Present: Dunn, Hunt, Williams, Graves, Moe, City Engineer Bohrer and Deputy Clerk Kueffner. I. Agenda Add: 6D. Discussion of Comprehensive Plan, IOC. State Municipal Board M/S/P Willimas/Moe - to approve the March 21,1989 City Council agenda as amended. (Motion carried 5-0). 2. Minutes: January 17, 1989 M/S/P Hunt/Graves - to approve the January 17, 1989 City Council minutes as amended. (Motion carried 5-0). Minutes: February 21, 1989 M/S/P Graves/Moe - to approve the February 21, 1989 City Council minutes as amended. (Motion carried 5-0). Minutes: March 7, 1989 M/S/P Williams/Graves - to reconsider the Gilbert Sullwold motion for a Large Lot Subdivision and Rezoning under discussion. (Motion carried 5-0). M/S/P Williams/Hunt-to direct the City Staff to prepare a resolution granting a large lot subdivision as proposed by Gilbert Sullwold, legal description on file in the office of the City Clerk, contingent upon applicant's compliance with the recommendation of. the City Engineer in his memo of February 27, 1989; and contingent upon applicant paying a park dedication fee of $450 for the newly created lot; and contingent upon this newly created parcel remaining in AG Preserves until such time as the entire 100 +/- acres is taken out of AG Preserves; and contingent upon applicant understanding that no other subdivision will be allowed on this property based on the "one house per forty acres" provision of the AG Preserve Act. (Motion carried 5-0). M/S/P Williams/Hunt - relative to the large lot subdivision granted to Gilbert Sullwold, to direct the City Staff to prepare an ordinance amending the Lake Elmo Municipal Code rezoning the newly created 10+ acre parcel from Agricultural to Rural Residential; contingent upon this parcel remaining in AG Preserves. (Motion carried 5-0). M/S/P Graves/Moe - to approve the March 7, 1.989 City Council minutes as amended. (See amended motion for Gilbert Sullwold). Motion carried 5-0). 3. Claims LAKE ELMO CITY COUNCIL MINUTES MARCH 21, 1989 PAGE 2 I M/S/P Moe/Aunt - to approve the March 21, 1989 Claims #91538 thru #91584 as presented. (Motion carried 5-0). 4. REAPP REPORT Todd Williams reported they have received three proposals from engineers for review of the Lake Elmo Landfill EIS. A ReAPP Subcommittee is reviewing these proposals and scheduling interviews with these engineers for March 31, 1989. The following questions were asked by ReAPP: (a.) Does the City Council want the City Engineer to review the proposals? City Engineer, Larry Bohrer, responded he would not review the proposal, but their Environmental Engineering Dept would allow 1 hour for each review, and supply a recommendation to the Council. MIS Hunt/Graves - to direct the City Engineer to review the proposals submitted for review of the Lake Elmo Landfill EIS M/S/P Williams/Hunt - to amend the motion to include setting a limit of $400. (Motion carried 5-0). M/S/P Hunt/Graves - to authorize the Environmental Engineering Dept. of TKDA review the three proposals submitted for review of the Lake Elmo Landfill EIS with a limit: set of $400. (Motion carried 5-0). (b.) Attorney Chuck Dayton has indicated interest in reviewing the proposals and being involved in the interviewing process, for. which Ellen Sampson has expressed a cost of $1,2.00 +/-$200. M/S/ Williams/Hunt - To authorize Attorney Chuck Dayton review the three engineers' proposals and participate in the interviews M/S/P - Williams/Hunt - to amend the motion to include setting the expenditure of $1200. (Motion carried 5-0). (c.) Todd Williams requested approval of the appointment of himself as the key contact between the City and the attorney and engineer in matters pertaining to the landfill. Administrator Morrison will continue to be the key contact between the City and the County. M/S/P Williams/Graves - to approve the appointment of Todd Williams as the key contact between the City and the attorney and engineer in matters pertaining to the landfill. ReAPP requests Attorney Dayton examine the wording of the proposal for a "scorecard" to be applied to the landfill siting decisions and LAKE ELMO CITY COUNCIL MINUTES MARCH 21, 1.989 PAGE 3 advise them of the most effective wording. ReAPP felt that Attorney Dayton could spend 2 hours reviewing the initial concept of the scorecard. M/S/P Williams/Gra.ves - to authorize up to two hours of Attorney Dayton's time to review and advise ReAPP concerning the wording in the proposal for a "scorecard". (Motion carried 5-0). 