(Motion carried 4-0). Frank Langer, Assessor, submitted a list of recommendations to the Lake Elmo Board of Review. (See Appendix A) Mary Leslie, 11546 206th St., stated her house was in poor condition because of the loss of their central heating system last year. They are using a wood burning stove to heat the house until a new furnace and ducting can be installed. Because the owner has not permitted Frank Langer or Scott Renee into the residence, an inside inspection relative to this complaint was not made. M/S/P Graves/Hunt - to accept the Lake Elmo Assessor's recommendations presented to the Board of Review; with the exception of Mary Leslie, PID 37024-2700, until such time someone from the assessor's office can make an inside inspection relative to her complaints. After the Board of Review has ended, (deadline of 20 days from the initial Board of Review), she can present her questions to the County Board of Equalization. (Motion carried 4-0). Frank Langer presented property adjustments in the Lake Jane Landfill Well Advisory Area (See Appendix B). All of the properties will be re-evaluated when the water system is installed. M/S/P Bunt/Graves - to approve the valuations, as submitted by Frank Langer, for the Lake Jane Landfill Well 1990 Advisory Area. (Motion carried 5-0). M/S/P Graves/Hunt - to close-out the Lake Elmo Board of Review at 7:00 p.m. (Motion carried 5-0). Mayor Dunn called the City Council meeting to order at 7:01 p.m. in the Council chambers. Present: Dunn, Hunt, Williams, Graves, Armstrong, City Engineer Larry Bohrer, City Attorney Steve Carlson, and Administrator Kueffner. 1. AGENDA Add: 8B. Personnel Committee M/S/P Graves/Armstrong - to approve the May 1, 1990 City Council agenda as amended. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 2 2. MINUTES: April 17, 1990 M/S/P Graves/Hunt - to approve the April 17, 1990 City Council minutes as amended. (Motion carried 4-0-1: Abstain: Armstrong) 3. CLAIMS Councilman Williams reported Claim 093236 Leonard, Street and Deinard in the amount of $1,514.80 should be reduced to $709.80. Williams reported he had talked to Ellen Sampson who stated this bill had not been reviewed by her and felt an adjustment would be made. The part under question will not be paid at this time. M/S/P Hunt/Armstrong - to approve the May 1, 1990 Claims #93218 thru #93267 with amended Claim #93236 reduced to the amount of $709.80. (Motion carried 5-0). 4. PUBLIC INQUIRIES Kelly Brockman, 3385 Lake Elmo Avenue, stated on several occasions this Council has been asked "What is the situation on the Section 32 negotiations"? The Mayor has answered "We're just talking, nothing is really happening". Today we read in the paper that negotiations are complete, and we will give up Section 32 to Oakdale without a public information meeting or an informational letter to the citizens. Mr. Brockman asked the Council for an informational meeting to let the citizens of our city know what is going on. Above all, do not give away Section 32. Mayor Dunn responded that no decision on Section 32 has been made with Oakdale. The newspaper article was in error. Negotiations have been on -going between Oakdale and Lake Elmo appointed representatives, Councilman Hunt and herself. When a proposal is reached, it will be brought before the entire Council for their review. Councilman Hunt read an excerpt from the newspaper article and clarified that no meeting date had been set. He indicated to Mr. Brockman, if he would like to stay, Section 32 was on the agenda later in the evening. 5. REAPP REPORT: No report was given. 6. PLANNING/LAND USE/AND ZONING: A. Trans -City Investment - Amendment to C.U.P. (Continuation) M/S/P Hunt/Graves - to bring back onto the table for Council consideration the amendment to C.U.P. by Trans -City Investment. (Motion carried 5-0). At the last Council. meeting, the Council instructed the Building Official to make an inspection of the facilities to confirm or refut if hazardous materials are stored on the site. Jim McNamara reporteed LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 3 in his memo, dated April 27, 1990, that after inspecting the tenant ( spaces at Trans City, meeting with Washington County Public Health and speaking with Mr. Brott, MPCA, he did not feel there is a violation of Trans City's C.U.P. (See J.McNamara's letter dated Apil 27, 1990). Mary Ann E. and H. Brent Archer, Glass Etc., gave a presentation on the process used in creating their finished product. The Council was provided with a statement from Gary LeGand, Env. Specialist of 3M Graphic Products Marketing, that there were no peculiar chemical qualities or unusual ingredients which would make the 3M products they use unusually hazardous either as inventory or as generators of waste. Copies were provided of the statement from Dr. Bruno Staffen, Senior Environmental Employee, stating the federal legal definition of storage. (See attachments) Councilman Williams indicated his appreciation to Glass Etc. for coming before the Council with their presentation. He added, I had stated, if any violation to the C.U.P. existed I believed it would have been unintentional. When he asked the Building Official if hazardous materials were being stored, he could not answer this question and was unable to get the answer to him by the next Council meeting. Based on the advice of our City Attorney, I requested we postpone consideration of the C.U.P. until an inspection was made. As a result of the inspection by the Bldg. Official and a. rep, from the County Health Dept., Williams expressed his satisfaction there was no violation to the C.U.P. This is the type of business we would like to have in our community and welcome Glass Etc, into our city. M/S/P Hunt/Williams - to accept the letter of April 27, 1990 from Jim McNamara (Motion carried 5-0). Councilwoman Armstrong has checked the site and had no problem with the proposed storage. Councilman Williams requested the following condition to be added to the C.U.P. Condition No. 7: Screen of double row of evergreen trees (no size specified) shall be maintained along the north side of fence. M/S/P Williams/Hunt - to adopt Resolution No. 90-20, A Resolution Amending Resolution 88-14 to include Outside Storage as Part of An Alternate Agricultural Conditional Use Permit; including Condition No. 7 as stated, to Howard Gelb and Trans -City Investments. (Motion carried 5-.0). B. Ray Salus - CUP Application for Golf Driving Range Background Information: In October, 1989 Mr. Salus applied for a large lot subdivision and a rezoning from RR to PF to allow for a Golf Driving Range on his property south of Cimarron. (Prior to Mr. Salus' application, S. Blasko was granted a similar request for property just south of Oak -land Junior High School). After Blasko's request was approved, the Planning Commission determined that Golf Driving Ranges were not specifically allowed in the PF zoning district. The City Council charged the PZ with dealing with this issue and to return to the LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 4 Council a recommendation by December 5th which the Commission had not been able to do. The staff suggested to Mr. Salus to change his application from the Large Lot Subdivision and Rezoning to a Conditional Use Permit (refer to Section 301.060D, Page 302-21 of the Municipal Code). The PZ held a public hearing on this amended request for a C.U.P. which included a minature golf course at its April 23rd meeting where one person opposed the proposal and three persons supported it. The PZ tabled the action until its May 14th meeting. Mr. Salus indicated he would remove the request for the minature golf course, and