LAKE ELMO CITY COUNCIL MINUTES
JULY 17, 1990
Mayor Dunn called the City Council meeting to order at 7:01 p.m, in
the City Council chambers. Present: Dunn, Hunt, Armstrong, City
Engineer Larry Bohrer, City Attorney Knaak and Administrator Kueffner.
Absent: Williams and Graves.
1. AGENDA
Add: 12K. Ordinance for Proposed Fees for Dog Impound, 13A. Workshop
with Planning Commission.

agenda as amended. (Motion carried 3-0).
2. MINUTES: June 19, 1990

5. JAYCEE PROCLAMATION
MAYOR DUNN PROCLAIMED THE SECOND WEEK OF AUGUST, 1990 TO BE "HUFF
N'PUFF DAYS" IN THE CITY OF LAKE ELMO, AND URGE. ALL CITIZENS OF OUR
COMMUNITY TO GIVE FULL REGARD TO THE PAST AND CONTINUING SERVICES OF
THE LAKE ELMO JAYCEES.
6. 3.2 beer License for Huff n'Puf£ - Lake Elmo Jaycees
The City received an application from the Lake Elmo Jaycees for a
non -intoxicating liquor license for Lion's Park from August 9th thru
August 12th, 1990. At this time,.the City has not received approval
from the Washington County Sheriff's Dept.. It has been a past
practice of the Council's to waive the $10 fee for this beer license
as well as the fee for use of the ba.11fields.
M/S/P Hunt/Armstrong - to grant a 3.2 non -intoxicating beer license to
the Lake Elmo Jaycees for the sale of beer in Lions Park during Huff
N'Puff Days; August 9 through 12, 1990; contingent upon favorable
response from the Washington County Sheriff's Office, and to waive the
$10 fee for said license; and to waive all charges for the use of City
Parks during Huff N'Puff activities, August 9th thru August 12, 1990.

Gambling
Application: Lake Elmo VFW
Ladies
Auxiliary
The City received an application for Exemption from Charitable
Gambling License from Violet Wagoner, 4th District VFW Ladies
Auxiliary for its annual fund raiser to be held October 6, 1990 at the
Lake Elmo VFW.
M/S/P Armstrong/Hunt - to approve the request of the 4th District VFW
Ladies Auxiliary for a one -day Charitable Gambling License for October
6, 1990. (Motion carried 3-0).
S. Report from Financial. Consultant
A. Pre -Sale Report Regarding Financing Capital Equipment
The Council received a Pre -Sale Report from Public Financial Systems,
Inc. for the City's capital equipment purchases (fire truck and dump
truck) through the use of General Obligation Capital Notes in the
amount of $2.45,000. Rusty Fifield from PFS explained the finance plan
a d the fin4ncing pro ess. Mr. Fifield and the Finance Director indicated
t e termino ogy was t e same as before.
M/S/P Hunt/Armstrong - to authorize Springsted Company to proceed with
the sale of General Obligation Capital Notes in the amount of $245,000
based on terms stated in the Pre -Sale Report to the City dated July
12, 1.990. (Motion carried 3-0).
Bond Counsel is needed to prepare legal documents relating to the
issue and renders an opinion that the bonds are issued in compliance
with relevant statutes.
M/S/P Hunt/Armstrong - to direct staff to obtain bids from four
interested Bond Counsel and make selection based on bid quotation and
potential performance. (Motion carried 3-0).
B. Public Financial Systems Proposed Merger with Springsted Company
Rusty Fifield advised the Council of the merger of Public Financial
Systems with Springsted Company. The Council indicated they had no
problem with this merger and. will continue working them and Mr.
Fifield and Kathy Aho as our financial consultants.
9. CITY ENGINEER'S REPORT:
A. State -Aid Maintenance Recommendations
At the last Council meeting, the Council decided to postpone the 33rd
Street and Laverne Avenue project until 1991 construction season. The
City Engineer was asked to find a new project to allocate its 1990 MSA
maintenance allotment of $42,327.00 and given Council authorization to
proceed with the recommended project.
Larry Bohrer reported he has reviewed the needs of the Municipal State
Aid street system and recommended that an overlay be constructed on
31st Street from Stillwater Boulevard (CSAH 6) to T.H. 5. The

