Present: Dunn, Hunt, Williams, Armstrong, City Engineer Larry Bohrer, Attorney Steve Carlson, and Administrator Kueffner. Absent: Graves. 1. AGENDA Add: ReAPP Report: Request from Solid Waste Advisory Committee relating to Olympic Festival events in Park, 11C. Update on Future Land Use Map Mailing. M/S/P Williams/Hunt - to approve the June 5, 1990 City Council agenda as amended. (Motion carried 4-0). 2. MINUTES: May 1, 1990 M/S/P Armstrong/Hunt - to approve the May 1, 1990 City Council minutes as amended. (Motion carried 4-0) MINUTES: May 15, 1990 M/S/P Williams/Hunt - to approve the May 15, 1990 City Council minutes as amended. (Motion carried 3-0-1: Abstain:Dunn). 3. CIAIMS M/S/P Hunt/Williams - to approve the June 5, 1990 Claims #93339 thru #93428 as presented. (Motion carried 4-0). 4. PUBLIC INQUIRIES: There were no public inquiries. 5. REAPP REPORT A. Recommendation from ReAPP on Proposed Rate Increase with DPRA ReAPP Member, Dick Acree, informed the Council because of delays in the EIS project schedule by the County, a year has passed since the original contract had been negotiated. During this period, DPRA has increased its labor rates 7% as a result of annual adjustments to staff salaries. This annual change represents both a cost -of -living and performance increase for staff. DPRA has asked that the City and REAPP approve the new labor rates, effective April 1, 1990 through March 31, 1991 for services performed under our existing contract. Mr. Acree noted he was in agreement with the increase based on the professional, timely performance of DPRA. LAKE ELMO CITY COUNCIL MINUTES JUNE 5, 1990 PAGE 2 Mayor Dunn and Councilwoman Armstrong agreed to a possible 4% increase ( and nothing higher. Armstrong noted DPRA could find answers to their surface water questions from the VBWD information that was submitted to them. M/S/P Hunt/Armstrong - to postpone consideration of DPRA Contract until the June 19th City Council meeting. (Motion carried 4-0). B. Solid Waste Committee Request Margaret Carlson, Solid Waste Committee member, requested the City Administrator write a letter to the Olympic Festival Committee and Washington County encouraging them to use paper products during the Olympic Festival. M/S/P Hunt/Armstrong - to direct the City Administrator write a letter to the Olympic Festival Committee and to Washington County recommending paper products be used in conjunction with all activities in the City of Lake Elmo. (Motion carried 4-0). 6. Community Volunteer Service: Barrett Colombo and Bruce Abercrombie Mr. Colombo explained the Community Volunteer Service is a non-profit, tax-exempt organization that has been serving Washington County residents for over 21 years providing help to individuals in areas where there were no existing program and encourage and support volunteerism as a means toward bettering the community we live in. They requested from the City a contribution of $500.00 toward the services that are provided the citizens of Lake Elmo. Mayor Dunn recognized the array of services and program as being valuable to our citizens, but indicated money had not been set aside for such a request in the City's budget. Therefore, the Council will bring this request back for consideration at budget time. 7. SW1 - Agreement to Provide Public Water to Well Advisory Area The Council received a copy of the proposed contract between Lake Elmo and Washington and Ramsey Counties to provide water, via Oakdale to those homes in the well advisory area. The City Engineer and City Attorney have reviewed this contract and their concerns had been addressed by the Counties. Mary Luth, Wash. Cty. Public Health reported final action on the proposed agreement was anticipated by both Ramsey County and Washington County Boards on June 26th; contingent on positive action by both cities prior to June 19. The Council suggested the following wording to be added to Item 2A of the agreement: "Lake Elmo agrees that no additional hookups will be made to the water system unless there is clearly demonstrated a capacity to serve all the fully developed area in the Well Advisory Area". Mary Luth said she would take this language and incorporate it into the agreement. The City Administrator will poll the Council for approval on the new wording change. LAKE ELMO CITY COUNCIL MINUTES JUNE 5, 1990 PAGE 3 M/S/P Hunt/Armstrong - to approve the agreement to provide public water to the Lake Jane Well Advisory Area between the City of Lake Elmo and the City of Oakdale, Ramsey County and Washington County; contingent upon polling of the City Council for approval of new wording change for 2A of the agreement and to include minor corrections:(Page 1: change "desires" to "agrees" and add Attachment C.). (Motion carried 4-0). 