LAKE ELMO CITY COUNCIL MINUTES
1 JULY 19, 1988
Mayor Arlyn Christ called the City Council meeting to order at 7:00
p.m. in the City Council chambers. Present: Christ, Johnson,
Armstrong (arrived 7:15 p.m.), Graves, Moe, City Engineer Bohrer, City
Attorney Knaak and City Administrator Morrison.

presented. (Motion carried 4-0)
2. MINUTES: June 21, 1.988
M/S/P Graves/Moe - to approve the June 2.1, 1988 City Council minutes
as presented. (Motion carried 3-0-1<Abstain: Christ>).
3. CLAIMS
City Attorney Knaak advised the Council against paying claim #90508
because he felt the County should forgive the real estate taxes as itt
was not the City's obligation to pay the taxes; it was between the
County and the landowners. In the meantime the City is being charged
8 percent interest. Attorney Knaak will follow up on this and report
back to the Council.

5. PLANNING/LAND USE/ZONING
A. LARGE LOT SUBDIVISION: 11890

IVISION
The Planning Commission, at its meeting of June 17 by a vote to 6-0,
unanimously recommended Council approval of the Large Lot Subdivision.
Will Turnbladh is requesting a subdivision to provide a 11.5 acre lot
for his son.
Councilman Johnson voiced the concern he had with common driveways.
Will Turnlbladh, Jr. responded that there was an easement recorded in
the deed and that it was not economically feasible for them to put in
a driveway now, but plans a driveway off 50th St. in the future.
M/S/P Graves/Moe - to adopt Resolution 88-31 granting a large lot
subdivision to Will and Mary Turnbladh; contingent upon applicants
paying a park dedication fee of $250 for the newly created lot.
(Motion carried 5-0).

B. PRELIMINARY PLAT; BROOKMAN 3RD ADDITION
LAKE ELMO BUSINESS PARK COMPANY
The Planning Commission at their July 11th meeting recommended
approval of the Preliminary Plat for Brookman 3rd Addition.
City Engineer Bohrer discussed the practicality of the 67% density
computations versus the 20% density requirement as currently required
by the code with the November 1987 Code Amendment. The Council had to
decide on what amount of impervious surface should the pond size be
calculated on. When the pond was designed for the 1st Addition,
engineering calculations were made and determined that the maximum
amount of impervious surface was 67% of each lot. When the 3rd
Addition ponding was calculated, the City Engineer used the same
ratio. If this addition is required to meet 20%, then the pond is
more than sufficient in size for drainage.
Councilwoman Armstrong stated that the 67% was not grandfathered in
and would be looked at with the present code of 20% impervious surface
coverage on each lot. She would also like to have more vegetation to
bufferthis development- from the RR land next to it. In regard to the
water system, Bohrer stated they would use the present water tower and
advised that the water main on 39th St. & Layton Avenue was sufficient
for the 3rd Addition.
The consensus of the Council was 20% coverage was too low and
suggested the Commission should review the ordinance.
M/S/P Graves/Moe - to approve the Preliminary Plat of Brookman 3rd
Addition based on our existing (20%) General Business Code of. November
1987. (Motion carried 5-0).
M/S/P Johnson/Moe - to direct the Planning Commission to look at the
density computations (35%-50%) versus the 20% density requirements as
currently required by the General Business code under different
conditions. (Motion carried 5-0).
C. PRELIMINARY PLAT: F.J. CROMBIE, 2ND ADDITION,
8014/8120 DEMONTREVILLE TRAIL, BRIAN/VERONICA CROMBIE
Brian and Veronica Crombie have made application for a preliminary
plat for F.J.Crombie Estates 2nd Addition, a subdivision of a 23.9
acre tract into eleven lots. The application also requests a variance
from ponding/drainage requirements and a variance for the length of he
cul-de-sac (830' vs. City Code standard of 800').
The concerns addressed by the Planning Commission were: 1.)
ponding/drainage, 2.) preservation of trees and site amenities, 3.)
outlot designations, and 4.) soil erosion control. The Commission, at
their July 11th meeting, recommended approval of the Preliminary Plat
with several conditions and recommended the Council consider a 24'
wide roadway rather than the standard 32' wide street.

