Mayor Dunn called the City Council meeting to order at 7:24 p.m. in the
City Council Chambers. Present: Dunn, Hunt, Williams, Moe, and
Administrator Morrison. Absent: Councilman Graves.

5. PLANNING/LAND USE/ZONING:
A. PUBLIC HEARING: Variance: Side Yard Setback
Thomas Arcand, 9202 31st St. N.
Mayor Dunn opened up the Public Hearing at 7:32 p.m. in the City Council
chambers. The Public Hearing notice was duly published and all property
owners adjoining this property have been notified. There was no one to
speak for or against this request.
Thomas Arcand, 9202 31st Street N., has requested a side yard setback
variance to construct an addition to an existing garage approximately 2
1/2 feet from the abutting property line whereas 10 feet is required. The
applicant proposes to enlarge the existing structure to a 2-car garage to
store two cars and a. boat. Arcand stated his hardship is a narrow,
long-linky type lot which makes this the only place for a garage, and the

driveway access is small and regular size vehicles are hard to maneuver.
The garage does not provide adequate storage space (his house has no
basement), nor enough room to house both vehicles or allow for summer boat
storage.
Letters were provided from the abutting property owners, Douglas Magnuson
at 9198 31st St. and Eugene Merier at 9240 31st St., in which they
indicate approval of this request. Jim McNamara, Lake Elmo Building
Official, stated in his memo, dated October 13, 1989, an inspection of the
property indicated this location would be appropriate for the requested
addition contingent upon Council. approval. The addition would not
interfere with the septic system or the expansion of the drainfield area,
if needed in the future.
Mayor Dunn closed the Public Hearing at 7:35 p.m.
Mayor Dunn and Councilman Moe had visited the site and indicated this
would be the only area to place the garage. Councilman Williams had
visted the site, had a concern for an alternate drainfield site on a lot
this small and concern that a legal hardship was demonstrated. Councilman
Hunt explained our City has many small lots that have been left over from
previous developments prior to restructuring of our Code and most people
consider a two -car garage today a necessity. There are unique features on
this .land that are keeping him from going into any other direction. The
layout of the land does appear to warrant this variance.
M/S/P Hunt/Moe - to approve the variance to sideyard setback (2 1/2 feet
versus 10 feet) for Thomas Arcand, 9202 31st Street N., to construct an
addition of approximately 190 sq.ft. to an existing 360 sq.ft, garage;
based on hardship being the layout of the lot only enables Mr. Arcand to
go to the West direction with his addition; There was no opposition
received from the neighbors, letter dated October 13, 1.989 from Jim
McNamara stating this location would be appropriate for the addition and
the addition would not interfere with the septic system for the expansion
of the drainfield area. (Motion carried 4-0).
B. PUBLIC: HEARING: Variance: Size of Accessory Building
Steve Johnson, 2945 Lake Elmo Avenue
Mayor Dunn called the public hearing to order at 7:45 p.m. in the City
Council chambers. The Public Hearing notice was published and all
propertyowner.s adjoining this property have been notified.
Stephen and Elizabeth Johnson are requesting a variance to the size of an
accessory structure in the R1 Zoning District. The applicant proposes a
2000 sq.ft, accessory structure whereas 1000 sq.ft. is allowed by code.
The applicants are in the process of purchasing the property at 2945 Lake
Elmo Avenue, along with a 30 foot parcel of land that would allow access
to the back of this property off of 30th Street. There is, presently, no
access to the rear parcel, and the house is on a very small lot with no
room for a driveway on either side of the house.
Steven Johnson stated they have lived at 5831 Hytrail in Lake Elmo for 12
years and are in the process of purchasing 2945 Lake Elmo Avenue. They
are requesting.a 2,000 sq.ft. accessory (Morton) storage building to store