asked to be placed on this Council agenda to obtain a consensus, one way or the other, from the Council on the golf driving range. Mayor Dunn noted for the record the Council received a letter from Robert Engstrom Companies requesting that the application be denied. (See letter 4/27/90 from Robert E. Engstrom) Administrator Kueffner suggested downzoning the property to Ag with a C.U.P. This application could be treated similarly to H. Springborns' application which was commercial recreation of a rural nature. Mr. Salus was willing to be downzoned to Ag. Mayor Dunn indicated she had no problem with the golf driving range. Councilman Graves indicated he had no problem with a golf driving range or the minature golf course. Infact, he felt it would be a nice addition to the community. Councilwoman Armstrong stated she had no problem with the golf driving range, but felt the minature golf course was too much for the area. The golf driving range retains the open space of the land, and it is surrounded by business, such as, Cimarron, Trans -City Investments, and the Drive -In Theater This would not be a detriment to the neighborhood. Armstrong suggested the parking area be dropped down below the berm next to the road so the cars were not seen. Councilman Hunt had a problem with a C.U.P. for this use in a Rural Residential area and felt it would be a dangerous precedent to start allowing C.U.P.'s of any type in a RR area. We do allow uses in Ag with a C.U.P. that would fit this recreation of a rural use, but felt the minature golf was an intense use. A golf driving range would not destroy the neighborhood. Councilman Williams felt this use was a commercial use in a residential area, and the Council has tried to very carefully define where commercial uses should go in our City. One of the areas is just south of this property and along the I-94 corridor. The Council needs to look at the overall proper planning for the City and decide if this is a use which belongs in a residential area or should this use go in a predominantly commercial area. Because there are residences already in the neighborhood and a new development is being built across the street, this is not an appropriate use for a residential area and LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 should not be allowed. Williams added he did not idea for the Council to be taking any action on a properly postponed by the PZ. The PZ has 60 days Hearing to submit a report. PAGE 5 think it was a good matter that has been after a Public C. PUBLIC HEARING: Stephen & Elizabeth Johnson Variance,to Sideyard Setback Mayor Dunn opened up the public hearing at 8:03 p.m. in the City Council chambers. The Public Hearing notice was published in the St. Croix Valley Press on April 11, 1990 and abutting property owners were notified. Stephen Johnson, 2945 Lake Elmo Avenue, explained he was granted at an October, 1989 Council meeting a Shoreland Permit to add on to the existing structure. A survey was requested, but was not done until a week after the October Council meeting. After having the property surveyed, it was determined the addition cannot meet the 10' setback, and he has applied for a 1 1/2' to 2' variance to the sideway setback. Johnson indicated his hardship was that the addition cannot be built without granting this variance due to the layout of the house and lot. He would still have access from the front of the house to the back of his property once the addition has been added. The DNR has no concern with this request. Jim McNamara, Building Official, explained the reason this was missed because one corner of the house sits on an angle to the lot. Once the survey was taken, which was after the shoreland permit was granted, it was determined they were 2' short. Dave Swanson, 2929 Lake Elmo Avenue, stated he had no problem with this variance. The houes are parallel, but not parallel to the lot line. If Mr. Johnson builds the addition as planned., the house is not going to be any closer to his house. Mayor Dunn closed the public hearing at 8:07 p.m. Councilman Hunt felt the City has shown in the past a history of granting small variances, especially in older areas with existing housing layout from the road and lake which has been considered a hardship. Currently, there is no access to the back part of the property. Mayor Dunn had no problem with granting a 2' variance to the sideyard setback. Councilwoman Armstrong voiced her concern about the 10' on the side, which is the access to lot behind his house, would be cut off by the addition to the back property. Johnson responded that it is his intention to settle the easement issue before he would start construction. If he moves 8" the other way, he would start infringing up the restriction of the septic system. LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 6 Councilman Williams referred to the certificate of survey which states ( 8' for a sideyard setback. Our code is specific in that there must be a hardship for granting a variance, and he did not see a hardship demonstrated here. Mr. Johnson could decrease the size of the addition or change the design to avoid the variance. Councilman Graves had no problem with granting this variance. The Council has granted variances such as this in the past. The neighbor has no problem with the variance, and there was no one else to speak against it. The addition would upgrade the neighborhood, improve the overall economic appearance and esthetics to the property and still allow access to the back lot. M/S/P Graves/Hunt - to grant approval of the 2' variance request to Stephen and Elizabeth Johnson, 2945 Lake Elmo Avenue, to the sideyard setback based on the hardship being stated there are no other physical options and on the orientation of the houses on their lots due to circumstances surrounding the road placement and placement of the lake and the septic system. Mr. Johnson acknowledge he was made aware that approval of this request may be detrimental to himself in cutting off access to the back lot. (Motion carried 3-2: Williams: I definitely disagree with the stated hardship; Armstrong: I agree there is no hardship stated and want to wait for the outcome of the 30th Street Easement.) D. PUBLIC HEARING: Feasibility Report and Order Project for Improvement of Legion Avenue Mayor Dunn opened up the Public Hearing at 8:18 p.m. in the City Council chambers. The Public Hearing notice was published in the St. Croix Valley Press on April 18 and April 25, 1990. All benefitting property owners were notified. City Engineer, Larry Bohrer, reported on the proposed improvement and on the proposed preliminary assessment rate and assessment role. (See L. Bohrer's Feasibility Report). Proposed Improvement: It is planned to overlay the street with a 1 1/2" thick bituminous overlay to strengthen the entire surface and seal off the cracks. A 1 1/2" overlay was chosen instead of a 2" overlay because Legion Avenue has very little rutting compared to other streets and no leveling is required. Gravel will be added to the shoulders and all driveways will be matched. Proposed Assessments It is proposed that the entire cost of the project be assessed to benefitting property. Benefitting property is every parcel which abuts the street or gains primary access from the street. Corner lots which were recently assessed for street imrpovements on one side will receive a one-half assessment on Legion Ave. Lots that have double frontage, but are not corner lots, will be reviewed individually to see if the property benefits from the second frontage. In this particular case, Lots 3 and 4, Packard Park 2nd Addition, have secondary frontage on Legion