WASHINGTON COUNTY, MINNESOTA
The City Council of the City of Lake Elmo does hereby ordain
as follows:
Section 1. Amendment. The following described lands
classified on the Zoning Diistrict Map as set forth in Section 301.070
C (1) as RR (Rural Residential) are hereafter classified as AG
(Agricultural) for zoning purposes and shall be subject to all zoning
regulations applicable to an Agricultural District.
TRACT 1
The Southwest Quarter of the Northeast Quarter, except the North 54
feet of Section 11, Township 29, Range 21, Washington County,
Minnesota. Subject to reservations, restrictions, easements of
record, if any, and local -zoning.

A RESOLUTION APPROVING A LARGE LOT SUBDIVISION FOR TWO LOTS FOR LYLE
A. AND MARY J. SLAWSON APPROXIMATELY 1/4 MILE SOUTH OF HIGHWAY 36 AND
WEST OF KEATS AVENUE.
WHEREAS, Lyle A. and Mary J. Slawson have made application to the
City of Lake Elmo to have the real estate legally described parcels as
shown on attached exhibits A and B approved by the City of Lake Elmo
as legally subdivided parcels; and,
WHEREAS, at the time of said application, the attached described
parcels were not separately described parcels of record; and,
WHEREAS, Chapter 401 of the Lake Elmo City Code provides the
requirements for the application and provides that the City Council
may approve such applications for subdivisions; and,
WHEREAS, the City of Lake Elmo Planning Commission considered this
application at a public hearing on January 28, 1985 and recommended
approval of the same; and,
WHEREAS, this City Council at its February 5, 1985 meeting
determined that no variances were required with this application, and
that no right-of-way acquisition was required with this application.

A RESOLUTION MAKING RECOMMENDATIONS REGARDING A SAFE WATER
SUPPLY TO THOSE PROPERTIES ADVERSELY AFFECTED BY THE
RAMSEY/WASHINGTION SANITARY LANDFILL #1
WHEREAS, certain properties in Lake Elmo have been adversely
affected by the migration of contaminants from the Ramsey/Washington
Sanitary Landfill #1; and,
WHEREAS, various levels of contamination have been found in
residential wells near the landfill property; and,
WHEREAS, certain properties within Lake Elmo have experienced
a decrease in market value due to the presence of these contaminants
in the ground water; and,
WHEREAS, the County Boards of Ramsey and Washington Counties
have established an advisory committee to address these concerns; and,
WHEREAS, the City of Lake Elmo has reviewed the findings of
the advisory report and has heard public testimony at a public hearing
on the matter.
NOW, THEREFORE, BE IT RESOLVED, by the City Council that the
City of Lake Elmo hereby makes the following recommendations to Ramsey
and Washington County Boards:
1. The City Council recommends that the Lake Elmo Water
Supply Alternative D, as outlined in the Advisory Committee Report
dated December, 1984, be selected by the Counties as the method to
provide a safe water supply to the affected area. This water system
will be owned and maintained by the City of Lake Elmo.
2. The water system and house service connections necessary
to supply water to the 52 existing homes within Service Area A, as
defined in the report, shall be constructed initially.
3. The well, pump and motor, pressure tank and water mains
shall be sized -initially so that the water distribution system is
expandable in the future to provide water to service area B should
that become necessary.
4. Ramsey and Washington Counties shall be responsible for
all costs associated with the installation of the initial water system
to serve the 52 homes within Service Area A. The Counties shall also
be responsible for costs associated with any future water main
extension and service construction should contamination be found
beyond the 52 initial connections. Annual operation and maintenance
costs, as well as fire protection costs shall be negotiated wih the
Counties.
5. The City of Lake Elmo desires to be represented at all
County meetings when this public water supply issue is to be
discussed. The appointed City representatives are Councillor Bruce
Dunn and Councillor Arlyn Christ.
ADOPTED this 5th day of February, 1985, the City Council of
the City of Lake Elmo, Washington County, Minnesota.

WHEREAS, it appears to the City Council of the City of Lake
Elmo, that the street hereinafter described should be designated a
Municipal State Aid Street under the provisions of Minnesota Laws 1967
Chapter 162:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Lake Elmo that the road described as follows, to -wit:

A RESOLUTION APPROVING THE FINAL PLAT FOR DAVID NELSON ESTATES
WHEREAS, the City Council of the City of Lake Elmo has previously
considered and approved the preliminary plat of David Nelson Estates;
and,
WHEREAS, the applicant has now presented to the City a five lot
final plat which conforms to the approved preliminary plat and meets
the requirements of the City's Subdivision Ordinances; and,
WHEREAS, the Lake Elmo Planning Commission has reviewed the
proposed final plat at its February 11, 1985 meeting and recommended
to the City Council approval of the said final plat.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Lake Elmo does hereby accept the final plat of David Nelson Estates
as it is on file with the City Clerk subject to the following
conditions:
1. Submitting plans and specifications for the required public
improvements for review and acceptance by the City Engineer.
2. Paying park donation fees in the amount of $700.
3. The applicant shall enter into a developer's agreement as
required by the City Subdivision Ordinance providing for the
construction of all streets and related improvements to City
Standards.
4. The developer's performance of said developer's agreement
shall be secured by security bond, cash deposit or letter of credit in
a form approved by the City Attorney or such other security as may be
hereafter approved by the City Council. The amount of said bond shall
be determined by the City Engineer in accordance with the provisions
of the subdivision ordinance.
5. The developer's agreement shall also include all conditions
placed upon the developer a- -roc-ommended -by-the Planning Commission -at - its February 11, 1985 meeting, including the recommendations listed in

