Mayor Eder convened the meeting at 7:00 p.m.
( Councillors Present: Novak, Mottaz and Fraser
1. AGENDA: Administrator requested the Council add four items to his
report 9. on the Agenda: 9.G. PERLA Workshop -Dec. 11; H. Cable
Meeting -Nov. 23; I. Budget Cuts and State Aid; J. Comp Plan Response
Councillor Mottaz 6.C. Response to letter of complaint.

2. Minutes - Nov. 3, 1981:
M/S/P Mottaz/Eder to approve the minutes of November 3, 1981.
3. CLAIMS:
M/S/P Fraser/Mottaz to approve Claims 81901 thru 81939.
4. PLANNING COMMISSION RECOMMENDATIONS:
A. Arnold Engstrom - CUP for Open Sales Lot at J & W Marine -
Whittaker explained the Planning Commission recommendation on.the
application - Novak asked the Administrator to be sure that the
parking required for the other business at this location was provided.
She said she was concerned that they delineate and preserve the fire
lane that serves the other business on the property. - Mottaz also
expressed concern about the number of parking spaces reserved for
the other uses on the property, Mr. Wallsworth indicated that there
was customer parking for the other business/behind the fence as well
as in front of the fence. Mottaz asked if the landscaping plan met
the requirements of the Ordinance. Whittaker said he felt the plan
was more than adequate, M/S/P Mottaz/Fraser to adopt R-81-70, approving
the CUP subject to the conditions set, by'the' Planning Commission, the')

Olinger -The Council reviewed the Administrator's comments (Nov. 13 memo),
the Olinger''s sketch plan and the Planning Commission recom-
mendation.
The Olinger's are requesting to subdivide off the existing
dwelling and garage. The parcel will be approximately 2A,
but will be divided by Lake Jane Trail.
The Council determined that the two pieces of property be
recorded as one parcel and not separable, Parcel 2, north
of Lake Jane Trail, cannot be sold or built on independent
of Parcel 1--directly south of Lake Jane Tr., nor can Parcel 2 be
declared unbuildable for tax purposes.
M/S/P Mottaz/Novak to adopt R-81-71, A Resolution approving
a minor subdivision for Dan and Jean Olinger, per the plan,
provided Parcel 1 & Parcel 2 are recorded as one tax parcel,
than are inseparable. It is consistent with existing lots
in the area and conforms to the neighborhood.

C. HedgessSimple Lot Division -
( The Council reviewed the Planning Commission's recommendation
to approve the lot division provided the 70ft strip become
a part of .Lot 13n,.is inseperable and not buildable., The
Council agreed with the Planning Commission recommendation.
M/S/P Mottaz/Novak to adopt R-81-72, A Resolution approving,
a simple lot division for George Hedges, providing the 70 ft.
strip be incorporated and filed as a part of Lot 13, Oace Acres
Second Addition, Said 70 ft. strip be inseparable and non --buildable.
5. RI.NGWBLSKI - UNBUILDABLE LOTS:
The Council reviewed the Administrator's memo listing the property
value, changes that were determined after the Board of Review.
The Council asked for clarification on how these figures were
arrived at on the individual parcels, The Administrator will
contact the Assessor and notify the Ringwalskils and the Council
with the additional data. The Ringwelski's questioned the un-
changed value on the homestead parcel,
6. COUNCIL REPORTS, -
A. Christmas Party - The City will sponsor a Christmas Party
Friday, December 18, 1981, beginning at 4:30 p.m, A short program
in planned and refreshements will be served, The City wants
to thank all the employees, volunteers, consultants and all the
people involved with Lake Elmo and extend the greetings of the
season. Invitations will`be mailed out,
B, Project 1006 ® Mayor Eder reported on the joint meeting with
Valley Branch. He indicated that whatever action is planned will
have to be initiated by the City of Lake Elmo. No action on 1006
or 1007 was considered at the joint meeting.
--Mottaz - City has to develop a position - need to include
cost limitations, design, areas to be served, assessment formula,
areas of assessment,- etc, Need genuine alternatives such as_.
total ponding; pipe and ditch; do nothing; buy land and create lakes
-Novak - would like the City to review the number of homes on
Lakes Jane and Elmo that have faulty systems or problem drainfield
areas, and use this as a beginning to solving the water problems,
--Mottaz -much more information is needed before the City can
go ahead and commit to drainage plans with the Highway Department.
This locks the City in all the way back up the line.
The Council will meet Wednesday, November 25, at 5:15 p,m. to
develop a plan of action.
9, ADMINISTRATOR'S REPORT:
C, St, Croix Cab - Ambulance -
Richard Ritzer, St; Croix Cab, explained his proposal to apply
for ;two ambulance areas and requesting a letter of support from
the City of Lake Elmo,, indicating that another ambulance service
is needed in the area. The service area would be the same as
Stillwater Ambulance,
--Whittaker - asked several questions of Mr. Ritzer and his
attorney Philip H. Eastwood, concerning exclusive licensing areas,
service territories, improved service to Lake Elmo, documentation
that ab.Qther-ambulance service .is needed , County funding, call
outs, etc,

