HomeMy WebLinkAbout02-19-85 CCMLAKE ELMO CITY COUNCIL MINUTES PEBRUARY 19, 1985 Mayor Morgan called the meeting to order at 7:05 p.m. in the council chambers. Present: Armstrong, Christ, Dunn, Mazzara, City Administrator Klaers, City Engineer Bohrer. 1. Agenda M/S/P Morgan/Mazzara - To adopt the agenda as amended - Add 8E Slawson large lot subdivision. (Motion carried 5-0) 2. Minutes: February 5, 1985 M/S/P Dunn/Christ - To approve the minutes of the February 5, 1985 City Council meeting as amended (Page 4). (Motion carried 5-0) 3. Claims M/S/P Mazzara/Christ - To approve claims 85816 thru 85870 as presented. (Motion carried 5-0) 4. Interview with applicant for second alternate position on the Parks Commission. The Council interviewed Tom Simpson, 5270 Jamaca Blvd. North. Mr. Simpson stated that although he lives across the street from Kleis Park, he is interested in and uses other parks in the City. He added that he would like to see the parks kept in their natural state as much as possible; would be willing to donate time for park activities. Dunn commented that although he does not know Mr. Simpson personally, the Parks Commission has commented on the work that he has done in Kleis Park. While there are two applicants for this position, Mr. Simpson has already shown a sincere interest in the parks by participating in the tree planting program and with his work in Kleis Park. M/S/P Dunn/Christ - To appoint Tom Simpson to the second alternate position on the Parks Commission. (Motion carried 5-0) 5. Public Hearing for Gisela Lee at 3479 Lake Elmo Avenue for variance to the sign code. Pursuant to published notice this public hearing was opened at 7:17 P.m. in the council chambers. Ms. Lee was present and stated her request is for a variance from Section 505.080 of the city code which prohibits signs within a public right-of-way. She is proposing to construct a business identification sign on the sidewalk in front of her business. There is 109" from her building to the curb, and the sign post will be set back from the curb approximately 30". The sign will be offset from the front steps of the building to the north. She further requested permission to install a flower box 18" wide under the sign and around the pole toward the curb. LAKE ELMO CITY COUNCIL MINUTES 2-19-85 PAGE 2 The City Engineer stated that Lake Elmo Avenue has County right-of-way, and to place anything on County right-of-way requires permission from the County. The determination has to be made where the property line is as the County right-of-way is wider than just curb to curb - it takes in some of the sidewalk or boulevard area. Another concern is that the flower box should project out at least as far as the sign does to avoid bumping into the sign. There were no residents present to offer comments for or against this proposal and the public hearing was closed at 7:30 p.m. Morgan stated that the proposed sign .looked very nice and he has no problem with it provided the County would approve it. The Council suggested that Ms. Lee determine whether or not there is room on her own property for the sign, which would eliminate the need for a variance. Or, if the County grants permission to place this sign in the right-of-way to come back before the City Council for a variance. t.. 6. City Engineer's Report A. Resolution approving newly designated MSA routes and mileage. The Engineer stated that at the January 8, 1985 City Council meeting, he was instructed to proceed with the documentation necessary to add 36th Street and Layton Avenue between Laverne Avenue and Trunk Highway 5 to the Municipal State Aid Street System, and provided a draft resolution required by MnDOT to add these streets. M/S/P Morgan/Christ - to adopt Resolution 85-3 designating 36th Street from Laverne Avenue to Layton Avenue, and Layton Avenue from 36th Street to Highway 5 as a City of Lake Elmo MSA Route. (Motion carried 5-0) B. Final plat for Nelson Estates At its February 11, 1985 meeting, the Planning Commission recommended. w approval of the final plat of David Nelson Estate subject to the three provisions in the Engineer's review letter of February 7, 1985. The Engineer recommended that the final plat be approved in accordance with the Planning Commission's recommendation and conditioned upon the execution of the Developer's Agreement. The Developer's Agreement can now be drafted and provides for the submission of plans and specifications, time to complete improvements, and security deposit for developer's performance. M/S/P Mazzara/Christ - To adopt Resolution 85-4 approving the final plat for David Nelson Estates contingent upon the applicant meeting the conditions set forth by the City Engineer in his memo of February 7, 1985 as recommended by the Planning Commission on 2-11-85; and