Public Comments: Jane McNaught 8989 Lk Jane Tr. - lives across from West Sunfish Park - concerned about the number of cars and traffic. Would like to see something done that would be an asset to the children in the neighborhood. Bill Best 8895 42nd St. - this is a start in providing a place for kids to go during the day. Positive start. Arlyn Christ - this will have playground facilities and picnic areas in the future Linda Schneider 469 Cimarron - does not feel this will generate any serious problems that cannot be handled or policed by the Jaycees. Have sponsored many events over the years without serious problems. Jim Dellis 6787 15th St. Ct.- Jaycees plan to put in a permanent sanitary facility Will start in summer of 82 - completed spring 83 Mike Wagner - Opposes the proposal Jim Wright 3524 Lake Elmo Ave- Wildlife will not be bothered by the ball diamonds. Wildlife lived there when the area was used as a dump. Arlyn Christ - No intention of going close to the wooded area. Mayor Eder - When County proposed the landfill the long range use that was proposed was more passive than this proposal. Asked for a response on this more intensified use. Jane McNaught - strongly concerned about the number of cars, and lights in a residential area. Should be developed without any complications to the residents living in the area. Councillor Mottaz no plan has been developed or presented to the Council on this park. All City parks have had a master plan developed first. Plan should be done first, then see if this fits in. Mike Mazarra - a private entity is offering to go in and do some- thing productive. Because of economics the property will most likely remain undeveloped for many years. Proposing to use only 15 acres to a greater extent. Feel this proposal would be of benefit to the City and a reasonable use. Jim Wright - if against from a planning standpoint - how long before a plan will be developed to see if this proposal is compatible or can be improved on. January 19, 1982 -2- JAYCEE PROPOSAL: Jim Wright - Good plan for 15 acres out of 400 acres.' Development is gratis to the City. Mayor Eder - City was not involved in this until December. All parks in the City have a plan and are developed according to the plan. Some problem in that people were told this area would be a passive use. No problem with one ballfield. Problem in finding a total benefit in having four fields. Why are the ballfields in Stillwater not being used more or up graded to make more useable, Jim Dellis - Fields in Stillwater have been fixed up but are not being maintained by the City. Jaycees have done maintenance on the Stillwater fields but the City has not followed up on the maintenance. Can lower the speed limit in the area, berm the area for noise, wildlife will keep its distance from people ample area for wildlife and ballfields. Jane McNaught - questioned campers - motorcyclists using the park. Response - This is a City park and will be govereried by the the same rules as other City parks. Bill Best - people can be controlled by the rules that are set down and enforced from the beginning. Mayor Eder - Pebble Park need a field developed - VFW field not intensely used. Bill Best - these are designed for Little League. Mayor Eder - over the past several years the amount spent on youth is nil compared to what has been spent on adult activities. Arlyn Christ Requested the City Council to table any action on the Jaycess proposal for West Sunfish and suggested the City Council and the Jaycees work together on developing a plan, as suggested by Councillor Mottaz. Nothing other than good faith was intended or put into this proposal. Three residents expressed opposition to the proposal. Kathy Hemen, representing the Jaycee Women, requested the use of the old Council Chambers in the Fire Hall for the Jaycee Women. They would like the hall the first Tuesday of each month on a yearly basis. --Mottaz - before approving future use of the facility the Council should establish policies for future use, as there may be many requests. --Fraser - this is an appropriate and favorable use; but, agrees this is a good time to establish a policy. --Whittaker suggested if they need a meeting place�on a one night basis, they should call the City Office to see if the hall is available and not being used by the Fire Department. Morgan absent. 1. AGENDA: Additions: Administrator's Report - 7 G. Rink Maintenance and 7 H. Comments on the Jaycee Plan. M/S/P Fraser/Mottaz to accept the agenda, as amended. 2. MINUTES: January 5, 1982 and January 9, 1982, Special Meeting. M/S/P Mottaz/Fraser to approve the minutes of January 5, 1982. M/S/P Fraser/Eder to approve the minutes of January 9, 1982. Motion carried 2-0-2 Mottaz and Novak abstained - not present,. at this meeting. 