REAPP REPORT ReAPP meetings will be held the first and third Sundays of the Month at 8:00 p.m. in City Hall until school starts. Todd Williams reported that the lobbying campaign was not successful in getting legislation passed to delete the landfill sites. However, the legislature did pass provisions allowing for compensation of Citys who have engineering costs involved in reviewing these sites. LAKE ELMO CITY COUNCIL MINUTES JUNE 6, 1.989 PAGE 2 j 7. PLANNING/LAND USE/ZONING: A. PUBLIC HEARING: (1) Variance --Lot Size Requirement in Shorel.and Ord. John Prokosch, 10907 32nd St. N. Mayor Dunn opened up the Public Hearing at 9:18 p.m. in the City Council chambers. Notice of the public hearing was duly published and sent. There was no one to speak for or against the proposal. John Prokosch, 1.0907 32nd St. N., has applied for a lot side variance and a variance for frontage on a public road. The applicant proposes to demolish their existing home and construct a new larger home. This house is served by a collector septic system call Old Village Remote C. The Code requires that whenever a non -conforming home is destroyed by more than 50%, the new structure shall meet the provision of the code. The DNR had no concern with this request. City Engineer, Larry Bohrer, presented his review, dated June 5, 1989. Bohrer stated the application, as proposed, would require variances for lot size, structure setback from the water, and minimum building elevation. Lot size usually relates to the land area needed for sewage treatment, but.this lot has City water and an off -site sewage treatment system. The septic system is sized properly to accommodate the 4-bedroom house proposed. The setback from the water is not reduced from what it or the neighbors is today. Mr. Prokosch stated he would be filling an area 50 x 50 x 3 ft., 200 feet from the lake. He would be willing to add fill and raise the house elevation to 892. (The Shoreland Ordinance requires a minimum floor elevation of 892. ) The house would be moved 10 feet toward to accomodate the deck, so the edge of the would be in the same location as the house is now from the lake. Prokosch talked to his two neighbors and they had no problem with the proposed project. Mayor Dunn closed the public hearing at 9:30 p.m. Larry Bohrer stated he had a concern that the finished landscaping would not shed water on the adjacent propertyowner and the drainfield be marked out in the yard so that no construction traffic drives over it. This can be inspected by the Building Official. Councilman Graves stated. his concern, if this existing house is being "destroyed" more than 50%, then the new home should meet the provision of the rode. M/S/P Williams/Graves - to grant a lot size variance and setback from the Ordinary High Water Mark and a shoreland permit and fill permit to John Prokosch, 1.0907 32nd St. N., based on the hardship being the existing configuration of the lot, the new dwelling proposal does not increase the non -conformity of the existing structure and the bottom floor elevation of the home will have an elevation of 892. The Building Official will. approve the marking of the drain.field so construction taffic will not drive over it and the finished landscaping will not shed water on the adjacent propertyowner.. Scott & Heidi Nietzel, 3291 Lampert Mayor Dunn opened up the public hearing at 7:30 p.m. in the City Council chambers. Notice of the public hearing was duly published and sent. There was no one to speak for or against the application. R. Scott & Heidi Nietzel, 3291 Lampert, have applied for three variances to the side yard setback, setback from drainfield, setback from driveway. If these variances are granted, the applicant proposes to construct a 30' x 24' accessory structure. City Engineer Larry Bohrer presented his review, dated June 5, 1989. Bohrer had reviewed the perc tests and are similar in both the front and backyard. Therefore, a combination of the yard behind the garage and expanding to the north, but still keep the setback from the north property line, could be an alternate drainfield site. Scott and Heidi Nietzel stated their hardship was they owned two cars and needed a two car garage and this was the only spot on the property you could build a garage. The existinggaragewouldbe left, but they have future plans to make the old garage