JULY 5, 1983
Mayor Eder called the meeting to order at 7:04 p.m. in the City Hall.
Councillors Present: Dunn, Fraser, Mazzara, and Morgan.
1. AGENDA - M/S/P Morgan/Mazzara to adopt the agenda as amended as follows:
14.G. Liquor License Fee - Jaycees Huff n' Puff Days.
H. Code Books
I. School District meeting.
2. MINUTES - [1] M/S/P Morgan/Mazzara to approve the 6/14/83 Joint Council/
Planning Commission minutes as written. (Carried 5-0) [2] M/S/P Morgan/
Mazaara to approve the 6/21/83 City Council minutes with a few minor changes.
(Carried 5-0)
3. CLAIMS - Claim No. 83883 amount was added ($197.90) to total $22,956.23.
Claim Nos. 83863 thru 83905 were approved. Morgan wondered if $2,000 annual
dues to League of Minnesota Cities was worth the price. Whittaker said it was
source of model ordinance and lobbying efforts. Fraser agreed since cities
couldn't lobby independently and achieve similar impact w/such cost effectiveness.
4. LICENSES - M/S/P Morgan/Fraser to approve 3.2 beer license for golf
tournament and fund raiser for St. Paul Company's Girls Softball Team to be held
7/23/83 at Cimarron Golf Course 7:30 a.m. to 5:00 p.m. (100-150 people). (5-0)
Fraser questioned appropriate liability insurance; Whittaker said Cimarron had
3.2 beer license. Eder suggested Whittaker clarify this with St. Paul Company.
5. PUBLIC INQUIRES - None.
6. PUBLIC HEARING, FRIEDRICH HEIGHTS - (REF: Bohrer letter dated 6/24/83 to
Mr. Whittaker re "Jamaca Court Improvements, Lake Elmo, Minnesota, commission
No. 7113-83). Bohrer reviewed the proposal considered in Jan/Feb 1983 and said
that same improvements are being considered. Cost has increased due to smaller
project ($1,324 in lieu of $1,106 per lot).
i Carol Kuettner - When this is done, will we be sure the water no longer stands
on curb? (Bohrer - crown will be created on road.)
• Ron Dornfeld - What is sub -base? (Bohrer - not too good, 2" gravel over top
soil, maintenance has tried to dig out areas and putting in more gravel. By
replacing completely with blacktop, will get away from contraction/expansion.)
9 Carol Baglio - What would life expectancy be before conditions repeated
itself? (Bohrer - hard to answer; we don't know accurately what's under
blacktop, should be a good 10 years before any more corrective work is done.
City has adopted 6-year sealcoating program which would be 6 years from now.)
o Ron Dornfeld - project would be amortized over how long a period? (Eder -
this is something we have to arrive at, assessment procedure still has not been
proposed.) (Whittaker. - latest interest rate was 9% for bonds, could be
assessed for 5-10 years, probably 5 years. There'll. be assessment hearing if
this is approved where your ideas and opinions will be heard.)
9 Bohrer - Bartell's lots are included as one lot because of equal benefit, also
66' lot is treated as one lot.
0 Morgan - What is total length of project? (Bohrer - 1,100 feet.)
• Judy Bartell - We only use Jamaca Avenue but never side road so can't see
being assessed for it.
* Morgan - How many lots are represented by petition? (Whittaker - 7 families or
48% of frontage on streets.)