A RESOLUTION AUTHORIZING A ROAD FRONTAGE VARIANCE TO JOSEPH KAISER
WHEREAS, the City of Lake Elmo has received an application by
Joseph Kaiser for a road frontage variance to allow the construction
of a single family residential unit on his property of 6.6 acres
described as follows:
Section 15, Township 29, Range 21. Part of the SE1/4 of SW1/4
being E 430.2 Ft Lying S of the Sly R/W of the C St P & 0 Ry exc there
from the S 455.4 feet thereof. Easement for road purposes over and
across a 33 foot wide tract of land the N line of which is described
as follows. The pt of beg of the N line of the 33 foot wide road
easement is the NW corner or the above described 6.6 acre tract thence
WLY along the SLY R/W of the C St. Paul and 0 RY for 343.8 feet to the
end of the desc of the N line of the 33 foot wide road easement.
WHEREAS, the Lake Elmo City Council held a public hearing on the
request by Joseph Kaiser for a road frontage variance at its March 5,
1985 City Council meeting; and,
WHEREAS, the City Council received public input from one resident,
Mr. Friedrich, relating to existing trees on his property immediately
west of the applicant's parcel, and Mr. Friedrich offered support of
the request of Mr. Kaiser for a road frontage variance; and,
WHEREAS, the Lake Elmo City Engineer has reviewed the proposal and
made a number of recommendations to the City Council relating to the
construction of a private road.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lake Elmo that a road frontage variance is hereby authorized to Joseph
Kaiser for his parcel of land containing 6.6 acres subject to the
following conditions:
1. The existing 33 foot wide easement from 31st Street East
to the West lane of the Kaiser property shall be deeded
to the City of Lake Elmo.
2. A 30 foot wide easement for access purposes shall be
__provided along the_ North line of the Kaiser property to a
point approximately 450 feet East of 31st Street to the
East line of the Kaiser property, and along the entire East
line of the Kaiser property.
3. A private 22 foot road in width shall be constructed
from 31st Street East, approximately 450 feet to the point at
which the Kaiser driveway would turn to the south. This
private road is subject to approval for design and
construction by the City Engineer.
4. The Kaiser driveway may be reduced to eighteen feet width,
south of the private road.
5. The line of pine trees on the south side of the existing

for the construction and maintenance of the private road

8. No Certificate of Occupancy for the dwelling unit shall
be issued until the private roadway described is fully
constructed and accepted by the City Engineer, and all
pass-thru expenses have been paid.
9. No maintenance of the roadway shall be accomplished by
the City of Lake -Elmo, and shall be maintained -as -a _-
private road by the developer.

(hereinafter called "City") and Joseph E. Kaiser (hereinafter called
"Devel oper") ,
WITNESSETH:
WHEREAS, the Developer desires to obtain a building permit to construct a
rest dent! al dwel I ing on property owned by Developer in the City of Lake
Elmo; and
WHEREAS, the City has granted the Developer a Road Frontage Variance to
at low construction of the aforementioned dwel i Ing on a parcel of land which
does not abut on a public right-of-way; and
WHEREAS, both the City and the Developer wish to provide for adequate
ingress and egress to the residence following its construction;
NOW, THEREFORE, and In consideration of the respective agreements and
undertakings herein contained, it is agreed by and between the parties as
follows:
1. Developer shall, along with Jim Friedrich, execute a deed to the City
for the 33 foot right-of-way from 31st Street to the east I Ine of the
Kaiser parcel (Parcel 36-37015-4305).
2. Developer shall provide an easement, 30 feet in width, along the north
fine and along the east I i ne of Developer's property as an access to
the Jim Friedrich property, Parcel 36-37015-4300.
3. Developer shall construct and thereafter maintain a private road on
the above described right-of-way and easement, 22 feet in width, from
31st Street to approximately 450 feet east to the point where the
Kaiser driveway would turn south.
The private road shall be 22 feet in width as measured after the
finished bituminous surface Is in place. The subgrade shall be graded
to provide a uniform crown in the center of the road. Ditches are
req u i red In the cut sections to provide drainage. The bottom of the
ditch sh al I be a minimum of one (1) foot deep below the edge of the
road. The €nslope from the edge of the road and the backslope out of
any ditch shal I not be steeper than 3: 1 . Culverts shall be placed at
the low point In the road or wherever surface water will accumulate.
Sufficient fill shall be placed so that the road Is at Ieast one foot
above the highest anticipated level of the adjacent pond. The
Compaction Method. The subgrade shal I be toi eranced and a four (4)
inch minimum thickness Class 5 gravel base constructed thereon.
Additional thickness of gravel base may be required if the subgrade
soils are not stable. A two (2) inch thickness bituminous surface
shal l be constructed thereon, MnDOT Specs f i catl ons 2331 . All areas
disturbed by construction shall then have topsoil spread and re -seeded
to prevent erosion. Upon final inspection by the City Engineer, there
shall be no evidence of erosion.
The Developer shall arrange a meeting on the site with the Contractor
and the City Engineer prior to beginning work on the road to discuss
these requirements.
4. The private driveway to the proposed residence may be reduced to an
eighteen (18) foot width south of the private road.
5. The Developer shal I make every effort to save a row of pine trees
along the south line of the existing 33 foot easement. If the trees
cannot be saved, the Developer shal 1 provide substitute trees to the
satisfaction of Jim Friedrich.
6. Developer agrees to maintain this roadway in winter and summer so as
to provide access for emergency vehicles. Th 1 s mai ntenance
requi rement I ncl udes keeps ng the road cl ear of snow at al I times.
7. Once this Agreement 1s executed by the Developer and all pass- through
costs to date have been paid, a building permit shall be issued to him
for the residence he Intends to construct. However, no Certificate of
Occupancy for the dwelling shall be issued until the roadway described
Is fully constructed and accepted by the City Engineer and all

