CROIX AREA UNITED WAY WEEK and urge all citizens, businesses, and all other organizations in the St. Croix Valley area to pledge support of this worthwhile cause - the UNITED WAY to help people in our communities in their time of need. Discussion ensued on proposed salaries, overtime, comparable worth and comparable salaries. Mayor Dunn called the City Council meeting to order at 7:06 p.m. in the City Council chambers. PRESENT: Dunn, Hunt, Williams, Graves, Moe, City Engineer Larry Bohrer, City Attorney Fritz Knaak, and City Administrator Pat Morrison. 1. AGENDA M/S/P Graves/Williams - to approve the July 18, 1989 City Council agenda as presented. (Motion carried 5-0). 2. MINUTES: JUNE 20, 1989 M/S/P Graves/Hunt - to approve the June 20, 1989 City Council minutes as amended. (Motion carried 4-1-0 Abstain: Moe). MINUTES: JUNE 6, 1989 M/S/P Graves/Hunt - to bring back the June 6, 1989 City Council minutes for reconsideration. (Motion carried 5-0). Mayor Dunn referred to an error in the closing time of the Public Hearing on Page 3, which should state: the Public Hearing was closed at 7:34 p.m. Councilman Moe was asked for his reason for voting against the motion (page 10) on cancelling the July 4th Council meeting. PUBLIC INQUIRIES Councilman Moe requested investigation of possible causes that could have lent to the flooding of Dora Lee's property at 635 Cimarron when the rain storm occurred on June 30, 1989. mayor Dunn responded to Lee's complaint by cPn.tacting Al Dornfeld, VBWD, Fahich resulted with theip :.T.n 1T 1 t �qtter. The Valley Branch Watershed District stated in their July etter to Ms. Lee, they have no control of rain fall events or authority to correct the problem of sedimentation at the storm water culvert inlet in Cimarron. LAKE ELMO CITY COUNCIL MINUTES JULY 1.8, 1989 PAGE 2 The City Building Official, Jim McNamara, City Engineer Bohrer, and Cimarron Management have been notified and Cimarron's maintenance dept. will take care of it. 5. REAPP REPORT ReAPP member, Teddie Carlson, reported Rossana Armson responded to ReAPP's request to review the structure of Genereux's questonaire with such findings: bases of data should be over 300 people interviewed rather than 60 people, the overlay picture depicting an active landfill was misleading because it only looked like a hill, and some of the questions could be interpreted as being biased based on the picture shown. Armson's letter was directed to Pat Morrison and will be forwarded to Zack Hansen. ReAPP will have a fair booth, in conjunction with the Solid Waste Advisory Committee, on recycling at the Washington County Fair and they will have available the on -going petition for signatures. 6. RECOMMENDATION: RECYCLING The Lake Elmo Solid Waste Advisory Committee recommended the City Council accept the following recommendation: to renew the contract with TMT Recycling at the rate of $85.00 per ton for recyclables picked up, twice a month, in the City of Lake Elmo, and that this contract be renewed thru December, 1990. When the City Attorney was asked if refuse hauling was considered a professional service and should this contract be sent out for bids, Attorney Knaak responded this was more like road surfacing and not considered a professional service. Therefore, the contract should be submitted for bids. The Council was pleased with the service Maroney's firm has given the City, but the Council was prepared to go through the process of soliciting bids. Therefore, the following motion was made. M/S/P Williams/Graves - to renew the contract with TMT Recycling at the rate of $85.00 per ton for recyclablespicked up, twice a month, in the City of Lake E'mo, and that this contract be extended from September 1, 1989 thru December, 1989. (Motion carried 5-0). M/S/P Hunt/Graves - to direct the City Administrator, with the assistance of the Solid Waste Committee, to advertise for bids for the recycling contract for the year 1990. (Motion carried 5-0). PLANNING/LAND USE/ZONING: A. Large Lot Subdivision, Laura Buggert (Owner: Modernistic Die Co.) LAKE ELMO CITY COUNCIL MINUTES JULY 18, 1989 PAGE 4 i The Administrator will contact Wyn John and Nancy Hansen and inform them of the Council's request. D. 1989 Comprehensive Plan Status Administrator Morrison, Comp Plan Sub -Committee Chairman Dick Johnson, PZ Chairman Rob Enes and Deputy Clerk Mary Kueffner met with Met Council planners for their input on the Comp Plan. Morrison indicated the Plan was looked upon favorably with only a few changes requested. Dick Johnson explained the Met Council would like to see more information on Parks, definite numbers relative of Section 32 (Section 32 Land Use Map was ommitted