into living space. The Nietzel's stated they do plan on removing the old driveway and move it over so the driveway goes along the side of the house. Sharon and Len Johnson, 3271 Lampert Avenue N., submitted a statement in which they were in favor of the proposed improvement and encourages completion. Mayor Dunn closed the public hearing at /7/:/.3"V.IW./ 7:34 n.m. (Amended 7/18) MIS/ Graves/Moe - to grant the following (3) variances based on the hardship being this is the only site available on the property and on the letter of approval by Len and Sharon Johnson M/S/P Hunt/Williams - to add to the motion the recommendations from the City Engineer as Conclusions. (Motion carried 5-0). M/S/P Graves/Moe - to grant the following (3) variances to Scott and Heidi Nietzel, 3291 Lampert Avenue N., in order for them to build a 30' x 24' garage based on the hardship this is the only site available on the property, the old driveway will be removed and the new driveway will be straight to the new garage, on the letter of approval by Len and Sharon Johnson; with City Engineer's recommendations stated in his Review letter dated June 5, 1989 be used as conclusions. (Bohrer strongly recommended the existing septic system be marked out in the yard so that no construction traffic drives over it.) (1) A driveway setback from the side lot line of 0.5 feet where 5 feet is required. (2) A structure setback from the side lot line of 8 feet where 10 feet is required. PUBLIC HEARING: (1) Variance --Allow commercially licensed vehicle parking in R-1 Zone R.J. Linnell, 9402 Stillwater Blvd. Mayor Dunn opened up the public hearing at 7:36 p.m. in. the City Council chambers. R.J. Linnell is a private contractor hauling mail for. the U.S. Postal Services and works out of the Minneapolis Post Office. Mr. Linnell is requesting a variance to the Lake Elmo Municipal Code (301.130 E.5) that prohibits parking of a commercially licensed vehicle over (1) ton capacity in a Residential area which would allow hint to drive his vehicle home and park it in his driveway overnight. Normally, Mr. Linnell comes home from work at 7 p.m. and leaves for work at 3:30 a.m.. Mr. Linnell presented pictures of his truck and views from sides of his property showing what is visible. He explained this truck is under contract with the Minneapolis/St. Paul Postal Service and require the truck be at his disposal 24 hours a day. The truck has government equipment on it and has to be secure; therefore, he has an umbrella insurance policy on his home for the truck. Delray Espelien, 9340 Stillwater Blvd, advised the Council he has lived in this residence for 21 years and owned this house, himself, for .11 years and presented his pictures showing various views from his house. Espelien stated "he doesn't believe there is any commercial vehicle under contract which states it has to be driven home and parked in your yard." Mr. Espelien, Delray's father, lives in Oakdale, but owns 2 lots opposite to his son. when he bought this place there was atrucking business next to him on a I acre lot, this is why he moved to Oakdale. when it burned dowr),;the land owner couldn't sell it. Mayor Dunn closed the public hearing at 7:46 p.m. When the City Attorney was asked if the condition, of Mr. Linnel having no other option than take this vehicle home due to his job, could be considered a legal based hardship for granting a variance, Knaak stated it would be difficult for him to say, based on this hardship alone, because he considered this an economic hardship. The Council asked the staff to use their expertise to find how widespread in the City is parking of a business vehicle at home. The Council asked the question "Does the ordinance really intend to stop someone from driving back and forth to work OR is it more to stop the actual storage of such vehicles,in a residential area?" and "how do other contract drivers maintain or store their trucks?" The Administrator will contact the Postal Service on their requirements. MIS/ Moe/Hunt - to grant a temporary variance to R. J. Linnell, 9402 Stillwater Blvd, to allow commercially licensed vehicle to park overnight in the R1 Zoning District. LAKE ELMO CITY COUNCIL MINUTES JUNE 6, 1989 PAGE 5 M/S/P Graves/Moe - to amend the motion to include postpone review for consideration of the variance request until the next