I have had an opportunity to review those minutes together with the minutes from the September 20, 1988 meeting in which the Council granted a fill permit to Mr. Gorman for 20,000 cubic yards of fill on the property of the White Hat Restaurant. It appears from the minutes of September 20, 1988 that Mr. Gorman was requesting a renewal of his fill permit which was originally granted on September 4, 1987 for an "unstated" amount of fill in order for him to proceed with his Phase I Development. It also appears from those minutes that Mr. Gorman's architect had felt 20,000 to 30,000 yards of fill was needed in order to accomplish this result. It also appears from those minutes that Mr. Bohrer, the City Engineer, had some concern about too much fill being brought in to that location. Notwithstanding Mr. Bohrer's concern, the Council granted a fill permit for Mr. Gorman for the White Hat Restaurant for 20,000 cubic yards with further review again in the spring. It further provides that the granting of the fill permit does not grant approval to add buildings on this site and it was to be assured that no rerouting of the drainage would occur. It appears from the minutes, however, that the granting of the permit, nevertheless, was subject to the review and approval by the City Engineer. The issue of Mr. Gorman's fill permit was apparently placed on the agenda of the April 18, 1989 meeting as a result of the Council and staff having received inquiries on the status of the fill pile south of the White Hat Restaurant. The minutes from that meeting clearly provide that Mr. Bohrer said the fill was not blocking the drainage, which was specifically a condition of the permit as issued from the meeting on September 20, 1988. Mr. Bohrer further went on to say, however, that he felt that if the full 20,000 cubic yards were brought in, there would be much greater likelihood of interference with the drainage, dirt and dust uses, and erosion. It was his opinion, Pat Morrison May 9, 1989 Page 2 according to the minutes, that until such time a site plan and building appli- cation were coordinated in conjunction with the filling permit, that the City should suspend the fill operations. Based on those statements, the Council directed the City staff and attorney to notify Mr. Gorman that fill operations would be suspended until the site plan had been considered and approved by the Council. Ultimately, the question of whether or not the Council was reasonable in suspending these operations will hinge on how the proviso from the September 20, 1988 motion that it all be subject to review on approval by the City Engineer is interpreted. Clearly, Mr. Gorman was granted a permit for 20,000 cubic yards and the only actual limitation was that there be no rerouting of the drainage. There does not appear to be any connection between the initial 20,000 yards that was granted and the site plan or building permit. Clearly, from the minutes of the September 20, 1988, the only relationship between the site plan and the fill permit was review with regard to whether or not the additional 10,000 yards would be permitted in the spring of 1989. Therefore, the suspension of the fill operations on the basis that there is no site plan would be deemed to be arbitrary and capricious. Notwithstanding,Af Mr. Gorman was given notice that even the initial 20,000 yards was subject to review and approval by the City Engineer, the fact that the engineer has now expressed concern over those initial 20,000 yards and that there is a factual finding by the Council as to what, specifically, those concerns are, there is sufficient basis for suspension of the permit until it can be determined what, in fact the likelihood of interference with drainage is, whether or not there is, in fact, a danger from dirt and windblown dust, and if in fact there is a slight hazard created. All of these factors must be viewed in light of the Council's police power and its charge to protect the heath,thelfactsthatytherewisfaneof its "unattractiveens. itnuisance's'hshouldenottenterointorthat and the Council's consideration. In conclusion it is appropriate to request a site plan here for Mr. Gorman how the fill is to be utilized. However, to suspend the fill operation and the initial 20,000 cubic yards solely on the basis of the site plan not having been filed, the Council is in substantial danger of having its actions being found arbitrary and capricious and, therefore, liable to Mr. Gorman for dama- ges he sustains as a result of that action. However, if Mr. Gorman knew or Pat Morrison May 9, 1989 Page 3 reasonably should have known that the original 20,000 yards was subject to review and approval by the City Engineer, and that the City Engineer has now had an opportunity to review these conditions, and there is sufficient evi— dence to support the City Engineer's concerns, Mr. Gorman can not now be heard to complain. DATE: May 11, 1989 RE: MUSA Area - Section 32 and part of Section 33. On April 10, 1989, a meeting was held at the Lake Elmo City Hall to discuss and plan appropriate actions needed to be taken by the City in order to assist the land owners within the MUSA line in facilitating development activities. Those in attendance were Council member Chuck Graves, Council member Lee Hunt, Planning Commission Chairman Rob Enes, Larry Bohrer of TKDA and myself. Two assignments were given to James R. Hill, Inc. at this meeting. The first was to interview property owners in Section 32 in order to get their opinion of what action should be taken by them or the City to accommodate development. The second was to review the Land Use Concept Plan for the MUSA area and recommend changes if appropriate. On Friday, April 21, 1989, and during the week of April 24, 1989, I interviewed five property owners or representatives in Section 32 and 33. (See also attached ownership map.) They included: Bob and Loj s Dreher. Mr. and Mrs. Dreher live in Lake Elmo at 7515 North 10th Street. They currently own land south of 10th Street on the east and west side of Helmo Avenue North. Kit Richardson. Mr. Richardson is a real estate broker with Griffin Real Estates Company. He offered comments on behalf of Mr. Clarence Enright who owns approximately 160 acres in the MUSA area. Doug DeCoster. Mr. DeCoster owns approximately 55 acres within the MUSA area. He also owns the properties adjacent to or near the MUSA line. Dan Dolan. Mr. Dolan is a real estate broker who has represented the sale of properties owned by R. Fraser, H. Brockman, and L. Kirvida. David Johnson. The answer are given in no particular order. 1. What problems have you had and why has your property not been developed? * There has been strong interest but without sanitary sewer and municipal water and with this annexation issue - no one is willing to wait for a plan for development by Lake Elmo. The location is prime and ready, but people do not want to wait. * We cannot sell property without sewer and water. There is not enough time to get municipal water and keep the potential interested parties. No one is willing to wait. * The perception in the market is that Lake Elmo is anti - development and that is reality since people were elected on "anti -development" campaigns. * The City's attitude towards development and the lack of cooperation for financial help. * Obviously the need for sewer and water. It is no secret Lake Elmo's attitude towards development. Persons interested in development do not want to get involved. 2. How can the City of Lake Elmo assist the property owners in Section 32 in developing the land. * I don't think they can. No confidence that they could help and no credibility. The City is not set up to consider, review, approve and service urban development. Lake Elmo should agree to the annexation of all MUSA property to Oakdale and negotiate the best deal possible. * Lake Elmo needs to work more cooperatively with the land owners. The major concern is that the majority of the City Council will not support development activity and a cooperative financing plan. * The City has to change it's attitude. They should hire professional help and show a real commitment toward progress. * Get sewer and water in or at least to a point where it can be easily extended. * Allowing the annexation to Oakdale is the best way to see the land be developed. 