City Council of the City of Lake Elmo.

RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, M:INNESOTA
A RESOLUTION VACATING EAST SHORE LANE IN LANE'S
DEMONTREVILLE COUNTRY CLUB ADDITION.
WHEREAS, at a regular meeting of the City Council of
the City of Lake Elmo, Washington County, Minnesota, held on
January 2, 1980, a Petition was presented to the City Council
praying for the vacation of a certain public street in the
plat of Lane's Demontreville Country Club Addition described
as follows:
East Shore Lane lying between Lots 480 and 482
and lying between Lots 655 and 657 reserving;
however, the drainage easement over and across
the same property which was previously deeded
t separately to the City;
WHEREAS, said Petition came on for hearing before said
City Council at a regular meeting thereof held
on Wednesday, January 2, 1980 at 8:00 p.m. in the City Hall
pursuant to Notice thereof published and posted as required
by law; and
WHEREAS, the City Council has reviewed this Petition
with concern for the interests of the public; and
WHEREAS, East Shore Lane proposed for vacation has
never been opened or used for a public street and it is
improbable that there will ever be any public need for said
street; moreover, by vacating the same, the property will be
returned to the tax rolls and would enhance the taxable value
of all the lands abutting thereon or affected thereby; and
WHEREAS, for the foregoing reasons, it appears to be in ,
the public interest to vacate East Shore Lane as described above;
NOW, THEREFORE, BE IT RESOLVED, that East Shore Lane
as dedicated in the plat of Lane's Demontreville Country Club
Addition described above be, and the same hereby is, vacated.
BE IT FURTHER RESOLVED, that the Clerk shall prepare a
Notice of completion of these proceedings which shall contain
the name of the City, and the identification of the vacation,
a statement of the time of completion thereof and a description
of the real estate and land affected thereby. Such Notice
shall be presented to the Washington County Auditor who shall.
enter the same in his transfer records and note upon the
instrument over his official signature the words "entered
in the transfer records". The Notice shall then be filed with
the County Recorder, all as required by Section 368.01 Subdivision
25 of the Minnesota Statutes.

A RESOLUTION VACATING NORTH SHORE LANE IN LANE'S
DEMONTREVILLE COUNTRY CLUB ADDITION.
WHEREAS, at a regular meeting of the City Council of
the City of Lake Elmo, Washington County, Minnesota, held on
January 2, 1980, a Petition was presented to the City Council
praying for the vacation of a certain public street in the
plat of Lane's Demontreville Country Club Addition described
as follows:
North Shore Lane lying between Lots 418 and 419;
WHEREAS, said Petition came on for hearing before said
City Council at a regular meeting thereof held at 8:00 P.M.
( on Wednesday, January 2, 1980 in the City Hall pursuant to Notice
thereof published and posted as required by law; and
WHEREAS, the City Council has reviewed this Petition
with concern for the interests of the public; and
WHEREAS, North Shore Lane proposed for vacation has
never been opened or used for a public street and it is

RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION REDUCING THE DEVELOPER'S PERFORMANCE BOND
AND EXTENDING THE TIME OF COMPLETION FOR THE PROJECT
KNOWN AS THE BROOKMAN ADDITION
WHEREAS, the Developers of Brookman Addition have completed
a substantial amount of the improvements required for final
approval by the City; and
WHEREAS, the Developers have been unable to complete the
project on its original completion date;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo as follows, to -wit:
1. The Developer's Performance Bond for the Developer
of Brookman Addition may now be reduced to the sum of $4,000.00.
2. The Developer's time of project completion is hereby
extended to June 1, 1980, to allow adequate time to complete
the project in favorable weather.

NOW, THEREFORE, BE IT RESOLVED by the City Council,
of the City of Lake Elmo;
THAT, $13,847.00 in the Road Project Fund are here-
by transferred to the 1974 Street Improvement Fund; and,
THAT, all other assets, including future assessments,
of the Road Project Fund are hereby transferred to the
General Fund.

WHEREAS, the City of Lake Elmo finds the following:
1. The City has appropriate cash reserves;
and,
2. The City has incurred expenses which
should properly be appropriated from
said reserves; and,
3. The City has adequate reserves to meet
these expenses
NOW, THEREFORE, BE IT RESOLVED by the City Council-,
City of Lake Elmo;
THAT, the following reserves are appropriated to
the General Fund to pay for these expenses as indicated
below:
1. Maintenance Equipment Sinking Fund--
$27,647.74, for the Maintenance garage;
and,
2. Emergency Road Maintenance and Road
Construction Fund--$18,977.73; for
MSI #1; $1862.45 for the improvement
of the parking area and driveway at
the Maintenance Garage; and,
3. Building Construction Sinking Fund.--
$3,292.00 for the City Office roof, and,
$31,723.62 for the Maintenance Garage; and,
4. Fire Equipment Sinking Fund--$27,693. for

THAT, the following reserves are eliminated by
appropriating the amounts indicated below to the General

A RESOLUTION ACCEPTING THE IMPROVEMENTS IN THE PLAT OF
EDEN PARK SECOND ADDITION AND RELEASING THE REMAINING
DEVELOPER'S BOND
WHEREAS, the Developers of Eden Park Second Addition have
completed the improvements required under the development agree—
ment between the City and said developers dated January 9, 1978;
and
WHEREAS, all improvements required under said development
agreement have been installed by the developer and inspected by
the city engineer who has now recommended final acceptance of all
the improvements required under the development agreement with
the City; and
WHEREAS, Section 401.510D of the Lake Elmo Municipal Code
provides that the developers shall warrant the said improvements
for one (1) year after their acceptance;
NOW, THEREFORE,BE IT RESOLVED, by the City Council of the
City of Lake Elmo as follows, to —wit:
1. The street improvements and storm sewer improvements
constructed by the developer of the plat Of Eden Park Second
Addition be, and the same hereby are, accepted by the City for
maintenance subject to the right of the City to require the
developer to perform any corrective work which may appear to be
necessary to the City for a period of one (1) year following the
adoption of this resolution.
2. The City acknowledges the installation of certain utility
improvements by the developer and various public utilities in�the
plat of Eden Park Second Addition; however, the City accepts no
responsibility whatsoever for maintenance of these utility improve—
ments.
3. The developer's bond or other security deposit which was
previously reduced to the sum of $11,000.00 is hereby released,
subject to the developer paying any remaining pass —through costs
and park dedication fees owed to the City of Lake Elmo.

A RESOLUTION REQUESTING THE MINNESOTA DEPARTMENT OF
TRANSPORTATION TO ESTABLISH SPEED ZONES ON CERTAIN
STREETS WITHIN SAID CITY.
WHEREAS, the City Council of the City of Lake Elmo is
concerned about vehicular traffic on its streets and that
said vehicular traffic should travel at speeds which are not
excessive; and
WHEREAS, it has come to the attention of the City Council
that there currently is vehicular traffic on certain streets
in the City which is traveling at excessive speeds;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the. City of Lake Elmo as follows, to -wit:
1. The City Council hereby requests the Minnesota
Department of Transportation to establish a thirty (30) mile
per hour speed zone for a portion of Lake Jane Trail between
Ideal and Jamaca.
2. The City Council requests the Minnesota Department
of Transportation to establish. a thirty-five (.35) mile per
hour speed zone on a portion of Jamaca between Jane Road North
and 45th Street North.

WHEREAS, the City Council of the City of Lake Elmo
did on October 21, 1980, adopt a Resolution for a pumping
project from Little Sunfish Lake to Horseshoe Lake; and
WHEREAS, additional evidence brought to the attention
of the City Council indicates an alternative method exists
to pump the excess surface water along County Highway 70 to
an area known as the West Lakeland storage site.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo as follows, to -wit:
1. Resolution R-80-61 adopted October 21, 1980, is hereby
rescinded.
2. The City Council hereby directs the City Engineer
to commence.pumping a maximum of 60 acre feet of excess storm
water from Little Sunfish Lake along County Highway 70 to
the West Lakeland storage site.
3. At all times during said project, the water being
pumped into the West Lakeland storage site will be kept at
least one (1) foot below the overflow level of the storage
site.
4. The City will frequently monitor the site to determine
the elevation of the pumping into the site.
5. The City of Lake Elmo will store an additional 75 acre
feet of surface water on Eagle Point Lake until an agreement
is reached between the City of Lake Elmo, the Valley Branch
Watershed District and the Town of West Lakeland to allow for
the release of this water downstream and that hopefully, said
agreement can be reached within one (1) year from the date
hereof.
6. The City of Lake Elmo will meet with the Valley Branch
Watershed District, the Town of West Lakeland, the City of
Oakdale and the residents of Cimarron to work on additional
storage sites and their acquisition.

CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ORDERING A PUMPING PROJECT TO REDUCE
THE FLOOD WATERS ON SUNFISH LAKE IN SECTION 25 AND
36 IN SAID CITY.
WHEREAS, the City Council on September 16, 1980, ordered
the City Engineer to prepare a Feasibility Report on a possible
pumping project to reduce the flood waters on Sunfish Lake
in said City; and
. WHEREAS, said flood waters are presently and continue
to endanger the. sewage treatment plant that serves Cimarron,
an area of 1300 homes in said City; and
WHEREAS, said City Engineer has returned said Feasibility
Report which.finds that said proposed project is feasible; and
WHEREAS, a public hearing on the feasibility of said
project was held October 7, 1980, and again on October 21, 1980;
NOW, THEREFORE, B.E IT RESOLVED, by the City Council of
the City of Lake Elmo as follows:
1. The City shall, as soon as possible, commence a
pumping project to remove approximately 60 acre feet of water
from Little Sunfish Lake to Horseshoe. Lakein said City.
2. The City shall make immediate and timely request for
all necessary permits from the Valley Branch. Watershed District,
the Minnesota Department of Natural Resources and any other
required permits.
3. The City shall also secure the necessary easements.
4. The City Administrator i.s directed to organize a
committee to meet with the Town of West Lakeland to discuss the
impact of this action on the residents of West Lakeland and
Lake Elmo and to assure them this project is a one (1) year
temporary project after which Lake Elmo will work on a permanent
solution.
5. The City of Lake Elmo also intends to store a
minimum of sixty (60) additional acre feet on Eagle Point
Lake and to secure the necessary permission to do so.
6. The City Engineer is further instructed to determine
any possible damage that may be caused downstream as a result
of this pumping project through the Town of West Lakeland and
in the event said pumping appears to be causing problems, a
special meeting will be called between the City of Lake Elmo,
the Valley Branch Watershed District and the Town of West
Lakeland and concerned residents so that a decision can be
made at that time as to whether the pumping should be continued.
7. The City also intends to continue to explore potential
storage sights in the County Park.

WHEREAS, the County of Washington has submitted to the
City of Lake Elmo a Petition praying for the vacation of
a portion of a public street in said City legally described
as follows, to -wit:
That part of 15th Street North, commencing
at the West Quarter Corner of said Section 27;
thence North.89 degrees`11 minutes 48 seconds
East (Bearing based on the Washington County
Coordinate System South Zone) along the East
West quarter section line of said Section 27
for 1761.70_feet to the point of beginning of
that part of 15th. Street North to be vacated,
said point of beginning alsobeing a point in
the center line of 15th Street North; thence
continuing in an easterly direction along the.
traveled center line of said 15th. Street North.
to a point where said traveled center line inter-

needed as a public street; moreover, by vacating the same, the
property will be returned to the tax rolls and will enhance the
taxable value of all the lands abutting thereon and affected
thereby; and
WHEREAS, for the foregoing reasons, it appears to be in
the public interest to vacate the street described above;
NOW, THEREFORE, BE IT RESOLVED, the above -described
street be, and the same hereby is, vacated.
BE IT FURTHER RESOLVED, that the Clerk shall prepare
a Notice of Completion of these proceedings which shall
contain the name of the City, and the identification of the
vacation, a statement of th.e time of completion thereof and
a description of the real estate and land affected thereby.
Such Notice shall be presented to the Washington County Auditor
who shall enter the same in his transfer records and note upon
the instrument over his official signature the words "Entered

WHEREAS, the developers of Demontreville Highlands
5th. Addition and Demontreville Highlands Gth. Addition have.
completed the street improvements and storm sewer improvements
required under the Development Agreements between the City and
said developer; and
WHEREAS, said street improvements and storm sewer improve-
ments have been inspected by the City Engineer and said City
Engineer has recommended acceptance of these improvements; and
WHEREAS, the City Engineer has reported to the City
Council that some ditching and cleanup work of a pond remain
to becompleted, but that the developer and the City Engineer
feel this final work cannot be done until the Spring of 1981; and
WHEREAS, the City Engineer has recommended the City retain
a bond of $5,000.00 to assure completion of the ditching and
pond cleanup; and
WHEREAS, Section 401.510 D of the Subdivision Ordinance
provides the subdivider shall warrant the said improvements
for one (1) year after their acceptance;

be necessary to the City for a period of one (1) year following

2. The City acknowledges that some final cleanup work
remains to be done relating to a ditch and a pond and that
this work will be completed as early as possible in the Spring
of 1981. In order to complete this work, the developers bond
shall be reduced to the sum of $5,000.00.
3. The City acknowledges the installation of certain
utility improvements by the developer and various public
utilities in the plat of Demontreville Highlands 5th Addition
and Demontreville Highlands 6th Addition; however, the City
accepts no responsibility whatsoever for maintenance of these
utility improvements.

A RESOLUTION BY THE CITY OF LAKE ELMO REQUESTING THE
COUNTY OF WASHINGTON TO REDUCE THE SPEED LIMIT ON
PORTIONS OF DEMONTREVILLE TRAIL NORTH, 50th STREET
NORTH, OLSON LAKE TRAIL NORTH, AND COUNTY ROAD 13.
WHEREAS, the City of Lake Elmo is concerned about the
excessive speed of vehicular traffic on certain streets in the
city; and
WHEREAS, the city believes the present speed limits on the
following described streets to be too high, to -wit:
Demontreville Trail North
50th Street North
Olson Lake Trail North
County Road 13 from 38th Street North to State Highway 36;
and
WHEREAS, the City Council feels the appropriate speed limit
on these streets is 30 miles per hour;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Lake Elmo hereby requests the County of Washington
to proceed with whatever steps are necessary to lower the speed
limits on the above described streets to 30 miles per hour and
thereafter to post said speed limits on said streets.

CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION AUTHORIZING CERTAIN IMPROVEMENTS OF PRIVATE
PROPERTY ADJACENT TO LEGION POND IN THE CITY OF LAKE ELMO
WHEREAS, the City Council has reviewed the Petition from
Thomas Deck, William Petersen, and Rodney Toft to fill their
lots and do all work necessary to make -their Septic Systems
workable and to bring those systems up to city standards;
and,
WHEREAS, the City Council is aware of the problem of fail-
ed Septic Systems of private homes adjacent to Legion Pond;
and,
WHEREAS, the land owners adjacent to Legion Pond have re-
quested the Council to order the improvements of the private
Septic Systems so as to enable the improvement to be a cost
of the city and assessable against the benefited property;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Lake Elmo, as follows:
1. The city hereby authorizes the improve-
ment of the Septic Systems on lots 8, 9
and 10, Myron Elman Subdivision in said
city.
2. The City Engineer shall begin all studies
necessitated by said improvement and
shall take bids to implement said filling
project. Depending upon the amount of
suitable fill available at the City of
Lake Elmo Landfill it is understood that
one-fourth of the amount will be allocated
to Mr. Dan Co.11yaxd with the remaining fill
to be distributed equally among Mr. Thomas
Deck, Mr. William Petersen and Mr. Rodney
Toft. Any additional fill will be purchased
if the city fill is inadequate or if a less
expensive source is available.
3. The filling process shall begin immed-
iately upon acceptance of the low bid-
der for hauling and supplying said fill.
4. The City Engineer shall check the three
systems within seven months to determine
what additional work may be necessary to
bring these Septic Systems and Drain
Fields into compliance with the applicable
city ordinances.
5. The city and the petitioners shall enter
into a Hold Harmless Agreement prior to
commencing any work and said agreement
shall provide the City of Lake Elmo shall
be held harmless from any liability that
may arise out of the project or the fail-
ure of any Septic System or Drain Field
which is a part of this project.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ADOPTING BUDGET FOR 1981 AND LEVYING TAXES
FOR THE YEAR 1981
WHEREAS, the City Council of the City of Lake Elmo has here-
tofore considered and has unanimously adopted a budget setting forth
in detail complete financial plans of the City for the year 1981; and
WHEREAS, the City Clerk/Treasurer (City Administrator) at
direction of the Council has computed the amount of taxes necessary
and within statutory limits which must be levied and collected during
the year 1981.in order to provide the budgeted funds; and
WHEREAS, the City Council of the City of Lake Elmo has con-
sidered the said proposed levy and determined the same to be necessary
in the public interest;
NOW,THEREFORE, BE IT RESOLVED, by the City Council of the
City of Lake Elmo that the attached budget is hereby adopted and
approved as the budget for the City of Lake Elmo during the year 1981,
and the sums of $ 200,000or 9,5milswhichever is less, is hereby levied
in order to provide the City with the funds required by said budget
and that the sum of $5,500, Special Assessment, and $80,000, General
Obligation, also be levied for 1981 Bonded Indebtedness.
BE IT FURTHER RESOLVED, that the Clerk/Treasurer (City
Administrator) is hereby directed to certify a copy of this resolution
to the County Auditor in accordance with law.