Council meeting. (Motion carried 5--0). M/S/P Williams/Hunt - to amend the motion to include the temporary variance is granted until the June 20, 1989 City Council meeting. (motion carried 5-0). M/S/P Moe/Hunt - to grant a temporary variance to allow a commercially licensed vehicle to park overnight in the R1 Zoning District to R.J. Linnell, 9402 Stillwater Blvd., until the June 20, 1989 City Council meeting and to postpone review for consideration of the variance request until the June 20th meeting. (Motion carried 5-0). D. PUBLIC HEARING: (1) Variance -Lot Size and Road Frontage Mildred Meier, Lanes DeMontreville Mayor Dunn opened up the public hearing at 8:1.0 p.m. in the City Council chambers. Mildred Meier is inquiring as to the buildability of a vacant parcel (Lots 132-140, 159-167) she owns in Lanes DeMontreville Country Club Addition. The Zoning Code and Shoreland regulations apply. Larry Bohrer presented his review which stated at least two variances (lot size and frontage) would be required. Bohrer further stated it is not known if more variances would be required because contour map, building site plan, and soil borings have not been submitted. The problem of suitable access to this lot was discussed because there is over 400 ft. of unimproved right-of-way between this lot and the nearest improved road (50th Street). Molly Shodeen, DNR, addressed her review of the variance requests and shorel.and permit proposal for the Meier property in her letter dated May 18, 1989. Mike Severin, 8012 50th St., stated when the City took the land from him, he was told it wouldn't perk out and it was not buildable. The pipes to remove his sewage is in this right-of-way. The access road would run 2.0 ft. from his front window. Mrs. Arndt, 7931. Hill Trail N., voiced her concern on water problems. At one time she was told there were no more buildable lots on this island. David Brown, 7990 50th St. N., lives directly north, and continues to have water problems. He doesn't want the water from that house in his back yard. Dave Furseth, 8004 50th St., stated he has a tremendous water problem and the mound site that was just installed increased his water problem. i R. Harvey, lives north of Meiers, stated he was told it was landlocked and had no access when he bought his property. The surveyor found no easement on his property. Ken Sovereign told him this pro erty was sold this fall. QmQ;q�r LAKE ELMO CITY COUNCIL. MINUTES JUNE 6, 1989 PAGE 6 Chuck LeMire, 8084 Hill Trail N., stated he lived there 16 years and would like .the City to" compensate Mrs. Meier for the property and keep it as a nature area. A. Siegel, 7951 Hill Trail Ct., stated he didn't like the idea of hacking up the residential area with later day roads. The area is of low elevation and has a concern on runoff and more swamp and brush. He asked who would pay for an improved access. Arlene Grayson, 1916 E. 4th St., St. Paul, daughter of Mrs. Meier, asked if theycould collectively come together with creative thinking to address this situaiton now. Richard Meier, son of Mrs. Meier, stated his father has been paying taxes on this property since 1958. Perk tests have not been done until access can be determined. Mayor Dunn closed the public hearing at8:35 p.m. Councilman Hunt asked the City Attorney.if the Council should not approve this right-of-way access, does this constitute taking of land. Knaak answered that this land has been unbuildable for many years, but the Meier's would not be aware of it until they came in with a request. The Council was under no obligation to approve this request. Larry Bohrer stated there is access to the property, but building a driveway to a house is another matter. The attorney stated she can utilize this as an access, but to bear in mind, if she should miss it, she would be considered trespassing. MIS/ Graves/Moe - to deny the variance request for lot size and frontage based on no hardship was presented, and there was a potential for other variances being required because a contour map, building site plan and soil borings have not been submitted and potential disruption to the adjoining propertyowners. Councilman Williams suggested the propertyowners and. Mrs. Meier get together to decide if they are interested in buying this land. Councilman Hunt was against the variance requests, but favored keeping the