8. PLANNING/LAND USE/ZONING: A. Variance and Shoreland Permit (Continuation) Joseph Kiesling, 9359 Jane Road North At the last Council meeting, the Council postponed action on this request so that staff could get a clarification from the VBWD's engineer and the DNR regarding the difference of opinions in relation to the OHWM. M/S/P Williams/Armstrong - to bring back to the table consideration of a variance requested by Joseph Kiesling. (Motion carried 4-0). Mr. Kiesling submitted new information for Council and staff review and requested consideration of his request be postponed until the June 19th Council meeting. M/S/P Williams/Hunt - to postpone further consideration until the June 19th Council meeting based on the applicant's request for postponement in order for the Council to review the new information submitted. (Motion carried 4-0). B. Shoreland Permit: William Bloyer 8881 Jane Road N. William Bloyer, 8881 Jane Road North, has applied for a Shoreland Permit to construct a 24' x 36' unattached garage. Jim McNamara, Building Official, reported in his letter, dated May 24, 1990, all setbacks can be met and no variances are required. A verbal response from Molly Shodeen, DNR, indicated no concern with the application. M/S/P Armstrong/Williams - to approve the Shoreland Permit for William Bloyer, 8881 Jane Road N., to construct a 24' x 36' unattached garage based on Jim McNamara's letter, dated May 24, 1990, stating all setbacks can be met and no variances are required, and based on the DNR having no concerns with the application. (Motion carried 4-0). M/S/P Williams/Hunt - to posptone consideration of Item 9A until the City Engineer arrives. (Motion carried 4-0). 9. CITY ENGINEER'S REPORT A. Street Improvement for 33rd & Laverne Drainage Improvement for Old Village (Continuation) M/S/P Hunt/Williams - to bring back Item 9A for Council consideration. (Motion carried 4-0). LAKE ELMO CITY COUNCIL MINUTES JUNE 5, 1990 PAGE 4 City Engineer, Larry Bohrer, reported he has investigated other routes along the tracks or within the railroad right-of-way and have not found any that are feasible. From the feasibility study and subsequent investigation, Bohrer ponted out: (1) the drainage improvements cannot be done without the street improvement because the financing plan relies on MSA funds paying about 67% of the total costs; and (2) the City will have to deal with Mr. Schiltgen regardless of which storm sewer option is chosen. The City has two options: do nothing or order the improvement as proposed. Councilwoman Armstrong visited the site. She suggested creating a pond in Lions Park or the VFW Park in order to alleviate some water problems rather than taking farm land from Mr. Schiltgen. Elmer Dittmann,3624 Layton Avenue N., explained the water use to travel through the VFW Field and felt the culvert under Hwy 5 is the bottleneck. He asked how did the Natural Gas building get approval to be built which he felt was in the waterway. "When Mr. Schiltgen started selling sod (approx. 1973)", Dittmann stated, "he changed the waterway by levelling the land off because there was too much water and he had to move his machine." Dittmann added, you can follow the crops and where the waterway is, there are no crops growing. Bohrer responded he cannot find any record of an established waterway on Mr. Schiltgens's property. Ed Gorman, White Hat Restaurant, stated he would not be a willing seller of any land easement. Gorman indicated the city caused a problem here with the placement of an inadequately designed 201 system. The Council asked the City Administrator to co-ordinate a date for a meeting, between Council members Armstrong and Hunt, Mr. Schiltgen and Larry Bohrer to discuss the drainage easement problem. M/S/P Armstrong/Hunt - to direct the City Administrator to co-ordinate a meeting between Council Members Hunt and Armstrong, Pete Schiltgen, and Larry Bohrer to discuss a drainage easement agreement and continue this discussion at the June 19th Council meeting. (Motion carried 4-0). B. N.S.P. Franchise David Schwartz, NSP representative, submitted draft ordinances for Council approval. Larry Bohrer has reviewed these ordinances and pointed out this short form agreement did not address the relocation provision, but has not seen any change of NSP operations without this provison in the agreeemnt. LAKE ELMO CITY COUNCIL MINUTES JUNE 5, 1990 PAGE 5 M/S/P Hunt/Armstrong - to adopt Ordinance No. 8031 granting Northern States Power Co, permission to construct, operate, repair, and maintain in the City of Lake Elmo, an electric distribution system and transmission