LAKE ELMO SPECIAL CITY COUNCIL MEETING
SEPTEMBER 8, 1988
Mayor Arlyn Christ called the Special Council meeting to order at 7:01
p.m. in the City Council chambers. Present: Christ, Johnson,
Armstrong, Graves, Moe, City Engineer Bohrer and City Administrator
Morrison.
1. Agenda
M/S/P Graves/Moe - to approve the September 8, 1988 Special City
Council meeting agenda as presented. (Motion carried 5-0).
City Engineer Bohrer reviewed the 1988 MSA Improvements and the 1988
Bituminous Overlay Project. A cost summary on the overlay project and
individual assessment rates were presented.
2. PUBLIC HEARING: Assessment Hearing, 1988 MSA Project
47th Street, from Keats Avenue to Kimbro Avenue
Mayor Christ called the public hearing to order at 7:03 p.m. in the
City Council chambers.
Bob Johnson, 1.0323 47th St.N., commented he was happy with the road
but questioned the difference in price because he had received a
letter from Larry Bohrer which stated the assessment cost would be
less than $500 and now the assessment is over $1000. Larry Bohrer
responded that he was not aware of any letter that came from him
stating an assessment rate of $500. In July the cost was given at
$750-$1000/Lot.
Mayor Christ closed the public hearing at 7:10 p.m.
M/S/P Johnson/Graves -• to adopt Resolution No. 88-39 approving the
1988 MSA Improvements for 47th Street --Keats Avenue to Kimbro Avenue
at a cost per lot of $1.,106.47. (Motion carried 5-0).
2. PUBLIC HEARING: Assessment Hearing;
1988 Bituminous Overlay Project
A. HILLTOP
Mayor Arlyn Christ opened up the public hearing at 7:13 p.m, in the
City Council chambers,
Larry Bohrer reported that the assessment rate for this project went
down from $661.74/Lot to $553.03/Lot.
There was no one to speak against the Hilltop assessments.
M/S/P Johnson/Armstrong - to adopt Resolution 88-40 approving the 1988
Hilltop Avenue Bituminous Overlay Project assessment rate of
$553.03/Lot. (Motion carried 5-0).

B. 36th AND WEST 200' OF 37th STREET
Larry Bohrer reported the assessment rate for this project went down
from $766.67/lot to $603.00/Lot.
Mark Waldo, 8838 36th St. N., asked when this street improvement was
approved by the City Council. His interpretation of the 6--7-88
Council meeting was to receive input from residents if they were in
favor of the 1988 Bituminous Overlay Project. The Council would then
make a decision and send further notice to the residents.
Larry Bohrer read the motion, from the 6-7-88 City Council minutes,
where the Council approved the 1988 Bituminous Overlay Project for
36th and West 200' of 37th Street.
Gordon Johnson, 8804 37th St. N., felt that their road was damaged
because of the big pieces of equipment that went down their road in
order for the VBWD to work on their 509 Plan, and, because of road
restrictions, the equipment traveled at 3:30 a.m.. Johnson submitted a
letter to the City Administrator requesting the VBWD-pay-a-share-of --
the assessable cost, based on the damage their equipment did to the
road. He also questioned the reasoning for paving the last 200' of a
dead-end road.
Gordon Johnson and Mark Waldo, explained to the Council that there was
more standing water at the end of their driveways now than before the
road overlay because the road was not rolled flush. Waldo and Johnson
asked if the Maintenance Dept. would come out and add crushed rock
where the driveway meets the road.
Bohrer thought a satisfactory job was done on this street, but he will
go out and check the problem with the standing water.
Tim Zilles, 37406-2250, did not receive a notice because of a change
of address. (Tim Zilles, 8890 36th St.)
M/S/P Graves/Moe - to adopt Resolution 88-41 approving the assessment
rate of $603.00/lot for the 36th and West 200 feet of 37th Street 1988
Bituminous Overlay Project. (Motion carried 5-0).
C. LEGION AVENUE
There was no one to speak against the Legion Avenue Bituminous Overlay
Project.
Larry Bohrer stated the assessment rate for Legion Avenue went down
from $481.48/Lot to $405.39/I,ot.
M/S/P Moe/Johnson - to adopt Resolution 88-42 approving the assessment
rate of $405.39/lot for the Legion Avenue 1988 Bituminous Overlay
Project. (Motion carried 5-0).

D. TABLYN PARK 1st ADDITION
Larry Bohrer reported the assessment rate for Tablyn Park Addition
went down from $617.07/Lot to $483.88/Lot.
There was no one to speak against this overlay project.
M/S/P Armstrong/Johnson - to adopt Resolution No. 88-43 approving the
assessment rate of $483.88/Lot for the 1988 Tablyn Park 1st Addition
Bituminous Overlay Project. (Motion carried 5-0).
TABLYN PARK 2nd ADDITION
Larry Bohrer reported the assessment rate for Tablyn Park 2nd Addition
went down from $831.50/Lot to $690.67/Lot.
Gary Carlson, 8735 27th St. N., reported he did not receive an
assessment notice. Because he is concerned about the future of this
road, Carlson would like to see the road sealcoated every 3 years
rather than 5-6 years which, in his opinion, is far too long to wait.
Being that Gary has lived in Tablyn Park 1st Addition (22' wide road)
and 2nd Addition (32' wide road), he was asked which road width he
preferred; his response was the narrower street (22' wide).
Terry Arends, 8815 27th St. N., asked the engineer to check the
manhole cover at the first intersection on the SW corner. Bohrer
responded that the contractor knows he must repair this.
M/S/P Graves/Moe - to adopt Resolution 88-44 approving the assessment
rate of. $690.67/Lot for the Tablyn Park 2nd Addition Bituminous
Overlay Project. (Motion carried 5-0).
Mayor Christ closed the public hearing at 8:08 p.m.

Enclosed, for your review, is a draft of the RE Ordinance, resulting from
the August 4th Committee meeting. Please note that I have redrafted the
format of Section C.3)(a)&(b); I believe I have incorporated the intent of
the Committee. This was arrived at after discussion with Larry Bohrer. I
have also included provisions for submission of a Grading Plan and Erosion
Control Plan (both subject to your review).
The Planning Commission, at their workshop meeting of July 25th, discussed
this Ordinance; a copy of those minutes is enclosed.
---For Your Consideration --
I would like to propose that, at our September 8th meeting, we concentrate
on:
(1) areas in the City eligible for coverage of the RE floating zone,
together with a defensible statement of the ratonale for this
coverage;
(2) an appropriate and legal method for limiting RE development on

301.070D.(3) R.E.-RESIDENTIAL ESTATES (One Family Residential)
A. Permitted Uses and Structures:
1) One (1) family detached dwellings
B. Accessory Uses and Structures:
1) Uses and structures which are customarily accessory
and clearly incidental and subordinate to permitted
uses and structures, as set forth in Section 301.130.
2) Garages, carports, screenhouses, conservatories,
playhouses, swimming pools, tennis courts, hobby
shops and storage buildings as allowed by code,
for private use only.
C. Zoning District Requirements:
1) Lot size:
(a) Five (5) acre nominal (ten percent (10%)
allowance for roads) minimum per unit.
(b) Two and one-half (2-1/2) acre (108,900
square feet) minimum per unit for subdivisions
of twenty (20) acres or more.
2) Configuration:
(a) Five (5) acre lots must be able to contain a
full circle having a diameter of at least
