AUGUST 15, 1989 Mayor Dunn called the City Council meeting to order at 7:00 p.m. in the City Council chambers. Present: Dunn, Hunt, Williams, Moe (arrived 7:05 p.m., City Engineer Bohrer, City Attorney Knaak and City Administrator Morrison. Absent: Graves. 1. AGENDA Item 5B: Correction --After further review by our City Engineer and Building Inspector, they determined that a variance is not required, Add: 8F. Review as Informational, 8H. Other M/S/P Hunt/Williams - to approve the August 15, 1989 City Council agenda as amended. (Motion carried 3-0 Note:Councilman Moe arrived at 7:05 P.M.). 2. MINUTES: August 1, 1989 M/S/P Hunt/Moe - to approve the August 1, 1989 City Council minutes as amended. (Motion carried 3-1 Abstain: Williams) 3. CLAIMS M/S/P Williams/Hunt - to approve the August 15, 1985 Claims #92157 thru #92211 as presented. (Motion carried 4-0). 4. ReAPP REPORT Todd Williams reported that ReAPP had a fair booth:at the Washington County Fair and collected over 600 new signatures on their petition, bringing the total close to the 5,000 mdrk. ReAPP is following up on conversations with Congressman Vento and Congressman Sikorski's office regarding the use of federal funds for the park. It has been called to ReAPP's attention that the County has started the Socio-Economic interviews with summer park users without informing the City or ReAPP. The County had agreed to allow us to view the questionnaire ahead of time. ReAPP will be formulating a letter for the City to send to the County officially protesting this lack of involvement by the City. 5. PLANNING/LAND USE/ZONING: A. PUBLIC HEARING: Variance from OHWM; Shoreland Permit Butzer/Cole, 8180 Hill Trail N. Mayor Dunn opened up the public hearing at 7:09 p.m. in the City Council chambers. Notice was published in our legal newspaper and affected propertyowners have been notified. There was no one to speak for or against the request. LAKE ELMO CITY COUNCIL MINUTES AUGUST 15, 1989 PAGE 2 Stephen Butzer and Patti Cole, 8180 Hill Trail N, have requested a shoreland permit and a variance to the setback requirements of 100 feet from the Ordinary High Water Mark so they can replace an existing deteriorating deck and walkway. Butzer indicated the hardship was the level of safety afforded by the current deck and walkway. According to the Building Official, the proposed plan would not be waterward any more than the existing deck and walkway. The DNR had no concerns with this request. Mayor Dunn closed the public hearing at 7:11 p.m. M/S/P Hunt/Moe - to grant a shoreland permit and variance to Stephen Butzer and Patti Cole, at 8180 Hill Trail N. (Lots 1 and 2, J.L. Cohn Subdivision) for setback from the OHWM based on the fact that the replacement of this deck and walkway would not increase the existing setback non -conformity, and the DNR has no concerns with this request and that no other variances are required, with the hardship being the level of safety afforded by the current deck and walkway. (Motion carried 4-0). B. PUBLIC HEARING: Variance from setback from front road; Shoreland Permit, Dorcas Gersmeyer, 9429 Jane Road N. Mayor Dunn opened up the public hearing at 8:15 p.m. in the City Council chambers. Notice has been published in our legal newspaper and affected propertyowners have been notified. There was no one to speak for or against the request. The public hearing was scheduled based upon the applicant's drawing. After further field review by our City Engineer and Building Official, they determined that a variance from the setback from the road was not required. Mayor Dunn closed the public hearing at 8:16 p.m. Dorcas Gersmeyer, 9429 Jane Road North, is requesting a shoreland permit for an addition to his house. The DNR had no concerns with this request. City Engineer Bohrer reported the addition does include a bedroom, but there is no net increase in bedrooms because they are discontinuing existing bedrooms. Therefore, the septic system is not evaluated under the circumstances and additional lines could be added to the north propertyline. The land where the addition is going to be situated could not be occupied by a drainfield because of the setback of the well. All of the setbacks can be met. Bohrer pointed out to the applicant the well is inside the existing house now, but whenever it needs to be repaired, the well goes outside the house. M/S/P Williams/Hunt - to grant a shoreland permit to Dorcas Gersmeyer, Lot 15, Berschens Shores, commonly known as 9429 Jane Road North, for an addition to his house. (Motion carried 4-0). LAKE ELMO CITY COUNCIL MINUTES AUGUST 15, 1989 PAGE 3 ( C. Preliminary Plat, Packard, Park, 3rd Addition Bruce Folz presented a preliminary plat for Packard Park 3rd Addition which is located east of Lake Elmo Avenue and west of Packard Park 2nd Addition. The Subdivision consists of 25.4 acres and is properly zoned R-1 for the proposed 13 lots which all meet the 1.5 acre minimum lot size. All of the lots have at least one acre of land suitable for septic system purposes and will have land sufficient for two separate drainfield sites. The Lakeshore land area between Lake Elmo Avenue and the lake will be split into four outlets and these outlets will be the extension of the existing proposed lot lines across the road going to the lake. Therefore, each person owning a lot there would own the lakeshore in front of their house. Folz explained the County requested the right-of-way be dedicated as 100' width so the developer will dedicate 17' of additional right-of-way on the westerly side to the County for highway purposes. The Council received Larry Bohrer's reports, dated August 4, 1989 and August 14, 1989, and letters from