lines, including necessary poles, pole lines, fixtures and appurtenances, for the furnishing of electric energy to the City and its inhabitants and others, and to use the public ways and public grounds of said city for such purposes. (Motion carried 4-0). M/S/P Hunt/Armstrong - to adopt Ordinance No. 8032 granting Northern States Power Company, permission to erect a gas distribution system for tge purpose of installing, enlarging, operating, repairing and maintaining in the City of Lake Elmo the necessary gas pipes, mains and appurtenances for the tansmission or distribution of gas to said city and its inhabitants and others and transmitting gas into and through said city, and to use the public ways and public grounds of said city for such purposes. (Motion carried 4-0). C. PCA Response The City did not receive a response to the request for reconsideration of the 201 Grant Funds that were denied from the MPCA. 10. CITY COUNCIL REPORTS: Mayor Dunn reported the ribbon cutting ceremony for the new Lake Elmo Bank is scheduled for June llth at 8:30 a.m. The City will send a plant recognizing the grand opening of the new bank. Washington County will hold a meeting on June 6th with residents who received letters regarding lead levels in their water. All members of the Council are welcome to attend. Comprehensive Plan Public Hearing Notice: The Public Hearing notice on the Comp Plan and Future Land Use Map, scheduled for June llth, was sent out today to all mailing addresses within the City. July 3rd City it Council meeting: M S P Hunt Armstrong - to cancel the July 3rd City Council meeting. (Motion carried 4-0). 11. CITY ADMINISTRATOR'S REPORT: A. Copier The staff was able to try out several copier machines on a trial basis and obtained quotes on these machines. The lowest price machine, (GSA pricing $11,600), with the best performance was the Sharp SF-9800. The staff will advertise for bids for our existing machine. ($10,000 has been budgeted and City expects at least $1500 for the existing machine.) LAKE ELMO CITY COUNCIL MINUTES JUNE 5, 1990 PAGE 6 M/S/P Armstrong/Williams - to accept the quote of D.C. Hey, $11,600, ($10,000 in budget) for a Sharp SF-9800 copier and direct the staff to advertise for bids for the existing machine ($1500+). (Motion carried 4-0). B. General Labor Position Due to Bob Wier's illness, the Council approved authorization for a General Labor position, Full -Time, until Bob Wier comes back to work. M/S/P Williams/Armstrong - to authorize hiring a General Laborer, Full -Time on a temporary basis, at $6.50/Hr. until Bob Wier returns to work. (Motion carried 4-0). 12. CITY ATTORNEY'S REPORT: The Council received the monthly litigation report. 13. ADJOURN M/S/P Hunt/Armstrong - to adjourn the City Council meeting at 10:45 p.m. (Motion carried 4-0). Section 32 ---------------------- Ordinances 8031 and 8032 granting Northern States Power Co. permission to erect and maintain electric and gas in the City. ORDINANCE NO. AN ORDINANCE GRANTING TO NORTHERN STATES POWER COMPANY, A MINNESOTA CORPORATION, ITS SUCCESSORS AND ASSIGNS, PERMISSION TO CONSTRUCT, OPERATE, REPAIR AND MAINTAIN IN THE CITY OF LAKE ELMO, MINNESOTA, AN ELECTRIC DISTRIBUTION SYSTEM AND TRANSMISSION LINES, INCLUDING NECESSARY POLES, POLE LINES, FIXTURES AND APPURTENANCES, FOR THE FURNISHING OF ELECTRIC ENERGY TO THE CITY AND ITS INHABITANTS, AND OTHERS, AND TO USE THE PUBLIC WAYS AND PUBLIC GROUNDS OF SAID CITY FOR SUCH PURPOSES. THE CITY COUNCIL OF THE CITY OF LAKE ELMO, WASHINGTON COUNTY, MINNESOTA, DOES ORDAIN: Section 1. There be and hereby is granted to Northern States Power Company, a Minnesota corporation, its successors and assigns, hereinafter referred to as "Company", during the period of 20 years from the date hereof, the right and privilege of constructing, operating, repairing, and maintaining, in, on, over, under, and across the streets, alleys and public grounds of the City of Lake Elmo, Washington County, Minnesota, hereinafter referred to as "City" an electric distribution system and electric transmission lines, including poles, pole lines, and fixtures and appurtenances, usually conveniently, or necessarily used in connection therewith, for the purpose of transmitting and furnishing electric energy for light, heat, power and other purposes for public and private use in and to said City and the inhabitants thereof, and others, and for the purpose of transmitting into and through said City such electric energy, provided that such electric distribution system and transmission lines shall be so located as in no way to interfere with the safety and convenience of ordinary travel along and over said streets, alleys, and public grounds, and