public hearing open so the Council could respond to the propertyowners' requests. M/S/P Williams/Hunt - to postpone consideration of this motion until the June 20th Council meeting in hopes the property owners can get together. (Motion carried 4-1: Graves: He sees variances for: lot size, road frontage, building a non -conforming road, size of the lot for septic system (perkable soils) with potential variances needed to put a structure in the future. If multiple variances are granted, this makes our code ineffective) The Council suggested Mrs. Meier contact the assessor for a fair market value and the City would provide them a list of adjacent propertyowners to contact that might be interested in purchasing this land. E. PLANNING COMMISSION FORMAL MOTIONS: May Meeting An extract of the Planning Commission motion of their May 22nd meting was submitted to the Council. LAKE. Authorization to Prepare Specificaiton to Advertise for Bids for Pumper Fire Chief Fran Pott explained that the Fire Department's CIP Budget for 1988 included purchase of a 1,000 GMP pumper and the anticipated expenditure of the Pumper is approx. $170,000 which was recommended be funded through the issuance of an Equipment Certificate if the Council chooses to proceed. This Pumper will replace a 1963 750 GBM pumper and the value of this pumper has not been determined. If the need comes up for a third fire hall, Fran felt a better pumper would be needed. M/S/P Graves/Williams - resolved that the Fire Chief is hereby authorized to proceed with preparation of specifications and advertisement for bids for a new crew cab, 1,000 GPM pumper. (Motion carried 5-0). B. Discussion --Issuance of Burning Permits Fran Pott requested that the Council formally authorize him to directly issue burning permits rather than having residents apply to the MPCA for the permits. MPCA requires Council formal action on this matter. The City has already adopted by Ordinance, Minnesota Rules, parts 7005.0700 to 7005.0820. M/S/P Williams/Graves - resolved that the Council hereby directs the Dept. Administrator to submit a request to the MPCA requesting that Fire gljyof, lIV401VOVV/ be formally authorized to issue Burning Permits on behalf of the City of Lake Elmo. (Motion carried 5-0). C. Discussion --Roof Repair Because bids had not been received, Fran Pott requested postponement of this item . M/S/P Graves/Moe - to postpone the request for roof repair on Fire Station #1 until the bids have been received. (Motion carried 5-0). 9. CITY ENGINEER'S REPORT: A. Payment #2, 43rd St., Kimbro Ave. (Drexel Const.) City Engineer, Larry Bohrer, recommended approval of Payment #2 to Dresel Contracting in the amount of $56,914.88 for 43rd and Kimbro MSA Improvements. M/S/P Graves/Williams - to approve Payment #2, in the amount of $56,914.88, to Dresel Contracting for 43rd and Kimbro MSA Improvements. (Motion carried 5-0). B. Payment #2, 39th St., (C.W. Houle) City Engineer, Larry Bohrer, recommended approval of Payment #2, to C.W. Houle, Inc. in the amount of $27,095.57 for 39th Street Improvements and passing onto the Developer for this payment in accordance to the Developer's Agreement. Houle Inc., in the amount of $27,095.57 for 39th Street Improvements and passing onto the Developer for this payment in accordance to the Developer's Agreement. (Motion carried 5-0). C. Request for Release and Discharge of Surface Water Drainage Easement, Lake Rose to West Lakeland Storage Site City Engineer, Larry Bohrer, reported that in 1981, the City of Lake Elmo conducted a pumping project to remove excess flood water from Lake Rose, which was threatening the Cimarron Treatment Plant, and pump it to the West Lakeland Storage Site for disposal. A temporary easement was obtained from the owners of: the property at that time. The property in West Lakeland Township is now being platted and the title company requests that the City release this easement to clear the title. Bohrer recommended that the city release and discharge this easement according to the form provided by the developer's attorney, because the City understood the easement expired on May 15, 1981, and there is no longer a need for this easement. M/S/P Hunt/Graves - to adopt Resolution No. 89-34, A Resolution to Release and Discharge Easement described as follows: That certain Surface Water Drainage Easement