• Fraser - I believe it's needed and people seem in favor of blacktopping; one
problem is with assessments.
♦ Eder - Unless street is improved, it would be left out of sealcoating program.
Keep in mind costs are only estimates.
o Mazzara - I'm in favor of it since I've been on streets and can see problems.
• Bohrer - This proposal is considered the least cost alternative. Standard
approach would be to test soil, replace with sandy soil, gravel base and
pavement.
♦ Dunn - Originally people were opposed but apparently have reconsidered so I
have no oposition.
M/S/P Fraser/Mazzara to adopt Resolution 83-46:
A RESOLUTION ORDERING THE CITY ENGINEER TO PREPARE FINAL PLANS AND
SPECIFICIATIONS FOR STREET IMPROVEMENTS TO JAMACA COURT NORTH
-(Carried 4 ayes; Morgan abstain)
• Morgan - Couldn't vote approval because of small turnout of previous
opposers. (Mr. Kuettner mentioned that some property is rented, vacant, etc.)
7. HEARING,.HOREISH VARIANCE & SHORELAND PERMIT - Bohrer explained to those
present to discuss (a)hUartiig iq-iophoreland variance for Lots 2, 3 and 4 for
lots under 1.5 acres and (b) Mr. Horeish Shoreland Permit including the
variance for a lot under 1.5 acres. Plat was approved prior to Shoreland
Ordinance adoption in 1980. DNR commitment is forthcoming.
• Fraser - What other properties could expect this same type of treatment?
(Bohrer - there are some undeveloped lots but haven't made a thorough search.)
• Eder mentioned the many exceptions made in DeMontreville Highlands.
♦ Bohrer - the few that would come up would be best done this way. If variances
not involved, permit or proposal still comes before the Council.
p Mazzara - would like to see how many more lots are involved.
M/S/P Fraser/Morgan to (a) approve a blanRL-t variance for Lots 2, 3 and 4
for lots under 1.5 acres and (2) a Shoreland permit for Lot 2 to include
variance. (5 ayes)
8. JANE ROAD NORTH IMPROVEMENTS, COST STUDY - Whittaker had one other response
from David Krause opposing project. Responses received were 5 opposed, 1 for
the project, and 1 phone call in opposition.
• Jim Weyer - opposed to both options: 32' wide road wouldn't look right and
additional water runoff isn't needed in Lake Jane area; the 22' wide road is
without drainage and we've already had soil erosion on our particular property.
We're also opposed to making this a through street. We prefer to leave Jane
Road the way it is.
• Bohrer - 32' road was proposed to collect water at low end and put drainage
into Springborn. 22' wide road would not control drainage. Absolute minimum
would be 22' otherwise traffic could not pass.
• Morgan - cost? (Bohrer - 32' street $4,300/1ot; 22' road $1,800/lot. These
are larger lots so cost is more than for Jamaca Court improvements.)
• Fraser - so it appears a petition is not forthcoming? (Whittaker- correct.)
♦ Jim Weyer - in past, it was assumed this would be a paved "driveway" and not a
city wide street and without the potential of being made into a through street.
(Eder - intention of first proposal was using 66' wide street and that's why lot
is 66' wide.)