Avenue. But since the building part of LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 7 these lots is approximately 30 feet higher than the road, Lots 3 and 4 are considered not benefitted. The method of assessment is proposed to be the Unit Method. The City owns one lot designated "Park" on the plat and is charged one unit. Proposed Assessment Rate = $19,360.00/12 Units _ $1613/Unit Mary Leslie, 11546 20th St. N., stated that gravel deliveries have done damage to the road and sees no benefit to their property. She asked if some other material which would stay in place could be used for the shoulder. Bob Stone, 2390 Legion Lane, stated he disagreed with the explanation from the engineer on why the road deteriorated. He felt there should be a broader distribution of assessments to benefitting properties. Debra Wilfong, 2229 Legion Avenue N., voiced her opposition to the assessments because it was hard to believe the deterioration of the road was because of the soils. On a daily basis there was heavy equipment that travel this road for development of Packard Park. There should be an immediate ban on heavy equipment using this road. The road should not be improved until the water problem has been solved in case the road would need to be dug up. Ann Bucheck, 2301 Legion Avenue, voiced her concern on the construction equipment that travelled this road and did not want to pay this assessment for the development of Packard Park. She requested a load limit be placed at 8 a.m. on Wednesday to preserve this road. Nothing should be done to this road until the city meets with VBWD in order to find out if this road would be considered within their water project. She prefered the grass shoulders because it looks more rural than gravel shoulders. This is the only access to the Packard Park property and felt the benefitting distribution could be extended. Chris Mayer, 2229 Legion, stated without the exception of using helicopters, how would the property owners of Packard Park get to their houses. The assessments should be based on if they use it. Jean Durand, 11332 20th St., stated Legion Avenue has no benefit to her parents, only to the developer of Packard Park. They don't use the road so they don't have to pay. Other people are benefitting from this road and are not assessed for it. The damage done to the road has been caused by heavy equipment. Linda Stone, 2390 Legion Lane, requested road limits be placed year around and enforcement of these restrictions. Joan Richert read into record the objections for the proposed iml.rovements and assessment to her parents, Peter and Bernadine Durand at 11332 20th St. Mayor Dunn closed the public hearing at 9:20 p.m. LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 8 Councilman Hunt pointed out the Council has heard 7 out of the 12 affected households that they do not want this street improvement this summer and request delay of the project for a year. The City should get more information from VBWD on the water project. Councilman Graves asked the City Engineer what the consequences would be to postpone the street improvement project until 1991? Bohrer answered it would be more expensive, an increase of 5 to 7%, because a road deterioration accelerates with age. The street is reasonably smooth and safe. Graves suggested waiting until construction in Packard Park is done and the VBWD has developed their plan. Larry Bohrer indicated the road construction would be done in Packard Park, but home construction is based, on economics. Trucks would use the new access. Councilwoman Armstrong felt the street was driveable for another year. M/S/P Graves/Williams - to not proceed with street improvement for Legion Avenue, 20th Street to legion Lane (N.Jct.), as being proposed by the City Engineer, but that we continue with normal street maintenance. (Motion carried 5-0). E. PUBLIC HEARING: Lampert Avenue, 32nd Steet to 33rd Street Bituminous Overlay Mayor Dunn opened up the Public Hearing at 9:35 p.m. in the City Council chambers. The public hearing notice was published in the St. Croix Valley Press on April 18 and April 25, 1990. All benefitting property owners were notified. City Engineer Larry Bohrer explained the proposed improvement and proposed assessment role and rate for Lampert Avenue, 32nd Street to 33rd Steet. (See L. Bohrer's Feasibility Report) Proposed Improvements: It was recommended that the areas of broken pavement be cut out and patched with a 4" thick bituminous patch. A 2" thick bituminous overlay should be constructed over the entire surface to strengthen the road, level the settled areas and seal off the cracks. Topsoil would be placed along the edges of the overlay to match the boulevards and gravel would be added to the gravel driveways as necessary. The improvements should be done in July or the beginning part of August. Assessments: It was proposed that the entire cost of the project be assessed to benefitting property. Benefitting property is every parcel which abuts the street or gains primary access from the street. Proposed Assessment Rate = $10,475.00/12 Units _ $873/Unit LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 9 Scott Nietzel, 3291 Lampert Avenue N., stated the street was in terrible condition and had no problem with the project. Hei asked if the overlay would match up to his concrete driveway. Bohrer responded the overlay would match right in with his concrete driveway. Mayor Dunn closed the public hearing at 9:42 p.m. M/S/P Graves/Hunt - to approve Resolution No. 90-20, Proceed with the bituminous overlay street improvement project for Lampert Avenue from 32nd Street to Lower 33rd Street. (Motion carried 5-0). 7. CITY ATTORNEY'S REPORT: A. Easement on 30th Street Attorney Carlson explained the City has been given notice of a hearing scheduled for May 3rd at Washington County District Court to determine who is the underlying fee owner of land which lies between the Taylor and the Mazzara parcels and explained what options the City had in this matter. M/S/P Williams/Graves - to instruct the City Administrator to write a letter to the Washington County Court stating that based on finding that the easement does not now serve a useful public purpose, the City intends to grant a quit claim deed to whomever is found by the court to be the correct fee owner. (Motion carried 5-0). B. Litigation Report The Council received the monthly pending litigation report. B. CITY COUNCIL REPORTS: A. Section 32 Update Councilman Hunt pointed out the articles in the newspaper stating there has been a settlement in Section 32 were incorrect and heavily based on rumors. A draft has been prepared by the negotiating teams with the input of property owners and is currently in the hands of the Lake Elmo's and Oakdale's attornies for their review. When this document is finished, it will be presented to both Councils and to the public, simultaneously, for public discussion. The details have been discussed as reflected in the City Council minutes of April 23, 1990. B. Personnel Committee Councilman Williams pointed out the Personnel Committee was to meet to discuss the City Administrator's contract and asked this be accomplished. Councilman Graves indicated he has been out-of-town longer than expected and has not had an opportunity to get together with the Committee, but intends to accomplish this as quickly as possible. Mayor Dunn has consented, if needed, to sit in any committee if Councilmen Hunt or Graves cannot attend the meeting. The City Administrator will call this meeting. LAKE ELMO CITY COUNCIL MINUTES MAY 15, 1990 PAGE 11 M/S/P Graves/Hunt - to accept the bid, $140/application, for lawn care for Kleis Park from Green