3. CLAIMS: M/S/P Fraser/Novak to consider Claim 82105 - LaFayette Co. separately. M/S/P Fraser/Novak to approve Claims 82088-82136, exclusive of Claim 82105. A. Appraisal Bill , LaFayette Company The Council reviewed the breakdown of the bill. Whittaker obtained two alternate bids on the recommendation of Bob LaFayette. One was from Ray Kirchner for $400; the other from Eldon Robey & Assoc. for $500. Iie also called a State appraisal group whose estimate was $800. Mr. LaFayette said he would accept the low bid as his fee. M/S/P Mottaz/Fraser to pay Bob LaFayette, Claim 82105, $400 for his appraisal fee. 4. OLD BUSINESS: A. CUP - Cimarron Golf Course - Stephen Taylor and Mike Ahrens were present to address the complaints on noise and liability for damage to private residences around the golf course, raised by the homeowners. Noise - Mr. -,Ahrens - it is common practice for courses to do maintenance of the course prior to 7:30 a.m. Based on the MPCA standards their equipment is within the allowable sound decibles for the type of equipment used. He outlined the procedure they use for mowing - starting at the furthest point of the course, away from the home, and working towards the homes after the hours indicated in the ordinance (7:30 a.m.). They...begin work at sunrise. They endeavor to keep the decible sound,set by the ordinance, to within the perimeter of the golf course. Have had only one complaint raised by a nearby resident. --Mottaz - loudness is not the concern; but, the nuisance effect of the noise. Suggested modifying the equipment to further muffle the sound. Mr. Ahrens said this would be looked into. ---Ahrens - Not practical to let golfers on later other alternative would be to,mow:while people are golfing. CITY COUNCIL MEETING, JANUARY 19, 1982 -2- Cimarron Golf Course - Golf balls going onto private property around course - Mr. Taylor addressed the question of insurance coverage by Cimarron to cover damage to homes. Mr. Tayor - do have insurance - General Liability clause covers damage if the management is liable. Gave the back- ground of the course and its design. Been operating basically unchanged for 10 years. Procedure for damages in the past referred the damaged individual to the golf course's insurance company. Insurance companies say that the golfer, not the golf course, is the liable party and people who live around a course assume a greater degree of risk. Based on this position of the insurance company,-Ciffiarroh'-ncw advises a complainant to contact the golfer. Recognizes this is not always possible, but if,,the liable party is not found, Homeowners Insurance,covers damage from an errant golf ball. Recognizes many policies have $100 deductible, is a problem, not sure that this speaks to the liability question. --Eder - suggested Cimarron consider carrying additional coverage and pass the extra cost onto the golfers through the green fees. --Mottaz - this is a serious problem with golf courses - recommended looking into redesigning or relocating some of the holes. Believes, in this facility, first liability is to the people who rent space. --Taylor - emphasised the question of liability --Mottaz - creating, with the golf course, an attractive nuisance. Owner as well as the offender has a liability. --Taylor - as part of an over-all updating of recreational facilities Cimarron is having the original architect review and make--reiaommendations on the layout of the course for improving the safety and playing of the course. --Mottaz - would like Cimarron's insurance company verifying if this type of coverage is available--aad•if it can be passed_ , on through the -green fee%t --Taylor - happy to approach the insurance company. Feel doing a responsible job in running the golf course, have a good golf course and are taking as much responsibility in the case of claims as any other golf course. The precedent for liability has been set in court cases. --Eder - is there any signing that notifies players of their responsibilities. --Taylor - no signs to this effect; but this could be done. Signs posted stating no trespassing on private property. Public Comments: --Don Moe, 61 Cimarron - presented grievances from residents within the park, on noise and trespass problems, damages and losses. Believe the golf'course should be liable for any damage done to.