Present: Dunn, Fraser, Mazzara, Administrator Klaers, Engineer Bohrer. 1. Agenda M/S/P Fraser/Dunn - To adopt the agenda as amended: Add: 4D - 3.2 beer license for Lake Elmo Business Association 5H-1 - Request to drill test wells in Sunfish Park water by Mr. Beaubi.en 5H-2 - Lake Jane Association 5H-3 - Shoreland Permit - Joe Hochban 5H-4 - 201 Update 6A - Board of Review (Motion carried 4-0) 2. Minutes: May 1, 1984 (Tabled) 3. Claims: M/S/P Fraser/Dunn - To approve claims 84845 thru 84901 as presented. (Motion carried 4-0) 4. Licenses: A. 3.2 beer license for a softball tournament at Lions Park and VFW Field on June 8, 9, and 10 - requested by Lake Elmo Jaycee's and Angelo's Women's Softball League. B. 3.2 beer license for two softball tourn- aments at Lions Park on May 18,19 & 20; and June 1,2 & 3 - requested by State Bank of Lake Elmo. C. 3.2 beer license for a graduation party at Green Acres Recreation room on June 2 with approximately 200 guests anticipated to attend - requested by Richard Hesse. D. 3.2 beer and wine license for the Lake Elmo Business Association and Stillwater Chamber of Commerce for Monday, May 21 in the council chambers for an after hours mixer. M/S/ Dunn/Fraser - To approve the 3.2 beer licenses for Lake Elmo Jaycee's and Agelos's Women's Softball League on June 8, 9, and 10 for a softball tournament at Lions Park; a 3.2 beer license for two softball tournaments at Lions Park on May 18,19 & 20 and June 1, 2 & 3 for the State Bank of Lake Elmo; a 3.2 beer license for a graduation party at Green Acres Recreation Room on June 2 for Richard Hesse. LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 2 M/S/P Fraser/Mazzara - To amend the above motion to exclude the Hesse application from the blanket approval of the other two applications, and to consider the Hesse application separately. (Motion carried 4-0) M/S/P Dunn/Mazzara - To approve a 3.2 license for Richard Hesse on June 2, for a graduation party at Green Acres Recreation Center. (Motion carried 3-1 <Fraser>) Fraser stated she would not vote for a beer license at a high school graduation because of the liability to the City. There is an extremely high liklihood that underage people will drink at such a party. Eder stated that the Washington County Sheriff's Department should be made aware of this party. M/S/P Dunn/Fraser - To approve the request by the Lake Elmo Business Assoication for the use of the council chambers for an after-hours mixer; and to approve the 3.2 beer and wine license for May 21, 1984 from 5:00 until 7:00 p.m. (Motion carried 4-0) 5. Engineer's Report A. Shoreland Permit for Todd Williams at 3025 Lake Elmo Avenue North for an addition to the existing house. Pursuant to recommendations from City Engineer, DNR and City Staff for approval of this application, (as this was a parcel of record before the adoption of the Shoreland Ordinance) the following action was taken. M/S/P Dunn/Mazzara - To approve a shoreland permit and lot size variance for Todd Williams at 30211 Lake Elmo Avenue North for an addition to the existing house, contingent upon applicant- complying with the recommendations of City Engineer as outlined in his letter of May 15, 1984 which includes the recommendation that the applicant coordinate with TKDA on the water service location. (Motion carried 4-0) B. Shoreland Permit for Robert Anderson at 4655 Olson Lake Trail. Pursuant to recommendations from City Engineer (as outlined in his letter of May 15 , 1984), DNR, and City Staff for approval of this application (as this was a parcel of record before adoption of the Shoreland Ordinance), the following action was taken. M/S/P Fraser/Mazzara - To approve the Shoreland Permit and Lot Size Variance for Robert Anderson at 4655 Olson Lake Trail to enlarge an existing garage, based on a favorable recommendation by City Engineer, as outlined in his letter of May 15, 1984, and based on a favorable recommendation from the DNR and City staff. (Motion carried 4-0) LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 3 C. Shoreland Permit for Michael Maas at Lot 12, Block 2 DeMontreville Highlands 4th Addition for construction of a new home. Pursuant to recommendations from City Engineer, DNR and City Staff for approval of this application as applicant meets all criteria, except for lot size (1.15 above the OHWM where 1.5 is required), this is an existing platted lot of record, there is sufficient room for two drainfield sites, there is adequate separation for the wells, meets minimum building elevations; the following action was taken. M/S/P Fraser/Mazzara - To approve the Shoreland Permit and Lot Size Variance for Michael Maas at Lot 12, Block 2, DeMontreville Highlands 4th Addition based on the favorable recommendations from the City Engineer, DNR, and City staff. (Motion carried 4-0). D. Shoreland Permit with 4 Variances for David Alford at 8080 Hill Trail North for construction of a new home. The Council reviewed Engineer's report of May 15, 1984 where he addresses the Lot Size (the lot consists of .233 acres where 1.5 acres is required), Lot Width (lot width is approximately 60 feet at the setback line where 125 feet is required