Mayor Eder convened the meeting at 7:06 p.m, with Fraser, Morgan,
Mottaz and Novak present. Administrator Whittaker was also present.
AGENDA: Whittaker advised the Council that the Oakdale Gun Club
would not appear before the Council at 7:15 p.m. He requested
the Council add one General Contractor's license to the Agenda.
Morgan asked that the use of Pebble Park for a Tri-Lakes Assoc.
picnic be added under his report.
Morgan moved, seconded by Mottaz, to approve the Agenda, as
amended. Motion carried 5-0.
CLAIMS: Whittaker asked the Council to add a claim for the Lake
Elmo Jaycees for $59.14 for paint and limber to repair the
bleachers in Lion's Park. The Council agreed that the City
should withhold 10% of the claim from Moen and Penttila for the
1980 Audit, until the City Council has met with and accepted
the annual audit from Moen and Penttila.
Novak moved, seconded by Morgan, to approve Claims 81424 thru
81466, with Claim 81454 amended to pay $5,481 to Moen and
Penttila. Motion carried 5-0.
BOARD OF REVIEW: While the Council waited for 7:30 p.m. to resume
scheduled agenda items, they agreed on the following schedule
for the Board of Review, to be held June 3, 1981, from 2:30 p.m.
to 7:30 p.m.:
2:30 to 5:00 - Eder, Mottaz, Novak
5:00 to 7:30 - Eder Fraser, Morgan
LAKE ELMO LION'S CLUB - PARK DONATIONS - HUGH MADSON:
Mr. Madson discussed the function of the Lion's Club and their
commitment to provide recreational equipment for City parks. He
expressed concern about the maintenance of facilities in Lions
Park; and stated that before making any Eurther commitment,
the Lions would lik&a commitment from the City that all the
facilities will be maintained.
Morgan itemized the maintenance effort made in Lions Park. He
reviewed the improvements -that -have been made -in the -last-three-
to four years, as well as those scheduled for this year; and
stated that Lions Park is maintained better now than it ever has
been in the past.
Mr. Madkon.,indicated that the Lion's have $2,000 to $4,000
available for park use and requested a listing of park needs
within the City. Morgan outlined the Master Park Plan with
approximate costs, and, explained an additional list is prepared
each year for specific equipment and improvements..for the
individual parks. He.also said the money donated by the Lions
was used for specific improvements; none was used for maintenance.
The Administrator will forward a copy of the Master Park Plan
to the Lions.

FEASIBILITY, 1981 MSA PROJECT: Engineer Bohrer reviewed the Feasibility
( Report. Notations were made on parcels that changed ownership or
were split. It was recommended that the road centerline be on
the section line. The Engineer stated that the centerline could
be placed similar tothe existing centerline, but these decisions
are usually made during the final preparation stage and can be
discussed with the property owners at that time.
The Council discussed assessment formulas, rates of assessment, and
Green Acres property. The report figures were based cn the
desirability to assess as little as possible on the project. The
Administrator questioned committing future MSA money as a means of
reducing the amount assessed for the project. He recommended
a formula that would reserve enough`. MSA funds to cover the 10 year
MSA construction program for the City.
The Engineer will prepare rough cost estimates on those streets
anticipated to be reconstructed within the next 10 years.
Morgan moved, seconded by Mottaz, to adopt a-81-41, A Resolution
accepting the Feasibility Report and calling a public hearing on
the 1981 MSA Project, the improvement of 47th Street, Julep,
45th Street, and Keats Avenue, for June 30, 1981, at 8 p.m.
Motion carried 5-0.
WELL #2: The Administrator reported that Elmer Richert is satisified
with the maintenance permformance from McCarthy Well. He
recommended that the pulling and inspection of the pump be budgeted
for in 1982. The 'Council asked about the feasiblity of inter-
connecting with the Cimarron water supply as a backup. The
Engineer said it was feasible from a construction standpoint; but,
not economically feasible unless there was a plan to include the
south half of Sec. 24 and all of Sec. 25 in a future water service
area.
Mottaz moved, seconded by Fraser, to authorize the Engineer to
proceed with a Feasibility Study for a second well in the Old
Village. Discussion - Morgan did'not feel there is an urgency
to establish a second well and that a cost estimate can be obtained
without spending $1500. Motion carried 4-1 Morgan opposed.
PROJECT 1006: The Administrator reported on the informational meeting
held by Valley Branch, on Project 1006. Novak asked why Downs
Lake was included. Whittaker said it was included to show alternate
pipe sizes from Lake Elmo to Horseshoe Lake. Mayor Eder suggested
questions or concerns be directed to Barr Engineering. Further
discussion was tabled until the next meeting.
COUNCIL REPORTS:
A. Mayor Eder - Office Plans - Eder proposed using the present
Council Chambers as tYn new City Office. He outlined hbw the
office areas could be structured and suggested using the present
City Office as Council Chambers and improving the garage area to
serve as a second meeting room. He estimated the cost, excluding
furniture, at between $5,000 and $7,000; and recommended getting a
firm estimate on the proposal. This would serve as an interm
solution until expansion and staff needs are better determined