2 James R. Hill, inc. 3. Is your property for sale and what price are you asking? * Yes, $25,000/acre. * Yes, very soft market without sanitary sewer and municipal water. * Yes, land price is negotiable. Freeway frontage is approximately $40,000/acre. * Yes, varies depending on land use and offer. * Yes, as a whole or portions. 4. What are your intentions or thoughts for the type of development on your land? * The property is highly visible and is a vocal point location. A corporate headquarters with an employment base. * Office showroom - more industrial employment and less retail. Housing to the northeast. * Commercial west of Helmo and residential east of Helmo Avenue. Maybe commercial east of Helmo. * Mixed uses - PUD - City should be flexible. * Highway business near County Road 13. 5. What is your schedule and do you have any buyers or interested parties now? * Would like to sell as soon as possible but no interest because of no sewer and water. * Immediately and yes. * To move forward for annexation. Yes, people are interested but not in working with the City of Lake Elmo. * As soon as possible and yes, with qualifications. Buyers are not interested if the land remains in Lake Elmo because they do not have a development plan. * Yes, some interest in office showroom. 6. What do you believe is a reasonable absorption rate for the area? 3 Jdf r 1e5 K. r111I, Ir1C. * Difficult to answer, there has been some interest for office and multiple family residential but conditions must change. * It may take 30 years to develop all the properties in the MUSA area. * If attitudes changed to become market competitive, a lot could happen. But things will not change hence nothing will happen. * With existing circumstances, 20 years or beyond before completely developed. * Ten to twenty acres a year. However, if things changed, it could happen very quick. 7. What do you believe is your time frame for selling your land? * The property near County Road 13 would move very quickly but nothing will happen without a plan for installing sewer and water. * Land is for sale now but is not encouraging. * Whenever - maybe the next five years. * Would like to sell immediately. * If land is annexed to Oakdale, an option may occur in 1989. 8. Have your reviewed the Feasibility Report prepared by TKDA for serving the area with sanitary sewer, storm sewer and municipal water? And, are you aware of the estimated related costs? * Yes, Yes. * Yes, yes and not unreasonable cost but difficult to take on debt without a buyer or user. * Yes, but not interested in doing it because of the cost of the water system. Yes, assessments are substantial without a financing plan. * Yes, yes and we have tried to ask the City for a financing plan to do the work. E! Jdf l 1e5 K. F111I1 111C.;. * Yes, yes, but it makes no sense not to use water from Oakdale. The proposal is not the most economical way to extend water to the area. 9. Have you considered petitioning for improvements or any other financing options? * No, because hope has been given up in working with Lake Elmo. Attention is focusing on working a financing plan with Oakdale. * We have tried to ask Lake Elmo for a financing plan. Property owners are concerned that the City Council will not accept any plan or agreement other than 100o payment by the land owners. * Yes, would be interested in petitioning for improvements but land owners must get off of green acres. It is desirable to use tax increment financing or deferred assessments. * No, because land owners are sellers not land developers. We are already paying area assessments without any benefit. * Why bother - the City has stated that 1000 of the cost will go back to the property owners. If you have a development waiting - okay, but what about land owners who do not. Tax increment financing should be used. We are not looking for personal advantage but if you want something you must be competitive. 10. Are you aware of the City's Land Use Plan designations for the area and do you agree with it? Do you suggest any changes and/or modifications? * Yes, in fact property owners in the area help prepare the plan. No, but the City should be flexible - it is only a guide. * Yes. Yes, office showroom and employment base near the freeway and retail near loth Street. It is possible for the whole area to be developed as an office park. plan should not be cast in stone. * Yes, would suggest retail near loth Street and Helmo Avenue. * Yes, maybe expand commercial north of 4th Street. 5 Jdl t ICS N. Would you be interested in meeting with the City Council at which time we could consider: various development scenarios, phasing plans for public improvements and options for financing of public improvements? * Yes, but not optimist - the annexation should be approved in June. Lake Elmo City Council cannot agree among themselves and that where it has to all begin. * Always interested in hearing and listening. Something has to change and so property owners are committed to the annexation process. Concern that the Lake Elmo City Council does not have enough votes to change. People were elected to the City Council on a no -development platform. * A petition for annexation into Oakdale has been signed and progress is being made - no desire to look back. If the City has something, put it in writing and we will consider it. * Cannot be optimistic - it is hopeless - the Lake Elmo City Council cannot agree among themselves. Property owners have invested time and money to the annexation process. Progress will be made without help of Lake Elmo. If the City has new information, mail it and it will be look at. 12. What specific actions do you expect the City to take which you believe would help with your long range plans for your property? * Negotiate the best deal possible with the City of Oakdale and do not object to the annexation. The land should go to Oakdale. Section 32 can then be developed and Lake Elmo can remain rural. We are not shutting our doors on Lake Elmo and hope they do not shut their doors on us, but we have to move ahead and we are doing what is the best prudent business decision. * One, allow the properties to be annexed to Oakdale. If not, two, provide a financing plan for sewer and water which may include a joint powers agreement with Oakdale. And, third, change fundamental attitudes towards development. * Determine what benefits the City of Lake Elmo would have in developing Section 32. 6 James R. Hill, inc. * The City should consider a financing plan by which the City takes on some risk or burden of the assessment. * Lake Elmo must make a 180 degree turn. 13. What do you see as your role in the pursuit of these actions? * No part at this time; it is up to the Lake Elmo City Council. * Listen and consider any suggestions that may come from a cooperative City Council. * Willing to meet with the City Council to work out a plan. * Act quickly - no one likes the existing situation. Potential buyers are not patient enough to work it out. * Nothing, Oakdale is better suited for development activities. The property owners within the MUSA line believe that the City of Lake Elmo does not want the land developed and hence they have no choice but to approach the City of Oakdale. They are frustrated that Lake Elmo cannot view the MUSA area as different than that of the rest of rural Lake Elmo. They have invested time and money into the annexation application and plan to carry it out. They are not optimistic but they would listen if the City put together a financing plan for infrastructure. Although all who were inter- viewed said they have reviewed the Feasibility Report prepared for the area, some still believe it would be better to receive water from Oakdale. When in fact, the supplement report estimates the Oakdale's supply a higher