M/S/P Williams/Graves - to approve the February 20, 1990 City Council
minutes as amended. (Motion carried 4-0).
3. CLAIMS
Add: Claim #93057 DPRA $5,097.76 and Claim #93058 DPRA $6,584.74 (The
City has received the money from the Met Council for reimbursement of
these invoices.)

4. PUBLIC INQUIRIES:
There were no public inquiries.
5. Information Meeting with Senator Laidig and Representative
McPherson
Senator Laidig and Representative McPherson discussed current
legislative issues. Topics discussed were Impact of local government
aid cut, Amendment for Redefining the Buffer Area around the proposed
landfill, Workmen's Compensation for Small Companies, and Charitable
Gambling.
6. REAPP REPORT:
Todd Williams reported Attorney Ellen Sampson will be attending the
REAPP meeting on Sunday, March 18th and bringing with her a map that
her firm has been working on regarding the property ownership and
funding for purchasing property in the park. Dan Novak had called
three council people who were interested in atttending this meeting.
Therefore, Williams felt an official Council meeting should be called.

Sunday, March 18 , 1.990 at 8:00 p.m. for the purpose of Ellen
Sampson's visit. (Motion carried 4-0).
7. PLANNING/LAND USE/AND ZONING:
A. Public Hearing "One Acre" Rule
At the February 6, 1990 meeting, the Council called a public hearing
to consider amending several sections of the Lake Elmo Municipal Code
relating to the "One Acre" rule for drainfields. The present wording
does not conform to the wording in the proposed Comprehensive Plan and
needs clarification because it requires two standards.
Mayor Dunn opened up the Public Hearing at 7:30 p.m. in the City
Council chambers. The public Hearing notice was published in the St.
Croix Valley Press on February 14, 1990.
Mike Mazzara, 1.1259 30th St. N., asked the following questions: This
amendment would require 1 contiguous acre for drainfields on all newly
subdivided lots rather than require two separate drainfield sites.
Williams clarified all lots existing prior to the adoption of this
ordinance shall have area sufficient for two separate and distinct
drainfield sites verified by soil borings and perculation tests.
What about a commercial establishment? Bohrer explained there is
almost no limitation on the amount of sewage that might be generated
by a commercial establishment. Therefore, the methods of evaluating
whether there is area sufficient for the required septic system is
slightly different.
Why is there a difference? Bohrer: There is no minimum lot size in a
PF or a P zoning district. Conceivably, A half -acre of land could
qualify for that zoning district. It would not be appropriate to
require one acre set aside for a drainfield if you don't even require
one acre for the total lot size.
Dick Johnson, 8896 Lake Jane Trail, asked the City Engineer what his
interpretation of placement of the well would be on a 1 1/2 acre lot.
Bohrer: As part of the Preliminary Plat submittal this one acre of
land will have to be delineated on each of the lots. For residential
property, he would consult the County's soils survey to see if the
soils within that one acre delineation are classified as having low to
moderate limitations for septic purposes. The well. would have to be
at least 50 feet away from that one acre delineation, because the
owner would have flexibility to locate his first system any place in
that one acre. If it is a 1 1/2 acre lot, the well would have to be on
the other half acre and the well would be 50 feet from the acre set
aside for a septic system.