estimated construction cost of this project is between $28,000 and
$35,000 depending on whether the shoulders are paved. Since this cost
is less than the total amount available in the 1990 MSA Allotment, the
remainder should be transferred into the appropriate City general
maintenance account and seal coat account to pay for general
maintenance and seal coating on MSA streets. An equal amount of
general and seal coat funds should then be transferred out of the City
accounts and into the 33rd Street and Laverne Avenue project account
for the 1991 project.
Bohrer indicated the reason he brought this matter before the Council.
was that for all other MSA overlay projects, some amount has been
assessed. If the City paid for the construction from MSA funds, but
assesed for the engineering and administrative costs, the assessment
rate would be around $2.00 per parcel. Based on past practice of the
City assessing for all other MSA overlay projects, the Council agreed
to an assessment rate around $200 per parcel.
M/S/P Hunt/Armstrong - to approve Resolution No. 90-23, A Resolution
calling Public Hearing for August 7, 1990 for an overlay to be
constructed on 31st Streetfrom Stillwater Boulevard (CSAH 6) to T.H.5.
(Motion carried 3-0).
B. Resolution Implementing 1990 201 Users Fees
The City approved the 201 Users Rate Increase and a resolution
implementing that increase was before the Council for their
consideration.
M/S/P Armstrong/Hunt -- to adopt Resolution No. 90-24 adopting the 1990
Rate Structure for 201 Systems in the City of. Lake Elmo. (Motion
carried 3-0).
C. Traffic Concern on County Road 17
Dick Acres, 2986 Lake Elmo, brought in his concern on excessive speed
on County Road 17 (Lake Elmo Avenue) just south of 20th Street up thru
the Old Village to Highway 5. (See attachment, Dick Acree's comments)
The Council discussed the concern with Deputy, Jesse Kurtz and. City
Engineer, Larry Bohrer. The Council suggested looking at:
1. Reducing the speed limit to 30 mph in this area.
2. Placement of stop signs at several strategic locations.
3. The possibility of constructing "speed monitored by radar"
signs.
The City Administrator will write a letter to Larry Bousquet, Wash.
Cty Traffic Eng, for his input on the Council's (3) suggestions.
In reference to Mr. Acree's comment that two officers of the Sheriff's
Dept, attested to traffic was allowed to travel at 39 mph or less in a
30 mph zone 'without receiving a citation, Deputy Kurtz responded that
it seemed comments were taken out of content, that they have run radar
on County Road 17 and found speeding not that bad of a problem. Kurtz

indicated County Road 17 is a popular road, but the Deputies were not
dealing with this street any differently than any other street in the
City.
Attorney, Carl Blondin addressed the following comments written by Mr.
Acree. (1.) it is too expensive to prosecute citations at the lower
level. Blondin: there is a flat fee per month. (2.) the judges throw
the citations out of court. Blondin: this is not true. (3) the City
does not pursue this enforcement because it would have to send a
prosecuting attorney to each court appearance. Blondin:It is a flat
fee and he would be there. He looses one out of every 200-300 cases.
D. Traffic Concern on 33rd Street
The Council received a petition from Mark Jechort, 11035 33rd St. N.,
with signatures of other residents in the area regarding the traffic
conditions on 33rd Street. Mr. Jechort indicated 33rd street was
narrow and with no curbs for the many walkers and bikers. He also
noted the increase in traffic since the County put up the directi.onl
signs to the Park Reserve.
The City Engineer was hesitant to place any stop signs on the street
until we can monitor the area after the speed signs are put up along
with the "Children Playing" signs. If- these signs do not change the
speeding conditions on the street, the Council recommended he bring
this back to the Council to consider further action.
M/S/P Armstrong/Hunt - to direct the City to erect a 30 mph sign on
h, 33rd Street, "Children Playing" signs, and consider moving the
directional signs to the Lake Elmo Park Reserve. If these signs do
not change the speeding conditions of the street, Mr. Jechort should
come back to the Council for consideration for further action.
(Motion carried 3-0).
10. PLANNING/LAND USE AND ZONING:
A. PUBLIC HEARING: Variance for lot size to create Agricultural
Zoning District. Applicant: Ray Salus, 404 Lake Elmo Avenue.
Ray Salus is requesting a variance to lot size so he can have his land
rezoned to Agricultural and proceed with his golf driving range.
Mayor Dunn opened up the public hearing at 8:00 p.m. in the Council
chambers. The Public Hearing notice was published, July 5, 1.990, in
the St. Croix Valley Press.
Florence Bradley, 520 Lake Elmo Avenue, voiced her disapproval of the
City granting a variance to the lot size for Ag Zoning based on:
(1) A golf driving range would be detrimental to house
market value.
(2) There is a higher tax base with Rural Residential.
(3) This would set the stage for a one -mile corridor for
commercial development.

