LAKE ELMO CITY COUNCIL MINUTES
JULY 2, 1985
Mayor Morgan called the meeting to order at 7:02 p.m. in the council
chambers. Present: Armstrong (arrived 7:06), Christ, Dunn, Mazzara,
Acting Administrator Banister, City Engineer Bohrer, City Attorney
Knaak, and City Planner Chelseth.
1. Agenda
M/S/P Morgan/Dunn - To approve the agenda for the July 2, 1985 City
Council meeting as amended. Add 8A. Board of Review, 8B. City
Administrator Applications, and 8C. Letter received on 201 Program.
(Motion carried 4-0)
2. Minutes
M/S/P Mazzara/Dunn - to approve the June 4, 1985 City Council Meeting
minutes as presented. (Motion carried. 4-0)
3. Claims
M/S/P Dunn/Christ - to approve the claims 86191 thru 86280 with the
exception of Claim 86223. (Motion carried 4-0)
Dunn and Morgan expressed concern with spending $1,068.00 to belong to
this organization (AMM) and would like to see a detailed explanation
on the benefits the City receives from belonging to this group.
4. Zack Hansen and Bruce Dunn on Composting.
Zack Hansen made a presentation regarding several possible yard waste
composting sites. From the public health department perspective, the
least acceptable site was the Regional Park, 15th Street Entrance, and
the best site was the Public Works Garage Site.
Zack Hansen reviewed his memo of June 27, 1985 in which he discusses
the most desireable to the least desirable sites for composting in
Lake Elmo. This memo is on file at the city office.
1. Public Works Garage Site . This site is by far the most
suitable site for a yard waste composting project. It has good
access, is secure because of the proximity of the Public Works
Garage and a gate could be installed, will require very little
site preparation, is close to public works equipment and is
well screened.
Composting periods are five weeks in the fall and five weeks in the
spring and depending on what the City wishes it could be open a couple
days per week in the summer for other yard waste. This could be
Wednesday afternoons and weekends.
In order to get this into motion by this fall the major concern is to
get the site developed in time and this site would simply be tree
trimming and erecting a gate, if necessary, and any signs that are
desired. It is important to publicize the site well in advance and in

the August city newsletter.
In addition, we have to sign a memorandum agreement between the city
and county, and this would be an annual contract. The County would
pay for the site to be prepared and if the City used.its own equipment
they would be reimbursed. Basically, the City provides the site and
the County picks up the cost for the whole project.
The compost will be given away if this composting site is operated as
in other programs. It would be an 18 month cycle, ie: material
collected this spring would be available in the spring of 1987.
Consensus of the Council is that the Public Works Garage site is a
good site at which to implement this program. Zack Hansen will be
sending a memorandum agreement to the City this week.
5. Public Inquiries
A. Bob Sneen and Steve Plummer (from Edina Realty)
representing the seller (Mrs. Dahl) and the potential
buyer (Mr. Strutt) regarding lot on 32nd St. off of
Klondike.
Bob Sneen has a purchase agreement between Mrs. Dahl and Mr. Strutt
for the lot on 32nd St. off of Klondike subject to the building
provisions. The potential builder had contacted the City Engineer for
a building permit and was told that a building permit would not be
issued on this property because there was an intended common
drainfield for this site. Edina Realty understood that the City would
be going through condemnation proceedings and would purchase the lot
from Mrs. Dahl for this drainfield.
Mayor Morgan explained that the 201 Program has been in existence for
at least three years. This program has gone through phase by phase
over this time and is a program with state and federal assistance to
restore private sanitary systems.
The City Engineer referred to the map and explained the 201 program in
further detail. There has not been any offers made to the owner
because acquisiton of land using the state and federal funds has to be
followed in a very strict manner known as the Federal Land Acquisition
and Relocation Act. The site has not been approved by the Minnesota
Pollution Control Agency as yet, and they are the review agency for
the state and federal grants; but it has been reviewed in a
preliminary way and they have made comments which we have to respond
to and believe that approval is imminent. Once we receive approval we
will have the land appraised and will negotiate with the owner for
that purchase.
Mayor Morgan explained that the City is committed to the 201 Program
and so no action will be taken until we find out whether this site is
approved. A building permit could not be issued in the time limit in
question because you would have to go through the variance process
which means the Planning Commission and then the City Council.
City Attorney Knaak advised by enforcing the zone code ordinances the
city is fulfilling its legal obligation of what it has to do and any

