A RESOLUTION OFFERING APPRECIATION AND THANKS TO
WILLIAM LUNDQUIST
FOR HIS CONTRIBUTION TO THE CITY OF LAKE ELMO
FROM 197O THROUGH 1985.
WHEREAS, we have had the pleasure of working with William
Lundquist during his service on the City Planning Commission; and
WHEREAS, we have greatly appreciated his perception; his
understanding of the community, the City Ordinances and
Comprehensive Plan, and local needs and goals;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Lake Elmo, that:
The City Council and each and every member, past and present,
of the Planning Commission who had the opportunity to work with
Bill, hereby, offer their sincere appreciation and thanks to
William Lundquist for his service and devotion to the City of Lake
Elmo.

A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO LEONARD HANSON
- ROCKIN L SALES - FOR OPEN SALES LOT IN THE AGRICULTURAL
ZONING DISTRICT FROM JANUARY 1, 1986 THRU DECEMBER 31, 1986
WHEREAS, Leonard Hanson has applied for a Conditional
Use Permit for an Open Sales Lot on the South 627.9 feet of the
West 618.0 feet of all that part of the Southeast 1/4 of the
Southeast 1/It of Section 35, T29N, R21W, lying N of the Northerly
right-of-way of MN Highway 12, at 10824 Hudson Boulevard in the

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Lake Elmo,
THAT, the Conditional Use Permit for an Open Sales Lot
at 10824 Hudson Boulevard is hereby granted to Leonard Hanson -
Rockin L Sales -from January 1, 1986 through December 31, 19861
subject to the following conditions:
1. There shall be no permanent structures built in support
of this use.
2. The display area for all equipment including the presently
permitted horse trailers shall not exceed an area of 150'
by 300' (east/west) in the SE area of the property.
3. All other storage of equipment shall be either inside a
building or screened from Highway 12 and neighboring
properties as provided by the zoning ordinance.
4. One 4' x 8' non -flashing, illuminated sign shall be
permitted.
5. The present ponds shall be kept clean and not be filled.
This Conditional Use Permit may be rescinded, after a 2 week notice
and a public hearing, if the City Council finds that public health,
safety, or welfare is jeopardized.

A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO OAKDALE GUN
CLUB FOR OUTDOOR TARGET RANGE IN THE AGRICULTURAL ZONING DISTRICT
FROM JANUARY 1, 1986 THRU DECEMBER 31, 1986.
WHEREAS, Oakdale Gun Club has applied for a Conditional Use
Permit for an Outdoor Target Range on SE1/4 of SW1/4 of Section
26,T29,R21, subject to easement, located at 10386 North loth Street in
the City of Lake Elmo from January 1, 1986 through December 31, 1986;
and has submitted all required information and fees for the application
for such permit; and,
WHEREAS, Section 301.070 D.b. of the Municipal Code of Lake
Elmo requires a. Conditional Use Permit to operate an Outdoor Target
Range in the City of Lake Elmo; and,
WHEREAS, Section 1300 of the ZONING ORDINANCE of the
Municipal Code of Lake Elmo sets forth the conditions under which said

THAT, the Conditional Use Permit for Outdoor Target Range at
10386 loth Street North, Lake Elmo, Minnesota is hereby granted to
Oakdale Gun Club from January 1, 1986 through December 31, 1986,
subject to the following conditions:
1. Fencing
a. Additional fencing, if any, along the north border
(common border with County Park) to be accomplished
per agreement between Club and County Director of
Planning.
b. Fencing along east and west borders to be accomplished
if and when adjacent properties are developed to the
extent that fencing is necessary. A determination as
to when the adjacent properties are sufficiently
developed to require fencing will be made at the time
of permit renewal in future years.
2. The Club will experiment with implementation of the Braslow
recommendations for noise abatement over the firing line
during 1986. The Club will report on the status of these
experiments prior to the time of the 1987 permit application.
3• Weapons on the shotgun range shall be limited to fine shot
(#6 shot) on the shotgun range.

WHEREAS, Cimarron Park has applied for a Conditional Use
Permit for a Public Golf Course at 901 Lake Elmo Avenue North in the
City of Lake Elmo known as that part of the Southeast Quadrant bounded
by County Road 70 on the North and Lake Elmo Avenue (CSAH 17) on the
West. Being a nine hole, 2345 yard, golf course along the north west
perimeter of the following described development: the west 10 rods of

THAT, the Conditional Use Permit for a Public Golf Course at
901 Lake Elmo Avenue North is hereby granted to Cimarron Park from
January 1, 1986 through December 31, 1986, subject to the following
conditions:
1. That the owners.of Cimarron Park shall demonstrate that they have
taken responsible action to process claims for damages from golfers to
residences and personal property of residents. Claims to be submitted
to Cimarron Management with a copy of each claim sent to the City.
Cimarron will prepare a year-end report on all claims and their
disposition for Council review. Their performance will be a factor in
determining the renewal of the Conditional Use Permit.
2. That the owners of Cimarron Park shall comply with the City's
Noise Ordinance.
3. The owner shall maintain the buffer between the homes in Cimarron