provided that Company, in the construction, operation, repair and maintenance of such poles, pole lines, and fixtures and appurtenances, shall be subject to such reasonable regulation as may be imposed by the City Council. Section 2. The service to be provided and the rates to be charged by Company for electric service in the City shall be subject to the jurisdiction of the Public Utilities Commission of this State. Company shall provide reasonably efficient and adequate service to members of the public within the City who apply for such service in accordance with the rules and regulations of Company. Section 3. There is also granted to Company, during the term hereof, permission and authority to trim all trees and shrubs in the streets, alleys, and public grounds of said City which may interfere with the proper construction, operation, repair, and maintenance of any so poles, pole lines, and fixtures and appurtenances, installed in pursuance of the authority hereby granted, provided that Company shall save said City harmless from any liability in the premises. Section 4. Company shall indemnify, keep and hold City free and harmless from any and all liability on account of injury to persons or damage to property occasioned by the construction, maintenance, repair or operation of Company's electric facilities located in, on, over, under, or across the public ways and public grounds of City, unless such injury or damage grows out of the negligence of City, its employees, or agents, or results from the performance in a proper manner of acts reasonably deemed hazardous by Company, but such performance is nevertheless ordered or directed by City after notice of Company's determination. In the event a suit shall be brought against City under circumstances where the above agreement to indemnify applies, Company at its sole cost and expense shall defend City in such suit if written notice thereof is promptly given to Company within a period wherein Company is not prejudiced by lack of such notice. If such notice is not reasonably given as hereinbefore provided, Company shall have no duty to indemnify nor defend. If Company is required to indemnify and defend, it will thereafter have complete control of such litigation, but Company may not settle such litigation without the consent of City, which consent shall not be unreasonably withheld. This section is not, as to third parties, a waiver of any defense or immunity otherwise available to City; and Company, in defending any action on behalf of City shall be entitled to assert in any action every defense or immunity that City could assert in its own behalf. Section 5. The City shall give the Company at least two weeks prior written notice of a proposed vacation of a public way. Except where required solely for a City improvement project, the vacation of any public way, after the installation of electric facilities, shall not operate to deprive Company of its rights to operate and maintain such electric facilities, until the reasonable cost of relocating the same and the loss and expense resulting from such relocation are first paid to Company. In no case, however, shall City be liable to the Company for failure to specifically preserve a right-of-way under Minnesota Statutes, Section 160.29. Section 6. Company shall have full right and authority to assign to any person, persons, firm, or corporation all the rights conferred upon it by this Ordinance, provided that the assignee of such rights, by accepting such assignment, shall become subject to the terms and provisions of this Ordinance. Section 7. Company shall, if it accepts this Ordinance and the rights and obligations hereby granted, file a written acceptance of the rights hereby granted with the City Clerk within ninety (90) days after the final passage and any required publication of this Ordinance. Section 8. This Ordinance shall be in full force and effect from and after its passage, any publication required by law, and acceptance by Company. -2- Section 9. Where a provision of any other Ordinance conflicts with the provisions of this Ordinance, the provisions of this Ordinance shall prevail. Notice to Company shall be mailed to the Area Manager thereof at 1700 East County Road E, White Bear Lake, Minnesota, 55110 and any notice to City shall be mailed to the CITY CLERK. MAY 3 1 1990 Community Volunteer Service (CVS) is a non-profit, tax -exempt -- organization that has been serving Washington County residents for.over 21 years. It was founded in 1967 with two goals in mind. 1) It sought to.provide help to individuals in areas where there were no existing programs. The Transportation Program, which provides rides to