APRIL 21, 1981
Acting Mayor Morgan called the meeting to order at 7:30 p.m.
Councillors in attendance: Novak, Fraser, and Mottaz. Also
Administrator Whittaker
AGENDA: Additions - Engineer's Report: Kroy Industries, Beaubien
Street, and Flood Elevation.'_on Sunfish Lake. Administrator's
Report: Ried Park/City Office, Handicap Use of Motorized Vehicles
in City Parks, DNR Access - Lake Demontreville.
Novak moved, seconded by Mottaz, to approve the agenda as amended.
Motion carried 4-0.
MINUTES: April 7, 1981 - Tabled until May S.
CLAIMS: Mottaz moved, seconded by Fraser, to approve Claims 81326
thru 81354. motion carried 4-0.
OLINGER MINING PERMIT: The Engineer reviewed the permit application.
Mr. Olinger proposes to mine approximately 10,000 cu. yds. of
material from a 3.3 acre area. The Engineer recommended that
the following data and work be completed by Mr. Olinger:
1. Elevations or contours showing present conditions and proposes
final conditions of the area to be mined.
2. A new comprehensive plan be submitted which conforms to the
City requirements which shows that the property can be developed
for the residential p_ pose intended and in conformance with the
minimum lot size and length of cul-de-sac street required
by the City. (Mr. Olinger had an old land use plan on file
indicating residential. use of this property.)
3. A survey establishing the south line of the property so that
the limits of the excavation can be defined.
4. A bond for maintenance of the haul raods be submitted, as
required.
Mr. Phil Tschumperlin, property owner to the east of Olinger, ap-
peared before the Council to question the duration of the mining
operation and also speak on the ordinance violations of the mining
operation, and other violations that have not been corrected by
Mr. Olinger. He -commented —on the violations and requirements
included in the Building Inspectors memo of December 15, 1980,
and asked why the large dirt pile has not been removed, per the
January 1980, deadline. Mr. Tschumperlin asked the City to enforce
the ordinances.
The Administrator will call the current violations to the Mayor's
attention and review the past recommendations with him.
Mottaz moved, seconded by Fraser, to table action on the mining
permit application until May 5, 1981, to provide more time to
consider the request and address the alleged violations which may
be conditions of permit approval. Motion carried 4-0. The
Administrator will contact Mr. Olinger and request he attend the
May 5 meeting.

PATRICK RILEY/SEELER PROPERTY - VARIANCE: Patrick Riley:, perspective
buyer of the Seeler property, located on the southwest corner of
Sunfish Lake, has applied for a Variance for a 150' building set-
back from the normal ordinary high water mark where a 200' setback
is required on a natural environment lake. The Engineer had
asked Valley Branch to review the 100-year flood elevation, as it
appeared too low. Valley Branch determined 900.0 to be a more
accurate figure than the old flood mark of 896.0. The Engineer
said this change does not affect the Riley application. He
reviewed the building and lot proposal, and stated it met the
requirements for elevation above potential high water and there
is adequate area for a primary and alternate drainfield site. He
said there are about two acres of dry ground on the site. The
Engineer recommended that a hay bale dike be constructed between
the home construction and the lake to prevent sediment or
erosion from entering the lake. The Engineer also advised the
property owners that a lift station may be necessary to lift the
settled effluent from the septic tank into the drainfield. A
permit from Mn/DOT will be necessary for the driveway entrance.
The highway right-of-way question has been resolved. The Council
determined that the front of the house is the area facing the lake,
therefore, the swimming pool would be constructed behind the house
facing Highway 5.
Mottaz moved, seconded by Fraser, to approve a Shoreland Variance
for Patick Riley, to permit a 130' setback for :a: house and pool
in the West 1/2 of that part of the NW 1/4*of Section 14, T29, R21,
lying North of the Center of Minnesota Trunk Highway 212 (5), as
*amended now constructed, from the normal ordinary high water mark, and a
5/5/81 - Variance to permit the pool to be closer to the highway than the
of SE 1/4 house, as provided in Section 301.130 C. 10. of the City Code.
Motion carried 4-0.
BUILDING ELEVATION/SUNFISH LAKE:
amended Fraser moved, seconded by Mottaz, to*a-4Q19Ordinance q , amending
5/5/81 - Section 301.070 E., 2., g., (2) of the Zoning Ordinance, changing
o instruct the building elevation on Sunfish Lake to 903.0, as recommended
he City by the City Engineer. Motion carried 4-0.