9, ADMINISTRATOR'S REPORT:
B. Jodi aesenp'tion and.Hiring Process for Building Inspector -
Whitta-cerorought the Council up� to -•date on the'Fiiring process
for a new Building Inspector. The Council suggested two additions
be included in the job description. 1. Attends City Council
and PZC meetings to present recommendations and findings. 2.
Surveys communities periodically for code violations. The
Administrator will revise the description to include these additions.
The final three applicants will be interviewed December 5.
D. Resolution Amending $78-29 Jamaca Avenue Maintenance -
The C ti y Attorney is preparing trie document. Deferred until
December 1 meeting.

St. Crna x Cab --+,Ambulance
Mr. Eastwood - the service area much the same as the existing
territory - Mr, Ritzer will have more ambulances - has heard
grievances about the present service from organizations in the
area - feels additional ambulances and ':service a bigger factor
than cost,
--Fraser - reluctant to go on record without more -conclusive
data indicating that there is an additional need for another_
ambulance service
--Eder --- is there enough dollars to warrant going into this business.
--Mottaz - present service coming in asking for domAunity funding.
do not want two services coming in and asking the City to keep
two ambulance services going when one is having a hard time
financially,
--Whittaker - Oakdale Fire Department now owns an ambulance and
will be applying for ai,license because of the proximity the
City should look into Oakdale-- probably give quicker service,
--Steve Pott, LE Fire Department - Department of. Health will
not give Oakdale a license - Oakdale presently asking the LEFD
for support too many ambulance services in the area.
M/S/P Eder/Mottaz to take no -action -on the request from St,
Croix Cab for support -of -an ambulance service.
A. Shelter.Wor'k'ers -
Whittaker reporE3W_he interviewed six applicants for the position
of shelter worker at Lion's Park. He recommended hiring Jody Eder,
David Eder, Barry Weeks, and Kevin Ritzer.

and Kevin Ritzer as Park Shelter Workers in Lion''s Park, per
the Administrator's recommendation,
7' OLD BUSINESS,
A. Schedule Infa'rmat onal.meeting - Public Access to Lake Demontrevill
An in-formaEion meeti_na,explainina the DNR plan a.nd landscape
design for the Demontreville Access, will be held December 2, 1981
at 7:30 p.m, at the City Hall. A DNR representative will be
present to explain the plan,and�answer questions, Whittaker
will meet with the Tri-Lakes Board.on the plan, December 3.
The Council and interested residents reviewed the draft plan.
C, Park Access to D'emonikreville 'Park -
�_--g.
Whittaker oriefed._ the Counc3._-on'7the meeting with Roger Derrick,
the City Attorney, Mr, Jungman's attorney and himself, Mr.
Jungman will not agree to the shared easement, as proposed,
--Mottaz - City needs clear, unencumbered easement, the property
should be fenced and the path landscaped,
--Novak - anyone using the path would be in jeopardy, if the
area were not fenced where it is proposed to be shared,
--Mrs. Jungman - concerned about the children using the access,
use not compatible as a shared use - would like another easement
at another plaice,
Council agreed that a shared easement with the Jungman''s driveway
was not desireable.