A RESOLUTION AMENDING RESOLUTION 84-66 GRANTING A CONDITIONAL USE
PERMIT TO CHARLES ANDERSON FOR THE OPERATION OF THE ANIMAL INN
WHEREAS, in Resolution 84-66 Charles Anderson applied for and
received approval for a Conditional Use Permit to operate the Animal
Inn on Pt of the W1/2 of the SE1/4 of Section 16, T29N, R21W, lying
between the Southerly right-of-way line of the MN State Trunk Highway
212 (5) and the Northerly right-of-way line of the
Chicago/Northwestern Railroad at 8533 34th Street North in the City of
Lake Elmo from January 1, 1985 thru December 31, 1985; and has
submitted all required information and fees for the application for
such permit; and,
WHEREAS, Charles Anderson has applied for the addition of a dog
training facility to be included within his Conditional Use Permit;
and,
WHEREAS, Charles Anderson has submitted all the required
information and fees for the application of such expansion of use of
the existing Conditional Use Permit; and,
WHEREAS, this approval of a dog training facility was originally
given to the Animal Inn by the Lake Elmo City Council at a May 15,
1973 meeting; and
WHEREAS, the Lake Elmo Planning Commission held a public hearing
on January 28, 1985 on the application for the expansion of the use of
the existing Conditional Use Permit for the construction of a dog
training facility of 50' x 136' with a 40' x 60' area on the front for
office space, and recommended approval to the City Council; and,
WHEREAS, Section 301.070 D.l.b. of the Municipal Code of Lake Elmo
requires a Conditional Use Permit to operate a public dog kennel and
training school in the City of Lake Elmo; and,
WHEREAS, Section 1402 of the Municipal Code of Lake Elmo sets
forth the conditions under which said permit may be granted and such
uses permitted; and,
WHEREAS, the applicant meets or exceeds all of the conditions set
forth above.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lake Elmo that the Conditional Use Permit amendment for the addition
of a rang training facility at the aboyT coil e pi2gpei2ty for the
Animal Inn is hereby granted to Charles Anderson thru December 31,
1985.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the
City of Lake Elmo that the said amendment to the Conditional Use
Permit approved by Resolution 84-66 is for the construction of a 50' x
136' dog training building with a 40' x 60' area on the front for
office space, contingent upon the applicant submitting a legal
description of the property, meeting the VBWD drainage requirements,
and meeting the State and Local building regulations.
This Conditional Use Permit may be recinded, after a two week notice
and a public hearing, if the City Council finds that the public
health, safety, or welfare is jeopardized.
ADOPTED, this 5th day of March, 1985 by the City Council of the

WHEREAS, the City of Lake Elmo Planning Commission reconsidered
this application at a public hearing on February 28, 1985 and
recommended approval of the same; and,
WHEREAS, this City Council at its March 5, 1985 meeting determined
that no variances were required with this application, and that no
right-of-way acquisition was required with this application.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lake Elmo as follows; to wit:
The application of Lyle A. and Mary J. Slawson for the large lot
subdivision of two forty acre lots as described in the attached

CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION FORMALLY ADOPTING THE "ONE PERCENT RULE" FOR THE CITY
OF LAKE ELMO.
WHEREAS, the City Council of the City of Lake Elmo has been and is
very concerned over increased surface water within the City; and,
WHEREAS, the City of Lake Elmo desires to adopt a policy requiring
restrictions on both the rate and volume of increased surface runoff
due to new constrution; and
WHEREAS, the City of Lake Elmo anticipates that the adoption of a
policy would help to limit the runoff volume, and to move any
increased surface water into the ground water system; and
WHEREAS, the City of Lake Elmo desires such a policy because a
large portion of the City is landlocked and increased runoff volume,
even at low rates, tends to collect at the low points in the
Watersheds and to increase flood levels; and
WHEREAS, the Lake Elmo City Council has reviewed and considered a
policy referred to as the "One Percent Rule" which states that:
1. The annual probability of increased rate and
volume of surface runoff, due to new construction
shall not exceed one percent.
2.. "Annual probability shall not exceed one percent"
d means that a 100 year storm of appropriate duration
should be used for design, but that storms of lesser
magnitudes should be examined as well.
3. Surface runoff is water leaving the property on or
very near the surface.
4. Surface runoff rate is the peak discharge as
calculated by appropriate hydrologic method
for a. storm of critical duration.
5. Volume is the total volume of water calculated
by an appropriate hydrologic method for a storm
of critical duration. The rational method is.
not appropriate for calculation of runoff volumes
unless coefficients are adjusted.

