MAY 1, 1984
The meeting was called to order.by Mayor Eder at 7:05 p.m. in the
Council Chambers. Present: Dunn, Fraser, Mazzara. (Morgan out of
town on business). Also present was City Engineer Bohrer and City
Administrator K1ae.rs.
1. Agenda:
M/S/P Fraser/Mazzara - To approve the agenda as amended. Add 6A --
Resolution for Mike Pott. (Motion carried 4-0)
2. Minutes:
M/S/P Dunn/Mazzara - To approve the minutes of the 4-17-84 City
Council meeting as presented. (Motion carried 4-0)
3. Claims
M/S/P Mazzara/Dunn - To approve claims 84807 thru 811744. (Motion
carried 4-0)
It. Public Inquiries: There were no public inquiries at this meeting.
5. Engineer's Report:
A. Shoreland Permit and lot size variance for Timothy
Mandel at Lot 1, Block 2, Eden Park 1st Addition on
Lisbon Avenue near Downs Lake.
Pursuant to a brief discussion regarding Engineer's concerns regarding
the septic system, and pursuant to a favorable recommendation for
approval of this application by the DNR and City Staff, the .following
action was taken.
M/S/P Fraser/Dunn - To approve the shoreland permit and lot size
variance for Timothy Mandel at Lot 1, Block 2, Eden Park lst Addition
provided that the applicant conform to the septic system
recommendation from the City Engineer in his 4-26-84 report. (Motion
carried 4-0)
B. Shoreland Permit and lot size variance for Riverwood
Humes at Lot 2, Oace Acres 4th Addition off of Hidden
Bay Trail on Olson Lake.

recommendation that the minimum bottom of trench elevation of 934 be
staked in the field by an engineer or surveryor„ (Motion carried 4-0)

C. Review of appraisals for right--of-way required for the
19811 MSA Project plus .request to offer said amount to
property owners.
The City Engineer began this discussion on the MSA Project by t(
distributing sections of the appraisals submitted by Winnfield, Inc..,
regarding the Myrtle Eder, John and Janet Berschens, and Gerhard and
Linda Schmidt property. The Engineer also put up the maps of the MSA
Project and right-of-way on the wall. Eder, expressed concern that the
highest and best use of the land was not considered when the
appraisals were developed. Eder, felt that cluster development of
seven units per forty acres could bring a much higher appraisal of the
].and than considering one unit per ten acres residential development.
Eder felt that it was possible that the assumption by the appraiser
was not appropriate.
The Engineer reviewed the residential development criteria that is
permitted in residential zones as outlined in the rural residential
zone in the City Code. Eder indicated that without noting if the
appraisals considered cluster developments, that the values for the
right-of-way could be substantially different.
The Engineer noted that the VBWD reviews the MSA improvements as
required by law. The City, like any other developer, must abide by
the 1% run off rule.
Dunn indicated that if the appraisals were increased because of
potential development, then accordingly, the taxes on the land may
also increase.

M/S/P Fraser/Mazzara - To refer the.appraisals back to Winnfield
Inc., in order for them to consider residential cluster development in
arriving at appraised prices; or for Winnfsield, Inc., to give further
explanations to the City Council. as to haw the existing appraisals
were determined. (Motion carried 3-0-1 <Eder>)
Eder mentioned that a special meeting may be needed for the project to
con Inue on its sch.>duled time frame. After a brief discussion, it
was determined that a special meeting would not be needed as deferring
app z:isal.e, until Ma,Y 15th Would not delay the project. A copy of any

Cit- Council as soon as possible.