•bill Brass -at meeting 2 months ago, big concern was to have plowing done for
emergency vehicles all the way to cul-de-sac - 10 homeowners on road and only 2
plowed it. (Bohrer - if either proposal were accepted, City would maintain. If
22' road accepted, there would be some erosion and I don't think City would be
responsible for that.)
* Jim Weyer - pavement instead of gravel would create substantially more runoff.
(Bohrer - gravel you have is so firmly packed and grade so steep, difference
would be minimal.)
o Jim Holmberg - I have water problem now and I understand this will be
contained as part of project. It takes half my lot right now. (Bohrer - if it
exceeds drainage easement, water would be collected and put in holding pond.
22' road would have crown in middle so runoff would be on both north and south
sides.)
o Majority of those present contended that City maintained road up until about 7
years ago and one wondered if it would be possible for City to do this again
without improvement. (Eder - When Krause developed land in 1963-64, standards
were nonexistent, he didn't want to put in street, and buyers wanted private
road; it was deeded to the City but not accepted because of cost of maintenance.
There are many examples of roads maintained by private citizens --such as Jane
Road until improvements made. Have no knowledge City ever maintained it.)
o Eder - City can't act unless there's a petition.
9. NEUDAHL PLAT - (REF: Letter from Dennis F. Peck of J.P. Homes Inc. to
Laurence Whittaker dated 6/30/83.) Mr. Peck reiterated statements and concerns
in the referenced letter. Essentially, they want (a) to request City to
t possibly install Jane Road Circle North, or take a part of roadway, as part of
this project since it would benefit City and allow the Neudahl's an easier way
to develop their property, knowing that there would be assessments to
benefiting lots, security pledges, etc.; and (b) to propose development in
phases (phase I would be the platted Lot 1, Block 1, and phase II would be the
improvement of lots abutting Jane Road Circle North and 2 lots east of Lot 1,
Block 1); under phase II, Jane Road Circle North would constitute a 1000-foot
long cul-de-sac requiring a variance from the 800-foot maximum allowed. He also
explained a more modest plan if above is not viable. There's also possibility
of extending Jerome Avenue. Problems that have to be dealt with are existing
topography, drainage problems, flooding of Lake Jane this spring. How much do
we have to address now? Would like to defer until one or two lots are platted.
o Eder - would be significant departure for City to finance projects and this
has not been done in the past. We need direction from engineering and planner.
o Fraser - would not want to foster change in present policy.
o Dunn - am against public financing of such private development projects.
o Bohrer - preliminary plan has shown there is sufficient area for ponding even
though not developed yet (such as streets are conveyance for runoff, etc.).
Often one lot is approved with understanding that drainage program is put in
when remaining lots are development but it's judgment call.
e Folz - Jerome Avenue was planned as through street; if street were extended,
storm sewer catch basin would be planned. Policy has been that developer does
drainage and streets;/are done by person who requests or needs them.
y Bohrer - drainage and ponding can be constructed in phases but needs long-
range plan.
10. PLANNING COMMISSION RECOMMENDATIONS
A. Klawitter Rezoning - Don Wolf, representing the Klawitter's, discussed
rezoning the Klawitter property (48 acres on SW corner of Keats and Highway 36)

from RR to AG. He stated it would be in conformance with surrounding area since
it is next to AG zoning, use would be in conformance with area and actually less
obtrusive than some uses already allowed on Highway 36, no noise, and traffic
would be minimal since used for wholesale business only. (Mrs. Klawitter
mentioned they do most of the delivering, etc.) No objections have been
received from neighbors.
• Fraser - acknowledge certain misgivings due to previous infraction of selling
retail. Would you elaborate on wholesale business? (Mrs. Klawitter - we're
starting to plant shrubberies and trees to be used for landscaping business;
tree trimming business has been sold off).
• Fraser - equipment? and where would it be stored? (Mr. Klawitter - tree
planter, 2 riding tractors and small hand types, 2 pickup trucks, 2 trailers -
smaller equipment would be stored in machine shed; other equipment would be
behind building which is not visible from road.
• Mazzara - why did City have to go to court? (Mrs. Klawitter - circumstances
were such that we didn't have a choice economically and could not go out and
rent more land for otoring equipment)
• Wolf - 60-day stay was granted at 5/17 hearing, temporary injunction.
• Fraser - this is permitted use in AG zone and this business can be generally
accepted but can also see extension of business creating more traffic, signs,
etc. Would zoning regulations protect us from this? (Whittaker - yes, but City
would probably have to go to court to enforce it. You in fact could sell trees
grown on property but not other landscaping materials.)
• Eder - record should show that the Klawitter's original intent is to only sell
wholesale (i.e. anything grown on property) and not sell retail.
0 Whittaker did not know City court expenses to date in regard to withdrawal of
complaint against the Klawitter's.
• Eder - would like to know amount of court expenses before action is taken and
feel the Klawitter's should reimburse us for part of these costs.
M/S/P Morgan/Dunn to adopt Ordinance 7955 to rezone the Klawitter property (48
acres on the SW corner of Keats and Highway 36) from RR to AG. (Carried 5-0)
Withdrawal of Complaint:
• Fraser - could action be deferred until we see what costs are? (Whittaker -
60 days is up in July.)
• Dunn - would just as soon drop complaint and not incur any more costs to City.
• Eder - violation was made so subsequent court costs should be reimbursed at
least in part. Amount should not be much - $100 or 300.
• Morgan - inclined to drop complaint since situation has been corrected.
• Mazzara - a portion of legal fees would be suitable.
M/S/P Eder/Mazzara to defer withdrawal of complaint issue until City attorney
can give us cost figures. (Carried 3-2, Morgan and Dunn nay)
B. Burrwood Estates - Folz presented the final plat containing all
easements, dedications, etc. Park donation amounted to $239.27 per lot. Since
improvements only consist of cutting drainage swale and putting in culvert,
detailed development agreement would not be necessary.