proposed changes have to include reasonable standard proof that a
( variance would not adversely affect among other things the safety and
health of surrounding properties. Especially when dealing with a
sewage situation the first thing to be considered is the health
factor, but it's the landowners seeking the variance that has thefull
burden before the council. (I/
6. Public Hearing - I-94 Overlay and Comp. Plan Amendment.
Pursuant to published notice, this public hearing was opened at 7:45
p.m. in the City Council Chambers.
Rob Chelseth referred to his memo dated January 21, 1985 to the
Planning Commission and City Council. There will be two districts. An
interim district along I-94 (eastern Section 33 east to County Road
15) and this district would permit interim uses, those are uses not
served by public sewer and water that demand negligible increases in
public services, and a "long term" area that would permit more
intensive uses consisted in the comprehensive pl�n. It's an overlay
district and is a means of monitoring the types of uses that go in
there and grant them conditional use permits. Each of the two
districts has approximately twelve standards that would be applied by
the City Council when they are considering a conditional use permit.

Elmo City Ordinance, The Comprehensive Plan
include an "Overlay District" as outlined in
of 1-21-85. (Motion carried 5-0)
7. City Engineer's Report
A. Landfill Water System Update
7971 amending the Lake
and the Zoning Map to
the City Planner's memo
There was some concern over the lack of progress on resolving the
public water supply issues around the old landfill. The City Engineer
has written a letter to provide the sequence of events from the joint
meeting of the County Boards up to the present and to provide all past
correspondence on the matter. The two remaining issues to be resolved
are Operation and Maintenance Costs and System Design.
One thing to note is that the tests of the wells have been getting
better. Formally, there were four residential wells that exceeded
health criteria for drinking water and that has been reduced to only
one that is in the health risk criteria. The purpose of the water
supply is two -fold, first, to provide safe water for all needs and,
secondly, to restore the property values. The advisory committee
determined that only a public water supply would do both.
Mayor Morgan would like to invite the County Commissioners and any
interested parties in for the next meeting, and Larry Bohrer will make
sure they have all the appropriate correspondence.
B. Public Hearing for variances requested by Ed Ryan at
4384 Kimbro Avenue North.
Pursuant to published notice, this public hearing opened at 8:46 p.m.
in the City Council Chambers.

l Mr. Ryan has a purchasers agreement with Mr. Whitman to sell him 2.54
acres. This would meet the 10 acre requirement Mr. Ryan needs to
raise horses. The problem comes in with the City not having a
mechanism to divide off 2.5 acres and add it to this property. There
is no provision for a minor subdivision. A large lot subdivision is
where the applicant proposes to subdivide a described tract of land
into lots or parcels of five acres or more each with 300 feet or more
of road frontage.
It should be noted that to conform to the city code, Mr. Whitman is
required to have 300 feet of road frontage. Although he does not have
this now, if the parcel that he sells to Mr. Ryan includes any of the
road frontage, Mr. Whitman will be less conforming than he is now.
Dunn asked Mr. Ryan if he wanted 7.5 acres or 10 acres. Mr. Ryan
answered that the 2.5 acres would cost him $11,000. If he had to and
it could be done easily without paying the platting expense because he
is purchasing the other property.
Since the existing house is set quite a ways back, Mr. Ryan would like
to put the barn between the road and house which would need a variance
and also the size. In a residential zone, the size of an accessory
structure is 1,000 square feet, but Mr. Ryan would like a 2,000 square
foot accessory structure.
M/S/P Christ/Dunn - To grant variances to Ed ryan on the porperty
legally described as Lot D of RLS 54 to allow up to three horses on
7.5 acres of land; to allow the accessory structure to be placed in
front of the primary structure, and to allow the accessory structure
to not exceed. 2000 square feet. (Motion carried 4-1 <Mazzara>)
C. Hecla Inc. - Site Plan presentation.
Del Sands, Hecla, made the site plan presentation. All the plans have
been approved by the State of Minnesota in terms of the types of
licenses they need to operate the facility.
The City Engineer pointed out, regarding the number of parking spaces
planned for this home, that under the General Business Zone one
parking space is required for each 200 square feet of gross floor
area. This proposed building has 3,000 square feet of area. The
question is does that mean that fifteen spaces should be provided now
or would it be sufficient that there is room available to construct
fifteen. It was clarified that it is more important that the parking
space be available.
The City Engineer further reported that the septic system is adequate,
there is room for an alternate drainfield, setbacks are met, and
public water is available.
M/S/P Dunn/Mazzara - to approve the site plan for the boarding care
home. (Motion carried 5-0).
D. Shoreland Permit - Citadel Homes/Roger Colombo at
Lot 9, Block 1 Eden Park 2nd Addition.

