Home My WebLink About04-19-88 CCMO LAKE ELMO CITY COUNCIL MINUTES APRIL 19, 1988 Mayor Christ called the meeting to order at 7:00 p.m. in the council chambers. Present: Armstrong, Christ, Graves, Johnson, Moe, City Engineer Bohrer, Deputy Clerk Kueffner. 1. AGENDA M/S/P Graves/Johnson - To approve the agenda as amended - Add 4A - VBWD request (Al Dornfeld). Motion carried 5-0. 2. MINUTES M/S/P Armstrong/Johnson - To approve the April 5, 1988 minutes as amended. Motion carried 5-0. 3. CLAIMS M/S/P Graves/Johnson - To approve the claims as amended - Delete Claim #901-50. Motion carried 5-0. 4. LANDFILL UPDATE Todd Williams advised the council that the bill berore the state legislature to stop the siting process as mandated by state statute had failed, and the County will continue its Environmental Impact Statement. Williams said the workshop recently held -on the scoping document provided no positive results, and was quite disappointed with the lack of input/concern of the county board, and suggested that all city council members contact the commissioners asking that they get more involved in the siting process. 4A. REQUEST FROM VALLEY BRANCH WATERSHED - AL DORNFELD Mr. Dornfeld told the council that problems had arisen in DeMontreville Park whereas trees that had been removed had made the area accessible to snowmobiles and other over the road.vehicles and had become a nuisance to the residents in the area. He requested that VBWD be allowed to hire the Lake Elmo maintenance crew to construct about a 20 foot fence at the north end of the park to eliminate this problem. Mr. Dornfeld further told the council that VBWD would, once permission was received from the DNR, pump Sunfish Lake to City Park Pond - with the hopes of getting Sunfish Lake to the level of 896.4. He again requested that VBWD be allowed to hire the Lake Elmo maintenance crew to install this 8" pump and to check it daily. He estimated it would take 1 to 2 days to install the pipe and the diesel pump. M/S/P/ Graves/Moe - To authorize the Lake Elmo maintenance crew to work at the direction of VBWD in erecting approximately a 20 foot fence at the north end of DeMontreville Park; and to authorize the Lake Elmo maintenance crew to work at the direction of VBWD in installing the pipes and monitoring the pump in Sunfish Park (which will pump water to City Park Pond) for a period of up to two months or until Sunfish Lake reaches the level of 896.4, with all costs for both of these projects reimbursed to the City of Lake Elmo by Valley Branch Watershed. (Motion carried 5-0) d P Graves/Johnson - to table this request until the 4-19-88 meeting. request was tableat the April 5 meeting. There was no further x(` information provided by the city staff. The applicants' representative told the council that Washington County was in the process of changing this height restriction as many requests have come in for this type of variance as the styles of homes have changed. M/S/P Armstrong/Graves - To deny the request of Al and Susy Williams/Mastro Construction for a variance to the 35 foot building height restriction based on the applicants not providing a non -economical hardship. Motion carried 5-0 The Council instructed the Planning Commission to review this ordinance to determine if an amendment to the Lake Elmo Municipal Code should be considered for building height restrictions. 6. CONTINUATION OF VARIANCE REQUEST FOR LOT SIZE AND SETBACK FROM OHMW, AND SHORELAND PERMIT FOR LOT 6, KRAUSE'S ADDITION. (Motion carried5-0) M/S/P Graves/Moe - to table this request until the 4-19-88 meeting, This request was tabled at the April 5 meeting. There was no further information provided by the city staff. M/S/P Graves/Moe - To grant a lot size and setback variance from the OHWM (required setback is 100 feet and applicants propose to build at 70 feet) and a shoreland permit for Lot 6, Krause's Addition with the stipulation that no further variances be granted for this property. Motion carried 4-1 (Armstrong). Armstrong felt that the house proposed for this substandard lot was much too big. The lot itself should dictate the size of the house rather than applicant receiving variances for the house desired. The house could be designed and sized to fit the lot. 7. BOARD OF REVIEW Deputy Clerk Kueffner told the council that, although it hasn't --.been a practice in the past, a quorum of the city council should be present at the board of review so that action can be taken if warranted. Discussion followed on whether the council can appoint a board of review. The Deputy Clerk will investigate this and will bring the opinion of the City Attorney back to the council table on May 3. 8. WELL PUMP CONTROL MODIFICATIONS AND WATER SYSTEM ALARM On April 19, 1988, bids were received (by the City Engineer) for the above referenced project, and the tabulation is outlined in the City Engineer's memo of April 19, 1988 and made part of these minutes by reference. M/S/P Graves/Moe - To award the bid for Well Pump Control Modifications and Water System Alarm to the low bidder, Waldor Pump & Equipment, which includes the base bid and alternate, for a total amount of $5,264.00. DRAFT SEPTIC PUMPING ORDINANCE AND REPORTING CARD The City Engineer presented a revision of pages 701-39, 40 41 and 45 of the Lake Elmo Municipal Code, which specifically addresses the i proposed mandatory two-year pumping. Existing Section 701 of the City Code, "Individual and Community Sewer Systems", already contains Section 701.060, Operation and Maintenance. which requires septic - tank pumping based on inspection or need. He also provided a draft of the proposed reporting card. The Council expressed concern with enforcement of the provision of the code, 701.060 A.3 which states that "Maintenance inspection shall be performed annually (not less than) by the owner or his agent. Such v inspection shall include, but is not limited to"... It was the concern of the council that we should not have a provision in our code that could not be reasonably enforced and suggested that the wording be changed to read: "The City recommends that a maintenance inspection be performed not less than annually by the owner or his agent. Such inspection should include, but is not limited to":... REVIEW PLANS AND SPECIFICATIONS FOR 47TH STREET IMPROVEMENTS AND AUTHORIZE ADVERTISEMENT FOR BIDS. The City Engineer presented the plans and specifications for the 47th Street Improvements which are made part of these minutes by reference. M/S/P Graves/Moe - To adopt resolution 88-18 approving the plans and specifications for the 1988 M.S.A. improvements (47th Street from Kimbro to Keats), and ordering advertisement for bids. Motion carried 5-0. 11. REVIEW BID ON MOWER Bids for a mower were received at city hall and opened on March 31, 1988 at 3:00 p.m. Bids received for the 1988 72" front deck mower were as follows: Polfus Imp. $8096.00 MTI Dist. 8140.00 Kromer Co. 9158.00 MacQueen Eq. 8888.00 Kortuem's 8195.00 The Parks Commission reviewed these bids at its April 18, 1988 and .recommended that the city council award the bid to the low bidder, Polfus Imp. M/S/P Graves/Moe - To award the bid for a 1988 72" front deck mower to Polfus, Imp. for a #932 JDF John Deere for a total sum of $8096.00, as recommended by the Parks Commission and Maintenance Foreman. JOINT MEETING WITH LAKE ELMO PLANNING COMMISSION Several members of the Planning Commission were present and discussion t centered around Tax Increment Financing, Residential Estate Zoning and the Comprehensive Plan's update. There was no action requested of or taken by the City Council at this joint meeting. The meeting was adjourned at at 10:15.
