Jest to 600 ft. East of County Road 13 and seeks the approval thereof, and WHEREAS said preliminary layouts are on file in the Office of the Department of Transportation, Saint Paul, Minnesota, being marked, labeled, and identified as Layout No. 1 S.P. 6211-62 & S.P. 8204-31 (36 = 118) at Charles Street and at County Road 13 NOW, THEN, BE IT RESOLVED that said preliminary layouts for the improvement of said Trunk Highway with the corporate limits be and hereby are approved. Upon the call of the roll the following Council Members voted in favor of the Resolution Eder, Fraser, Novak and Mottaz r 1\ q9A -q i1.._-- R-82-3 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION REQUESTING, THE FORMAL CREATION OF AND POSTING OF A "NO PASSING" ZONE ON STATE HIGHWAY 5 FROM COUNTY ROAD 17 TO LAYTON AVENUE NORTH WHEREAS,, there is a high potential traffic safety hazard on State Highway 5 from the northerly extension of County Road 17 to Layton Avenue North because: 1. There is a school zone with two access to the school property; 2. There are entrances to a restaurant, gas station, 2 car dealerships, a bar and several other businesses; 3. There are two intersections with COUNTY ROAD 17; and 4. The principal access for Fire Department vehicles is along this part of State Highway 5; and, WHEREAS, there is only one lane improved for traffic in each direction, no turn lanes, and many drivers are pass- ing off the pavement or main -traveled portion of the road- way and passing illegally on the right and left; and, WHEREAS, the City's efforts to have the speed limit reduced from 40 miles per hour have not been approved by the Minnesota Department of Transportation; and, WHEREAS, the Minnesota Department of Transportation has the authority to create, designate and post "No Passing" zones on State Highways; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo, that The City of Lake Elmo hereby urgently requests the creation, designation and posting of "No Passing" zones in both directions along State Highway 5 from the northerly ex- tension of County Road 17 to Layton Avenue North in the City of Lake Elmo. Whittaker City Administrator R-82-4 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION RESCINDING RESOLUTION R-81-61 TO CORRECT A TYPOGRAPHICAL ERROR. WHEREAS, there is a typographical error in Resolution 81-61; and, WHEREAS, the minutes of the September 1, 1981, City Council reflect adoption of Resolution 81-61 with said typographical er- ror; and, WHEREAS, the rising level of the water on Lake Elmo Lake in this City has impacted by flooding, certain platted reparian lots on said lake reducing the area remaining above the minimum eleva- tion to .less than the amount currently required for granting a residential building permit thereon; . NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo THAT, Resolution 81-61, adopted by the City Council on Sep- tember 1, 1981, is hereby rescinded; and, THAT, the City Administrator is hereby directed to indicate on the official copy of the minutes of the September 1, 1981, City Council meeting that said Resolution 81--61 is repealed; and, THAT, Lots Five (5) and Six (6) in Ruth's First Addition to Lake Elmo, according to the plat thereof on file and of record in the office of the Washington County Recorder, be and the same hereby are declared to be currently unbuildable and that said lots are expected to remain so until the elevation of the water of Lake Elmo Lake is permanently lowered or until permission is sought and received from the City of Lake Elmo to add sufficiant fill to permit construction to proceed in full compliance with existing rules governing set -back, well and sewer locations. Whittaker City Administrator -2- R- 8 2-5 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION DIRECTING THE CONDEMNATION OF CERTAIN EASEMENTS FOR THE MSA PROJECT ON KEATS AVENUE IN SAID CITY. WHEREAS, it is necessary, advisable and in the public interest that the City of Lake Elmo conduct certain street improvements on a portion of Keats Avenue in said City; and WHEREAS, in order to accomplish such purpose, it is necessary to acquire easements on certain lands adjacent to said project as more fully set forth in the Engineer's Report; and WHEREAS, the City has offered to purchase such easements from the owners at prices deemed by the Council to be favorable; and WHEREAS, the owners of said lands have refused to accept the offers; and WHEREAS, the City is advised and believes that the most feasible location for such road improvements is on the lands described in the Engineer's Report; and WHEREAS, by reason of such refusal to sell the easements to the City, it has become necessary to procure title of said easements by right of eminent domain; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo that the City proceed to procure title to the necessary easements for said project under its right of eminent domain and that the City attorney be, and he hereby is, directed to file the necessary petitions therefore and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the City or by the Court; and that the City attorney, the Mayor and the City Administrator do all things necessary to be done in the commencement, prosecution and successful termination of such action. Eder, Mayor -3- , I , R82-7 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION AMENDING THE CONDITIONAL USE PERMIT FOR THE GREEN ACRES RECREA- TIONAL CENTER WHEREAS, the City Council became aware of the