Bruce Folz presented the F.J.Crombie 2nd Addition third revision of
the Preliminary Plat which he advised now meets the 1% calculations
and was designed with this criteria.
Karen Chandler, of Barr Engineering (VBWD Engineer) has advised that
the second revised plat had not been received from the applicant and
their report on the drainage and erosion control, of this plat would
not be before the VBWD Board until July 28th.
City Attorney Knaak stated, in regard to the 24' width of their road,
the Council has to consider if this is unique enough to grant the
variance in order to decide other requests that come in the future.
Folz also asked the Council to consider adding "No Parking" on the
cul-de-sac roads in the development.
The consensus of the council was that the plat, as distributed at this
meeting, was revised significantly to table for review by the City
Engineer and VBWD.
Actions requested were: 1.) Original signature of Veronica Crombie (as
owner at the time of submission on the platting application); 2.) Copy
of the Contract for Deed (for sale of the property to Brian Crombie),
and County certification of filing of the Contract for Deed; (3.)
ownership report on property from the applicant or his attorney. 4.)
Review of the revised Plat by the City Engineer and review for
drainage and erosion control requirement by the VBWD.
M/S/P Graves/Armstrong - to table action on the Preliminary Plat; F.J.
Crombie, 2nd Addition until the City Council meeting of August 2nd.
(Motion carried 5-0).
Councilwoman Armstrong suggested adding the wording "or the setback on
the present lot" to Article 4B. Building Location of the submitted
protective covenants.
D. REZONING (RR to AG) and CUP (GREENHOUSES):
So. of 15, between Inwood and Keats, LINDER'S GREENHOUSES,
INC., RESOLUTION NO. 88-32; Granting CUP to Linder's
Greenhouses, Inc.
Li.nder's Greenhouses, Inc. is requesting a downzoning of a 64 acre
tract off 15th Street between Inwood and Keats from Rural Residential
to Agriculture. The Conditional Use Permit is for construction of
greenhouses (Stage 1 = 29,000 sq.ft. plus a 7,250 sq.ft. steel pole
building). Adequate drainage was provided for, landscaping
requirements of three staggered rows of evergreen trees will be
planted to provide a buffer to adjoining properties, and lighting on
the site shall conform to existing City Code. Linder commented that
the tree planting may not happen until the Spring because of the
drought.
The Planning Commission, at their meeting of July 11th, recommended
approval of the rezoning and approval of the Conditional Use Permit
with conditions as outlined in Resolution No. 88-32.

( Planning Commission Dave Johnson considered greenhouses a commercial
business, stated it did not belong in this area across from the
Regional Park and there was no tax benefit being in an Ag zone. Dave
presented a petition to the City Attorney with 25 signatures
requesting an Enviromental Impact Statement. According to Dave, the
Enviromental Review Board requires any structure that is erected over
200,000 sq.ft. in a Class 4 City needs an environmental assessment
worksheet.
The consensus of the Council was greenhouses were a reasonable and
good use of the land. The request was for. a 29,000 sq.ft. greenhouse
and a 7,250 sq.ft. accessory building which did not need an EIS.

6. CITY ENGINEER'S REPORT
A. RECOMMENDATIONS/ALTERNATIVES FOR BITUMINOUS WALKWAYS
(Bikepath), 43rd & Kimbro
At the public hearing for the Improvement of 43rd Street and Kimbro
Avenue, several questions arose as to alternatives available for a
walkway/bikeway. See City Engineer Bohrer's recommendations in his
report dated July 14, 1988.
M/S/P Johnson/Graves - to direct the City Engineer to include in the
43rd and Kimbro Project paving both shoulders 6' wide which will be
paid for. by MSA funds and contingent on these 6' shoulders not
requiring additional right--of-way. Motion carried 4-1<Armstrong:
approval would set a precedent for 6' shoulders>).
M/S/P Graves/Moe - to direct the City Engineer to include paving both
shoulders of 47.th Street 4` ,ride' between Keats and, KimbrdAvenue.
(Motion carried 5-0).
B. PARTIAL PAYMENT & REDUCTION OF RETAINAGE; PART D, 201 PROJECT
Lake Area Utility Contracting completed all contract work prior to the
July 1st completion date. The only items remaining are some sod clean
up and construction of the Twin Points Tavern system pending MPCA
approval.
Since the contract is substantially complete, City Engineer Bohrer
recommended that the contract retainage be reduced to $1,000 to cover
any remaining cleanup and to keep the contract open until the Twin
Point Tavern issue is finally resolved with the MPCA. It was
recommended that Partial Payment No. 6 be approved in the amount of
$39,872.17. Of this amount, $10,500 should come from the Maintenance