contingent upon approval of the plans and specifications for the required improvements, and contingent upon applicant entering into a Developer's Agreement with the City of Lake Elmo. (Motion carried 5-0) LAKE ELMO CITY COUNCIL MINUTES 2-19-85 PAGE 3 C. Ice/water runoff from landfill spray irrigation system. The Engineer stated that he made an inspection of the spray irrigation system on February 13, 1985. He found, that the containment dike has been and continues to be overtopped to the south and a cut has been put through the dike on the east which allowed some water to flow east at one time. No water is presently flowing east. The Engineer's concern is that the water that is overtopping the dike to the south is leaving the landfill property and creating a pond on the Mervin Nippolt property. The cut in the east dike has allowed some water to leave the containment area but it has not left the landfill property nor has the water entered the City Park Pond system. Another concern is that water which may still contain some chemicals (the non-volatile chemicals) is now leaving the landfill property. The VBWD conditioned the Counties' permit for the work by limiting the discharge to 250 gallons per minute or the infiltration capacity of the soil, whichever is less. Obviously, the winter time infiltration capacity of the soil has been exceeded and the operation is in violation of the VBWD permit. Washington County and the MPCA are aware of the situation. The Engineer discussed the situation with Mike Ayers who said he has met with Mr. Nippolt. The Counties have agreed to reimburse Mr. Nippolt for any crop damage in the spring. Other than crop damage, there doesn't seem to be any other concern by the Counties, Mr. Nippolt, or the MPCA. Mr. Ayers stated the Counties plan to reinforce the dikes and create some new terracing next year to eliminate this problem for next winter. Mr. Ayers feels that with little snow cover this year, the containment area is frozen and not allowing the water to percolate. Last winter they had no problem. The Engineer recommended that the City ask the Counties to respond to the City's concerns and provide information on alternatives. For example, would shutting off the gradient control well cause the water table to return to its natural slope and re -introduce chemicals into residential wells? It could very well be that the temporary pond on Mr. Nippolt's property is the lesser of the two evils. Mr. and Mrs. Nippolt were present and expressed their conerns over the potential damage to their farm land. If the water leaves the ponding area, it will hit the flat land and drown out four or five acres. Morgan stated he is concerned with the water leaving the landfill area. If the Counties are willing to negotiate with Mr. and Mrs. Nippolt and satisfy their concerns, he would agree that there is nothing that can be done until spring. However, the dyke should be reinforced and all precautions should be taken to prevent water from leaving the landfill area. The Engineer stated that the Counties feel that as long as the water does not leave the landfill site - rather than being contained to the prepared site for the irrigation, they are in compliance with their agreement. Dunn stated that after visiting the site, he feels that the hole in the dyke was cut before the thaw. It is a clean cut, so it had to be LAKE ELMO CITY COUNCIL MINUTES 2-19-85 PAGE 4 done last fall. Therefore, somebody was anticipating this problem, and made provisions to run this water down to the Nippolt property. M/S/P Morgan/Armstrong - to instruct the City Engineer to write a letter to the MPCA, Washington County and Ramsey County expressing the concerns of Lake Elmo with this runoff; that arrangements should be made to reimburse Mr. Nippolt for the damage that has been caused to his property; to do whatever is necessary to keep the water on the landfill property as per the assurances previously given to the City; and that Lake Elmo is concerned with the potential danger of this pond and ice pile. (Motion carried 5-0) D. Discussion: VBWD 509 Plan The Engineer referenced his memo "Review of Draft 509 Plan Dated January, 1985 Reviewed February 18, 1985" hereby made part of these minutes (Exhibits ]. thru 5). The Engineer reviewed step by step the fourteen recommendations he deemed significant to the City of Lake Elmo to be incorporated into the 509 Plan by the Board of Managers (included in this memo). The Engineer further stated that this review is in preparation for the 2-21-85 VBWD public meeting for all officials of the cities and townships within the district. Written comments will be received by VBWD up until March 15, 1985. The City Engineer and City Administrator will attend this 2-21-85 VBWD meeting and verbally express the concerns as outlined in this memo, with the exception of #12 relating to Cost Estimates. 