5. NPDES PERMIT: Washington County Landfill #1 Councilman Graves, Dick Johnson, Attorney Carlson, City Engineer Bohrer and Administrator Morrison met with representatives of Washington and Ramsey Counties on March 16 to discuss this Permit and some of the concerns of the Council and residents of the community. An amended agreement was being prepared by Washington County Attorney's office after this meeting which will. provide for: a) improved frequencey of testing; b) annual review and comment by the City of Lake Elmo at the time of Permit renewal with MPCA; c) inclusion of testing for chemical compounds to drinking water standards at the point where water enters the open air of the stream (Hwy 5). A Resolution, was provided for Council review, approving the agreement between Washington and Ramsey Counties and the City relative to the NPDES Permit for Washington Cty Sanitary Landfill No. 1. was prepared by Steve Carlson, Larry Bohrer and the City Administrator. Mary Luth and Paul Josephson, of Wash. Cty Public Health, gave some background on how the Counties have been ordered by the MPCA to operate gradient control wells under the NPDES Permit and to comply with said order the Counties deem it necessary to discharge treated water from Gradient Control. Well No. 1 into the drainage system of the VBWD and, in order to do so, a drainage pipe needs to be constructed under Jamaca Avenue into a manhole that is used by VBWD. There is a treatment system in the manhole, and if chemicals are present, they will be volatilized and discharged into the VBWD system. The City received a letter from Tablyn Park resident, Rita Conlin, 8560 Ironwood Trail N, opposing this plan because it would pose a health hazard to their children, other park users and wildlife. Conlin stated the flowage of water would run directly into a stream that runs through Tablyn Park. Their children play in this stream, as well as fish in it and eat the fish they catch. it adjoins a picnic area and tennis courts and eventually flows into Eagle Point Lake which is in the Lake Elmo Regional Park Reserve. Mark Busta, 8810 27th St. N., voiced the following concerns of the Tablyn Park residents: a. Request that the County have the wells tested at the County's expense for outside of the Well Advisory Area before the pipe is turned on. (approx. 60 homes; 20 homes adjacent to stream bed). LAKE ELMO CITY COUNCIL MINUTES MARCH 21, 1989 PAGE 4 b. The propertyowners would like a list of contaminants in the water as compared to drinking water. (The County responded this list can be provided by the City). c. Frequency of Water Tested: April 15 - October 15 water tested weekly. Tested monthly in the interim. Assurance if any one contaminant is over the level, the valve will be immediately turned. off. Mayor Dunn asked the County, "who turns off the discharge if a red flag should occur?" The County responded that they would shut off the valve in the manhole. If a 100 year storm should occur, VBWD can turn the valve off. Linda Hardy spoke up that she has the last driveway before the lake and the culvert under her driveway freezes up in the winter. The VBWD has pumped their water and she has had water problems. She asked what assurance would she have of this water not getting into the driveway. Margaret Carlson, 8735 27th St., has asked the Clean Water Action group to respond to the list• of contaminants within two weeks and asked for a delay on the decision until their comments are received. Councilman Williams handed out changes for Council consideration to the resolution submitted by the City Attorney. M/S/P Graves/Moe - to postpone consideration of the wording in the Resolution approving the NPDES Permit, in order to hold a meeting to address these concerns with the Counties, City staff, and representatives from the Tablyn Park and the Well Advisory Areas, with their conditions available for the April 4th City Council meeting. (Motion carried 5-0). M/S/P Williams/Hunt -- to request a written opinion from the City Attorney, to be included in the Council packet, on whether the County has the option of condemnation. (Motion carried 5-0). 