OTHER MATERIAL 1. Attached is our certification that Lake Elmo is a member of good standing in the Minnesota Association of Civil Defense. 2. Attached.. -are two letters regarding the permit obtained by Washington County from the Minnesota Pollution Control Agency to operate a Gradient Control Well System. One of these letters is from the engineering firm hired by the County; and the other. is from Bob Lockyear of Washington County. The intent of these letters is to keep Lake Elmo informed on what is happening at the landfill site. Please note that this permit is good thru September 30, 1988. The most recent City Newsletter dated December 13, 1983, is attached. As you can see, Mary Meyer had a wealth of infor- mation for this last issue of 1983, Therefore, Mary put together a two page newsletter, which also gave her the opportunity to print some articles that have been previously planned, but never quite made it into a Newsletter issue. I am especially happy to see the snowplowing schedule outlined in this newsletter. This week I called Sally A. Johnson, of Faegre & Benson, who represents the City in the LaVonne Richert and the Weldon Richert vs the City of Lake Elmo lawsuits for an update on These lawsuits. She indicated to me that nothing new has taken place and that nothing else is expected to take place for a few months. Currently, the MN PCA has been dismissed from the Weldon Richert suit and has requested to also be dismissed from the LaVonne Richert suit. According to Ms. Johnson, the reason for this dismissal by the judge and sub- sequent second request for dismissal is based on the "exercise of judgement" used by the PCA. Ms. Johnson further indicated that the City also had to use the "exercise of judgement" in approving the building permit and, therefore, will also be seeking dismissal from the law- suits (once the PCA is out of the cases) based on the same reasoning as the PCA. Informational Memo December 28, 1983 Page 2 5. Attached is the December 19, 1983, Cable TV Newsletter, 6. If any Council member needs to contact me after office hours; I can generally be located at either 771-3 50 or 78 0-0228. 7. City Consultant, Larry Whittaker, did not attend our last City Council meeting as he was making a presentation to the Met Council regarding the draft EIS relating to the Waste - to -Energy project. The Council asked that we submit these comments on paper; and a letter outlining our concerns is attached for your information. As you can tell by this letter, the staff believes many of our concerns relating to compatible land uses, control of services, maintenance of services, fire and police protection, etc., have not been adequately addressed. The staff hopes that the final EIS will address many of our noted concerns. 8. The monthly report from Washington County pertaining to our contract police service for the month of November, 1983 is attached. I have reviewed these reports for the past two years and it appears that the number of complaints, miles driven and citations issued are not unusual for this time of year. June, July and August usually have the highest number of complaints, and then the number of complaints decrease after the onset of winter. The miles driven are generally around 4000, and the number of complaints average around 180 in the summer months and 110 in the winter months. The number of citations issued seems to be a fairly consistent amount; around 30 to 35 per month. 9. In late November, the City Council authorized the payment of registration fees for any Planning Commission member that wished to attend the Annual Planning Conference held in St. Pau].. For your information, no Planning Commission member attended this meeting as it was held during the week and many members could not get off from work. Nonetheless, I think this request indicates the need to appropriate funds in the next budget for conferences and training for Commis- sioners and Councillors. 10. As you can tell by looking at the agenda, we are planning Tuesday's meeting to start at 6:30 p.m. for an Execu- tive Session Meeting. Attached for your information is the section of the City Code and material from the Handbook for Minnesota Cities related to calling special and executive meetings. 11. I wish to acknowledge and to inform the Council that the City of Lake Elmo received a $100.00 donation from TADA and a $100.00 donation from LawsOn,Ralelgnmarshall to be applied towards the catering service charges for our annual Christmas Party. This is a very nice expression of thanks from these two firms; and is well appriciated by the City of Lake Elmo. Informational Memo December 28, 1983 Page 3 12. The City of Lake Elmo has received a certificate of participation that indicates we are a member of the League ( of Minnesota Cities Workers Compensation Program for this upcoming year. This program has proven to be an cost efficient and effective program for us in the past. 13. Maintenance Foreman, Dave Wisdorf, has notified me they are having difficulty finding someone to remove the snow from the hockey rink in Lions Park. I understand in the past, that this has been done by the Pott brothers, but at this time, they have not made a commitment to provide this snow removal service this year. The City Crew does not have the proper equipment for this type of snowcleaning operation, and they really have their hands full with simply removing and clearing the snow from the City streets. We expect that very soon either the Pott brothers, or some other local individual, will be found who can assist the City in removing snow from the hockey rink. If, however, no one is willing to do this service, then this item may be on a future Council agenda. 