the VBWD and Washington County. Karen Chandler, VBWD, stated in her letter, August 2, 1989, that the immediately tributary area of Eden Park Pond and Durand's Pond alone will not cause the high water levels. Hence, the effect of the Packard Park development upon the 100-year flood elevation is expected to be minimal. The Council also received concerns and questions regarding this continued development, which were handed out at the August 14, 1989 PZ meeting by Debra Wilfong, 2229 Legion Avenue, and pictures (dated 7-9-89) showing erosion of the holding pond and sedimentation in the outlet pipe. Larry Bohrer explained that the improvements for the 3rd Addition would provide a stormsewer system of catch basins and pipes in 24th Street from 24th Street Court directly into the pond. "Much discussion has centered on whether this subdivision contributes to the problem on Durand's property and the Eden Park Subdivision and the performance of the pond, Bohrer stated, and it is true the pond does not perculate as other ponds we have seen in the City. However, he does not find a code requirement that requires the pond to meet a certain perculation rate". Bohrer indicated the pond is sized according to the adopted 1988 Stormwater Control Ordinance and development of this subdivision would have a minimal effect. In regard to the PZ's recommendation of routing the water from the pond into Lake Elmo, Bohrer had two concerns: (1) transferring water from one sub -watershed into another; and (2) would this controlled drainage into Lake Elmo detrimentally effect the water quality of Lake Elmo. The Council made the following motion in order to review the information that was presented. M/S/ Hunt/Williams - to postpone consideration of Packard Park 3rd Addition until the September 5th City Council meeting. Concerns were expressed relative to the effectiveness of the drainage system and, in particular, the holding pond on the site due to the lack of permeability and seepage from the pond. In an effort to eliminate drainage concerns presented, the Council discussed useage of a storm drainage pipe LAKE ELMO CITY COUNCIL MINUTES AUGUST 15, 1989 PAGE 4 to allow release of surface water from the storage pond into Lake Elmo. Therefore, the following amendment was made: M/S/P Williams/Hunt - to amend the motion to include direct the city staff to contact the VBWD to request permission to allow controlled release of surface water from the existing storage pond into Lake Elmo Lake. (Motion carried 4-0). M/S/P Hunt/Williams - to postpone consideration of Packard Park 3rd Addition until the September 5th City Council meeting and to direct the City Staff to contact the VBWD to request permission to allow controlled release of surface water from the existing storage pond into Lake Elmo lake. (Motion carried 4-0). D. Planning Commission Motions: August 14, 1989 Information Item. 6. CITY ENGINEER'S REPORT: A. Resolution No. 89-36: Resolution Calling for Assessment Hearings City Engineer Larry Bohrer reported assessment hearings need to be scheduled for the following improvement projects: 1. 20th Street 2. 38th and 39th Streets 3. 33rd Street and Klondike Avenue 4. 43rd Street and Kimbro Avenue. These hearings must be held prior to October 10, 1989. Two suggested dates were the regular Council meeting on Tuesday, October 3rd, or a special meeting on Tuesday, September 26. A total of 88 individuals will be notified of the hearings. M/S/P/ Williams/Hunt - to adopt Resolution 89-36 calling for Assessment Hearings for the 1989 Street Improvement Projects for Tuesday, September 26th at 7:00 p.m. (Motion carried 4-0). 7. CITY ATTORNEY'S REPORT: A. Order to Repair or Raze Building (Cozy Cove) The City has made several attempts to work with Elmer Haase, the owner of the Cozy Cove located at 7676 Hudson Boulevard, to upgrade his facility to comply with the Building Code (Building officials's memo dated August 1, 1989). The City Attorney provided an Order to Repair or Raze the buildings. Attorney Knakk explained the City has been pursuing two avenues to address this situation, ie: (1) legal: violation of the building code, and (2) by working with the Lake Elmo Fire Department: two buildings (out of 4) are scheduled to be burned (dependent upon weather) on Saturday, August 26th. LAKE ELMO CITY COUNCIL MINUTES AUGUST 15, 1989 PAGE 5 Fire Chief Fran Pott reported he has talked to Mr. Haase who has agreed to the City burning of 2 buildings (center motel building and building to the west). Pott indicated the buildings cannot be burned to the ground because heat radiation would be too much for the powerlines. The City will have to fence the area and a removal effort is required within ten days. Hunt /Moe - to adopt Resolution 89-37 in accordance with the recormendations of the City Attorney and the City Building Official: An Order to Raze or Repair buildings at Cozy Cove Motel located at 7676 Hudson Blvd. (Motion carried 4-0). 