Mayor Dunn closed the Public Bearing at 8:06 p.m.
M/S/P Armstrong/Hunt - to grant a variance for lot
Agricultural Zoning District to Ray Salus, 404 Lake
on the following Findings: (Motion carried 3-0).
(1) There was originally 40 acres.

size in
Elmo Avenue, based
(2) 14+ acres were taken by condemnation for the Northern Route
of I-94.
(3) This reduction in size was not the result of applicant's
actions.
(4) That taken land is still open space today and would be if
Mr. Salus continued to own it. (Mr. Salus still farms the
taken land for the current owner.)
(5) This is an unique application. The proposed use is not intense
and the amount of acres required is not the same as the amount
of space which would be required for buildings or other
impervious surfaces that we might see for a housing development
or an intense commercial development. The intent is to convert
open farm land to an open space driving range. The full 40
acres would not be required for actual use, but rather to make
tap the 1 house per 40 acres rule in Ag zoning now in effect
for the City. This is a downzone to AG. This land has always
been in Agricultural use and the proposed use won't change the
open space by much.
(6) This application is also unique in that it is farm land
surrounded by General Business, Alternative Ag Use
businessess, the Cimarron housing development and a golf
course. This application would not be deleterious to this
neigborhood as is planned today when the restrictions
spelled out by the PZ are in place.
M/S/P Hunt/Armstrong - to call a Special City Council Meeting for
Monday, July 23, 1990 at 2:00 p.m, to consider the request from Ray
Salus for a rezoning to Agricultural and a C.U.P. for a golf driving
range. (Motion carried 3-0).
B. Continuation of Variance Request by Joseph Kiesling at
9359 Jane Road N.
At the June 19th meeting, the applicant requested postponement of
council. consideration on his request until the next City Council
meeting.
M/S/P Armstrong/Hunt - to bring back the request by Joseph Kiesling
for Council consideration. (Motion carried 3-0).
Mayor Dunn: When you (Joe Kiesling) put in the concrete patio
underneath the proposed walkway, was this patio approved by the DNR3
Kiesling: Everything that is there, including the patio and grading,
was looked at and approved by the DNR,