6. PLANNING/LAND USE/ZONING: A. PRELIMINARY PLAT: KENRIDGE HEIGHTS APPLICANT: ARLYN CHR:IST M/S//P Graves/Hunt - to bring back for consideration the Preliminary Plat for Kenridge Heights. (Motion carried 5-0). At the last Council meeting the City Engineer was directed to investigate the newly constructed wells in the area and determine if safe drinking water is available. In Larry Bohrer's letter, dated March 17, 1989, based on test results, the MN Health Dept, felt that the Prairie du Chien aquifer outside of the landfill boundary is safe for residential wells. Bohrer further stated, that since the Well Advisory eXcludes that portion of Kenridge Heights within the NSP easement and since a well would be allowed in that easement, Bohrer recommends that wells constructed in the NSP easement with Kenridge Heights also be required to be constructed to Well Advisory LAKE ELMO CITY COUNCIL MINUTES MARCH 21, 1989 PAGE 5 standards. In the same letter, Bohrer explains that the current R-1 zoning only extends to the northern line of the NSP easement, not the southern line of the easement as assumed by the developer. This means the south 125' of the preliminary plat is not properly zoned for inclusion in the plat. To keep the plat configuration as proposed, the developer will have to seek a rezoning from RR to Rl for the NSP easement area. Chuck Plowe, Peterson & Assoc., submitted a new preliminary plat showing a curved street. Bohrer noted that this curved road reduces the lot size of Lot 1, Block 1 and reduces the land suitable for septic systems to less than one acre. In his letter, dated March 20, 1989, the City Attorney had concluded that the City's potential liability for preliminary plat approval, within the well advisory area, is diminutive at most and that greater danger to the City was if the preliminary plat was being denied on the basis of the plat's being within the Well Advisory area. His conclusions are listed in this letter. Councilman Moe wanted to deal with the plat before him that included a longer cul-de-sac than our code provides, a variance to the required 32' road width before he considers a rezoning application that would not be consistent with the comprehensive plan. Councilman Graves was not in favor of the rezoning because it is not consistent with the Comprehensive Plan and this has been the basis on which other plats had been turned down. He also has concerns of the Health, Safety and Welfare of the people if the landfill has not reached a stable state and will not get worse in the future. Councilman Williams would approve the Rl plat with the proper street width and would allow the cul-de-•sac because there will be development to the West. He was not in favor of the rezoning based on the Comprehensive Plan. Councilman Hunt explained how he strives to be consistent with the Comp Plan and has turned down two plats based on this. The plat is not zoned properly at this time and he would not be in favor of a rezoning at this time. Mayol^Dunn stated consideration for rezoning would be in conflict with the Comp Plan as amended by Resolution 83-56, dated September 6, 1.983. M/S/P Graves/Moe - to deny preliminary plat approval of Kenridge Heights based on: the length of the cul-de-sac is .longer than what the code allows which is 800 ft., the street width would require a variance to the required 32' road width, and consideration would not be given to rezone the portion of the plat that was shown to extend into RR zoning district based on such rezoning being in conflict with the 1979 Comprehensive Plan f--1 as amended by Resolution 83-56, dated September 6, 1983. (Motion carried 5-0) Councilman Williams explained, if the NSP easement problem was not there, LAKE ELMO CITY COUNCIL MINUTES MARCH 21, 1989 PAGE 6 he would vote for approval of the preliminary plat with a 32' street width. Councilman Hunt stated, to rezone this easement to Rl now, would only weaken our Comp Plan for any other proposal that comes before us. B. REZONING RR TO PF: APOSTOLIC BIBLE CHURCH Jeff Roos from the Apostolic Bible Church, was requesting a rezoning of 14 acres of land, on loth Street east of County Road 13A, from Rural Residential to public facility. Councilman Williams felt this was a non-residential use and was not consistent with the City's comprehensive plan. This area should be restricted for residential use and felt the people that live there now were most important. Pastor Robert Sabin responded that he had never heard anybody say that a church is not consistent with rural land or with residential land. They want to serve the community and help people who have needs. Councilmen Moe and Graves had no problem with the plan and felt it was proper utilization of the land. An example given was the Lake Elmo Baptist Church sits on PF land with land adjacent currently zoned RR. M/S/ Graves/Moe - to approve the rezoning request by Apostolic Bible Church of 14 acres from Rural Residential to Public Facility in order for