in the Plan submitted), numbers on Section 32 sewer plan by City Engineer and more numbers on the airport. Johnson would like to see a section on Capital Improvements based on his opinion the purpose of a Comp Plan is to guide the City on what future services are going to be required based on the projected growth. The Met Council could care less about Comp Plan format, Johnson added, and recommended proceeding with the Plan that Mary had put together. Extensive discussion followed on which Comp Plan format the Staff was directed to follow: The format of the 1979 Comp Plan or the March, 1989 Planning Commission draft Comp Plan. MIS/ Hunt/Williams - that the Planning Commission be allowed to continue to update the PZ's current version of the Comp Plan of the PZ Sub -Committee (March, '89). M/S/F Graves/Moe - to amend the motion to include the PZ version of the Comp Plan be submitted to the City Council by July 25, 1989. (Motion Failed 2-3: Dunn, Williams, Hunt: totally unrealistic --the City staff would not have their version done at that time.) M/S/P Hunt/Williams - that the Planning Commission be allowed to continue to update the PZ's current version of the Comp Plan of the PZ Sub -Committee (March '89) with the two plans (PZ and Staff's) submitted (no specified date) simultaneously to the Council for comparison. (Motion carried 3-2 Graves,Moe: they have a workable document in front of them now which they would support and recommend the staff and Comp Plan Sub -committee be allowed to continue updating this draft proposal). M/S/P Graves/Moe - to direct the staff, (staff includes City Engineer) tc continue working on updating the proposed draft of the Comp Plan, following the recommendations from the Met Council. (Motion carried 3-2.: Hunt, Williams: the Comp Plan should come from the PZ and not the City Staff.) Administrator Morrison requested clarification of direction from the Council, she asked if the Council wanted staff to proceed with the Plan typed by Mary by incorporating Met Council's recommendations, and, if the Sub -Committee of the Planning Commission was to use the format of the March, 1.989 Planning Commission draft Comp Plan and proceed with completion on the basis of that format. The majority of the Council indicated this was the direction they desired. LAKE ELMO CITY COUNCIL MINUTES JULY 18, 1989 PAGE 3 Linda Besk, realtor representing Laura Buggert, has made application for a 10 acre Large Lot Subdivision from a 110 acre tract of property zoned Rural Residential. The Planning Commission recommended, unanimously, that the Council grant this large -lot subdivision. Linda Beak stated they are in the process of rectifying an encroachment problem with the Smith property and would not have a problem providing a Certificate of Survey because they are required to have a survey at the closing on Friday. M/S/P Hunt/Williams - to instruct the staff to prepare a resolution granting a 10-acre large lot subdivision to Modernistic Die/Laura Buggert based on aright -of -way dedication for Lake Elmo Avenue, submission of certificate of survey, and based on the applicant paying a park dedication fee of $450 for the newly created lot. (Motion carried 5=0). B. Architectural Standards The staff prepared suggested architectural standards for the business district within the city. The Planning Commission received these recommendations at their meeting of June 26th and accepted them with some .additions. The Commission recommended that the standards be quantified for nuisance type operations. The Administrator asked if the Council wanted to have these standards set out in the code or referred to by MPCA Regulations. City Attorney Knaak suggested these standards be set in the Zoning Code and in the Nuisance Section. Planning Commission member, Ed Stevens advised the Council the PZ did not specifically state to submit, or don't submit the standards to the Council. It was his understanding that the PZ would want to review the complete text. The Council postponed action and requested the PZ continue on working with the City Administrator's recommendations. C. Future Park Needs A summary of future parks needs, as proposed by Nancy Hansen and Wyn John, was provided for Council consideration. The Parks Commission did not site specific parcels of land to be set aside, but instead determined it more appropriate to identify general areas. Some of the Councilmembers noted these points were good general concepts, but would like more specifics for identifying specific guidelines. The Council requested they break the Future Land Use Map into specific sections and identify potential park sites. Williams suggested looking at