Mayor Dunn; Do you understand why the DNR has a concern on the
encroachment of the walkway on the Lake? Kiesling: Part of it I
don't understand. There was an existing deck on the original house
and the way the permits were issued to me, I was able to reconstruct
the house without further encroachments. The proposed walkway and
stairway would not go any further than what it was originally. I was
permitted to reconstruct the house as it was. I am not changing the
point of going any closer to the lake than it was before. The DNR has
approved the deck to the southside of the house, and a walkway needed
to have access to the lake out of the house from the second floor.
Mayor Dunn: Do you perceive any other requests for variances on this
dwelling? Kiesling: No, I cannot see any variance requests. This is
the first variance request I have applied for other than when I
requested moving the garage to the other site.
Mayor Diann: At the last meeting you stated you could live with a 4'
walkway instead of a 6' walkway. Kiesling: My original request was
for a 6' walkway. When I was asked at the last meeting what minimum
size of walkway I could live with, I stated I could go to a 4'
walkway. I would chose not to because of my footings. With a 6'
walkway, I wouldn't have to bore through my concrete that is already
existing because it doesn't patch well. I could get in my footings
and still stay above the ordinary high water mark and not come out to
the farthest point than the original deck.
Mayor Dunn: Mr. Kiesling has a concrete patio under the proposed
walkway which was allowed by the DNR. The proposed 4' walkway would
not go out any further towards the lake than the existing concrete
patio. The original Keane house had a deck attached. The proposed,
walkway would not increase the non -conformity that existed prior to
Mr. Kiesling owning the home. I look at a walkway as an exit for
safety reasons and have no problem with it as long as all. the permits
have gone through the DNR and City office.
Councilman Hunt: (Referred to the letter from the DNR, dated July 15,
1988, which states in Permit 88-086, to place fill and raise existing
structure above the 100 year flood elevation.) At that time no
demolition work had occurred on the house. It was as the Keanes had
left it. I cannot see where it dictates that the existing deck was
different from the structure. The DNR has allowed Mr. Kiesling to
have the concrete patio. The DNR has stated that no deck would be
allowed., but I cannot see in any of the documentation from them or in
the permit where it pulls apart the existing deck from the structure
of the first constructor. We have approved variances to the OHWM when
the encroachment was no greater. We did allow Mr. Kiesling to bring
in fill and reconture the shoreline. The hardship is the potential of
safety and feels it is appropriate to have two exits on the main level
in terms of water and fare safety.
Councilwoman Armstrong: The new garage and lateral expansions, the
walkway and deck, to the existing structure were not part of the
review made by the City when the Keanes obtained the variance to raise

the house. I have been told the Keanes have received full valuation
of that house from their insurance company on the assumption that
the house was totalled. Therefore, I'll make the following motion:
M/No Second/ Armstrong/No Second - to deny the request by Joseph
Kiesling for a walkway based on the following Findings:
1. There is NO hardship.
2. A deck is allowed on the south side of the home.
3. The (3) sliding glass doors which Mr. Kiesling claims are his
hardship were placed after he was made aware by the City that
neither deck nor walkway would be automatically allowed.
4. Mr. Kiesling chose to arrange the rooms inside the home as
they exist with the bedrooms on the south side in spite of
comments by the City Inspector about the deck and walkway not
being allowed on the lake side.
5. The footings for the house are in the lakebed.
6. According to a letter from the Valley Branch Watershed Dist.
dated April 4, 1990, even after your house was raised up and
out of the water, it is still only 12.5 feet from the
100 year flood elevation.
7. In letters dated July 20, 1989 and May 10, 1990, the Dept.
of Natural Resources states they have consistently opposed
any further encroachment on the lake side of this house and
oppose the deck and/or walkway being built there.
8. In a letter dated July 15, 1988, the DNR stated their
feelings that your proposal of a 4-foot walkway across the
front of the house was not allowed in the permit obtained
by the Keanes to raise the house and they further state
that this walkway would not meet the City of Lake Elmo's
Shoreland ordinances.
9. The concrete patio under the proposed walkway was not
approved by the City.
10. Mr. Kiesling's modifications have been planned and made
with the full knowledge that his property was too close
to and, in fact, in the lake and that the City would most
likely not approve of his actions encroaching further
toward the lake. The City Council strongly advised
Mr. Kiesling in the past that no further variances would
be granted for his house, because of the number of
concessions already allowed.
1.1. This denial is not taking away from Mr. Kiesling any
rights that have been enjoyed by other residents in
similar situations. Other decks on lakes have been allowed
to be demolished and rebuilt no closer to the shoreline