ADMINISTRATOR'S REPORT:
E. Resolution- County State Aid Designation -
50th St., CSAH 13, CSAH 17, and loth St. -
Whittaker reviewed the letter'>from Short -Elliott -Hendrickson, Inc.
requesting the redesignation of County State Aid Highway 13. He
explained the context of the Resolution supporting the transfer
of this designation and the changes that were in conflict with
Oakdale's original request. These changes will not affect 50th
Street or delay its construction.
The Council agreed with the Resolution presented by Whittaker.
M/S/ Mottaz/ Eder to approve Resolution 81-73, A Resolution
supporting the efforts of Washington County to transfer the
County State Aid Highway designation from C.S.A.H. 17 to Co.
Road 70 in Lake Elmo, from C.S.A.H. 19 to I-694 and to realigned
Co. Road 68 from C.S.A.H. 13 to State Highway 36.
Amendment - Eder recommended including a time recommendation
to the County. This is not just a resolution of intent; but a
resolution requesting the County to act.
--Mary Merly, Mayor of Oakdale - appreciate anythi.ng'.LakesElmo
can do for them. Implore Lake Elmo to encourage the County to
act as soon as possible. Appreciates the time the City has taken
in reviewing this proposal - this action is appreciated by the
City and citizens of Oakdale.
Amendment:
Page 2, paragraph 3 - delete -when that designation must be
removed from C.S.A.H. 17; and insert immediately; and
Add another paragraph that reads:
That the City of Lake Elmo urges the County Board of Commissioners
to make these State Aid designation transfers early in 1982 to
allow for early construction for the realignment of 50th Street.
Motion carried 4-0.
F. Watershed Law-
Mottaz and Eder strongly object to the proposed Metropbltan`47ater-
shed Bill stating it is too wide open.
--Mottaz - Bill cannot be rewritten or amended' - should be voted
down flatly. Bill gives the Met Council and the different Water-
shed Districts a blank check and sets no limits on ordering and/or
assessing projects.
--Mottaz, Eder, Fraser - Unacceptable - Not a way to go.
--Whittaker - suggest amendments to the present law.
--Eder - need a watershed district made up of Citys and/or 'township
representatives - this would be the Board. Need a change in the
law that relates the law to an urban/agricultural environment
recognize the dual condition. Taxing/assessing based on this condition.
--Mottaz - Purpose of the Bill is impressive; but the substance
of the bill does not support this purpose.
M/S/P Mottaz/Eder send a letter to Connie Levi opposing the
proposed Watershed Bill, stating any necessary changes would best
be handled by modifiying onchanging the existing law - not in
passing a new law. Lake Elmo agrees with :the, :°-P:urpodell of the
proposed bill, but this is not dealt with in the body of the bill.

6, COUNCIL REPORTS:
D. Councillor Motta-z - Mottaz referenced a letter to the City
dated October 5, 1981, from Marilyn Olson requesting the City
deny Mottaz a permit to cut trees on a City right-of-way next
to their house. He then read his letter of response to the
City Council, copied to Mrs. Olson, denying any communication
with Mrs. Olson,as well as, any intent to seek a permit to cut
trees on City property.
Mottaz explained his property lay -out after vacating the Bergman
Addition Plat. The area questioned by Mrs. Olson was not vacated,
as it is the only access to the south/east portion of the Mottaz
property. This would be the only access should the property
ever be replatted.
Whittaker reported that Mr. Salisbury, property owner north of
the non -vacated strip, has asked to petition to vacate this area.
9. ADMINISTRATOR'S REPORT:
G. M/S/P Mottaz/Fraser approval for Laurence E. Whittaker to
attend the PELRA Conference
H. State Planning Conference
Whittaker will notify the Planning Commission of the Planning
Conference December 10 and 11. He will also put a notice in
the Newsletter.
I. Cable Meeting -
Eder, Fraser and Whittaker will meet with Zona Butler, November 23,
at 5:30.
J. State Aid -
Whitt'aker advised the Council that they need to make a decision
or take a position on the State Aid issue. He suggested
advising the State that since they have the flexibility in raising
revenues that they increase taxes, rather then cutting the City's
revenues when it has no ability to raise taxes.
The Council discussed various alternatives in developing a response
to the State.
The Administrator will draft a letter summarizing the Council's
comments,.to be sent to the Governor and State Legislators. This
will be reviewed December 1.
K. Comp Plan Response -
The Council generally agreed the letter answered the questions
askdd, and had no further comments.
L. December_ 1, 1981 Council Meeting -
The Council willhmeet at 5:30 p.m. December 1, :to go over _
the new office interior with Janet Goltz.
M. Present City Office Appraisal -
M/S/'P Mottaz Fraser to autTorize up to $250 for an appraisal
of the present office building for sale and/or rental .