REPORT ON THE REDUCTION OF THE FLOOD
WATERS ON SUNFISH LAKE IN SECTION 25
& 36 ALL IN THE CITY OF LAKE ELMO
AND ORDERING A HEARING ON THE FEASI-
BILITY REPORT.
WHEREAS, the sewage treatment plant that
serves Cimarron may be flooded as a result of the
high water on Sunfish Lake; and,
WHEREAS, 1300 homes in Cimarron are served
by that see?age treatment plant; and,
WHEREAS, there is a need to determine the
most cost effective remedy to the high water in
Sunfish Lake; and,
WHEREAS, the City Engineer will be able to
prepare a feasibility report on that project be-
fore October 7, 1980; and,
WHEREAS, the floodwaters on Sunfish Lake may
be creating a public health and safety hazard which
may have to be solved before November 15, 1980.
NOW, THEREFORE, BE IT RESOLVED, by the City
Council of the City of Lake Elmo, Minnesota, Washington
County, Minnesota, that:
The City Council hereby orders the City Engineer
to prepare a Feasibility Report on the floodwater
problem on Sunfish Lake in Section 25 & 36; and,
The City Council orders the public hearing on
the feasibility of said project for October 7, 1980,
at 8:15 P,M., in the City Hall, of the City of Lake
Elmo.

A RESOLUTION AUTHORIZING THE CONDEMNATION OF REID
PARCEL FOR PARK PURPOSES BY MEANS OF EMINENT DOMAIN
PROCEEDINGS.
WHEREAS, the City Council of the City of Lake Elmo has
heretofore determined that it is necessary, advisable and
in the.public interest to establish certain parks within the
City; and
WHEREAS, in order to accomplish.such purposes it is necessary
to acquire the following described land, namely:
The East 726 feet of the South 1800 feet of the
Southwest Quarter (SW4) of Section 13, Township
29 North., Range 21 West, Washington County,
Minnesota, subject to an easement over the South.
33 feet for road purposes,
owned by Annabella Reid,
and the City has offered to purchasesuch land from said
owners at a price deemed by the Council to be favorable but the
owners have refused to accept such offer; and
WHEREAS, by reason of such such refusal to sell the lands
above described to the City, it has become necessary to procure such
lands by right of eminent domain.:
NOW, THEREFORE, BE IT RESOLVED, that the City of Lake. Elmo
proceed to procure title to such land under its right of eminent
domain and that the City Attorneys be and are hereby authorized
and directed to file the necessary Petition therefor and to
1prosecute such action to a successful conclusion or until it is
abandoned, dismissed or terminated by the City or by the Court;
that the City attorneys, the Mayor and the City Administrator
do all things necessary to be done in the commencement, prosecu-
tion and successful termination of such action.

RESOLUTION REQUESTING 1980-81 LOCAL PLANNING
ASSISTANCE ENTITLEMENT GRANT FUNDS FROM THE
METROPOLITAN COUNCIL.
WHEREAS, the Metropolitan Land Planning Act, Minn-
esota Statutes, Section 473.851-473.872, requires that
The City of Lake Elmo prepare and submit a comprehensive
plan to the Metropolitan Council; and,
WHEREAS, the Metropolitan Council and The City of
Lake Elmo have entered into a contract numbered 7889 dated
April 14, 1978 for Local Planning Assistance Grants which
was subsequently amended on October 3, 1978 and February
15, 1979, and in the amount of $11,249. to assist The
City of Lake Elmo in carrying out the required planning;
and,
WHEREAS, the Metropolitan Council, has allocated
$9879 to The City of Lake Elmo in additional grant funds
for 1980-81;and,
WHEREAS, The City of Lake Elmo has completed the
planning program required of it by the Metropolitan Land
Planning Act; and,
WHEREAS, the actual total cost of the required
planning activities was $38J022.43_as documented by the
final progress report attached hereto; and,
WHEREAS, the total grants from the Metropolitan
Council of $21128 will not exceed 75% of the total actual
cost of carrying out the required planning; and,
WHEREAS, grant funds from other sources, plus
Metropolitan Council grants, will not exceed 100% of the
actual planning cost.
NOW, THEREFORE, the City of Lake Elmo requests $9879
in 1980-81 entitlement funds and authorizes the Mayor to
execute the Agreement Amendment to the above -referenced
contract on behalf of The City of Lake Elmo.

WHEREAS, it is the 25th Anniversary of the founding of
the Tri-Lakes Association; and,
WHEREAS, The Tri-Lakes Association has provided great
service to the community by:
A. informing its residents through the Birchbark,
B. protecting residents with well and lake testing
programs,
C. assisting the City's policy process by studying
'City problems and participating in decision making,
and,
D. serving as a liaison between the City and the Tri-
Lakes area; and,
WHEREAS, the Tri-Lakes Association has fostered community
spirit, a sense of identity, and a forum for discussion of community
issues;

A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR A REAL ESTATE DEVELOPMENT SIGN FOR WILLARD MORTON.
WHEREAS, Willard Morton has applied to the City for a
Conditional Use Permit to place a real estate development
sign on the following described property located in the
City of Lake Elmo, Washington County, Minnesota:
The Southeast Quarter (SW,) of the Southwest
Quarter (SW-4) of Section Twenty-five (25),
Township Twenty-nine (29), Range Twenty-one (21)
West, Washington County, Minnesota;
WHEREAS, a Conditional Use Permit is required under the
applicable Section of the 1979 Municipal Code of Lake Elmo;
and;
WHEREAS, the City Planning Commission considered the
proposed Conditional Use Permit at a public hearing held
July 28, 1980, and recommended the approval thereof; and
WHEREAS, there does not appear to be any reason related
to the public health, safety and welfare which would require
a denial of the proposed Conditional Use Permit;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Lake Elmo, the application of Willard Morton
for a Conditional Use Permit to place a real estate develop-
ment sign upon the above -described property be, and the same
hereby is, granted subject to the following conditions:
A. Such sign shall not exceed one hundred (100) square
feet in area.
B. Only one such sign shall be erected.
C. Such sign shall be removed when the project is eighty
(80) percent completed, sold or leased. In all cases,
such sign shall be removed no later than two (2) years
after the project has been commenced, August 5, 1980
D. Such sign shall not be located closer than one hundred
(100) feet to any existing residence.
E. No Conditional Use Permit shall be issued for the
construction and erection of this sign until the
applicant shall execute an acceptance and consent
to these conditions.

WHEREAS, several septic tanks that serve property
along Jamaca Court have been under water as a result of
the high water on Beutels Pond; and,
WHEREAS, several homes along Jamaca Court have
been threatened by high water on Beutels Pond; and,
WHEREAS, the floodwaters on Beutels Pond have
created a public health and safety hazard;
WHEREAS, the most cost effective remedy to the
high water in Beutels Pond appears to be lowering the cul-
vert outlet to Beutels Pond; and,
WHEREAS, the City Engineer reports that the pro-
ject is feasible; and,
WHEREAS, the City Council held a public hearing
on the project on August 5, 1980 at 7:30 p.m..
NOW, THEREFORE, BE IT RESOLVED, by the City Council
of the City of Lake Elmo, Washington County, Minnesota,
that:
The City Council hereby accepts the Feasibility
Report on lowering the culvert outlet of Beutels Pond;
finds the project feasible; and,
The City Council hereby orders the project and
authorizes the Councillor Fran Pott and the City Adminis-
trator to order the materials, negotiate with "a qualified"
Construction Company to install the culvert and appertances
at a cost .for the completed project not to exceed $12,500.00.