Budget for the overlay of 32nd Street between Layton Avenue and
Klondike Avenue which was completed as Change Order No. 3.
M/S/P Graves/Moe - to approve Partial Payment No. 6 of Part D-201
Project to Lake Area Utility Contracting in the amount of $39,872.17.
(Motion carried 5-0).
The City has been notified for the second time from the MPCA that our
request to add the Twin Points back into the program by change order
has been denied. Bohrer has requested a face-to-face meeting with
senior MPCA official in one last attempt to resolve the matter.
M/S/P Graves/Johnson - to direct the City Engineer to write an appeal
to the Director of the MPCA for construction of the Twin Points Tavern
system. (Motion carried 5-0).
The Council requested the staff to check on the status of the MPCA
letter requesting a public hearing, on renewal of the Permit for
Washington Co. Landfill $1, and report to the Council at the next
meeting.
C. FINAL PAYMENT --MAINTENANCE OVERLAY; TOWER ASPHALT
At the last Council meeting, the staff was granted permission to
solicit quotes and award the work for the following projects:
1988 Maintenance Overlays - Hill Trail, Jane Road, Jane Court
1988 MSA Maintenance - Gravel shouldering on 45th, Julep,
47th and Keats
Quotes were received and Tower Asphalt was the low bidder on both
jobs. Bohrer recommended that payments be made to Tower Asphalt in
the total amount of $20,334.50.
M/S/P Graves/Moe - to authorize payment to Tower Asphalt in the total
amount of $20,334.50 for work performed on Hill Trail, Jane Road, Jane
Court, 45th, Julep, 47th and Keats as outlined in the City Engineer's
memo of July 15, 1.988. (Motion carried 5-0).
D. PROPOSED ORDINANCE NO. 8020: ORDINANCE AMENDING SECTION 4
The City Attorney had recommended incorporation of the Ordinance
within Chapt.400 of the Code, under subdivision and platting
procedures. At Council's direction, the staff had incorporated the
Attorney's draft ordinance recommendation, definitions of impervious
surface and surface runoff. The City Engineer concurred with the City
Attorney's recommendations.
M/S/P Johnson/Graves - to adopt Ordinance No. 8020 amending Sections
401.220 and 401.2240 of the 1979 Lake Elmo Muncipal Code, Relating to
Subdivision and Platting of Properties, by Adding to Paragraph Bic of
Section 401.220 and by Adding to Paragraph B3k of Section 401.240,
Relating to Stormwater Runoff Control. (Motion carried 5-0).

City Engineer Bohrer reported he attended the Assessment Hearing held
by the County for the 201 Project. Six residents have filed an appeal
to their assessments.
7. AUDIT REPORT REVIEW: Robert Tautges, CPA
RESOLUTION NO. 88-30; A Resolution Ordering Interfund
Audit Adjustments
Robert Tautges presented the audit report review. The following is a
summary of the items to be recorded, investigated and/or resolved
during 1988:
--Consider writing off the damage reimbursement receivable
The damage reimbursement of $1.,282 should continued to be pursued.
M/S/P Graves/Moe - to write off the Accounts Receivable bad Debt.
(Motion carried 5-0).
--Monitor the past due rent on the old City Hall
The City rents the old City Hall for $500 per month and as December
31., 1.987 the renter was six months delinquent on payments.
M/S/P Johnson/Graves - to direct the City Administrator to commence
collection of the outstanding rental due of $6,000 and to evict the
tenant from the Old City Hall if a satisfactory payment plan is not
submitted. (Motion carried 5-0).
--Record interfund adjustments and adjust the City's financial
accounting records for the year-end adjustments.
--Consider establishing a policy on the use of excess MSA maintenance
monies in conjunction with future proposed MSA construction
Drojects.
--Continue to monitor the property tax collection rate.
--Re-invoice the assessment amount which were billed directly by the
City and/or take official City Council action to write off the
remaining balance. (Washington County $1,393) (Railroad $388)
The Council directed the Finance Director to review these and see if
they are collectable.
--Consider methods of determining the status of green acre properties.
The Council directed the staff to check if the properties still
qualify for Green Acre status.
--Consider the benefits of establishing computerized fixed assets
inventory and accounting records.
The Council suggested starting a numbering identification system on
the Maintenance equipment.