considering they do not increase their non -conformity to
the setbacks from the lake. None of these homes were as
close to the lake as this one.
12. The people around Lake Jane has suffered a great deal from
the high waters. This was before Mr. Kiesling lived here.
It isn't fair to these people if this applicant is given
special treatment of this property which is probably at
the lowest point on the shoreline of any of the homes.
The other property owners have had to abide by the
Shoreland Ordinance and the directions given by the Dept.
of Natural Resources and this property should too.
M/S/P Hunt/Dunn - to approve the variance request and shoreland permit
to Joseph Kiesling, 9359 Jane Road N., granting a 4' walkway to the
front of his house based on the hardship of safety as it would be
appropriate to have two exits on the main level in terms of water and
fire safety. (Motion carried 2-1: Armstrong: For reasons stated
above. Mr. Kiesling has created what is being considered as
hardships.).
11. CITY ATTORNEY'S REPORT:
A. Letter from Prosecuting Attorney, Car]. Blondin
The Council received a letter from Carl A. Blondin, the City's
prosecuting attorney, asking for direction from the City regarding
appeals. Admin. Kuef£ner reported she has checked the file and could
not find where the City has ever had a definite policy on appeals.
Mr. Blondin indicated the Council may wish to establish some kind of
strict guidelines which would involve the prosecutor getting a written
order from the Mayor or City Admin. before initiating an appeal.
Attorney Knaak agreed that such a policy was an excellent idea. The
Council thanked Mr. Blondin for bringing this matter to their
attention.
M/S/P Hunt/Armstrong - to direct staff to draw up draft policy for
appeals from ciminal prosecutor cases and present policy to Council
for review. (Motion carried 3-0).
B. Litigation Report
The City Attorney handed out the pending Litigation Report for Council
review.
Section 32 Annexation Proceedings #1: The City has until July 30 to
file an appeal of Judge Maas' Order opposing decision of the Board.
Attorney Knaak recommended that the City appeal this decision to the
Court of Appeals.

decision of. the Board on Section 32 Annexation Proceedings #1 (File
No. 1608-10). (Motion carried 3-0).

12. CITY ADMINISTRATOR'S REPORT:
A. Continuation of DPRA's Proposed Contract Increase
DPRA has requested an increase in fees for professional services
provided to the City of Lake Elmo as it relates to the EIS Review for
the proposed landfill site in the Lake Elmo Park Reserve. The Council
acknowledge Mr. Acree's letter and felt this letter was one that
should have remained in a desk drawer for a couple of days before
being mailed. The majority of the Council members felt it
inappropriate to consider an increase at this time since the City and
DPRA have a contract thru June of 1991. The Council noted this denial
in no way is meant to be indicative of discontent with the services
that DPRA has provided to the City.
M/S/P Armstrong/Dunn - to continue contract "As -Is" with DPRA through
June of 1991. (Motion carried 2-1: Hunt: The present contract was bid
under current conditions. The work scope has changed because of
County's plan; therefore, the contract should be changed accordingly.)
B. Metro Transit Commission Regarding Bus Shelters
The City received a letter from the Metropolitan Transit Commission
regarding a program it has reactivated to assist in providing bus
shelters. Lake Elmo does not have a bus stop where more than 40
passengers board per day, but we would still qualify for a
cost -sharing agreement. The City would be required to provide a
concrete base pad and provide minor maintenance if it is interested in
participating in this program.
The Council indicated they would rather not see advertising placed in
the bus shelter, but would be in favor of a concrete slab. The
Administrator will contact Cimarron management to find out if enough
people board the bus there, would they like to provide this shelter
and share in the expense of providing the concrete pad and the
on -going maintenance of the shelter.
C. Request from Maintenance Dept, for extension to
Existing Pole Building.
Dan Olinger has asked the City to consider allowing for an extension
of his existing pole shed so that salt and sand can be installed
indoors, on a paved surface to comply with PCA Rules. The cost
estimate for the expansion is approximately $13,500. We have not
budgeted for this expansion. The Council asked the staff to review
this requirement of the PCA. If staff feels this is appropriate, this
request should be brought back to the Council.
D. Request from Fire Department for Repair to Fire Truck
Fire Chief, Dick Sachs, submitted a bid in the amount of $7880.00 from
General Safety Equipment Corp. for work that should be done on the
Tele-squirt. The staff noted this truck was purchased in 1981 for
$150,000, and this would be the first major expense towards this truck
since its original purchase. Because this is a major expense,

