RESOLUTION
CITY OF LAKE; ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO
RICHARD BERGMAN, BERRY FARM GREENHOUSE, FOR
GREENHOUSE AND SALES LOT FROM JANUARY 1, 19811 TO
DECEMBER 31, 1.984.
WHEREAS, Richard Bergman has applied for a Conditional
Use Permit for a Greenhouse and Sales Lot on the S 534.9 ft. of
the N 925.9 ft. for the W 1/2 of the NW 1/4 of Sec. 1, T29, R21W,
at 5833 Lake Elmo Avenue N. in the City of Lake Elmo, from
January 1, 1984 through December 31, 1984; and has submitted all
required information and fees for the application for such
permit; and,
WHEREAS, Section 301.0'70 D.l.b.(1) and (5) of the
Municipal Code of Lake Elmo requires a Conditional Use Permit to
operate a Greenhouse and Sales Lot in the City of Lake Elmo; and,
WHEREAS, Section 301.130 C. D. E. F. and G. of the
Municipal Code of Lake Elmo sets forth the conditions under which
j said permit may be granted and such use permitted; and,
WHEREAS, the applicant meets or exceeds all the
conditions set forth above;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Lake Elmo,
THAT, the Conditional Use Permit for a Greenhouse and Sales
Lot at 5833 Lake Elmo Avenue N. is hereby granted to Richard Bergman
from January 1, 1984 through December 31, 19811.
This Conditional Use Permit may be rescinded after a two week notice and
public hearing,.if the City Council. :finds that the public health, safety
or welfare is. jeopardized.
ADOPTED, -this the 3rd day of January, 1.984, by the City Council.

LANDFILL,LERP:
1) Donahue and Assoc. has informed us that starting January
3rd they will start drilling for the monitoring wells at
the Regional Park (between 32-34 wells around the perimeter
of the site). They anticipate drilling to go on for up to
two months. The wells will remain in place for up to two
years (unless the landfill becomes a reality, in which case
the wells will remain on site as long as the landfill exists)
They, of course, will need to get the various Agencies
approval before the wells are taken out.
Donahue will also be conducting soil borings starting in
January.
2) The Request for Qualifications was prepared, and a draft sent
to you as well as ReApp. ReApp had,some recommended changes,
which will be incorporated into the RFQ. I have on file the
list of engineering firms submitted by Dayton and Washington
County. As soon as we receive the list of suggested firms
from ReApp, the RFQ will be mailed.
DOWN'S LAKE STUDY:
The consideration of the VBWD's Downs Lake Study will be on the
Council's Februar;7 7th Agenda. Mr. Dornfeld had suggested this
date to allow for review of applicability of their floodproofing
program to two affected homes in this area,
The updated Report was forwarded to you earlier; if you should
have any questions about it, please don't hesitate to call Larry
Bohrer(who is currently reviewing it), or Al Dornfeld directly.
It is my understanding, from residents at the VBWD Hearing, that
they are not satisfied that the Study addresses the alleged problem.
Although I was not here at the time, it is my understanding that
the proposed subdivision of Packard Park Third Addition.was
continued until such time as this Study was done. Therefore,
dependent upon Council action on the 7th, we should determine if
it's appropriate to start processing this matter again.

RINK ATTENDANTS: Three rink attendants have been hired: Matt Eder,
Mark Hoisington and Joe Gardner. As you know, rink hours are:
Holidays and Week -ends: 10:00 a.m. - 9:00 p.m.
Week -days: 4:00 p.m. - 9:00 p.m.
Dan Olinger and Mary Kueffner reviewed responsibilities and
scheduling with the three gentlemen; they are under the direct
supervision of Dan. If you hear of any problems/concerns with
these temporary employees, please let us know; however, we
believe they will do a good job.