--Review the trend of depleting reserve balance over the past
two years.
--Continue efforts to compel the County to complete the assessment
process and conclude the City's participation in the bonding program
related to the 201 program.
--Monitor the cash position of the City's 201. Fund.
--Verify compliance is being achieved for EPA Grant program.
--Review qualifying types of expenditures prior to expending such
amounts in the Infrastructure Reserve Fund.
--Review water rates annually to assure full funding of water
operations.
--Reconsider the viability of implementing the general ledger and
payroll computer system and consider other computer alternatives.
The Council asked to increase our park dedication fees to what other
cities are charging. City Attorney Knaak added he would have input on
this for the Council.
The consensus of the Council was to direct the staff to follow through
with the auditors' final recommendations.

8. GOETSCHEL--APPEAL TO VARIANCE DENIAL
In December, 1986 the City Council denied a variance requested by
[Halter Goetschel for a 3,000 sq.ft. accessory building (1,000 sq.ft.
would be allowed on the 5 acre parcel). There were two comments made
by the Council when this request was heard: (1) Mr. Goetschel should
see if more acreage could be added to the five acres; and (2) the
Planning Commission considered amending the City Code to prorate the
size allowed for accessory structures on parcels of land over ten
acres in the RR zoning district.
Mr. Goetschel has followed through with the council's recommendation
and has purchased 20 acres of additional land (parcel 2660) and will
deed this property to his daughter and son-in-law (Mr. & Mrs. Klatt)
so the Klatt's will have a total of 25 acres; contingent upon the
variance for accessory structure.
The Council has in the past allowed larger accessory structures based
on the ammount of land the property owners had. Variances were
granted to Steve Pott, Donald Durand and Bernie Meyer for accessory
structures larger than what is allowed in the zoning district.
Approval of these variances were based on the amount of land that each
applicant had.

M/S/P Graves/Moe - to approve the variance of a 3,000 sq.ft. accessory
structure in the Rural Residential zoning district for. Walter
Goetschel/Klatt based on prior practice on examples presented and;
contingent on Mr. Goetschel providing proof of the transfer of
ownership (from Goetschel to Klatt), and that the Klatt's provide
proof that the two parcels have been combined into one 25 acre parcel.
(Motion carried 5-0).
The Council instructed the staff to review the prorating procedures of
size of accessory structures in the Rural Residential Zoning District.
9. CITY ATTORNEY'S REPORT
The City Attorney did not have a report.
10. CITY ADMINISTRATOR'S REPORT
A. RESOLUTION NO. 88-29: Appointing Frank Langer as
for Citv of Lake Elmo
Our contract with Frank Langer is up for renewal. His per parcel 1988
rate is $4.23 and he is requesting for 1989 the per parcel rate be
increased to $4.35. This is 10% less than what Washington County
charges.
Resolution 88-28 has been amended from past years in two respects:
(1.) The contract is continuous unless cancelled by either party by 30
day written notice; and
(2.) The per parcel fee, commencing in 1990 and thereafterr will be
based on a cap of 50 cents under the Washington County rates.
M/S/P Moe/Armstrong - to adopt Resolution No. 88-29, appointing Frank
Langer as Assessor for the City of Lake Elmo. (Motion carried 5-0).
B. REQUEST FOR 3.2 BEER PERMIT; LE JAYCEES HUFF_& PUFF
The Lake Elmo Jaycees submitted their Dram Shop Insurance Certificate
and the County Attorney and Sheriff's Department have given their
approval of the 3.2 Beer permit for the Jaycees for Huff & Puff on
August 11-14th.
M/S/P Moe/Graves - to resolve that the City Council hereby grants
approval of the 3.2. Beer Permit for the Lake Elmo Jaycees for the
period of August 11 through August 14, 1988, and further that the
$10.00 permit fee be waived. (Motion carried 5-0).
C. MOTION VERIFYING PURCHASE: 3/4 GMC PICKUP/EQUIPMENT PACKAGE
M/S/P Graves/Moe - to resolve that the Council hereby verifies and
approves the acceptance of the bid of Routson Motors of Stillwater, MN
in the amount of $14,500 for a 3/4 ton FMS Pickup and further
verifies, the acceptance of the bid of Truck Utilities, in the amount
of $3,313 for an equipment package on the GMC 3/4 ton pickup and

further that said funds are expended as follows: $16,000 budgeted
from Public Works Capital Outlay and $1,813 budgeted from Capital