fact that there have been many parties extending after 10:00 P.M., at the Green Acres Recreational Center; and, WHEREAS, this Center is in a primarily residen- tial area; and, WHEREAS, no firm closing hours have been estab- lished for the Center; and, WHEREAS, such uses are controlled by Conditional Use Permits in the City of Lake Elmo; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo, that the Conditional Use Permit for Springborn's Green Acres Recreation, Inc. is amended to stipulate the following: 1. The operation shall close at 10:00 P.M., Sunday through Thursday and 10:30 P.M. on Friday and Saturday; and, 2. Whittaker City Administrator RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR THE OPERATION OF THE OAKDALE GUN CLUB FOR 1982 WHEREAS, the Oakdale Gun Club has applied for a permit to continue operation of the outdoor target range through 1982; and, WHEREAS, Section 301.070 D.l.b.l4? of the Zoning Ordinance requires a Conditional Use Permit to operate commercial recreation of a rural nature in the Agricultural Zone; and, WHEREAS, Section 1301 and 1302 of the Municipal Code of Lake Elmo regulate the use of firearms and the operation of target ranges; and, WHEREAS, the Oakdale Gun Club has operated the target range in compliance with their permit, in general, since 1965; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo, THAT the Conditional Use Permit for the operation of an outdoor target range by the Oakdale Gun Club at 10386 N. 10th Street is hereby granted through"'December 31, 1982, subject to the following conditions: 1. That the outdoor target range is operated by the Oakdale Gun Club in compliance with Sections 1301 and 1302 of the Municipal Code of the City of Lake Elmo; and, 2. That the outdoor target range is operated by the Oakdale Gun Club in compliance with all other provisions of the Municipal Code of the City of Lake Elmo. Whittaker City Administrator RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION AMENDING THE 1982 BUDGET TO COMPENSATE FOR THE DECREASE IN STATE AIDS WHEREAS, Local Government Aid has been reduced $13,514.29 from the budgeted Local Government Aid; and, WHEREAS, Homestead Credits to the City have been reduced $1,684.50 from the budgeted Homestead Credits; and, WHEREAS, the City has no authority to increase the property tax levy to make up for these lost State Aids, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo that: 1. The balance of $4482.64 in the Emergency Road Maintenance Reserve be transferred to the General Fund to offset increased costs of snow plowing.;and, 2. A $3,000. surplus .from insurance premiums be used to support other services in the General Fund; and, 3. The Forester budget of $500.00 in the General Fund be eliminated and those duties be performed by the Maintenance Foreman/Superintendent; and, 4. The $4000. budget for professional planning on the Highway Plan be eliminated. Whittaker City Administrator R-82-11 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION REQUESTING THE METROPOLITAN COUNCIL TO FIND THE LAKE ELMO REGIONAL PARK RESERVE AN INCONSISTENT SITE FOR A SOLID WASTE LANDFILL. WHEREAS, Washington County has submitted part of the Lake Elmo Regional Park Reserve to the Metropolitan Council as a candidate site for a solid waste landfill; and, WHEREAS, a solid waste landfill is not a park and open space use and is therefore inconsistent with Metro- politan Council policy; and, WHEREAS, placing a solid waste landfill in the Regional Park Reserve would violate the restrictive cov- enants on the use of the property; and, WHEREAS, there are other potentially suitable sites in Washington County; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKE ELMO: The City of Lake Elmo requests: 1. That the Metropolitan Council determine that the candidate solid waste landfill site in the Lake Elmo Regional Park Reserve is inconsistent with Council policies that protect park and recreational open space areas. 2. That the Metropolitan Council determine that said site is inconsistent because of a restrictive covenant in the land acquisition contract between the Council and Washington County. WHEREAS, Washington County has submitted just two of the required four candidate sites for solid waste land- fill; and, WHEREAS, all sites potentially eligible and suitable in Washington County were not evaluated or submitted; and, WHEREAS, the Metropolitan Council must approve Washington County's request to submit fewer than 4 sites; and, WHEREAS, the City of Lake Elmo is confident that there are four suitable candidate sites for a solid waste landfill in Washington County if all eligible sites are considered; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKE ELMO: 1. That the Metropolitan Council not approve Washington County's request for a reduction in the number of mixed municipal solid waste land- fill sites. 