A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO
ARNOLD M. ENGSTRO14 FOR AN OPEN SALES LOT.
WHEREAS, Arnold M. Engstrom has made application to the
City of Lake Elmo for a Conditional Use Permit to operate an
open sales lot on property located in the City of Lake Elmo,
the address of which is 9200 Hudson Boulevard in said City,
and commonly known as J & W Marine;
WHEREAS, a public hearing was held on this application by
the City•Planning Commission on November 9, 1981;
WHEREAS, the City Planning Commission did on November 9,
1981, recommend the approval of said Conditional Use Permit
upon certain conditions;
WHEREAS, the area is zoned to permit this conditional
use;
WHEREAS, the application meets all of the requirements of
the City Code,
NOW, THEREFORE, BE IT RESOLVED by the City of Lake Elmo
as follows:
1. The application for a Conditional Use Permit
for an open sales lot be and the same hereby
is granted upon the following terms and condi-
tions:
A. A maximum of 30 cars be allowed in the
permitted open sales lot.
B. Plan -Ling islands shall be installed and
completed by June 1, 1982 pursuant to
the site plan as submitted to the City.
C. Landscaping and planting shall be located
and approved by the City Engineer by the
City Engineer and the City Council of.Lake
Elmo.
2. The appliant shall not interfere with the parking
of any other businesses located adjacent to this
location.

A RESOLUTION APPROVING A SIMPLE LOT DIVISION FOR CARL AND
DAN OLINGER ,
WHEREAS, Carl and Dan Olinger are the owners of the following
described parcel in the. -City of Lake Elmo, legally described as
follows, to -wit:
That part of the,East 186.00 feet of the West 405.00
feet of Government Lot 5 of Section 10, Township 29
North, Range 21 West, Washington County, Minnesota
lying northerly of the South 1711.82 feet thereof,
as measured at a right angle to the south line of
said Government Lot 5, containing 1.97 acres, more
or less.
Subject to a 66.00 wide. -road easement over that
part of the above described -tract lying 33.00 feet
each side of the following described center line:

Commencing at the southwest corner of.said Govern-
ment Lot 5; thence North 01 degree 42 minutes 37
seconds West, bearing oriented to the Washington

1. The application of Carl Olinger and Dan Olinger for a
simple lot division for the real estate described above
be and the same hereby is granted subject to the follow-
ing conditions to which the applicants agree.
a. The property on both sides of 45th Street shall be
shown as one parcel with 66 feet of right-of-way
for Lake Jane Trail being shown as an exception.
b. A legal description shall be furnished the City
which describes the two.parcels as one parcel.
c. A legal description for the exception from the
parcel described in the preceeding paragraph
and a deed to.the City for that parcel.