raft... TOM HOSEK - GARAGE SETBACK VARIANCE: Mr. Hosek proposes to build
a new garage at 11120 32nd Street. The new structure will replace
an old garage that is 5'4" from the property line. Mr. Hosek
said the slope of the lot makes it impossible to put the garage
at the 10' setback. Roy Witzel, neighbor to the west, on the
garage side, had no objection to the Hosak request.
Mottaz moved, seconded by Fraser, to approve the Variance request
of Tom Hosek, to place a new garage 514" from the side lot line.
Approval is based on the hardship that t•heslope•of the lot makes
placement of the structure at the 10' setback unfeasible. Motion
carried 4-0.

ENGINEER'S REPORT:
A. Kroy•industries - The Engineer reviewed the plans for the
Kroy IndustrM planned unit development, in the City of Oakdale,
to determine any possible impact on the City of Lake Elmo. The
complex consists of 70 acres of commercial/industrial development
in the m rtheast quadrant of I-694 and County 70, adjacent to Lake
Elmo. The Engineer reviewed the proposal on the basis of drainage
and traffic impact on the City and made the following observations
and recommendations:
1. The City of Lake Elmo objects to any additional runoff leaving
the site and entering Lake Elmo. The proposed flow of 50cfs in
the County 70 ditch is in excess of the Oakdale Comprehensive Plan.
2. Runoff from phase II and III, of the building and parking lot
expansions, should be directed to the pond in the south central
part of the site and not allowed to drain to the southeast and
leave the site.
3. The pond in the south central part of the site should be allowed
to seep normally and no attempt should be made to seal the bottom
with clay.
4. The entire southeast corner of the site between the future
collector street and County 70 should be set aside as a storm
water ponding area. if and when a collector street is designed, a
more complete analysis of the drainage should be made to direct the
flow north or construct a permanent holding pond in the southeast
corner of the property.
Mottaz moved, seconded by Novak, to accept the Engineer's report
and instruct the Administrator to forward his recommendations
to the City of Oakdale. Motion carried 4-0.
LITTLE SUNFISH HEARING: Acting Mayor Morgan reconvened the hearing
at 8:00 P.M.
The Administrator reported that figures he obtained from the PCA,
on effluent disposed of by Cimarron, did not agree with the
figures presented by the 3M Club at a previous meeting.
The Engineer reported that, in his opinion, effluent from the
Cimarron plant did not significantly contribute to the rise of
Little Sunfish Lake,
Steven Taylor, Cimarron, briefly outlined -%the measures Cimarron
took to protect the lake. He said the primary contributing factor
was the ground water level.
Mottaz said he is satisified with the assessment roster, as long
as the allegations made by 3M Club have been addressed.
No new information has been received other than the flow records
on the Cimarron Plant.
Morgan closed the hearing at 8:13 p.m.
Mottaz moved, seconded by Morgan, to adopt R-81-27, a Resolution
to adopt the assessment roster for the Little Sunfish Flood Control
Project. The Council agreed to waive the assessment for E & H
Earthmovers, in lieu of the work they did on the project. Motion
carried 4-0.

