Mayor Arlyn Christ called the City Council meeting to order at 7:00 p.m. in the City Council chambers. Present: Christ, Johnson, Armstrong, Graves, City Engineer Bohrer and City Administrator Morrison. Absent: Councilman Moe 1. Agenda M/S/P Graves/Johnson - to approve the August 2, 1988 City Council agenda as presented. (Motion carried 4-0). 2. Minutes: July 19, 1988 M/S/P Johnson/Graves - to approve the July 19, 1988 City Council minutes as amended. (Motion carried 4-0). 3. Claims M/S/P Armstrong/Graves - to approve the August 2, 1.988 Claims #90556 thru #90626 as presented. (Motion carried 4--0). 4. Public Inquiries There were no public inquiries. 5. Status Report: Proposed Lake Elmo Regional Park Landfill -- Dan Novak Dan Novak advised the Council that REAPP would be out in force at the County Board on August 16th to argue for inclusion of the remaining final issues in the scoping decision. REAPP requested support from the City Administrator and legal council at this meeting. M/S/P Armstrong/Graves - to designate the City Administrator as coordinator of activities relating to the proposed Lake Elmo Regional Park landfill, and further, that the Administrator and Councilman Johnson act as overseers of all expenditures attributed to legal costs of the Dayton law firm. (Motion carried 4-0). REAPP will staff a booth at the Washington County Fair for the purpose of educating county residents and securing signatures on a petition. This year they will make a county campaign issue by circulating literature identifying the positions of all incumbents and challengers for the Board of Commissioners. REAPP had been working on a third action item with Attorney Dayton which was to provide us with legal strategy and its cost. Dan, Attorney Ellen Sampson, City Attorney Knaak and City Administrator Morrison have met to discuss the legal strategy and its cost. As a result of the meeting, they have found that they cannot reasonably expect Mr. Dayton to predict costs prior to knowledge of on -going LAKE ELMO CITY COUNCIL MINUTES AUGUST 2, 1988 PAGE 2 activities. REAPP was satisfied that this third action is now closed down. A copy of the contract, engaging the law firm of Leonard, Street and Dei.nard, to represent it with regard to the potential siting of a landfill in the Lake Elmo Regional Park Reserve, was provided for the Council's information. The Council directed the City Administrator and City Attorney to review the proposed contract for approval at the August 16th meeting and further directed that terminology be incorporated into the contract which would effectively funnel all activities, with this law firm, through the City Administrator's office. 6. PLANNING/LAND USE/ZONING A. PRELIMINARY PLAT: F.J. CROMBIE, 2ND ADDITION (Continued from 7-19-88) M/S/P Graves/Johnson -• to remove off the table consideration of the Preliminaray Plat for F.J. Crombie, 2nd Addition. (Motion carried 4-0). John Stibbe, Attorney at Law, provided a letter informing the Council of the status of the purchase by Brian Crombie of Veronica M. Crombie's homestead and surrounding property in Lake Elmo. The closing on that property has taken place and Veronica executed and delivered a warranty deed to Brian and Kathleen Crombie. The warranty deed has been recorded at the Washington County Register of Titles office and the property is therefore indefeasibly vested in Brian and Kathleen Crombie. City Engineer Bohrer reported that the VBWD Board of Managers have not taken action on this plat. The_VBWD recommendations were included in Bohrer's review, dated July 29, 1988. Bohrer advised the Council that he had no problem with the variance of street width to 24 feet based on the traffic flow standpoint. Based on the width of the street, he recommended restricting parking to no more than one side. If there is concern about people launching their boats at the public access, he recommended no parking on both sides. Bruce Folz requested "no parking" be placed on both sides of the street. The Council felt the existence of the number of trees of substantial size would justify the variance to 24' from the required 32' road width. In Larry Bousquet's letter dated July 21, 1988, he requested eighty feet of right-of-way be dedicated through the area of the plat where sixty-six feet of right-of-way has been sufficient in the past. Bohrer felt that any improvements that could be made to DeMontrevill.e Trail could be made within 66 feet. In regard to the length of the cul-de-sac, Folz explained if you use the definition of the cul-de-sac starting at the shoulder, it would be less than 800 feet. City Engineer Bohrer stated if you measure the LAKE ELMO CITY COUNCIL MINUTES AUGUST 2, 1988 PAGE 3 distance from the edge of the County right-of-way to the center of the ] cul-de-sac that scales 800 feet. If it was defined from the center of the County road to the center of the cul-de-sac, then it would be 830 feet. If it was defined from the center of the County road to the farthest edge of the cul-de-sac, then it is about 850 feet. The preliminary plat shows that the distance of the cul-de-sac from the edge of the County right-of-way to the center of the cul-de-sac is 800 feet and the Council determined that no variance is required. The applicant requested a variance from permanent ponding for volume control., but they would still have the rate controlled ponding. VBWD no longer enforces volume control. The City ordinances