Discussion followed on the concern this requirement (one contiguous
( acre of land dedicated for septic system use) could become an undue
restriction based on topography. Councilman Graves suggested it be
appropriate to identify an acre of suitable soils that we allow it to
be done consisting of a maximum of two parcels neither of which may be
less than .4 of an acre.
M/S/P Graves/Williams - to direct the staff to prepare the ordinance
amendment of the Lake Elmo Municipal Code to incorporate the amended
proposed Revision to "One Acr Rule as follows: "For A, RR, R-1,
R-2, and RE Zoning Districts, all newly subdivided lots shall have at
least one acre of land dedicated for septic system use This acre
may consist of a maximum of two peparate parcels neither of which may
consist of less than 0.4 acres..." and "For GB, HB or CB Zoning
Districts, all newly subdivided lots shall have at least one (1) acre
of land dedicated for septic system use or area, sufficient fnrtwo (2)
separate and distinct drainfield sites, whichever is greater. The
area may consist of a maximum of two (2) parcels, neither of which may
be less than 0.4 acre or the area sufficient for one drainfield,
whichever is greater." (Motion carried 4-0).
B. Comprehensive Plan
The consensus of the Council was to hold a workshop on the
Comprehensive Plan to discuss overall density and the Future Land Ilse
Map.
M/S/P Armstrong/Graves - to set up a Council workshop on the
Comprehensive Plan for Thursday, March 15, 1990, at 4:30 p.m. in the
Council chambers. (Motion carried 4-0).
C. Request from ReComp
Bob Healy, ReComp Inc., presented information on an organic soil
manufacturing and yard waste composting operations in conjunction with
Bob Mogren of Mogren Brothers Landscaping, on 20-acres at 1-94 and
County Road 15 (Manning Avenue). ReComp will lease and manage the
site, while the Mogren Brothers Landscaping firm will. retain
ownership; (Refer to Jim McNelly letter dated March 5, 1990)
Mayor Dunn thought the operation was too intensive, 160 trucks per day
and 160 tons per day, for the proposed location.
Councilman Williams voiced his doubts about the plan. Williams
stated, "I don't want this site to be a dumping ground for Ramsey and
Hennepin counties. We already have lots of problems in Lake Elmo
because we were once the dumping ground for Ramsey County. I don't
want it to happen again. Hennepin County and Ramsey County should
take care of their own yard waste. As long as the populated counties
can get away with shipping their waste to less populated counties, the
populated counties are not going to buckle down and do what they
should for all recycling and waste reduction."
Councilwoman Armstrong voiced her concern on 160 trucks per day and
160 tons per day was a very intense use for that site located in the
corner of our city.

The Recomp proposal had been reviewed by the Solid Waste Committee,
but no recommendation was made.
D. Other
8. CITY ENGINEER'S REPORT:
A. Woodbury's 494 Access Plan
City Engineer Larry Bohrer, reviewed the Environmental Assessment
Worksheet prepared for the I-494 related improvements and submitted
his (5) conclusions in his letter to the Council dated March 2, 1990.
M/S Graves/Williams - to direct the staff to forward Larry Bohrer's
conclusions listed in his letter dated March 7, 1990 to David Jessup,
Woodbury, on the I-494 Access Improvement Study.
M/S/P Graves/Williams - to amend the motion to include the comment
"Lake Elmo has not made provisions for the extension of Bielenberg
Drive into Lake Elmo in their Compehensive Plan and the City finds
there is a negative economic impact on Lake Elmo because Federal,
State and County monies are proposed to be used on the improvements
which will provide a benefit only to Woodbury." (Motion carried 4-0.
M/S/P Armstrong/Graves - to include in the staff's letter Larry
Bohrer's comment in asking the City of Woodbury to compare its
drainage plan to the Watershed Plan and correct any errors found.
(Motion carried 4-0).
M/S/P Graves/Williams - to direct the staff to forward Larry Bohrer's
conclusions, as stated, on the I-494 Access Improvement Study to David
Jessup, Woodbury. (Motion carried 4-0).
1. Lake Elmo finds there is no environmental impact on
Lake Elmo from the proposed improved access to I-494.
2. Lake Elmo finds there is a negative economic impact on
Lake Elmo because Federal, State and County monies are
proposed to be used on the improvements which will
provided a benefit only to Woodbury.
3. The Lake Elmo Comprehensive Plan has not made provisions
for this extension of Bielenberg Drive north on its
present alignment over I-94 and into Lake Elmo. if
Woodbury wishes to continue to show this extension on its
planning documents, a better location may be farther
to the east. Your proposed alignment lines up with an
existing commercial building, a wetland shown to be
utilized on Lake Elmo's drainage plan and an existing
petroleum pipeline.
4. The I-494 Access Improvement Area is generally within the
Ramsey Washington Metro Watershed District. The southwest