A. Application for Park Commission by Rosemary Armstrong
for first alternate position.
After a brief discussion by the City Council, the following action was
taken.
M/S/P Dunn/Fraser - To appoint Rosemary Armstrong to the first
alternate position on the Parks Commission. (Motion carried 4-0)
B. Quotations for backstop in DeMontrevi.11e Park
(holdover from 1983 Parks CIP)
Klaers updated the Council on recent Parks Commission actions
regarding a backstop in DeMontreville Park. After a brief discussion,
the following motion was adopted.
M/S/P Dunn/Mazzara - To accept the low bid of Midwest Fence in the
amount of $1,,090 for the materials and installation of a backstop in
➢eMontreville Park. (Motion caried 4-0)
C. Planning Commission Updates and Recommendations
Klaers gave a brief review and update on recent Planning Commission
discussions regarding lot sizes. Fraser indicated that in the future,
the Business Association should be invited to participate in
discussions which relate to business concerns. Eder indicated that
often, the lot sizes required for business' are determined by the use
of the business. Dunn indicated that he felt the drainfield
requirement is the most important, issue determining lot sizes. Eder.
and Fraser both expressed pleasure with the extensive process and
review given this topic by the Planning Commission.
M/S/P Fraser/Dunn - To acknowledge the Planning Commission's
recommendation to retain the 1-1/2 acre lot; size requirements in
business and residential zones; and to acknowledge the Planning
Commission's endorsement of the 60% rule and average lot size policy,
whereby the variances should be kept to an absolute minimum. (Motion
carried 4-0)
E. Washington County Commissioner, A.B. Schaefer, Jr., to
discuss the Waste -to -Energy proposal; the landfill
situation; plus other relevant Take Elmo issues.
There was a general discussion on the Waste -To -Energy plant that is
proposed to be .located in Section 32 of Lake Elmo. Schaefer indicated
this his been a very long drawn -out and slow process, and he has urged
the b6a4rd to proceed with the purchase of :Land in the event that this
, �ni ir1 t : r rti 6h schedule The environmental review process has
omp...„'ishi s plant in Section :32, but Schaefer
Indicated tk ���{�Wllii ,tY RPPOAP9 to be dragging their feet on this
issue as it is an election year.. Schaefer further indicated that, 3M
has a committment to purchase the steam from this proposed plant, and
3M's plans for moving to Texs has no effect on this project.

Bob Dreher, a property owner in Section 32 was present to discuss
future residential development in the area and the timing of the
Waste--To-Energy plant being in operation after the project proceeds.
The discussion centered on private versus public efforts to find
alternatives to landfills and it was not established that a private
company could do a better ,Job in running a waste--to-energy plant than
a public agency.
Consensus of the Council was that the County Board should make some
type of a presentation in the very near future to the property owners
in Section 32 in an effort to keep the citizens updated on the
progress of the Waste -to -Energy project. Mike Mazzara will work with
Commissioner Schaefer in organizing this presentation.
M/S/P Fraser/Mazzara •- To adopt resolution 84-35 requesting the
Waste--to-Energy Board make a presentation to the property owners in
Section 32 in an effort to update the citizens on the progress of the
Waste -to -Energy plant as the original timeframe has been delayed
numerous times. (Motion carried 4-0)
The contaminated landfill. situation (south of Lake Jane and east of
Jamaca) was briefly discussed. A committee to determine alternativv
water supply solutions will begin meeting on May 14th, 1984.
Committee members will be from Lake Elmo City Council, Lake Elmo
citizens, Washington County and Ramsey County staffs. Schaefer
indicated that this issue has a much higher priority than the
Waste -to -Energy project. Further reports are due from consulting
engineer's hired by Washington County (Hitchcock & Assoc) and that
report will be forwarded to the City Council when received.
Schaefer briefly updated the City Council on planned expenditures in
the Regional Park in 1984. The discussion touched on the presentation
at the April 17th meeting by Jack Perkovich, Washington County Parks
Director on the entrance to the Regional Park from the south. The
Council expressed appreciation of the County's consideration of the
concerns of Lake Elmo for this entrance.

County Deputy rescued two men in an over -turned boat on Lake
Demontreville and, according to Washington County sources'
definitely saved two lives by their quick response,,
At the 4`24~84 Annual Meeting of the Fire Department Relief
Association/ Mike receive a letter and Certificate of
Commendation from Washington County. All of Lake Elmo can
be proud of Mike and the efforts of the Volunteer Fire
Department.

lornted in the area and the supplies needed to rectify the
problem (per Council authorization last fall) have been

Cattle Design.

Regarding this law suit, the City is in the process of
responding to a second set of questions that have been

signifisant to report about this law suit at this time. The
City iS basically doing routine work (as much as a law suit

The major question the Council l will l have to address in the
future (late 1985 or 1986) wi.l.l be relative to the

program. The City Council addressed d the hand amount needed
by Lake Elmo at their 2 7•-84 meeting. At that time the.,
staff indicated tlhaat we would need appromimataly $200,000
plum the amount nett prepaid by the property t.y owners for their
new sewers. After 'futhe9r analysis, the staff now believes
that theme figures should not be added together to determine
the 'tottal amount needed in the bond. Thim. collection of
permit feels or assessments only relates to "how fast" t:.hle?