WHEREAS, Roger Derrick, on behalf of. Derrick Land Company,

The City Engineer is hereby ordered to prepare a

Pond, acquire the necessary permits and easements, and estimate
the costs to those to be assessed, and,
A public hearing on the feasibility of said project
is hereby scheduled for August 5, 1980, at 7:30 p.m., in the

A RESOLUTION VACATING A PART OF BENNET AVENUE AND A
PART OF ARGYLE STREET IN LANE'S DEMONTREVILLE COUNTRY
CLUB ADDITION
WHEREAS, at a regular meeting of the City Council of
the City of Lake Elmo, Washington County, Minnesota, held on
January 2, 1980, a Petition was presented to the City Council
praying for the vacation of certain public streets in the
plat of Lane's Demontreville Country Club Addition described
as follows:
All that part of Bennet Avenue lying to the West of
a Southerly extension of the West line of Lot 138
and all that part of Argyle Street, lying between
a Westerly extension of the South line of Lot 342
and an extension of the Northerly line of Lot 325,
and all of Mack Avenue in the plat of Lane's Demontreville
Country Club Addition according to the plat thereof
on file and of record in the office of the County
Recorder in and for Washington County, Minnesota;
WHEREAS, said Petition came on for hearing before said
City Council at a regular meeting thereof held on Tuesday,
July 15, 1980 at 7:45 p.m. pursuant to Notice thereof published
and posted as required by law; and
WHEREAS, the City Council has reviewed this Petition
with concern for the interest of the public; and
WHEREAS, the streets proposed for vacation have never
been opened or used for public streets and it is improbable
there will ever be any public need for said streets; moreover,
by vacating the same, the property will be returned to the
ta.xrolls and will enhance the taxable value of all the lands
abutting thereon of affected thereby; and
WHEREAS, for the foregoing reasons, it appears to be
in the public interest to vacate the streets described above;
NOW, THEREFORE, BE IT RESOLVED, that the portions of
Bennet Avenue, Argyle Street and all of Mack Avenue described
above in the plat of Lane's Demontreville Country Club Addition
be, and the same hereby are, vacated.
BE IT FURTHER RESOLVED that the Clerk shall prepare a
Notice of Completion of these proceedings which shall contain
the name of the City, and the identification of the vacation,
a statement of the time of completion thereof and a description
of the real estate and land affected thereby. Such Notice
shall be presented to the Washington County Auditor who shall
enter the same in his transfer records and note upon the instru-
ment over his official signature the words "entered in the
transfer records". The Notice shall then be filed with the
County Recorder, all as required by Section 368.01, Subdivision
25 of the Minnesota Statutes.

WASHINGTON COUNTY, MINNESOTA
WHEREAS, Lake Elmo (lake) and Tartan Park have had
excessively high water levels on several occasions in the
past few years; and,
WHEREAS, these excessive levels have caused property
damage, threatened or damaged some on -site septic systems,
and caused hardship and inconvenience for a number of pro-
perty owners; and,
WHEREAS, the City expects approval from the Minnesota
Department of Natural Resources, Valley Branch Watershed
District, and Washington County, to store storm water on
Eagle Point Lake;
NOW, THEREFORE, BE IT RESOLVED, by the City Council
of Lake Elmo that:
1. The City of Lake Elmo will encourage the Valley
Branch Watershed District to vigorously pursue the Construc-
tion of an outlet to Horseshoe Lake so that excessive water
levels do not cause the backup of water into Tartan Park
and Lake Elmo (lake); and,
2. The City will cause the outlet,of Lake Elmo (lake)
to be clean to the invert level at all times. This will be
accomplished, primarily by detailed inspection and maintenance
in Early Spring, Mid -Summer, and Late Fall of each year; and,
3. Wherever the level of Lake Elmo is above the
invert, water will be detained upstream from Lake Elmo within
the guidelines established by the Minnesota Department of
Natural Resources, Valley Branch Watershed District and Wash-
ington County.

WHEREAS, the floodwaters on Legion Pond are creating
a public health and safety hazard:
NOW, THEREFORE, BE IT RESOLVED, by the City Council
of the City of Lake Elmo, Washington County, Minnesota,
that:
The City Council hereby accepts the Feasibility
Report on pumping the floodwaters from Legion Pbnd into
Lake Elmo with City pumps and irrigation pipe; and,
The City Council confirms the public hearing on the
feasibility of said project for July 8, 1980, at 7:30 p.m.

A RESOLUTION -ACCEPTING THE FINAL PLANS AND SPECIFICATIONS
FOR MSA PROJECT NO. 1, AND ORDERING THE ADVERTISEMENT FOR
BIDS.
WHEREAS, the City Council of the City of Labe Elmo, after
notice duly given in accordance with chapter 429 of the Minnesota
Statures, held a public hearing on ray 6, 1980, and continued it to
May 20, 1980, to consider the construction of the following street
improvements, 45th Street North from Jane Road North to Julep Avenue
North, Julep Avenue North from 45th Street North to 47th Street North,
and 47th Street North from Julep Avenue North to Keats Avenue North;
and,
WHEREAS, it appears to the City Council that it would be in
the best interest of the City and of the property adjacent to said
streets to proceed with said improvements; and,
WHERE -AS, the final plans and specifications prepared by the
City Engineer meet the requirements set forth by the City Council;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Lake Elmo, Washington, County, 7innesota, that.
The plans and specifications prepared by the City Engineer
for such improvements, copy of which plans and specifications are
attached hereto and made a part hereof, are hereby approved and shall
be filed with the City Administrator; and,
The City Administrator shall prepare and cause to be inserted
in the official newspaper and in the Construction Bulletin an advert
tisement for bids upon the malting of such improvements under such
approved plans and specifications; and,
The advertisement shall be published as required by law,
shall specify the work to be done, shall state that bids will be opened
and considered by the City Council at 10 o'clock a.m, on July 25th, 198.0.

A RESOLUTION AUTHORIZING THE TRANSFER OF
APPROPRIATED RESERVES TO THE GENERAL FUND
WHEREAS, the City Council of the City of Lake Elmo
appropriated the reserve funds of the City by Resolution
78-53A, December 19, 1978; and
WHEREAS, such reserves are appropriated to meet
the needs of the capital improvement program and emer-
gency needs; and,
WHEREAS, the culvert under 15th. Street is contin-
uously washing out because it is too small to handle
the volume of run-off generated by recent storms; and
44 feet of 24 inch culvert are needed to supplement the
existing culvert under 15th. streets;
NOW, THEREFORE, BE IT RESOLVED, by the City Council
of the City of Lake Elmo, Washington County, Minnesota,
that:
The City Administrator is authorized to transfer
$666.81 for 44 feet of 24 inch culvert and appertanances
from the Emergency Road Maintenance and Road Construction
Reserve to the General Fund.

A RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TO DR. RAYMOND B. SWANSON TO OPERATE THE OAK -
WOOD ANIMAL HOSPITAL.
WHEREAS, Dr. Raymond B. Swanson has applied to
the City of Lake Elmo for a Conditional Use Permit to
operate a veterinary clinic, animal hospital, crematory
& dog pound; and to sell pet drugs, supplies, and kennel
supplies, at 8611-34th. St. No., in said City; and,
WHEREAS, there does not appear to be any reason
related to the public health, safety and welfare which
would require denial of said Conditional Use Permit; and,
WHEREAS, the Planning Commission of the City of
Lake Elmo held a hearing on said application and recommends
approval thereof, of June 9, 1980; and,
WHEREAS, the Planning Commission of said City re-
commended the fee for said permit be waived for 1980;and,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF LAKE ELMO THAT:
1. Dr. Raymond B. Swanson is hereby granted a
Conditional Use Permit to operate a veterinary clinic,
animal hospital, crematory & dog pound; and to sell pet

A RESOLUTION APPROVING THE TRANSFER OF A CONDITIONAL USE
PERMIT TO OPERATE AN OPEN SALES LOT FOR MOBILE HOMES FROM
PATTI HOMES, INC. TO EQUITY HOMES, INC.
WIIERE;AS, Patti Homes, Inc. has a Conditional Use Permit
to operate an open sales lot for mobile homes in good standing; and,
WHEREAS, Patti homes, Inc. has leased the premises at 11450
Hudson Boulevard to Equity Homes, Inc.; and,
WHEREAS, Equity Homes, Inc. has agreed to honor all the
conditions set forth in said Conditional Use Permit and has applied
for a transfer of: said Conditional Use Permit from Patti Homes, Inc.
to Equity Homes, Inc.;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Lake Elmo, Washington County, Minnesota, that:
The transfer of the Conditional Use Permit to operate an
open sales lot for mobile homes at 1.1450 Hudson Boulevard from Patti
Homes, Inc. to Equity Homes, Inc. effective from January 1, 1980 to
December 31, 1980, be approved subject to the following conditions:
1. The storage building on said premises be kept up to
the standards of the State Building Code.
2. No storage of property not owned by or on consignment
to Equity Homes, Inc. shall be permitted, on the premises.
3. The mobile homes must be blocked up for safety.
4. These will be no repair work or maintenance on mobile
homes at the site.
5. Operating hours will be 9 a.m. to 9 p.m., Monday thru
Thursday; 9 a.m. to 6 p.m., Friday, except in the summer when they
will be 9 a.m. to 9 p.m.; 9 a.m. to 6 p.m., Saturday, and 12 p.m. to
5 p.m., Sunday.
6. The grounds will!.be kept in a neat and orderly manner.

