Mayor Eder called the meeting to order at 7:05 p.m.
COUNCILLORS PRESENT: Novak, Mottaz and Fraser, Councillor Morgan
arrived at 9:00 p.m. Also present, Administrator Whittaker.

5. JAMES FISH - PUBLIC HEARING ON SHORELAND PERMIT AND VARIANCE -
Bruce Folz presented the three variances needed to construct a
new home on Lot 9,, Blk. 2, Eden Park- The City Engineer reviewed
,the site plan prepared by Mr. Folz.,. His summary of the requested
variances and--repommendat ions were reviewed by the Council (per
the Engineer's:0'etter of May 26, 1982 - Revised Site Plan Review for
Lot 9, Bll�. 2, Eden Park). The Engineer indicated that there were
no ;en.4 neer.(i.ng or public health reasons for denying the variances.
The house a.nd drainfield are to be located at the highest point on
the lot; and, the lot was platted prior to the adoption of the
Shoreland Regulation and the re-classification of Down's Lake flood
elevation.. A second drainfield site is identified on the lot.

5, FISH PUBLIC HEARING - Continued -
M/S/P Mottaz/Fraser to approve the followinq variances for James
Fish, to permit the construction of a new home on Lot 9, Blk. 2,
Eden Park:
1, A 65' variance -from 2001 structure setback from the
Normal Ordinary High Water Mark (889) -
2, A variance from the minimum drainfield elevation of 897 to 895
3, A variance from the 20" drainfield setback from the garage
to within 10 feet of the garage.
All variances being subject to the conditions outlined by the"City
Engineer in this letter of review dated May 26, 1982,
In granting said variances the following hardships:were determined:
1. The lot was platted prior.to.the adoption of. the
Shoreland Reaulation,
2, The lot was platted before the reclassifiction of the
flood elevation on Downs Lake.to-897 from 892, Downs Lake
overflows at 891,
3. Thpare,i.s inadequate -land area to"place the drainfield'
further than 10 feet away from the -garage. Past policy '
permitted drainfields to be placed within 10 ft., of an
uninhabited building. The drainfield will -be 20 feet from
the house.
4. The building site is the only location the drainfield and
house can be located on the lot.
Motion carried 4-0
--Mottaz - the present Ordinance permits individuals to create
` restrictions to adjacent lots by the location of drainfields
within 10 feet of a lot line. This should be taken into consideration
by the Building Inspector when reviewing construction plans.
Whittaker will mention this to the Building Inspector,
S.A. 50TH STREET SURVEY - BRUCE FOLZ -
Folz reported that the high water level on Olson Lake permits
public access to that lake provided the lake level is within
80 ft, of the north side of 50th Street. Once the water falls
beyond this 80 ft, the property is again private and not accessible
to the public. He will provide the City with the court case.;
documenting this action.
Engineer Bohrer - if the Council permits and encourages fishing
from the City right-af-way consideration should be given to
making the boulevard safe.
Whittaker will notify residents adjacent to the City property
that the surveyor will be out staking the City right-of-way,
6. POLICE REQUEST FOR RADIO -
Lake Elmo Deputy, Dave Heuer, explained the request to have the
City purchase a radio for the exclusive use of the Lake Elmo
officers. This would insure that Lake Elmo's officers would have
a well operating piece of equipment at all times. The radio
would also have the City's fire frequency on it,; The estimated
cost would be $1,118. This could be paid out of the $3,000 over-
payment credit the City is receiving on its 1981 police contract.
The Lions Club has offered to contribute $150 towards the purchase.
--Mottaz - does not oppose the purchase; but feels the County
should be more responsible in maintaining and keeping their
equipment up to date,