those without cars or who can't drive, is a good example of this, and 2) CVS sought to encourage and support volunteerism as a means towards bettering the communities we live in. Towards these ends, CVS developed a whole array of services and programs that are recognized as being valuable to the citizens in Washington County. Some of these are: *Holiday Bureau *Transportation Program *Tax Help *Senior Center *In -Home Assistance *Senior Companions *Telecare *Off Again On Again Shop *The Washington County Volunteer Center Last year, CVS directed the time, energy and skills of 313 volunteers into our communities with impressive results. In 1989, CVS volunteers helped over 10,000 individuals by volunteering 15,537 hours. 1WA Volunteer Center RECEIVING SUPPORT FROM THE ST. CROIX AREA UNITED WAY One Here are some reasons why CVS is worthy of your consideration: *It is a non-profit, tax-exempt organization that qualifies for the receipt of such proceeds. *It serves the residents of Lake Elmo- *Because of CVS' unique ability to rely on volunteers for most of their work, donations to CVS are particularly well -spent. The value of each dollar given is at least doubled as it is channeled through the work of the volunteers that CVS places each year. During 1989, 28 round-trip rides were given to Lake Elmo residents who requested rides from our Transportation Program, costing the CVS Transportation program a total of $338.10. There were 27 families from Lake Elmo who received assistance from the Holiday Bureau at Christmas time and a number of Lake Elmo Senior Citizens made use of our Senior Center and the many programs that it provides. I have enclosed some information on CVS that will acquaint you with the work that we do. The 1989 Annual Report contains a summary of each of the programs and the numbers served.by them. I would like to ask the City of Lake Elmo for a contribution of $500.00, toward the services that we provide the citizens of Lake Elmo. As described in 40 CFR 35.2212, the grantee shall expeditiously initiate and complete the project in accordance with the project schedule. The city initiated operation and completed its one year certification period in accordance with the approved project schedule. The city received MPCA approval on the project performance certification and evaluation report dated December 31, 1988. This satisfied the primary purpose of the grant in accordance with 40 CFR 35.2000. A budget period extension would be necessary for any land, administrative, engineering, or legal costs to be considered grant eligible. 2) LAND COSTS As stated in previous correspondence, in accordance with 40 CFR Part 35, Appendix A (a), the Minnesota Pollution Control Agency (MPCA) has the authority to review the just compensation amount and other requested costs to determine grant allowability of the costs based on reasonableness. Allowable costs are defined in 40 CFR 30.200 as "those project costs that are: eligible, reasonable, necessary, and allocable to the project." The Findings of Fact Order and Order For Judgment (District Court, Tenth Judicial District) dated September 20, 1989, identified $70,000 as the just compensation due to Edward T. Gorman (landowner) for Site D. Of the $70,000, $45,000 was to compensate the landowner for the land actually taken and the remaining $25,000 was to compensate the landowner for damages to the remaining property not taken. The city's appraisal prepared by Penfield, Inc. valued the property at $30,000. The landowner's appraisal prepared by Wiley Appraisal, Inc. valued the property at $88,000, The landowner's appraiser reviewed comparative sales. The appraiser believed that the location of a large sewage drainfield adjacent to the remaining parcel was a potential hazard. The location was also recognized as being a market perceived detriment to value. Therefore, he adjusted the comparative sales partially on location next to a large sewage drainfield. The final value was based on sAs of the comparative sales. In accordance with 40 CFR Part 35, Appendix H.2.f., unallowable costs include ". . . damages arising out of the project." Therefore, the $25,000 awarded to the landowner for damages to the remaining property is not allowable. The Minnesota Pollution Control Agency (MPCA) previously approved $49,600 for Site D. Although this amount exceeds the amount of $45,000 awarded by the court to approved as ahe lanowne reasonabler for the land, we consider the $49,600 previously app amount. Therefore, the MPCA's final determination of the just compensation amount eligible for grant assistance as $49,600. This determination would not change even if a budget period extension was granted.