2. WHEREAS, the City Council of the City of Lake Elmo, be- lieves the construction of a mass -burning resource recovery plant in Section 32, west of Helmo Avenue, will be a perma- nent long-range solution to the disposal of solid waste in Washington County; and, WHEREAS, the City of Lake Elmo does not oppose the con- struction of said plant if all the environmental concerns raised in the development and review of an Environmental Im- pact Statement are addressed and solved and the other reason- able conditions of the City of Lake Elmo are met; and, WHEREAS, said plant will fulfill the requirements of the State of Minnesota, the Metropolitan Council and Washington County for an adequate long --term solution to the disposal of solid waste in Washington County; and, WHEREAS, Washington County will not generate more solid waste than this plant will handle at any time within the plan- ning period; and, WHEREAS, with this plant, there will be no need for a sanitary landfill in Washington County; and, WHEREAS, the proposed site for a sanitary landfill in the Lake Elmo Regional Park Reserve will therefore be unnec-- easary; and, WHEREAS, said site should not be located in the Regional Park Reserve because such siting would violate covenants on the land, Metropolitan Council policy, and State regulations, which prohibit siting landfills within 1,000 feet of a nark and within a park; and, WHEREAS, siting such a landfill in the Regional Park Reserve would permanently destroy the potential for a Regional Park Reserve at that location; and, WHEREAS, resources and opportunities for Park Reserves have diminished considerably as a result of urbanization and reductions in funding; and WHEREAS, any landfill would be a temporary and enviro- mentally risk solution to solid waste disposal needs; and, R-82-42 WHEREAS, the siting of a landfill in the Regional Park Reserve along with the present contaminated Lake Jane land- fill, the Resource Recovery Plant, and other Metropolitan nuisances would greatly diminish the attractiveness and mar- ketability of land in large areas of the City of Lake Elmo; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKE ELMO, WASHINGTON COUNTY, MINNESOTA, THAT, subject to consideration of other requests to be forwarded by City of Lake Elmo at a later date, the City of Lake Elmo will not oppose the construction of a mass -burning resource recovery plant west of Helmo Avenue in Section 32 of the City of Lake Elmo, providing the City of Lake Elmo will no longer be considered for future location of a sludge ash, demolition, or sanitary landfill site. WHEREAS, the City of Lake Elmo has completed a 201 Facilities Plan at the request and direction of the Metropolitan Waste Control Commission and the Minnesota Pollution Control Agency and submitted it for Metropolitan Council, Mn/PCA and U.S. EPA approval; and, WHEREAS, said 201 Facilities Plan redefines the need for .Metropolitan Sewers in the City of Lake Elmo; and, WHEREAS, Metropolitan Sewer will not be needed outside of Section 32 before 1990; and, WHEREAS, the Planning Commission and City Council determined, after a public hearing, that the City will nead just 3,700 population equivalent units of. Metropolitan Sewer in Section 32 before 1990; and, WHEREAS, the City Council believes that the additional 2,300 p.e.u, will be needed by 2000 to serve development in Section 32, especially if the Waste to Energy Resource Recovery Plant is built in Section 32, as planned; and, WHEREAS, the City of Lake Elmo has now adopted new ordinances controlling On -site sewer systems, Wetlands, and Restrictive Soils; and, WHEREAS, the Metropolitan Council requires these amendments to the Lake Elmo Comprehensive Plan and must approve the Plan and these amendments; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKE ELMO, WASHINGTON COUNTY, MINNESOTA THAT: 1. Pages 53, 55, 56, 57, 58, 60, 85, 87, 95, 96, and 99 of the Lake Elmo Comprehensive Plan are hereby amended, subject to review by the Metro- politan Council; and, 2. The findings of the 201 Facilities Plan are hereby incorporated in the Lake Elmo Comprehensive Plan; and, 3. Ordinances regulating On -site Sewers, Wetlands," and Restrictive Soils hereby become a part of the documentations implementing the Lake Elmo Comprehensive Plan. Eder, Mayor -2- ., �. ,; A ` R-82-53 RESOLUTION A RESOLUTION ADOPTING FINAL ASSESSMENTS FOR THE KEATS AVENUE PROJECT WHEREAS, pursuant to proper notice duly given as required by law, the City of Lake Elmo City Council has met and heard and passed upon all objections to the proposed assessments for the improvement of Keats Avenue within said City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo as follows, to -wit: 1. The proposed assessments, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessments against the lands named therein and each tract of land therein included is hereby found to be benefited by.the proposed improvement in the amount of the assessment levied against it. 2. Such assessments shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or before October 1, 1983, and shall bear interest at the rate of 8% per annum from January 1, 1983. To the first installment shall be added interest on the entire assessment from January 1, 1983, until December 31, 1983. 3. The owner of any property so assessed may, at any time prior to the certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid before October 1, 1983; and he may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before October 10 or interest will be charged through December 31 of the next succeeding year. 4. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo as follows: 1. Such proposed assessment is hereby and shall constitute the special assessment against the land named therein and the land is hereby found to be benefited by the improvement in the amount of the assessment levied against it. 2. Such assessments shall be payable in equal installments extending over a period of ten years, the first of the installments to be payable on or before October 31, 1983, and shall bear interest at the rate of 10o per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1983. 