corner of Lake Elmo is also within this District. In 1986
we reviewed the water management plan for Lake Elmo & found
that the plan limited Lake Elmo's discharge to 5 cfs even
though under present undeveloped conditions the discharge is
20 cfs. The Watershed's engineers told us that Lake Elmo's
discharge must be limited to 5 cfs because of Woodbury's
922 cfs discharge from Pond C7A. It seemed to us that
922 cfs was an incorrect number. At that time, we talked
to Joe Anderlik and found that Woodbury's drainage plan had
no such large discharge for that area. We also know of no
existing structure under I-494 to pass that kind of flow.
We wrote to the Watershed's engineer pointing out what we
felt was an error and received no response.
Since drainage is an "environmental" impact, we thought this
environmental review may be the appropriate forum to bring up
this discrepancy again. We ask the City of Woodbury to
compare its drainage plan to the Watershed Plan and correct
any errors found.
B. lOth Street Construction Schedule
At the last Council meeting, City Engineer, Larry Bohrer, was directed
to contact the Washington County Public Works Dept. to find out the
schedule for reconstructing 10th Street (C.S.A.H. 10) between Inwood
Avenue (C.S.A.H. 13) and I-694. Rohrer reported the road is
scheduled for 1992 and is anticipated to be a four lane divided road
with center grass median similar to C.S.A.H. 13 between I-94 and. loth
Street.
C. 1990 Sealcoat Program
Larry Bohrer reported in 1982 the City adopted a City-wide sealcoating
program in which every street that would benefit from sealcoating
would be sealed once every six years. This was set up to seal
one-third of the streets every other year (in the even years) to
coincide with the County's sealcoating contract. The 1990 Capital
Improvements program showed that sealcoating should be done this year
on these streets which were previously sealed in 1984.

M/S/P Graves/Williams - to approve the 1990 Seal Coat Program as
presented. (Motion carried 4-0).
Mary Kueffner reported Kelly Brockman contacted the city about the
possibility of sealcoating the Brookfield II parking lot and splitting
the sealcoating cost of the access road when the City sealcoats their
parking lot. The Council was unwilling to be involved in any
arrangement to do work on the privately owned Brookfield II parking
lot.
City Engineer Bohrer explained once the contractor is under contract,
the City could inform the private owner of who that contractor is, and
if they want to they can make their own private arrangements. The
Council consensus was that, when the city hall parking lot is
sealcoated, they would pay half of the sealcoating cost of the access
road between City Hall and Laverne Avenue. Larry Bohrer will. contact
Kelly Brockman and Mike Lynsky regarding the procedure for sealcoating
the access road.. Bohrer will report back to the Council when he
receives the cost figures from Washington County.
D. SW1 Concept Review
Mayor Dunn reported Councilman Hunt, herself, Mary Kueffner, Arlyn
Christ and. Dave Dufresne met with. Mary Luth, Wash. Cty, to review a
conceptual design public water supply for Wash. Cty Sanitary Landfill
No. 1. Ramsey and Washington Counties met today and looked favorably
at this conceptual design. Mary Luth set up a tentative meeting for
March 22nd and asked if our city engineer could be involved and felt
at some time our city attorney's input would be needed. Councilman
Graves indicated his interest in. participating in these discussions
because he has been involved with this situation for 3+ years.
Larry Bohrer reviewed the public water supply proposal and found
several points that needed to be discussed; such as: design criteria
is not correct for the size of the tank, what kind of release from
liability do they want, operation maintenance and depreciation, and
tower placement.
The Council directed Mary Kueffner to contact Mary Luth with the
proposal that TKDA be hired by the Counties to prepare plans and
supervise the construction of the water system.
E. 1.990 Weight Restrictions
Maintenance Foreman, Dan Olinger, had prepared a list of 1990 Road
Restrictions on City Streets.
City Engineer Bohrer, recommended that no exemptions from the load
limits restriction be given to trash haulers or septic haulers. An
exemption could be given to septic haulers in an emergency situation.
School buses are exempt by State Statutes.