how a developer's plan would coincide with the next developer's plan, so if there is land inbetween that would make good park land, then we can make sure both of them contribute to the same parcel to increase the size. The recommendations should be brought to the Parks Commission for their approval. LAKE ELMO CITY COUNCIL MINUTES JULY 18, 1989 PAGE 5 B. CITY ENGINEER'S REPORT: A. Lake Jane Erosion Jack McGee, Chairman of the Lake Jane Marine, Recreation & YathtClub, advised the Council in a letter dated July 3, 1989, of an erosion problem due to a sewer culvert that carries water from Jane Court under Jane Road and spills onto Lot 2, Berschens Shores. They requested the City to cover the expense of an extension for the culvert, either by a concrete spillway or a ditch with trap rock applied. Two estimates were furnished. There are 13 area families that make up this association who have a 75 foot easement over this lot. They do not own the property, but do pay the real estate taxes and have the owner's approval. City Engineer Bohrer considered this "nuisance erosion" and speculated this culvert was installed when the Jane Court improvements were put in, about 20 years ago, which was before this area was part of the City. Bohrer did not do a complete title search, but speculates there is no drainage easement across this Lot 2. After review by the City Engineer, the Council viewed this as a pre-existing condition that the applicants were aware of when they took this recreational easement, and Council determined that it would be inappropriate for the City to expend funds, outside of the budget, for improvement to private property. M/S/P Graves/Moe - to direct the City Administrator to prepare a letter . stating it is not in the City's best interest to participate in an erosion controlled project. (Motion carried 5-0). B. Partial Payment #3, 39th St., C.W. Houle M/S/P Graves/Hunt - resolved that the Council hereby authorizes payment of Partial Payment #3, for 39th Street Improvement to C.W. Houle of Roseville, said payment in the amount of $38,226.89, to be made by the City upon receipt of payment from the developer. (Motion carried 5-0). C. Partial Payment #3, 43rd & Kimbro, Dressel Cont. M./S/P Graves/Moe - resolved that the Council hereby authorizes Partial Payment #3, for the 43rd & Kimbro Street.Improvement, in the amount of $35,088.36 to Dressel Cont. of Forest Lake. (Motioncarried 5-0). 9. CITY ATTORNEY'S REPORT: The Lake Elmo Pending Litigation Report was presented to the Council by City Attorney Knaak. 10. CITY ADMINISTRATOR'S REPORT: A. Planning Commission Resignation: Al Kunde Al Kunde submitted his resignation from the Planning Commission on July loth and a letter of appreciation has been sent to Mr. Kunde. M/S/P Hunt/Graves - to appoint Rita Conlin to fill the remainder of Al Kunde's PZ appointment. (Motion carried 5-0). M/S/P Hunt/Williams - to appoint Wyn John as 1st Alternate of the Lake Elmo Planning Commission. (Motion carried 5-0). B. Application 3.2 Beer Permit, Huff'n Puff Huff'n Puff Days will be held on August 10-13, 1989. In the past the Council has waived the fee for this event. The Sheriff's Office has reviewed and approved the Permit. M/S/P Hunt/Graves - resolved that, the council hereby approves a. 3.2 Beer Permit for the Lake Elmo Jaycees from August 10th through August 13th, 1989 for Huff & Puff Days, and further that the $10.00 temporary, Beer Permit fee is hereby waived. (Motion carried 5-0). M/S/P Hunt/Graves - to recommend, if possible, the Lake Elmo Jaycees consult with Teddie Carlson of the Solid Waste Advisory Committee concerning the use of more biodegradable and/or recyclables during Huff'n Puff Days. (Motion carried 5-0) C. Meeting with Oakdale Council Representatives The Oakdale City Council has expressed interest in scheduling meetings at which we can discuss issues affecting our boundaries. Mayor. Dunn, Councilman Hunt and Administrator Morrison, with Councilman Graves as an alternate, will attend the July 27, 1989 evening meeting. D. Update: Forthcoming Ordinances The Council recommended the I-94 Freeway Corridor Ordinance wait until the Comprehensive Plan is completed. M/S/P Moe/Hunt - to add as Item 10E. Lake Elmo Park Reserve --Safety Concerns to the July 18, 1989 City Council Agenda. (Motion carried 5-0). E. Lake Elmo Park Reserve --Safety Concerns. Councilman Moe expressed his safety concerns on the intersection of the Lake Elmo Park Reserve which has been the site of some recent accidents. The Council discussed requesting Washington County review safety factors at the intersection of County Road 10 (Minnehaha) and County Road 19 (entrance to the Park Reserve.)