Stuff Lawn Treatments. (Motion carried 3-1: Armstrong: She felt chemical applications were environmentally unsound and hated to see these grass clippings end up in our compost pile, was a danger to our children and pets, not a good precedent to set for us as a City and foolish waste of money which could be put to a better use.) C. Update on Section 32 Administrator Kueffner reported the Oakdale City Council voted 4:1 to approve a written agreement generated from meetings composed of a group of officials from both cities in an effort to resolve border disputes due to action by Lake Elmo property owners in Section 32 to annex to Oakdale. Councilman Hunt indicated he was one of the negotiators, and although this is the best agreement we would get out of Oakdale, he did not feel that in good faith the City should approve this agreement at this time. He would be willing to sit down with the property owners and work with them and try to rebuild their trust. Based on Councilman Hunt's recommendation and the Mayor's opinion, Councilwoman Armstrong would not give approval to proceed with this agreement. She would welcome actually seeing the first proposal for Section 32. Councilman Williams indicated the Council has repeatedly stated to the property owners, "bring in a development proposal and we want to work with you". Councilman Graves would like to see the property owners give the council a chance to work with them for the betterment of the individuals and for the community. He concurred with the comment that the City was not getting much, and that "Oakdale was trying to strongarm us". Bob Dreher, Section 32 property owner, asked for a letter, signed by the City Council, stating the the City would be willing to work with the Section 32 property owners and/or developers. He would be willing to deliver such a letter to the property owners. The Council asked the City Administrator to prepare such a letter for their signatures. M/S/P Hunt/Armstrong - to recommend rejection of the draft agreement of May, 1990, between Lake Elmo and Oakdale for detachment and annexation of land. (Motion carried 4-0). M/S/P Hunt/Graves - to adjourn the City Council meeting at 11:50 p.m. (Motion carried 4-0). LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 10 9. CITY ADMINISTRATOR'S REPORT: A. SW-1 Public Water Supply Update -- Officially appoint City Council representatives to Negotiating Committee Washington County has a problem with meeting with more than a sub -committee of two members of the City Council while negotiating a public water supply in the Lake Jane Well Advisory Area. The Council should officially appoint two members to this committee. Mayor Dunn and Councilman Hunt have been representing the City. Councilman Graves indicated he has been involved with discussions with the County in trying to address the problem for years and felt Mayor Dunn and Councilman Hunt have had an opportunity to be intimately involved with discussions with Oakdale relative to Section 32 and felt it was appropriate to share these duties with other representatives of the Council. He has talked to Mary Luth and, in her opinion, there was no discontinunity in the progress that has been made if there was a change. From a technical standpoint, he believes he would be better qualified to make contributions to this issue and would like the opportunity. He would be more than willing to assume this responsibility. Mayor Dunn appreciated Councilman Graves' offer, but noted for over three months we could not get the Personnel Committee to meet for an hour, which Councilman Graves specifically asked to be appointed to. She understands his work schedule is demanding, and he doesn't always have the time to put forth. She has more flexibility than someone in his position and is willing to put forth the many hours that are needed. Updates on the meetings are given regularly and input from all Council members are encouraged and appreciated. Councilman Hunt stated his family commitments are much lower than other Councilmembers and his work hours are extremely flexible. Councilwoman Armstrong indicated that Mayor Dunn and Councilman Hunt have this under control, and we should not disrupt the process right now. M/S/P Williams/Armstrong - to appoint Mayor Dunn and Councilman Hunt as official representatives of the City in discussions with the County on the public water supply. (Motion carried 4-1: Graves) M/S/P Hunt/Williams - to adjourn the City Council meeting at 10:16 p.m. (Motion carried 5-0). TODAY WE READ IN THE PAPER THAT NEGOTIATIONS ARE COMPLETE AND ON MAY 8TH WE WILL GIVE UP SECTIOZ,'b OAKDALE. 1 NOT SO MUCH AS A PUBLIC HEARING, A PUBLIC INFORMATION MEETING OR A SIMPLE INFORMATION LETTER TO THE CITIZENS. The inspection consisted of a tour, by each of the tennants, of the area they occupy and also a step-by-step procedure of the process used in creating their finished product. Neither tennant stored any excess chemicals. They keep in their-tennant space only the chemicals that they are in the process of using. It was explained to me that the shelf life of some of the chemicals is very short, therefore, it is more economical to buy the chemicals as they are used, Glass E.T.C. is licensed by Washington County Public Health (License #6110). They are considered a small hazardous waste generator. The waste generated is strips of film trimmed from the negative during the photo process and then properly disposed of by a designated waste hauler. The generation and disposal of this hazardous waste is controlled by Washington County Public Health and on -site inspections are made periodically by Cheryl Erler of the County, I also spoke with Bruce Brott of the Minnesota Pollution Control Agency concerning the hazardous materials and the word "storage". The State of Minnesota has not legally defined the word "storage", however, because of the permit process required through M,P,C.A, for hazardous materials, guidelines have been set forth by M.P,C,A. For a small generator, such as Glass E.T,C., a minimum of 90 days is allowed before it is considered hazardous storage. Up to 270 days is allowed under certain conditions, Glass E.T.C. has their waste material removed every 30 to 60 days by a designated waste hauler for recycling, Etching Concepts was also investigated by Washington County Public Health and has been determined not to be a hazardous waste generator, con It LI Trans City Page 2 The chemical used in their process is a 12 oz. bottle of hydrofluoric acid. They maintain 4 - 12 oz. bottles of the chemical for their glass etching process. After inspecting the tennant spaces at Trans City and meeting with Washington County Public Health and speaking with Mr. Brott at M,P.C,A. I do not feel there is a violation of Trans City's Conditional Use Permit. It has been patched over the years and some areas have settled. The age of Its original paving is unknown to me. The areas . of "alligator" cracking are beginning to come loose and will become potholes shortly. The City crew patched several areas last year. Proposed Irnprovernent It Is recommended that the areas of broken pavement be cut out and patched with a 4" thick bituminous patch. A 2" thick bituminous overlay should be constructed over the entire surface to strengthen the road, level the settled areas and seal off the cracks. Topsoil would be placed along the edges of the overlay to match the boulevards and gravel would be added to the gravel driveways as necessary. Feasibility The project is feasible and should best be made as proposed. Initiation This project was Initiated by the City Council, therefore ordering the project will require a four -fifths majority vote. (Motion