Weight Restrictions, as presented, be enforced for trash haulers and
septic haulers, except for septic haulers in an emergency situation.
(Motion carried 4-0).
9. CITY ATTORNEY'S REPORT:
A. R-1 Zoning District Repeal
The City Attorney will attend the next Council meeting to discuss the
R-1 Zoning District Repeal.
B. Monthly Status Report
The City Attorney provided the Council with his monthly Litigation
Report.
C. Public Facility Ordinance
Councilman Williams suggested the City Attorney be asked how to reword
the PF Ordinance to allow rezoning for only a specific use. Williams
i.ndicatd the alternative would be to not have the PF Ordinance and be
more specific as to what uses are allowed in our other zoning
categories.
The Planning Commission will bring their recommedation to the Council
on the PF Ordinance and then the Council can discuss this further.
10. CITY COUNCIL REPORTS:
Mayor Dunn reported because Councilman Hunt was out-of-town on
business, he was unable to attend the Council meeting. The Council
received a letter from Councilman Hunt explaining on February 27th he
met with Mary Kueffner to discuss the city's performance review
process and finding a new city administrator. Councilman Graves was
invited, but was unable to attend. Mayor Dunn was in attendance.
Based on his meeting, Hunt made the following recommendation to not
advertise for a new City Administrator, but promote from within. He
recommended the City Administrator's position be offered to Mary
Kueffner since he felt she met the necessary qualifications of the
job.
The Council was supportive of the recommendation that the City appoint
Mary Kueffner as Full Time Permanent City Administrator.
Councilmembers Graves and Williams suggested the Personnel Committee
work out the details, relative to determination of salary, possible
changes needed in the City Admin. Job Description and other possible
personnel appointments within the office incorporating the City's
staff recommendation relative to additional staff.
M/S/P Armstrong/Graves - to direct the Personnel Committee to
determine a salary and contract for Mary Kueffner that will be
reviewed at the next Council meeting. (Motion carried 4-0).
M/S/ Armstrong/Graves - to direct Mary Kueffner to advertise for help
within the City staff as she sees fit.

( Councilman Williams requested postponing consideration of the motion
until the next Council meeting to give the Personnel Committee a
chance to get together with the staff to come up with a recommendation
on what type of person needs to be hired and at what salary.
Councilwoman Armstrong voiced her concern that she saw the City was in
need to hire someone now and would not like to wait for two weeks for
a motion.
Mary Kueffner suggestd a clerk/typist position with a starting salary
of $6.50/Hour maximum.
Councilman Graves felt, as long as the Council places a limit on
hiring only one person and the salary range, Mary could proceed to
advertise for this position.
M/S/P Williams/Graves - to amend the motion to include advertising for
a clerk -typist position at a maximum salary of $6.50/Hour. (Motion
carried 4-0).
M/S/P Armstrong/Graves - to direct Mary Kueffner to advertise for a
clerk -typist position at a maximum salary of $6.50/Hour. (Motion
carried 4-0).
11. CITY ADMINISTRATOR'S REQUEST:
A. Street Lights at CR 19 and CR 10 Stop Signs at City Hall Road.
and CR 17 and Laverne
Mary Kueffner explained she was given incorrect information for the
last council meeting relating to the proposed street lights. The
proposal was for two 250 watt high pressure sodium lights which cost
$13.75 each per month for a total cost of $330.00 per year. The
County would have to install one of the light poles at a cost of
approximately $2,000. They would absorb that entire cost and ask the
City pay for the ongoing electrical costs.
The city received a letter from Lawrence Bousquet, Traffic and
Maintenance Engineer, stating they increased the size of the double
stop signs and installed rumble strips. They felt these measures seem
to have eliminated. the accident problem.
The Council directed the staff to suggest to Mr. Bousquet the
possibility of "Do Not Enter" signs on both sides of the north bound
lanes, in addition to adding radius delineation to better emphasize
the intersection location.
An inquiry was made about placing a stop sign at the intersection of
"City Hall Road" and County Road 17. Mary Kueffner talked to Mr.
Bousquet who stated, since it is the County's intersection, they will
be placing a stop sign there as soon as they can get into the ground.
The staff suggested a stop sign be installed at the intersection of.
City Hall. Road and Laverne Avenue because of increased traffic on
39th Street once the bank is open or when the "Business Park" goes in.
The County will install this sign for the City at a cost of $50.00.