A RESOLUTION IN.__OPPOSITION TO ANY STATE LAW THAT WOULD REQUIRE
CITY PLUMBING BUILDING OFFICIALS TO HOLD A MASTeR OR JOURNEYMAN
PLUMBING LICENSE
WHEREAS, the City of Lake Elmo has received excellent service from
its current and past Building Officials, including plumbing
inspections of the City sanitary septic systems; and
WHEREAS, the City of Lake Elmo is very concerned over the health,
welfare and safety of its citizens and also is very concerned about
providing adequate services to the citizens at the most economcial
cost feasible; and,
WHEREAS, the City's Building Officials are State Certified and
tested and have a two year vocational technical degree, plus three
years of training; and
WHEREAS, the City's Building Officials comply with technical
examinations; and,
WHEREAS, the City has been informed that Senate File #342 has been
discussed at the State Legislature which would require that Plumbing
Inspectors employed by the State, County or Local Units of Government,
including cities, must hold a Master or Journeyman license; and,
WHEREAS, the City believes that this amendment to the State Law
would only add to the cost of local units of government, or else force
local units of government to abandon plumbing inspections.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lake Elmo that the City is in opposition to Senate File #342, or any
other State Law that would require local Building Officials to have a
Master or Journeyman Plumbing License.

A RESOLUTION REGARDING THE DNR PROPOSED GATEWAY SEGMENT OF THE
MINNESOTA-WISCONSIN BOUNDARY STATE TRAIL
WHEREAS, the City of Lake Elmo has received information and
been informed by the Department of Natural Resources (DNR) of the
preliminary project proposal for the Gateway Segment of the
Minnesota -Wisconsin Boundary State Trail; and,
WHEREAS, this proposed trail follows the abandoned Soo Line
railroad in the eastern Minneapolis-St.Paul metropolitan area; and,
WHEREAS, this abandoned Soo Line boarders the northwest
section of Lake Elmo at DeMontreville Park, south of Highway 36 and
east of the City of Oakdale; and,
WHEREAS, the City of Lake Elmo has an established policy of
prohibiting the use of motorized vehicles, including snowmobiles, in
the City parks; and,
WHEREAS, the City of Lake Elmo Park Commission at its March
18, 1985 meeting unanimously voted to recommend to the Lake Elmo City
Council the adoption of a resolution to the DNR requesting that
motorized vehicles, including snowmobiles, be prohibited from the
section of the proposed Gateway Segment Trail that borders the City of
Lake Elmo.
NOW, THEREFORE, BE IT RESOLVED, that the Lake Elmo City
Council requests that the DNR prohibit the use of motorized vehicles,
including snowmobiles, on that section of the proposed Gateway Segment
of the Minnesota -Wisconsin Boundary State Trail that borders the City
of Lake Elmo.

A RESOLUTION GRANTING AN EXTENSION OF PRELIMINARY PLAT APPROVAL
FOR MIDLAND MEADOWS
WHEREAS, the Preliminary Plat of Midland Meadows was approved by
the City Council of the City of Lake Elmo on December 11, 1979; and,
WHEREAS, Section 401.240 G. required the subdivider to submit a
Final Plat within 180 days of the approval of the Preliminary Plat;
and,
WHEREAS, Chapter 401 of the City Code provides that the City
Council may grant an extension of Preliminary Plat approval upon the
request of the Subdivider; and,
WHEREAS, The Subdivider has requested a one year extension for the
approval of. the Preliminary Plat because the current economy makes
development of the property very difficult;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Lake Elmo that:
The Preliminary Plat approval of Midland Meadows is extended for
one year from April 2, 1985, within which time the Subdivider will be
required to submit a Final Plat.

A RESOLUTION RELATING TO PAYMENT OF FEE UNDER THE SUBDIVISION
ORDINANCE IN LIEU OF PARK LAND DONATION
WHEREAS, the City of Lake Elmo has adopted various subdivision
ordinances and resolutions providing for the donation of park land or,
in the alternative, the payment of a fee to the City when property is
subdivided; and
WHEREAS, Lake Elmo City Code Section 401.400 provides for park
donation requirements for plats; and
WHEREAS, Resolution 79-37 provides for payment of $175 per lot
in lieu of park land dedication on minor subdivisions; and
WHEREAS, the Lake Elmo Park Commission has reviewed the
subdivision/park fee donation requirements at its January 21 and March
18, 1985 meetings and recommended to the City Council that these fees
be increased from the current $175 to $250 per lot for all
subdivisions; and,
WHEREAS, the Lake Elmo City Council has considered the
recommendation from the Park Commission to increase the park donation
fees on all subdivisions to $250 per lot at its April 2, 1985 meeting.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Lake Elmo:
1. Effective immediately, all subdivisions shall pay to the City
a fee of $250 per lot in lieu of park land donation at the
time of recording said subdivision. This provision includes
all simple and large lot subdivisions.
2. That the City Adminstrator is authorized and directed to
determine what parcels are affected and to collect said fee.