cost than a Lake Elmo system. The key to any land use plan is remain flexible and willing to accept change or amendments as a market may dictate. Some flexibility has been taken away in that the WONE interceptor does have a limited capacity. Once development activities begin in the area, further refinement of the Land Use Plan may be necessary to stay within the capacity limits of the WONE sewer pipe. Attached is a copy of the existing Land Use Plan for the MUSA area and a copy James R. Hill, inc. showing an alternate recommendation. The term "commercial" on the existing plan is confusing. I do not believe that commercial is intended to be "retail sales" in all places. The area south of 4th Street and north of I-94 and west of Ideal Avenue is more suitable for office/corporate headquarters with a large employment base than it is for retail commercial uses. Although the area is accessible, it is not convenient to access. Commercial retail uses may be appropriate near County Road 13 and I-94 and in the northerly area along I-694 and 10th Street and Helmo Avenue. Residential land uses are appropriate east of Helmo Avenue and south of the loth Street. The balance of the area should be planned for corporate headquarter, offices and limited industrial park. City Council Action I do not believe it is too late for the City to work with the property owners within the MUSA line. The following action is recommended: 1. The City Council has to agree to work together with the property owners. A two-thirds majority vote of the City Council will be necessary for development to occur. 2. The Land Use Concept Plan for the MUSA area should be amended to allow greater flexibility. 3. The City should work with a financial consultant to consider financing alternatives for infrastructure including but not limited to tax increment financing and deferred assessments. This plan may also include a phasing plan extending sewer, water and storm sewer over some period of time. 4. The City should call a meeting with the property owners in the MUSA area to: a. Registration No. 12120 -1- 9492 Introduction This report is written to determine the feasibility of reconstructing 15th Street North between Inwood Avenue (CSAH 13) and the Oakdale City Limits. 15th Street North Is a paved 2-lane street. The pavement is in poor condition due to Inadequate subgrade strength. Also, the sight distances are insufficient. 15th Street North is a municipal state aid route, and is eligible for construction, engineering and right-of-way funds. Proposed Improvement The street would be constructed to State Aid Standards for a rural road. Like 47th Street, 15th Street would have two 12 foot driving lanes and 4 foot wide paved shoulders. Poor soil would be removed from the roadbed and would be replaced with suitable material. Driveways would be paved from the edge of the shoulder to property line. The ditches would be graded, and new culverts installed. The road will be designed for 40 mph speeds. Statement oft..Feasibility The project is feasible from an engineering standpoint. This project was Initiated at the request of the Lake Elmo City Council as part of the City's 5-year WA Construction Program. Because assessments are anticipated, a 4/5 vote of the Council is required to order the project. RlRlaht--of-of-way-way There is no platted right-of-way for 15th Street. ,:Because 15th Street has been maintained by the City for a number of'years, _and the existing road Is properly cnetered on the section line, it Is expected that the abutting property owners will donate the required 66'feet of permanent easement. -2- 9492 Same additional slope easements and temporary construction easements will be required to properly match existing driveways and property. A permit is required from the Cottage Grove Ravine Water Management Organization and the Valley Branch Watershed District. Plan approval Is required from the State Aid Division of MnDOT. The fol lowing I ist shows the property owners abutting on or benefitting from the street. The list also shows area of each parcel and the number of lots it could be subdivided into under present zoning. It has been the City's policy on other State Aid streets to assess only those costs which are not eligible for State Aid reimbursement. The only items not eligible for State Aid reimbursement are legal fees for land acquisition, engineering costs in excess of 18% of the construction cost and City administrative costs. The estimated assessable cost is $7,000. Listed below are assessment alternatives for the Council's consideration. The alternative methods are: 1. Benef itted Front 'Foot Method This method assumes'fhat each parcel benefits from the improvement in proportion to the lot frontage abutting on the improvement. in this method, the owner of a small or interior lot generally pays less than the owner of a large or corner lot. The rationale is that is costs more to pave across the frontage of a large lot than it does to pave across the frontage of a small lot. For the purpose of this example, benef fitted frontage is def fined as the frontage which abuts the Improvement. For lots with more than one sided frontage, the benefltted frontage is the sum of the short side and 112 the length of the long side. 2. Unit Charge This method assumes that each parcel benefits equally from the -- Improvement In this method, all property owners pay equal ly regardless of their lot size. The rational is that the benefit ( derived from a street improvement is improved access to the property. Since all are provided equal access, all benefit equally. -3- 9492 f 3. This method assumes that each parcel benefits partially in proportion to its frontage and partially on a unit basis. For the purpose of this example 1/2 of the cost will be spread on a unit basis and 1/2 wit I be spread on a frontage basis. WHEREAS, the petitioners are property owners of more than 35 percent of the real property abutting on 15th Street west of County Road 13 and east of the Oakdale border, and WHEREAS, the petitioners have reviewed a copy of the Feasibility Report dated May 2, 1989 and entitled "Feasibility Report, 15th Street North, SAP 206-110-01, Lake Elmo, Minnesota., Commission No. 949211, and WHEREAS, the petitioners know that 15th Street North in its present condition constitutes a safety hazard because of the following facts: 1. The road has no shoulders. There are many adults and children walking, jogging and biking on 15th Street. Petitioners have witnessed several incidents where accidents almost occured because these pedestrians were on the travelled portion of the roadway. The proposed paved shoulder would solve this problem. 2. The sight distances at the driveway and field entrance at 8281 - 15th Street are inadequate and dangerous. The two Coppin boys, aged 5 and 8 years, wait for their school bus at this driveway and cross 15th Street to and from the bus. A vehicle coming from the east cannot see „_- them until the last seconds. The Coppin boys and any person attempting to come on to 15th Street from the driveway or field entrance cannot see traffic coming from the east. In the summer months,'cars belonging to .'50 families of Hmong gardeners exit from this same field entrance. .'During winter storms countless cars have gone off the road at this spot avoiding oncoming traffic not seen until it is too late. In 1966, when 15th Street was blacktopped, Raleigh Armstrong requested that the grading be changed to give a proper sight distance. The proposed plan will finally solve this safety problem. The present roadbed is in very bad condition. It consists of dirt with a few inches of gravel and blacktop. This is inadequate for the school busses and traffic to and from Eagle Point School. The reason the road was originally blacktopped was to serve Eagle Point School. WHEREAS, the petitioners have witnessed a steady increase in traffic due to rapid development in Oakdale and that this increase combined with the present safety hazards constitute a serious accident just waiting to happen. NOW