7. City Council Reports A. Update on 2-9-85 conference for newly elected officials. Three City Council members (Rose Armstrong, Arlyn Christ and Mike Mazzara) attended this conference put on by the League of Minnesota Cities. They felt the conference was interesting and offered handouts to be copied for those interested. They would also recommend this conference for future elected officials. B. Cross Country Ski Race Arlyn Christ presented the council members with pins commemorative of this ski race held at Sunfish Park on February 16th and as a thank you for allowing the Jaycee's to use the facility for this race. Christ stated there were about sixty-five participants in this race. The winner of the race was Dan O'Donnel who finished the 11 kilometer race in forty minutes. C. Sunfish Lake - Morgan (update) Morgan stated that the Sunfish group has indicated they will commence a lawsuit if pumping continues into City Park Pond. Lake Jane obviously will have some homes going under if the pumping is stopped. Therefore, there is going to be a problem either on Lake Jane or at Sunfish Lake. It does look like the amount of water that needs to be taken out of Sunfish to keep it from rising could be irrigated on City owned land. The problem is that we have to go through the petition and hearing process to do that. The cost of the project would be between $28,000 and $33,000, which could be assessed back upstream. However, the existing 1005 Project does not give us jurisdiction to LAKE ELMO CITY COUNCIL MINUTES 2-19-85 PAGE 5 add pumping out of Sunfish back onto City owned property. The only way to get anything done is to petition the VBWD to do this. It looks at his point to be feasible - based on the report by t6ieVBWD engineer. However, the danger to the City is that if we do petition and the Board of Managers votes not to order the project or not to do this, we would be stuck with the cost up to that point, which could amount to up to $5000. The Coucil will most likely be faced with the decision very quickly as to whether or not it wants to take a $5000 risk and get thisproject started, or do nothing and see the pumping into the Park stopped and consequently damage the homes on Lake Jane.; or start the pumping and probably be faced with a lawsuit from the residents on Sunfish. The point is, it is feasible to dispose of the amount of water that needs to be disposed onto City land, probably with not much damage to the land, but we would have to risk the petition process. 8. City Administrator's Report A. Cover for Computer Printer M/S/P Christ/Mazzara - To accept the quote in the amount of $287.50 from Woodworks, 714 N. Martha, Stillwater, MN for an oak computer printer cover. (Motion carried 5-0) B. Office Space Committee Guidelines M/,S/P Dunn/Morgan - To adopt the "Office Space Committee Guidelines" as amended. The last sentence of paragraph 2 under "Responsibilities" should read "The Committee should prioritize the top three alternatives and supply background information and justification, ( including financial, for these three alternatives". (Motion carried 5-0) C. City Attorney (update) The Administrator stated that ten law firms have requested the material regarding this position. He suggested that along with the Deputy Clerk, he will open these bids and copy them to the City Council prior to the 3-5-85 City Council review of these bids. D. Planning Commission Workshops M/S/P Dunn/Morgan - To authorize the payment for Planning Commission members attending the March 7, 1985 Rezoning Workshop to be held in St. Paul. (Motion carried 5-0) M/S/P Dunn/Christ - To authorize the staff to administratively approve Planning Commission members attendance at relevant seminars and workshops when the total fee for the entire Planning Commission members which desire to attend the workshop is under $100 per meeting. (Motion carried 5-0) The Administrator pointed out that these workshops occur approximately every four to six weeks. Carol Kuettner, Planning Commission member gave a brief update on the Workshop she recently attended. LAKE ELMO CITY COUNCIL MINUTES 2-19-85 PAGE 6 E. Other - Slawson subdivision The Administrator advised the Council that a staff error occured in the publication of the notice for the public hearing for the Slawson large lot subdivision. The Planning Commission held this public hearing on January 28th where the published notice had stated this public hearing would be held on February 28th. The public hearing will be held as published on Thursday, February 28th at 7:45 p.m., and will be back before the Council on March 5, 1985. The meeting was adjourned at 9:00 p.m. Resolution 85-3 MSA Designation for 1985 Resolution 85-4 Nelson Estates Final Plat Exhibit 1 BEYIEId_4E_QBAEI_548_ELAd QAIED-dMUABY,._1M MIEWEQ_EMAJABY_1111_1925 I . 