3 cars, 3 snowmobiles, 2 boats and a possible motorhome, behind their home
where it will be secure and not seen from any road. They are planning a
10 foot driveway, paved with asphalt or concrete, which would be behind
the main tree TSx976.injheir intentions are to leave as many trees as they
possibly can and to bring in several 6-8 foot spruce or green Norways to
line the driveway and around the shed area.
Phillip Taylor, 11227 30th St. N, stated he was against the size of the
building because this would set a new precedent and would not fit in this
area.
Bill Rohrer, 2989 Lake Elmo Avenue, asked how much of the tree line do you
intend to preserve? Johnson responded he wanted to retain every tree
because he didn't want the shed seen for security purposes. What would the
height be on centerline? The height on the sidewalls would be 9 ft. and
the centerline would be approx. 1.4 feet. Rohrer voiced his concern, his
lot looks out on the NW corner of this property, his children play back
there and they enjoy the treeline as it stands now. They would prefer not
to see any building back in that area. He asked if it would be possible
for the neighbors to comment on the trees that are taken out. Johnson
invited comments from the neighbors as he did not want to alienate his
neighbors.
Julia Ashley, 11.205 30th. St.N., voiced her concern on what happens in ten
years when the property is sold and someone else moves in with other
intentions that the City would have no control over. What about lighting?
Johnson responded there would be no lighting unless there are problenswith
vandalism. Johnson believed the City has control over this property which
should never be used for other than residential uses. He believes this
proposed use may be a varied use from what others have thought of doing
with the land --he does not want to break up the property and develop it in
anyway.
Mrs. Charles McCoy, 2.915 Lake Elmo Avenue N., asked, other than that shed,
would you be leaving everything "As Is". Johnson responded, absolutely.
Mike Mazzara, 11259 30th St. N., stated he was not excited about having a
driveway next to his house, but it could be worse --somebody else could put
a house back there. Mike had no problem with the size as it cannot be
seen behind the tree line. The tradeoff here as he saw it, Mike would
rather see a storage building with little use versus a house with alot of
use.
Mayor Dunn closed the Public Hearing at 8:04 p.m.
Mayor Dunn asked if all. these items are stored in his garage at his
residence because she visited this site and didn't see outside storage.
Johnson responded they are acquiring a pontoon boat with the purchased
property and their speed boat is stored at a friend's house while they are
moving. They have sold their motorhome, but plan on purchasing another in
the future. Dunn had a problem with a request for a building double the
footage (2000 sq.ft.) of what is permitted (1000-sq.ft.) in a residential
area and asked what would the hardship be. Johnson responded the hardship
is the access in front of the house is on a slight incline and you cannot
park anything there. Parking of these vehicles would be in the front and

detract from the house which is seen from Lake Elmo Avenue. He does not
j get full benefit 'Of the property. If there is an heir to the Collopy
Estate, Johnson stated he will buy this strip to have an access to this
property which would make almost five acres total. Dunn suggested the
applicant come back when this is settled.
Councilman Williams clarified the variance request before the Council is
not hinged on the access to the property. The Council was going beyond
their legal authority and should address this specific variance request at
this time. Williams could not accept possession of many vehicles as a
legitimate hardship.
Administrator Morrison pointed out the applicant could not subdivide this
property because he does not have proper road frontage and a hardship,
other than economic, has to be demonstrated.
Johnson asked the Council about the possibility of erecting a 1,000 sq.ft.
accessory building with a 1,000 sq.ft. canopy to keep the snow off the
motorhome. Esthetically to the neighborhood, Johnson felt the motorhome
should be enclosed rather than leave it outside. The Council looked at
this as a building code question and asked. Mr. Johnson to contact the
Building Official to review this proposal.
M/S/P Williams/Hunt - to deny the variance request of Stephen and
Elizabeth Johnson, 2945 Lake Elmo Avenue, for size of accessory structure
in R1 Zoning District, 2000 sq.ft. versus 1000 sq.ft. allowed by code,
based on lack of a demonstrated hardship. (Motion carried 4-0).
C. Resolution No. 89-42 Large Lot Subdivision: Gilbert Sullwold
At the March 7, 1989 Council meeting, the staff was directed to draft a
resolution granting a large lot subdivision to Gilbert Sullwold. The
Council reviewed the draft resolution.