A RESOLUTION ORDERING A FEASIBILITY REPORT ON TIIE
PUMPING OF TILE FLOOD WATERS OF LEGION POND TO LAKE
ELMO AND ORDERING A HEARING ON TIIE FEASIBILITY REPORT.
WHEREAS, several septic tanks that serve property along
Legion Avenue are under water as a result of the high water on
Legion Pond; and,
WHEREAS, several homes along Legion Avenue are threatened
by high water on Legion Pond; and,
WHEREAS, the most cost effective remedy to the high water
in Legion Pond appears to be pumping the floodwaters to Lake Elmo;
and,
WHEREAS, the City Council, from past experience, believes
the project may be feasible and wants to promote rapid consideration
of the Feasibility Study by the affected property owners; and,
WHEREAS, the floodwaters on Legion Pond are creating a
public health and safety hazard:
NOW,THEREFORE, BE IT RESOLVED, by the City Council of the
City of Lake Elmo, Washington County, Minnesota, that:
The City Engineer is hereby ordered to prepare a Feasibility
Report on pumping the floodwaters from Legion Pond into Lake Elmo
with City pumps and irrigation pipe, acquiring the necessary permits
and easements, and, for the purposes of relating costs to those to
be assessed, estimate the cost of pumping 30 acre feet from Legion
Pond to Lake Elmo; and,
A public hearing on the feasibility of said project is
hereby scheduled for July 0, 1980, at 7:30 p.m, in the City Ball,
of the City of Lake Elmo.

A RESOLUTION OPPOSING ONE FULL -TERM MEMBER FROM
RAMSEY COUNTY ON THE BOARD OF MANAGERS OF TI3E
VALLEY BRANCH WATERSHED DISTRICT.
WHEREAS, only two percent of the land area in the
Valley Branch Watershed District is in .Ramsey County; and,
WHEREAS, only 8.270 of the assessed valuation of the
District is in Ramsey County; and,
WHEREAS, there are only five (51 full -term managers
appointed to the Board of Managers of the Valley Branch Watershed
District to serve all areas of the District; and the City of
take Elmo believes representation of the Board of Managers of the
Valley Branch Watershed District should be in proportion to these
relationships; and,
WHEREAS, Ramsey County has requested the appointment of
one (1) full -term permanent manager be from Ramsey County;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo, Washington County, Minnesota that:
1. The City of Lake Elmo opposes redistribution of
the Board of Managers of the Valley Branch Watershed District
to permit one full -term permanent Manager from Ramsey County; and,
2. The City Council of the City of Lake Elmo respectfully
suggests that the next vacancy on the Board of Managers be filled
by the Ramsey County Board of County Commissioners for a term of
two years; and,
3. That representative be replaced with a representative
appointed by the Washington County Board of County Commissioners;
and,
4. Thereafter, this term alternate every two years
between Ramsey and Washington Counties.

A RESOLUTION OPPOSING THE RECLASSIFICATION OF LAKE
ELMO REGIONAL PARK RESERVE TO REGIONAL PARK
WHEREAS, All the property purchased for the Lake Elmo
Regional Park Reserve was purchased for the purpose of creating
a Park. Reserve; and,
WHEREAS, this area was designated and described as a
Park Reserve at all the public hearings and meetings concerning
the plans for the acquisition and the development of the Lake Elmo
Regional Park Reserve; and,
WHEREAS, none of the conditions surrounding the nature
of the land or its appropriateness for various uses have changed
since the land was acquired and the meetings on the Park Reserve
were held; and,
WHEREAS, the area purchased exceeds the desired size
for a Regional Park by 2,000 acres.; and,
WHEREAS, the development of more than twenty percent (20%)
of the land area would certainly over -tax Washington County's
ability to manage and the City of Lake Elmo's ability to accom-
modate this development; and,
WHEREAS, the development of more than twenty percent (20%)
of the land area would be out of character with the present and
planned uses adjacent to the Park Reserve property in Lake Elmo,
which are guided by Metropolitan Council policies; and,
WHEREAS, the Metropolitan Development Guide indicates
that this area is entirely outside of the Metropolitan Urban
Service Area;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo,Washington, County, Minnesota, that:
1. The City of Lake Elmo strongly opposes the reclassi-
fication of the Lake Elmo Regional Park Reserve to Regional Park;
and,
2. The City of Lake Elmo will oppose said reclassification
throughout the hearing and review process on the Metropolitan
policies with respect to the Lake Elmo Regional Park Reserve and
throughout the process of review and hearings for the plan and
development of the Lake Elmo Regional Park Reserve; and into the
courts if necessary.

RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ACCEPTING THE IMPROVEMENTS IN THE
PLAT OF SPRINGBORN'S GREEN ACRES
WHEREAS, the developers of Springborn's Green Acres
Subdivision have completed the improvements required under
the Development Agreement between the City and said developers,
dated January 8, 1979; and
WHEREAS, street improvements were accepted November 20,
1979, and all other improvements have been inspected by
the City Engineer and said City Engineer, by his letter of
May 30, 1980, has recommended acceptance of the improvements
and;
WHEREAS, Section 401.510D of the Subdivision Ordinance
provides that the subdivider shall warranty said improvements
for one year after their acceptance;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo as follows:
1. The turf restoration improvements of boulevards and
other disturbed areas constructed by the developer of the plat
of Springborn's Green Acres be, and the same hereby are,
accepted by the City Council subject to the right of the City
to require the developer to perform any remaining corrective
work which may appear to be necessary to the City Engineer
before June 3, 1981.
2. The remaining street improvements and storm sewer
improvements constructed by the developer of the plat of
Springborn's Green Acres be, and the same hereby are, accepted
by the City Council for maintenance subject to the right of
the City to require the developer `to perform any remaining
corrective work which may appear to be necessary to the City
Engineer before November 20, 1980.
3. The City acknowledges the installation of certain
utility improvements by the developer and various public
utilities in the plat of Springborn's Green Acres; however,
the City accepts no responsibility whatsoever for maintenance
of these utility improvements.

4. The developer's bond or other security deposit which
was previously reduced to the sum of $5,000.00 is hereby
released, subject to the developer paying the remaining
pass through costs owed the City of Lake Elmo.

A RESOLUTION GRANTING A MINOR SUBDIVISION AND REZONING
FOR WILLIAM LUNDQUIST
WHEREAS, William Lundquist has made application to the
City of Lake Elmo for a rezoning and minor subdivision on
the following described real estate located in the City of Lake
Elmo, Washington County, Minnesota, legally described as
follows, to -wit:
The East 787.00 feet of the North 657.77 feet of the
Northeast Quarter of the Northeast Quarter of Section 2,
Township 29 North, Range 21 West, Washington County,
Minnesota as measured at a right angle to the east and
north lines of said Northeast Quarter of the Northeast
Quarter, respectively, containing 6.53 acres, more or less,
exclusive of the T. H. No. 36 Highway Easement.
Subject to a road easement for public road purposes
over the South 30.00 feet thereof and also subject toa
highway easement along the north line thereof for T.H.
No. 36 as described in the Final Certificate recorded
in Book 275 of Deeds on page 497 and also subject to a

WHEREAS, the Lutheran Church of America proposes to
purchase the above -described real estate from William Lundquist
and to use the site to construct a church within the next three
( 3 ) years; and
WHEREAS, the above -described land was not at the time of
the application a separately described parcel of record; and
WHEREAS, there does not appear to be any reason related
to the public health, safety and welfare which would require
a denial of said rezoning and minor subdivision for said
property; and
WHEREAS, the City of Lake Elmo Planning Commission
considered the proposed rezoning and minor subdivision on
May 28, 1980, and recommended the approval thereof;
NOW, THEREFORE, BE IT RESOLVED,",by the City Council of
the City of Lake Elmo as follows:
1. The application of William Lundquist for a rezoning
and minor subdivision of the above -described real estate is,
hereby granted.