Office Plans Continued - The Council discussed the landscape design
cohcept and the possiblity of adapting it into the remodeling alternative.
Novak would consider looking into the proposal; but, would like to
review the remodeling estimates on the present office. Mottaz did
not feel either proposal addresses the real need or offers a long
term solution. He favors continuing to explore alternatives that
will solve the space needs on a permanent basis. Fraser felt a
new building is needed. The Council will continue to review
alternatives.

B. Councillor Fraser -
1. Cable TV Fraser moved, seconded by Eder, to direct the
Administrator to contact the adjacent communities that are
considering cable service, and ascertain their willingness to
have Lake Elmo join them and come back to the Council with
their responses and conditions of participation. Discussion:
Fraser said the intent of this motion is to support pursuing
a franchsis for the following reasons:
1. A strong and continuing citizen support for cable TV,
2. The time is now to pursue the service since surrounding
communities are actively involved in the process and
because an overwhelming majority of other communities
are pursuing the cable question.
3. The cost to franchise one area of the City is almost as
expensive as the process of franchising the entire City.
The cost is reduced by joining other communities and
benefitting from a more extensive survey.
Motion carried 5-0.
Fraser moved, seconded by Novak, to instruct the Administrator
to discuss the following questions with the City Attorney
and report back to the Council:
1. Is a short term franchise feasible at Cimarron.
2. Is a short term arrangement with Allen Brakemeier feasible
from a legal standpoint.
Discussion: Whittaker recommended that the Attorney come in
and discuss the general legal context of the questions. Fraser
agreed that this suggestion is within the intent of the motion.
The Council agreed to.._ask the Attorney to attend the Jitne l(-. JR
meeting.
Motion carried 5-0.
2. Personnel Committee Report - Fraser updated the Council on the
committeeeeting and outlined the areas of involvement and
approaches they discussed. She asked the Council to submit any
additional suggestions before their next meeting, June 9.
C. Councillor Morgan -
1. Demontreville Access - Morgan reported on the Park Commission
meeting with the-Mn DNR, Demontreville residents, and Frank
Kubicheck. The Park Commission minutes summarized the recom-
mendations made at the meeting. Morgan gave a brief background
of previous negotiations with the DNR on an access for Lake
Demontreville.

Demontreville Access Continued - The Council reviewed the proposal
for -a par ing lot in Demontreville Highlands 5th Addition.
Morgan stated that the Park Commission felt a parking lot
would be more manageable than roadside parking.
Frank Kubicheck, lot owner negotiating with the DNR, reviewed
the communication he has had with the DNR during the past year.
He said the offer the DNR made for the lot was considerably
less than they indicated a year ago, when they first approached
him; and, said the access would have a substantial impact on
the value of the remaining lots. At this point, her:is unsure
about selling the lot to DNR.
Residents in the audience preferred`stricter enforcement or
towing rather than a parking lot. Several Council members
felt that a parking lot would provide better control and
enforcement. The Administrator will ask.�the City Attorney
about the legal ramifications of towing. It was suggested
that guard rails be installed along the road to eliminate
the shoulder area.
Fraser moved, seconded by Morgan, to install additional "No
Parking"signs along Highland Trail, as petitioned.
Discussion: All the petitioners were present and stated they
were aware and agreed that "No Parking" pertained to residences
in the no parking areas also. Motion carried 5-0.
i Mottaz moved, seconded by Morgan, to instruct the Administrator
to send a letter to Joe Alexander and copy it to the legislators
explaining the history of the Demontreville access question
and ask for their assistance in expediting a remedy on the'
parking problem along Lake Demontreville; and encourage the
State to make a concerted effort to provide funding for
enforcement of regulations for public accesses. Motion carried 5-0.
The Council would also like a more detailed plan of the proposed
parking area.
Eder moved, seconded by Morgan, to send a letter of response
to Roger Derrick indicating the Park Commission recommendations.
Motion carried 5-0.
Greg Fouks and Dave Garloff requested that the Council ask the
Sheriffs Department that their dispatchers be courteous to the
residents who call in about parking violations along Demontreville
Trail. They said that during the past two months the dispatchers
have been very negative and rude when a deputy has been requested.
The Administrator will contact the Sheriff's Department.
C. Tri-Lakes Picnic - Dick Murray, of the Tri-Lakes Association,
requested the use of Pebble Park for their annual picnic July
19. He requested that the electrical outlets be made accessible
and that the tennis court lights be left on until midnight.
He also asked about using the tennis courts for dancing.
The only conditions under which the courts could be used for
dancing would be with tennis shoes or bare feet.
The Administrator will have the Maintenance Foreman repair the
well head and talk to him about by-passing the tennis court lights.