A RESOLUTION SUPPORTING POSSIBLE LEGISLATION INITIATED BY THE CITY
OF RAMSEY REGARDING COMPENSATION AND MITIGATION POLICIES FOR
COMMUNITIES HOSTING LANDFILLS
WHEREAS, the City of Lake Elmo had the Ramsey/Washington
County Landfill Site No. 1 located within the City of Lake Elmo and
was in operation in the early 1970's; and,
WHEREAS, the City Council of the City of Lake Elmo is opposed
to landfills as the main method to eliminate waste and supports any
efforts to eliminate future needs for landfills such as recycling and
composting; and,
WHEREAS, the City of Lake Elmo has experienced a number of
problems relating to the landfill sites including ground water
contamination of residential wells within the area of the landfill;
and,
WHEREAS, the City of Lake Elmo is experienced in dealing with
these problems and is sympathetic to other communities that may be
considered for landfill sites; and,
WHEREAS, the City of Lake Elmo has been informed and updated
by the City of Ramsey regarding proposed legislation dealing with the
compensation and mitigation policies for communities hosting
landfills.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Lake Elmo that Lake Elmo supports the efforts of the City of Ramsey
to obtain legislation which would provide compensation and mitigation
policies for communities hosting landfills.

WHEREAS, the City Council of the City of Lake Elmo proposes to construct a
28 foot urban designed roadway with 2-way traffic and "No Parking"
restrictions on both sides of said roadway described as follows, to-wlt:

Control Section 101 - Segment 010
WHEREAS, the City Council finds that said construction can be completed,
within the existing right-of-way of 33 feet; and,
WHEREAS, the City Council finds that the purchase of the additional 27 feet
of right-of-way to comply with Minnesota Rules for State Aid Operations,
Chapter 8820, Section 8820.2500, Subparagraph 3, "Right of Way Standards"
would create undue hardship to the surrounding property by the encroachment
on one existing home and removal of one existing home and one commercial
building along the southern portion of 33rd Street.
NOW, THEREFORE, DE IT RESOLVED, that the City Council of the City of Lake
Elmo hereby requests a variance be granted from the required right-of-way

A RESOLUTION APPROVING THE FINAL PLAT FOR TEAL PASS ESTATES THIRD
ADDITION
WHEREAS, the City Council of the City of Lake Elmo has
previously considered and approved the preliminary plat of Teal Pass
Estates; and,
WHEREAS, the applicants have now presented to the city an
Eleven Lot Final Plat which conforms to the approved preliminary plat
and meets requirements of the city subdivision ordinance; and,
WHEREAS, this Eleven Lot Final Plat completes all of the lots
contained within the original preliminary plat; and,
WHEREAS, the Lake Elmo Planning Commission has reviewed and
recommended approval of the proposed final plat at its April 22, 1985
meeting.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Lake Elmo does, hereby, accept the final plat of Teal Pass Estates
Third Addition as it is on file with the City Clerk subject to the
following conditions:
1. The applicant shall in turn to a developer's agreement
as required by the city subdivision ordinance providing
for the construction of all streets and related public
improvements to city standards.
2. The developer's performance of said developer's agreement
shall be secured by security bond, cash deposit, or letter
of credit in a form approved by the City Attorney or such
other security as may be, hereafter, approved by the City
Council. The amount of said bond shall be determined by
the City Engineer in accordance with the provisions of
the subdivision ordinance.
3. The developer shall agree to pay the city its park
donation fee based on $175 per lot.

A RESOLUTION APPROVING A LARGE LOT SUBDIVISION FOR TWO LOTS FOR
LEROY M. AUGUSTINE AND DOROTHY E. AUGUSTINE.
WHEREAS, Leroy M. and Dorothy E. Augustine have made application
to the City of Lake Elmo to have the real estate legally described
parcels as shown on attached exhibits A and B approved by the City of
Lake Elmo as legally subdivided parcels; and,
WHEREAS, at the time of said application, the attached described
parcels were not separately described parcels of record; and,
WHEREAS, Chapter 401 of the Lake Elmo City Code provides the
requirements for the application and provides that the City Council
may approve such applications for subdivisions; and,
WHEREAS, the City of lake Elmo Planning Commission considered

