HomeMy WebLinkAbout09-20-88 CCMLAKE ELMO CITY COUNCIL MINUTES 20, 1988 Mayor Ar.lyn Christ called the City Council meeting to order at 7:02 p.m. in the City Council chambers. Present: Christ, Armstrong, Graves, Moe, City Engineer Bohrer, City Administrator Morrison and Building Official McNamara. Absent: Councilman Johnson 1. Agenda M/S/P Graves/Moe - to approve the September 20, 1988 City Council agenda as presented. (Motion carried 4-0). 2. Minutes: September 6, 1988 M/S/P Armstrong/Graves - to approve the September 6, 1988 City Council minutes as amended. (Motion carried 4-0). Minutes: September. 8, 1988 M/S/P Graves/Moe - to approve the September B, 1988 Special City Council minutes as presented. (Motion carried 4-0). Minutes: September 14, 1988 M/S/P Armstrong/Graves - to approve the September 14, 1988 City Council Workshop Minutes as presented. (Motion carried 4-0). 3. Claims The Parks Commission recommended payment to Asphalt Specialties for tennis court additions at their meeting on 9/19/88. Add: Claim #90837 Asphalt Specialties Co. - Pebble & Tablyn Park $2,795.00 M/S/P Graves/Moe - to approve the September 20, 1988 Claims #90756 thru added claim #90837 as presented. (Motion carried 4-0). 4. Landfill Update No update was presented. 5. PLANNING/LAND USE/ZONING A. Preliminary Plat: Tony & Alice Maistrovich Tony and Alice Maistrovich, 8880 Jane Road North, are requesting preliminary plat approval of a one -lot subdivision known as "Firefly". The Planning Commission held a public hearing on September. 12, 1.988 and unanimously recommended that preliminary plat approval be given. The Commission commented that although they recommend approval of this preliminary plat, it is not a guarantee that the rest of the property can be developed. LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 20, 1988 PAGE 2 Dan Collyard, 8896 Jane Road N. commented that he did not want to see an improved road. Mr. Maistrovich stated that it was not his intention to put a road in at this time. The City Engineer and the DNR have both reviewed this application and find it to be in conformance with the City Code. M/S/P Graves/Moe - to approve the Preliminary Plat application of a one -lot subdivision known as "Firefly" by Tony and Alice Maistrovich, 8880 Jane Road North. (Motion carried 4-0). B. Shoreland Permit: Joseph McGrath 8120 DeMontreville Trail Joseph McGrath, 8120 DeMontreville Trail, is requesting a shoreland permit to allow exterismye remodeling to the existing structure at 8120 DeMontreville Trail N.Aowned by Brian Crombie. Since the lot with the house on it is separated from Lake DeMontreville by DeMontreville Trail, the DNR has indicated they have no concern with this application. Larry Bohrer questioned the size of the septic system as it was replaced by the former owner without benefit of a permit so the information provided on the system is "after -the -fact". Since the 3-bedroom house will. be expanded to a 4-bedroom plus guest bedroom, Bohrer felt the septic system needed to be re-evaluated. Perk tests need to be taken and a septic system permit taken out for a system to be upgraded according to our Building Official. in conformance with the City Code. No variance is necessary. M/S/P Armstrong/Graves - to approve the shoreland permit for extensive remodeling to the existing structure for Joseph McGrath at 8120 DeMontreville Trail; subject to review by the Building Official for upgrading the septic system in conformance with the City Code and Building Code. (Motion carried 4-0). C. PUBLIC HEARING: 1. D.C. Sales, 9240 Hudson Blvd. Variance to number of signs Gregg Dovolis, D.C. Sales, stated in his letter dated August 15, 1988 there are four new tenant spaces and they are now requesting a total number of six signs on the property. Mr. Dovolis' property frontage is approximately 350 feet and per our Sign Ordinance, Section 505.320, his piece of property is allowed three business signs. LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 20, 1988 PAGE 3 A "White Wolf" sign is existing and was installed without the necessary permit and the sign is believed to be over our maximum allowed square footage of 200 sq.ft. per sign. White Wolf has been notified of the violation. Steve, from White Wolf, stated he called the City Office and was told the 3.9 ft. high sign he proposed was acceptable and he did not need a permit. Naegle Signs installed his sign. Administrator Morrison stated Naegle Signs has installed signs in the City before and they know our sign ordinance requires a permit. Steve, owner of White Wolf, stated he has plans for combining both businesses, North Country and White Wolf, and move it into the D.C. Sales Building. The Building Official warned him to check with the City before he decides to add a sign for North Country. Steve DeLapp, Planning Commission Chairman, read the minutes when D.C. Sales