does not differentiate between watersheds that have an improved outlet and watersheds that do not. Councilwoman Armstrong stated the Council made a concession for the trees with a 24' road width, but was not in favor of making a concession to the trees on the ponding because it was too important to Lake Elmo. M/S/P Graves/Christ - to approve the Preliminary Plat for E.J. Crombie, 2nd Addition; contingent upon compliance with the following: 1) adequate soil tests showing two drainfield sites on Lot 3; 2) ponds be designed with permanent storage, as outlined in the City Engineer's memo of July 29, 1988, and temporary storage and outlfow rates be established in accordance with VBWD requirements; 3) sediment and erosion control measures be taken in accordance with VBWD requirements; 4) all Washington County Traffic Engineer's requirements be met; 5) unused wells and septic systems be abandoned in accordance with applicable codes and Statutes; 6) adequate resolution of the County's request for an 80 foot right-of=*way; 7) restrictive covenants, for development, address restrictions on access from the County Road to outlots on Lake DeMontreville, with no vehicular driveway access to outlots; 8) roadways within the development restrict parking on both sides of the streets; and, further, that a variance be granted allowing a 24 foot road width, (with no parking requirements on both sides of roads) based on the uniqueness of the terrain and preservation of existing trees; and, that a variance be granted waiving the permanent pond requirement dedication and ponding easement on Lot 2, Bloc], 1, F.J. Crombie, 2nd Addition, based on the preservation of large trees in the area and sloping of land in this area. CITY ENGINEER'S REPORT friend and business associate) Amended 8-16-88).' A. PACKARD PARK 2ND ADDITION; ESCROW REDUCTION City Engineer Bohrer reported that the grading, gravel base, and bituminous surfacing have been completed on Packard Park 2nd Addition. The only work items remaining are final pond shaping and boulevard LAKE ELMO CITY COUNCIL MINUTES AUGUST 2, 1988 PAGE 4 seeding and mulching. Bohrer estimated that $10,000 retaining would be sufficient to ensure that this work is completed and recommended that the letter of credit be reduced as follows: Original Letter of Credit $62,000 Amount of This Release $52,000 Remaining Security $10,000 M/S/P Graves/Johnson - to approve an escrow reduction for the grading, gravel base, and bituminous surfacing in the amount of $52,000 for work completed in Packard Park 2nd Addition acknowledging that $10,000 will remain securred for the final pond shaping and boulevard seeding mulching. (Motion carried 4-0). B. PAUL EMERSON, LOT 3, BLOCK 1, EDEN PARK REQUEST FOR SHORELAND PERMIT Paul Emerson has applied for a permit for grading and filling necessary to construct a building site and house pad on Lot 3, Block 1, Eden Park Addition. (A building permit is not being applied for at this time.) This grading and filling was shown on the original grading plan for Eden Park approved in 1975 or 1976, but the work was never done. Mr. Emerson is now applying for the permit to do this work. Since this lot is within 1,000 feet of Downs Lake, shoreland regulations apply. There is a drainageway through the lot but his grading and filling will not interfere with drainage. The lot is above the high flood mark and there is no water on the lot. No variances are required for this shoreland permit. The DNR has indicated that they have no problem with this application. M/S/P Graves/Armstrong - to approve a shoreland permit for Paul Emerson to fill Lot 3, Block 1, Eden Park in accordance with the original submitted grading plan. (Motion carried 4-0). 8. DISCUSSION: RDF PLANT TOURS Mary Kueffner reported, including Cimarron, the overall pickup was 20%. Excluding Cimarron because of their very low rate of participation, pickup was up to 25%. A brochure will be worked on with tips and details for recycling. There is money in advertising from the County through our compost agreement, and with part of this money Mary would like to buy a bulk mailing permit to send this brochure out for 10.1 cents. Russ Larkin and Teddy Carlson have been trying to get information on what is available in containers for the City. Councilman Johnson advised the Council, and extended an invitation to the Councilmembers, of a tour that will be set up of the Rtuter Resource Recovery plant in Eden Prairie. RESOLUTION NO. 88- APPOINTING ELECTTO GNATING AND 8TH A list of residents who have agreed to be election judges at the September 13th Primary and November 8th General Election was provided. M/S/P Armstrong/Graves - to adopt Resolution 88-33 designating the Lake Elmo Fire Hall, 3515 Laverne Avenue North as the official polling place for the City of Lake Elmo for the Primary Election September 13, 1988 and the General Election November 8, 1988, and to approve the list of election judges, with two additions; contingent upon each judge attending the City's training session as required by law. APPOINTMENT TO PLANNING COMMISSION The City has received the resignation of 'Tom Simpson from the Planning Commission. Tom was a full voting member and was appointed in January of 1987 to a three year term. The staff will. advertise this position in the next newsletter. M/S/P Armstrong/Graves - to accept the resignation of Tom Simpson, and appoint Al Kunde (1st Alternate) to a full -voting