HomeMy WebLinkAbout04-03-84 CCMLAKE ELMO CITY. COUNCIL MEETING APRIL 3, 19811 The meeting was called to order by Mayor Eder at 7:10 p.m. in the council chambers. Present: Dunn, Mazzara, City Administrator Klaers, City Engineer, Bohrer. 1. Agenda: M/S/P -- Dunn/Mazzara - to approve the agenda as amended: add: 6-D Appraisal Quotes 6-E Shoreland Permit 7-A Council Reports 8-H VBWD Report 8--G Christmas Lights Delete: 8-D CIP Tractor (Motion carried 3-0) 2. Minutes: for MSA Improvements for Kinderman - Campfire Resolution M/S/P - Dunn/Mazzara - to approve the minutes of the March 6, 1984 City Council meeting as presented. (Motion carried 3-0) 3. Claims: M/S/P - Mazzara/Dunn - to approve claims 84693 thru 84769 as presented. 4. Presentation by Mike Castelluccio from Lakeview_ Memorial HospItal'on area Hospital Service. Mr. Castelluccio stated that this hospital has recently made application to the State Department of.' Health for ap'?roval to operate an ambulance service in Stillwater and the surrounding area. They feel that as. a non-profit and hospital based ambulance service, they can offer quality service at a reasonable cost to the people using the ambulance service. The plans now are for two new ambulances; and to have a paramedic and EMT on duty twenty-four hours a day, seven days a week, for the first call. The back up ambulance will consist of a paid part-time roster of volunteers who will be paid on a per --run basis. `They now have over thirty volunteers on this roster. There are nurses within the hospital who are qualified for ambulance service, and will also be taking EMT training. They have targeted for a thirty percent savings from the existing rates. Mr. Castelluccio further stated that at this point, they do not feel that they will need a subsidy from any of the communities. If a subsidy was ever requested, the hospital's books will be opened; and the only reason that a subsidy would ever be requested would be to keep the rates down. There will be a rate list published in the near future comparing the proposed rates from Lakeview Hospital versus the rates from the existing ambulance service. Fire Chief, Fran Pott, stated that all of the incidents mentioned in the local television stations expose on the current ambulance service were in the Oak: Park Heights/Stillwater area. They did not involve Lake Elmo. LAKE ELMO CITY COUNCIL MEETING April. 3, 1984 PAGE 2 Mr. Castelluccio stated that there was one incident in Lake Elmo (in February of this year) on DeMontreville `1'rall, where Mahtomedi ambulance service responded to a call. Pott stated that some kind of consideration should be made for the lr southwest portion of the City. There is a very long response time r from Stillwater for this area of the City. Pott further stated that he has not yet talked to Woodbury (about handling these calls), but feels that it is something that should be looked at. M/S/P - Mazzara/Dunn - To instruct the City Administrator to draft a letter of support for the Lakeview Memorial Hospital application to operate an ambulance service in the Stillwater area. (Motion carried 3-0) Dunn stated his endorsement of this request is not based on the recent - expose on KSTP Television. Where are a lot of unanswered questions resulting from this report. Dunn stated he likes to see competition, and on that basis is in favor of this endorsement of Lakeview Hospital's request. 5. Licenses for Lake Elmo Fire Department: A. 3.2 beer license for April 7th Spaghetti Dinner; June 15th Street Dance; Huff n' Puff Days - August 9th, 10th and 11th. M/P/S - Mazzara/Dunn - To approve a 3.2 beer license for the fire department for April 7th, June 15th, and August 9th, 10th and 11.th, and to waive the fee for each license. (Motion carried 3-0) B. Bingo :License for Huff n' Puff Days. M/S/P - Dunn/Mazzara - To approve a bingo license for the fire department for August 9th, 10th and 11th;`and to waive the fee for this license. (Motion carried 3-0) C. Lions Club of Lake Elmo. Willard Griffin, representing; the Lake Elmo Lions Club, stated that the Club is .looking for projects to be done and would like some suggestions from the City Council. The City Administrator will contact the Parks Commission and Fire Department for suggestions for future Lions Club projects. Mr. Griffin further requested that the City Council go on record as being in favor of reducing the speed limit on Lake Elmo Avenue North (to 30 m.p.h.) Klaers to compile the necessary information for a Resolution petitioning the speed limit be reduced, and return it to the Council table at its next meeting. 6. Engineer's Report: A. Crombie Simple Lot Division at 8120 DeMontreville Trail North A LAKE ELMO C:C'PY COUNCIL MEETING April. 