requested their building addition, stated their intent of this addition was to be used as a warehouse for their products. The owner has occupied the building for several years along with two tenants, White Wolf Ski Shop and BRS, Inc. The proposed building addition will meet the expansion needs of D.C. Sales and the White Wolf Company. DeLapp explained that the addition of tenants and five store fronts is totally outside of their application that was before the Planning Commission and City Council. - A representative from D.C. Sales was not present therefore, the Council suggested tabling this public hearing until D.C. Sales could be present. D.C. Sales will be notified of the public hearing. M/S/P Moe/Armstrong - to table the public hearing, until the October 4th Council meeting, for a variance to the number of signs fot D.C. Sales, 9240 Hudson Blvd. (Motion carried 4-0). 2. Charles Taylor, 4677 Birchbar.k Tr. Shoreland Permit & Setback Variance from High Water Mark Mayor Christ called the public hearing to order at 8:20 p.m. in the City Council chambers. Charles Taylor, 4677 Birchbark Trail, is requesting a shor.eland permit and variance from the setback from the Ordinary High Water Mark. The purpose of this request is to allow the applicant to construct an 18' x 26' addition to the South of the existing structure which is not towards the lake. The City Engineer and DNR have reviewed this application. Since the addition does not increase the existing non-conformancy, they would recommend that a variance and shoreland permit be granted. There was no one to speak for or against the application. Mayor Christ closed the public hearing at 8:23 p.m. LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 20, 1988 PAGE 4 M/S/P Moe/Graves - to approve the shoreland permit and setback variance from the Ordinary High Water Mark for Charles Taylor, 4677 Birchbark Trail, to allow him to construct an 18' x 26' addition to the existing structure, in accordance with the schematic submitted; this approval is based on the fact that the addition does not infringe on the lake or increase the existing non-conformancy. (Motion carried 4-•0) . 6. PUBLIC HEARING: 1989 Budget Mayor Christ called the public hearing to order at 8:25 p.m. in the City Council chambers. The 1989 budget was provided for the Council's review. Finance Director Marilyn Banister commented that this is the first time there was no money for Reserves. She further explained the adjustments which were made resulting from the September 14th budget workshop, and with the aforementioned ajustments, we will have $19,000 available for consultant planning service. Mayor Christ commented that Administrator Morrison will be up for her six-month review on November 16th. Based on the outstanding job she has done in this position, Christ suggested a 10 percent increase in November and a 4 percent increase January 1, 1.989. Councilman Graves agreed with Mayor Christ on the Administrator's job performance, but based on the tight budget, he su ested a 10 percent increase overall. The Council decided to increasEONffl Budding category $2,2.00 in order to increase the City Administrator's salary.' The Council and Administrator felt liquor license fees ($1200 off -sale, $1.00 on -sale) were low and will consider raising this fee. The Budget will be reviewed for the final time at the October 4th City Council meeting. Mayor Christ closed the public hearing at 8:40 p.m. M/S/P Graves/Moe - to authorize the finance Director to increase the Building Permit category $2200 and to approve the City Administrator's salary of $36,000 effective January 1, 1989. (Motion carried 4--0). 7. CITY ENGINEER'S REPORT A. Final Payment, Water System Alarm & Control Waldorf Pump &.Equipment Larry Bohrer reported the work to replace the well pump control and to install an audible alarm and visual alarm system has been completed. He recommended that final payment be authorized for $5,264.00, to be taken out of the Water Fund, to Waldorf Pump and Equipment Company, Minneapolis, Minnesota. The new alarm system relies on a neighbor or other observer to witness the alarm and telephone the appropriate City personnel. The notification procedure has been mailed to the residents adjacent to the pumphouse and to the Washington County Sheriff's office. LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 20, 1988 PAGE 5 M/S/P Graves/Moe - resolved that the City Council hereby approves final payment, in the amount of $5,264.00, to Waldorf Pump and Equipment for the City's water system alarm and control. (Motion carried 4-0). B. Update: Washington County Landfill #1 Larry Bohrer reported that Mary Luth has directed her staff to review the conditions set at the meeting with MPCA for more frequent testing and aeriation systems for water purification prior to entrance downstream. She will come to the City Staff in