C. Packard Park (Peltier's one -lot subdivision on Legion Avenue) -
Whittaker stated if all conditions meet the Council's approval, development
agreement will be drawn up and signed before final plat; park donation is
$175.00.
M/S/P Morgan/Mazzara to adopt Resolution 83-48:
TO APPROVE THE FINAL PLAT FOR PACKARD PARK CONTINGENT UPON CONDITIONS
FOR PAYMENT OF PARK DONATION, MAINTENANCE AGREEMENT FOR LEGIONAve, and
DEVELOPMENT AGREEMENT, ALONG WITH VARIANCES FOR PONDING AND UNIMPROVED
PUBLIC STREET. (Carried 5-0)
D. Comp Plan Hearing, to be held August 8 at 7:45 p.m. Consensus of
Councillors was that this item would be covered briefly in Newsletter and that
special notices would be sent to those concerned.
9:15 to 9:30 p.m. - BREAK
11. ENGINEER'S REPORT
A. Hubenett Shoreland Permit - Bohrer presented "Topography Survey and
Grading Plan" showing area to be filled (as staked out by DNR) on the Hubenett
property across Lake Olson and which is being flooded. Would require 158 yards
of fill to bring to 931:932 elevations and to make his land useful in back. No
variance is required; Valley Branch Watershed has approved permit because amount
is below that allotted for shoreline. We would recommend that drainfield be
marked so heavy equipment doesn't run over it. Presently, drainage runs across
south driveway and by filling, some water may stand on edge of driveway so
culvert may be needed. Hubenett should assume responsibility for drainfield and
culvert.
♦ Hubenett mentioned that there has been no problem with drainfield put in 1970.
M/S/P Morgan/Dunn to grant Hubenett Shoreland Permit according to Survey and
Grading Plan. (Carried 5-0)
B. LAWCON, Cost for Preparing Cost Estimate - Bohrer listed improvement's
for Pebble Park as delineated by Park Commission and engineering cost would be
$600.00 to estimate improvements requiring some field work but no surveying.
♦ Whittaker - money could come from General Park budget.
M/S/P Dunn/Morgan to approve the $600.00 engineering cost as presented by Mr.
Bohrer to estimate LAWCON cost estimate. (Carried 5-0)
C. Cimarron Shoreland Permit, Seepage Pond - Tom Noyes, engineer,
illustrated the proposal to construct two rapid infiltration basins into which
water from Lake Rose and/or water from existing Waste Water Treatment Plant
effluent seepage ponds may be pumped if existing dikes are threatened by high
water. This proposal would generate 400 gallons a minute to equal 1.76 acre-
feet a day to compare with present 7 gallons a minute. PCA has given a
consensus of yes that soils will hold water; Mr. Taylor will be talking to
Valley Branch and DNR regarding approvals.
♦ Bohrer - project is in response to Council's desire to have Cimarron solve
problem. We believe that this proposal should be reviewed by the PCA, DNR and
Valley Branch Watershed as to operating plans to see under which conditions this
project would be instituted and receive a copy of plans and specs recognizing
safety and other public features.