901.010. Purpose. For the health, welfare, safety, .and optimum
land development, it is necessary to regulate the removal of sand,
gravel, rock, soil and other natural deposits in the City of
Lake Elmo.
Other purposes include the following:
A. To provide for the economical availability of sand,
gravel, rock, soil, and other materials vital to the continued
growth of the community.
B. To establish reasonable and uniform limitations, safe-
guards, and controls in the community, for the future production
of sand, gravel, rock, soil, and other natural resources.
C. To control noise, dust, hazards, effect on adjacent
property, and other factors related to the active mining and/or
excavating operation..
D. To provide for control of the extent of excavation
compatible with the surroundings; and for the restoration of the
mining area after termination of the removal operation to make
the site compatible with the surroundings and the comprehensive
plan for development of the City.
E. To control pollution by erosion or sedimentation.
901.020. Definition. Mining shall include the excavation, re-
moval or storage of sand, gravel, rock, soil, clay and other
natural deposits within the community, except:
A. For the purpose of the foundation, cellar or basement
of some pending structure, for which a permit has been issued,
and which is to be erected immediately following the excavation,
removal or storage. or;
B. For the purpose of construction of sewer lines, storm
sewers, water mains, surface water drainage, agricultural or
conservation purposes and sod removal. Nor shall mining include
the moving of dirt for landscaping purposes on a lot used or to
be used for residential purposes. Nor shall mining include the
moving of dirt within the construction limits of a road project.

901.030. Annual Permit Required.
I
A. It shall be unlawful for any person, partnership,
company or corporation to engage in mining within the commu-
nity or for an owner to permit a person to mine on his pro-
perty; without first having obtained aconditional use permit.
for mining from the City Council.
B. The applicant shall submit an application together
with the required fees to the Planning Commission. Property
owners within 350 feet shaj.l be notified by certified mail
to days prior to the date the Planning Commission considers
the request. The Planning Commission shall consider the re-
quest at its next regularly scheduled meeting, but not earli-
er than 10 days from the date of submission. The petitioner
or his representative shall appear before the Planning Commis-
sion, in order to answer questions concerning the proposed
mining. The Planning Commission shall make its recommendation
to the governing body within 60 days after the submission of
the application. The governing body must take action on
the application within 60 days of receiving the recommenda-
tion of the Planning Commission. If it grants the mining
permit, the governing body may impose conditions it considers
necessary to protect the health, safety, morals or general
welfare of the community and to insure the said use is in
harmony with the general purpose of intent of this ordinance
and the comprehensive plan. .No application for a mining per- ((
mit shall be resubmitted within six (6) months from the date \
of denial.
C. A.permit, when issued, shall be valid for one year
unless terminated pursuant to Section901.040.
D. The City Council may waive the requirements
in subsection 901.030 B on a request for renewal.
901.040. Termination of Permit.
A. The City Council may terminate a mining permit for
violation of this ordinance or a condition of the permit, or
for violation of other applicable laws.
B. To terminate a permit, the City Council shall
give notice of the violation or other cause for the termina-
tion along with an order that the condition be remedied. If
the condition has not been repaired within two weeks, the
City Council shall hold a hearing to determine whether the
permit should'be terminated..
C. No mining shall take place after the permit is ter-
minated pursuant to this section.

901,.050. Nuisance Defined.
A. Where 'unsafe conditions or conditions in violation
of this Ordinance or the permit exist, said conditions are
hereby declared to be a nuisance, and the City Council
may give notice to the operator or owner to abate the same.
B. If after a reasonable time for repair of the con-
dition, it still exists, the City Council may abate the
nuisance and the costs of such work may be taxed against the
property and become a lien thereon.
901.060. Application.
A. The application for the permit required in Section
.030 hereof shall be filed with the Administrator for presen-
tation to the City Council. A fee of $25.00 shall accom-
pany each application. Application for renewal permit must
be. made forty-five days prior to the termination of the pre-
vious permit. The application shall be made in the name(s)
of the operator of the mine and the owner of the .land to be
mined.
B. The application shall contain:
1. The name and address of the operator and owner
of the land.
2. The correct legal description of the property
where the mining shall occur.
3. Names of neighboring landowners within 350 feet.
4. A map of the property where the mining is to
occur that clearly indicates the property lines and the limits
of the proposed excavation. Topographic data, including
contours at vertical intervals of not more than five (5) feet
except where the horizontal contour interval is one hundred
(100) feet or more, a two (2) foot vertical interval shall
be shown on this map. Water courses, marshes, wooded areas,
rock outcrops, power transmission poles and lines, and other
significant features shall also be shown. 1929 sea -level datum
shall be usdd for all topographic mapping where feasible.
5. The purpose of the removal, storage or excava-
tion.
6. The estimated time required to complete the re-
moval, storage, or excavation.