and Agreement dated Novmber 11, 1980, recorded December 15, 1980, and Doc. No. 412741 in the office of the Washington County Recorder. (Motion carried 5-0). M/S/P Graves/Hunt - to amend the Council agenda to include 9D. Creekside on DeMontreville as requested by the City Engineer. (Motion carried 5-0). D. Escrow Release No. 1, Creekside on DeMontreville Larry Bohrer reported that the grading and storm sewer are substantially complete on the Creekside on DeMontreville Improvements. Bohrer recommended that the letter of credit be reduced as follows: Original Letter of Credit $120,000.00 Less Grading and Storm Sewer -$ 43,578.50 Less Staking and Inspection -$ 6,000.00 Less 25% per Ordinance _$ 12,3994.61 Remaining Letter of Credit $ 58,026.88 M/S/P Graves/Moe - to approve Escrow Release No. 1, Creekside on DeMontreville as recommended by City Engineer Larry Bohrer. (Motion carried 5-0). 10. CITY ATTORNEY'S REPORT: The City Attorney submitted to the Council his monthly report on pending litigation. LAKE ELMO CITY COUNCIL MINUTES JUNE 6, 1989 PAGE 9 ( 11. CITY ADMINISTRATOR'S REPORT: A. Discussion re: Park, Reserve Directional Signs Administrator Morrison advised the Council that the City has received calls of concern from residents living on Klondike, 34th Street and 32nd Street, indicating that there has been a considerable amount of traffic on their streets by persons trying to locate an entrance to the Regional Park. Directional signs were suggested to be placed at Klondike Avenue; Lake Elmo Avenue/TH.5; Lake Elmo Avenue and C.R. 10, and another on Lake Elmo Avenue, between TH.5 and C.R. 10. Mike Polehna, Regional Park Director, has advised Washington County would pay for the signs if the Council desires to have them installed and get the necessary approval from MnDOT. Councilman Williams favored soliciting comments from residents on whether they felt directional signs would be a reasonable solution. M/S/P Dunn/Moe - resolved that the Administrator is hereby authorized to formally request that Washington County install Lake Elmo Regional Park directional signs in appropriate locations, as suggested, to alleviate problems in finding the entrance to the Park. (Motion carried 5-0). B. Resolution No. 89-33: Approving Large Lot Subdivision (Ziertman) When the City Council approved the last Large Lot Subdivisoon of Mr. Ziertman, they requested review of the Resolution after receipt of the surveys for the two approved Large Lot Subdivisions. The survey has been received and the Resolution, which was approved by the City Attorney, was presented for Council review. The staff reported the park dedication fee ($450.00/lot) will be collected at the time of application for the building permit. M/S/P Williams/Graves - resolved that Resolution No. 89-•33; A Resolution Granting a Large Lot Subdivision to Robert and Dorothy Ziertman is approved as submitted. (Motion carried 5-0). C. Request to Stockpile Dirt: Linder's Greenhouse Rob Linder, of Linder's Greenhouse, has an opportunity to receive 10,000 cubic yards of soil which can be used for potting of plants. The City does not have in the Code any provision to addresss stockpiling of fill. The Building Official and the City Engineer had no problem with this request. M/S/P Graves/Hunt - to direct the staff, with the assistance of the City Engineer, to draft a proposed Ordinance requiring a permit process setting forth standards and conditions for fill permits. (Motion carried 5-0). Discussion followed on the interpretation of Mining--�he Council suggested exclusion be made for bringing soil from one site to another site for utilization on that site is not considered mining) This section (900-1) of the Code needs to be revised because the City does not allow any more mining. Award of Bid - Parks Mower The 1989 Budget provided for an expenditure of $500.00 for a self-propelled mower for the Parks Department. The mower will be used largely for cutting of slopes and around trees and structures. The Public Works Supervisor has received four quotes for the mower: Polfus Imp-$379.00, Century Power-•$380.00, Meier's Hardware--$423.71, Gary Lee (Homelite)--$379.00. Dan Olinger recommended purchasing the John Deere mower fo Polfus Implement, in the amount of $379.00, as they have been excellent in the past with service and parts. M/S/P Graves/Dunn - resolved