by Zoning Code), Structure Setback from OHW (proposed distance from house to OHWM is 75 feet where 100 feet is required), Septic System Setback (setback of 75 feet from system to High Flood can be met), Structure Setback from Road (the existing garage is 15 feet from Hill Trail where 30 feet is required), Structure Setback from Side Yard ( the proposed house is 9 feet from the south property line where 10 feet is required), Building Elevation (the proposed building elevation is not shown but must conform to 934 minimum elevation), Septic System Design (design submitted is a "mound" which is an alternative as replacement for a failed conventional system.) Percolation tests have not been performed so any approval must be contingent upon satisfactory percolation tests. The system as designed would only support a 2 bedroom home. It is not indicated the number of bedrooms proposed. The mound as proposed would have a zero setback from the north property line and garage. Adequate separation is provided between the well and septic system. In conclusion, Engineer stated that this was a previously developed parcel prior to the fire destroying the house. The City Attorney feels that the courts would treat this parcel differently than an undeveloped parcel. The question is the improvements and enlargements being proposed. The house is being moved farther away from the water in line with the neighboring houses which improves the shoreline. The major concern is the adequacy of the sewage treatment and its effect on the health, safety and welfare of the applicant and the neighbors, especially with the zero setback. If this system should fail, the only alternative is to treat the sewage off -site. There exists a vacant City -owned lot across Hill Trail which might be available should this system fail. LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 4 Dunn stated his concern was if the City approved the mound system, and the system fails, would the City be legally responsible. Engineer stated that percolation tests have to be done. If the percolation rates would not be adequate, there are no other alternatives. Consensus of the Council is that the adjacent property owners should be made aware of this proposal and this particular situation warrants a public hearing. Bohrer stated that there is a three home joint septic system proposed for this immediate area under the 201 Program, and the possibility exists that this septic system could be accomodated by this joint septic system. Fraser stated that if the 201 Program is intended to deal with existing problems, on that basis it should not be used to handle a new situation. Eder stated that even if some of the variances were approved, the septic system still has to be ten feet away from a property line. Bohrer suggested that since the percolation tests have to be taken anyway, they may decide in themselves that this is not a buildable lot. Fraser stated that even with favorable percolation tests, she would find it very difficult to vote in favor of this application. Dunn stated that before he made a decision, he would like to hear the Engineer's recommendations on the septic system based on the percolation test. M/S/P Fraser/Dunn - To table a decision on this application until the results of the percolation test are submitted. (Motion carried 4-0) E. Bid review for 1984 MSA Project and review right-of-way appraisals. Engineer reviewed the bids that were opened on May 9, 1984 for work on the 1984 MSA Project and Jane Road North within Krause's Addition. The low bid was submitted by Forest Lake Contracting for $163,683.26 (1984 MSA Project $142,876.76 - Jane Road North $19,806.50). Engineer stated that these projects are within his estimates and recommended that the contract be awarded to the low bidder. He further recommended that the award be delayed until plan approval is received from the State Aid Division of MnDOT. This plan approval is expected to be received by June 5, 1984. Engineer pointed out that these bids are construction costs and in the total cost of a project, there are other things considered; ie: engineering costs, etc., that will be added. Engineer further advised the Council that per their instructions, an estimate for completing the surfacing on Jamaca Avenue north of Jane Road was done and the estimated total cost for this work is $6,060.00. LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 5 M/S/P Fraser-Mazzara - To acknowledge the low bid in the amount of $162,683.26 was submitted by Forest Lake Contracting for the 1984 MSA Street Improvements and Jane Road North project; but deferring ( official action until the June 5, 1984 City Council meeting. (Motion carried 4-0) Council reviewed the letter from Winnfield, Inc. responding to the City's question on whether or not the cluster type development was considered when the appraisals were made (it was). Eder questioned whether the landowners would be able to obtain their own appraisals and if the charge for these independent appraisals would be allowed for under the State Aid program. Engineer reviewed. the "Recommended Procedures for State Aid Projects" (right-of-way