WHEREAS, at a regular meeting of the City Council of the
City of Lake Elmo, Washington County, Minnesota, held June 3,
1980, a Petition was presented to the City Council praying
for the vacation of a portion of 35th Street adjacent to the
Haseley property in the City of Lake Elmo, legally described
as follows, to —wit:
The Southerly Six (6) feet of 35th Street North, lying
adjacent to and immediately Northerly of the following
described parcel:
All that part of Section 13, Township 29, Range 21 West,
described as follows, to —wit:
Beginning at a point on the West side of the highway
324.69 feet (recorded as 321.85 feet) North of the Northeast
corner of Block 2 of Elmo Park; running thence West 17
degrees 18 minutes South 196.55 feet; thence North 17 degrees
18 minutes West 50 feet; thence East 17 degrees 18 minutes
North 212.12 feet to the highway; thence South along said
highway 52.37 feet to the place of beginning, said premises
being located in the Southwest Quarter of the Northwest Quarter

City Council at a regular meeting thereof held at 7:30 P.M. on
Tuesday, June 3, 1980, in the City Hall pursuant to notice
thereof published and posted as required by law; and
WHEREAS, the City Council of the City of Lake Elmo has
conducted several meetings and discussions relating to said
vacation with the owners of the abutting property and has
heard all the evidence presented for and against said Peti-
tion and after due consideration thereof has determined it
is in the best interests of the public to vacate the above -
described portion of 35th Street for the following reasons:
1. The portion of 35th Street being vacated is un-
improved and has never been used for any public purpose.
2. The City would benefit by having said property
returned to private use and maintained as part of the adja--
cent private holdings; and no public purpose would be served
by improving or opening the above -described portion of said
street;
WHEREAS, for the foregoing reasons, it appears to be in
the public interests to vacate the above -described portion
of 35th Street;
NOW, THEREFORE, BE IT RESOLVED, that the portion of 35th
Street described above be, and the same hereby is, vacated.
BE IT FURTHER RESOLVED, that the City Administrator
shall prepare a Notice of Completion of these proceedings
which shall contain the name of the City, and the identifica-
tion of the vacation, a statement of the time of completion
thereof and a description of the real estate and land affect-
ed thereby. Such notice shall be presented to the Washington
County Auditor, who shall enter the same in his transfer
reocrds and note upon the instrument over his official signa-
ture the words "entered in the transfer records". The notice
shall then be filed with the County Recorder, all as required
by Section 368.01, Subdivision 25 of the Minnesota Statutes.

WHEREAS, the City of Lake Elmo and the Town of West Lakeland
and the County of Washington have petitioned the Valley Branch
Watershed District for certain improvements in the City of Lake
Elmo and the Town of West Lakeland; and
WHEREAS, said proposed improvements as set forth in said
Petition are intended to alleviate additional flood damage in
portions of the City of Lake Elmo:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo as follows:
1. The City Council requests the Valley Branch Watershed
District take the appropriate action requested in the Joint

WHEREAS, the City of Lake Elmo has been working with the
Washington County Highway and Sheriff's Departments for several
years to diminish the safety hazards along Demontreville Trail;
and,
WHEREAS, said efforts have not been adequate to control
parking abuses on private property; and,
WHEREAS, there is not an adequate shoulder to assure off-
street parking on the easterly side of C.S.A.H. 13 near the public
lake access; and,
WHEREAS, line of sight south of the public lake access
does not permit safe ingress anal egress from the lake; and,
WHEREAS, the maximum safe speed is 30 m.p.h. and there
are not sufficient speed limit signs posted in this area;
NOW, THERRFORE, BE IT RESOLVED by the City Council of the
City of Lake Elmo that:
1. Washington County establish a "No Parking" Zone and post
both sides of C.S.A.H. 13 from 50th Street North to Highlands Trail
"NO PARKING"; except for the 120 lineal feet on the easterly side of
C.S.A.H. 13 just north of the established public lake access; and,
2. Washington County authorize the improvement of said 120
lineal feet of shoulder north of the established public lake access;
and,
3. Washington County explore alternative ways to improve the
line of sight south of the public access and improve the line of sight;
and,
4. Washington County approve and post a 30'mile per hour
speed zone for C.S.A.H. 13 from 50th street North to North Highland
Trail North.

WHEREAS, the Preliminary Plat of Midland Meadows was approved
by the City Council of the City of Lake Elmo on. December 11, 1979;
and,
WHEREAS, Section 401.240 G. required the Subdivider to submit
a Final Plat within 180 days of the approval of the Preliminary Plat;
and,
WHEREAS, Chapter 401 of the City Code provides that City Council
may grant an extension of Preliminary Plat approval upon the request
of the Subdivider; and,
WHEREAS, the Subdivider has request a one year: extension .for the
approval of the Preliminary Plat because the current economy makes

Pebble Park; and,
WHEREAS, THE VALLEY SHAMROCKS 4H CLUB planted 300 trees
in Sunfish Lake Park; and,
WHEREAS, THE GO-GETTERS 4H CLUB planted 2000 trees in
Sunfish Park; and
WHEREAS, these activities greatly enhance the City's
park system and considerably reduce the cost of improvement
and maintenance of the parks;

extension of County State Aid Highway 15 from State Trunk

due notification, held a public hearing on this request
April 14, 1980; and

A RESOLUTION APPOINTING A RESPONSIBLE
AUTHORITY AND ASSIGNING DUTIES
WHEREAS, the Minnesota Government Data Practices
Act, Minnesota Statutes, Sections 15.1611 to 15.1698 as
amended, requires that this city appoint one person as the
Responsible Authority to administer the requirements for
collection, storage, use and dissemination of data on indivi-
duals, government data., and summary data, within this city
and,
WHEREAS, the city council is concerned with the
responsible use of city data and wishes to satisfy this con-
cern by immediately appointing an administratively qualified
Responsible Authority as required under the Act and assign-
ing duties to that person;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF LAKE ELMO, MINNESOTA:
1. The city council of Lake Elmo, Minnesota, appoints.
Laurence Whittaker as the Responsible Authority for the pur-
poses of meeting all requirements of the Minnesota Government
Data Practices Act, Minnesota Statutes, Section 15.1611 through
15.1698, as amended.
2. The Responsible Authority may designate a city
employee or employees to assist in the administration and en-
forcement of the duties of the Responsible Authority and to be
in charge of individual files or systems containing government
data and to receive and comply with requests for government
data. If the Responsible Authority appoints a designee or
designees, this appointment must be in writing, and the city
council shall be provided a copy of the appointment. If desig-
nees are appointed, the Responsible Authority shall instruct
the designees in the requirements of administering and enforc-
ing the Minnesota Government Data Practices Act.
3. The duties of the Responsible Authority and designees
are as follows:
a. The Responsible Authority shall keep records
containing government data in such an arrangement and condition
as to make them easily accessible for convenient use by the pub-
lic. Photographic, photostatic, microphotographic, or micro-
filmed records shall be considered as accessible for convenient
use regardless of the size of these records.
b. The Responsible Authority shall establish pro-
cedures to insure that requests .for government data are re-
ceived and complied with in an appropriate and prompt manner.