large lot subdivision to Gilbert Sullwold. (Motion carried 4-0).
D. Reconsideration of Extension of Fill Permit for Ed Gorman
M/S/P Williams/Hunt - to open for reconsideration the motion to deny Ed
Gorman's request of fill permit extension. (Motion carried 4-0).
Councilman Williams prepared, with the assistance of the City Attorney,
appropriate Findings of Fact in a Resolution. The Council reviewed the
submitted Resolution and amended the following: No. 12 .....drainage, it
being a source of,

6. CITY ENGINEER'S REPORT:
This item was deleted from the Agenda, as the City Engineer did. not have
any reports.
7. CITY ADMINISTRATOR'S REPORT:
A. Payment to Compost Workers
The Council, at their meeting of September 26th, requested the City
Administrator review hourly rates paid to compost workers.
Administrator Morrison reported the City receives $2,500 per year for
payment to the compost workers. A maximum of 546 hours could be worked.
Therefore, if all hours were worked, the hourly rate in order to stay
within budget, should not exceed $4.58 per hour. Scout Troop $162
received $1,200 for work, performed on weekends during Spring and Fall.

when the compost is open, the compost workers are paid the minimum wage of
$3.85 per hour. Morrison explained it may be possible to pay a higher
then minimum hourly rate by decreasing Scout hourly rate to equalize wage
rate or if City contributed to payment of workers.
Mayor Dunn indicated the pay should be equalized and strongly encouraged
the Solid Waste Advisory Committee, who has been actively working on this
project and the grants, review past proposals and come back with a
recommendation
M/S/P Hunt/Williams - to refer Item 7A. Payment to Compost Workers to the
Solid Waste Advisory Committee which meets Thursday, October 26th, for a
recommendation. (Motion carried 4-0).
B. Awarding of Bid: Recycling
At the time, the Council extended TMT's contract thru 1989 and at the
recommendation of the City Attorney, the Council directed the City
advertise for Request for Proposals for our curbside recycling for 1990.
One response was received from our current contract holder, TMT Recycling,
Inc.
Pine Springs joined our program in September and Grant Township has
indicated a strong desire to join our program, hopefully before the end of
the year. Therefore, the RFP included all three cities.
Councilman Williams was in favor of TMT Recycling, Inc. because they have
done a good job, but felt we should have a signed Joint Powers Agreement
�" before we enter into a contract with TMT Recycling, Inc.

M/S/P Hunt/Williams - to award the 1990 Recycling Contract to TMT
Recycling, Inc, and to instruct the staff to prepare a contract for this
service. This award is contingent upon execution of a Joint Powers
Agreement for Pine Springs and Grant Township for recycling services
provided by TMT Recycling, Inc. for 1990. (Motion carried 4-0).
C. Open Burning Proposed Ordinance
Fire Chief, Fran Pott and the City Administrator have been working with the
MPCA for several weeks in an attempt to incorporate verbage, allowing the
Fire Chief to issue burning permits, in an Ordinance which would satisfy
the MPCA. A proposed ordinance was presented to the Council for their
review.
M/S/P Williams/Moe - resolved that the Council hereby requests the
Administrator set a public hearing for the Ordinance amending Section 803
of the 1979 Municipal Code, relative to Issuance of Burning Permits.
(Motion carried 4-0).
D. Building Permits
Administrator Morrison reported Frank Langer, Lake El.mo's Assessor, is now
in the process of assessing one• -quarter of the City's area. He has
informed the City there are a considerable number of home improvements
which have been undertaken since his last review four years ago without
the benefit of a permit.