3, -1984 PAGE 3 Pursuant to review, the Planning Commission, City Engineer, and City Staff recommended approval of this application. M/S/P - Mazzara/Dunn - To adopt Resolution 84-29; a Resolution i approving the Single Lot Division for Mr. and Mrs. Crombie at 8120 DeMontreville Trail North contingent- upon receiving $175 cash donation for park purposes; and that if the Crombie 2nd Addition is ever platted, provisions be made for the additional storm water run off created by this lot split. (Motion carried 3-0) B. Johnson Shoreland Permit and Lot Size Variance at Lot 6, Oace Acres. Pursuant to report from City Engineer; that Mr. Johnson has revised his site plan to meet the 1.00' setback from the OIIWM to the structure, and all other concerns have been met which were outlined in City Engineer's letter of February 16, 1984, the City Engineer and City Staff' recommended approval of this request. M/S/P - Dunn/Mazzara - To approve 'the Shoreland Permit and Lot Size Variance for Lee W. Johnson on Lot 6, Oace Acres. (Motion carried 3-0) C. Moen Shoreland Permit and Lot Size Variance at 91.12 Jane Road North. Mr. Moen proposes to construct a garage at the above address. Since the property is within 1,000 feet of Lake Jane, Shoreland Regulations apply. The lot contains 1.43 acres where 1.5 acres are required. Pursuant to report .from City Engineer, that Mr. Moen meets all. of the requirements as outlined in City Engineer's letter of March 23, 1-984, the City Engineer and City Staff recommends approval of this request. M/S/P - Dunn/Mazzara - To approve the Shoreland Permit and Lot Size Variance for Michael Moen at 9112 Jane Road North. (Motion carried 3-0) D.1984 MSA Improvements: Presentation of plans and specifications, plus request to order advertisement for bids. The Engineer presented and reviewed the plans and specifications of the proposed -improvement of 45th Street, Julep Avenue, and 4'lth Street from Jane Road North to Keats Avenue. The Mayor mentioned that the Soil Conservation Service will be making a recommendation .regarding drainage across the Myrtle Eder property. The SCS will be sending the Engineer a copy of their recommendations. Basically, the; recommendation involves directing the water across Julep Avenue in only one location, which is basically the low point in Julep Avenue about station 21+50. The other crossings near the intersection of Julep Avenue and 47th Street should be eliminated or should, by ditching, direct the drainage to the main line crossing at station 21+50. The SCS plans to construct a grassed waterway at that location and they feel. that is better than having two waterways cross the agricultural property. M/S/P - Mazzara/Dunn - To adopt Resolution 84-26 - A Resolution accepting the Plans and Specifications for the 1984 MSA Improvements, LAKE ELMO CITY COUNCIL MEETING April 3, 1.9811 PAGE )I subject to additions that may be entered as a result of the recommendations of the Soil. Conservation Service; and ordering the advertisement for bids. (Motion carried 2-0-1 <Eder>) Bohrer stated that the bids will be opened at 10:00 a.m. on May 9, 1984. The City Council reviewed the two proposals for right -of --way appraisals submitted by Winnfield, Inc. and by Appraisal Research Associates. Winnfield, Inc. provided a bid of $350 and Appraisal Research Associates bid $1,000. The City Council reviewed the qualifications of each firm and their bid price.The recommendation (:,f the City Staff was to award the bid to Winnfield, Inc. M/S/P - Mazzara/Dunn - To accept the $350 quotation of Winnfield., Inc. to perform the land appraisals for the 1984 MSA Street Imrpovements. (Motion carried 2-0-1 <Eder>) E. Shoreland Permit and Lot Size Variance for Richard J. Kinderman at 7818 North 50th Street. Mr. Kinderman proposes to construct a garage at the above address. Since the property is within 1000 feet of Lake Olson and Lake DeMontreville, Shoreland Regulations apply. The lot is approximately 1 acre; therefore, a. lot size variance is needed. Pursuant to review by the DNR and City Engineer, the staff recommended approval of this request. M/S/P - Dunn/Mazzara - To grant a Lot Size Variance and Shoreland Permit for Richard J. Kinderman at 7818 North 50th Street. (Motion , carried 3-0) F. Other - Lake Jane Pumping The City Council reviewed the letter dated March 13, 1.984 from the Valley Branch Watershed District. This letter is an attempt to address questions that were raised by the City Council at their meeting of March 6. Much of the letter centered around discussion and costs of providing a different pumping program to Eagle Point Lake. The City Council is very concerned with highwater levels on Sunfish Lake and that's why they suggested the Watershed District consider pumping in a different direction to Beutel Pond and then on to Eag..e Point Lake. The City Council considers that rerouting the pumping to Beutel Pond as an amendment to the original petition for project 1005 and within the scope of the original petition. It is believed that the petition did -not specify where to deposit the water. The City Council instructed the Engineer to review a copy of the original project 1005 petition, develop a response outlining the City Council's position to the Watershed District and route a draft- copy of that response to the individual council members for review and comment. 