MINUTES - June 1, 1982 - Motion carried 3-0.1 M/S/P Mottaz/Fraser to approve the minutes of June 1, 1982. Carried 3-0. 3. M/S/P Fraser/Eder to approve a 3.2 beer license for the Lake Elmo Jaycees for Huff & Puff Days. Motion carried 2-1. Mottaz opposed. CITY COUNCIL MEETING, JUNE 15, 1982 -2- 5. DE:Nardo STORAGE AREA AT OLD CITY OFFICE: Mr' DeNardo explained his proposal to construct a cedar fenced, plank based storage area behind the old City Office building, which he presently rents from the City. He also asked if the City crew would be available to do some excavating and leveling of the area. --Mottaz - no problems with the storage area; but recommended Mr. DeNardo contract with an outside firm to do the grading work, at his expense. M/S/P Fraser/Mottaz to approve the construction of a storage area behind the old City Office building for DeNardo Associates, per the plans and specification presented to the City Council, Motion carried 3-0. The Council specified Mr. DeNardo will be responsible for all excavation work in the storage area. 10. COUNCIL REPORTS: A,- Mayor Eder - 1—Lake-Jane Trail - No Parking Area Mayor Eder recommen e esta is ing a o Par ing ,zone along Lake Jane Trail in the area of the lake access. The zone would be from Jamaca to 45th Street on both sides of Lake Jane Trail. The Council directed the Administrator to include the north and south side of Lake Jane Trail, from,Jamaca Avenue N. to 45th Street in the "No Parking" Ordinance, presently being drafted. 2,'31st Street & County 6 Inter'sec'tion - Eder recommended �`o -. thatTposts Be -placed in t e old roadbed of 31St;Street at Co, 6. to discourage people from driving through the ditch area. The Council agreed, Whittaker will notify the Maintenance Forman. B. Councillor Fraser 1—P'i'cture Rail inCouncil Chambers - The Council directed the Administrator to get an estimate for installing a picture rail in the Council Chambers, The picture area would be available to local artists for display of their work.. C. Councillor Mottaz - No report 11. ADMINISTRATOR'S REPORT; A. Planning Commission Recommendations - 1 Sewer in Comp Pl:an - Whittaker reported on the PZC recommendation to delete reference to the 6,000 sewer unit reserve in the Comp Plan. He gave the background necessitating this,action and reported on the meeting between the PZC and the property owners in Sec, 32. The City is waiting for a -letter,- from the Waste Control Commission assuring Lake Elmo that the units that have been assessed and paid for by property owners in Section 32 will be available as development needs necessitate. --Mottaz - based on current information and figures on the Waste/ / Energy Plant, the minimum waste water requirements would be 1200 \- units with a maximum need being 1800 units - water scrubbers would require additional capacity. These figures should be included in the City's projected sewer needs. --Whittaker - City can include the Waste/Energy Plant as long as it is a reasonable possibility. Will get more exact figures on units needed by a W/E Plant and include them in the sewer needs. CITY COUNCIL MEETING, JUNE 15, 1982 -3- 1. Sewer Comp Plan - Continued / The Planning Commission will hold a hearing on amending the 1 sewer unit reserve sections of the Comp Plan rn July 12 at 7:45 p.m On Site Sewage Treatment ordinance - Whittaker suggested that the Council pt-the new County Model On -Site Treatment Ordinance that adopts State Standard.WPC-40. As'the, �Wl Study determi,ngd that that Lake Elmo will not needmetropolitansewer, the Metropolitan Council requires that WPC740 be adopted for managing on -site systems. The ordinance has been reviewed by the City Engineer and Building Inspector. Whittaker will forward a copy of the ordinance to the Council for review. --Eder - recommended the Administrator draft a cost estimate and`fee�bchedule for implementing the ordinance inspection .requirement. 6. HAMMES HOUSEMOVING AND SKETCH PLAN: The Council reviewed a letter from B.ruce_Folz, retained by -Wm. Hammes,Ur., proposing a design for a'phased seven lot subdivision. Phase 1 would contain a 2A parcel that would be used for locating one of Mr. Hammes' houses. The site would have access off of loth Street. Mr. Folz requested this lot be approved by a one lot ,subdivision. The ramainibg lots would be served from a new street that would be deterMined when the design is completed. The Council then reviewed the Ariministrator's letter of response indicating that the entire parcel..or cluster has to be platted to qualify for a 1 1/2 a lot in Rural Residential, otherwise the owner would have to plat a 