CIMARRON-ADDITIONAL PONDING AREAS: Steven Taylor, Cimarron, reported
on what Cimarron has done to identify ponding areas on their property.
After walking the property with`their engineer, they have con-
cluded there are no ponding areas up-stroam of Little Sunfish.
They would have to pump from Sunfish Lake to a pond near their
water tower to gain any storage area.
Morgan suggested irrigating 'the golf course with lake water. Mr.
Taylor said they have looked into this; but determined it would
not be practical. He will have their engineer review this suggestion
and report back to the Council.
Novak reminded Mr. Taylor that alternative storage areas were a
condition to the pumping project, not just a suggestion.
The Council discussed the City's and Cimarron's role in handling
this problem should it arise again, within the next couple of years,
before Valley Branch initiates a permanent solution.
Mr. Taylor said they can make a formal report to the City on their
alternatives. He suggested Cimmaron provide a storage area into
which the City can pump water, in order to forestall additional
problems. They propose the City do the pumping since 0.mmarron
is not=the only contributor to Little Sunfish.
Morgan requested the Mr. Taylor prepare a report, for Council review,
on the ponding and storage sites considered by Cimarron.and
include the size and elevations for the storage area near the water -
tower, as proposed.
PLANNING COMMISSION ALTERNATES:
The Council interviewed Fred Nazarian, Mike Mazarra, and Don Moe,
for the position of Planning Commission Alternate. The Council
felt all three applicants met the qualification of the City and
would be an asset to the Planning Commission; but concluded that
additional representation in the Old Village and Cimarron is needed.
Presently, there are four representatives from Tri-Lakes, one rep-
resentative from Cimarron, one representative from Tablyn Park,
two representatives from the rural areas, and one representative
from the Old Village.
Morgan moved, seconded by Mottaz, to appoint Mike Mazarra, Old
Village, as 1st Alternate and Don Moe, Cimarron,as 2nd Alternate
to the Planning Commission. Motion carried 4-0.
Morgan thanked Mr. Nazarian for his interest and encouraged him to
reapply when another positon opens up.

PLANNING COMMISSION REPORT:
A. Tartan Meadows - Final Plat- The Council reviewed the Planning
Commission recommendation to approve the final plat. Engineer
Bohrer reviewed the construction plans and specifications, found
them in order, and recommended they be approved. The Engineer
also reviewed the revised final plat. He=recommended three re-
visions: 1. that the drainage and utility easements between lots
4 and 5 and between lots 7 and 8, Block 3, would also serve as
access to the park property and, therefore, access easements should
be deeded to the City; 2, that, the. centerline radius of the two
horizontal curves on Leward Avenue be increased to 200 to allow
a more gradual curve; and 3. that the plat should indicate each
lot corner stake and not just the block corners, as indicated.
The Engineer also reviewed the proposed deed description for the
temporary cul-de-sac on the west end of 12th Street; and said the
description was in error and should be revised. He recommended that
the developers bond be set at $145,000. The developer's engineer
reviewed the estimate and agreed with the bond amount.
Novak moved, seconded by Mottaz, to adopt R�81-28, "A Resolution
approving the final plat and accepting the plans and specifications
for Tartan Meadows; and authorizing the Mayor and City Administrator
to execute the development agreement and Final Plat subject to
meeting the requirements set forth in this Resolution."
Motion carried 4-0.
B. Rossow Rezoning - Administrator Whittaker reported that the
Planning Commission held the public hearing on the rezoning request
and recommended against rezoning the property. He indicated that
there is still interest among some Planning Commission members
to further discuss the 36 Corridor for long range consideration of
permitted uses for that area. He outlined the commissions reasons
for their recommendation and the reasons of the applicant for
wanting the property rezoned.
Mottaz moved, seconded by Novak, to accept the Planning Commission's
recommendation to deny the rezoning request for Lee Rossow and
Tim Dwyer. Discussion: The Administrator briefly commented on
the opinions expressed by residents along the corridor. Morgan
stated the corridor is not the question presently before the Council.
Morgan, Mottaz, and Novak agree that there are alternative uses for
this area, that there are adequate areas for General Business in the
City where there are adequate public services, and that past
discussion and decisions by the Council have adequately covered the
question of the 36 Corridor. Fraser stated she was at the Planning
Commission meeting when the recommendation was made, heard the
various discussions, and concurs and supports the recommendation.
Motion carried 4-0,
C. Robert Schoenecker - Simple Lot Division - The Council reviewed
the Administrator's comments and the Planning Commissions recommendation
to approve the simple lot division. Each lot will be about 1.95 acre.
Morgan moved, seconded by Mottaz, to adopt R-81-29, "A Resolution
approving the simple lot division 'of Robert`Schoenecker, 9302
Stillwater Blvd, describedas follows:_