o Morgan - think this is a wonderful initiative taken on by Cimarron and a
chance to gain valuable information for future like situations.
! Eder - Mr. Taylor and staff are to be commended for job they've done.
M/S/P Morgan/Mazzara to grant the Cimarron Shoreland Permit for seepage pond
contingent upon Larry Bohrer's recommendations. (Carried 5-0)
D. Tablyn Park Improvements
1. Road Access - Service road needed to maintain park is proposed to
be located south of large drainage ditch next to spillway; curb will not have to
be removed. City crews plan to do majority of work but it will require small
equipment rental and 10 tons of limerock and perhaps posts and chain will be
required. We've estimated $565 for the remainder of cost for the service road.
2. Black Dirt - 7' x 130' area needs top soil to get some grass
growing in that area. Would best be handled by contractor. Our estimate for
115 cu. yd. of 4" of topsoil to include leveling, hauling in dirt, seeding,
mulching and fertilizing is $1,050.
3. Fence Pond - A fence has been suggested around the drainage pond
which has about 1 foot of standing water and there might be hazard. The
suggested woven wire can be climbed and chain -link fencing would cost about
$1,550. We could be making it more of an attractive nuisance by fencing. In
fact, 80% of water mishaps occur in fenced facilities. Also, fencing makes it
more difficult to maintain.
t o Whittaker - attorney thinks fence would not change liability.
a Mazzara - seems like a lot of money for a pond.
o Morgan - not enough water to worry about --frozen 9 months of the year.
M/S/P Morgan/Fraser to approve funds for Tablyn Park road access and black
dirt but to deny fencing of pond. (Carried 5-0)
12. OLD BUSINESS
A. County Road 19 (I-94 to loth Street)
1. Plan Parkway - Dorothy Lyons was present to express her dissatis-
faction with plans for the park along County Road 19 leading to RegionalPark
since it would be an overflow area for drinking, etc. when Regional Park closed
at night and increase hazards of pine trees catching fire; create additional
taxpayers' expense regarding extra policing and maintenance and the 10-12 car
parking lot proposed; and there could be possible pollution of lake. Seems to
be more of a public nuisance to that whole area; I think we should go back to
existing line and it's too elaborate as entrance to Regional Park. (Eder - we
were trying to change it from two-lane divided highway into something more
scenic.)
• Fraser - points regarding the park area are well taken --such as park nuisance and
add extra expense. I like green area in road median strip.
o Folz - would be good idea to have Park Committee look at it to see if they
want that type of park. Also, if there is bike trail it should be fenced to
protect adjacent commercial property.
e Morgan suggested getting Park Committee's recommendation, but Whittaker said
they wouldn't be meeting until August and Council's reaction is needed in July.
I think if we told them we don't want it, they wouldn't have a problem taking it
out of plan.
a Eder - points to be suggested are (a) fence west side of bike trail, (b)
eliminate parking lot, and (c) cut down on amount of right-of-way.