A RESOLUTION VACATING PART OF DEMPSEY AND ARGYLE STREETS IN LANE'S
DEMONTREVILLE COUNTRY CLUB ADDITION.
WHEREAS, at a regular meeting of the City Council of the City
of Lake Elmo, Washington County, Minnesota, held on July 16, 1985, a
Petition was presented to the City Council praying for the vacation of
certain public streets in the plat of Lane's DeMontreville Country
Club Addition described as follows:
Dempsey Street: From a point 10 feet East of the East
Line of Lot 264 Easterly to Argyle Street.
Argyle Street: From North Line of Lot 325 to North Line of
Lot 321.
WHEREAS, said Petition came on for hearing before said City
Council at a regular meeting thereof held at 7:45 p.m. on Tuesday,
July 16, 1985 in the City Hall pursuant to Notice thereof published
and posted as required by law; and
WHEREAS, the City Council has reviewed this Petition with
concern for the interests of the public; and
WHEREAS, that part of Dempsey and Argyle Streets proposed for
vacation has never been opened or used for a public street and it is
improbably that there will ever be any public need for said street;
moreover, by vacating the same, the property will be returned to the
tax rolls and would enhance the taxable value of all the lands
abutting thereon or affected therby; and
WHEREAS, for the foregoing reasons, it appears to be in the
public interest to vacate parts of Dempsey and Argyle Streets.
NOW, THEREFORE, BE IT RESOLVED, that parts of Dempsey and
Agryle Streets as dedicated in the plat of Lane's DeMontreville
Country Club Addition described above be, and the same hereby is,
vacated.
BE IT FURTHER RESOLVED, that the Clerk shall prepare a Notice
of Completion of these proceedings which shall contain the name of the
City, and the identification of the vacation, a statement of the time
of completion thereof and a description of the real estate and land
affected thereby. Such Notice shall be presented to the Washington
County Auditor who shall enter the same in his transfer records and
note upon the instrument over his official signature the words
"entered in the transfer records". The Notice shall then be filed
with the County Recorder, all as required by Section 368.01

vacation of a certain twenty (20) foot easement in the plat of

WHEREAS, the City Council of the City of Lake Elmo has heretofore
considered and has adopted a budget setting forth in detail complete
financial plans of the City for the year 1986; and
WHEREAS, the City Clerk/Treasurer (City Administrator) at
direction of the City Council has computed the amount of taxes
necessary and within statutory limits which must be levied and
collected during the year 1986 in order to provide the budgeted funds;
and
WHEREAS, the City Council of the City of Lake Elmo has considered
the said proposed levy and determined the same to be necessary in the
public interest.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Lake Elmo that the attached budget is hereby adopted and approved
as the budget for the City of Lake Elmo during the year 1986, and the

WHEREAS, at a regular meeting of the City Council of the City
of Lake Elmo, Washington County, Minnesota, held on October 15,
1985, a Petition was presented to the City Council praying for the
vacation of the property legally described as follows:

OF DEMPSEY AVENUE (AKA HILL TRAIL COURT) NORTH

WHEREAS, said Petition came on for hearing before said City

never been opened or used for a public street and it is improbable
that there will ever be any public need for said street; moreover, by

would enhance the taxable value of all the lands abutting thereon or

WHEREAS, for the foregoing reasons, it appears to be in the
public interest to vacate part of Argyle Street.

dedicated in the plat of Lane's DeMontreville Country Club Addition
described above be, and the same hereby is, vacated.
BE IT FURTHER RESOLVED, that the Clerk shall prepare a Notice
of Completion of these proceedings which shall contain the name of the
City, and the identification of the vacation, a statement of the time
of completion thereof and a description of the real estate and land
affected thereby. Such Notice shall be presented to the Washington
County Auditor who shall enter the same in his transfer records and
note upon the instrument over his official signature the words

election to be excluded from membership in the Public Employees
Retirement Association and has provided this Council with a copy of

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lake Elmo as follows:
1. The Council makes the following findings:
(a) Robert Lee Overby is the City Administrator of the
City of Lake Elmo, Minnesota.

A RESOLUTION AUTHORIZING DISPATCH AND USE OF CITY EQUIPMENT
AND SERVICES BY CITY ADMINISTRATOR IN EMERGENCY SITUATIONS
WHEREAS, the City Council finds that instances have occurred in
the past and can be anticipated in the future wherein there is a
danger by fire, hazard, casualty or other similar occurrences taking
place or occurring outside the territorial limits of the City of Lake
Elmo; and by the suddenness thereof it would be impossible or
impractical for the City Council to meet and authorize the dispatch
and use of City equipment and personnel to combat such fire, hazard,
casualty or other similar occurrence; therefore,
BE IT RESOLVED by the Lake Elmo City Council as follows:
The Council finds it desirable and necessary to authorize the
City Administrator or his designee to exercise discretion, considering
at all times and in each case the internal needs of the City of Lake
Elmo and its inhabitants, to dispatch City equipment and personnel as
deemed necessary to combat such occurrence whether it takes place
within or without the Lake Elmo City limits.
BE IT FURTHER RESOLVED that such dispatch and use as directed by
the City Administrator or his designee shall be fully authorized as an
act of the City of Lake Elmo and all provisions for compensation of
personnel, rental of equipment, liability insurance coverage,
workman's compensation insurance and all other safeguards and matters
pertaining to the City, its equipment and personnel, shall apply in
each case as if specifically au.horized and directed by this City
Council at such time, whether or not the governing body or authority
of the place in which the fire, hazard, casua.slty or other similar
occurrence exists, has previously requested and provided for
assistance and the use of the Lake Elmo equipment and personnel under
a mutual protection agreement or other type protection agreement with
the City of Lake Elmo.
FURTHER, the City Administrator or his designee shall recall,
order and terminate the use of such equipment and personnel when the
need for their use no longer exists, or earlier, when at his
discretion it appears in the best interest of the City of Lake Elmo.