POLICE RADIO - Continued
--Heuer - the Sheriff's department is beginning to replace
the radios as money allows. Lions have offered $150 toward the purchase.
l --Fraser - shared Mottaz's concern; but felt City should go
ahead and purchase the radio. This can be discussed further
when reviewing the County contract. Should accept the Lions offer.
--Mottaz - send a letter to the Sheriff's Department and the
County Commissioners stating the City's concerns on the departments
equipment.
M/S/P Mottaz/Fraser to purchase a portable radio for the Lake
Elmo deputies at an estimated cost of $1,118 less the Lions
contribution of $150. Motion carried 4-0.
7. PUBLIC INQUIRIES:
A. Harvey Allen Shoulder Improvement on CSAH 17 -
Mr. Allen has expressed concern that the shoulder improvement along
CSAH 17 will encroach on private shoreland; encourage trespassing
on private property and encourage additional parking on the
shoulder,
--Eder - designating the shoulder improvement as a bike trail
would prevent parking along the shoulder.
The Council discussed Eder's suggestion and agreed to the bike
trail designation. The shoulder should be defined with a wide
white fog line with the bicycle designation painted within the
shoulder area.
--Novak - would like to have input from the property owners along
17 on the bike trail designation,
M/S/P Mottaz/Fraser to request Washington County to designate
the paved shoulder along CSAH 17 as a bike trail. Motion carried
3-0-1 Novak abstained.
B. Othcr - None
U. ENGINEER'S REPORT -
A. Water Tower Painting - Whittaker reported that there are adequate
funds 'In_the Water Account to do the watermain improvements and
paint the water tower; but that the Water Fund Reserve would be
depleted for 1983. He also reported that the Water Bond Fund
would be paid up in January, 1984, leaving a cash amount of $35,200.
Based on this analysis of the Water Fund, he recommended that all
the recommended maintenance and capital improvements on the water
system be performed, as operating without a reserve in 1983 is
less of a risk than not performing the recommended maintenance on
the Citv's water system.
The Council will have an opportunity to review the bids farsthe
watermain crossing and the water .tower painting before the annual
budget is prepared.
M/S/P Fraser/Mottaz to ad -opt R-82-37, a Resolution authorizing
the City Administrator and City Engineer to secure bids on the
water tower painting. Motion carried 4-0.

8. ENGINEER'S REPORT -
B. Railroad Grade Crossings -
The Engineer reported that t e City has received correspondence
from Mn/DOT explaining the City's eligibility for funds for the
improvement of railroad grade crossings. The City would have to
submit information on the condition of the road surface at the
railroad crossing for review by the State. Funds would be allocated
on a priority basis. The City has three crossings that would
qualify, 31st Street, Kelvin Avenue and Klondike Avenue. The
Council felt that the grade crossings were not in particular need
of improvement; and that the expenditure to assemble and transmit
the information to the State was not worthwhile.
C. Lake Demontreville Public Access - At the request of some
of the Council members; t e 'Engineer reported on the feasibility
of realigning Demontreville Trail within the limits of Demontreville
Highlands 5th Addition so that the public access and parking
would be located entirely on the lake side of Demontreville Trail.
After discussion on designating Highlands Trail as a county road
and the design and safety factors of the proposed DNR access,
the Council instructed the Engineer to prepare a sketch plan
of a possible realignment to the west of Demontreville Trail.
M/S/P Mottaz/Fraser instructing the City Engineer to prepare a
Preliminary sketch showing an alignment to the west of Demontreville
Trail beginning at about Lot 7, Block 2, Demontreville Highlands
Addition and proceeding north through the Fifth Addition, at a
cost not to exceed $100.
The Council also recommended that a "Caution - Boat Launch Ahead"
sign be place along Demontreville Trail by the present launch
area,

and Catagories of Use for the City's Council Chambers, as presented
by Councillor Fraser, including Federal Organizations, Soil
Conservation Service and the Citizens League. Motion carried 4-0.
B. Ordinance 7934 - Park and Planning Commission Policy -
Based on an analysis of t e average engt of service of the
Planning Commission members (3.39 yrs.), Councillor Fraser
recommended that the Council support Planning Commissioner Prince's
position and delete the requirement that a member can serve only
two terms.
M/S/ Fraser/Mottaz to delete the requirement that a Planning
Commission member can only serve two consecutive terms.
Discussion:
--Eder - enact the two term requirement when a determined percentage
of the membership does not turn over.
--Mottaz - the requirement should be deleted from the Park Commission
policy.

9. OLD BUSINESS
B. Ordinance 7934 - Continued
--Fraser - average for the Park Commission was 5.85 years per
member. Members have remained on the Commission although attendance
was poor. Different than the Planning Commission as turn over
has been minimal.
--Eder - prefer to see the policy remain as it is and make an
exception to reappoint members after two consecutive terms,with
Council approval.
Fraser/Mottaz withdrew their motion,- concurred with Eder's position.