M/S/P Williams/Graves - to approve the installation by the County for
a stop sign for the intersection of "City Hall Road" and Laverne
Avenue at a cost of $50.00 (Motion carried 4-0).
B. Bids for Truck
Maintenance Foreman, Dan Olinger, received bids that were let to
replace the 1983 Dump Truck.
The Council requested the CIP Committee meet with the Maintenance
Foreman to disucss this request. The Council postponed a motion until
the next Council meeting for the CIP Committee's recommendation.
C. Request fromm Olympic Committee
The City received a letter, dated March 1, 1.990, from Connie Israel,
Dir. of Venues, requesting appropriate permits for the following:
1. Lake traffic control: During practice times boat
traffic will. be restricted to "no wake" speed.
During competition times no boat traffic is allowed.
2. Parking Control: Highway 17 should be posted as no
parking during the Festival to prevent spectators from
parking along the roadway and watching the event.
3. Operations parking: Request to park a construction
trailer at the end of Klondike road near the norh end
of the lake.
In addition, Klondike should be controlled to prevent
spectators from parking along the street and entering
the park from the north end.
Connie Israel has met with Mike Johnson, Washington County Sheriff, to
discuss these issues. He assured her that he can provide the support
to enforce these policies as long as they have been approved by the
City.
The Council had a concern as to someone staying overnight in the
construction trailer which was requested in Item 3. and asked for a
definition of a construction trailer.

to facilitate the requests of the Olympic Committee, in their letter
dated March 1, 1990, and the City requests their definition of a
construction trailer. (Motion carried 4-0).

1 D. Clean -Up Days
The City sponsors a yearly clean-up day, and it was suggested this
event be held Saturday, May 12th from 8:00 a.m. to noon. Again this
year $3000 was budgeted for clean-up days. Because this is a budgeted
item, clean-up days will be free of charge for Lake Elmo residents.

from 8:00 a.m. to noon, free of charge for Lake Elmo residents.

In 1988, the City of Woodbury completed a report outlining that City's needs for improved
access to I-494. This study showed the need for an improved interchange at Valley Creek Road
and now interchanges at Tamarack Road and Courtly Road, The study also showed a need for a
northerly extension of Bielenberg Drive over 1.94 into lake Elmo.
A diagram of the proposed improvements is attached. The report states that all 'of these
improvements will be necessary by 2010,
Ira January, 1990, an Environmental Assessment Worksheet was prepared for the 1.494 related
improvements and the City of Lake Elmo received a copy, We have reviewed the documents and
tine following are our comments:

We can find no adverse effects, environmental or otherwise, on Lake Elmo froth the I.494
improvements, We believe Lake Elmo will experience benefits from the improvements. We
know that traffic has increased noticeably on 10th Street between Inwood Avenue and 1-694,
This may be a result of Woodbury residents who want to go north on 1.694 using the loth Street
entrance to avoid the existing congestion at the Valley Creek Road entrance, Improving access
to I-494 may decrease loth Street traffic.
Although not part of the EAW, the Blelenberg Drive extension will have an impact on Lake
Elmo, The extension is being proposed because the study forecasts CSAH 13 at 1.94 will be
overloaded by 2010. In conceptual form, the Woodbury study shows Blelenberg Drive
extending due north from existing Bielenberg Drive on the center of section line. This alignment
would be directly in litre with the Contnco Shoes building, a wetland shown on the City's
drainage planfor the area, and in line with the existing Minnesota Pipeline Company's petroleum
pipeline, A better location would be approximately 1,000 feet east, The alignment would then
lure up with Helmo Avenue, avoid wetlands and pipelines, and match up with existing high
ground that would soften the visual height impact of the overpass,

1. We see no environmental impacts on Lake Elmo for the 1.494 access improvements.
2. The Bielenberg Drive extension will improve access into and out of Woodbury.
3. It cannot be determined at this time if the Bielenberg Drive extension will provide a
benefit for Lake Elmo.
4. It makes sense for Woodbury to continue to plan for 1ielenberg Drive and for Lake Elmo
to consider it when planning for Section 32.
S. Lake Elmo should comment to Woodbury that a better location, for planning purposes, is
1,000 feet east.