•bomes along that property. People who live along the course pay premium rent. 75-80 homes affected - no one there to enforce rules. Recommended that before a CUP is issued to Cimarron Golf Course management ;show that they have procured some type of insurance that will protect the people who live around the course. CITY COUNCIL MEETING, JANUARY 19, 1982 -3- Cimarron Golf Course _CUP - Public Comments - -Stephen J. Palfe - 124 Cimarron - Related problems experienced with broken windows - Lives near 5th green. Would like to see golfers leave name if homeowner is not home and make golfers aware they are liable for damage. -Betty Bell — Does not live on the course - equipment very loud noise terrible. Does not feel one should be awakened every morning at 5 a.m. Has talked to several residents in the area and all have the same concern. Should do something to muffle the noise. -Charles M. Clausen - 63 Cimarron - Asked about past damages - insurance rider for additional coverage excellent idea for future damages; but past damages have to be addressed. Recommended that the Council review the past claims and write something into the Conditional Use Permit that Cimarron Park would have to process the past claims. If people who live on the course can produce a bill for a broken window, management should pay at least 1/2 - this should be retro-active back to 1977 when Mr. Taylor took over the park. -Tom Guindon - 503 Cimarron -.Insurance Agent - in reference to the alternatives - relocating the holes - too expensive; lower deductible for homeowners - very expensive 30-40o more; golfer liability - no practical from enforcement standpoint. Expensive for kanagement to carry additional insurance - premium based on projected loss - high for a golf course. Specific coverage is available in a package that deals only with golf courses. Mottaz-- would like Cimarron -to.. -provide statements from insurance companies regarding coverage for damage from golf balls. Council agreed. Need positive assurance to the homeowners that if a golfer breaks the+ir_window someone is going to replace it. --Taylor - not sure can get insurance if admit liability when not legally liable. Will discuss this with his attorney and insurance agent. --Fraser - unique operation when owner rents space and runs the golf course. --Eder - if this suggestion proves totally unreasonable and can be documented as such then may have to explore other alternatives. Requesting Cimarron to respond at this time. B'.: IRB - Final,'Resolution ConnCo Dave Johnson said ConEio wirl be using Lake Elmo as their address. Whittaker reported that the City Attorney has reviewed the material and all the documents are in order. M/S/P Mottaz/Fraser to adopt R-82-1, A Resolution providing for the issuance and sale of Industrial Development Revenue Bonds pursuant to Chap. 474, Mn Statutes to provide funds to be loaned to Conn -Co Shoes, Inc, for Industrial Development Project. C. Green Acres - Beer License and After Tours parties - Howard Spring orn met with -the Council and explained his operation and the facilities. He said not all the parties using the facilities after 10:30 request a beer license. --Mottaz - for the benefit of the City,andithe owners the limits of the permit should be defined and documented. --Springborn - all the events are chaperoned. He reviewed the interior facilities of the chalet. CITY COUNCIL MEETING, JANUARY 19, 1982 Green Acres- --Whittaker-outlined what is adlowbdc,:i under the present permit. Hours are not defined. --Springborn - currently close at 10:00 p.m. Sun-Thur and 10:30 Fri -Sat. He hires an off -duty deputy for Friday and Saturday night. --Mottaz - as a close neighbor, no problems now; but it is :important to set limits on the extent of expansion. Also, have to consider that this is a residential neighborhood and someday this use may not be compatible with the area, should set parameters now. Administrator Whittaker will meet with Mr. Springborn to work out a proposal setting limits on hours and use. 5. ENGINEER'S REPORT: A. 201 Study Report - Engineer Bohrer referenced the 201 Study Report outlining Phase I ,I 'ideritifying the septic needs -i:n-the community, that was sent to the Council for their review and comment. He introduced Bob Callery,_.201 Project Manager, and Loren Braun, who explained the field work, how needs were.determined and the procedure that will be followed at the public meeting. Comments are to be directed to Mr. Callery or Mr. Braun before the public hearing, January 26. B. MSA Variance or Change Plan - Engineer Bohrer presented a map indicating the alignment of the 30 mph curve and the 40 mph curve. 1.2 acres would be \ required for the 40 mph curve. Discussion included road alignment, curves, "T" intersections, and extensions of Julep and 45th St. --Eder - get the property owners together to discuss alternative alignments. Concerned about preserving ag land. --Mottaz - may regret constructYng a 30 mph curve. Would prefer extending 45th Street and using a "T." intersection at 45th and Keats, provided this is economically feasible. The Engineer and Administrator will approach Mn/DOT about endorsing a "T" intersection. Bohrer will compile cost figures for extending 45th for future road plan consideration. C. Jamaca Avenue Paving - Bohrer referr d'his letter of October 27, regarding --the completion of Jamaca Avenue, and recommended increasing the