carried 4-0). Frank Langer, Assessor, submitted a list of recommendations to the Lake Elmo Board of Review. (See Appendix A) Mary Leslie, 11546 206th St., stated her house was in poor condition because of the loss of their central heating system last year. They are using a wood burning stove to heat the house until a new furnace and ducting can be installed. Because the owner has not permitted Frank Langer or Scott Renee into the residence, an inside inspection relative to this complaint was not made. M/S/P Graves/Hunt - to accept the Lake Elmo Assessor's recommendations presented to the Board of Review; with the exception of Mary Leslie, PID 37024-2700, until such time someone from the assessor's office can make an inside inspection relative to her complaints. CLAIMS Councilman Williams reported Claim #93236 Leonard, Street and Deinard in the amount of $1,514.80 should be reduced to $709.80. Williams reported he had talked to Ellen Sampson who stated this bill had not been reviewed by her and felt an adjustment would be made. The part under question will not be paid at this time. M/S/P Hunt/Armstrong - to approve the May 1., 1990 Claims #93218 thru #93267 with amended Claim #93236 reduced to the amount of $709.80. (Motion carried 5-0). 4. PUBLIC INQUIRIES Kelly Brockman, 3385 Lake Elmo Avenue, stated on several occasions this Council has been asked "What is the situation on the Section 32 negotiations"? The Mayor has answered "We're just talking, nothing is really happening". Today we read in the paper that negotiations are complete, and we will give up Section 32 to Oakdale without a public information meeting or an informational letter to the citizens. Mr. Brockman asked the Council for an informational meeting to let the citizens of our city know what is going on. Above all, do not give away Section 32. Mayor Dunn responded that no decision on Section 32 has been made with Oakdale. The newspaper article was in error. Negotiations have been on -going between Oakdale representatives and Lake Elmo representatives, Councilman Hunt and, herself. If an agreement is reached, this will be brought before the entire Council for their approval. Councilman Hunt read an excerpt from the newspaper article and clarified that no meeting date had been set. He indicated to Mr. Brockman, if he would like to stay, Section 32 was on the agenda later in the evening. 5. REAPP REPORT: No report was given. 6. PLANNING/LAND USE/AND ZONING: A. Trans -City Investment - Amendment to C.U.P. (Continuation) M/S/P Hunt/Graves - to bring back onto the table for Council consideration the amendment to C.U.P. by Trans -City Investment. (See J.McNamara's letter PAGE 3 Jim McNamara reported inspecting the tenant County Public Health and there is a violation of dated Apgl. 27, 1990). Mary Ann E. and H. Brent Archer, Glass Etc., gave a presentation on the process used in creating their finished product. The Council was provided with a statement from Gary Legand, Env. Specialist of 3M Graphic Products Marketing, that there were no peculiar chemcial qualities or unusual ingredients which would make the 3M products they use unusually hazardous either as inventory or as generators of waste. Copies were provided of the statement from Dr. Bruno Staffen, Senior Environmental Employee, stating the federal. legal definition of storage. (See attachments) Councilman Williams indicated his appreciation to Glass Etc. for coming before the Council with their presentation. He added,"I had stated, if any violation to the C.U.P. existed I believed it would have been unintentional.�When he asked the Building Official if hazardous materials were being stored, he could not answer this question and was unable to get the answer to him by the next Council meeting. Based on the advice of our City Attorney, I requested we postpone consideration of the C.U.P. until an inspection was made. As a result of the inspection by the Bldg. Official and a rep. from the County Health Dept., Williams expressed his satisfaction there was no violation to the C.U.P. This is the type of business we would like to have in our community and welcome Glass Etc. into our city. M/S/P Hunt/Williams -- to accept the letter of April 27, 1990 from Jim McNamara (Motion carried 5-0). Councilwoman Armstrong has checked the site and had no problem with the proposed storage. Councilman Williams requested the following condition to be added to the C.U.P. Condition No. 7: Screen of double row of evergreen trees (no size specified) shall be maintained along the north side of fence. M/S/P Williams/Hunt - to adopt Resolution No. 90-20, A Resolution Amending Resolution 88-14 to include Outside Storage as Part of An Alternate Agricultural Conditional Use Permit; including Condition No. 7 as stated, to Howard Gelb and. Trans -City Investments. (Motion carried 5-0). B. Ray Salus - CUP Application for Golf Driving Range Background Information: In October, 1989 Mr. Salus applied for a large lot subdivision and a rezoning from RR to PF to allow for a Golf Driving Range on his property south of Cimarron. (Prior to Mr. Salus' application, S. Blasko was granted a similar request for property just south of Oak -land Junior High School). After Blasko's request was approved, the Planning Commission dQtermined that Gold Driving ftngEs we e not specifically allowed in the PF zoning .istric e ity rCouncil LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1.990 PAGE 4 charged the PZ with dealing with this issue and to return to the Council a recommendation by December 5th which the Commission had not been able to do. The staff: suggested to Mr. Salus to change his application from the Large Lot Subdivision and Rezoning to a Conditional Use Permit (refer to Section 301.060D, Page 302-21 of. the Municipal. Code). The PZ held a public hearing on this amended request for a C.U.P. which included a minature golf course at its April. 23rd meeting where one person opposed the proposal and three persons supported it. The PZ tabled the action until its May 14th meeting. Mr. Salus indicated he would remove the request for the minature golf course, and asked to be placed on this Council agenda to obtain a consensus, one way or the other, from the Council on the golf driving range. Mayor Dunn noted for the record the Council received a letter from Robert Engstrom Companies requesting that the application be denied. (See letter 4/27/90 from Robert E. Engstrom) Administrator Kueffner suggested downzoning the property to Ag with a C.U.P. This application could be treated similarly to H. Springborns' application which was commercial recreation of a rural nature. Mr. Salus was willing to be downzoned to Ag. Mayor Dunn indicated she had no problem with the golf driving range. Councilman Graves indicated he had no problem with a golf driving range or the minature golf course. Infact, he felt it would be a nice addition to the community. Councilwoman Armstrong stated she had no problem with the golf driving range, but felt the minature golf course was too much for the area. The golf driving range retains the open space of the land, and it is surrounded by business, such as, Cimarron, Trans -City Investments, and the Drive -In Theater This would not be a detriment to the neighborhood. Armstrong suggested the parking area be dropped down below the berm next to the road so the cars were not seen. Councilman Hunt had a problem with a C.U.P. for this use in a Rural Residential area and felt it would be a dangerous precedent to start allowing C.U.P.'s of any type in a RR area. We do allow uses in Ag with a C.U.P. that would fit this recreation of a rural use, but felt the minature golf was an intense