THEREFORE, the petitioners request the City of Lake Elmo, pursuant to Minnesota Statutes 429.031 et seq. to pass a resolution ordering the improvement project as outlined in the feasibility study of May 2, 1989. Improvement It is proposed to cut out the broken up areas and patch those spots with bituminous. A 211 thick overlay will then be placed over the entire street to strengthen the road and to seal off the cracks. Two culverts would be installed to improve drainage. This letter summarizes our findings and recommendations which will allow the City to obtain its current objectives for data processing and adapt to future requirements that may be placed on City's processing abilities. CITY'S CURRENT DATA PROCESSING CAPABILITIES The City currently has three Apple H computers and three printers. The City currently uses the computers for word processing and for utility billings. The City had purchased the Apple H computers with the intention of implementing a general ledger system including receipting and processing of accounts payable. Implementation of the software was not completed for a variety of reasons, including the elimination of support for the software by the vendor of the software. It is the City's objective to obtain new general ledger software. General ledger software includes the functions of receipting, accounts payable, and a general report writer. The City must also retain or improve its word processing and utility billing automated capabilities. With the limited number of employees, payroll software is not a high priority at this time. If however, a cost effective payroll software is available, the City would consider adding this software also. City personnel have experience on Apple based microcomputer systems. You have indicated that you prefer to stay with an Apple microcomputer system. You have also indicated that there may be advantages to having the computers connected through a local area network. The cost of such a system at this time may be prohibitive, however, the ability to expand is a priority. Our understanding of the City's priorities is as follows: 1) Obtain general ledger micro -based system(software and hardware) which includes automated accounts payable and receipting features. 2) Replace some or all existing microcomputers (current units are approximately 5 years old). 3) Replace utility billing software which is not currently supported by the software vendor. ANALYSIS OF CITY'S REQUIREMENTS Software The computer software selected will determine to a large extent what hardware is required. The City's first priority as stated above is to obtain general ledger software suitable for processing the City's financial transactions. The City's accounting system is structured significantly different to the majority of enterprises (i.e. fund accounting). Therefore the number of suitable software alternatives for a City such as Lake Elmo is relatively small. The major alternatives are as follows: -Obtain an off -the -shelf software package that is written and supported locally. -Obtain an off -the -shelf software package that is nationally distributed. -Purchase and than have customized a relational database manager program. Naturally each alternative has advantages and disadvantages. Off -the -shelf software packages are generally less expensive than customized programming however greater flexibility may be realized by using the database program. Support availability becomes a deciding factor between off -the -shelf software packages. We have reviewed a few off -the -shelf packages all of them suitable for processing the City of Lake Elmo's needs. Of the ones packages reviewed, the Banyon Software package is written and supported locally in this area. Other advantages of this package are that the product has been around for several years and has been well tested during this time. Our firm has also had experience in implementing this package with two other City clients. We are also familiar with this software package when assisting the City during the annual audit. An alternative to a an off -the -shelf software package is to customize a relational database program. This would allow the City to have the program written to their own specifications. This alternative would provide the City with greater flexibility in meeting future requirements by allowing the City to add to its database program when it is deemed warranted. We have recently been involved in an engagement such as this using a customized database application. Programmers are available locally for these packages and the cost of implementing these systems is within reason for the product that is received. With regards to other software applications required by the City, there are numerous standard word processing packages and spreadsheet programs that would adequately meet the City's needs for these applications providing more capabilities than the City is currently using. Support and training for these packages may be obtained through numerous sources including classes, seminars, and books. City of Lake Elmo. EDP Recommendation Page 3 Hardware Once the software to be used is determined, the City's decision for hardware to be purchased is likewise determined to a great extent. City personnel indicated that they preferred to stay with Apple computers. However, because of the domination of IBM in the business computer marketplace we were unable to locate suitable off -the -shelf general ledger software that would run on an Apple computer. This is not to say that a suitable program to process the City's financial transactions on a Apple computer will never be available, but currently an appropriate package is not obtainable. If the City determines that a customized relational database program is desirable than either an IBM compatible microcomputer or an Apple Macintosh computer could be used. The City's current utility billing system is available for IBM compatible computers. We have not located a canned utility billing package that it is suitable for an Apple Macintosh computer. The same relational database program could likewise be used for the utility billing application at an additional cost for the programming. This could be programmed for either type of hardware environment. A single microcomputer should be capable of processing the City's current and foreseeable financial data. We do not foresee the City requiring a local area network (LAN) for their financial data processing needs. However, other applications the City may wish to implement such as word processing or spreadsheets may necessitate a LAN at some point to use these applications to their potential, Computers that are networked require a larger investment for both hardware and software. Additionally, larger systems are generally more complex which increases orientation and training costs. However, this investment decreases marginally for each computer added (i.e., the second computer costs more than the third which is more than the fourth, etc.) At this time we do not feel it would be cost effective or efficient to have to network the computers. However, our recommendation does provide for this feature to be implemented at a later date. If the City determines to implement an off -the -shelf general ledger package we would recommend purchasing an IBM compatible (MSDOS) computer with an internal hard disk storage device. The computer we have listed on the attached letter is one example of this type of computer. There are several options available to you for manufacturers of IBM compatible computers. The computer we have listed is designed to be flexible. Larger storage devices, extra memory and multiple printers may be added at a later date. All prices listed are estimated prices based on information received from a computer dealer. If the City determines that a customized relational database programed to meet their requirements should be implemented than either a IBM compatible computer or a Apple Macintosh computer could be used. The Apple Macintosh computer we recommend also is flexible allowing similar