In 1983, the City adopted a City-wide seal coating program in which every street that would
benefit from seal coating would be sealed once every six years, This was set up to seal one-third
of the streets every other year (in the even years) to coincide with the County's seal coating
contract. The 1990 Capital Improvements Program shows that seal coating should be done this
year on those streets which were previously sealed in 1984.

At the January 2, 1990 Council Meeting, the staff was directed to submit suggested wording to
clarify the "one acre of land suitable for drainfield purposes" rule. The present wording does not
conform to the wording in the proposed Comprehensive Plan and needs clarification because it
requires two standards. The following are our recornmendations.
For A, RR, R-1, R-2, RE (2-1/2) and RE (5) Zoning District, the requirement for one acre
will always be larger than the requirement for two sites, therefore the following wording
is suggested:
"All newly subdivided lots shall have at least one„won i�gtrutmacre of land dedicated
for septic system use. This area shall not contain permanent buildings or structures,
wells, paved surfaces, drainage easements, or the setback distances from any of the
above or from property lines. The suitability of this area for septic system use shall be
determined by comparison to the Washington County Soil Survey. If the area is
classified as having only "slight" or "moderate' limitations for drainfields, the area shall
be deemed as meeting these requirements. If any portion of the proposed area is
classified as having "severe" limitations, that area shall be evaluated by soil borings and
percolation tests to verify the accuracy of the Soil Survey's "severe' classification.
All lots existing prior to the adoption of this ordinance shall have area sufficient for two
(2) separate and distinct drainfield sites, as verified by soil borings and percolation tests.
Placement of the second required drainfield between the trenches of the first drainfield is
prohibited."

would not be applicable. The following wording is suggested:
"All lots shall have area sufficient for two (2) separate and distinct drainfield sites, as
verified by soil borings and percolation tests. Placement of the second required
drainfield between the trenches of the first drainfield is prohibited."

The Lake Elmo City Council will hold a public hearing on Tuesday,
March 6, 1990 at 7:00 p.m. to consider amending Sections 301.070
D.1.d.(6) and (7);
301.070 D.2.c.(6); 301.070 D.3.c.(6); 301.070 D.4.c.(6) to read as
follows:

After reviewing and confirming all specifications and bids,I
am recommending the following.
1. That the low bid of $17,147.93 tax included with trade
from Lakeland Ford be accepted..
2-That the dumpbody, hydraulic system, snowplow, wingplow,
underbody plow, and sander be purchased as a package from
Crysteel Equipment Co. at a price of $20,715.00. There is tax
on cab and chassis only. There is.$55,000.00 in our beget for
this truck.

We need to place the order for this. truck as soon as possible
because we are looking at a 120-150 day delivery time frame.
That means it would be August or September before the cab and
chassis will be delivered, than.another 20-40 days to install
all equipment to make truck complete and ready for operation.
That does not leave much time to work with this unit and get
all new vehicle "bugs" out before going into winter.
When looking at the bid we received from L-Z Co. for a plow
it appears to be low, however there plow does not have a
companionable wing plow or quick attach hitch that my
specifications call for.

As follow-up to our February 5, 1990 letter, i would like to
point out that the work we have done at the above referenced
intersection seems to have stopped the accident problem. As you
know, originally we had double stop signs, double stop ahead
signs and double stop ahead pavement messages in place prior to
opening of the road. Later on, we increased the size of the
double stop signs and installed rumble strips. These measures
seem to have eliminated the accident problem.
The two fatal accidents that occurred at the intersection, did
occur during daytime hours. We have considered street lights, as
well as an overhead red flasher should further accidents occur.
As soon as weather permits, we will be adding delineation to
better emphasize the intersection location.

The plans provide for complete road reconstruction and improvement of sight distance. The road
will be reconstructed to MSA rural road standards with a 24 foot wide bituminous driving
surface with 4 foot wide bituminous shoulders on either side.