7. The plan of operation, including soil processing,
(any operation other than direct mining and removal), nature
of the processing and equipment, location of the plant, source
of water, disposal of water, and reuse of water.
8.' The plans for drainage, water and wind erosion
control, sedimentation and dust control; these plans shall
be in conformity with the recommendations of the Washington
County Soil and Water Conservation District office.
9. A map of plat of the proposed pit or excavation
showing the confines or limits thereof together with the pro-
posed finished elevations based on 1929 sea level datum.
Where the finished elevations prohibit natural drainage, cer-
tified soil borings shall be included through the proposed
excavation.
10. A comprehensive plan showing that suitable pro-
vision will be made for the restoration of the excavated:area
so that it will not become a health or safety hazard or a
nuisance, such plan to include anticipated final elevations,
slope and a plan for the return of sub -soil and topsoil.
Where the Governing Body deems it necessary, such plan shall
include adjoining related areas where excavations have pre-
viously been made and remain under the control of the owner
of the land on which the excavating is to be done or under the
control of the person other than the owner to whom the permit
is to be issued.
11. The travel routes to and from the site.
C. The applicant shall abide by one of the two following
operating and land rehabilitation practices:
1. Excavations resulting in the accumulation of
substantial water areas after rehabilitation must meet the
following requirements:
a. The water depth must not be less than three
(3) feet.
b. All banks shall be sloped to the water line
at a slope which shall not be steeper than four (4) feet hori-
zontal to one ('1) foot vertical.
C. All banks shall be sodded or surfaced with
soil of a quality at least equal to the topsoil of land areas
immediately surrounding and to a depth of at least three inches.
d. Such topsoil as required by subsection c above
shall be planted with trees, shrubs, legumes or grasses upon
the parts of such area where re -vegetation is possible.

Slopes on boundary areas shall not be
steeper than four (4) feet horizontal to one (1) foot ver-
tical.
2. Excavations not resulting in water areas after
rehabilitation but which must be graded or back -filled, shall
meet the following requirements:
a. Such grading or back -filling shall be made
with non -noxious, non-flammable, non-combustible solids.
b. The graded or back -filled area shall not
collect or permit stagnant water to remain therein.
C. The peaks and depressions of the area
shall be reduced to a gently rolling topography in substan-
tial conformity to the land area immediately surrounding and
which will minimize erosion due to rainfall.
d. Such graded or back -filled area shall be
sodded or surfaced with soil of a quality at least equal to
the topsoil of land areas immediately surrounding, and to a
depth of at least three (3) inches.
e. Such topsoil as required by Sub -Section d
above shall be planted with trees, shrubs, legumes or grasses
-' upon the parts of such area where re -vegetation is possible.
.f. New slopes on boundary areas shall not be
steeper than four (4) feet horizontal to one foot vertical.
901.070. operating Conditions. The owner of the premises
must:
A. Pence. Properly fence any pit or excavation.
B. Slope of Excavation. Slope the banks, and other-
wise properly guard and keep any pit or excavation in such
condition as not to be dangerous because of sliding or caving
banks.
C. Set -backs. Refrain from mining below grade closer
than 30 feet.to the boundary of any zone where such operations
arc not permitted, or closer than 50 feet to the boundary of
an adjoining property line, unless the written consent of
the owner in fee of such property is first secured in writing
and filed with the Administrator. Refrain from excavating
below road grade closer than 50 feet to the right-of-way
line and any existing or platted street, road, or highway,
except that excavating may be conducted within such limits in

order to reduce the elevation thereof in conformity to the
existing or proposed street grades. Refrain from excavating
below any maximum depth designated by the Governing Body.
D. Inspection Fee. An annual inspection fee shall be
paid to the community. The minimum annual inspection fee
shall be $100.00. The annual inspection fee shall be based
on the actual reasonable costs which are incurred by the
community in providing periodic inspections and administering
the provision of the annual permit. The Governing Body shall
estimate these charges at the time the annual permit- is issued
and the applicant shall make a cash deposit with the community
equal to the estimate at the time the annual. permit is issued.
Any surplus at the expiration of the annual permit shall be re-
funded to the applicant or if the costs exceed the estimate
the applicant shall pay the additional costs.
E. Survey. Furnish a survey by a certified registered
surveyor showing the boundaries of the property.
F. Bond. Post a bond of $50,000.00, conditioned to
pay the community the cost and expense of repairing any
highways, street, or other public ways and the.restoration
of other sites within the community made necessary by the
special burden resulting from hauling and transporting there-
on by the applicant in the removal of rock, sand, dirt, gra-
vel, clay or other material, and conditioned further to com-
ply with all the requirements of this.ordinance and the par-
ticular permit (including provisions relating completion of
operations and restoration of the site) and to save the com-
munity free and harmless from any and all suits or claims
for damage resulting from the negligent excavation, removal
or storage of rock, sand, dirt, gravel, clay or other material
within the community boundary.
G. Insurance. Carry bodily injury and property damage,
public liability insurance in the amount of $100,000.00 for
any one person and $300,000.00 for any occurrence including
blasting insurance naming the community as an additional in-
sured.
11.- Noise. Maintain and operate all equipment in such
manner as to eliminate objectionable noises and vibrations,
and comply with State and County noise standards.
I. Hours of Operation. Conduct operations only be-
tween the hours of 7:00 A.M. and 7:00 P.M. except no trucking
or mining shall be allowed on Sundays or holidays.
J. Dust and Dirt. Construct, maintain and operate all
equipment in such a manner as to minimize dust conditions.
All operations shall meet the standards of the State Pollu-
tion Control Agency.