devices to be added comparable to the IBM compatible computer. Having both IBM compatible computers and Apple Macintosh computers on the same network is also a possibility. Recent product developments that allow both types of operating environments to be on the same network have been introduced. We are looking at this option for our own office at this time. However, these developments are too new to have been adequately evaluated at this time. When the City deems a network is appropriate these may be a viable alternative. City of Lake Elmo. EDP Recommendation Page 4 SUPPORT Technical support for hardware and software is extremely important. Support agreements provide comfort while you are automating a system. We recommend purchasing a hardware support agreement for all equipment purchased for a minimum of one year. After the first year the cost/benefit of this coverage on the equipment may warrant the equipment not be covered by a service agreement. Quite often, problems with the hardware occur within the first year. A source for software support should also be obtained when the software is purchased. Software support will be required during the period the software is first being installed and setup. Subsequently, support may be required to answer questions that arise when actual processing begins. This support may be purchased directly from the software company or from a private source that specializes in the software that you have purchased. We recommend using a local support person for the initial installation and training on the software. Depending on the program implemented continued support may usually be purchased on a per call basis or on annual support agreement from this same local source or from the software vendor directly. Support prices may vary considerably depending on the source used for the service. Average hardware support prices experienced are listed on the attached schedule. Software support cost cannot be estimated to any degree of accuracy. The actual cost will vary based on the source of the support and the number of times problems requiring support are experienced. An estimate of the cost for installation and initial training on the software is included on the attached schedule. This is an average based on other client's experiences. This cost will also vary depending on your specific requirements. SUMMARY AND CONCLUSIONS Summary The City's main decision for upgrading its computer processing abilities is dependent on what type of program the City intends to implement for processing its financial transactions. If speed is of the essence for implementing a new system then an off -the - shelf general ledger program such as the one available from Banyon Software with an IBM compatible computer is a prudent purchase for the City. If the City desires greater flexibility for its general ledger processing a relational database management program may be implemented. Either type of computer hardware may be purchased with these programs. This would also allow City personnel already familiar with Apple Macintosh computers to continue using them. The City's main objective to implement new general ledger software could be done currently on a IBM compatible computer. When the City officials determine that other computer systems must be replaced the possibility of implementing and sharing data between both hardware environments may be a feasible and prudent alternative for increasing productivity of City personnel. You indicated that the City anticipates the issuance of an equipment certificate in 1990. The use of equipment certificates for computer equipment is allowable pursuant to MS 412.301. The City may establish the Equipment Purchase Capital Project Fund prior to issuance of the certificates. This fund would incur a temporary deficit prior to bonding. Your fiscal consultant should include capitalized interest in the bond issue from the date of the computer equipment is purchased, our fees and other included costs related to the acquisition would also qualify for bonding. You may wish to also include the cost of the utility software which the City may purchase by the end of 1990. if this purchase is not made, the excess bond proceeds could be transferred to the debt service fund. This report and the attachment must be discussed prior to any final decision. Flooding in Tablyn Park Date: April 24, 1989 Today we started the annual walkthrough of all our parks. At Tablyn Park we viewed the aftermath of the flooding from this spring's melt. We saw that the outfield of the ballfield is littered with debris left after the water, which had been up to the infield, receded. What is left of the fence at the edge of the streambed of the Valleybranch project is also full of debris. Last year I talked with Al Dornfeld of the Valleybranch about this problem which not only occurs every spring, but after every major rainfall. This causes a lot of maintenance on our part and unsafe conditions for those who use the facilities of the park. I met with Mr. Dornfeld and another gentleman who I believe was an engineer for Valley Branch and we looked over the site. They thought that a realignment of the streambed would be the proper remedy for the situation and we tentatively mapped out the new location. This realignment would send the water on a straighter path and improvements would be made to the entire bed to increase it's capacity. We would also benefit with an increase in the size of the playing field in right field, as it is now it is too short and is dangerous to older players who run into or over the fence and risk injury. This is a great potential liability to the City. Valley Branch later backed out of this proposal. They apparently did not think it was cost effective. They opted to merely clean out the streambed which was not effective. I ask that our Council request Valley Branch to realign the streambed as they initially proposed, and also ask them to install a new fence. The City budgeted $90,000 in 1988 for police services. The Sheriff's Department estimates of 1988 costs were $84,050.89; the actual costs were $89,649.76 (6.6% over estimate). The 1988 average cost per hour, per Deputy, (including benefits) was $21.45. The City budgeted $97,000 for police services in 1989. The 1989 Sheriff's Department estimate for 1989 is $95,031.40 (or an increase of $5,381.64 over the 1988 actual). The 1989 average cost per hour, per Deputy, (including benefits) is $22.74. This information may be helpful for you during our budget workshop (which we hope to hold within the first or second week in July.) Proposed Work Schedule: - Comp Plan: The enclosed schedule was drafted to organize completion of the Comp Plan. The schedule has been placed on the June 22nd agenda of the Planning Commission for their consideration and review. Their comments and the schedule will be submitted to you for consideration at the June 6th meeting. Concurrent Detachment/Annexation: As per Council direction, a letter was sent to the Municipal Board requesting delay of Board action until after June 30th, on any concurrent detachment/annexation affecting properties of Lake Elmo or Oakdale. Fritz Knaak was contacted before the letter was sent to verify that the letter would have no detrimental affect on our later efforts; he gave full support to the action. Although Mayor Leo Hudalla, of Oakdale, fully supported their submission of a like letter, his efforts were not supported by the majority of the Oakdale Council. Also, Terry Merritt, Exec. Dir. of the Municipal Board, called this week (prior to receipt of the letter) to ask if our Resolution re:Sunburrow was to serve as the official request for detachment/annexation. I advise him that it was not, as the Resolution only accepted the petition and that the propertyowners would be the responsible party for submission of the Petition. He further advised: Brockman/Fraser: Board has yet to meet to review the evidence in view of the remand. No time limit for response was indicated in Judge Maas' decision. It is anticipated that the full House will not pass the bill in that form; therefore, it will go to conference committee. REAPP requested the City to authorize expenditure of up to $1000 to have a professional attorney lobby the seven members of the conference committee in the House to try and get them to leave that particular clause in. There would not be any lobbying until we know who the members are. (We failed in this effort last year by one vote.) LAKE ELMO CITY COUNCIL MINUTES MAY 16, 1989 PAGE 2 Attorneys Dayton and Sampson have declined based on their work schedule, but they have given Todd the names of two attorneys they recommended that are well known in the Legislature and knowledgable about waste management issues. REAPP has indicated it would be willing to kick in some money, if it is required, if the final bill was over a $1000. This $1000 will be taken out of the $200,000 allocated by the voters. M/S/P Graves/Hunt - to authorize expenditure of up to $1000 for lobbying efforts on the Solid Waste Management Act that is being considered by the 1.989 Legislature with the attorney to be identified by REAPP. (Motion carried 5-0). 