4YEBYlEW The draft Water Management Plan dated January 1985 provides for the relief from recurring high water levels on many of the District's lakes. The chosen method of controlling this high water is to construct a system of pipes and channels to provide an outlet from landlocked areas or to improve existing outlets. The projects are proposed to be financed by an ad valorem mil levy upon all property in the District. II. PBQP4;iEQ_S,4d.SIBU.4'I141f The Plan proposes the construction or improvement of outlets and the subsequent lowering of lake levels within Lake Elmo in a three phase program: EhA.9s_1 Would provide outlets and lower water levels on Jane, Sunfish, and Horseshoe Lakes, it may also include floodproofing the four ( lowest homes on and around Lake Jane (Brown, Greene, Evanoff, and Keane). EbBSs_z Only includes work in West Lakeland. Phess_3 Would provide outlets and lower water levels on City Park Pond, Olson and DeMontreville, and Lake Elmo. Phases 2 and 3 are only to be implemented when needed. I 11. PB9P4.SEQ_E1 MCILd4 The proposed method of financing is by an ad valorem tax over the entire District and collected with real estate taxes. Table 5 on page 63 of the Plan estimates the impact on two example homes. A benefit of this method of financing is that this tax Is deductible from one's Income. Also, If a homeowner does not presently receive the maximum homestead credit of $650, a portion of this tax will be offset by a Exhibit 2 larger homestead credit. The greatest benefit is to the lakeshore residents that are experiencing flood damage. This project will lower the water level at very little cost to them. The disadvantage with this method of financing is that many persons who do not benefit from the project nor contribute runoff to the problem will help pay for the project. I V. 1MPBS."I_QN_LANpL9S�SE12_BBENS The engineers for the VBWD have made certain assumptions about which areas can be outletted and their flow accommodated by the Main Stem system and which areas cannot be outletted. The attached map shows the areas colored in pink which are assumed never to be outletted. If the City would like the main stem system to have capacity so that any of these areas could be outletted in the future, the request for additional capacity should be made at this time. For example, Foxfire-Green Acres Additions and Down's Lake could be fitted with a small outlet but Legion Pond could not. V. G4A ENIS-RID-REMICENDMON-S The fol lowing is a page by page review of the 509 Plan. We recommend that those comments deemed significant to the City of Lake Elmo be incorporated into the 509 Plan by the Board of Managers. i. Figure 6 on page 14 corresponds to the colored map attached to this summary. The City Council should discuss which areas are planned or not planned to be provided outlets. 2. Page 24, Item 5 lists the policies to be followed for areas outside the MUSA Iine. The portion of Lake Elmo In the VBWD is all outside the MUSA Iine. Please note that a water management plan at the City level is not required. The Watershed District will continue Its review and approval role in the same degree as In the past. Is this satisfactory with the City or does the City want more local control? 3. Figures 8, 10, and i1 on pages 31, 33 and 34 show the "before" and "after" flood levels on the lakes. The City should request that the 10 and 50 year flood levels be provided for the "after" improvement condition and that the duration of time the lakes are above the 10, 50 and 100 year levels be calculated. It Is Important for the City to know not only the probability of a flood but also the duration that the water will stay above that level. 4. Page 37, the last sentence under Deer Pond - since the channel Improvements between Hedges Pond and Lake Jane are not Included in the CIP, is it assumed that this improvement will be done at local cost if it is needed? Exhibit 3 5. Page 38, the last sentence In the first paragraph - the improvement referred to is an outlet from the Foxfire-Green Acres Additions, If needed. 6. Page 38, third to last sentence under City Park Pond - this plan assumes nafurje will replace the dead trees around City Park Pond with new flood tolerant species. No clean up of dead trees is planned. Speaking to Nels Nelson about this, he said the cost estimates may have sufficient funds under "clearing and grubbing" or turf restoration to do some clean up but the present estimate does not provide for the 500+ trees counted by TKDA in our previous flood damage report. The Council should make its feelings known in this matter. 