Subject to a Certificate of Survey being provided. Motion carried
4-0.
ADMINISTRATOR'S REPORT:
A. Cable TV Committee - Surve andpointments - Administrator
WhittaF er reposed several resients have volunteered to serve on
the study committee.
Mottaz moved, seconded by Novak, to reconsider the motion to set up a
Study Committee. Discussion: Mottaz feels that the previous
action is, in effect,setting up a Cable Commit4ee;_which is not the
intent of the City at this point. He thinks the questions that
need to be addressed can be answered without a committee, by polling
the cable companies, as suggested by the Administrator in his April
16 Memo. He recommended that the Administrator draft a letter
with 8-10 pertinent questions. After preliminary information is
available, the City can decide if a study cable committee is desirable
or necessary. Fraser agreed with the basic principle, but feels
a preliminary overview is necessary to decide when the City should
deal with it. She said Mottazs' suggestion fails to address the
question in a manner the weight of the question deserves. Mottaz
feels both he and Fraser are looking for the same answer; but their
approach differs. The Council discussed the pros and cons of
a Preliminary Study Committee.
Don Moe, Cimarron committee volunteer, agreed with Fraser's position
stating there is a definite need for the preliminary committee.
Motion carried 4-0.
Mottaz moved, seconded by Novak, to establish a Preliminary Study
Committee. Motion failed 1-3. Fraser doting for the motion.
Mottaz moved, seconded by Novak, to instruct the Administrator to
prepare a questionaire to be sent to the companies providing cable
service in the State; and request they respond by May 5. Motion
carried 3-1. Fraser opposed. She feels the committee approach would
better address the questions.
B. Well #2 - Test results are not back on the City Office well.
C. Revenue Sharing Audit - Estimates are not available, yet.
D. County Landfill - Re
ngional Park -
Mottaz moved, secoded by Novak, to adopt $-81-30, "A Resolution
objecting to the use of the Regional Park as a landfill." The
resolution will be sent to all branches of government involved with
the landfill, parkland use, pollution control, etc. Motion carried 4-0.

E. Sealcoatin� - Bids -
Mottaz moved, seconded by Morgan, to authorize the Administrator to
take bids for sealcoating. Motion carried 4-0.
F. 50th Street - Oakdale - The Council reviewed the proposed
alignment 6f 50th Street to Highway 36. Mottaz expressed concern
on the number of access points onto Highway 36 in this area.
Morgan moved, seconded by Mottaz, to instruct the Administrator to
send a letter to the City of Oakdale stating Lake Elmo's concerns
on the proposed alignment and access of 50th Street. Motion
carried 4-0.
HANDICAPPED USE OF PARKS/MOTORIZED VEHICLES: Dave Siedow has asked
for a permit to operate a 3-wheeled ATC, all terrain vehicle, in
the City parks. Current policy prohibits motorized vehicles in the
parks. Mr. Siedow said his vehicle is his only means of getting
around the parks.
The Administrator contacted the County and DNR about their policy
on motorized vehicles. He reported that the County does not have
a policy governing handicapped use of motorized vehicles in parks.
The DNR permits motorized wheelchairs on improved trails; but
prohibits all other motorized vehicles. Morgan stated that the
graveled trails in the parks could accomodate motorized wheel-
chairs. The Park Commission opposes other types of motorized