5. IMPROVEMENT HEARINGS: City Engineer Larry Bohrer provided assessment alternatives for the Council's consideration. The alternative methods are: Benefitted Front Foot Method, Unit Charge, and Combination Method. Lists were provided showing the property owners abutting on or benefitting from the street improvement. A. 15th Street, Inwood Avenue to West City Limits, Resolution 89-28 Mayor Dunn opened up the public hearing at 7:30 p.m. in the City Council chambers. Proposed Improvement: The street would be constructed to Municipal State Aid Standards for a rural road. 15th Street would have two 12 foot driving lanes and 4 foot wide paved shoulders. Poor soils would be removed from the roadbed and would be replaced with suitable material. Driveways would be paved from the edge of the shoulder to property line. The ditches would be graded and new culverts installed. The road will be designed for 40 mph speeds. The estimated project cost is $158,000. It has been the City's policy on other State Aid streets to assess only those costs which are not eligible for State Aid reimbursement. The only items not eligible for State Aid reimbursement are legal fees for an acquisition, engineering costs in excess of 18% of the construction cost and City administrative costs. The estimated assessable cost is $7,000. John Bodey, 8155 15th St. N., asked if Oakdale had plans to upgrade their section of 15th St. Bohrer answered that 15th Street was not presently in Oakdale's 5-year plan. Bodey asked if the new road would be sufficient to handle the amount of truck travel. Bohrer answered this road would be designed for 9-ton minimum axle load all year around. Leo Pierre, speaking for his father living at 8167 15th St. N., stated he believes the road should be rebuilt, but the assessment was too large for the small parcel (1.3 acres) his father owns. He would like a maximum speed of 40 mph. Rob Pierre, 8167 15th St. N., asked, if more property is needed for the road and the shoulder, would he be compensated for this .land or the two big trees that might be taken down. Bohrer explained they have done some preliminary surveys, but they would know within the next 2-3 weeks if they LAKE ELMO CITY COUNCIL MINUTES MAY 16, 1.989 PAGE 3 ' need more property. If property is needed from Mr. Pierre, he would be entitled to compensation for that strip of land, and trees, which are considered. part of that value. Pierre responded that if he got something out of it, then he could afford to pay a little assessment. Thomas and Rosemary Armstrong submitted a petition, of which the petitioners are property owners of more than 35 percent of the real property abutting on 15th Street west of County Road 13 and east of the Oakdale border, requesting the City to pass a resolution ordering the improvement project as outlined in the feasibility study of May 2, 1989. Tom Armstrong, 8291 15th St. N., stated that normally the City has used the "unit assessment method", for people that live on cul-de-sacs who have narrow frontages and other people that have wide frontages, because it is the only fair thing to do is charge everybody equally. In this particular street, there are no people with corner lots or who own a lot with narrow frontage on it. Armstrong stated he was in favor of this project and was willing to use a "front foot assessment method" because in this particular project it is the fairest way to do it. Steve DeLapp, 8468 Lake Jane Trail, requested consideration by the City Engineer on all the street projects, especially when there is a straight road going through farmland, that they try to make a little "squiggle" so they can save the trees that are worth something, rather than bulldoze these trees just for the sake of a. State law. Bohrer responded that the trees are on the high point of the hill and the hill has to be lowered to improve the site distance. When you lower the grade, this makes the slopes go out farther. Mayor Dunn closed the public hearing at 7:55 p.m. in Resolution 89-29, Councilman Hunt suggested adding a paragraph stating: WHEREAS, a petition has been received by the City of Lake of more than 35 percent of the front footage property owners M/S/P Hunt/Graves - to adopt Resolution 89-2.8, as amended, ordering Improvement and Preparation of plans for 15th Street from Inwood Avenue to West City Limits. (Motion carried 5-0). B. 20th Street, Lake Elmo Avenue to Manning Trail, Resolution 89-29 Mayor Dunn opened, up the public hearing at 8:00 p.m. in the City Council chambers. Proposed Improvement: 20th Street has been patched and had spot overlays done over the past few years; however, the road surface continues to break up due to inadequate subgrade strength. It is recommended that a 2" overlay be placed over the street to increase the strength of the road and to seal off the cracks. Gravel would be added to the shoulders to bring them up to finished grade. Existing driveways will not be altered. A tapered edge will be raked out at each entrance. The total estimated project cost is $49,000. LAKE ELMO CITY COUNCIL MINUTES MAY 16, 1989 PAGE 4 The amount of 1989 MSA Maintenance Funds ($44,099) remaining after 33rd Street is completed is estimated at $24,500. The difference between the $49,000 estimated project cost and the $24,500 of MSA funds is $24,500 and would be assessed to the abutting properties, and it is assumed that Tartan Park would pick up one-half of the assessment. The remaining portion would be split on an equivalent lot basis. Amount to be Assessed $24,500 Tartan Park (1/2)-$12,250 Remaining Assessed to Residents $12,2.50 Allen Kierhafer, 2040 Manning Trail, because of the cars turning onto 20th St. from Manning Trail they have cut into his yard, asked about a curb placed on the corner of his side. Bohrer preferred not to because it causes problems for snowplowing. Speaking for her dad, Peter Durand, Jean Durand stated 20th Street is used by people to get into their houses at Eden Park and Peltier's addition, and 90% of the traffic is for Tartan Park. Therefore, they should have to pay for this. In the early '60s they were told they only had to pay for road improvements once and this should be stated somewhere in our city records. Ed Bruno, Manager of Rec. Services for 3M, stated they do have a lot of traffic that uses Tartan Park and felt the road has started to deteriorate and if it is not repaired now, it will end up being very expensive to repair. Tartan was certainly willing to pay their share. M. Erickson, 11588 20th St., stated, she can't prove it, but she was sure that Tartan Park has more than 50% of the traffic on this road. Mary Leslie, 11546 20th St., felt the Eden Park and Packard Park residents were benefitting propertyowners because this is the only road for exit/entrances to their homes. She asked the Engineer to consider a reflector showing the street doesn't continue through at the end of Manning and 20th Street. (Motion carried, 5-0). C. 38th