WHEREAS, R.J. O'Neil has applied for a Conditional Use

A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO
HAMMES MINING TO ENGAGE IN MINING OPERATIONS FROM
JANUARY 1, 1986, THROUGH DECEMBER 31, 1986
WHEREAS, Hammes Mining (applicants are William H. Hammes and
Clara C. Hammes and their heirs) has applied for a renewal of a
City of Lake Elmo Conditional Use Permit to engage in mining
operations - to mine and sell sand, gravel and rock - on and from
the property described as follows:
The South one-half (S1/2) of the Northeast Quarter
(NE1/4) of Section Thirty-four (34) Township
Twenty-nine (29), Range Twenty-one (21) West, and the
West One-half (W1/2) of the Northwest Quarter (NW1/4)
of Section Thirty-five (35), Township Twenty-nine
(29) Range Twenty-one (21) West.
WHEREAS, Section 901.030 of the Municipal Code of Lake Elmo
requires a Conditional use Permit to engage in mining operations; and,
WHEREAS, Section 901 of the Municipal Code of Lake Elmo sets
forth the conditions under which such permit may be granted for mining
operations and expressly authorizes the City to impose conditions
considered necessary to protect the health, safety, moral and general
harmony of its citizens.
WHEREAS, the City finds that certain conditions exist on the
aforesaid property, which represent a potential hazard and nuisance to
surrounding citizens, and expressly desires to impose conditions on
the grant of any permit to eliminate any such conditions.
WHEREAS, Section 301 of the Municipal Code of Lake Elmo sets
forth the zoning regulations which allows mining operations in
Agricultural zoned land; and,
WHEREAS, the applicant meets or exceeds all the conditions set
forth above except as may be hereinafter stated.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lake Elmo,
THAT, the Conditional Use Permit for mining operations at the
above described parcel is hereby granted to Hammes Mining from January
1, 1986 through December 31, 1986 subject to the following conditions:
1. This permit shall be valid for one year from the date hereof,
and shall terminate on December 31, 1986 unless terminated earlier by
action of the City Council for violation of said Ordinance or this
permit, as provided therein or unless renewed by the City Council.

2. Mining operations shall be conducted on the above described
property within the limits, under the conditions and in accordance
with the plans submitted with the application herein and entitled
"Hammes Property Evaluation", prepared by Frank Horner Co., dated
March 14, 1972, as revised May 9, 1972, except insofar as said plan is
limited or modified. by the terms of this resolution granting renewal
of the permit.
3. Adherence to said plan shall be in accordance with the
reasonable directions of the Building Official.
4. All operations permitted by the Conditional Use Permit shall
be under the terms and conditions of Section 901 of the Municipal Code
of 1979 relating to mining.
5. As a condition of operation pursuant to this permit, the
Applicants shall abide by the terms of this permit, the aforesaid
Ordinances and said plan, including all of the provisions thereof
relating to completion of operations and restoration of the premises.
If Applicants should default in any of their obligations hereunder,
the City may proceed to abate any nuisances, complete operations and
restore the premises in accordance with the said plan and hold each of
said Applicants liable personally for the cost and expense incurred
therein. Alternatively, the City expressly retains the right to
terminate this Conditional Use Permit pursuant to Secion 901.040 of
the Lake Elmo City Code of 1979.
6. No operation shall begin pursuant to this permit until a
certificate or other evidence of insurance as required by Section
901.070 (G) has been filed with the City clerk and until the
performance bond required by Section 901.070 (F), or other security
instruments as may be provided in this permit, shall have been filed
with the City Clerk.
7. No mining excavations shall be conducted below an elevation
of 935 feet above mean sea level until the Applicants shall post a
bond in a reasonable amount satisfactory to the City Council,
whereupon mining excavation may thereafter be conducted to a depth of
920 feet above mean sea level during the term of this permit.
8. No mining operations shall be conducted any closer to the
proposed rights -of -way of County Road 19 or Interstate Highway 94, as
said rights -of -way have been located on the date hereof, than shall be
permitted in the case of existing or proposed street right-of-way
under Section 901.070 (C) of the said Municipal Code.
9. No operation shall begin pursuant to this permit until the
minimum annual fee has been paid. By commencing operations pursuant
to this permit, Applicants agree to pay annual inspection fees, as
defined and determined pursuaant to Section 901.070 (D) of the said
Municipal Code.
10. Without the consent of the City Council, this permit shall
not be assigned and shall be valid only so long as at least one of the
above named Applicants continues to be the owner of the above
described real estate. The City Council agrees that it will not
withhold its consent unreasonably.