acquisitions). It says on qualifying projects, State Aid will participate in the following: direct purchase price or condemnation award, including damages; court appointed commissioner fees; relocation expenses permitted by law. M/S/P Dunn/Fraser - To accept the Winnfield appraisals and make that offer to the respective parties. (Motion carried 3-0-1 <Eder>) M/S/P Fraser/Mazzara - To approve payment of $350 to Winnfield, Inc. for 1984 MSA appraisals. (Motion carried 3-0-1 <Eder>) Engineer reviewed the proposal to complete the surfacing on Jamaca Avenue north of Jane Road. The estimate to complete this work is $6060. He stated that $300 was allowed for the grading of the boulevards (backfilling the curbs and seeding) and is something that could possibly be done by the City Crew, although it may not be feasible. M/S/P Eder/Mazzara - To instruct the Engineer to prepare a change order and add the surfacing on Jamaca Avenue north of Jane Road at an estimated cost of $6060 to the contract sumbitted by Forest Lake Landscaping. (Motion carried 4-0) Klaers pointed out that this amount will come out of the City's General Reserves and will not be assessed to the adjacent property owners. F. Bid review for 1984 Jane Road North Improvement Project Administrator advised the Council that the estimate was $20,000 plus $5000 for drainage for this project. It appears that the project will fall within that framework. The residents along Jane Road North were present and offered no objections. LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 6 G. Public Hearing Application by Jed Wier for two zoning code variances to allow the construction of an accessory structure before the primary structure; and to allow the accessory structure to exceed the code required maximum of 2000 square feet on the newly created 17 acre lot approved by the Council in 1983. Pursuant to published notice, this public hearing was opened at 8.30 p.m. in the Council chambers. The Council reviewed the reports submitted by Building Official and City Planner. City Planner pointed out that a variance should be used to relieve unique hardship situations not created by actions of the applicant and that it would appear from the application that this request has difficulty meeting these criteria used in deciding to grant a variance. Fraser stated that she is opposed to this as the present code was adopted to prevent the very thing that this application requests. Eder concurrs with Fraser and added that this would set an undesirable precedent. Neil Kreiger, an adjacent property owner, stated he was not concerned with the size of the building, but is concerned with the visual aspect. The public hearing was closed at 8:40 p.m. M/S/P Fraser/Dunn - To deny the request by Mr. Wier for two zoning code variances to allow the construction of an accessory structure before the primary structure; and to allow the accessory structure to exceed the code required maximum of 2000 square feet. (Motion carried 3-1 <Mazzara>). H. Other 1. Request by an attorney for Mr. Beaubien to drill test well(s) in Sunfish Park. Engineer advised the Council that Beaubien's have hired a consultant by the name of Fletcher Driscoll. He is a professor at the University of Wisconsin, and was hired by the Beaubien's to give them some information on the ground water situation between City Park Pond and Sunfish Lake. He would like to conduct the drilling on the City property (Sunfish Lake Park) in the valley that runs between the park pond and Sunfish Lake. Bohrer said that he conferred with City Attorney who advised him that we have no basis to deny this request as long as he performs the tests in a reasonable manner. Fraser suggested getting this request in writing, outlining specifically what the drilling will consist of and how the area will be cleaned up after drilling is complete. LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 7 M/S/P Fraser/Dunn To instruct the Engineer and Administrator to administratively reply to this request, when made in writing, contingent that clean-up, in their judgement was appropriate. (Motion carried 4-0) 2. Lake Jane Association Jim Weyer, president of the Lake Jane Association, told the Council about the association's concern with rising water on Lake Jane and Sunfish Lake and asked the Council to work "more closely" with VBWD for a solution to the problem. Weyer said the association is hoping a long term solution would be found when the VBWD 509 water management plan is implemented. Chuck Taylor, 4677 Birch Bark Trail North, an association member who checks water levels in city lakes, said the level of Lake Jane had reached 923.32 feet that morning. (According to VBWD figures, the lake's overflow level is 924 feet). He said the lake's condition is less severe than last year. If the diesel pump hadn't been operating last year, Lake Jane would have overflowed. The council told the association members that any solution to the lake's overflow it has proposed has not been feasible. Eder responded to Weyer's charge that the Council had not cooperated with the VBWD on a plan to prevent flooding. He said there is "no reason we wouldn't be