C. The Responsible Authority or designee shall,
upon request by any person, permit that person to inspect and
copy government data during the normal business hours of the
city and at places provided by the Responsible Authority, and
if the person requests, that oerson shall be informed of the
data's meaning. The Responsible Authority or designee shall
provide copies of government data upon request. The Responsible
Authority or designee shall require the requesting person to
pay the actual cost of making, certifying and compiling the
copies. If the Responsible Authority or designee is not able
to provide copies at the time a request is made, the Responsible
Authority or designee shall supply copies as soon as reasonably
possible. If the Responsible Authority or designee determines
that the requested government data is classified so as to deny
the requesting person access, the Responsible Authority or desig-
nee shall so inform the requesting person orally at the time of
the request, and in writing as soon thereafter as possible, and
shall cite the statute, temporary classification, or federal law
upon which the determination is made.
d. The Responsible Authority shall prepare a
public document containing his name, title and address, and a
description of each type of record, file, or process relating
to private or confidential data on individuals retained by the
city. Forms used to collect private and confidential data shall
be included in this document. The Responsible Authority shall
update the public document annually and make any changes necessary
to maintain the accuracy of the document.
e. The Responsible Authority shall establish pro-
cedures to assure that all data on individuals is accurate, com-
plete, and current for the purposes for which it was collected;
and establish appropriate security safeguards for all records
containing data on individuals,
f. The Responsible Authority or designee shall
prepare summary data from private or confidential data on in-
dividuals upon the request of any person, provided that the re-
quest is in writing and the cost of preparing the summary data
is borne by the requesting person. The Responsible Authority
may delegate the power to prepare summary data to the administra-
tive officer responsible for any central repository of summary
data; or to a person outside of the city if the person, in writ-
ing, sets forth his purpose and agrees not to disclose, and the
Responsible Authority reasonably determines that the access will
not compromise private or confidential data on individuals.
g. The Responsible Authority shall prepare a
public document setting forth the rights of the data subject
pursuant to the Minnesota Government Date Practices Act and the
specific procedures in effect in the city for access by the data
subjects to public or private data on individuals.
h. The Responsible Authority or designee shall allow
another Responsible Authority or designee access to data classi-
fied as not public only when the access is authorized or required
by statute or federal law. The Responsible Authority or designee
when supplying government data under this provision may require
the requesting Responsible Authority to pay the actual cost of
supplying the data.
i. The Responsible Authority shall, when appro-
priate, apply to the Commissioner of Administration for per-
mission to classify temporarily data or types of data on in-
dividuals as private or confidential, or data not on individuals
as non-public, on a temporary basis until a proposed statute
can be acted upon by the Legislature.
j. Upon request to the Responsible Authority, or
designee, any individual must be informed whether he is the
subject of stored data on individuals, and whether it is classi-
fied as public, private or confidential. Upon further request,
the individual who is the subject of stored private data on in-
dividuals shall be shown the data without any charge to him and,
if he desires, shall be informed of the content and meaning of
that data. The Responsible Authority or designee shall provide
copies of the private data upon request by the individual sub-
ject of the data, and the cost of providing copies shall be borne
by the individual. The Responsible Authority or designee shall
comply immediately,if possible, with any request made by and
individual under this paragraph, or within five days of the date
of the request, excluding Saturdays, Sundays and legal holidays,
if immediate compliance is not possible. If the Responsible
Authority or designee cannot comply with the request within that
time,he shall so inform the individual, and may have an addition-
al five days within which to comply with the request, excluding
Saturdays, Sunday and legal holidays.
k. If an individual contests the accuracy or com-
pleteness of public or private data concerning himself, and
notifies in writing the Responsible Authority decribing the
nature of the disagreement, the Repsonsible Authority shall
within thirty days either correct the data found to be inaccurate
or incomplete and attempt to notify past recipients of inaccurate
or incomplete data, including recipients named by the individual;
or notify the individual that the Responsible Authority believes
the data to be correct. Data which is in dispute shall be dis-
closed only if the individual's statement of disagreement is
included with the disclosed data.
4. This resolution implementing the Minnesota Govern-
ment Data Practices Act shall remain in force and effect until
modified by the city council

WHEREAS, County State Aid Highway 6 (C.S.A.H. 6) serves
many residents of the City of Lake Elmo; and,
WHEREAS, the City Council of the City of Lake Elmo did
adopt Resolution 80-13BF approving the plans and specifications
for the improvement of C.S.A.H. 6; and,
WHEREAS, those plans and specifications include the
drainage facility for which the City is being asked to grant
an easement; and,
WHEREAS, the Washington County Highway Department has
assured the City that the access to Tablyn Park will be restored
once construction of C.S.A.H. 6 is complete;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF

Statutes 161.44 Subd. 1, is permitted to retain right-of-way
for public streets and grant it to the City requesting such
right -of --way for future street purposes; and,
WHEREAS, the City of Lake Elmo, in considering the long
range plan for public streets, believes the extension of Ideal
Avenue from the proposed I-94 frontage road to the existing
service road will be essential to promote adequate fire protection
and access for public safety; and,
WHEREAS, the Commissioner of Transportation has been
authorized to release the right--of-way, once procured for I-94,
at this time,
NOW, THEREFORE BE IT RESOLVED, by the City Council of the
City of Lake Elmo that:
The City of Lake Elmo hereby requests the Commissioner of
Transportation retain the right-of-way for Ideal Avenue from
the proposed frontage road to the existing service road in order
that the State of Minnesota may errant said right-of-way to the

A RESOLUTION VACATING A PUBLIC STREET - A PORTION OF
RIDGEWAY DRIVE - IN TABLYN PARK
WHEREAS, at a regular meeting of the City Council of
the City of Lake Elmo, Washington County, Minnesota, held
July 5, 1978, a Petition was presented to the City Council
praying for the vacation of that certain public street in
the plat of Tablyn Park described as follows:
Ridgeway Drive, as described and dedicated in
the plat of Tablyn Park which plat is on file
and of record in the office of the County
Recorder in and for Washington County, Minnesota.
WHEREAS, said Petition came on for hearing before said
City Council at a regular meeting thereof held at 7:30 p.m.
on Tuesday, August 15, 1978, in the City Hall pursuant to
notice thereof published and posted as required by law; and
WHEREAS, the City Council of the City of Lake Elmo has
conducted several additional meetings and discussions relating
to said vacation with the owners of the abutting property and
has heard all the evidence presented for and against said Petition
and after due consideration thereof has determined it is in the
best interests of the public of the City of Lake Elmo to vacate
a portion of said street for the following reasons:
1. The said street is unimproved and has never been
used for any public purpose.
2. It appears that as a result of the approval of the
plat of Tablyn Park Second Addition immediately adjacent to
said Ridgeway Drive that no public purpose would be served by
improving or opening said street. In fact, the said street
would be inconsistent with the newly approved plat.
3. The said Ridgeway Drive is small and located so close
to residential developments that it could not reasonably be
used for any public purpose without a high probability of a
nuisance resulting.
4. The City would benefit by having said property
returned to private use and maintained as part of -the adjacent
private holdings.
5. The City Council has been informed and understands that
the owners of the land contained within the newly approved plat
of Tablyn Park Second Addition - namely, Top Twenty, Inc., a
Minnesota corporation - have agreed and consented to conveying
whatever interest they may have in part of said road to the
owners of the lands abutting said street on the Westerly side
thereof.
6. It is understood and agreed that all of the Petitioners
who own property abutting on the portion of Ridgeway Drive
which is proposed to be vacated and the said Top Twenty, Inc.
will join in the conveyance to the City of Lake Elmo of a ten
foot utility easement in the lands which are now part of said
Ridgeway Drive which easement shall be located on the portion
of said street immediately adjacent to the newly approved plat
of Tablyn Park Second Addition.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo that the following described portion
of Ridgeway Drive, to -wit:
All that portion of Ridgeway Drive abutting Lots
16, 17, 18 and 19, all in Block 3, as described
and dedicated in the plat of Tablyn Park, which
plat is on file and of record in the office of
the County Recorder, in and for Washington County,
Minnesota,
be, and the same hereby is vacated absolutely and forever
for the reasons set forth herein.
It is further resolved that the City Council does hereby
determine that the City is deemed to benefit from said
vacation for the reasons set forth above and the same is
sufficient consideration for the vacation thereof. Provided,
however, that:
1. The utility easement required by the City as
described above be conveyed to the City by the Petitioners who
own the property abutting the portion of the street being
vacated and -the said Top Twenty, Inc. by instrument to be
approved by the City Attorney.
2. That said Top Twenty, Inc. conveyed to the owners
of the abutting land all that portion of said vacated street
in which Top Twenty, Inc. may have an interest.
3. That the owners of the abutting lots of the
street being vacated shall pay the sum of $308.00 each toward
payment of the costs to the City by paying said amount to the
City Clerk.