Bike Trail - M/S/P Morgan/Mazzara to have the County consider installing a
fence separating the bike trail from the west property owner and to include this
in the design. (Carried 5-0)
City Administrator was directed to send letters to property owners as to what
the Council recommended.
2. Assessments - Whittaker stated that adjacent property owners should
share in the cost of acquisition of right-of-way and access since improvement
would open development to property owners. One property owner that would
benefit would be Federal Land Company for shopping center.
0 Eder - main time it would be considered would be for residential and
commercial; here it's collector street with limited access. Until we get better
idea we can't make decision.
p Dunn - If money is not available to build this project, it shouldn't be built.
Benefi.tting property owners have already paid in other ways.
•Fraser - This primarily serves the Regional Park.
Consensus of Councillors was that they were not interested in assessments.
B. Park Commission Recommendations_
1. Damage Deposit to $50.00 - M/S/P Morgan/Dunn to accept the
revised "Policy and Fees for Park Use in City of Lake Elmo" as submitted.
(Carried 5-0)
2. Security Lights, Tablyn - M/S/P Mazzara/Morgan to approve the
purchase of a security light in the parking lot by the tennis courts.
(Carried 5-0)
3. Revised 5-Year CIP - Whittaker suggested that Councillors look at
the 5-Year CIP presented before budget appropriations are made.
C. Ordinance 7954, Changing Wetland Setback -
M/S/P Morgan Dunn to adopt Ordinance 7954: AN ORDINANCE AMENDING THE 1979
MUNICIPAL CODE RELATING TO WETLANDS. (Carried 5-0)
D. Resolution 83-45. Park Donations for Laree Lot Subdivision -
M/S/P Morgan/Dunn to adopt Resolution 83-45:
A RESOLUTION RELATING TO PAYMENT OF THE FEE UNDER THE SUBDIVISION ORDINANCE
IN LIEU OF PARK DONATION AND REPEALING RESOLUTION 79-37. (Carried 5-0)
13. COUNCIL REPORTS
A. Mayor Eder, Lake Jane Flooding - (REF: Maynard L. Eder memo to City
Council regarding "Alternative Flood Control Measures for Lake Jane.") Eder
read alternatives to those present in audience.
9 Bohrer - Alternative between Items 11 and 12 would be to pump water through
Schaffer Contracting Gravel Pit since it is shorter distance.
o Morgan - would be good situation to review gravel pit percolation/seepage
basins and flow rates.
9 Richard Murray questioned the feasibility and economics of it. Option 1 seems
the most feasible.
9 Bohrer - this is semi permanent pond in first place so will hold sediment.
9 Scottie Lyle - there's concern of trees dying.
• Carol Kuettner - how feasible would it be to move 2 houses up? (Eder -
wouldn't have time to do this before flooding.) (Ken EV anoff - there's no way
houses could be moved up now with water so high.)

M/S/P Morgan/Mazarra that City give permission to Valley Branch to pump
another 2' in City Park pond and to have city engineer look at this to see if
any damage is being caused. (Carried 5-0)
14. ADMINISTRATOR'S REPORT
A. City Release, Whittaker's Deferred Compensation, ICMRC -
M/S/P Morgan Mazzara to have Mayor send letter to ICMRC authorizing release of
Mr. Whittaker's deferred compensation. (Carried 5-0)
B. Volunteer, Ramsey/Washington Metro Watershed, CAC -
Valley Branch Advisory Committee is looking for nominee. Whittaker will contact
interested people in that area (e.g. Bob Dreher, Connco representative, etc.).
C. Nominee for VBWD Board of Managers -Al Horning's turn is up and
replacement is needed. Whittaker will pursue prospects from Baytown and West
Lakeland area and report on this at next meeting.
D. Severence Pay, Sick Leave - pamphlet was handed out for favorable/
unfavorable comments for July 19 meeting.
E. Metro Water Quality Hearing - to be held August 2 on Lake Elmo, at Stillwat er.
F. Maintenance Water Department - M/S/P Morgan/Fraser to accept Mr.
Wisdorf's recommendation for both the trash pump (water main breaks, etc.) and
the Schoenstad locater (underground pipe) as presented. (Carried 5-0)
G. Liquor License, Jaycees Huff n' Puff Days - M/S/P Morgan/Mazzara to
waive liquor license fee for Huff n' Puff Days. (Carried 5-0)
H. Code Books - Councillors agreed to bring their code books into City
Office to update and collate them.
I. School District Meeting - Stillwater Educational Council has invited
governmental entities to share in their meeting July 25 at 7:30 p.m.
The meeting was adjourned at 10:45 p.m.