use. A golf driving range would not destroy the neighborhood. Councilman Williams felt this use was a commercial use in a residential area, and the Council has tried to very carefully define where commercial uses should go in our City. One of the areas is just south of this property and along the I-94 corridor. The Council needs to look at the overall proper planning for the City and decide if this is a use which belongs in a residential area or should this use go in a predominantly commercial area. Because there are residences already in the neighborhood and a new development is being built across the LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 5 street, this is not an appropriate use for a residential area and should not be allowed. Williams added he did not think it was a good idea for the Council to be taking any action on a matter that has been properly postponed by the PZ. The PZ has 60 days after a Public Hearing to submit a report. C. PUBLIC HEARING: Stephen & Elizabeth Johnson Variance to Sideyard Setback Mayor Dunn opened up the public hearing at 8:03 p.m. in the City Council chambers. The Public Hearing notice was published in the St. Croix Valley Press on April 11, 1990 and abutting property owners were notified. Stephen Johnson, 2945 Lake Elmo Avenue, explained he was granted at an October, 1989 Council meeting a Shoreland Permit to add on to the existing structure. A survey was requested, but was not done until a week after the October Council meeting. After having the property surveyed, it was determined the addition cannot meet the 10' setback, and he has applied for a 1 1/2' to 2' variance to the sideyard setback. Johnson indicated his hardship was that the addition cannot be built without granting this variance due to the layout of the house and lot. He would still have access from the front of the house to the back of his property once the addition has been added. The DNR has no concern with this request. Jim McNamara, Building Official., explained the reason this was missed because one corner.of the house sits on an angle to the lot. Once the survey was taken, which was after the shoreland permit was granted, it was determined they were 2' short. Dave Swanson, 2929 Lake Elmo Avenue, stated he had no problem with this variance. The houes are parallel, but not parallel. to the lot line. If Mr. Johnson builds the addition as planned, the house is not going to be any closer to his house. Mayor Dunn closed the public hearing at 8:07 p.m. Councilman Hunt felt the City has shown in the past a history of granting small variances, especially in older areas with existing housing layout from the road and lake which has been considered a hardship. Currently, there is no access to the back part of the property. Mayor Dunn had no problem with granting a 2' variance to the sideyard setback. Councilwoman Armstrong voiced her concern about the 10' on the side, which is the access to lot behind his house, would be cut off by the addition to the back property. Johnson responded that it is his intention to settle the easement issue before he would start construction. If he moves 8" the other way, he would start infringing up the restriction of the septic system. LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 6 Councilman Williams referred to the certificate of survey which states 8' for a sideyard setback. Our code is specific in that there must be a hardship for granting a variance andFltid not see a hardship demonstrated here. Mr. Johnson could 'decrease the size of the addition or change the design to avoid the variance. Councilman Graves had no problem with granting this variance. The Council has granted variances such as this in the past. The neighbor has no problem with the variances and there was no one else to speak against it. The addition would upgrade the neighborhood, improve the overall economic appearance and esthetics to the property and still allow access to the back lot. M/S/P Graves/Hunt - to grant approval of the 2' variance request to Stephen and Elizabeth Johnson, 2945 Lake Elmo Avenue, to the sideyard setback based on the hardship being stated there are no other physical options and on the orientation of the houses on their .lots due to circumstances surrounding the road placement and placement of the lake and the septic system. Mr. Johnson was made aware that approval of this request may cause a hardship to himself in cutting off access to the back lot. (Motion carried 3-2: Williams: I definitely disagree with the stated hardship, Armstrong: I agree there is no hardship stated. and want to wait for the outcome of the 30th Street Easement.) D. PUBLIC HEARING: Feasibility Report and Order Project for Improvement of Legion Avenue Mayor Dunn opened up the Public Hearing at 8:18 p.m. in the City Council chambers. The Public Bearing notice was published in the St. Croix Valley Press on April 18 and April 25, 1990. All benefitting property owners were notified. City Engineer, Larry Bohrer, reported on the proposed improvement and on the proposed preliminary assessment rate and assessment role. (See L. Bohrer's Feasibility Report). Proposed Improvement: It is planned to overlay the street with a 1 1/2" thick bituminous overlay to strengthen the entire surface and seal off the cracks. A 1 1/2" overlay was chosen instead of a 2" overlay because Legion Avenue has very little rutting compared to other streets and no leveling is required. Gravel will be added to the shoulders and all driveways will be matched. Proposed Assessments It is proposed that the entire cost of the project be assessed to benefitting property. Benefitting property is every parcel which abuts the street or gains primary access from the street. Corner lots which were recently assessed for street imrpovements on one side will receive a one-half assessment on Legion Ave. Lots that have double frontage, but are not corner lots, will be reviewed individually to see if the property benefits from the second frontage. In this particular case, Lots 3 and 4, Packard Park 2nd Addition, have secondary frontage on Legion Avenue. Bob Stone, 2390 Legion Lane, stated he disagreed with the explanation from the engineer on why the road deteriorated. He felt there should be a broader distribution of assessments to benefitting properties. Debra Wilfong, 2229 Legion Avenue N., voiced her opposition to the assessments because it was hard to believe the deterioration of the road was because of the soils. On a daily basis there was heavy equipment that travel this road for development of Packard Park. There should be an immediate ban on heavy equipment using this road. The road should not be improved until the water problem has been solved in case the road would need to be dug up. Ann Bucheck, 2301 Legion Avenue, voiced her concern on the construction equipment that travelled this road and did not want to pay this assessment for the development of Packard Park. She requested a load. limit be placed at 8 a.m. on Wednesday to preserve this road. Nothing should be done to this road until the city meets with VBWD in order to find out if this road would be considered within their water project. She prefered the grass shoulders because it looks more rural than gravel shoulders. This is the only access to the Packard Park property and felt the benefitting distribution could be extended. Chris Mayer, 2229 Legion, stated without the exception of using helicopters, how would the property owners of Packard Park get to their houses. The assessments should be based on if they use it. Jean Durand, 11332 20th St., stated Legion Avenue has no benefit to her parents, only to the developer of Packard Park. They