a church to be built; M/S/F Williams/Hunt - to amend this motion to include "but the City Council discourages further non-residential uses on 15th St. South of loth and East of County Road 13 and County Road 19". (Motion failed 2-3: Graves, Moe, Dunn: They felt this was an attractive proposal and a church is consistent with the RR land use. Examples given were the Baptist Church and the Guardian Angels Church which are surrounded by homes). M/S/F Graves/Moe - to approve the rezoning request of 14 acres (Legal description provided) from Rural Residential to Public facility by Apostolic Bible Church in order for a church to be built. (Motion failed 3-2: Williams, this will be the third non --residential use (Linder Greenhouse, NWBell bldg.) in a quarter section and worries about what future non-residential uses would follow, Hunt: agreed with Todd and asked for better .lay out criteria in our comp plan to prevent this from happening). Because rezoning requiree a 4/5ths vote by the Council, this motion failed. Councilman Graves asked Councilman Williams if he would change his vote for approval if his amendment provision was included in the motion. Therefore the following motion was made: M/S/P Grave/Moe - to bring back for Council consideration the above motion which includes the amendment provision. (Motion carried 5-0). M/S/P Graves/Moe - to approve the rezoning request of 14 acres (legal description provided) from Rural Residential to Public. ORDINANCE: NO. 8022: Impervious Surface Standards General Business District The Planning Commission, at their March 13, 1.989 meeting, recommended approval by the City Council of Ordinance 8022 amending Ordinance 8088 relating to impervious surface in the General Business District. c.(5) Maximum area to be covered by buildings, parking lots, driveways and other hard surfaces: Lot Size Covered Area Up to 4 acres 45 of lot size Larger than 4 to 8 acres 35% of lot size Larger than 8 acres 25% of lot size M/S/P Graves/Moe - resolved that the City Council hereby approves Ordinance No. 8022, amending Section 301.070 D.C(5) of the 1979 Municipal Code, Relating to Impervious Surface Standards in the General Business Zoning District. (Motion carried 5-0). M/S/P Williams/Graves - to direct the to work on landscaping/architectural District and submit a recommendation (Motion carried 5-0). D. COMPREHENSIVE PLAN Planning Commission and City Staff standards in the General Business to the City Council by July 1, 1989. Councilman Williams provided proposed options for Council direction to the Planning Commission in regard to the Comprehensive Plan. Councilman Hunt preferred Option #3: wait until Residential Estates zoning was done. Include RE and any new R-1. in a new future land use map in a revised Plan, but he did not want this work to slow down the update of the Comp Plan. M/S/P Williams/Graves - to direct the Planning Commission to take the 1986, Plan, rearrange it to the proper format, making changes only to the extent necessary to have it flow together., add appendices, and adopt current zoning map as future land use map. Once this plan is adopted, the PZ to take as top priority revision of the future land use map and plan to include where appropriate residential densities greater than 1 house per 10 acres. (Motion carried 5-0). Dick Johnson, Comp Plan Subcommittee Chair, stated the Council will receive the first draft of the Comp Plan at their April 4th Council meeting. M/S/P Graves/Williams - to set a joint meeting, for a duration of not longer than 1 hour, for April. loth between the Council and Planning Commission to discuss the draft Comp Plan. REQUEST FOR APPROVAL BUILDING MAINTENANCE REPAIR FIRE CHIEF FRAN POTT Fire Chief Fran Pott requested authorization to proceed with the following building maintenance repair items: Station #1 : $1,200 Replacement of Windows 4,800 Partial Reroofing 700 Separation Wall for office area Station 02: $3,000 Floor for Station 2 Finance Director Marilyn Banister reported the reroofing will be taken out of the the Capital Reserve for the Fire Dept. and payment of the other maintenance items are within budget. M/S/P Graves/Moe - resolved that the Council hereby approves authorization for the Fire Chief to proceed with maintenance repair as outlined in his Memorandum of March 16, 1989. (Motion carried 5-0). 