C. Councillor MOttaz - No report
D. Councillor Novak -
1. "No Parking", Klondike - Novak reported that people are entering the
1 Regional Park illegally off of Klondike and that the "No Parking signs
posted at this location are being cored. Mike Pohlena, Washington County
indicated to Novak that there is increasing pressure to use the park and
inferrelthat Klondike affords easy access to the park. Novak also noted
that the park has been advertised as being open. She feels that until an
adequate parking area, access and public facilities are available, the
County should not encourage people to use Klondike as an entrance to the
park or permit use of the park until .it is ready to be officially opened.
The Administrator will write the County Commissioners and the --,County
Officials notifying them that Lake Elmo opposes any use of the Regional
Park until. such time as it is officially open and public facilities are
available. Novak recommended Klondike be included as a tow away area
and the fence signs be posted "No Entrance'".
2, Clean -Up Dam - Novak distributed North St, Paul's fee schedule for
their Clean Up Days. The Administrator distributed additional schedules
from surrounding communities. Novak recommended issuing permits for
residents, or charging the non-residents and/or involving local service
organizations to help avoid the problems experienced this ,year at the
clean-up. The Council discussed changes that would help alleviate some
of the problems.
Dick Murray, Tri-Lakes Association, suggested packer trucks be used
with the dumpsters, and would like -to see free dumping remain available
to bake Elmo residents with a user fee charged to non-residents. Novak
stressed separation and recycling be eneauraged. Mottaz favored following
Oakd.ales fee schedule. The Administrator will, contact surrounding communities
on how they organize Clean -Up Days and report back to the Council,
Mr. Murray said the City employees didan exceptional job on Clean -Up Days.
ADMINISTRATOR'S REPORT:
A. Licenses - Mottaz moved, seconded by Morgan, to approve the following
licenses: R. W. :guilders, Inc., 100 S. 6th Avenue, Princeton; Lake Elmo
Fire Dept„ Temporary Beer License for Street Dance, June 199 1981; Green
Acres Recreation, Temporary Beer License for Thermoelectric Reunion, July 18.
Motion carried 5-0.
B. Gerhard Schmidt Building Permit - Because the Schmidt home was recently
destroyed by fire, the Building Inspector asked that the Building Permit
fees be waived and just the surcharge and miscellaneous fees be imposed.
Mottaz moved, seconded. by Morgan, to waive the Building Permit fees for
Gerhard Schmidt. Motion carried 5-0.
C. Ani mal Control Contract - The Animal Control Contract is up for re-
newal. Jerry Dahlbert, Animal Control Office; has requested a $25 a month
increase. This would raise his monthly salary to $250. North St, Paul
has agreed to approve the increase.
Mottaz moved, seconded by Morgan, the agreement with Jerry Dahlberg for
animal control services from July 1, 1981 to December 319 1981 at $250
per month. Motion carried 5-0.