14. Dave Wisdorf and I have talked this past week about the existing snowplowing operation in the City. It seems that we are getting the standard complaints from the same individuals as in preceding years, but that we are also getting some compliments on our snow removal operation, especially in the core village area. Dave expressed the following problems to me: (1) Parked cars (snowbirds) on narrow streets when the plows are in operation; (2) Individuals parking cars in front of their driveways to stop the plow from blocking them in. This only complicates our problems as we must go back and remove the snow at some point in time and eventually the driveway will get plowed in. (3) Individuals pushing snow from their driveways out on to the street. This causes drifting problems, snow removal and safety problems, and snow storage problems for the City. (4) Not only do we have problems with vehicles on the streets during snow removal, but also when cleaning and widening the streets after snow removal operations. This usually takes place 1-112 days after a storm and clearly inhibits an effective operation. Dave is keeping a list of problems he is experiencing this year, and we may have some requests for additions to our snowplowing policy for the next snow season. 15• Attached is a letter from the Association of Metropolitan Cities (AMM) soliciting nominations for their Board of Directors. The vacancy on their Board of Directors is the result of recent elections. Any Council member interested in trying to be appointed to this Board should let me know as soon as possible and I will forward your name to the AMM office. I,hformational Memo December 28, 1983 Page 4 16. At the last Council meeting, Dave Morgan asked me about two water issues concerning Oakdale. I have expressed these concerns to the City of Oakdale and they have once again assured me that no storm water from development that is taking place south of Stillwater Boulevard, near our boarder, will leave the development site. Oakdale has also indicated to me that no storm water or contaminates from the landfill site in Oakdale will be removed from the site. Attached is an informational handout regarding this cleanup project at the landfill site, and this brochure should answer many of your questions. The City Council of the City of Lake Elmo ordains: Section 1. Amendment. Section 401.260A4 is hereby amended to .read as follows: City Council Action. The City Council shall act upon the application for simple lot division and may impose such conditions and restrictions as are .required by this ordinance and other applicable city ordinances, within twenty-one (21) days after receiving the recommendation of the Planning Commission or within sixty (60) days after filing of the appli- cation with the Administrator. If a simple lot division is granted with conditions, all conditions set forth by the City Council at the time of the approval of the simple lot division must be completed within one hundred eighty (180) days after said approval,, or the approval of the simple lot division shall be considered void,unless a .request for a time exten- sion is submitted in writing and approved by the City Council. Section 2. Amendment. Section 401.260B7 is hereby amended to read as follows: City Council Action. The City Council shall' act upon the property division and may .impose such conditions and restrictions as deemed necessary by the City Council in view of the purpose of this Ordinance and recommendations of the Planning Commission within thirty (30) days after receivingthe recommendations of the Planning Commission or within sixty (60) days after publication of the notice of hearing in the official newpaper should the Planning Commission fail to forward recommendations. If a large lot division is granted with conditions, all conditions set forth by the City Council at the time of the approval of the large lot division must be completed within one i hundred eighty (180) days after said approval, or the approval of the large lot division shall be considered void, unless a .request for a time extension is submitted in writing and approved by the City council. Such restrictions shall become effective upon a date specified by the City Administrator. The City Administrator shall make every effort to notify the public of such restriction by notifying local newspapers and attempting to have this restriction published as a news item. All public lake accesses shall be posted prior to and during the time such restrictions are in place. In addition, notice of said restrictions shall be posted at the Lake Elmo City Hall. WHEREAS, the Lake Elmo Volunteer Fire Department has developed an intensive emergency rescue program which provides emergency training for its volunteer firemen; and, WHEREAS, the Washington County Sheriff"s Department received a 911 emergency rescue call on April 14, 1984, concerning an overturned canoe in Lake Demontreville; and, WHEREAS, Lake Elmo Volunteer Fireman, Michael Pott, along with Washington County Deputy Dennis Widenstrom, were the first responders to this emergency call; and, WHEREAS, Michael Pott, because of his training and ability to handle emergency situations, along with Deputy Widenstrom located a boat and with discarded boards paddled out to the middle of Lake Demontreville where they promptly and efficiently initiated the life saving rescue of Terence Smith and Robert Larkin. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo, that Michael Pott is hereby commanded for his part in the competent, expedient and efficient life saving rescue of Terence Smith and Robert Larkin from Lake Demontreville on April 14,1984. Kenneth Neudahl and Sherrill J. Neudahl, husband and wife, as vendees, dated August 21 1980, and recorded September 8, 1980, as Docu- ment no. 408533. WITNESSES: 1. Purpose. The Developers have made application to the city for approval of a land development known as Trot 1, Block 1, Teal Pass Estates, Second Addition, withi❑ the corporate limits of the City described as follows: See attached Exhibit "A" (hereinafter referred to as the "Development"). The City Council on September 4, 1984, approved the final plat- by adopt- ing Resolution 84-, on condition that Developers enter into this Agreement to provide for the installation of streets and other improvements on the terms and conditions of the Ci.ty's prelimi- nary approval and in consideration of the mutual promises and conditions hereinafter contained, the parties hereto agree with each other as set forth in the following paragraphs. 