vehicles because of the damage and erosion problems they cause.
Mr. Siedow disagreed that the graveled trails would accomodate a
motorized wheelchair,, stating the ground would break away. He
feels his vehicle is best suited for the trails
Mottaz questioned how the City could permit some use of motorized
vehicles and prohibit others. He asked how the City could police
use of all terrain vehicles by other than handicapped persons. He
does not agree that a 3-wheel vehicle would not cause damage.
Mr. Siedow suggested ticketing violators--' who do not have a permit.
Again, the Council'foxesaw problems with policing this much as they
had in snowmobile use in,the parks. The speed is another concern.
Mottaz suggested limiting 'handidapped u'se of-motorized=vehicles
to surfaced trails with a permit. He suggested the Park Commission
consider this.
Mr. Siedow stated this limitation would not give him full use of
the park and does not feel his vehicle would do any more damage
than what is caused by general use of the parks.
Novak said the safety factor has to be considered.
Fraser feels that if the Park Commission is willing to consider
opening even a limited area, like the surfaced trails, this is
a concession to Mr. Siedow.
Morgan said the Park Commission will discuss this request.

G. Licenses - Morgan moved, seconded by Novak, to approve the
following it cense: Tom Rose, Excavating and Sewer licenses, Box 21,
Afton. Motion carried 4-0. The Administrator notified the Council
that Bill Marty, sewer pumper, is again operating without a license;
and that the City will most likely prosecute.
H. Conservency Regulations - The Administrator reported that the
Plann ng Commission will hold a hearing on the Conservency
Regulations May 11. Any Council comments should be forwarded
to the PZC before the hearing.
I. Metropolitan Governance Bill - The Council had no comments.
J. Police Contract -
Mottaz moved, seconded by Novak, to approve the Police Contract,
subject to review by the City Attorney. Motion carried 4-0.
K. Demontreville Lake Access - Tabled until May 5.
L. Ried Park/Cif Office Site - The Administrator reported that
Reid Park connot be used for the City office unless the City
replaces it with property of equal dollar and recreational value.
Sunfish Park/Office Site - Morgan was unaware he was to contact
Lehart Friedrich a out a-1and exchange for the City Office in
Sunfish Park. The Council agreed it was not interested in doing so.
M. Sewer Bond Payments - The Administrator reported that this was
the annual payment on the last claims list but the interest is
paid twice a year.
N. Hockey Boards - All the materials are at the Landfill building.
0. May 5 Meeting - Novak moved, seconded by Mottaz, to start the
May 5 meeting at 5 p.m. Motion carried 4-0.
P. Mileage Rate - Mottaz moved, seconded by Morgan, to set the
mileage rate at-.20�-per mile. Motion carried 4-0.

CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ADOPTING ASSESSMENT ROLL FOR LITTLE
SUNFISH LAKE FLOOD CONTROL PROJECT
WHEREAS, pursuant to proper notice duly given as re-
quired by law, the City Council has met and heard and
passed upon all objections to the proposed assessment for
the Little Sunfish Lake Flood Control Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
Lake Elmo, Minnesota:
1. Such proposed assessment, a copy of which is attach-
ed hereto and made a part hereof is hereby accepted and shall
constitute the special assessment against the lands named
therein, and each tract of land therein included hereby found
to be benefited by the proposed improvement- in the amount of
the assessment levied against it.
2. Such assessment shall be paid on or before October
1, 1981, or it shall be added to the real. estate taxes due
and payable in the year 1982
3. On or before October 10, 1981, the Clerk shall
transmit a certified duplicate of this assessment to the
County Auditor so that any portions of this assessment which
are unpaid at that time can be extended onto the proper tax
lists of the County and such assessments shall be collected
and paid over in the same manneras other municipal taxes.

RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION APPROVING THE FINAL PLAT OF TARTAN MEADOWS
WHEREAS, the City Council of the City of Lake Elmo has
previously considered and approved a Preliminary Plat of
Tartan Meadows; and
WHEREAS, the applicant has now presented to the City
a final plat which conforms to the approved Preliminary Plat
and meets with the requirements of the City°s Subdivision
Ordinance;
NOW, THEREFORE, BE IT RESOLVED, the City Council does
hereby approve and accept the final plat of. Tartan Meadows
as is on file with.the City Administrator subject to the following
conditions:
1. The applicant shall enter into a Development Agree-
ment with the City providing for the construction
of public improvements according to the plans and
specifications approved by the City Engineer and the
City Council; and provide a Performance Bond or
Letter of Credit assuring the construction of said
improvements;
2. Applicant pay all pass -through costs incurred by
the City for review and inspection of the plans and
improvements;
3. The applicant pay the park donation fee outstanding
in the amount of $2,735.64;
4. The applicant correct the final plat to reflect
corner stakes on all lots;
5. The applicant deliver to the City Deeds for the
cul-de-sac on the West end of 12th Street together
with Deeds for the easements to the park.
Upon compliance by the applicant with the conditions
outlined above, the Mayor and City Administrator are authorized
and directed to execute the Developer's Agreement and Final
Plat for this subdivision.
Adopted by the City Council of the City of Lake Elmo this
21st day of April, 1981.

A RESOLUTION GRANTING A SIMPLE LOT DIVISION TO ROBERT
SCHOENECKER.
WHEREAS, Robert Schoenecker has made application to the
City of Lake Elmo for a Simple Lot Division on a parcel of land
located in said City into two tracts legally described as
follows, to -wit:

That part of the Northeast Quarter of the Southwest

of-way line of Trunk Highway 5; thence northwesterly along said
right-of-way line 153.58 feet to a one-half inch iron pipe
monument and said east line of the west 160.00 feet of the North-
east Quarter of the Southwest Quarter (NE-34 of SW4); thence North
00 degrees, 46 minutes, 34 seconds West along said east line a
distance of 542.52 feet to the point of beginning, containing
1.92 acres, more or less.
WHEREAS, it appears the above -described land was not at the
time of the application separately described parcels of record
and;
WHEREAS, there does not appear to be any reason related to the
,
public health, safety and welfare which would require a denial
of this simple lot division; and
WHEREAS, the City Planning Commission considered the proposed
simple lot division on April 13, 1981, and recommended the approval
thereof;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Lake Elmo as follows, to -wit:
1. The application of Robert Schoenecker for a Simple Lot
Division for the real estate described above, be and the same hereby
is granted.
2. The City Administrator is authorized to approve the
recording of any deeds required for the above -described parcels.
Adopted by the City Council of the City of Lake Elmo, this 21st

RESOLUTION
CITY OF LAKE
WASHINGTON COUNTY,ELMO MINNESOTA
A RESOLUTION OPPOSING THE SELECTION OF
THE LAKE ELMO REGIONAL PARK RESERVE AS
A POSSIBLE SOLID WASTE LANDFILL SITE.
.WHEREAS, the Lake Elmo Regional Park Reserve
was established to maintain the unique and precious
natural resources in and around Eagle Point Lake; and,
WHEREAS, everyone who sold land for or is adjacent
to the Regional Park Reserve was assured that such land
was to be used for a Park Reserve; and,
WHEREAS, the proposed Comprehensive Plan provides
for passive recreation and nature preserve in the Regional
Park; and,
WHEREAS, any landfill will take land out of Park
Reserve, uproot wildlife and destroy natural vegative and
wildlife habitat, and create an environment in which the
very flora and fauna you are trying to preserve will be
forced out and destroyed; and,
WHEREAS, there is ample evidence- in Lake Elmo alone -
that landfills contribute to the degradation of our land,
air and water resources; and,
WHEREAS, there are not adequate collector streets
for a Regional Park Reserve, let alone a regional landfill;
and,
WHEREAS, landfills do not solve the solid waste
problems; but merely transfer the responsibility for man-
aging these wastes to future generations.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Lake Elmo,
THAT, the City of Lake Elmo strenuously objects
to the siting of any landfill in or near the Lake Elmo
Regional Park Reserve, and,
THAT, the City of"Lake Elmo objects to the devel-
opment of any new landfills; and supports efforts to
recover , recycle and permanently dispose of Solid Wastes.

County, Minnesota.