D. Retirement/Resignation. Elmer Richert — The Council reviewed Elmer
Richert's letter of resignation and retirement.
Mottaz move( seconded. by Morgan, to accept Elmer Richert's letter of
resignation. Motion carried 5-0.
Mr. Richert requested the Council consider compensation for accumulated
sick days. The current City policy does not provide for this type of
compensation. The Council agreed that until City policy provides for
accruing sick days, compensation cannot be paid.
E. Audit — Deferred until June 16,
F. Conservancy Regulation — Deferred until ,Tune 16.
ANNOUNCEMENTS:
Hossow Law Suit — The Council reviewed a copy of the summons and the
City's response. The City Attorney advised that the City acted legally
and properly in denying the .rezoning. The City is entering a defense of
their action.
D. 208 an — The Administrator advised the Council that the final draft
of the 208 Plan is available for review in the City Office.
C, Re ion nal Park — The final Region Park Policy Plan and Development Guide
is available in the City Office.
D. Landfill Sites — The Administrator reported that the County is going
to review the more detailed information on each of the landfill sites at
the June 16 0ounty Board meeting. The Administrator mill report on this
at the next meeting.
E. Molly hedges — Resignation — Molly hedges, Editor of the Newsletter,
submitted her resignation effective August 25, Molly indicated she will
try to find a replacement. If this cannot be done, the position will
be advertised in the Newsletter.
F, Gas Pump Islands — Maintenance Gara-.e — The Maintenance Foreman recom—
mended a more extensive abutment around the gas pumps. This exceeds the
budret by $150 to $200. The Council reviewed the sketch and recommendation;
and decided the original plan with posts would be adequate.

A RESOLUTION APPROVING ELECTION
OF LAURENCE E. WHITTAICER TO BE
EXCLUDED FROM THE PUBLIC EMPLOYEES
RETIREMENT ASSOCIATION
WHEREAS, Laurence E. Whittaker has notified the City
Council of his election to be excluded from membership in
the public employees retirement association and has provided
this Council. with a copy of his written election to do so,
all as authorized by Minnesota Laws 1981, (Minn. Stats.353.025);
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Lake Elmo as follows:
1. The Council makes the following findings:
(a) Laurence E. Whittaker is the City Administrator
of the City of Lake Elmo, Minnesota.
(b) That position is provided for in the Section 207
of the Municipal Code of the City of Lake Elmo.
(c) He was duly appointed'to serve in that position
effective January 1, 1979, and he has held that
position continuously since that date.
(d) The City Administrator is the chief administrative
officer of the City of Lake Elmo.
(e) Acting under Minnesota Laws 1981, (Minn. Stats.
353.025) he has elected to be excluded from member-
ship in the Public Employees Retirement Association,
effective upon his filing such election with the
Executive Director of that association.
(f) In making this election he has agreed that he will
not at any time in the future seek any authorization
to purchase service credit for any period of ex-
cluded service. He has further agreed that this
election is irrevocable.
2. Said election is therefore approved.
3. A certified copy of this Resolution shall be pro-
vided to the Executive Director of said association.

RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA_
RESOLUTION AUTHORIZING AGREEMENT
WITH CITY ADMINISTRATOR RELATING
TO DEFERRED COMPENSATION
WHEREAS, Laurence E. Whittaker ("Whittaker"), City
Administrator of the City of Lake Elmo has elected to
be excluded from membership in the Public Employees Re-
tirement Association, which election has been approved
by the City Council.; and,
WHEREAS, prior to such action the City has contributed
an employer's contribution to the Public Employees Re-
tirement Association for his account in accordance with
Minnesota Statutes, Section 353.025, Subdivisions 3 & 3a;
and,
WHEREAS, by reason of such election, the City's employer
contribution to PERA on his account will cease; and,
WHEREAS, Minnesota Statutes, Section 353.025, Subdivision
3, provides as follows:
"DEFERRED COMPENSATION: CITY CONTRIBUTION. If an
election of exclusion is made, and if the City
Manager and the governing body of the City agree
in writing that the additional compensation is
to be deferred and shall be contributed on be-
half of the City Manager to a deferred compensation
program which meets the requirements of Section 457
of the Internal Revenue Code of 1954, as amended
through December 31, 1980, the governing body may
compensate the City Manager, in addition to the
salary allowed under any limitation imposed on
salaries by law or charter, in an amount equal to
the employer contribution which would be required
by Section 353.27, Subdivision 3, if the City
Manager were a member of the association."
WHEREAS, the City Council desires to exercise the authority
conferred by the aforementioned Subdivision 3, and the addi-
tional compensation now appropriated per aforementioned Sub-
division 3a.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Lake Elmo, Minnesota, as follows:
1. In addition to the City Administrator's
salary now in effect or which may heregf7er be established
from time to time as his stated salary, Whittaker shall be
compensated in an additional amount equal to the employer
contribution which would be required by Minnesota Statutes,
Section 353.27, Subdivision 3 and 3a, if he were a. member
of the Public Employees Retirement Association subject,
however, to the provisions of the following paragraph of
this resolution.
2. Such additional compensation shall be paid
only if and during the time that there is an agreement
between City and Whittaker wherein it is agreed in writing
that the additional compensation is to be deferred and
shall be contributed on behalf of Whittaker to a deferred
compensation program which meets the requirements of Section
457 of the Internal Revenue Code of 1954, as amended through
December 31, 1980.
3. The Mayor, acting for and in behalf of the
City, is hereby authorized and directed to enter into an
agreement of a type described in the foregoing paragraph no.
2 with Whittaker. Upon the execution of such agreement,
the Mayor, City Administrator and other appropriate officials
of the City are authorized to take the actions necessary to
give effect to the provisions of such agreement.