Councilman Hunt who is on the Capital Improvement Committee,
suggested this Committee look at the request and the entire Fire
Dept.'s Improvement Program. Councilman Hunt will arrange the meeting
between the CIP Committee and Fire Chief Sachs.
M/S/P Armstrong/Hunt - to direct the Capital Improvement Committee to
meet with the Fire Chief to review this request and the entire CIP for
the Fire Department. (Motion carried 3-0).
E. Employee Evaluation
Mike Buckles started in May of 1989 as a permanent part-time
maintenance worker and should have had a performance review after six
months of employment, but this was not done. The Council received a
copy of a performance evaluation on Mike Buckles done by Dan Olinger,
Mike's direct supervisor.
The City Administrator recommended that Mike Buckles' pay rate be
increased to $9.00 per hour, with one-half of the difference from what
he is making now ($6.24 per hour) and the new proposed rate ($9.00 per
hour) be retroactive to January 1, 1990 and the new rate be effective
August 1, 1990. It was recommended that Mike's vacation and sick
leave be calculated from that date of his employment.
M/S/P Armstrong/Hunt - to approve Mike Buckles' pay rate be increased
to $9.00 per hour, with one-half of the difference from what he is
making now ($6.24 per hour) and the new proposed rate ($9.00 per hour)
be retroactive to January 1, 1990, and the new rate be effective
August 1, 1990 with vacation and sick leave being calculated from the
date of his employment. (Motion carried 3-0).
F. Lake Elmo Airport Expansion - Update
Mark Ryan of the Metropolitan Airport Commission will give an update
on the Lake Elmo Airport at 7:30, August 7th Council meeting. Mr.
Ryan is in the process of preparing a press release to go to all local
newspapers outlining their objectives.
G. Ordinance Repealing Sprinklers
The staff was directed to prepare an ordinance which would repeal the
sprinkler requirement that was adopted. The Council reviewed a copy
of the ordinance and recommended adoption. This will become effective
upon its passage and publication.
M/S/P Armstrong/Hunt - to adopt Ordinance 8034 amending Section 500
BUILDING CODE of the Lake Elmo Municipal Code and to direct the staff
to publish this ordinance in the City's legal newspaper as soon as
possible. (Motion carried 3-0).
H. Solid Waste Advisory Committee
At their July 11th meeting, the Solid Waste Committee decided to
proceed with the "Adopt -a -Highway" program and adopt Highway 5 from
Manning Avenue to two miles west. The Committee asked the Council's

approval for this program and suggested that other communities and/or
organizations with in. the community follow suit.
M/S/P Hunt/Armstrong - to formally support and encourage the Solid
Waste Advisory Committee to proceed with the "Adopt -a -Highway" program
and adopt Highway 5 from Manning Avenue to two miles west and suggest
other organizations within the community follow suit. (Motion
carried 3-0)
The Committee also discussed the pros and cons of organized
collection. At a later meeting, the Council will receive a copy of
this list. At that time, the committee will be looking for direction
from the Council on whether or not to proceed with an RFP as a first
step in implementing an organized collection program in the City.
I. Valley Branch Watershed Appointment
The City received a memo from Washington County regarding Valley
Branch Watershed District Appointments indicating that the term of
William Rohrer, Lake Elmo's representative on the Watershed will
expire on November 13, 1990. The Council can either chose to reappoint
Mr. Rohrer or direct the staff to advertise for applicants. Mr. Rohrer
had indicated he wished to continue as Lake Elmo's representative to
the VBWD.
M/S/P Armstrong/Hunt - to recommend to the Washington County Board
that William Rohrer be reappointed as Lake Elmo's representative on
the Valley Branch Watershed District. (Motion carried 3-0).
J. Ordinance Amending Fee Schedule
The staff was directed to proceed wtih preparing an ordinance to

