Home My WebLink About09-10-85 CCMI ` i ASSESSMENT HEARING FOR a 45th Street, Julep Avenue and 47th Street and Jane Road North SEPTEMBER 10, 1985 Vice -Mayor Dunn called the assessment hearing to order at 8:03 p.m. in the City Council Chambers. Present: Armstrong, Mazzara, Christ and City Attorney Knaak. Absent: Mayor Morgan. City Engineer Larry Bohrer stated that the 1984 Street Improvements consisted of three projects. 1. 45th Street, Julep Avenue, and 47th Street from Jane Road North to Keats Avenue, 2. Jane Road North from Jamaca Avenue to the west, and 3. Jamaca Avenue extension which completed that portion of Jamaca Avenue from Jane Road North to the roads that were completed in Foxfire Estates. The Jamaca Avenue extension was determined by the City Council to be a City project and there would be no assessments on that portion. A lot is defined as an existing single family lot or the number of lots a parcel could be divided into under present subdivision regulations without platting. In the case of the Agriculture land the zoning is Rural Residential and that could be divided into ten acre parcels under present zoning. Jim Blackford, 9765 45th St. N, questioned if there has been a traffic count and Bohrer answered that a traffic count was not taken. In a co-operative program with the highway department traffic is counted every two or three years. Blackford commented that it was a good quality road and would prefer a 10 year period with 10%. Janet Berschens, 9579 45th St., asked how did you end up with 7 lots for her where you had 6 lots the last time Bohrer talked on it. Bohrer explained that when this was brought up at the feasibility hearing the definition of a large lot was 10.0 acres minimum. It had to be a full ten acres. If you had a forty acre tract and this goes to the center of the road where actually the road takes up some of that area, you really don't have forty full acres to subdivide. In that case you could only get three lots out of a 40 acre tract because in essence there were not 40.0 acres. In the last year or so, that definition was changed in the City Code to a "nominal" ten acres and it allows for a 10% reduction due to roads, survey variations, etc. and in that case where you have approx. 40 acres you could subdivide into four lots. So under todays definition you could subdivide your land into four 10 ASSESSMENT HEARING MINUTES SEPTE.MBER 10, 1985 Page 2 acre lots on the south, but only three lots of 10 acres or more on the north because of the curve which takes up a certain amount of property. Mike Mazzara asked how does land in Green Acres affect the assessment. Bohrer answered that the assessments are deferred until such time as the land is sold or the use changes. Interest does accrue. Wynn John, 8883 Jane Rd. N., stated that the road is a definite improvement from what we had before, but that the turnaround has inadequate space. Jim Weyer, 8991 Jane Rd. N. thanks the Council for keeping this well within the budget and for this proposal of a 22 foot wide road. He would prefer 10 years at the 10% interest rate. The City Engineer discussed the installment payments of 10 and 12 percent over a five and ten year period, but City Attorney Knaak enlighted the Council that if the City pays for it out of existing funds you are limited to an 8% interest charge. The total amount of the assessment may be paid to the City of Lake Elmo prior to October 10, 1985. If not paid before October 10, 1985 the assessment will be certified to the Washington County Auditor in ten (10) equal installments, with interest accruing on the unpaid balance from January 1, 1986 at the rate of 8% per year. Councilman Dunn acknowledged a letter from Airs:-Bersehens; Mrs. Frances Eder, Joseph F. Moris, Jr. and Donald Moris through their Attorneys Lawson, Raleigh, & Marshall dated September 3, 1985 to the City of Lake ELmo objecting to any assessments of their property for the improvemnns referred to in the Notice. M/S/P Dunn/Armstrong - to accept the assessment of 8% interest for 10 years as proposed by the City Engineer for 45th St, Julep Avenue and 47th Street and Jane Road North. (Motion carried 4-0). M/S/P Christ/Mazzara - to adopt Resolution 85-30 to assess the property owners in the approved assessment roster as presented by City Engineer Bohrer for 45th Street, Julep Avenue and 47th Street (Exhibit A as attached to the minutes) at 8% for 10 years. (Motion carried. 4-0). M/S/P Christ-Mazzara - to adopt Resolution 85-31 to assess the property owners in the approved assessment roster as presented by City Engineer Bohrer for Jane Rd. North (Exhibit B as attached to these minutes) at 8% for 10 years. (Motion carried 4-0).