A RESOLUTION REQUESTING 1980-81
LOCAL PLANNING ASSISTANCE ENTITLEMENT
GRANT FUNDS FROM THE METROPOLITAN COUNCIL
WHEREAS, the Metropolitan Land Planning Act, Minnesota
Statutes, Section 473.851-473.872, requires that the
City of Lake Elmo prepare and submit a comprehensive
plan to the Metropolitan Council; and
WHEREAS, the Metropolitan Council and City �of Lake Elmo
have entered into a contract number 7889 dated Agri 1 . 1978
for Local Planning Assistance GrantsTh was subsequently
amended on October 3,1978 & February 1�5 199779 awarding a
total amount o- . to assist the City of Lake Elmo
in carrying out the required planning;
WHEREAS, the Metropolitan Council has allocated $6,622. to
th.e'Ci:ty of Lake Elmo in additional grant funds or -81:
and
WHEREAS, the City of Lake Elmo has completed the planning
program required of it by the Metropolitan Land Planning
Act; and
WHEREAS, the total grants from the Metropolitan Council of
$17,871. will not exceed 75 percent of the total actual cost
of carrying out the required planning; and
WHEREAS, grant funds from other sources,plus Metropolitan
Council grants, will not exceed 100 percent of the actual
planning cost.'
NOW, THEREFORE, the City o.f Lake Elmo requests $6,622. in
1980-81 entitlement un�cs and authorizes the Mayor to
execute the Agreement Amendment to the above -referenced
contract on its behalf.

Sally Zoller and David Stephen
Questioned the valuation. The Durrow's have a
life estate with Dayton Hudson to live on the
property. They cannot sell the property; but
could move the house if they would move. The
house is 125 years old. They live on three acres
that are still part of the 60 acre farm they sold
to Dayton Hudson. They pay a life estate tax of
$200. They do not feel they should have to pay
the same amount of taxes as someone who could
sell their property. They questioned double
taxing of the property stating Dayton Hudson
is taxed on the 60A; and they are taxed on their
three acres. The life estate provision is on the
three acres, only.
The Assessors said the parcel and house still have
value and they cannot change the value. The parcel
is presently taxed residential.
ASSESSOR ACTION: None
COUNCIL ACTION : Mayor Eder recommended the Assessor
research this situation and make a recommendation
to the Board.
ASSESSOR RECOMMENDATION: The Assessor checked the
records and determined that Dayton Hudson pays taxes
on 57 acres. The Durrows are paying taxes on the
3 acres. No comment was made about changing the
classification to agrigultural.
Gerald Wulfing Questioned the 32% valuation increase. He does

WHEREAS, the City of Lake Elmo is eligible to
receive construction funds for the improvement of municipal
state aid highways for fiscal 1981; and
WHEREAS, the City Council did on May 19, 1981 by
Resolution 81-38, order a feasibility study for an MSA
improvement project on 45th Street, Julep, 47th Street and
Keats Avenue from Jane Road North to State Highway 36; and
WHEREAS, the City Council reviewed the report of
the City Engineer at the June 2, 1981, meeting and accepted