10 acre lot. --Eder - want Hammes' aware that all seven lots have to be platted —cannot plat one lot in a cluster development - the design of a seven lot clusterApd-subdivision does not serve as a platted cluster. --Dorothy Lyons - is aware that the seven lots have to be platted. Tie Council reviewed the status of the five move -in buildings with -Mr. Hammes and Mrs. -Lyons.' --Bill Hammes - indicated-onSstorage building is in place on a foundation. A second building should be complete b June 30. A third gar4ge is not located as it will replace an old building that has to be torn down. He wants to get the first house on footings and a foundation before deciding on the second house. --Mottaz - the second house is presently in violation as there was no permit issued for moving it. --Eder - recommended Mr. Hammes prepare a sketch plan committing 10 acres to each house then begin work on locating them on each site. --Dorothy Lyons - not planning to sell either house. M/S/P Mottaz/Fraser to grant a final extension to William Hammes to complete placement of two houses and two but -buildings on perma- nent foundations. Work to be completed as 'follows: Completion of storage buiding presently on footings by June 30. Second storage building to be placed on a foundation and work completed by July 30, 1982. Two houses to be placed on permanent foundations in an approved plat by September. 30, 1982. The Administrator will be instructed to begin legal action for removal of the structures should the work not be completed within the designated extension period. Approval from VBWD is expected later in the week, He reported that the easements to be condemned have been reviewed by the Court appointed Commissioners. A final hearing will be set to make a final judgement' Five property owners are challenging the easements. Bohrer reviewed their positions. - The Council reviewed the bid summary with the Engineer. As the bids came in lower than were estimated at the feasibility hearing, and the project will not use all of the construction funds available; the.Engineer requested and received approval from the State Aid Engineer to include the right—of-way as an eligible cost. All factors considered, the Engineer indicated that the assessed amount at the time of the bid opening is slightly less than was estimated at the time of the feasibility hearing. MIS/0 Mottaz/Fraser to accept the bids for the Keats Avenue. Motion carried 3-0 The Engineer recommended accepting the low bid from Husting & Engstrom when the bids are awarded. Contract will bot be awarded until all easements are secured. B. Demontr-Iv'i'1te Trail Re'al3gnnient - Eng�''ineer Bo rer presented a doncept plan for the realignment of Demontreville Trail that would allow placement of the proposed DNR public access and parking facilities to be located between Demontreville Trail and Lake Demontreville, The Council's intention is to provide a safer public access to the lake. M/S/P Mottaz/Fraser that Lake Elmo accept the concept plan for the ralignment of Demontreville Trail as suggested by Engineer Bohrer in his letter of June 11, 1982; and, that this plan be forwarded to the DNR and to County Commissioner Schaefer asking his support with the County Board. Further that efforts be made to negotiate a land trade with the owner of Lot 8, Demontreville Highlands, for the 0°1 acre of land needed. This design is needed to provide the maximum safety for those using the boat landing as well as for those using Demontreville Trail. This plan would provide for better policing as well as the best separation from private home owners. The cost of the realignment should be paid for by the DNR and Washington County. Discussion: --Fraser - individual Council members should lobby this request with Commissioner Shaefer. The City Administrator and Mottaz should personally view this area with Mr. Schaefer. WHEREAS, Ordinance 7927 requires permits in the Restrictive Soils Overlay and Wetland Protection and Preservation Overlay Districts; and, WHEREAS, a fee is required to coves the costs of processing said permits; and, WHEREAS, Resolution 81-16 establishes the fees for various license and permit applications; NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF LAKE ELMO THAT: 1. The fee for processing an application for a Restrictive Soils Overlay or Wetland Protection and Preservation Overlay District permit shall be $25.00 plus pass through costs for administrative, legal, engineering or consulting fees not covered by the fee; and, 2. Resolution 81-16 is hereby amended to add paragraph 10. g., the fees for these two new permits.