11. Except for financing purposes, and except for conduit
conveyances among themselves, the Applicants shall not convey fee
title to the above described real estate without first giving written
notice thereof to the City.
*12. If the Applicants elect to do so, they may secure their
performance of the conditions of this permit by an appropriate
performance agreement secured by a mortgage on forty (40) acres of the
land owned by Applicants in the City of Lake Elmo, in lieu of the
performance bond required by Section 901.070 (F) of the said Municipal
Code; the same to be in a form approved by the City Attorney.
13. Storage of inoperable or unlicensed vehicles shall cease on
the premises effective March 1, 1986.
14. All junk and other materials as defined in Section 1501.040
(J) of the City Code shall be removed, or properly screened, pursuant
to Section 1053.020, by March 1, 1986.
15. The blue house, white house and mobile homes currently
located on the aforesaid property shall either be removed or placed on
permanent approved foundations by March 1, 1986.
16. Discharges of firearms of any type shall not be permitted
upon the aforesaid property.
17. Operations of any off -the -road vehicles (ORVs), including,
but not limited to three-wheelers recreational four-wheel drive and
snowmobiles, by persons other than the property owners or their
immediate families is prohibited.
This permit renewal is issued by the City of Lake Elmo pursuant
to its Municipal Code. This permit renewal does not purport to permit
any improvement, use of activity which may be prohibited or regulated
by other governmental agencies having jurisdiction over said land of
the subject matter of this permit.
The conditions of this resolution are intended to supercede any
and all conditions previously imposed. The City expressly refuses to
waive any rights or authority allowed it under its Municipal Code to
grant or renew a Conditional Use Permit for mining purposes. Failure
of Hammes Mining to fulfill the aforesaid conditions shall be grounds
for termination of this renewed Conditional Use Permit.

CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
WHEREAS, the Lake Jane Landfill was operated for many years
within this City by Washington and Ramsey Counties (hereinafter the
"Counties"); and
WHEREAS, the Lake Jane Landfill has created a serious
environmental and health problem for citizens of the City of Lake Elmo
as the result of groundwater pollution; and
WHEREAS, the aforesaid groundwater pollution has, in addition
to its health and environmental impact, substantially and negatively
affected property values in the area surrounding the Lake Jane
Landfill, resulting in lower assessed values; and
WHEREAS, the State of Minnesota has ordered the Counties to
take efforts to remedy the pollution problems created by their
landfill; and
WHEREAS, the Counties by earlier resolution had accepted a
public water supply as the appropriate resolution of the problem; and
WHEREAS, the City of Lake Elmo has over the past year, made
every good faith effort to negotiate with the Counties in order to
allow for construction of an adequate public water supply for the
affected area within the City; and
WHEREAS, Ramsey County has, despite said lengthy negotiations,
decided, without notice to the city, to install a stop -gap charcoal
filtration system in lieu of an adequate public water supply; and
WHEREAS, the City of Lake Elmo wishes it to be clearly
understood by all persons interested in this issue that it neither
shares nor accepts any responsibility for the decisions of Ramsey
County seeking resolution of this matter; and
WHEREAS, it has been the City of Lake Elmo's experience that
Ramsey County has demonstrated callous disrespect of environmental
problems created by their landfill in Lake Elmo, and as a result, has
shown itself to be an unresponsive and irresponsible landfill
operator.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF LAKE ELMO:
1. That the City of Lake Elmo strongly condemns the
action of Ramsey County choosing options other
than an adequate public water supply to resolve
the pollution problem they created at the Lake
Jane Landfill.
2. That the City of Lake Elmo is and will remain
strongly opposed to the placement within
the City of any other landfill or waste facility
operated by either or both of the aforesaid
Counties or any other entity on behalf of the
aforesaid Counties.
3. That the City Administrator shall forward a copy
of this resolution to the Ramsey County Board and
the Washington County Board.

WHEREAS, the City Council of the City of Lake Elmo has
priviously considered and approved the preliminary plat of Lake Elmo
Heights; and
WHEREAS, the applicants have now presented to the City a
final plat which conforms to the approved preliminary plat and meets
the requirements of the City's Subdivision Ordinance; and,
WHEREAS, the Lake Elmo Planning Commission has reviewed the
proposed final plat at its March 10, 1986 meeting and recommended to
the City Council approval of the said final plat.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Lake Elmo does hereby accept the final plat of Lake Elmo
Heights as it is on file with the City Clerk subject to the following
conditions:
1. The applicant shall enter into a developer's agreement, as
required by the City's Subdivision Ordinance, providing for the
construction of all streets and related improvements to City
Standards.
2. The developers performance of said Developer's Agreement
shall be secured by security bond, cash deposit or letter of credit in
a form approved by the City Attorney or such other security as may be
hereafter approved by the City Council. The amount of said bond shall
be determined by the City Engineer in accordance with the provisions
of the Subdivision Ordinance.
3. Park Dedication fees in the amount of $250 per lot be paid
to the City of Lake Elmo as well as all pass-thru expenses incurred by
the City of Lake Elmo in reviewing this plat.