with any construction.iRxkkaxNRK&tekknxx Mayor Dunn felt the lost revenue
could be handled, administratively, at the discretion of the Building
Official. Councilman Williams had a definite concern for possible safety
defects and was in agreement that the Building Official be more aggressive
in the future in finding out these things beforehand before project
completion. The Council's primary concern was that of safety; therefore,
they requested Mr. Langer make a list of the improvements made without
permits and distribute this list to the Council. Councilman Moe added
that once the word gets out that the City requires permits for any
building, this problem would be resolved.
E. Budget Extension for the 201 Project
Councilman Williams reported that he, the City Administrator, and. City
Engineer met with the MPCA staff to try to convince them to allow us a
budget extension to cover the Gorman condemnation and they refused. There
are two other steps: to appeal to the Director of Water Quality for the
MPCA and, if this fails, then appeal to the Federal EPA. Williams
recommended directing the Administrator to continue the appeal for budget
extension of the 201 Project.

OTHER:
Mayor Dunn informed the Council, Firefighter Jerome Eder, will be retiring
LAKE ELMO CITY COUNCIL. MINUTES OCT'OBER 17, 1989 PAGE 7
from the Lake Elmo Fire Dept. effective October 1, 1989. Jerome has been
l a dedicated individual and has done a superb job for the community. The
Council suggested a commendation from the Council be read to Mr. Eder at
the Fire Dept's meeting on October 24th.
M/S/P Moe/Williams - to direct the Administrator tp work with the Mayor on
commendation verbage for Jerome Eder for presentation by the Mayor at the
Fire Dept's October 24th meeting. (Motion carried 4-0).
Deputy Clerk Mary Kueffner has requested approval for her attendance at
four seminars (approx $2.00) held at the Government Training Service
Center. The Council gave their approval and indicated there was money in
the budget for such training.
Mayor Dunn informed the Council of a letter she received from Amy Novak,
852.0 Irowood Trail N., stating her concerns with the proposed landfill in
the Lake Elmo Park Reserve. The City Administrator will send Amy Novak a
thank you letter.
Councilman Williams re y d letter from Attorney Ellen Sampson who
enclosed a suggested e� ei to be sent to our Federal
representatives. Sampson would like to meet with City representatives to
discuss strategy, which Williams was very much in favor of. He will be
getting back to Ms. Sampson and coordinate a time with the City
Administrator for such a meeting.
Jack Marty, Trail Boss, and Diane Holman, Co -Trail Boss, presented an
informational slide show on the 1989 Camp Courage Wagon Train. Another
journey by wagon train is being planned for June, 1990 to raise money for
Camp Courage. They are asking the City for a spokeperson, someone they
can contact if needed, and for the Fire Dept. to bring in water to fill
the tanks for the horses on Friday night at the Washington County
Fairgrounds. The Council expressed the City would help, wh.ereever
possible, to make this another successful year.

Municipal Board Transcript: The transcript from the Municipal Board
Hearing for Section 32 is now in my office and, of course, is
available to the Council. As it is our only copy, if you wish to
review it, it would be appreciated if you could return the document as
soon as possible.
Animal Control Officer: The City is now being served by a new Animal
Control Officer, as Jerry and Merle have both retired. His name is
Mike Smith and he lives in Cimarron. Mike also works for the cities
of Lakeland, West Lakeland and Afton. We continue to contract with
the City of North St. Paul for this service.
Workshop/Meeting with Council: I would appreciate the opportunity of
meeting with the full Council to have a general discussion on the role
and expectations the Council, collectively, has for its City
Administrator. This meeting, I think, would be helpful to the Council
and to me, particularly in veiw of the recent salary recommendations.
I am free to meet with the Council at any time.
Planning Commission Meeting: The regular Planning Commission meeting
of October 9th has been cancelled, with the concurrence of the Chair.
The reasons for cancellation: (1.) no specific planning commission
development cases pending; and, (2.) October 9th is a legal Holiday.
Fire Dept. Pumper: Chief Fran Pott will be opening bids (as
authorized by Council) for the pumper on November 13th. Marilyn and I
will be discussing timing for issuance of equipment certificates for
the pumper.