Street, 39th Street, Innsdale Avenue, East of Ideal Avenue Resolution 89-30 Mayor Dunn opened up the public hearing at 8:2.0 p.m. in the City Council chambers. Proposed Improvement It is proposed to cut out the broken up areas and patch those spots with bituminous. A 2" thick overlay will then be placed over the entire street to strengthen the road and to seal off the cracks. Two culverts would be installed to improve drainage. Crushed rock would be added along the shoulders and at driveways as needed. The total estimated project cost is LAKE ELMO CITY COUNCIL, MINUTES MAY 16, 1989 PAGE 5 $66,550. It was proposed that the entire cost of the project be assessed, i to abutting properties. Harvey Gleason, 8311 Lake Jane Trail, explained his back property abuts 30th St. and his driveway is on Lake Jane Trail and asked if he would pay the same assessment. Bohrer answered this was a unique situation, it was not a corner lot, but it was a lot that had more than one side fronting on a road. The Engineer advised he would review this situation. Gary Wright, 8225 39th St., favored the project, but felt the road was in this condition because of lack of maintenance in the past and asked. the City Engineer to address this situation. Bohrer responded that normal city maintenance is a program where most streets are sealcoated every 6 years. When he first studied these streets in 1983 they had gone beyound the point that a sealcoat would help --it would not glue back the broken pieces. The patches were of such an extent that it was beyond the capabilties of the three man crew we have for maintenance. Based on the fact that maintenance was not done, Wright asked if there was any funding to help with this project. Realizing there were spots in the road that could not have been saved, Jim Demko, 3929 Innsdale Avenue N., felt in 1983 even a sealcoat would have helped the rest of the road. Demko had not decided if he was in favor of a project or not. Kathy Landucci, 8312 38th St. N., stated she was in favor of the street project, but would like a maintenance plan. Councilman Hunt asked the engineer what was the expected life of a road surface. Bohrer answered this type of a patch and overlay is a lower cost alternative than rebuilding a complete road. He did not know what was under the road nor how it was constructed many years ago. Based on past practice, since 1983, they have done streets like this and these streets are in the 6 year maintenance program, Bohrer would predict a surface life of about 10 years. Avenue. (Motion carried 5-0). 6. PLANNING/LAND USE/ZONING: A. Resolution 89-31: Approving Future Land Use Map, Setting a Moratorium, Directing Amendment to Comprehensive Plan Councilman Williams requested the property north of Eden Park thru Section 13 be kept as RR for the following reasons: airport safety zone and, primarily, until the City and the VBWD can come to some solution on the surface water problems. Planning Commission member, Steve DeLapp, indicated area. affected with "Post SWMP", i.e., storm water management plan. LAKE ELMO CITY COUNCIL MINUTES MAY 16, 1989 PAGE 6 Larry Bohrer pointed out that during development you are given the opportunity to define drainage, ponding and right-of-way easements and the City is in a very good position to impose these costs on a developer. Otherwise, to improve that area with the types of ponding or other needs, the City would have to purchase the land or condemn it. Under watershed law, Bohrer explained the City has to have a drainage plan within the local plan for that part of the City that lies in the VBWD. According to Bohrer, since the VBWD Managers were amending their basic plan, Karen Chandler of Barr Eng., lead him to believe that our deadline for a Water Management Plan was not to come in the upcoming year; therefore, the City did not budget for it. Bohrer felt it would be better for the City to have a drainage plan in place when a developer comes in with an application. The City can either adopt the VBWD Plan as our plan or develop their own that would follow their basic guidelines. If the City adopts their plan, that is expedient and cheap, but it doesn't address our individual problems. In his opinion the most immediate need is the •wia�lvillage area, north of the railroad tracks. Cletus Tauer, 5270 Keats Avenue, requested consideration for RE zoning on his 40+ acres (South of Hwy 36, abutting Foxfire Estates on the West which has a 66 ft. wide road easment off of Keats Avenue). Tauer stated he has no immediate plans, but he had talked to Bruce Folz and was aware of the plan for connecting the street. Based on the health, safety and welfare issue and the possibility of the road being connected without the City incurring any expense, Councilman Hunt would support the RE zoning for the Tauer property. In trying to bring some overall criteria for RE 2 1/2 acre versus 5 acre, Councilman Williams suggested RE 5 acres rather than the proposed 2 1/2 acre of the tabletop farmland on the southside, 1/2 mile to the east of Cty Road 13B and for the area west of Cty Rd. 15 by the Oakland Jr. High School. (Planning Commission member Steve DeLapp indicated area by lining with 5 acre color code). Councilman Graves stated he would be comfortable with 5 acre RE, but with the realization that it is a Comp Plan and it can be changed if people come in and request 2 1/2 acre RE. Councilman Hunt had no problem supporting this area as 5 acre RE because he felt loth Street has become a very busy street and 2 1/2 acres of flat land is not as promising as 5 acres. neXt to Cty. Rd.15 Based on conversations he has had with these propertyowners,n Moe felt they would not be interested in developing 5 acre parcels. Councilman Williams submitted a revised Resolution for Council consideration. Williams stated "In the past he has gone on record as ( saying he is not convinced that commercial development on I-94 is necessarily in the best interest of the City. However, if the Council adopts this Future Land Use Map as a workable document, then he is committed to making that zone work as best that we can." LAKE ELMO CITY COUNCIL MINUTES MAY 16, 1989 PAGE 7 ( Planning Commission member Ed Stevens explained at the last meeting, the PZ decided they didn't have to specifically state what businessess should or should not be qualified for along 1-94, that it would just be understood. After later consideration, it seemed to some of the PZ members that it would be better to let the Council know their recommendations. For this purpose, Ed polled the PZ members, who signed and submitted their recommendations to the Council. M/S/P Graves/Hunt - to amend the Future Land Use Map to include the Cletus Tauer property (42.75 acres) as 2 1/2 acre RE Zoning; the two parcels north of Eden park indicated by Councilman Williams with surface water problems remain Rural Residential, but would be available for RE development (Upper parcel proposed as 5 acre RE, Bottom parcel proposed as 2 1/2 acre RE) post completion of the I.990 Surface Water Management Plan; area east of Cty. Rd 13B, South of loth Street for 3/4 mile be changed to 5 acre RE from 2 1/2 RE shown at present, areas by 15th Street, South of Oakland Jr. High School be changed to 5 acre RE. (Gene Peltier) Now that the Council has reached a consensus on a future land use map, the Council reconsidered the zoning application from Gene Peltier. Councilman Williams questioned the Council's action to adopt the Future Land. Use Map before the Public Hearing was held and made the following motion. Councilman Graves stated he has every intent to move ahead with this plan. By approving the rezoning in Peltier's case, we are amending the Comp Plan. The Forest is not an actual rezoning request. Councilman Hunt agreed with Councilman Graves in that he has seen a 4/5th majority of Council vote on the FLUMap and was prepared at this time to vote favorably on the rezoning as he did not see anything to stop this City from concluding the draft, just agreed upon, will be our FLUMap. Hunt did agree with Williams that the City should look at rezoning for the entire city and was not in favor of piecemeal zoning. There was discussion on procedure; could the Future Land use Map be adopted by the Council with the enabling ordinances to follow. Admin. Morrison will contact Ann Hurlburt, Met Council, for the correct procedure. M/S/P Graves/Moe - to amend the motion by deleting the contigency. Councilman Graves voiced his concern on the road width conforming to our City guidelines and advised he was in favor of the concept but wanted road widths to conform to current standards. (Motion carried 5-0). 