2. Required Improvements. In accordance with the policies and ordinances of the City, the following -described improvements shall be constructed and installed on the terms and conditions hereinafter contained: (a) Street grading, graveling and stabilizing, bituminous surfacing, bituminous curb, con- struction of berms and boulevards, and turf restoration, including seeding and mulching and street signs (hereinafter called "street improvements"); (b) Drainage improvements, if any, to the extent determined to be necessary by the City En- gineer, including all necessary catch ba- sins, ponds, inlets, and other appurtenances including an overflow pipe and structure (hereinafter called "drainage improve- ments"); (c) Underground gas, if any, electric and telephone service to be arranged by D e v e l o p e r s w i t h u t i l i t y c o m p a n i e s (hereinafter called "utility improvements"). -2- ( 3. Dcsifn, Inspection and As-Builts and Warranty Related to Improvements. The construction plans and specifications for all drainage improvements and street improvement's have been prepared by a registered professional civil engineer and approved by the City Engineer and the City Council and Developers through their engineers shall provide for competent daily inspection of all street and utility construction, both public and private. As -built drawings with service and valve ties, in a form acceptable to the City Engineer, together with certificates of completion and compliance with the approved specifications, shall also be delivered to the City Engineer. Prior to acceptance by the City of any streets or utilities or commencement of maintenance thereof, the City Engineer shall i inspect and approve the same and signify his approval for ac- ceptance in writing. Developers by this instrument, agree to a one (1) year war- ranty from and after approval by the City Engineer, in favor of the City covering the workmanship and material in such street and utility improvement. 4. Time for Performance_ Completion by City on Default. Developers agree to complete the improvements required by this Agreement on or before October 1, 1985. In the event Developers fail to compute the said improve - meats within the time provided by this Agreement, then the City may at its option bring an action in a court of competent juris- diction for an order compelling Developers to complete the im- provements or cause the same to be completed in which case the -3- ( Developers agree to pay the reasonable and actual cost to the City of the completion thereof. In either case, Developers agree to pay, in addition to the cost of completing said im- provements, any reasonable legal, engineering or other fees or expenses incurred by the City in connection with the completion thereof or the enforcement of. this Agreement upon default 'of the Developers. 5. Performance Bond. Prior to the approval of the final. plat or the issuance of any building permits for improvements within the said development, the Developers shall deliver to the City Clerk a "Cash Performance bond" in an amount equal. to the estimated cost of completing the specific improvements plus twenty-five percent (25%). This amount shall be determined by the City Engineer. Said Cash Performance Bond shall secure Developers performance of this Agreement. The estimated cost of the said work is as follows: Type of Improvement Estimated Cost of Improvement Street Improvement $8,700.00 6. Drainage Improvements. It is understood that Developers are not at present obligated to supply a Performance Bond, cash deposit, or letter of credit for drainage improvements including certain catch basins and piping. However, Developers shall in -- stall. such drainage improvements at such time as the street im- provements are installed. 7. Developers Representations. Developers further repre- sent and agree that the farm home located north of the Develop- ment and owned by Developers shall not be used as a residential dwelling so long as the improvements outlined herein remain un -4- completed; that Developers shall relocate the driveway of the home to be built on the Development to the satisfaction of the City Engineer at such time as the improvements outlined herein are completed; and that Developers understand that the City will probably require the remaining three lots which abut Jasper Avenue North, which were approved as part of the preliminary plat of Lake Jane Estates (Teal Pass Estates), to be final platted at the same time. 8. Release of Security. Upon partial. performance by the Developers of the terms of this Agreement, the City will release to the Developers cash deposited in escrow with the City in ac- cordance with this Agreement-. The amount to be released shall be determined by the City Engineer with approval by the City 1 Council after the receipt of bills for work completed and inspected. The City shall retain an amount necessary to com- plete any remaining improvements plus twenty-five percent (25%). 9. 1nding Effect. The terms and provisions of this Agree- ment shall be binding on and inure to the benefit of the heirs, representatives, successors and assigns of the parties hereto and shall be binding on all future owners of all or any part of the said subdivision and shall be deemed convenants running with the land. References herein to Developers, if there be more than one, shall mean all of them. This Agreement at the option of the city, shall be placed of record so as to give notice thereof to subsequent purchasers and encumbrancers of all or any part of the said subdivision. 10. Notices. WHEREAS, it appears that the above parcel of land was not at the time of application a seperately described parcel of record; and, WHEREAS, there does not appear to be any reason related to the public health safety and welfare which would require denial of this simple lot subdivision; and, WHEREAS, Lake Elmo City Code section 401.260 A. lists the requirements for a simple lot subdivision; and, WHEREAS, simple lot subdivisions in the City of Lake Elmo are generally granted for the future construction of a residential home; and, WHEREAS, Mr. Kleis is applying for a simple lot subdivision only to assure future access to his property from Highway 36 and has no intentions on constructing a residential unit on the above described parcel. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lake Elmo hereby expesses its thanks and appreciation to the Light Up Lake Elmo Committee and its Chairperson, Carol Kuettner for their diligent work in fulfilling their commitment to "Light Up Lake Elmo".