7. Council Reports: A. Campfire Resolution M/S/P - Eder/Dunn - To proclaim the week of March 17 thru March 24, 1985 as Camp Fire Birthday Week. (Motion carried 3--0) LAKE ELMO CITY COUNCIL MEETING April 3, 1984 Page 5 8. City Administrator's Report: i A. Preliminary Plat extension of time request for Midland Meadows ( Mr. Stockstead, developer of Midland Meadows, appeared before the City Council to ask for a 1 year extension of the preliminary plat approval of Midland Meadows. The 1 year extension is requested due to the slow economic situation with the new housing market. M/S/P - Eder/Mazzara - To adopt Resolution 84-28 granting a one year extension of time of the Preliminary Plat approval for Midland Meadows. (Motion carried 3-0) B. Election Equipment Pursuant to the demonstration of the punch card election equipment by a representative of E.L. Marketing, before this regular council. meeting, the following action was taken by the City Council. M/S/P - Dunn/Mazzara -- to authorize the City Administrator to purchase: the required material to implement the punch card voting system in Lake Elmo for the approximate cost of $2500 from E.L. Marketing. (Motion carried 3-0) Dunn stated that in anticipation of any problems with this system, we should seek the cooperation of people like the Jaycee's to set up informational meetings, etc., to get people orientated to this system. Klaers stated a demonstration unit will be set up in City Hall and we could possibly put up a demonstration unit, at the Bank, Library, County Fair; put on demonstrations where it will get the most exposure. Also, give it print in the newsletter. C. Street Sweeping Bids 9 In 1983, the City had a problem with the contractor who received the bid„ This contractor (McPhillips) is again the 'low bidder. for 1984. However, because of previous difficulties with this contractor, Maintenance Foreman Wisdorf has recommended that the bid be awarded to the second lowest bidder (Allied Blacktop). M/S/P - Dunn/Mazzara - to award. the 1984 Street Sweeping Contract to Allied Blacktop in the amount of $2450. (Motion carried 3--0) Dunn feels that McPhillips should be notified as to why he was denied the bid, as he was the .lowest bidder. D. CIP Equipment for Parks: Tractor (Tabled) E. MEED Employee Administrator advised the City Council that the City does not have to provide Workman's Comp. or health insurance and is not eligible, as a government agency, for the additional $1.00 per hour to cover these expenses. Also, the employee will be paid directly by the County and the City's only functions will be to fill out a time sheet, and supervise the employee. (Motion carried 3-0) F. Clean -Up Days M/S/P - Dunn/Mazzara - To authorize Sparing Clean Up Days to be held at the old landfill site on May 5th, 1984 from 8:00 a.m. until 12:00 noon; and to charge the fees per recommendation from Maintenance Foreman. (Motion carried 3-0) G. Christmas Lights - Carol Kuettner The City Council reviewed the letter from the';"Li.ght Up Lake Elmo Committee", wherein the Committee asks for permission to sell the existing Christmas lights and use the proceeds towards the purchase of new lights; and wherein it states that the Committee will accept all responsibility for these lights; ie; purchase, maintenance, putting up, taking down, and electrical costs. M/S/P - Mazzara/Dunn -To direct the Administrator to draft a letter to the "Light Up Lake Elmo Committee" giving the committee rights to the lights. (Motion carried 3-0) Mayor Eder commended Carol Kuettner for the efforts of this committee. KLAERS, CITY ADMINISTRATOR INFROMATIONAL MATERIAL FOR APRIL 3 MEETING 1" I wish to acknowledge that the Met Council approved the Lake Elmo adopted change in the MUSA line. The City Council at its 1^17-84 meeting requested that the MUSA line run from north to south along the section line between Sections 32 and 33 to 4th Street and then run east to Inwood Avenue and then south to I`94. This proposal got a favorable review from the Metropolitan staff and the Council had no problems with this proposal" 2. Wish to remind everyone that there will be a demonstration of voting punch card equipment at 6:15 on Tuesday, April 3, before the regular City Council. meeting. 3. Attached is a map with diagonal lines showing the unneeded right-of-way that Mn/DOT obtained for 1-94 construction. Last year the Council passed a resolution requesting that this land be given to the City for future park purpopes"` Mn/DOT is in the process of obtaining appraisals for the value of this land. Once a value is determined, the City has the first right to purchase, the previous land owner, Doug Decoster, has the second right to purchase and the third option to sell the land would be at a public auction. Originally, the City believed that this land would he free or cost the City a minimal amount" I now understand that this definitely will not be the case and this land will not be cheap. The Park Commission has indicated a definite lack of interest in spending any substantial amount of money for this land. ` If the land returns to the previous owner or is purchased ~by a new owner and developed into some commercial activity, then a buffer zone can be required, per the City Code" Construction of this buffer zone was the intent of the City in the first place. This City Code buffer zone is very thin and narrow, but would be the responsibility of the developer' I do not believe that the City can afford a large expenditure for park land in this area. I believe that in Lake Elmo the2,r:'.t functions and related activities would be better and more efficiently handled by the sponsoring commission. The staff had one addition to the 1983 approved plan and that was for the Tab:lyn Park:: parking lot and entrance drive off of CSAH 6. I am not sure if the future of this plant is in doubt, but, some concerns are certainly raised in this article.