member, to complete his term which expires December 31, 1989. (Motion carried 4-0). E. RETAINING A PLANNER Morton/Engstrom has advised the City they would like to pursue a PUD. Because this is the first residential PUD the City has reviewed, the City Administrator requested a professional planner, Mike Black, of James Hill Assoc., to review this application when it is processed. It is anticipated the majority of his costs will be pass-throughs. The Council directed the Administrator to request a resume from Mr. Black and his estimate to review this application. Adjourn CITY OF LAKE ELMO City of Lake Elmo 777-5510 3800 Laverne Avenue North / Lake Elmo, Minnesota 55042 July 29, 1988 TO: Mayor and City Council FROM: Pat Morrison, City Administrator SUBJECT: Informational Memo Councilman Don Moe is out-of-state and unable to attend our August 2nd meeting. Green Acres Compliance: Upon the recommendation of the Auditor, the Council directed staff to determine compliance of those persons currently filed under the Green Acres Act. In discussing this with Frank Langer, he advised me that Washington County is responsible for compliance measures and as Assessor for Lake Elmo, he is charged with the responsibility to determine if compliance is being met in Lake Elmo. He further advised that to qualify for Green Acres you need only demonstrate you have ten tillable acres, and thereafter the person needs to meet only one of the several criteria (as listed on page 12 of the Auditor's Management Report) to stay in compliance. Frank determines that at least one of the criteria, or restrictions, are met when he views the property (he evaluates 1/4 of the City each year). It is his opinion, which is shared by the County, that all those persons in Lake Elmo, under the Green Acres provision, are in compliance. For your information, he informed me that at least 80% of agricultural land in Washington County is filed under Green Acres. If you feel you would like me to pursue this further, please advise me accordingly. Election Filing Dates: For your information filings for local office will open on August 30th, and run through September 13th. (State Primary is September 13 and the General Election is November 8th). The 1988 Legislative Session produced some changes in the Fair Campaign Practice Act; I have enclosed a summary of the amendment from the League, as well as summary from the Secretary of State's office. In my opinion the major point for candidates to remember is that if they received/spend $750.00, or more, it must be reported to the State, through my office. When the time comes for reporting, I would be happy to try to answer any questions you may have. Cable: Also enclosed is a breakdown of cable viewership in the City; we are at 37.22% penetration; David Garloff advises this is a bit below overall area penetration. I-94 Right -of -Way: I received a call from Gary Workman, MnDot's Right -of -Way Dept., advising that a six acre parcel, of the I-94 proposed R-O-W would be sold back to the heirs of the Schiltgen family (off County Road 13) for $12,000. This parcel was apparently offered to the City in January, 1988, for $12,000, with a 30-day requested response time. It is now being sold to the Shiltgen heirs, as the City did not express interest in purchasing it. Request for Hearing; Washington Co. Landfill Permit #1: As per your request of July 19th, I called Douglas Hall, of MPCA to determine the status of our request. Our request was turned over to Marge Valke, who was apparently out this week; I will try to get an update by Tuesday's meeting. Fire Dept.: Fran has advised he will be submitting specifications to advertise for bids for the Department's personnel transport; $23,000 was directed toward this expenditure in the Department's 1988 capital program. The bids will be submitted for your consideration. Morton/Engstrom Development: On Wednesday, the 27th, Rose Armstrong, Larry Bohrer, Mary and I met with Willard Morton and Bob Engstrom to discuss appropriate processing of their proposal to subdivide approximately 50 acres into 18 lots on property south of 10th St., on the west side of Lake Elmo. The applicants had appeared before the Planning Commission on May 9th of this year to discuss their development (Mr. Engstrom also was before the Council to express his views on the R-R ordinance). Staff reviewed two alternate procedures they could pursue (the land is currently zoned Ag): 1.) apply for rezoning to R-1; plat and encompass within the development agreement the stipulation of a minimum 2 1/2 acre lot size (the applicant had been waiting for the RE Ordinance adoption, but has an August 30th deadline on his option to buy) and, apply for variances on lot frontage and length off cul-de-sac; OR 2.) apply for PUD and R-1 zoning. Morten/Engstrom advised they would like to pursue a PUD, and that they would attempt to be on the Planning Commission agenda of 8-8-88 and Council agenda of 8-16-88 with their General Concept Plan. As the City has denied some applications with similarities to this case, and the Planning Commission generally encouraged the applicant to proceed with his PUD, and this is the first (to my knowledge) residential PUD the City has reviewed, I have taken the liberty to request a professional planner (Mike Black, of James Hill Assoc.) to review this application when it is processed; it is anticipated the majority of his costs will be pass-throughs.