7. CITY ENGINEER'S REPORT: A. Report on White Hat Fill Permit M/S/P Graves/Williams - to bring back for reconsideration Ed Gorman's fill permit. (Motion carried 5-0). Ed Gorman, owner of the White Hat Restaurant, submitted a letter to the Council proposing to submit a site plan showing existing and proposed land elevations in 2-foot contours, drainage provisions, drainfield locations, holding pond location and. a. general. concept plan for proposed expansion to the City by December 1, 1989. Larry Bohrer advised the Council that the City needs more detailed perameters for fill applications than what the City has now when Mr. Gorman was issued a fill permit. Limitations suggested were: 0-100 cu.yds. application be administratively granted., 101-500 cu.yds. requires site plan, over 500 cu.yds. requires a full grading plan with contours. Bohrer added he would not want the fill graded out and spread over a larger area just for the sole purpose of stabilizing it until a plan is forthcoming because this amount of fill will compact the natural soils underneath it and may render it unuseable for drainfield purposes. Initial assumptions are being made here, Bohrer stated, that this is going to prove suitable for a drainfield. These responsibilities are Mr. Gorman's not the City's. Because of the volume of fill. brought in without any specific grading or site plan Mayor Dunn voiced her concern with the drainage in this area. Ed Gorman responded that Mr. Schiltgen's topsoil has been running across his drainfield for the nine years he has been there. Councilman Moe stated there are other people in that same area that contribute water, or that have land that sits vacant 6-7 months out of the year. if we are going to pose restrictions we should look at the broad issue. Bohrer answered there are guidelines for Ag land put out by the soil conservation service on soil loss limits to water erosion, wind erosion, etc. MIS/ Graves/Moe - to reinstate the current White Hat Fill Permit to Ed Gorman, for up to a maximum of 20,000 cu.yds. which expires Sept. 20, 1989 with the understanding that no further consideration of extension of the fill permit will be granted unless all the requirements as stated in our ordinances for concept plan approval such as: contours, grading and site plan, drainfield location, building location, are submitted and approved by the Council. M/S/P Graves/Moe - Whereas the City Council has received a letter dated May 15, 1989 from Ed Gorman proposing submittal of a site plan showing existing and proposed land elevations in 2-foot contours, drainage provisions, drainfield, locations, holding pond location and a General Concept Plan for proposed expansion to the City by December 1, 1989, and he agrees that any part of the fill that was brought onto the site that cannot be incorporated into a plan approved by the City will be removed from the site at his expense; The City Council approved reinstatement of the current fill permit for the White Hat Restaurant to Ed Gorman for up to a maximum of 20,000 cu.yds. which expires September 20, 1989, with the understanding that any further consideration for extension of the fill permit will not be considered until all the requirements as stated in our ordinances for concept plan approval such as: contours, grading and site plan, drainfield location, building location are submitted and approved by the City Council. When the 20,000 cu.yds. of fill have been reached, City Engineer, Larry Bohrer will submit his comments. (Motion carried 4-1: Dunn: This amount of fill should not have been granted without a grading and site plan submitted first to address any drainage concerns. This is too intense of a use for that specific parcel of land without a grading and site plan submitted first). B. Discussion: Close -Out, 201 Grant As we have come under budget with our grant expenditures, City Engineer, Larry Bohrer and Administrator Morrison asked Kathy Sather, MPCA, if we can now use some of those funds toward payment of possible extended legal fees. Ms. Sather checked into the EPA regulations and was unable to come up with anything that would permit extension of the grant period. Discussion: Future Park Areas (Councilman Williams) When the proposed future land use map was approved on May 4, 1989, Councilman Williams explained there was discussion on identifying suitable areas in the City where future park dedication should, take place so the City would have some control with selection of areas that would be accessible to residents and take into consideration natural amenities. Williams was not advocating developing new parks, but the city should identify park parcels to be set aside. Section 32 Report: Mike Black City Administrator Morrison recommended having our financial consultants come up with financing alternatives before the Administrator and City Engineer meet with Scott Renee and Frank Langer to analyze the tax impact consequence of varying land uses of properties within the MUSA line. Councilman Williams stated his concern of spending money on such a small amount of propertyowners that don't even live here. A Comparison of Candidate Engineering Firms for Landfill EIS Review Hoagberg and Associates: Committee Comments: Plus: Lots of experience with hydrogeology and fighting landfill proposals in Minnesota, so he knows how things are done. Hoagberg currently working with Corcoran to fight landfill site. there proposed by Hennepin County. Hoagberg recognized by some as top hydrogeologist in Minn. Atty. Dayton knows Hoagberg and David Braslau as expert witnesses. Recognized value of graphics to convince non -technical political decision makers. The small size of firm probably means we will get good value for our money. Minus: No direct experience with landfill designs. No computer modeling capability at present; would have to purchase the software. TKDA Comments: 1. Presentation of proposal exudes experience, but team's fragmentation is cause for concern about coordination of work. 2. Liked the position they take: Lake Elmo is opposed to the landfill and needs a team of experts to help. 3.. Work plan is well done. 4. Work for City of Corcoran is similar and experience will help. i DPRA and Geraghty and Miller: Committee Comments: -Plus: Fletcher Driscoll is recognized by some as the best hydrogeologist in the country. He literally wrote the book on wells and groundwater contamination. Geraghty and Miller is largest hydrogeology firm in country. DPRA has lots of experience with hazardous waste landfills working with EPA. Bill Rohrer of Lake Elmo is an officer of DPRA but will not be directly involved because of appearance of conflict of interest. Atty. Dayton has used Driscoll many times as expert witness. Kelton Barr (G & M) was project manager for Hennepin County's landfill EIS, so he knows the ropes. G & M currently hired by Winnebago Co., Wisc., to monitor landfill EIS being done there by Donahue. Driscoll working for Greenfield -Independence to fight the landfill site there proposed by Hennepin County G & M has in-house computer modeling capability. Minus: The larger size of these firms probably means more money goes for overhead. TKDA Comments: 1. Personnel listed in proposal have lots of background and experience 2. Will those listed actually be involved? (Yes.) 3. Both DPRA and G & M are experienced in this type of work. 4. Experience of Chris Lough (DPRA project manager) in risk assessment could be plus or minus depending on his outlook.