that the Council hereby approves the purchase of a John Deere, 4 1/2 HP, self-propelled 21" mower from Polfus Implement, in the amount of $379.00. (Motion carried 5-0). E. Discuss July 4th City Council Meeting The first regularly scheduled meeting in July falls on the July 4th Holiday. In the past, this meeting has been cancelled. M/S/P Hunt/Graves - to cancel the July 4th City Council meeting. (Motion carried 4-1: Moe)TToe: He was available for the meeting. (Amended 7/18/89) F. Satellite Inquiry - Councilman Moe Councilman Moe had received a complaint, conducive to the health, safety and welfare, on the rental farming done in the City without the convenience of portable satellites. The staff will look into how other areas are addressing this situation. G. Council Workshops M/S/P Graves/Moe - The City Council will hold a workshop relative to Section 32 on Tuesday, June 13th at 7:30 a.m. at City Hall.. (Motion carried 5-0). M/S/P Graves/Hunt - The City Council will. hold a workshop on the 1989 Budget on Tuesday, June 27th, at 7:30 a.m. at City Hall. (Motion carried 5-0). H. Other: Connie Wichelmann and a neighbor expressed an interest in purchasing a City parcel, of just under one acre, south of 28th St. N. off of unimproved Ivy Avenue, to enlarge their existing residential lots. The Council expressed a desire in selling and requested the City Assessor be contacted to get a property appraisal. The Council also suggested checking if the Parks Commission would be interested in this property. M/S/P Graves/Moe - to adjourn the City Council meeting at 10:44 pm. Motion carried_ 5-0). PRESENT: Mayor Dunn, Councilmembers Graves, Hunt, Moe and Williams. Also Present were: Fire Chief Fran Pott, Public Works Supervisor Dan Olinger, Finance Director Marilyn Banister and City Administrator Pat Morrison. Fire Chief Pott presented his proposed estimated 1990 Budget expenditures of $105,817. Chief Pott discussed briefly the five-year CIP for the Fire Department, incorporating the approximate $170,000 for the pumper in 1990/91. He also reviewed the need for firefighters and suggested moderate income housing may help with recruitment. Chief Pott reviewed line item expenditures, answered questions of the Council, discussed firefighter training needs and supplies and equipment requirements. Public Works Supervisor Dan Olinger addressed questions from the Council. The Council requested that the Public Works Budget expenditures for maintenance (patch and overlay) work on City streets be segregated and defined separately and specifically in the final Budget document. Mr. Olinger advised: the shop supplies budget was increased considerably to purchase metric tools; $5,000 was requested to purchase new entry signs into the City; educational funding was sufficient. The Administrator requested formal Council approval of the Century Fence bid, in the amount of $3,760 for replacement of the Lions Park outfield fence. Funding for this was anticipated to include $2,000 contribution from the Lake Elmo Jaycees and funds budgeted for the play equipment at Reid Park transferred toward this fence, as Jaycees had paid for the play equipment also. M/S/P Hunt/Williams - resolved that the City Council hereby approves the bid of Century Fence Co., in the amount of $3,760 for replacement of the outfield fence at Lion's Park, and accepts contribution of $2,000 from Lake Elmo Jaycees. Avenue and Keats Avenue 47th St, from Keats to Kimbro Kimbro Avenue and 43rd to Lake Elmo Avenue Keats Avenue from 47th to Highway 36 Klondike and 33rd St., from Highway 5 to Lake Elmo Avenue Upper 33rd St, and Laverne Ave., from Lake Elmo Avenue to Highway 5 30th Street from Lake Elmo Avenue to Manning Avenue 20th Street from Lake Elmo Avenue to Manning Trail All of the above comprise just over nine (9) miles of ^icipal State Aid Streets. Without changing the density proposed for the area, perhaps a trade-off could be made with the Ag zoned property north of this property. I have no idea what the intentions of Mr. Lauseng or the Klawitter's is, but it appears that Mr. Lauseng has a flourishing business going and in all probability, won't be giving that up for sometime. I have attached a map of the area that shows th property. The Planning Commission reviewed the future land use map at its May 8, 1989 meeting, and on a vote of 8-1 supported the map.