The City Engineer referred to his memo of June 27, 1985 in which he
( states that Citadel Homes proposes to construct a single family home
on the above lot. Since this area is within 1,000 feet of Down's
Lake, Shoreland Regulations apply.
He further stated that lots within Eden Park 2nd Addition require some
background information regarding application of the Shoreland
Ordinance. At the time the plat was approved, the flood elevation was
set sat 891, assuming the VBWD would follow its overall plan to divert
water from Down's Lake to Lake Elmo. Since it is likely this will not
occur the flood level was raised to 894 in the Shoreland Ordinance.
This difference greatly affects buildability of lots within Eden park
2nd Addition.
If this application would be approved, variances for lot size,
structure setback from the water, and basement elevation would be
required. Variances for lot size, building elevation and building
setback are reasonable and consisstent with past Council action with
other lots in Eden Park 2nd Addition. The Engineer feels tat it would
be appropriate to grant these variances since the applicant has chosen
the best site for the house and septic system available on the lot.
The approval should be conditioned on the recommended septic system
design.
M/S/P Dunn/Armstrong - To grant a shoreland permit to Roger
Colombo/Citadel Homes on Lot 9, Block 1 Eden park 2nd Addition for the
construction of a home contingent upon the applicant complying with
the recommendations of the City Engineer in his memo of June 27, 1985.
(Motion carried 5-0).
E. Shoreland Permit - Daniel Lindstrom, 7959 Hill
Trail North
Mr. Lindstrom proposes to remove an existing garage and construct a.
new attached tuck under garage with living room above. Since this lot
is within 1,000 feet of Lake Olson, shoreland regulations apply.
No variances are required for this work. This lot is included in the
201 Septic System Progra, but since no bedrooms are being added, no
changes to the septic system design are required. The City Engineer
recommended that the Shoreland Permit be granted.
M/S/P Christ/Mazzara - to grant a shoreland permit to Daniel
Lindstrom, 7959 Hill Trail North. (Motion carried 5-0).
F. Variance Requests - Bill Eder (continued)
The original proposal came up in April which was a request for a
simple lot subdivision to create two lots and since one was going to
be less than a acre and a half a lot size variance would have been
required. Mr. Bill Eder now owns the Shultz property which had
divided the property owned by Willard Eder and now the lot size
variance is no longer required. The road frontage variances and some
kind of private road agreement are still required.
The City Engineer pointed out now that the subdivision is allowed with
these variances, and he assumes that Mr. Eder will be going through

the subdivision process a survey is required showing the division of
the two lots.
M/S/P Christ/Morgan - to grant a road frontage variance to Bill Eder
with the stipulation that the City of Lake Elmo will not be liable for
the access of emergency vehicles nor for the maintenance of the road.
(Motion carried 5-0).
G. Tartan Meadows - Phase II
The plat for Tartan Meadows was allowed to be signed and recorded
without the developer furnishing his developers bond. This was not
discovered until some time later. The only leverage the city had is
to deny the building permits until he complies with the terms of the
developer's agreement. There are three things that are left to do;
filling and grading the boulevards, constructing a temporary
turnaround and the turf establishment.
It is the City Engineer's opinion that the temporary cul-de-sac and
turf restoration can wait until fall to be completed. However, the
curbs should be backfilled and the boulevards brought up to grade to
protect, the curbs during home building activities. Bohrer has
suggeested that building permits can be issued for Tartan Meadows
after all of the following conditions are met:
1. Filling, leveling and placing topsoil on the boulevard should
be completed now.
2. The developer, Mr. Morton, should furnish a cash escrow,
letter of credit or performance bond for the completion of the
cul-de-sac and turf restortation in the amount of $3,100.
3. Payment of the outstanding snowplowing bill to the private
contractor.
M/S/P Dunn/Armstrong - to allow building permits to be issued in
Tartan Meadows Phase I contingent upon these three conditions outlined
by the City Engineer. (Motion carried 5-0).
H. Surface Water Update.
City Engineer, Bohrer, referred to his letter dated June 26, 1985
regarding the status report on various surface water problems. He
said sandbags are still in place on the Lake Olson Weir, since the DNR
denied the Valley Branch Watershed District (VBWD) Board of Managers'
request for installation of a vandal -proof steel ring on the weir.
The second week in June, Beutel Pond, threatening at least one Jamaca
Court home, was drained until Eagle Point Lake began to overflow.
Installation of a temporary culvert connecting the 32nd Street Pond to
Reid Park Pond lowered the 32nd Street Pond by about eight inches
providing accessibility to the fire hydrant and the Rupperts'
driveway.
One Lake Jane Trail and two Jane Road residents have received fill to
protect their homes from flooding.