My wife and I are owners of the 21.6 acres at the southeast corner of
highway 36 and county highway 13. The River Valley Christian Church
has applied for rezoning of this property for purposes of building a
church. I attended the Lake Elmo Planning Commission meeting Feb 12th
where the Committee voted to recommend denial of the rezoning
application based on the attached findings. I do not have their final
version of the recommendation but this one was passed out at the
meeting. I would like to point out some shortcomings to the reasons
given for denial.
1. "The change is not called for in the Future Land Use Map." That is
obvious which is why the rezoning application is being made by the
Church.
2. "PF zoning may allow more intensive land use." Usage by other than
a church can be limited by approving the rezonig classification
conditioned on it being used for a church. Looking at the Lake Elmo
Land Use Map you can see that several conditional use permits have
been approved in that area.
3.&4. These points I believe were striken at the meeting. However,
with respect to the drianage issue, any problem can readily be dealt
with in approving the building/landscape plan. In fact the design
could actually reduce the exposure to damage which currently exists.
5. This number was missing from the list of reasons.
6. "Traffic Safety" The Minnesota Department of Transportation has
indicated that the proposed use does not significantly increase the
accident risk.
7."This is desireable residential land." There wasn't any evidence
presented to support this conclusion. On the contrary, the property
fronts a major highway for a quarter mile. It has high voltage power
lines with two towers and a 450' NSP easement through the middle of
it. The property has been for sale for four years with three real
estate companies and there has not been one person interested in
purchasing it to build a house. Even some of the Planning Commission
members volunteered that they would not wont to build a home there.
8. "Residents unanimously consider the change a threat to their rural
life style." There was nothing unanimous about it. There is no
indication that all the residents in the area were asked to vote by
those submitting their petition. There are residents with more land
adjacent to this property that did not sign this petition than did
sign. The rural life style of most of those who did sign have that
life style protected by large (2-3 acres), wooded lots. More
importantly, a church is consistent with a rural life style and is
actually the hallmark of most rural communities.

The Planning Commission's recommendation is ill-founded. We ask that
you ignore that recommendation and approve the application to rezone
the property_ for church use. Use as church property is a good

CONTRACT FOR CITY PROSECUTION SERVICES
1.1 Carl A. Blondin, Attorney at Law, Minnesota Attorney
License 157661, with offices at 7475 15th Street north, Suite
204, Oakdale, Minnesota 55128 agrees to provide his services as
City Prosecutor to the City of Lake Elmo for the calendar year
1990 for the fee of $900.00 per month ($10,800 for the entire
year).
2.1 Prosecution services shall include all District Court
appearances for all City Ordinance violations, and all petty
misdemeanors, misdemeanors and gross misdemeanor violations of
Minnesota Statutes, except for those matters that Minnesota
Statutes state must be prosecuted by the County Attorney or the
Attorney General.
2.2 Prosecution services shall also include representing the
City in any habeas corpus actions in United States District Court
for the District of Minnesota brought by a person convicted of an
offense described in paragraph 2.1 of this contract and
prosecuted by the Lake Elmo City prosecutor.
3.1 Prosecution services shall not include appeals to the
Minnesota Court of Appeals, the Supreme Court of Minnesota, or
the United States Supreme Court.
3.2 Carl A. Blondin shall not initiate an appeal on behalf of
the City of Lake Elmo without prior approval of the City Council,
or if the City Council sets up a procedure for the appeal of
criminal and petty misdemeanor decisions without prior approval
of the City Council, he shall not perfect an appeal without first
strictly complying with the City's procedures.
3.3 Carl A. Blondin shall immediately notify the City
Administrator and the City Council of any appeals brought by a
defendant in any matter he is obligated to prosecute under this
contract.
3.4 Prosecution services shall not include the costs
associated with an appeal such as service of notices and motions,
printing and other incidental costs.
3.5 The Lake Elmo City Council is free to hire Carl A.
Blondin or any other attorney it so chooses to represent the City
of Lake Elmo in any appeal of an Ordinance violation or other
matter prosecuted by the Lake Elmo City prosecutor.
4.1 Carl A. Blondin shall be responsible for all court
appearances required of the Lake Elmo City prosecutor by the
District Court. He shall personally appear, or if unable to do
so insure that another attorney licensed to practice law in
Minnesota and of sufficient training and experience in city
prosecution work appear at no cost to the City of Lake Elmo.