RESOLUTION
CITY OF LAKE ELMO
( WA.SALNGTON COUNTY, MINNESOTA
A RESOLUTION RELATING TO PAYMENT OF THE FEE
UNDER THE•SUBDIVISION ORDINANCE IN LIEU OF
PARK.DONATION AND REPEALING RESOLUTION 79-37
WHEREAS, the City of Lake Elmo has adopted various
subdivision ordinances providing for donation of park
Land or in the alternative the payment of a fee to the
City; and,
WHEREAS, since October 3, 1968, the City of Lake
Elmo has by ordinance regulated minor subdivisions which
were exempt from the park dedication requirements; and,
WHEREAS, the City Council determined , in
Resolution 79-37 that the City would collect a fee in
the amount of $175.00 per lot in lieu of park land ded-
ication on all those minor lot subdivisions occurring
since October 3, 1968;
WHEREAS, Ordinance 7951 requires a park land. or
cash donation for all minor subdivisions.
( NOW, THEREFORE, BE IT RESOLVED, by the City Council
of the City of Lake Elmo:
1. Effective immediately all minor subdivisions
occurring from October 3, 1968 to July 5, 1983, shall
pay to the City a fee of $175.00 per lot, in lieu of
park donations, at the time a building permit is issued
for that lot.
2. A1.1 Simple and Large Lot subdivisions shall pay
to the City a .fee of $175. per lot in lieu of park donations,
at the time of subdividing before recording of said sub-
division.
3. The City Administrator is authorized and directed
to determine what parcels are effected and to collect said
fee.
4. Resolution 79-37 is hereby repealed,

A RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF
PLANS.
WHEREAS, a Resolution of the City Council adopted the
7th day of June, 1983, fixed a date .f.or a council hearing
on the proposed improvement of Jamaca Court North; and
WHEREAS, ten (10) days published notice of the hearing
through two weekly publications of the required notice was
given and the hearing was held thereon on the 5th day of July,
1983, at which a1.1 persons desiring to be heard were given
an opportunity to be heard thereon;
NOW, THEREFORE, BE IT RESOLVED. -by the City Counci'1°of o
the City of Lake Elmo as follows:
1. Such improvement is hereby ordered as proposed
in the Council Resolution R--83-37, adopted the
7th day of June, 1.983. d
2.. 'Foltz, King, Duvall, Anderson & Associates is
hereby designated as the Engineer for this
improvement. They shall prepare plans and
specifications for the making of such improvement.

A RESOLUTION APPROVING THE FINAL PLAT OF BURRWOOD ESTATES.
WHEREAS, the City Council of the City of Lake Elmo has
previously considered and approved the preliminary plat. of
Burrwood Estates, and
WHEREAS, the applicant has now presented to the City a
final plat- which conforms to the approved preliminary plat
and meets all the requirements of the City's Subdivision.
Ordinance:
NOW, THEREFORE, BE IT RESOLVED that the City Council does
hereby approve and accept the final plat of Burrwood Estates
as the same is on file with the City Administrator, subject
to the following conditions:

1. All required drainage improvements as set forth
in Valley Branch Watershed District Permit No. 83-11.
must be constructed in a fashion ,satisfactory to
( Valley Branch Watershed District and the 'City of
" Lake Elmo before the final plat shall. be Aigned by the
City of Lake Elmo.
2.. The applicant must warrant these drainage improvements
for a period of. one (1) year following their final
acceptance. 11
3. The applicant must pay the City the sum of $957.00 for
the City park donation fee.
4.. The applicant shall pay all pass -through costs incurred
by the City prior to signing of the final plat by the
City.

final plat which conforms to the approved preliminary plat
and meets with the requirements of the City's Subdivision
Ordinance:
NOW, THEREFORE, BE IT RESOLVED that the City Council
does hereby approve and accept the final plat. of Packard
Park as the same is now on file with the City. Administrator

1. Gene Peltier, the owner, together with his heirs
and assigns, agrees to maintain Legion Avenue along
the front lot line at his expense for emergency
vehicles in exchange for a variance from the City
requirement that this lot be on an improved public
street.

2... Gene Peltier, together with his heirs and assigns,
agrees to provide any necessary surface water drainage
and ponding facilities determined in the sole discretion
of the City of Lake Elmo at the time the balance of
the property is platted. This condition is based
upon the fact that the owners received a variance
from the City from the City's drainage and ponding
requirements.
3.. Gene Peltier, together with his heirs and assigns,
shall pay $175.00 to the City for park donation fees
together with all pass -through costs before the
final plat is signed.