willing to work together". Reference was made to the letter City Engineer wrote to VBWD managers concerning the high water levels on Sunfish Lake, due to pumping excess Lake Jane water to City Park Pond. The Council recommended the VBWD consider a project to deposit the water in Eagle Point Lake. Engineer advised the Council that this solution is no longer feasible since the water level on Eagle Point has risen to within six inches of the dike, which is subject to erosion. Taylor suggested exploring water storage areas about Long Lake, the Richert gravel pit and any "pothole" near Sunfish lake. 3. Shoreland Permit - Joe Hochban The Mayor advised the Council of Mr. Hochbaum's request to bring in ten yards of fill for landscaping purposes on Lots 7 and 8 of Berschens Shores First Addition on the east side of Lake Jane. The Mayor suggested that the City state that if it is less than ten yards that is brought in, we have no objections. M/S/P Eder/Fraser - To grant the Shoreland Permit to Joe Hochban for Lots 7 and 8 of Berschens Shores First Addition to place ten yards of fill for landscaping; and a copy of that request be sent to DNR stating we have no objections as this is above the 924 level; and also advise VBWD for their confirmation or denial; and that the City waive the $25 fee. (Motion carried 4-0) LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 8 4. 201 Update Engineer advised the Council that this past week two residents requested to be included in the 201 Program (William Hagberg on Lake Elmo Avenue and Jerry and Patricia Schwartz on 32nd Street). Bohrer stated we have reached the practical limit and it is very difficult to keep accepting more and more requests and still meet our deadlines. The other issue is performing the soil tests. We have subcontracted the work for performing the soil tests and this work has been completed. To add people at this point would undoubtedly add costs. M/ Dunn/ - To approve the Hagberg request to be added to this 201 Program (as the final addition) and to deny the request by the Schwartz's as their home is not a primary residence. (Motion failed for lack of a second) M/S/P Fraser/Eder - To deny the request by the Hagberg's and Schwartz's to be added to the 201 Program; and to not accept any further requests for participation in this program. (Motion carried 4-0) 6. City Council Reports: A. Board of Review The schedule for the Board of Review is as follows: Fraser: 6:00 p.m. until closing Dunn: 2:30 p.m. (until relieved) Mazzara: 3:00 p.m. until 5:00 p.m. Eder: 2:30 p.m. and as needed Morgan: If available 7. City Administrator's Report: A. Shoreland Ordinance - comments from DNR The Council reviewed the letter of April 27th from John Line Stine of the DNR where he suggests the possibility of amending the City's shoreland controls so as to eliminate the need for City Council action on all shoreland permits. DNR municipal shoreland management regulations require only that, "municipalities shall establish permit procedures for building construction, installation of sewer and water facilities, and grading and filling in shoreline areas". The DNR has consistently advised cities that routine types of permit applications where the development complies with all the ordinance standards (setback, impervious surface, sewage system, etc.) do not require DNR or City Council review. The DNR feels that these types of permits can be issued administratively by the City staff. LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 9 Bohrer stated the City always seems to run into the lot size question. On previously developed lots where we are dealing with garage additions, house additions, etc., do we need to grant the variance for lot size? The shoreland ordinance says 1-1/2 acres, but they don't make any distinction between brand new (never improved lots) as opposed to previously developed lots. If there was a clarification that way it would eliminate bringing to the Council a number of shoreland permits. Consensus of the Council is that the staff should research the DNR suggestion, and come up with a responsible way for staff to assume some responsibility and decide when a shoreland permit should come to the City Council B. Code Amendments relating to (1) time limit for meeting conditions of simple lot subdivision; (2) placement of the second drainfield. Administrator advised the Council that the Planning Commission held a public hearing on these two code amendments on 5-14-84; and further explained the purpose of the code amendments. M/S/P Fraser/Mazzara - To adopt Ordinance 7958, an amendment to the 1979 Municipal Code stating "If a simple lot division or large lot division is granted with conditions, all conditions set forth by the City Council at the time of the approval of the simple lot division or large lot division must be completed within one hundred eighty days after said approval, or the approval of the simple lot division or the large lot division shall be considered void, unless a request for a time extension is submitted in writing and approved by the City Council". (Motion carried 4-0) M/S/P Fraser/Dunn - To adopt Ordinance 7959 an amendment