WHEREAS, the City Council, by resolution adopted , has
granted preliminary approval to the Development, on the condition that the
Developers enter into this agreement to provide for the installation of
streets, utilities, landscaping and other improvements hereafter described
in the terms and conditions hereafter set forth.
NOW, THEREFORE, and in consideration of the premises and of the mutual
promises and conditions hereinafter contained, it is hereby agreed as
follows:
In accordance with the policies and ordinances of the City, the
following described improvements shall be constructed and installed on
the terms and conditions hereinafter contained:
A. Street grading, graveling and stabilizing, bituminous surfacing,
bituminous curb, construction of berms and boulevards, and turf
restoration Including seeding and mulching (hereinafter called
"Street Improvements);
B. Drainage facilities, Including all necessary storm sewers, catch
basins, ponds, inlets and other appurtenances as well as seeding
and mulching (hereinafter called "Storm Sewer Improvements");
( C. Standard street name signs at all newly opened intersections and
such other traffic control signs within the subdivision
determined to be necessary by the City Engineer (hereinafter
called "Traffic Signing Improvements");
D. Underground gas, electric and telephone service to be arranged
by the Developers with the utility companies involved
(hereinafter called "Utility Improvements").
2. DESIGN, INSPECTION AND AS-BUIITS AND WARRANTY PEJAM TO IMPROV mENTS
Prior to any construction, plans and specifications for ail storm
sewer facilities, grading, bituminous curb and bituminous surfacing,
whether to be public or private shall be prepared by a Registered
Professional Civil Engineer and submitted to the City Engineer for
approval. The Developer, through his Engineer, shall provide for
competent dally Inspection of all street and utility construction,
both public and private. As -built drawings on reproducible mylar and
certificates of completion and compliance with approved specifications
shall also be delivered to the City Engineer.
Prior to acceptance by the City of any streets or utilities or
commencement of maintenance thereof by the City, the City Engineer
shall inspect and approve the same and signify his approval for
acceptance In writing.

Developer, by this instrument, agrees to a one (1) year warranty, from
and after approval by the City Engineer, in favor of the City covering
the workmanship and material in such street and utility improvements.
3. PERFORMANCE ASSURANCE
Prior to the approval of the final plat or the issuance of any
building permits for this Development, the Developer shall deliver to
the City Clerk a "Performance Bond", "Cash Deposit", or "Letter of
Credit", in a form acceptable to the City Attorney and in an amount
equal to the estimated construction cost plus twenty-five percent
(25%). This amount shall be determined by the City Engineer. All
streets and utilities which are intended to be owned and maintained by
the City shall include:

4. FEES
The Developer herein agrees to pay all City fees required per City
Ordinance and further agrees to completely reimburse the City for all
the costs it incurs including, but not limited to, direct City payroll
costs, fees paid to consultants and other professionals, and the costs
of printing, mailing and supplies. In addition to the above, the
Developer herein also agrees to pay the charges for City Engineering
personnel time involved in consultation with the Developer and his
engineer for review of grading and utility plans and general and final
inspection of streets and utilities and final plat processing.
5. TIME FOR PERFORMANCE= COMPLETION BY CITY ON DEFAULT
Developer agrees to complete the improvements required by this
agreement or or before September 15, 1986.
In the event Developers fall to complete the said Improvements within
the time provided by this agreement, then the City may, at Its option,
bring an action in a court of competent Jurisdiction for an order
compelling Developers to complete the improvements or the City may
complete the improvements or cause the same to be completed. In
either case, Developers agree to pay, in addition to the cost of
completing said improvements, any reasonable legal, engineering or
other fees or expenses Incurred by the City in connection with the
completion thereof or the enforcement of this agreement upon default
of the Developer.

The terms and provisions hereof shall be binding upon and inure to the
( benefit of the heirs, representatives, successors and assigns of the
parties hereto and shall be binding upon all future owners of all or
any part of the Subdivision and shall be deemed covenants running with
the land. References herein to Developers, If there be more than
one, shall mean each and all of them. This agreement, at the option
of the City, shall be placed of record so as to give notice hereto to
subsequent purchasers and encumbrancers of all or any part of the
Subdivision and all recording fees, if any, shall be paid by the
Developers.
Whenever in this agreement it shall be required or permitted that
notice or demand be given or served by either party to this agreement
to or on the other party, such notice or demand shall be delivered
personally or mailed by United States mail to the addresses
hereinafter set forth by certified mail (return receipt requested).
Such notice or demand shall be deemed timely given when delivered
personally or when deposited In the mall in accordance with the above.

Upon partial performance by the Developers of the terms of this
Agreement, the City will release to the Developers a portion of the
Performance Assurance in accordance with this Agreement. The amount
to be released shall be determined by the City Engineer with approval

remaining improvements plus twenty-five percent (25%).
The City agrees to give final approval to the plat of the Subdivision
upon execution and delivery of this agreement and all required
petitions, bond, security and fees.