don't use the road so they don't have to pay. Other people are benefitting from this road and are not assessed for it. The damage done to the road has been caused by heavy equipment. Linda Stone, 2390 Legion Lane, requested road. limits be placed year around and enforcement of these restrictions. Joan Richert read into record the objections for the proposed improvements and assessment to her parents, Peter and Bernadine Durand at 11332 20th St. Mayor Dunn closed the public hearing at 9:20 p.m. LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1.990 PAGE 8 Councilman Hunt pointed out the Council has heard 7 out of the 12 affected households that they do not want this street improvement this summer and request delay of the project for a year. The City should get more information from VBWD on the water project. Councilman Graves asked the City Engineer what the consequences would be to postpone the street improvement project until 19917 Bohrer answered it would be more expensive, an increase of 5 to 7%, because a road deterioration accelerates with age. The street is reasonably smooth and safe. Graves suggested waiting until construction in Packard Park is done and the VBWD has developed their plan. Larry Bohrer indicated the road construction would be done in Packard Park, but home construction is based on economics. Trucks would use the new access. Councilwoman Armstrong felt the street was driveable for another year. M/S/P Graves/Williams - to not proceed with street improvement for Legion Avenue, 20th Street to legion Lane (N.Jct.), as being proposed by the City Engineer, but that we continue with normal street maintenance. (Motion carried 5-0). E. PUBLIC HEARING: Lampert Avenue, 32nd Steet to 33rd Street Bituminous Overlay Mayor Dunn opened up the Public Hearing at 9:35 p.m. in the City Council chambers. The public hearing notice was published in the St. Croix Valley Press on April 18 and April 25, 1990. All benefitting property owners were notified. City Engineer Larry Bohrer explained the proposed improvement and proposed assessment role and rate for Lampert Avenue, 32nd Street to 33rd Stret. (See L. Bohrer's Feasibility Report) Proposed Improvements: It was recommended that the areas of broken pavement be cut out and patched with a 4" thick bituminous patch.. A 2" thick bituminous overlay should be constructed over the entire surface to strengthen the road, level the settled areas and seal off the cracks. Topsoil would be placed along the edges of the overlay to match the boulevards and gravel would be added to the gravel driveways as necessary. The improvements should be done in July or the beginning part of August. Assessments: It was proposed that the entire cost of the project be assessed to benef.itting property. Benefitting property is every parcel which abuts the street or gains primary access from the street. Corner lots which were recently assessed for street improvements on one side will receive a one-half assessment on Lampert Avenue. The method of assessment is proposed to be the Unit Method. Proposed Assessment Rate = $10,475.00/12 Units _ $873/Unit LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 9 Scott Nietzel, 3291 Lampert Avenue N., stated the street was in terrible condition and had no problem with the project. He asked if the overlay would match up to his concrete driveway. Bohrer responded the overlay would match. right in with his concrete driveway. Mayor Dunn closed the public hearing at 9:42 p.m. M/S/P Graves/Hunt - to proceed improvement project for Lampert Street. (Motion carried 5-0). 7. CITY ATTORNEY'S REPORT: A. Easement on 30th Street with the bituminous overlay street Avenue from 32nd Street to Lower 33rd Attorney Carlson explained the City has been given notice of a hearing scheduled for May 3rd at Washington County District Court to determine who is the underlying fee owner of land which lies between the Taylor and the Mazzara parcels and explained what options the City had in this matter. M/S/P Williams/Graves - to instruct the City Administrator to write a letter to the Washington County Court stating that based on finding that the easement does not now serve a useful public purpose, the City intends to grant a quit claim deed to whomever is found by the court to be the correct fee owner. (Motion carried 5-0). B. Litigation Report The Council received the monthly pending litigation report.. 8. CITY COUNCIL REPORTS: A. Section 32 Update Councilman Hunt pointed out the articles in the newspaper stating there has been a settlement in Section 32 were incorrect and heavily based on rumors. A draft has been prepared by the negotiating teams with the input of property owners and is currently in the hands of the Lake Elmo's and Oakdale's attorney for their review. When this document is finished, it will be presented to both Councils and to the public, simultaneously, for public discussion. The details have been discussed as reflected in the City Council minutes of April 23, 1.990. 9. CITY ADMINISTRATOR'S REPORT: A. SW-1 Public Water Supply Update -- Officially appoint City Council representatives to Negotiating Committee Washington County has a problem with meeting with more than a sub -committee of two members of the City Council while negotiating a public water supply in the Lake Jane Well Advisory Area. The Council should officially appoint two members to this committee. Mayor Dunn and. Councilman Hunt have been representing the City. LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 10 Councilman Graves indicated he has been involved with discussions with the County in trying to address the problem for years and felt Mayor Dunn and Councilman Hunt have had an opportunity to be intimately involved with discussions with Oakdale relative to Section 32 and felt it was appropriate to share these duties with other representatives of the Council. He has talked to Mary Luth and, in her opinion, there was no discontinunity in the progress that has been made if there was a change. From a technical standpoint, he believes he would be better qualified to make contributions to this issue and would like the opportunity. He would be more than willing to assume this responsibility. Mayor Dunn appreciated Councilman Graves' offer, but noted we cannot even get the Personnel Committee, which Councilman Graves is on, to meet for an hour. She understands his work schedule is demanding and he doesn't always have the time to put forth. She has more £lexability than someone in his position and is willing to put forth the many hours that are needed. Councilman Hunt stated his family commitments are much lower than other Councilmembers and his work hours are extremely flexible. Councilwoman Armstrong indicated that Mayor Dunn and Councilman Hunt have this under control, and we should not disrupt the process right now. M/S/P Williams/Armstrong - to appoint Mayor Dunn and Councilman Hunt as official representatives of the City in discussions with the County on the public water supply. (Motion carried 4-1: Graves) B. OTHER Councilman Williams pointed out the Personnel Committee was to meet to discuss the City Administrator's Contract and asked this be accomplished. Councilman Graves indicated he has been out of town longer than expected and has not had an opportunity to get together with the Committee, but intends to accomplish this as quickly as possible. Mayor Dunn has consented, if needed, to sit in any committee if Councilmen Hunt or Graves cannot attend the meeting. The City Administrator will call this meeting. Because of delays in the EIS project schedule by the County, a year has passed since we negotiated our original contract with the City (May 5, 1989). During this period, DPRA has increased its labor rates approximately seven percent as a result of annual adjustments (effective April 1) to staff salaries. This annual change represents both a cost -of -living and performance increase for staff. This does not affect the overhead rate, profit level, or total projecf costs fgf[ected in our current contract with the City (December 4, 1989). We therefore ask that the City and ReAPP approve our new labor rates, effective April 1, 1990 through March 31, 1991, for services performed under our existing contract. We have not included this rate increase on the enclosed invoice for April's billings. Upon approval by the City and ReAPP, DPRA will invoice the remaining difference for April ($263.27) on the next invoice. Thank you for your consideration of this matter. Lake Elmo, MN 55042 Re: Possible Appeals Dear Mayor Dunn and Council Members: In April a Lake Elmo drunk driving case was dismissed by a judge for lack of probable cause for a stop. $oth the arresting deputy and I were surprised at the judge's ruling. In some of these cases it may be possible for the prosecutor to appeal the case to the Minnesota Court of Appeals. However Lake Elmo has no policy on when an appeal should be made by the prosecutor, if ever. An appeal in a criminal case not only involves the extra cost of preparing the appeal and having briefs printed, but will often result in the prosecuting ,governmental entity (Lake Elmo in our case) paying for the defendant's attorney's fees and costs of appeal. Usually the cost of an appeal is too much to ,justify making the appeal. In some cases, such as criminal nuisance or zoning violations the cost of not appealing may be even more in the longrun. As the Lake Elmo prosecutor I would like to see a clear policy on appeals. In most criminal cases the rules of criminal procedure require the prosecutor to file the appeal within five days of the trial court ,judge's order. I will not commit the city to the cost of an appeal unless there is some bind of a guideline, and our present prosecution contract does not address the issue of appeals anyway. I will be out of town in early June, but would he free to address the council at its July meeting if you so wish. In any case, I would want to know when, if ever, you would want me as prosecuting attorney to appeal a case. Again, I emphasize that the cost of an appeal is seldom worth the effort of making the appeal in criminal cases, and in the case dismissed in April the city could have never made up the cost of the appeal with a fine had we won the case. However you may wish to establish some kind of strict guideline which would involve the prosecutor geLtingy a written order from the mayor or someone else before initiating an appeal. There is also the likelihood that the metro area will have competing installations of national franchises for miniature golf. These elaborate and expensive installations usually have a theme such as Jungle Golf, Shipwreck Golf, etc. They also have a common theme of being located on high visibility roads and areas of dense population. That the two rod strip of land was first referred to and created by a deed dated July 25, 1946, between Roscoe J. Collopy and Josephine Collopy, husband and wife, grantors and Roland D. That at some point in time someone apparently advised the Auditor -Treasurer that the two rod strip was a separate parcel which had been inadvertently dropped from the tax rolls and in the years 1985-86 a two rod strip was placed on the tax rolls as Plat/Parcel 37024-0055. Delinquent tax statement is attached to this report as Exhibit "B". No record of ownership of said parcel, except on Certificate of Title No. 14234, appears in the office of the Registrar of Titles. 5. The intent of Roscoe J. Collopy and Josephine Collopy at the time of the execution of the deed of July 25, 1946 would appear to control the determination of this petition. The apparent intent of the deed was to create a public easement rather than reserve the fee and the instrument was obviously construed in that manner by the then Registrar of Titles. if the Court determines on hearing this matter that that was the intent of the grantors, it would appear that the easement failed and that the owners of the underlying fee, who would appear to be applicants herein, own that fee free of any easement. { 6. During the hours of 8:00 a.m. to 12:00 p.m. on July 5 and July 6, 1990, the boating activities on Lake Elmo shall be restricted to "no -wake" speed. B. During the hours of 4:00 p.m. to 8:00 p.m. on July 5, 1990, the boating activities on Lake Elmo shall be restricted to "no wake" speed. C. During the hours of 6:00 a.m. to 10:00 a.m. on July 10 and July 11, 1990, the boating activities on Lake Elmo shall be restricted to "no wake" speed. D. During the hours of 3:00 p.m, to 7:00 p.m. on July 10 and July 11, 1990, the boating activities on Lake Elmo shall be limited to "no wake" speed. E. During the hours of 7:00 a.m. to 11:00 a.m. and 3:00 p.m. to 7:00 p.m. on July 12, 1990, the boating activities on Lake Elmo shall be limited to "no wake" speed. F. During the hours of 8:00 a.m. to 11:30 a.m. and 4:00 p.m. to 7:00 p.m. on July 7, 1990, no boat traffic will be allowed on 'Lake Elmo with the exception of non -motorized boats from adjacent private property, and all such boats must remain motionless during the competition. G. During the hours of 8:00 a.m. to 11:15 a.m. and 4:00 p.m. to 7:15 p.m, on July 8, 1990, no boat traffic will be allowed on Lake Elmo with the exception of non -motorized boats from adjacent private property, and all such boats must remain motionless during the competition. H. During the hours of 6:30 a.m. to 10:45 a.m. on July 13 and July 14, 1990, no boat traffic will be allowed on Lake Elmo with the exception of non -motorized boats from adjacent private property, and all such boats must remain motionless during the competition. I. During the hours of 6:30 a.m. to 11:30 a.m. on July 15, 1990, no boat traffic will be allowed on Lake Elmo with the exception of non -motorized boats from adjacent private property, and all such boats must remain motionless during the competition. SECTION 3: ENFORCEMENT: The enforcement of this ordinance shall be the primary responsibility of the Washington County Sheriff's Department. Other licensed peace officers including Conservation Officers of the Department of Natural Resources of the State of Minnesota are also authorized. SECTION 4: All authorized Resource Management, Emergency and Enforcement Personnel, while acting in the performance of their duties are exempt from the foregoing Restrictions. SECTION 5: PENALTIES: Any person who shall violate any of the provisions of this ordinance shall be guilty of a Misdemeanor, and upon conviction thereof, shall be punished by a fine of not more than Seven Hundred Dollars ($700.00) or by imprisonment of not more than ninety (90) days, or both. SECTION 6: EFFECTIVE DATE: This Ordinance shall be in effect upon its passage and publication from July 5, 1990 through July 15, 1990. THE FEDERAL LEGAL DEFINITION OF "STORAGE" IS 90 DAYS AFTER GENERATION OF THE WASTE. 2. A SMALL QUANTITY GENERATOR WHO GENERATES LESS THAN 100 KILOGRAMS OF HAZARDOUS WASTE PER MONTH, MAY EXTEND THE STORAGE PERIOD TO 270 DAYS. 3. THIS EXTENDED PERIOD IS GIVEN SO THAT THE SMALL COMPANY, WHICH DOES NOT POSE A SERIOUS DANGER TO THE ENVIRONMENT, DOES NOT HAVE TO PAY EXORBITANT DISPOSAL FEES. 4. DR. STAFFEN IS VERY WELL AWARE OF MINNESOTA'S POLLUTION CONTROL AGENCY GUIDELINES. HE FEELS THAT IF WE STATISFY THOSE, (AMONG THE MOST RIGOUROUS IN THE COUNTRY), WE WOULD SATISFY STANDARDS ANYWHERE. 5.