Planning Commission Composition and Section 210.012 Park Commission
to read "No member may serve more than two consecutive three-year
terms unless.the average years of service for all Commission
members is less than four years". Motion carried 4-0.
M/S/P Eder/Fraser to adopt Ordinance 7934, as amended. Motion
carried 4-0.
BREAK - 9:00 p.m. Councillor Morgan arrived at 9:00 p.m.
9. C. Fishing from City Right -of -Way - 50th Street -
Handled earlier in meeting.
D. 50th Street Improvement in Oakdale - Co. 68 to Hwy, 36 -
Whittaker reviewed t� summary recommendations from the City of
Oakdale with the Council and recommended City support of the
project.
M/S/P Fraser/Eder to approve the recommendations for theimprovement
of 50th-Street from County 68 to Highway 36 as requested by the
City of Oakdale. Motion carried 5-0.
E. gional
Park�Res'erve Master Plan The CouncF accepted the action of the County Board with regard
to Lake Elmo's concerns on the park plan. The Council make no
further comments.
F. Zoning Ordinance Amendments Review -
The Council opposed amending Section 301.130C. 14. a. and b, which would
increase the square footage of accessory buildings to 4,000 sq. ft.
ior_parcels over 10 acres and for parcels of 10 to 20 acres.
M/S/P Novak/Eder to .adopt the Zoning Ordinance Amendments, as
recommended by the Planning Commission with the exception of
Section 301.130 C. 14. a, and 301.130 C. 14. b.
G. Board of Review - Council will review the Board of Rev,iew
after tae-201 Hearing on June 8, at 8:15 p.m.

CIMARRON EXPANSION -
Steven Taylor and Mike Ahrens presented a preliminary proposal
for the expansion of Cimarron. They have an opportunity to purchase
13 acres from the Highway Department and are.exploring the possibility
of expanding the facility by 50 or 60 homes. Mr. Taylor indicated
they have the mechanical waste water disposal capacity to handle
150 to 180 homes. Have done test borings on a hill southeast of
the mechanical plant - borings look favorable as a means of getting
rid of excess water. Before going ahead, would build a seepage
pond on the Bill and pump water to it to determine if excess water
could be adequately removed. Taylor said, despite the heavy snowfall
and rain this spring the present ponds are holding their own. No
interior connector road is proposed; a walking path would connect
the two areas,
The Council expressed no objection to the expansion provided
all sewer and excess water questions are addressed to the
satisfaction of the City. This would include the present waste
water system and its relation to Lake Rose, °
10. COUNCIL REPORTS:
A. Mayor Eder -
Eder reported on the AMM meeting,and informed -the Council that
Councillor -Fraser was elected as;a full member to the Board.
B. Councillor Fraser - No Report
C. Councillor Morgan - No Report - Notified the Administrator that
the allfie a`s at L ons Park and the VFW need grading,
D. Councillor Mottaz -
1. Requested the City Administrator to send a letter to the
County Board urging them to consider a policy that would prohibit
employees from using their position as a County employee to
further a personal opinion in the press, especially on items that
are still in discussion that may be construed as a County position.
This request :was prompted by an interview with Mike Fox, County
Planner, that appeared in the St. Paul Dispatch.,
Fraser and Morgan supported Mottaz's request.
2. Waste to Energy Plant -
Mottaz afi s—been attending the committee meetings. -As of the last
meeting, Lake Elmo is the prime location site for the plant.
The plant would be located to the north of Conn -Co, 3M will be
the principal user of the steam that is generated, with Kroy
Industries and Western Life being potential future users. Mottaz
explained how the plant operates and will bring in pictures of
other sites, located around the country, for the next meeting.
3. City Sewer Plan -
The City may be able to account for an additional 2,000 units in
l Section 32 for use by the Energy Plant, This should be taken into
account when reviewing the plan for the Met Council.
4. Landfill Site/Waste-Energy Plant - Mottaz reported he talked
with County Commission Chairman, Artie Schaefer, who is also
the Chairman of the Waste to Energy Committee,

4. Landfill Site/Waste-Energy Plant - Continued
He requested that s ce Lake Elmo will be the site for the
Waste to Energy Plant that the County Board eliminate Lake
Elmo as a future landfill site. Mr. Schaefer agreed, and
said he would lobby the other Commissioners. Mottaz encouraged
the other Council members to contact. Mr. Schaefer and urge
him to follow-up on this action.
E. Councillor Novak - No report
.11. ADMINISTRATOR'S REPORT
A. Personnel Policy -
--Fraser - Item 5, 12. C. is repetitious. The Administrator will
clarify the wording.
M/S/P Eraser/Novak to adopt the Personnel Policy changes.
B. City Position on Project1006 -
Whittaker reported that the Board of Managers want to meet with
the Council June 7, to discuss the revised projer_t and Mn/DOT's
participation in the project, The Council will meet with VBWD
June 7, at 7 P.M. in the City Council Chambers.
C. CSAH 14 and 15 - Final Action -
Whittaker reported that the County ordered the intersection
improvements without the culvert under the tracks. The project
will proceed without the culvert with the drainage system -
remaining the same.
D. Audit Reports
M/S/P Morgan/Novak to acknowledge receipt of the City Audit
Report as prepared by Delahunt, Voto, Inc.
E. Manfactured Housing -
Whittaker urged the Council to submit their concerns and
suggestions on manufactured housing so that they can be passed
on to the Planning Commission for review and recommendation.