3. The owner of the property so assessed may, at any time prior to the certification of the assessment to the County Auditor, pay the whole of the assessment on such property with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged as the entire assessment is paid on or before January 1, 1983; and the property owner may at any time thereafter pay to the City It Treasurer the entire amount of the assessment remaining interest accrued to December 31 of the year of which such payment is made. Such payments must be made before October 31 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. THE JOINT AT)MINISTRATTON OF THE WASTE TO ENERGY PROJECT, WHICH INCLUDES THE, CITY OF LAKE ELMO, WITH RAMSEY AND WASHINGTON COUNTIES, WHEREAS, the T',Taste to Energy plant is, nroposed to be built entirely within the City. of Lake ElmTo;'and, WHEREAS, all of the Public services that will be re-, quired to service the nronosed Waste to Energy Plant must be approved, constructed, and maintained by the City of Lake Elmo; and, WHEREAS, the development of said facility will be the single most important factor in the future development of Section 32, which is the only severed area in Lake Elmo and the only area of Lake Elmo Droposed for Urban. development within the TTetronolitan Urban Service Area; and, WHEREAS, the Citv of Lake Flmo is very concerned about the preparation of Feasibility Studies for Dublic improvements such as water, sewer, streets and surface water management facilities; and, WHEREAS, the City of Lake Elmo is concerned about the provisions for real estate taxes or Dayments in lieu of real estate taxes; and, WHEREAS, the City of Lake Elmo may have to signifi- cantly increase its Maintenance staff, its Fire Department, and its police services because of said facility; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITE' OF LAKE ELMO, WASHINGTON COUNTY, MINNESOTA, THAT, the City of Lake Elmo supports the Agreement for the Joint Administration of the Waste to Energv plant only if the City of Lake Elmo is a full partner to the agreement, on the Board, and in the project; and THAT, the City of Lake Elmo recommends that the Droposed Agreement for the Joint Administration of the Final Feasibility and Implementation Phases of the Ramsey/Washington Waste to Energy Project be amended as follows: 1, Page 1 - The City of Lake Elmo be included in the title 2, Page 3 - The City of Lake Elmo shall anDoint a repre- sentative to the Waste to Energy Project Board; Ramsey and Washington Counties should each have two representatives; and each of those Board members should have all the rights, duties and powers proscribed in the Agreement. R,-82�59 3. :Page 4 - The City Administrator of. the City of Lake Elmo shall be a member of the Administrative Committee with all of the rights, duties, and nowers of the other members of that Committee, 4, page 14 - The City of Lake Elmo shall have the right to approve any change in the agreement or scope of the Board responsibilities; and, 5. The budget reflects the costs of the studies the City of Lake Elmo will have to make to determine the feasibility of the project and the public improvements, and amendments to our Comprehensive plan, to accomo- date the Waste to Energy project; and, THAT, the City of Lake Elmo request this recommendation be accepted or we will be forced to oppose the project from this day forward and will have to seek to stop the project by whatever means are available and necessary, if these demands are not met. W'ltta er City Administrator RESOLUTION A RESOLUTION GRANTING A SIMPLE LOT DIVISION TO LAVONNE RICHERT WHEREAS, Lavonne Richert has made application to the City of Lake Elmo for a simple lot division of land located in the City of Lake Elmo and legally described as follows, to -wit: PARCEL C-1 The North 219.99 feet of the South 441.10 feet of the East 330.00 feet of the North Half of the Northeast Quarter of Section 16, Township 29 North, Range 21 West, Washington County, Minnesota, containing 1.67 acres, more or less. Subject to a road easement for Jamaca Avenue over the. East 33.00 feet thereof as described in Book 150 0£ Deeds, page 621 on file in the Office of the County Recorder, Washington County, Minnesota. WHEREAS, the City Council of the City of Lake Elmo has recently considered the possibility of rehabilitating certain streets in said City during 1983; and WHEREAS, the City engineer has prepared a proposal to conduct a feasibility study to determine what street rehabilitation program best serves the City's needs. NOW, THEREFORE, BL IT RESOLVED by the City Council of the City of Lake Elmo as follows: 1. The City engineer is hereby directed to prepare a feasibility report for the rehabilitation of city streets within the following subdivisions in said City, to -wit: Tablyn Park Addition, Kenridge Addition, Kenridge 2nd Addition, Bordner's Garner Farmettes, Friedrich and Friedrich Heights Addition. 2. In addition, the City engineer will conduct a visual inspection of the street surfaces in the these areas and inventory those areas needing repair. 3. This feasibility report will be prepared with estimated costs and in accordance with the provisions of Minnesota Statutes Chapter 429. 4. The City engineer is authorized and directed to expend not more than $900.00 in the preparation of this feasibility report without the additional authorization of the City Council.