backs these bonds with its "ful.l faith and credit" and will,

go to the City Counci.:l. on May 1%
On May 14 t.he., Planning Commission wi.l.l also hold a Public

as CUP. The Planning Commission will also be reviewing the

9" I would also like to acknowledge that the Planning 0
Commission will hold a Public Hearing on two other Cgde
at its 5�14 meeting" These code amendments
relate to:
A, an extension of time requirement on Simple Lot Divisions
when the conditions pf approval have not heen met; and,
8° prohibiting the placement of the City Code required
secood drainfield site between the trenches of the first
drainfield"
The Council authorized the staff to proceed with these code
amendments back in February, 1984. If a recommendation is
obtainedf from the Planning Commission after the hearing on
May 14, then these items will proceed to the Council on May
15" However� if the Planning Commission tables the final
decision on these code amendmentsthen these code
amendments will not get to the Council until sometime in
June.

Board meeting, At this meeting, Washington County endorsed

appointed two staff members to this committee and Washington
Ctounty has likewise appointed two staff members" Mr^
Schaefer was origjnally on this committee but has since been

reprcmentative,m to thita committee. It is anticipated that
thicmmmittee will start meeting sometime during the first
waek of May.

source of safe drinking water to the residents of Lake Elmn

/ 2, The time frame of the committee is constantly being
/ delayed. We are starting the committee at a time when
recommendations were suppose to be coming from the committee"
Now the committee will be meeting for two to three months;
then it will take an additional two to three months for the
governing body to act on a committee recommendation and
than; if the recommendation is accepted by the governing
body, it will take an additional few months to arrange
financing, draft plans, develop a construction time frame,
etc. It is conceivable that this project would not start
construction (if this is the recommendation) until 1986"
By this time, if the spray irrigation system has a
successful history in »drawing the contaminants back to the
landfill site", the wells that were previously determined to
be contaminated may be declared useable by the PCA and no
project of any type may be needed"
I believe we must approach this committee with the "worst
case scenario"" We must have the attitude that there is an
enormous amount of contaminants in the landfill and that
additional wells will be declared unsuable in the future;
and that, therefore, an alternate water source is needed"
This approach will prepare us for the worst.
11" Attached is the history of Council discussions and
correspondence regarding the bikp Rgth along the new County
road 19B that will serve as an entrance in to the Regional
Park, As you can tell, concerns on this issue started prior
to my arrival to the City and most of this issue was handled
by former administrator.

meeting (but not mentioning the bike path),

concerns discussed by the Council at its 7~5 meeting.
5" A response from Mr" Swanson to these concerns in which
Mr" Swanson specifically states that of the 54 miles of
bike paths in Washington County there is no fencing
provided and the County has not experienced any
nuisance complaints"
6. A letter to Mr" Swanson in late July requesting that
the that the County reconsider fences in the bike path
area.
7" A letter from Federal Land regarding the location of
the bike path"
S. The City Council response to this letter at its 8~l6-83
meeting, where the Council requested that the bike path
be relocated on the east side of 19 or, if remaining on

we are now aware that thebike path is planned for the east
side of 19 and that no fence it planned to protect the
adjacent property owners" This latest discussion was at
the B-16-83 Council meeting and was listed on the agenda.
Dprothy Lyons received all the agendas and the minutes last
year (as is true this year) and if she had concerns or
problems with the bike path, these concerns should have been
expressed at that time. This fence issue may very well be a
battle that Hammes' should fight directly with the County;
but, the City can certainly support the Hammes' request for
fencing" T am not sure that the City should take the lead
in this issue, but this is the decision of the Council. I
think that the County may want to wait and see if problems
develop before spending funds on a fence"

thi similar to screen the Hammes mining

window'/ to our community and we would like to project as
good of an image as possible. With the mining operation on
the Hammes property I am not sure that this is the image we
would like to project to the public" The staff is still
working on enforcing the junk ordinance violations that
surfaced last year on the Hammes property, but this is
admittedly a mining operation which always will have some
equipment and other items lying around that appear to be
~/ junk. This is a fact of life but many of these items that
may be considered junk by the public, are actually an
important part of the mining operation.

This item can he added to the agenda if the Council feels so
inclined" If the City wants to take the lead in requesting
a fence along the bike path I have no objections with this
approach. It sometimes seems that no matter what is done or
how many times a governing body rescinds to a request, that a
project, in the viewpoint of some, is never done completely
right.