8. REQUST FOR CHANGE TO SNOWMOBILE TRAIL RON SMITH Mr. Smith did not appear before the Council to discuss the problems he has experienced with snowmobile damage to his property. He did request relocation of the trail so as not to have the problems continue. Administrator Morrison has talked to Steve Pott, Wash. County Sheriff Deputy, and he suggested working with the Wash. Cty Star Trail Association for better marking of the trail in hopes this would eliminate the problem being experienced by Mr. Smith. The Council recommended that the Administrator, Deputy Steve Pott and Ron Smith meet with representatives of the Star Trail Assn. to remedy this concern. 9. CITY ENGINEER'S REPORT: A. CITY WELL MAINTENANCE REPORT Larry Bohrer reported the City's Municipal Well Pump is removed periodically for inspection and maintenance. The last pump maintenance was performed in 1982 and the next scheduled maintenance is in 1989. The schedule called for the work to be done Monday, March 20, 1989 during which time the well pump was removed and the water system continued to operate from the Municipal water tank. Due to the extent of wear on the old pump, a new pump was installed, with the old pump being retained as an emergency backup. Also, when maintenance is done again, the old pump will be used to continue water service, allowing the maintenance to be done properly during regular working hours. When the final bill comes in, Bohrer will have a complete written report for the Council at the next meeting. 10. CITY ADMINISTRATOR'S REPORT: LAKE ELMO CITY COUNCIL MINUTES MARCH 21, 1989 PAGE 9 A. SECTION 32: TIMETABLE & PRESS RELEASE Administrator Morrison and Councilman Williams each provided a draft press release for Council review. In the draft action plan provided by the City Administrator, the Council added a checkpoint before April 18th after they have met with the Section 32 propertyowners or developers the week of April. 3rd. At this time the Subcommittee, comprised of Councilmen Hunt, Graves, Administrator. Morrison and PZ Chair Enes will evaluate any progress and come back with good recommendations to the Council. Councilmen Hunt and Williams wanted to set a limit, days or money, ahead of time for professional services provided by the City Engineer and Planner. M/S/P Graves/Hunt - to preauthorize expenditures of funds, (up to one day each for the City Engineer and City Planner as determined by Councilmen Hunt & Graves) in. support of initiating developmentrelated activities based on interaction with the Section 32 propertyowners and developers and. the Subcommittee. (Motion carried 5--0). B. DENTAL INSURANCE COVERAGE The employees have requested LMC dental insurance coverage under the provision outlined in the Administrator's memo of March 14, 1989. M/S/P Graves/Moe - resolved that the Council, hereby approves LMC dental insurance coverage for employees of the City of Lake Elmo, under the provision outlined in the Administrator's memo of March 14, 1.989. (Motion carried 5-0). C. STATE MUNICIPAL BOARD It was noted the City received a letter, dated March 16, 1989, from the Municipal Board indicating they received a (second) petition from the Section 32 propertyowners for detachment/annexation. M/S/P Williams/Hunt - to direct the City Attorney to prepare a resolution to the State Municipal Board strenuously objecting to the detachment/annexation to Oakdale. (Motion carried 5-0). 1.1. Landfill: The cut-off for receipt of the RFP for engineering was Marc t . We received 3 proposals, which have been forwarded onto ReAPP for review and recommendation to Council, The Council may want to consider review by Larry Bohrer and/or the Dayton law firm as well. Section 32 Petition: The Oakdale City Council meeting of 2/14, at which they were to consider the petition for annexation of Section 32, was cancelled due to weather. They will now be considering the petition and Planner's recommendation at a meeting on Tuesday, March'21, at 7:00 p.m. As this is also the date of our Council meeting, perhaps the Council may wish to request that the Planning Commission Chair., Rob Enes (and other members of the PZ) be present at the Oakdale meeting. The Oakdale City Adm. has assured me that any letter(s) from the City will be placed in the record. I have requested a copy of the Planner's report and recommendation, as well as a copy of the petition. U.S. Olympic Event: The Parks Committee had a good deal of enthusiasm r this event. Nancy Hansen (Chair.) is forming a sub -committee to analyze details. At the suggestion of Mike Bouthilet (from our Parks Dept,), he and Nancy took time to go around to each homeowner, having frontage on the Lake, to inform them of this event and answer questions they may have.