A RESOLUTION APPROVING THE FINAL PLAT
OF TARTAN MEADOWS 2ND ADDITION
WHEREAS, the City Council of the City of Lake Elmo has previously
considered and approved a preliminary plat for the development known
as Tartan Meadows; and
WHEREAS, the City Council did on April 21, 1981 approve the final
plat for Tartan Meadows; and
WHEREAS, the developer has applied to the City for an amended
final plat for Tartan Meadows; and
WHEREAS, this amended final plat presented to the City conforms
to the City's subdivision ordinance.
NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby
approve and accept the amended final plat of Tartan Meadows as the
same as on file with the City Administrator subject to the following
conditions:
1. The City should. receive permanent easements for a 120
feet by 120 feet area, for a temporary turn -around at the
West end of 12th Street. The City will deed this parcel
back to the owners at such time as the street is extended.
2. A walkway easement shall be granted to the public along
the South line of Lot 4, Block 1. This walkway easement
is for the purpose of providing access to the park.
Upon compliance by the applicant with the conditions
above, the Mayor and City Administrator are authorized
and directed to execute the Developer's Agreement and.

has granted preliminary approval to the Development, on the condition
that the Developer enter into this agreement to provide for the
installation of streets, utilities, landscaping and other improvements
hereafter described on the terms and conditions hereafter set forth.
NOW, THEREFORE, in of the premises and of the mutual
promises and conditions hereinafter contained, it is hereby agreed as
follows:

1. IMPROVEMENTS
In accordance with the policies and ordinances of the City, and in
accordance with approved plans and specifications dated April 3, 1981,
the following described improvements shall be constructed and installed
on the terms and conditions hereinafter contained:
a. Street grading, graveling and stabilizing, bituminous
surfacing, bituminous curb, construction of berms and
boulevards, and turf restoration including seeding,
mulching, and sodding (hereinafter called "Street
Improvements");
b. Drainage facilities, including all necessary storm
sewers, catch basins, ponds, inlets and other
appurtenances as well as seeding, mulching, and
sodding (hereinafter called "Storm Sewer Improvements")
C. Standard street name signs at all newly opened
intersections and such other traffic control signs
within the subdivision determined to be necessary
by the City Engineer (hereinafter called "Traffic
Signing Improvements");
d. Underground gas, electric and telephone service to
be arranged by the Developer with the utility
companies involved (hereinafter called "Utility
Improvements");
2. DESIGN, INSPECTION AND AS-BUILTS AND WARRANTY RELATED
TO IMPROVEMENTS
The plans and specifications dated April 3, 1981 for all storm
sewer facilities, grading, bituminous curb and bituminous surfacing and
miscellaneous construction have been prepared by Wood, Grover and

Associates, a Registered Professional Civil Engineer, and have been
approved by the City Engineer. The Developer through his engineer
shall provide for competent daily inspection of all street and utility
construction, both public and private. As -built drawings on
reproducible mylar and certificates of completion and compliance with
approved specifications shall also be delivered to the City Engineer.
Prior to acceptance by the City of any streets or utilities or
commencement of maintenance thereof by the City, the City Engineer
shall inspect and approve the same and signify his approval for
acceptance in writing.
Developer, by this instrument, agrees to a one (1) year warranty,
from and after approval by the City Engineer, in favor of the City
covering the workmanship and material in such street and utility
impovements.
I BONDING
Prior to the approval of the final plat for the issuance of any,
building permits for this Development, the Developer shall deliver to
the City Administrator a "Performance Bond", "Cash Deposit", or "Letter
of Credit", in a form acceptable to the City Attorney and in an amount
equal to the estimated construction cost plus twenty-five percent
(25%). This amount has been determined by the City Engineer to be
$121,000.00 and is itemized as follows:

4. FEES
The Developer herein agrees to pay all City fees required per
City Ordinance and further agrees to completely reimburse the City -for
all the costs it incurs including, but not limited to direct City
payroll costs, fees paid to consultants and other professionals, and
the costs of printing, mailing and supplies. In addition to the
above, the Developer herein also agrees to pay the following minimum
charges for City Engineering personnel time involved in consultation
with the Developer and his engineer for review of grading and utility
plans and general and final inspection of streets and utilities and
final plat processing.