tennis --.court parking lot contract to include this work. --Eder - suggested asking Schifsky to either share in the cost or do the work for cost. Eder and Whittaker will approach him. --Whittaker - this is not budgeted. Monies would have to be taken out of the Emergency Road Maintenance Reserve. --Bohrer - would like to bid the parking lot in February - encouraged to make a decision by then. This will be on -the February 2, agenda. CITY COUNCIL MEETING, JANUARY 19, 1982 -5- ENGINEER'S REPORT: ( D. State Wetlands Survey - t Bohrer reviewed is letter of December 23 regarding protected waters and wetlands,within Washington County. The Engineer had no comments on the designations made by the DNR in Lake Elmo; but, suggested adding the West Lakeland Storage Site and the Horseshoe Lake Outlet, as the City has an interest in keeping these areas open and flowing. M/S/P Novak/Eder to request the DNR to designate the Horseshoe Lake Outlet and the West Lakeland Storage Site as a protected watercourse and a protected wetland in the "Preliminary Designation of Protected Waters and Wetlands within Washington County; Minnesota". E. Highway 36 Improvements - The Council reviewed the Engineer's letter of recommendation to approve Mn/DOT's construction of turning lanes at Highway 36 and Demontreville Trail. M/S/P Mottaz/Novak to adopt R•-82-2, A Resolution approving the preliminary layout for the improvement of a part of Trunk Highway 36, within the corporate limits of the City of Lake Elmo, from 600 ft. west to 600 ft. east of County Road 13 (Demontreville Tr. N.). BREAK ,6. PLANNING COMMISSION REPORT: A. Amending 'Zoning Ordinance to provide for Nominal 10's & 40's - The Council reviewed the -Planning Commission recommendation to— provide for nominal 10's and 4"01s. Discussion included density, ag preservation, cluster development and review of the Administrator's comments (January 14, Memo'- Nominal 10's and 40's). --Novak - large tracts should be looked at individually to see if they can conform. Hardships of the land should also be considered individually. --Whittaker - few parcels over 400 acres - Ifyouu had less than 400 acres, you would end up with a lot less than-10.acres requiring a variance for the sub -standard lot. Ordinance permits clustering 7 lots per 40 acres - higher density. --Novak - intent of the ordinance is to perserve ag land, if developed,..: want to keep services at a minimum through clustering. Acreage is not what is important in the intent of the ordinance,, ag.,preservation is.` --Eder - either going to encourage retention of ag land or forget preserving ag land and consider density. --Whittaker - does not feel this will have an effect on ag land. If want to preserve ag land should zone this land ag with 40 acre minimums. Could not build on 40 acres in ag because would not meet the minimum lot size exclusive of road right-of-way. --Eder - no problem with nominal 40's but does not agree with nominal 10's. - �, --Mottaz - at some point will have to make a concession for land given up for right-of-way that is less than 10 acres. --Eder—should encourage some areas to stay ag. Worst thing is to split 40's into 10 acre lots - this permits economic out for 40 A tracts. CITY COUNCIL MEETING, JANUARY 19, 1982 -6- Nominal 10's and 40's - --wh tta Ar -'ideal solution is platting 7 per 40 to keep large areas open. --Novak - lack of planning by permitting nominal 10's. 4-Mottaz - need to allow nominal 10's or disallow 10 acre lots. --Novak - require full 10 acres until 10 acres cannot be met - then allow the nominal 10 or grant a variance. Encourage property owners with 40 acres to plan the parcel, and plat 7 per 40. Nominal 10's takes the incentive away to plan the 7 per 40:. -Mike Mazarra, Planning Commission — Planning Commission felt that Nominal 10's did not encourage development,of-ag land only made it easier for a property owner to divide a 40 acre parcel. --Whittaker =recommendedamending the subdivision ordinance to require an over-all plan for remaining acreageafterone 10 acre split is made. M/S/P Eder/Novak to accept the recommendation of the Planning Commission for nominal 40's and defer action on nominal 10's. Discussion - -- --Mottaz - if allow nominal 40's automatically create nominal 10's --Fraser - would like to see both approved. " --Eder with approval from Novak withdrew his motion. Prefers to see clustering; ` M/S/ Mottaz/Eder to table further discussion until February 5. Motion carried 3-1 Fraser opposed would like to see action taken. B. Amend Zoning Ordinance to Permit Truck Repair by CUP in GB The Council reviewed the Planninq Commission recommendation. Bruce Hill - Simple Lot Division The Council discussed -the Planning Commission recommendation, right-of-way dedication, and the future alignment of Co. i3. --Whittaker Hill is willing to dedicate