Dear Mayor and Council:
At the public hearing for the improvement of 43rd Street and Kimbro Avenue,
several questions arose as to alternatives available for a walkway/bikeway.
The following is our report:
In 1983, the Minnesota Department of Transportation published a Bikeway
Design Manual. This manual was intended to provide design guidelines as
well as funding guidelines. At one time, blkeways were specially funded.
Any reference to funding in the guidelines is not applicable to Lake Elmo's
situation.,
The original proposal for 43rd and Kimbro was to pave two — 12T wide
driving Lanes with 41 wide gravel shoulders on each side. The present
traffic is 200 vehicles per day. This traffic is projected to increase to
400 vehicles per day over the next 20 years.
Referring to the attached Design Chart, a two way undivided rural road with
121 wide traffic lanes and 4" wide unpaved shoulders has a 1/good" rating
for suitability of the road for bicycle travel up to 453 vehicles per day
and a "fair" rating up to 750 vehicles per day. if the City were asking
for special bikeway funding, road sections currently rated "good" or "fair"
would not be eligible for shoulder or off —road construction. Off —road
designs would only be considered if shoulders could not be upgraded to
"good" or 11fai r" status.
Based on the MnDOT Design Manual, we make the following recommendations:
1. Keep the road design as proposed with 41' wide gravel shoulders.
Current design manual indicates this is good for at least up to 450
vehicles per day. Bicycle travel should be in the same direction as
traffic, according to Minnesota rules. Bicycles will probably ride on
the pavement until a vehicle approaches and then move off to the
shoulder.

2. If the Council feels gravel shoulders are not acceptable, then the
next alternative would be to pave both shoulders 41 wide. Two-way
bicycle traffic on one shoulder would not be allowed. We recommend
staying with 41 wide shoulders because of continuity with other
streets to the west that have already been constructed.
3. If 41 wide paved shoulders are not acceptable, then the next
alternative would be to pave both shoulders 6? wide. Anything over 61
wide shoulders would probably require more right-of-way beyond the 661
wide minimum.
4. A separate walkway/bikeway is not recommended. Traffic counts would
not warrant it. Additional right-of-way would be required. Special
maintenance would be required. The eastern terminus at Lake Elmo
Avenue is gravel shoulders. If a separate bikeway is still desired,
it should be constructed outside of the road ditch as shown on Figure /
G.

H. CLEAR ZONE (distance from bikeway to traveled
way)
For on -road bikeways refer to the bikeway design
-
tables to assess the road suitability for bicycle travel,
The tables will also enable "pretesting" of shoulderwiden-
ing and surfacing. Bike traffic must flow the same direction
as adjacent motor vehicle traffic. Two-way bike traffic on
one -side of the road is not permitted.
For off -road. bikeways, there are two categories:
roads without curbs and roads with curbs. The proper set
back from the traveled way is an important consideration
for the designer because operation of the facility is de-
pendent upon adequate separation from each respective
travel mode (motor vehicle, bike, pedestrian) and sta-
tionary objects (poles, signs...). See Figure G. -
I, DRAINAGE
For bike routes and lanes the existing roadway drain-
age is normally adequate. However, on curb and gutter
sections a check of ponding depths should be made and
corrective action proposed if depths are significant- This
may entail improved grate designs or wider bike lanes.
On off -road bikeways, the surface of the bikeway
should have a cross -slope of two percent for the proper
irainage. Sloping in one direction usually simplifies longi-
tudinal drainage design and surface construction, and
accordingly, is the preferred practice. Ordinarily, surface
irainage from the path will be adequately dissipated as
t flows down gently sloping terrain. However, when the
ukeway is constructed on the side of a hill, a drainage
iitch of suitable dimensions may be necessary on the uphill
ide to intercept the hillside drainage. See Figure H. Cul-
,erts or bridges are necessary where a bikeway crosses a
lrainage channel. Sizing of the required waterway opening
hould be determined by a hydraulics engineer, Minimum
,ulvert size used for bikeway drainage should be 18 inch.

dcycle travel, Where it is not immediately feasible to re -
lace existing grates with standard grates designed for
icycles, 1 inch x 1/4 inch steel cross straps should be
relded to the grates at a spacing of 6 inches to 8 inches
n center, to reduce the size of the openings. See Standard
lates 4151 and 4152 for acceptable designs of grates,

At the last Council meeting, the staff was granted permission to solicit
quotes and award the work for the following projects. This work needed to
be completed prior to sealcoating.
1. 1988 Maintenance Overlays - Hill Trail, Jane Road, Jane Court.
2. 1988 MSA Maintenance - Gravel Shouldering on 45th, Julep, 47th and
Keats.
Quotes were received and Tower Asphalt was the low bidder on both jobs.