Clerk shall cause notice that this vacation proceeding has

THE MINNESOTA DEPARTMENT OF TRANSPORTATION TO
CONSTRUCT NOISE BARRIERS ALONG INTERSTATE 194
IN LAKE ELMO.
WHEREAS, the City of Lake Elmo is concerned about
the noise pollution associated with Interstate 194 which
affects the health and welfare of the residents adjacent
to the freeway; and
WHEREAS, the State of Minnesota Department of
Transportation has completed a study which indicates that
due to high noise levels, certain areas along Interstate
194 in Lake Elmo rank high in priority to receive federal
and state funding to construct noise barriers at no cost
to the City; and
WHEREAS, a public meeting was held to receive comments
from residents adjacent to the freeway regarding a proposal
from the Minnesota Department of Transportation for construc-
tion of noise barriers; and
WHEREAS, a majority of the residents affected by the
proposed improvement indicated that they were in favor of
the noise barriers; and
WHEREAS, a second public information meeting will be
scheduled to receive comments regarding plans and specifi-
cations prepared by the Minnesota Department of Transportation,
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of Lake Elmo hereby requests the Minnesota Depart-
ment of Transportation to proceed with design of plans and
specifications to construct wood noise barriers along the north
side of Interstate 194 from 600 feet west of Ideal Avenue to

WHEREAS, it appears that a rezoning is necessary since
the above -described real estate is presently zoned R-3
(Mobile Home Park), and the proposed use is permitted only
in GB (General Business) districts; and
WHEREAS, it appears the above -described land was not at
the time of the application a separately described parcel of
record; and
WHEREAS, there does not appear to be any reason related
to the public health, safety and welfare which would require
a denial of said rezoning and simple lot subdivision for said
property; and
WHEREAS, the City Planning Commission considered the
proposed rezoning and simple lot division on January 14, 1980,
and recommended the approval thereof subject to certain
conditions hereinafter set forth:

NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo as follows:
1. The application of Cimarron, a Minnesota limited
partnership and Cimarron Park, a Minnesota limited partnership,
for a rezoning and simple lot division is, hereby granted,
subject to the following conditions:
a. The above described tract 1 must be served by
central water and sewer.
b. The above described tract l must have a permanent
easement from the existing Cimarron parcel to
allow access across the private streets in Cimarron
to the south and east portion of tract 1.
C. The acceptance of this Resolution by the applicants,
and their consent to the conditions imposed hereby,
shall be endorsed hereon.
d. A certified copy of this Resolution along with
such endorsement by the applicants shall be
recorded with the County Recorder of Washington
County, Minnesota.
2. No building permit shall be issued for the construction
of any buildings on said parcel until a Certificate of Survey
prepared by a registered land surveyor shall have been filed
with the City Administrator.

A RESOLUTION ADOPTING THE LEAGUF OF MINNESOTA
CITIES INSURANCE TRUST AGREEMENT IaOR THE
GROUP MEDICAL AND GROUP LIFE INSURANCE PLAN
WHEREAS, the City of Lake Elmo recently experienced
a twenty percent increase in premiums for group medical in-
surance; and,
WHEREAS, the cost per individual. employee to the
City and the cost to each employee under the current insur-
ance plan exceed the costs of group medical and group life
insurance under the League of Minnesota Cities Insurance
Trust Agreement is far cheaper than the current plan,- and,
WHEREAS, the City- of Lake Elmo can, by Resolution,
adopt the League of Minnesota Cities Insurance Trust Agree-
ment and qualify for insurance coverage at these reduced rates;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF LAKE ELMO THAT:
The City Council of the City of Lake Elmo hereby
authorizes the Mayor and City Administrator to execute the
League of Minnesota Cities Insurance Trust Agreement and en-
roll all City employees in the Group Medical and Group Life
Plan, effective March 1, 1980.
ADOPTED THIS THE 15th day of January, 1980, by the

A RESOLUTION VACATING NORTH SHORE. LANE IN LANE'S
DEMONTREVILLE COUNTRY CLUB ADDITION.
WHEREAS, at a regular meeting of the City Council of
the City of Lake Elmo, Washington County, Minnesota, held on
January 2, 1980, a Petition was presented to the City Council
praying for the vacation of ascertain public street in the
plat of Lane's Demontreville Country Club Addition described
as follows:
North Shore Lane lying between Lots 418 and 419;
WHEREAS, said Petition came on for hearing before said
City Council at a regular meeting thereof held at 8:00 p.m.
on Wednesday, January 2, 1980 in the City Hall pursuant to Notice
thereof published and posted as required by law; and
WHEREAS, the City Council has reviewed this Petition
with concern for the interests of the public; and
WHEREAS, North Shore Lane proposed for vacation has
never been opened or used for a public street and it is
improbable that there will ever be any public need for said
street; moreover, by vacating the same, the property will be
returned to the tax rolls and would enhance the taxable value
of all the lands abutting thereon or affected thereby; and
WHEREAS, for the foregoing reasons, it appears to be in
the public interest to vacate North Shore Lane as described above;
NOW, THEREFORE, BE IT RESOLVED, that North Shore Lane
as dedicated in the plat of Lane's Demontreville Country Club
Addition described above be, and the same hereby is, vacated.
BE IT FURTHER RESOLVED, that the Clerk shall prepare a
Notice of completion of these proceedings which shall contain
the name of the City, and the identification of the vacation,
a statement of the time of completion thereof and a description
of the real estate and land affected thereby. Such Notice
shall be presented to the Washington County Auditor who shall
enter the same in his transfer records and note upon the
instrument over his official signature the words "entered
in the transfer records". The Notice shall then be filed with
the County Recorder, all as required by Section 368.01 Subdivision

WHEREAS, the Minnesota State Statutes provide that
the City Council shall appoint a person to fill the re-
mainder of the unexpired term when a vacancy occurs on
the City Council; and,
WHEREAS, Carol Jeanne Novak has applied .for the
vacancy, is qualified to serve, and successfully inter-
viewed for the position with the City Council;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF LAKE ELMO:
THAT, Carol Jeanne Novak is appointed to fill the

A RESOLUTION AUTHORIZING DISTRIBUTION OF THE
COUNTY EMS SUBSIDY AND DESIGNATING THE CITY
OF STILLWATER AS RECEIVING GOVERNING BODY TO
DISTRIBUTE SAME.
WHEREAS, the Washington County Board of Commissioners
have provided $15,622 for distribution to the Emergency Ser-
vice Area comprised of the communities that are a party of
this resolution; and
WHEREAS, Washington County required that the commun-
ities comprising the Emergency Service Area do agree to an
equitable distribution of this subsidy;
WHEREAS, the Emergency Service Area is comprised of
the followinq communities:
City of Stillwater
City of Oak Park Heights
City of Bayport
City of Lake Elmo
West Lakeland Township
Stillwater Township
Grant Township
Baytown Township
NOW, THEREFORE, BE IT RESOLVED by the City of Lake Elmp
that the sum of $15,622 be distributed to the Stillwater Rescue,
Lake Elmo Rescue, Bayport Rescue and the Stillwater Ambulance
Service on a pro-rata basis in 1980 based upon the number of
runs by each service during the year 1979;
That the City of Stillwater is hereby designated as the
receiving government body for these county funds and shall be
obligated to make distribution to the respective services pur-
suant to this resolution;
That the City of Stillwater submit a year-end report to
the Washington County's Community Health Services office by
February 15, 1981 showing the manner in which the 515,622 was
distributed to each service provider;

A RESOLUTION COMMENDING MICHAEL JOHNSON FOR SERVICE TO
THE COMMUNITY AND THE CITY OF LAKE ELMO, AS A MEMBER
OF THE JAYCEES, THE PARK COMMISSION, AND THE CITY COUNCIL
WHEREAS, Michael Johnson served the community as a
member of the Lake Elmo JAYCEES from 1972 to the present,
and as an officer; and worked on many community improve-
ment projects; and,
WHEREAS, Michael Johnson was a charter member of the
Lake Elmo Park Advisory Committee and served on its
successor, the Lake Elmo Park Commission from May 17, 1973
until December 31, 1978; and also served as an officer
thereof; and,
WHEREAS, Michael Johnson served on the Lake Elmo City
Council from January 1, 1979 until December 31, 1979;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Lake Elmo;
THAT, Michael Johnson be and is hereby commended for
his efforts on behalf of and service to the City of. Lake
Elmo and the community; and,
THAT, this City Council award a "Certificate of
Appreciation" to Michael Johnson for his devotion to the