A RESOLUTION APPROVING A MINOR SUBDIVISION FOR GEORGE
HEDGES.
WHEREAS, George Hedges has made application to the City
of Lake Elmo for a minor subdivision of the following --
described real estate located in the City of Lake Elmo,
Washington County, Minnesota, and legally described as
follows:
That part of Government Lots 3 and 6 of Section 9,
Township 29 North, Range 21 West, Washington County,
Minnesota described as follows:
Beginning at Judicial Landmark No. 5 (a 2-1/2" brass
cap set in concrete inside a 3-1/2 inch iron pipe),
as established in Torrens case No. 334, which is
on the south line of Lot 14 of DACE ACRES SECOND ADDITION
according to the plat of record in the Office of
the County Recorder, Washington County, Minnesota;
thence West, orientation of assumed bearing system,
along the south line of said Lot 14 a distance of
170.3 feet to the southwest corner of said Lot 14;

A RESOLUTION SUPPORTING THE EFFORTS OF
WASHINGTON COUNTY TO TRANSFER THE COUNTY
STATE AID HIGHWAY DESIGNATION FROM C.S.A.H.
17 TO CO. ROAD 70 IN LAKE ELMO, FROM C.S.A.H.
19 TO I-694 AND TO REALIGNED CO. ROAD 68 FROM
C.S.A.H. 13 TO STATE HIGHWAY 36.
WHEREAS, the City of Oakdale has proposed a realign-
ment of Co. Road 68 from C.S.A.H. 13 to State Highway 36
in order to solve long-standing traffic problems along
50th. Street and at the intersection of State Highway 1.20
and 50th, Street; and,
WHEREAS, that plan also meets the needs of the City
of Lake Elmo and generally meets with the approval of the
City Council of the City of Lake Elmo; and,
WHEREAS, that County .road would then carry traffic
from a State Highway to a County State Aid Highway and
would serve the needs of at least two communities; and,
WHEREAS, the present County road is much in need of
repair and reconstruction and the realignment would solve
those problems; and,
WIiEREAS, the best way to encourage and insure County
participation in the realignment/ reconstruction of that
County Road is to secure County State Aid Highway designa-
tion for County Road 68; and,
WHEREAS, the County must transfer 32 miles of C.S.A.H.
designation from C.S.A.H. 17 between State Highway 5 and
I-94 once I-94 is completed, as the road will no longer
connect a State Highway and a C.S.A. Highway; and,
WHEREAS, the County could transfer approximate 2 miles
of that C.S.A.H. designation to County Road 70 between
C.S.A.H. 19 and I-694, and better meet the needs of the
City of Lake Elmo, the City of Oakdale and Washington County;
WHEREAS, that part of County Road 70 between I-694 and
State Highway 120 is already improved to four lanes and con-
crete pavement; and,
WHEREAS, the County could transfer the balance of the
3z miles of C.S.A.H. designation to County Road 68 and meet
the needs of the County, the City of Lake Elmo and the City
of Oakdale without jeopordizing the future road plans for
Demontreville Trail C.S.A.H. 13 and Minnehaha Avenue in
Oakdale; and,

WHEREAS, the City of Lake Elmo cannot accept- the trans-
fer of C.S.A.H, designation from Demontreville Trail to
County Road 68 as that would jeopordize the planned improve-
ments and maintenance of Demontreville Trail and C.S.A.H. 13;
and,
NOW, THEREFORE, BE IT RESOLVED by the City Council, .
That the City of Lake Elmo endorses the plan to realign
50th.. Street to Highway 36 and designate it a County State Aid
Highway.
That the City of Lake Elmo hereby recommends and en-
courages the Board of County Commissioners of Washington County
to transfer the County State Aid Highway designation to be re-
moved from C.S.A.H. 17 to County Road 70 from C.S.A.H. 19 to
I-694; and to County Road 68 from C.S.A.H. 13 to State Highway
36,immediately; and,
That the City of Lake Elmo asks the County Board of
Commissioners to make these State Aid designation transfers
early in 1982 to allow for early construction for the realign-
ment of 50th. Street; and,
i
That the City of Lake Elmo strongly opposes the transfer
of C.S.A.H. designation from C.S.A.H. 13 north of Olsen Lake
Trail (Demontreville Trail) to County Road 68.
ADOPTED, this the 17th. day of November, 1981, by the
City Council, of the City of Lake Elmo.