to the 1979 Municipal Code stating "Placement of the second required drainfield between the trenches of the first drainfield is prohibited". (Motion carried 4-0) C. Old City Office Table M/S/P Fraser/Eder - To authorize the advertisement to sell the old City Hall table in the next Newsletter at a minimum price of $200. (Motion carried 3-1 <Dunn>). Mazzara feels we should take the offer that was made ($200) as the table has been advertised in the City Newsletter once. Dunn does not feel the table should be sold at this time. D. Extra Police coverage at, public access. Administrator advised the council that the extra police coverage for "opening weekend" cost the City $288. The DNR anticipates that the new access will officially open sometime the first week of June. According to the deputies there should be no need for further police coverage. There was a minimal amount of problems on opening weekend as there seems to be adequate parking at the new access. LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 10 The DNR and Washington County deputies indicated that they would like to see the old access kept open for limited parking and fishing off the shore. Consensus of the council is that since it was agreed that when the new access was completed, the old would be removed the City should adhere to that agreement. Greg Fauks and Dave Garloff, DeMontreville Trail residents are concerned that people will use two accesses if steps are not taken to close the old access. They suggested removal of access signs, posting it as closed and ripping out the large section of blacktop there. Garloff further advised the Council that the new access is much better than the original access and is a positive feature for the area. The Council directed City Administrator to take the necessary action to close the old access and to discover when the Minnesota Department of Natural Resources will complete the new access. Discussion on the three-way stop signs that were proposed by the DNR. The County denied this request. The meeting adjourned at 9:50 p.m. Ordinance 7958 - Time limit on conditions of simple lot divisions or large lot divisions. Ordinance 7959 - Prohibiting the placement of the second required drainfield between the trenches of the first drainfield. Since we do not have time to discuss every point presented, it may seem that decisions are preconceived. However, background information is provided for the City Council on each agenda item in advance from City Staff and appointed Commissions; and decisions are based on this information and past experiences. In addition, some items may also have been discussed at previous Council meetings. If you are aware of information that hasn't been discussed, please fill out a "Request to Appear Before the City Council" slip; or, if you came late, raise your hand to be recognized. Larry Bohrer and myself are planning to attend and our Council Representatives on this committtee are Maynard Eder and Bruce Dunn. 8, Wish to remind the Council that the BgqQ gf 6gy11W is scheduled for Tuesday, May 22 from 2:30 p.m. until 7:30 p.m. in the Council Chambers. Some members of the Council may also want to add this to the agenda under Council reports in order to set up a schedule for atleast two Council members to be present at all times. 9. " In my last few Informational Memos I have been providing you with up -dates on the Klghg gpp11gQ1g[l and how he is proceeding through the Planning Commission" Yesterday, I received a phone call from Mr" Klohn and he indicated that he must regretfully withdraw his applications at this time. After discussions with Bruce Folz, review of the soil conditions, has requirements and street requirements, Mr. Klohn has determined that the expense is not worth the risk. I am not sure if this is a temporary setback or if Mr. Klohn is completely abandoning his plans" The staff will just have to take a wait and see attitude on this broodmare farm concept. Not all the staff time spent on this project was a total loss as we gained valuable experience in dealing with a new application; and,"11r. Attached is the agenda and registration form for the 1284 4UOU01 WgUM of Minaelgta Citipm CgafgCoUgM to be held in Duluth from June 12 through June 15. I am not sure what the history has been in Lake Elmo for Council members to attend this annual League meeting, but, if anyone is interested in attending this 1984 conference, please contact me. There are funds available in the budget for any Council member who wishes to attend and past history has indicated that these conferences are good for obtaining information on current issues and for exchanging ideas with council members from other cities, l encourage anyone who is interested in attending to do so. 14. Attached is the monthly report for April from Maintenance Foreman, Dave Wisdorf^ I hope to receive these reports on a monthly basis from Dave and forward them to the Council in an effort to keep everyone better informed as to the activities that are taking place in the Maintenance Department" This is a pretty good report for the first attempt, but in the future I hope that the report areas will be expanded.