October with a proposal. C. Fill. Permit: White Hat Restaurant Ed Gorman Ed Gorman, White Hat Restaurant, requested a renewal of his fill permit which was granted September 4, 1987 for an unstated amount of fill in order for him to proceed with his Phase 1 development. Gorman has already brought in 2,000 yards of clean fill. Larry Bohrer recalled when Mr. Gorman brought in his concept plan, Bohrer commented that the total development was likely too intense for that site because of the ponding and two drainfield sites that also had to be accommodated on that property. A site plan was provided for. Phase 1 showing the elevation needed (had to be brought up 6' to 8') and his architect felt. 20,000-30,000 yards of fill was needed in order to accomplish a green space and provide a driveway area where you can drive back into the property. This will be brought up for ease of his customers to be able to get into his new entrance. Gorman stated his septic systemm will be relocated and after the first of the year he will pursue his building permit. Larry Bohrer refered to the site plan that was provided which had a dimension of 250' x 250' x 8' high which would be 18,500 yards of fill and voiced his concern of too much fill being brought in. M/S/P Moe/Graves - to approve a fill permit for Ed Gorman, White Hat Restaurant for 20,000 cubic yards with further review again in the Spring; that granting this fill permit does not grant approval to add buildings on the site and to be assured of no rerouting of the drainage; all subject to review and approval by the City Engineer. (Motion carried 4-0). 8. Lake Elmo Water System Advisory Committee Report The Advisory Committee (Hugh Madson, Chair., Ben Friedrich, Fran Pott, Sue Dunn, Jim Beers and Don Mehsikomer) have been meeting this summer to review the present operation of the water system (financial structure, maintenace program, future requirements and report back to the Council with their 12 recommendations.) LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 20, 1988 PAGE 6 i Mr. Madson, who was unavailable for this Council meeting, but can appear at a later meeting, had submitted the recommendations from the Committee. M/S/P Moe/Graves - to table the Water System Advisory Committee Report until the October 4th City Council meeting. (Motion carried 4-0). 9. Striping of Streets Mayor Christ has talked to several of his neighbors and they do not want 36th Street striped because of its general local nature and due to the fact it is a dead-end street. Larry Bohrer stated the City adopted a policy for striping streets on August of 1987. The City will stripe center line stripes on all streets classified as collectors on the City's functional classification map and to provide center line striping on those local streets which due to some standard width or limited visabili.ty would benefit from such striping. Two calls have been received requesting that 42nd St., between Lake Jane Trail and Jamaca, not be striped. This (42nd Street) is classified as a collector street on our functional classification map. Therefore, Bohrer recommended we continue to follow our policy and r.estripe 42nd Street. Bohrer stated the was a reason for recommending 36th Street to striped was that there was a fairly steep hill by Arlyn's driveway and trees and bushes along the street could cause cars to swurve over the centerline. Also, the centerline stripe does aid the maintenance crew when they are snowplowing. The City Attorney was asked to comment on the City's liability if there is no striping. The Council decided no striping be done subject to a legal opinion stating there is no liability on behalf of the City for not striping on the local street and a petition is signed by 75% of the residents on 36th Street and 37th Street requesting their streets not be striped. If the legal opinion comes back that there is some kind of liability, these streets will be striped. M/S/P Moe/Graves - to adjourn the City Council meeting at 8:30 p.m. (Motion carried 4-0). Municipal Board: As indicated on the attached Memorandum, the Municipal Board will conduct its telephone conference call, relative to annexation of Lake Elmo parcels (Brochman & Fraser) to Oakdale on Friday, September 23, at 8:45 a.m. Although we will not have input into the process, I hope as many Councilmembers as possible can attend; Steve Carlson and I will be there. Striping of Streets: We have received two calls requesting that 42nd St., between Lake Jane Trail and Jamaca, not be striped. I am enclosing the City's last policy statement which is stil°1 in force, which the homeowners were advised of; if the Council determines the policy should be changed, please let us know. L.E. Regional Park Landfill Ballot: Enclosed is a copy of the Ballot, for expenditure of funds to .oppose the landfill, which was submitted today to the County for printing.