7. Page 39, Lake Elmo - no homes around Lake Elmo are planned to be floodproofed. The City does not receive many structure related damage reports on Lake Elmo other than from Paul Magnuson. It Is assumed by the VBWD that lowering the normal level by 2.5 feet will eliminate the problem. 8. Page 40, the second and third sentences under Horseshoe Lake should be removed and substituted with wording that states the work approved for Tartan Park by VBWD Permit No. 84-21 provides for the 100 year capacity outflow from Lake Elmo and are the only Improvements required in Tartan Park other than minor channel excavation associated with the Lake Elmo outlet construction. 9. Page 43, the first.paragraph reminds the City again that present landlocked lakes, some of which have experienced high water problems, cannot be outletted. Some of these are Clear Lake, Green Acres Pond, Cromble Pond, Animal Inn Ponds, Legion Pond, Goose Lake, Reid Park Pond at and of 32nd Street, and Lake Rose. 10. Page 43, Valley Branch Creek - no improvements are contemplated even though flood related problems have been noted on Lot 10, Beau Haven Addition, the David Hardy driveway, and homes around 28th Street and Ivy Avenue. Does the Council wish to have any Improvements considered in this area? 11. Page 58 - the first sentence of the last paragraph under Financing - if a community wanted Phase II or III initiated sooner than VBWD, It may have to petition for the Improvement and open itself up for special assessments. 12. Cost Estimates on pages 59-62 - Design and Administration was estimated at 7% of construction costs. This may be too low. In order to have the estimated project cost as accurate as possible the VBWD engineer should review these costs and the costs for Miscellaneous and Contingency in Appendix C. Exhibit 4 ( 13. , Table 4 on page 60, Phase I Improvements - it is recommended that the Improved outlet from Lake Elmo be moved up from Phase III to Phase I. It Is also suggested that the Eagle Point Lake Outlet and Tartan Park improvements be shown In Phase I, even though they are to be paid by others. 14. Table 4 on page 62, Phase III Improvements - the conditions under which Phase III will be implemented should be more specific so that the City will not need to petition for the improvements and expose Itself to special assessments. The City should be confident that after certain conditions appear that Phase III will be implemented by the VBWD and financed by an ad valorem tax. In conclusion, it is recommended that the City Council decide which of the above concerns, along with any other concerns, should be passed on to the VBWD. The concerns should be made verbally at the public meeting to be held on February 21, 1985 and then followed upon in writing prior to the March 15, 1985 deadline. This past Wednesday, 2-13~85, I met the The City Administrators from Maplewood, North St. Paul and Oakdale were also present" The intent of this meeting was to introduce the new superintendent to the City Administrators in the cities within his school district" The superintendent would like to hold a joint meeting with all of the City Council members of all the cities in School District 622 for an open discussion of current issues sometime in later March" Maplewood, North St" Paul, Oakdale, parts of Woodbury, Landfall, Lake Elmo and Pine Springs are all in School District 622" At this point, it appears that a Thursday evening is the most likely for such an evening informational meeting. The setting would most likely be at a restaurant for a dinner and round table discussion. This relates to the new Comparable Worth Law and I have already registered myself to attend this conference" If any Council members are interested in attending this seminar, please feel free to contact me and I will submit the registration forms. 4" The Lake Elmo Planning Commission is holding a public hearing at its 2-25-85 meeting on seven different ��gd�~����d���t� " Only zoning code changes require a public hearing; but, the staff has always held public hearings for any any code amendment in order to provide the citizens with the opportunity for comments" These public hearings on 2~25-85 relate to the Planning Commission membership, Park Commission membership, Fire Department membership (method of notifying the Council of new and resigning members), street access onto major thoroghfares, street requirements in RR zone cluster developments:, drainfield requirements in RR and Ag zones and the size of accessory structures in Ag, RR and R~l zones. Many of these issues have been discussed by both the Planning Commission and the Council in the past; but, this will be our, opportunity to make a final decision on any code amendments that are deemed necessary. I anticipate that most, if not all, of these items will receive a recommendation from the Planning Commission and will be on the 3-5-85 City Council Agenda.