WHEREAS, the City Council of the City of Lake Elmo has been
making plans for the construction of a new City Hall building
and,
WHEREAS, Kelly Brookman and Don Raleigh of the Brookfield
Company have offered to donate a 1.5 acre parcel of land (lot
one, block two, Brookman Addition) located immediately south of
the present City offices in the Brookfield II building, and
WHEREAS, the City of Lake Elmo is willing to meet the three
conditions imposed on the land donation, namely: that the City
begin construction of the new City Hall by November 1, 1987 and
that the City use this property for a City Hall for at least
fifteen years, and that Brookfield Company representatives will
be given an opportunity to review the concept plans and offer
their comments.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION OPPOSING THE PROPOSED LANDFILL IN LAKE ELMO REGIONAL
PARK RESERVE
WHEREAS, Washington County is currently in the process of
revising its Solid Waste Master Plan; and
WHEREAS, the goals, objectives and policies for the Solid
Waste Plan have been revised; and
WHEREAS, one of the land disposal objectives indicates that
the County will establish a 21464 acre-foot landfill by 1993 in
accordance with the Metropolitan Council Policy Plan, pending
approval by all parties required by law to act upon the issue;
and
WHEREAS, one of the land disposal policies indicates that
Washington County will prepare an Environmental Impact Statement
for the landfill inventory site located in the Lake Elmo Regional
Park Reserve; and
WHEREAS, the City Council of the City of Lake Elmo reviewed.
the County Solid Waste Master Plan at its February 18, 1986
meeting and finds the following concerns:
1. There is already one failed landfill in the City of Lake Elmo
which continues to contaminate private wells and lower the
property values in the affected area.
2. Many citizens of Lake Elmo were forced by the County to leave
their homes to make way for the County's Regional .Park, with the
understanding that the land would remain forever in use as park
land.
3. The proposed landfill site is dangerously close to Eagle
Point Lake, which with the recently modified 509 surface water
management plan will drain or leach into areas of Lake Elmo and
other communities downstream.
4. The County proposes to site and construct a "sanitary
landfill" at the same time it is working to construct a
refuse -derived fuel waste energy plant to provide a better
alternative to waste disposal than the discredited technology of
landfills. The County is also currently working with the City of.
Lake Elmo in trying to find an acceptable method of providing
safe water to residents living near the old lake Jane Landfill.
The City Council is of the opinion that there is no such thing as
a "safe" landfill, a fact which unfortunately is only discovered
after the hazard has been created.

NOW, THEREFORE, BE IT RESOLVED that the City Council does
hereby condemn and oppose all actions taken by Washington County
or any other parties in support of the proposed landfill site in
the Lake Elmo Regional Park Reserve.

RESOLUTION NO. 86-35
CITY OF LAKE ELMO, MINNESOTA
WHEREAS, the Lake Jane Landfill was granted for many years within
this City by Washington and Ramsey Counties; and (hereinafter the
"Counties")
WHEREAS, the Lake Jane Landfill has created a serious environmen-
tal and health problem for citizens of the City as the result of
groundwater pollution; and
WHEREAS, the aforesaid groundwater pollution has, in addition to
its health and environmental impact, substantially and negatively
affected property values in the area surrounding the Lake Jane
Landfill, resulting in lower assessed values; and
WHEREAS, the State of Minnesota has ordered the Counties to take
efforts to remedy the pollution problems created by the landfill,
and
WHEREAS, the Counties by earlier resolution had accepted a public
water supply as the appropriate resolution of the problem; and
WHEREAS, the City of Lake Elmo has over the past year, made every
good faith effort to negotiate with the Counties in order to
allow for construction of an adequate public water supply for the
affected area within the City; and
WHEREAS, the Counties have, despite said lengthy negotiation,
decided, without notice to the City, to install a stop -gap char-
coal filtration system in lieu of an adequate public water
supply; and
WHEREAS, a ten -home, inadequate water system to some of the
affected homeowners would cost in excess of $225,000; and
WHEREAS, Washington and Ramsey Counties have offered a combined
total of $175,000 for the construction of such a system, an offer
manifestly inadequate and in bad faith; and
WHEREAS, the City of Lake Elmo operates no other ten -home water
system as a municipal system and is unaware of any such system
being operated by any other city; and
WHEREAS, the City of Lake Elmo wishes it to be clearly understood
by all persons interested in this issue that it neither shares
nor accepts any responsibility for the decisions of the counties
seeking resolution of this matter,
WHEREAS, it has been the City of Lake Elmo's experience that
Washington and Ramsey Counties have demonstrated callous
disrespect of environmental problems created by their landfill in
Lake Elmo, and as a result, have shown themselves to be unrespon-
sive and irresponsible landfill operators.
NOW THEREFORE, BE IT RESOLVED BY THE CITY OF LAKE ELMO:
1. That the City of Lake Elmo strongly condemns the action of
Washington and Ramsey Counties choosing options other than
an adequate public water supply to resolve the pollution
problem they created at the Lake Jane landfill; and
2. That the City of Lake Elmo is and will remain strongly
opposed to the placement within the City of any other land-
fill or waste facility operated by either or both of the
aforewaid counties or any other entity on behalf of the
aforesaid counties.
3. The City rejects as woefully inadequate and manifestly in
bad faith the combined offer of $175,000 from Washington
and Ramsey Counties to pay for a municipal water system.
4. The City urges the aforesaid counties to offer to directly
compensate the affected homeowners in the same or greater
amount, to wit, $175,000 or more.
5. The City finds that the bad faith offer of the counties to
be a sufficient basis to close any further discussion of
this matter and to remove itself altogether from this
matter between the counties and the affected homeowners.