A proposal for interim emergency pumping 300 acre feet of water from
( Lake Jane to the Shafer's (Richards) Gravel Pit lying in the NE 1/4 of
Section 16 was discussed. A pump is available from the Valley Branch,
and the Lake Jane Assoc. has approached the owners of the Shafer's
Gravel Pit and they would be agreeable. No easements would be needed
because it would go through city owned property or the Richards
property. The three Shafer's Gravel Pit stipulations were that they
would be free of liability, and there would not be damage to the road
or the gravel deposits of the pit.
The City Engineer and Scotty Lyall looked at the soils and they seemed
to look sandy in this area. Scotty was told by Rudy that the water
stands there and does not go away so they thought there must be clay
underneath it. From looking at the contour map, Bohrer found that the
elevation of the standing water is 926 feet, and he thinks that is
ground water table right there and questions the feasibility. Another
concern is the contaminants close -by that may be pushed into another
direction by raising the level of the water table. The City Engineer
will do a mini -feasibility study.
Costs were given for the following:
pipe rental $1/ft. for 10" pipe until Fall for est. 4,400 feet =
$4,400
the pump capacity is 3 acre feet a day.
electrical estimate = $2,500
manhole estimate = $1,000
liability insurance (Shafer's request to protect themselves)
laying the pipe will be volunteer labor.
minor labor cost for actual hooking up the pump
question road crossing at Jamaca
If we want to asses this, we have to have a public hearing which will
be held on Wednesday, July 24, 1985 at 8:00 p.m. in the City Council
Chambers. Every lot., piece or parcel of land abutting the three lakes
(Jane, Demontreville and Olson) and ponds will be the proposed area to
be assessed.
Mazarra - if this project is feasible and the homeowners are willing
to pay for this, he feels its reasonable and we should go ahead and do
it.
Dunn - we should take a serious look at this and firm up the figures
and answer the question of the water standing in the gravel pit.
M/S/P Morgan/Mazzara - to call a public hearing to determine the
feasibility of moving 300 acre feet of water from Lake Jane across
city property to the Shafer's Gravel pit. (Motion carried 5-0).
I. 1984 MSA Improvements - Change Order #2
Work on the 1984 MSA Improvements, 45th Street, Julep Avenue and 47th
Street, was substantially complete last Fall, and they have just
finished some ditch sodding.

Throughout the spring a maintenance problem has developed. The gravel
( shoulder on the south side of 45th Street east of Jane Road erodes
because of the steep slope and the superelevation of the pavement.
The recommendation of the Maintenance Department would be to pave that
strip (a 4 foot wide shoulder x 600 feet long) and the estimated cost
is around $2,200 and would be reimbursible from state aid funds. A
firm price from the contractor is $2,760 and the difference is
primarily the general contractors markup. Based on the Maintenace
Dept. recommendation, the City Engineer would like to add a change
order on this work.

Order #2 as recommended by the City Engineer in his memo of June 26,
1985-(Motion carried 5-0)
J. Street Light Request -• Jamaca Avenue and Lake Jane
Trail
The City has received a request from Mr. Mike Wagner, 9040 Lake Jane
Trail, for the City to install a street light at the intersection of
Jamaca Avenue and Lake Jane Trail. He states that since the
intersection is dark, some people miss the turn from Jamaca Avenue to
Lake Jane Trail and end up in his yard.
Traffic counts indicate over 1,000 vehicles per day use the
intersection and the Lake Jane Trail is a designated bicycle route.
The monthly charge for the light will be between $9 and $15, depending
on the wattage required. There is no additional charge for
installation.
A suggestion was made for the City Engineer to contact the other
neighbors and find out how they feel about this request and report
back the findings.
K. 1985 Street Repairs - Review Bids
The street repair bids were received on June 28, 1985 and the apparent
low bid was from Tower Asphalt. This low bid exceeded the engineers
estimate by almost $2,000. This was because of the item Bituminous
Mixture (blacktop) was estimated at $30 a ton and the lowest bid was
$33.30.
M/S/P Morgan/Dunn - to accept the lowest bid of $19,360.00 from Tower
Asphalt for the 1985 street repairs. (Motion carried 5-0).
8. City Council Reports
A. Board of Review
Mayor Morgan brought up that he was informed that our Board of Review
was illegal for the last ten years because there is suppose to be a
majority of the Council present rather than just two council members
along with the assessors. Also the meeting that we accept the Board
or Review's conclusions is probably illegal because the assessor was
not present. A request was made to the City Attorney to look into
this and report back.

The City has received 52 applications for City Administrator and the
Council Members were asked to each select five top applicants for the
position.
C. 201 Program Letter
A letter was received from Holmes and Graven regarding their comments
on the 201 program and this letter was turned over to the City
Engineer and the City Attorney for their comments.
