Present: Mayor Dunn, Councilmembers Graves, Hunt, Moe and Williams.
Also present: Roger Williams, State Planning Agency, Nancy Welsh, Director
of State Mediation Services and City Administrator, Patricia
Morrison.
Mr. Williams and Ms. Welsch outlined their background and area of expertise,
described the facilitator/mediator services they could offer, and the pur-
pose of this meeting with the Council.
Williams asked if the Council desired to proceed with this process.
Mayor Dunn: Supported the process.
Councilman Graves: Worthwhile technique to explore and see if there
are areas of common concern.
Councilman Moe: In favor of mediation process.
Councilman Williams: In favor of sitting down with Oakd.a.le; at this point
not sure if willing topaya lot of money to a mediator; believe
Oakdale and Lake Elmo could hash out a lot before mediator needed.
Councilman Hunt: What level of mediation is needed; should we involve
affected property owners also, and at what point; believe we would
win in court, but if we can work with landowners, would be better.
Welsh: Advised. her cost was $125/hr (Roger Williams at no cost), which
would be devided equally between Oakdale and Lake Elmo; anticipate
this process should take no more than 20 hours. Would like to see
two meetings and then determine if process was viable.
R.Williams: Suggested one meeting between property owners and Lake Elmo
Council, and then a meeting between Lake Elmo and Oakdale Councils,
Oakdale wants property owners to be heard,
Graves: Need to determine our objective and look at agenda for discussion.
Dunn: Interested in entire border of Lake Elmo.
R.Williams: Believe Oakdale wants to know if you are proactive in seeing
Section 32 developed; they are looking at cooperative arrangement
for development; wants to stabalize borders.
Hunt: Sit down with Oakdale and see what areas they want to talk about;
come up with list if issues.
Welsh: Representative Council group could get together to set forth
Section 32/33 issues.
Dunn,Graves,Hunt advised they would be interested in serving in this capacity;
discussion of need to comply with Open Meeting Law.
Graves: Have no interest in sitting down with Oakdale and drawing a line
to change borders;no intention of creating new borders; residents
have to be involved; retaining the integrity of our municipa7border
is my prime.concern; believe main issue to be resolved is between
residents of Lake Elmo and the City, talking with Oakdale is
secondary; will look at Joint Powers activities in connection
with sewer and water services (gave examples).
R.Williams: Believe Oakdale is looking, for a policy statement; who pays for
what and who gets what out of it.

Dunn: Have not received a development plan for this area in last
15 years; property owners should have^$- i%E lion mind.
Graves: Property owners have told us nothing will happen there until
City facilities are there and what is City going to do to put
facilities in; response from Lake Elmo was bring in plan and
show us the need; people felt they received no response from Laek
Elmo and therefore had no options.
Welsh: What do you need to hear from property owners.
Graves: Our City Planner talked to them; property owners were suspicious;
we need to have concrete plan; we need agreement between City and
property owners; City needs to take concrete steps.
Dunn: There are some differences in development philosophies between
Council members.
Hunt: Discussed planners interviews with property owners and advised
the City's financial consultant will be submitting financial
options to the City for construction of sewer and water.
T.Williams: Maybe first step, prior to meeting with property owners, is for
City of Lake Elmo to sit down and say what they want; may not be
essential to have a unanimous decision of what we want; we have to
look at figures and try and decide next step.
,Graves: Option may be for Oakdale to put in trunk line from the north'to
south.
R.Williams: You may need to decide what kind of development you want; set
certain development criteria and standards; appears to be some
major philosophical differences as to how to deal with land.
Hunt: We have discussed an urban services district for Section 32.
Dunn: Need to protect wetland areas there and make sure area developed
properly.
Welsh: Should determine next step, or series of steps; who would. repre-
sent Council that all Council members feel comfortable with and
trust as representative of the Council; should Council meet with
property owners before financial plans in place; any joint venture
possible with Oakdale.
Hunt: Would like to have couple of Council members as representatives
with a regular update to full Council; will take flexability on
all of our parts; thought we decided we needed to develop this
area; would like to work with property owners to find out what's
acceptable to them; believe we should invite them into process
after financial consultant review.
Discussion ensued as to why both Roger and Nancy needed in process.
T.Williams: Hope we come out of this with stable borders. Need report
back fnom financial planner. Believe property owners and City
representatives can meet without additional cost to the City; hate
to keep throwing good money after bad.
Graves: Don't think processes we have engaged in to date have been
productive.
Moe: Don't know how much time we have; believe it is this or litigation;
I would be more willing to spend it now.

MOTION by Moe, seconded by Graves, to hire mediators,;.Roget Williams
and Nancy Welsh, to hire mediators to set up meeting with
property owners to get their view for a maximum time period
of four (4) hours.
T.Williams: Will property owners assume soma of th6 costs/
R,Williams: We can bring this up to them when we meet with them.
MOTION TO AMEND by Graves, seconded by Hunt, to'split costs of mediation
services 50/50 with property woners.