WHEREAS, Frank Langer has offered to provide complete
assessment services to the City of Lake Elmo for the 1987
assessment year; and
WHEREAS, Frank Langer intends to provide assessment services
for one-fourth of the total number of tax parcels in the City of
Lake Elmo on a 12-month re -occurring basis; and
WHEREAS, these assessment services are to be provided at a
per -parcel rate of $3.96; and
WHEREAS, the term of appointment shall take effect on July 1,

IN SUPPORT OF ALLOWING RESIDENTS OF
THE CITY OF OAKDALE TO USE THE
LAKE ELMO COMPOSTING SITE
WHEREAS, the City of Lake Elmo operates a site for the
composting of leaves and grass that is open to the public; and
WHEREAS, there is enough capacity at the City's composting
site to handle additional compost material; and
WHEREAS, Washington County has requested that the City of
Lake Elmo decide whether it wants to allow residents of Oakdale to
use Lake Elmo's composting site; and
WHEREAS, Washington County will contact the City of Oakdale
in order to make the initial offer of providing the service and
prepare the necessary agreements if the City of Oakdale should
desire to use the Lake Elmo composting facility; and
WHEREAS, Washington County will consider increasing the
amount of compensation provided to the City of Lake Elmo, should
the cost of operating and maintaining the facility increase beyond
the present rate of compensation as a result of the increased use
by Oakdale residents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Lake Elmo,
THAT, Washington County Public Health Department may inquire
of the City of Oakdale as to their interest in using the Lake Elmo
composting facility and provide the necessary administrative
follow-up, including additional compensation to the City of Lake
Elmo if that proves to be necessary.

WHEREAS, the City Council has heretofore determined that
individual and joint land use wastewater treatment facilities
should be developed to protect the health, safety and welfare of
residents of the City of Lake Elmo.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LAKE ELMO, MINNESOTA, AS FOLLOWS:
1. Acquisition by the City of the following described
property is necessary for the purpose of providing
sites for joint land use wastewater treatment
facilities or easements thereto:
See Attachment A for a listing and description of
the properties to be acquired in fee simple interest
and the properties where easements are to be acquired.
2. The City Attorney is authorized and directed on behalf
of the City of Lake Elmo to acquire the above described
real estate by the exercise of the power of eminent
domain pursuant to Minnesota Statutes, Chapter 117, and
is specifically authorized to notify the owners of intent
to take possession pursuant to Minnesota Statutes,
Section 117.042.
The City Attorney is further authorized to take all
actions necessary and desirable to carry out the purposes
of this resolution.

A RESOLUTION ADOPTING BUDGET FOR 1987 AND LEVYING TAXES FOR 1987
WHEREAS, the City Council of the City of Lake Elmo has heretofore
considered and has adopted a budget setting forth in detail complete
financial plans of the City for the year 1987; and
WHEREAS, the Finance Director at direction of the City Council
has computed the amount of taxes necessary and within statutory limits
which must be levied and collected during the year 1987 in order to
provide the budgeted funds; and
WHEREAS, the City Council of the City of Lake Elmo has considered
the said proposed levy and determined the same to be necessary in the
public interest.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Lake Elmo that the attached budget is hereby adopted and approved
as the budget for the City of Lake Elmo during the year 1987, and the
sum of $388,182 is hereby levied in order to provide the City with the
funds required by said budget and that the sum of $75,000, General
Obligation Park Bond, and $18,672, Equipment Lease, also be levied for
1987 Bonded Indebtedness, and the sum of $61,200 infrastructure
replacement reserve funds for Gravel, Patch and Overlay, and Sealcoat
of City Streets.
BE IT FURTHER RESOLVED, that the Finance Director is hereby
directed to certify a copy of this resolution to the County Auditor in
accordance with law.

of Minnesota, adopted a resolution altering the designation of County
State Aid Highway No. 15 (C.S.A.H. 15) within the corporate limits of
the City of Lake Elmo and West Lakeland Township as follows:
The center line of County State Aid Highway Number 15 (October 6,
1986) to be located in Sections 19 and 30, Township 29 North, Range 20
West, Washington County, Minnesota is described as follows:
Commencing at the southwest corner of the Northeast
Quarter of the Southwest Quarter of said Section 30,
thence North 0 degrees 50 minutes 16 seconds West along
the west line of said Northeast Quarter of the
Southwest Quarter 45.38 feet to the point of beginning
of the center line to be described (bearings are based
on the Washington County Project Coordinate System);
thence North 48 degrees 23 minutes 30 seconds East
213.00 feet; thence northerly 2504.41 feet along a
tangential curve concave to the west having a radius of

rerouted, traffic to the altered, C.S.A.H. 15 and overlayed the portion
of existing Manning Avenue between the connections, Lake Elmo will
assume jurisdiction over that portion of Manning Avenue within its
corporate limits not still designated as C.S.A.H. 15 by Washington
County.

Trunk Highway Number 118 renumbered as Trunk Highway No. 36 within the
corporate limits of the City of Lake Elmo, at D.N.R. Trail (0.8 miles
east of T.H. 694); and seeks the approval thereof, and
WHEREAS said preliminary layouts are on file in the Office
of the Department of Transportation, Saint Paul, Minnesota, being
marked, labeled, and identified as Layout No. 1 S.P. 8204-35 (36=118)
at, D.N.R Trail (0.8 miles east of T.H. 694).
NOW, THEN, BE IT RESOLVED that said preliminary layouts for
the improvement of said Trunk Highway with the corporate limits be and
hereby are approved.
