MINUTES OCTOBER 3, 1989 Mayor Dunn. called the meeting to order at 7:00 p.m. in the City Council chambers. Present: Dunn, Hunt, Williams, Graves, Moe (Arrived 7:05 p.m.), City Attorney Knaak and City Administrator Morrison. 1. AGENDA M/S/P Graves/Hunt - to approve the October 3, 1989 City Council agenda as presented. (Motion carried 4-0:Councilman Moe arrived at 7:05 p.m.) 2. MINUTES: September 26, 1989 M/S/P Hunt/Graves - to postpone consideration of the September 26, 1989 Council minutes until the October 17, 1989 Council meeting. (Motion carried 5-0). 3. CLAIMS Councilman Williams indicated the Council was not pleased with the large amount of legal costs that they have incurred, but they don't see anyway this can be avoided. M/S/P Hunt/Graves - to approve the October 3, 1989 Claim $92212 thru $92250 as presented. (Motion carried 5-0). 4. REAPP Todd Williams reported ReAPP has talked with Rossana Armson, MN Center for Survey Research, requesting her to write a letter regarding the socio-economic part of the EIS. Based on the previous letter she had written the cost was $25; therefore, ReAPP would like the Council authorization of $25 for one final letter. It was clarified that this cost would be added to the on -going account for landfill expenses. M/S/P Williams/Hunt - to authorize $25 for a letter to be written by Rossana Armson to Zack Hansen regarding the socio-economic part of the EIS. (Motion carried 5-0). 5. PUBLIC INQUIRIES: There were no public inquiries 6. PUBLIC HEARING: Proposed 1990 Budget Published notice for the Public Hearing: Proposed 1990 Budget was scheduled for 7:30 p.m. The time was 7:05 p.m.; therefore, the following motion was made. M/S/P Williams/Hunt - to postpone consideration of the Proposed 1990 Budget until 7:30. (Motion carried 5-0). M/S/P Dunn/Hunt - to bring the Public Hearing for the Proposed 1990 Budget back onto the table for Council consideration. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES OCTOBER 3, 1989 PAGE 2 Mayor Dunn opened up the Public Hearing at 7:30 p.m. in the City Council Chambers. The Public Hearing Notice was duly published. Finance Director, Marilyn Banister, explained the proposed 1990 Budget represents a 6.93% increase, which will mean our tax rate will be going down because our assessed evaluation has gone up approximately 10.84% according to the Assessor's Office. Our final levy figures could be as much as $5,000-$6,000 less than the figure stated in the Budget. October 23, 1989 is the date the City will receive their new levy from the State of Minnesota. On December 28, 1989 we have to certify the final levy to the County. Banister explained, according to the latest news publication from the State, if you have published your public hearing notice already, which the City has, you should hold. your Hearing. Another Hearing would not be needed if this levy is not more than the levy we have. Dick Johnson, 8896 Lake Jane Trail, asked if the expenditures for the landfill is in a Special Funding Account in the Budget. Banister responded the expenditures, for legal, engineering and professional services, comes out of the Special Landfill Referendum fund and not the General Fund. There are minor expenditures out of the General. Fund, which are stated in the last page of the Budget. Councilman Hunt added that the Council has approved all expenditures out of this Fund. Mayor Dunn closed the Public Hearing at 7:37 p.m. Even though the Council gave their approval for expenditures, Councilman Graves requested the Council be presented, in the future, with a running summary of the Special Landfill Referendum Fund Account balance and charges against this account. Equipment Certificates have not been incorporated into the budget because Banister explained she wanted to wait until we get the final figures of the levy, then she could give the Council a better idea of what the rate might be. Councilman Williams wanted to see the "entire picture" because this would impact the Final Assessed Rate. 7. PUBLIC HEARING: Ordinance Amending Section 1401.010.C. RE: Horses on Paved Shoulder of Roads Mayor Dunn opened up the Public Hearing at 7:06 p.m. in the Council Chambers. Notice was duly published and the affected public notified. Steve DeLapp, 8468 Lake Jane Trail N., stated the reason the shoulder is being paved there is to create a bicycle path. After the discussion last week where he heard about the quality of the road, automobile tires leaving their imprints in the road, the impressions made by the horses on the road on warm summer days would not destroy the effectiveness of the shoulders for the stated purpose, mainly to take care of the bicycle traffic. LAKE ELMO CITY COUNCIL MINUTES OCTOBER 3, 1989 PAGE 3 1 Mayor Dunn closed the public hearing at 7:09 p.m. Councilman Graves voiced his concern on the ordinance being unduly restrictive —this ordinance does not permit horses crossing a roadway from one pasture to another. Proposed wording "an exception to this ordinance would permit the traversing of the roadway at right angles to theaxis of the road for transit from one side of the road to the other." Councilman Williams indicated the word "shoulder" was not defined, and there are many streets in the City which are wide enough to be considered to have paved shoulders, but they are not marked as such. Proposed wording "Except that horses or ponies shall be allowed on paved shoulders of said street or public road where the shoulders are marked by a painted line." M/S/P Graves/Moe - resolved that Ordinance No. 8026, being an Ordinance amending Section 1401.010, by allowing horses and horse drawn carriages on paved road shoulders of public roads; incorporating the amended wording: Except that horses or ponies shall be allowed on paved shoulders of said street or public road where the shoulders are marked by a painted line. An exception to this ordinance would permit the traversing of the roadway at right angles. (Motion carried 5-0). The Public Hearing was already closed when Steve Pott, 4212 Lake Elmo Avenue, arrived at the meeting. Steve indicated he called other cities, and no other cities in Washington County have an ordinance prohibiting horses on paved roads. 8. PLANNING/LAND USE/ZONING: A. UPDATE: Status Comprehensive Plan; Councilmen Williams and Graves Councilmen Graves and Williams and Deputy Clerk, Mary Kueff.ner, have been meeting and are making progress toward completion of the Comprehensive Plan. An update will be given intone mgnth. appr•oxxnately 9. CITY ENGINEER'S REPORT: There were no reports from the City Engineer. 10. CITY ATTORNEY'S REPORT: City Attorney Knaak provided the Council with a written litigation summary. An Executive Session is scheduled before the City Council meeting on October 17th at 6:30 p.m. 3.1. CITY ADMINISTRTATOR'S REPORT: Administrator Morrison reported that applications have been received and reviewed for the replacement of Nancy Kuckler who has accepted a full-time position with another organization. Nine persons were called, six of whom were interviewed. Morrison recommended to the Council that Barbara Holm, 4497 Olson Lake Trail, be hired, commencing October 12, 1989 for up to 24 hours per week, at the beginning rate of $5.00 per hour. Holm, 4497 Olson Lake Trail for the part-time clerical position, commencing October 12, 1989 for up to 24 hours per week, at a beginning rate of $5.00 per hour. (Motion carried 5-0). B. Youth Service Bureau The Youth. Service Bureau is requesting that the Council authorize a contribution of $9,581 for services rendered by this organization to the City of Lake Elmo. A provision for this expenditure was not made in the budget. The Council recognized the Youth Service Bureau made a valuable contribution to the community, but at this time the City was unable to send funds. It was suggested the availability of this service be noted in our City Newsletter and if private individuals would be interested, they could send in contributions.