Jane Road right-of-way the parcel is planned R71. --Mottaz - how will this subdivision affect the proposed North/ South alignment of County 13`along the powerline. "Road alignment critical. -Novak - need some idea of future subdivision of the entire parcel and access to the property. M/S/P Eder/Novak to refer the request to the City Engineer and back to the Planning Commission. D. Baytown Comp Plan - M/S/P Mottaz/Novak to approve the Baytown Comp Plan with the exception of the section on airports. Resolution - No passing in 40 mph Zone on Highway 5 - / M/S/P Eder/Fraser to adept ResT won 82-3, A Resolution requesting t the formal creation of and posting of a "No Passing" zone on State Highway 5 from County Road 17 to Layton Avenue North. MEETING EXTENSION: M/S/P Nova%/Mottaz to extend the meeting to 10:45 B. Changing Permit Year for Mining CUP's - Whittaker informed the Council that the Code does not set a specific date for mining permit renewal. I He recommended notifying the permittees that the renewal date will be changed to September 1, and the fee for 1982 pro -rated. M/S/P Novak/Mottaz to renew mining permits September 1 of each year, starting September 1, 1982, and pro -rating the permit fees for 1982. C. office Improvements - IF Table Tops M/S/Mottaz/Fraser to purchase the table tops, per the sample from Lake Elmo Hardwood Lumber. Discussion - ,-Fraser - recommended purchasing a wedge shaped section that would permit the tables to be placed in a curved formation. M/S/P Fraser/Mottaz, to amend the motion and include the purchase of a wedged "V" shaped table section, provided it can be purchased within the original cost. estimate. Amendment carried 3-0-1 Novak abstained. Motion, as amended, carried 3-0-1 Novak abstained. (2) Closing Januarya2`9 whittaker requosted au—tior:ization to hire a moving company to move a he:office equipment to.the new building,:.As themaintenance men may be involved with snow'rgmoval. He"recommended closing the office on moving day and notifying the public through the Newsletter. Moving day has been set for January 28. M/S/P Mottaz/Eder to authorize the Administrator to hire a moving company and close the City Office on moving day, (3) Disposition of Present Office Building - M/S/P Mottaz/Fraser to table item (3) until February 2. D. Guidelines - City Attorney - Eder suggested inviting Ray Marshall to attend the February 2 meeting to discuss the disposition of the City Attorney. The Council agreed. E. �Servheim Resolution Correction - `. R7S7P Fraser/Mottaz to adopt Resolution 82-4, A Resolution rescinging R-81-61 to correct a typographical error. CITY COUNCIL MEETING, JANUARY 19, 1982 ADMINISTRATOR'S REPORT: F. Hire Foreman - The Council discussed the qualifications and experience of the two applicants. M/S/ Fraser/Novak to authorize the Administrator to conclude negotiations with David Wisdorf for the position of Maintenance Foreman/Superintendent. Discussion --Whittaker - recommended probationary salary be set at $20,500. --Novak - should be offered the same as the previous Foreman, $20,000. Motion carried 3-0-1 Mottaz abstained. M/S/ Novak/Eder to offer. David Wisdorf a probationary salary of $20,000, with a review in six months. Discussion: --Fraser - feels the $20,500 recommendation is appropriate because of the reduction of insurance benefits he will sustain in,;�6osping to Lake Elmo. Whittaker � Wisdorf is also being paid more in his present job than Rolle Maxey was. --Mottaz - feels $20,000 is fair - will receive the same salary as the man he is replacing. Motion carried 3-1. Fraser opposed. 8. COUNCIL DISCUSSION AND REPORTS: A. Goals and Policies - Park and Planning Commission B. Appointments - Park and Planning Commission Because, of the importance to items A & B,the Council felt it would be beneficial to delay, action until adequate time is scheduled for discussion. There are two intersections with COUNTY ROAD 17; and 4. The principal access for;Fire Department vehicles is along this part of State Highway 5; and, WHEREAS, there is only one lane improved for traffic in each direction, no turn lanes, and many drivers are pass- ing off the pavement or main -traveled portion of the road- way and passing illegally on the right and left; and, WHEREAS, the City's efforts to have the speed limit reduced from 40 miles per hour have not been approved by the Minnesota Department of Transportation; and, WHEREAS, the Minnesota Department of Transportation has the authority to create, designate and post "No Passing" zones on State Highways; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo, that The City of Lake Elmo hereby urgently requests the creation, designation and posting of "No Passing" zones in both directions along State Highway 5 from the northerly ex- tension of County Road 17 to Layton Avenue North in the City of Lake Elmo.