5. THE FOR PERFORMANCE; COMPLETION BY CITY ON DEFAULT
Developer agrees to complete the improvements required by this
agreement on or before October 1, 1986.
In the event Developer fails to complete the said improvements
within the time provided by this agreement, then the City may at its
option bring an action in a court of competent jurisdiction for an
order compelling Developer to complete the improvements or the City
may complete the improvements or cause the same to be completed. In
either case, Developer agrees to pay, in addition to the cost of
completing said improvements, any reasonable legal, engineering or
other fees or expenses incurred by the City in connection with the
completion thereof or the enforcement of this agreement upon default
of the Developer.
6. BINDING EFFECT
The terms and provisions hereof shall be binding upon and inure
to the benefit.of the heirs, representatives, successors and assigns
of the parties hereto and shall be binding upon all future owners of
all or any part of the Subdivision and shall be deemed covenants._.
running with the land. References herein to Developer, if there be
more than one, shall mean each and all of them. This agreement, at
the option of the City, shall be placed of record so as to give notice
hereto to subsequent purchasers and encumbrancers of all or any part
of the Subdivision and all recording fees, if any, shall be paid by
the Developer.
7. NOTICES
Whenever in this agreement it shall be required or permitted that
notice or demand be given or served by either party to this agreement
to or on the other party, such notice or demand shall be delivered

personally or mailed by United States mail to the addresses
hereinafter set forth by certified mail (return receipt requested).
Such notice or demand shall be deemed timely given when delivered
personally or when deposited in the mail in accordance with the above.

remaining improvements plus twenty-five percent (25%)-
9. FINAL FLAT APPROVED
The City agrees to give finalapprovalto the plat of the
Subdivision upon execution and delivery of this agreement and all
required petitions, easements, bond, security and fees.
10. INCORPORATION BY REFERENCE
All plans, special provisions,'proposals, specifications and
contracts for the improvements furnished and let pursuant to this
Agreement shall be and hereby are made a part of this agreement by
reference as fully as if set out herein in full.

IN THE MATTER OF LAND CONDEMNATION FOR THE 201 WASTEWATER
TREATMENT PROGRAM AND THE DISMISSAL OF PROCEEDINGS BY THE
CITY OF LAKE ELMO IN REGARD TO A TAKING OF LAND BY EASEMENT
WHEREAS, the City of Lake Elmo has entered into condemnation
proceedings to acquire an easement to land needed to provide
an area for the installation and maintenance of a sewage pipe,
necessary appurtenances, and for street right-of-way; and
WHEREAS, land parcel No-, 3 subject to a partial taking by
easement is located at 11072 34th Street North, Lake Elmo, MN
and is owned by Brian and Patricia Dennis; and
WHEREAS, the City of Lake Elmo has determined that an alternative
route exists to provide the necessary area for a sewage pipe,
appurtenances, and street right-of-way which will allow access
by City maintenance personnel to Old Village Remote Site D; and
WHEREAS, the City of Lake Elmo has determined that the easement
from Brian and Patricia Dennis is no longer needed for purposes
of the 201 Wastewater Treatment Program,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Lake Elmo,
THAT the City Attorney is directed to bring appropriate court
action to have condemnation proceedings against Parcel Number 7
owned by Brian & Patricia Dennis, 11072 34th St, Lake Elmo, dismissed,

A RESOLUTION ORDERING A PUBLIC HEARING FOR THE CITY ENGINEER'S
FEASIBILITY REPORT AND CALLING FOR THE 1987 M.S.A. IMPROVEMENT
PROGRAM FOR A PROJECT TO IMPROVE 47TH STREET NORTH FROM KEATS
AVENUE NORTH TO KIMBRO AVENUE NORTH IN THE CITY OF LAKE ELMO
WHEREAS, the City of Lake Elmo is eligible to receive
construction funds for the improvement of Municipal State Aid (M.S.A.)
Highways for fiscal year 1987; and,
WHEREAS, it is proposed to improve 47th Street North from Keats
Avenue North to Kimbro Avenue North, all in the City of Lake Elmo, in
1987 and to assess the benefited property for a portion of the cost of
these improvements pursuant to Minnesota Statutes Chapter 429.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Lake Elmo that the improvements proposed herein shall henceforth be
referred to as the 1987 M.S.A. Improvements; and the City Engineer is
instructed to report to the Council in a preliminary way as to whether
the proposed improvements are feasbile and the estimated cost of the
proposed improvements; and,
BE IT FURTHER RESOLVED, by the City Council of the City of Lake
Elmo that a public hearing be held on July 21, 1987, at 7:30 p.m. in
the Lake Elmo City Council Chambers to consider the feasibility of the
1987 State Aid Improvement Program and to receive public input on the
proposed project.

A RESOLUTION ORDERING THE 1987 MSA IMPROVEMENTS
AND PREPARATION OF PLANS AND SPECIFICATIONS
WHEREAS, pursuant to Resolution 87-43 of the City Council adopted
May 19, 1987 a Feasibility Report has been prepared by the City
Engineer with reference to the 1987 Municipal State Aid (M.S.A.)
Improvement and this report has been received by the City Council; and
WHEREAS, pursuant to Resolution 87-43, the City Council held a
public hearing on the planned 1987 M.S.A. Improvement on July 21, 1987
at 7:30 p.m. and received public input and comments on the 1987 M.S.A.
Improvement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lake Elmo as follows:
1. The 1987 M.S.A. Improvements are hereby ordered as
proposed in City Council Resolution 87-43 adopted
May 19, 1987.
2. The City Engineer is hereby designated Engineer for
this improvement and shall proceed to prepare plans
and specifications for the making of such improvements
with all deliberate speed.
ADOPTED by the City Council of the City of Lake Elmo this 21st
day of July, 1987.