8. CITY ADMINISTRATOR'S REPORT: A. 1989 Law Enforcement Services Contract The City has now received the 1989 Law Enforcement Services Contract from Washington County and a copy of the contract was sent to the City Attorney for his review. M/S/P Williams/Moe - resolved that the council hereby approves the 1989 Law Enforcement Services Contract. (Motion carried 4-0). B. Charitable Gambling Requests (1) License Renewal: Jaycees, Lake Elmo (2) Application for Exemption: Transportation Club of St. Paul-Mpls. Two charitable gambling applications have been received; one is a renewal for the Lake Elmo Jaycees and the second is an Application for Exemption from Charitable Gambling License for the Transportation Club of St. Paul -Minneapolis for an event they have planned for Tartan Park. An exemption is usually asked for when an event is a one-time or once a year event. The Council had no problems with these Charitable Gambling Requests. C. Request for Off -Sale Non -Intoxicating Malt Liquor License: Retail Foods of MN, a Division of Gateway Foods of Mpls, Inc. dba Brooks Food Market The staff reported there has been a change of ownership of the Brooks Superette located on loth Street an Lake Elmo Aveue; therfore, a new license to sell off -sale non -intoxicating malt liquor is required. The staff had not received approval, prior to the Council meeting, from the Washington County Sheriff's Department and County Attorney. M/S/P Hunt/Williams - to grant off -sale non -intoxicating malt liquor license to Retail Foods of MN, a Division of Gateway Foods of Mpls. Inc., dba Brooks Food Market located at 11025 loth St. N., for the remainder of 1989; contingent upon a favorable recommendation from the Sheriff's Department and County Attorney. (Motion carried 4-0). D. Report from Building Inspector/Code Enforcement Officer re: CUP, Trans City Investment LAKE ELMO CITY COUNCIL MINUTES AUGUST 15, 1989 PAGE 6 When he received complaints about rodents in this building, Jim McNamara requested the building be checked out by the State Dept. of Agriculture and Washington County Health Dept. No violations were issued. Jim McNamara contacted Howard Gelb, Trans City Investment, 11490 Hudson Boulevard, in regard to the Trans -City Investment C.U.P. When the C.U.P. was granted there were six businesses in the building. Although the building has not increased in size, nor has the number of people actually changed, the number of businesses has increased from six to 13. At this meeting Howard Gelb presented a list of tenants located at Trans -City Investments and will issue a letter to the City when a tenant leaves or comes in. As required at the time the C.U.P. was granted in 1987, McNamara indicated the septic system for Trans City Investment was replaced and the system for the farm house was also replaced. Outside storage has been eliminated and signs that were erected for the various businessess, without a sign permit, have been removed. The Council emphasized this Conditional Use Permit will be reviewed on an annual basis, and may be rescinded, after a two week notice and a public hearing if the City Council finds that the conditions have been violated or the public health, safety, or welfare is jeopardized.': E. Authorization: Installation of Cable Equipment The City has applied for and received a grant to obtain funding for cable equipment, installation and training. Staff will be receiving training on useage of a new Amiga system next week. The balance of the equipment (cameras, wiring cable, etc.) is ready for installation. M/S/P Moe/Hunt -that the Lake Elmo City Council hereby approves the installation of cable equipment, as outlined in the grants application approved May 11, 1989, and further, that the Council determines this equipment will be utilized at minimum of four times per year, as recommended by the Ramsey -Washington Counties Suburban Cable Commission representatives. (Motion carried 4-0). F. Request for Approval: Star City Joint Powers Agreement The Council reviewed the Joint Powers Agreement for participation in the Sillwater Area Star City Commission. The Council determined that they did not desire to participate in the program to the degree outlined in the Agreement. Instead, they felt it appropriate to continue to participate at the level they have in the past which allows for sharing of information and participation in meetings. G. Discussion: VBWD Appointment Washington County has indicated that the term of office for Gordon Moosbrugger, West Lakeland Township, on the Valley Branch Watershed District will expire on November 13, 1989. West Lakeland Township has notified the County of their support for the reappointment of Mr. Moosbrugger to a new three year term. *The Council made specific mention that Mr. Gelb will notify the City of change in use of his building. Mr. Gelb responded that not notifying the the City will never happen again. Since we do not have time to discuss every point presented, it may seem that decisions are preconceived. However, background information is provided for the City Council on each agenda item in advance from City Staff and appointed Commissions; and decisions are based on this information and past experiences. In addition, some items may also have been discussed at previous Council meetings. if you are aware of information that hasn't been discussed, please fill out a "Request to Appear Before the City Council" slip; or, if you came late, raise your hand to be recognized. OTHER PAGE 7 of Gordon Moosbrugger of the Valley Branch Groundwater Management Plan: Councilman Williams reported that the Washington County Planning Department is to prepare a county -wide groundwater management plan which will begin this fall with the appointment of a 15-member advisory committee. The Council advised this request for appointment to serve as a member of this Groundwater Task Force be submitted to the PZ and advertised in the City newsletter. Safety Concern: The Council discussed their safety concern, for both summer and winter driving, on the intersection of the Lake Elmo. Park Reserve. Administrator Morrison reported the Washington County Public Works Dept. had been informed of the Council's concern and the County was studying the situation. M/S/P Moe/Williams - to direct the staff to write a letter to Washington County reinforcing our position letter for maximum safety measures. (Motion carried 4-0).