The 1987 Minnesota State Building Code, established pursuant to
Minnesota Statutes 16B,59 through 16B,73, one copy of which is on
file in the office of the City Building Official, is hereby adopted
as the building code for the City of Lake Elmo, Such code is hereby
incorporated in the City Code, as completely as if set out in full,

The Building Official and his duly appointed representatives shall

1, No person, firm or corporation shall erect, construct,

or demolish any building, or structure in the City of Lake
Elmo or cause the same to be done, without first obtaining
a separate building permit for each such building or
structure as required by the State Building Code as adopted
by Chapter 501 of this Code.
2. Permits, inspections and collection of fees shall be as
provided in Chapter 3 of the Uniform Building Code, 1985
Edition, (See Section 105 of this Code.)
The Building Official shall utilize the chart of estimated
construction costs as annually provided by the Minnesota
Department of Administration,.State Building Codes and
Standards Division, to compute building valuations for the
purposes of establishing the permit fees of the City of
Lake Elmo, (See Section 105 of this Code.)

502,050 EXCAVATION AND "GRADING PERMITS
A permit shall be required for the excavation, grading or surfacing
for any building, structure, plot or area of ground occupied by a
building or structure, or in preparation for the construction of any
building or structure where such excavation and grading is to be done
with mechanical equipment, (See Section 105 of this Code,)
502.060 PRIVATEROAD 'PERMITS
A permit shall be required to construct an asphalt, concrete, or
gravel private road or alley, (See Section 1602 and Section 105
of this Code,)
502.070 MOVING BUILDINGS INTO' 'CITY
A. Buildings or structures moved from one location to
another shall comply with the provisions of this code
for new buildings,
B. Where the Building Official is required to inspect a
building outside of the City, any travel expense shall
be paid by the applicant, Building mover must present
a State license for house and building moving to the
Building Official when applying for permit to move a
building,
C. Before any house or other structure is moved onto a lot or
parcel in the City of Lake Elmo, the owner shall apply for
a building permit, The Building Official shall present the
site plan, construction plans, and photos of the structure
from two or more angles to the Planning Commission. The
Planning Commission shall report to the City Council
whether or not the structure will be compatible with
other development in the area; and make such recommendation
to the City Council, If the City Council determines the
structure would depreciate the area into which it is to be
moved, it may withhold the permit for such relocation.
502.080 BUILDING DEMOLITION FEES
All buildings or structures prepared for,derolition within the City of
Lake Elmo require a demolition permit. (See Section 105 of this Code.

Every permit issued by the Building Official shall expire by
limitation and become null and void after one (1) year, or if the
building or work authorized by such permit is not commenced within one
hundred twenty (120) days from the date of such permit, or if the
building or workauthorized by such permit is suspended or abandoned
at any time after the work is commenced for a period of one hundred
twenty (120) days. Before such work can be recommenced a new permit
shall be first obtained to do so, and the fee therefore shall be,
one-half (1/2) the amount required for a new permit for such work,
provided no changes have been made or will be made in the original
plans and specifications for such work; and provided further, that
such suspension or abandonment has not exceeded one year,
502.110 BUILDING' PERMIT FEES
A fee for each building permit shall be paid on or before the issuance
thereof. The fees for such permits shall be in the amount established
from time -to -time by ordinance of the City Council,

On any new construction for property abutting a permanent street a
bond or cash deposit shall be required to protect against damage to
the permanent street, curb, or other public property or improvement
occurring by reason of construction. (See Section 105 of this Code.)
502.130 SURVEY
The Building Inspector may require a Certificate of Survey showing the
actual dimensions of the lot to be built on, the exact size and
location on the lot of the building and assessory buildings to be
erected, and such.other information as may be necessary to determine
compliance with.the Municipal Code of the City of Lake Elmo, before
issuing a building permit for new construction on any lot.
502.140 SUSPENSION OR, RE'VO'CATION
The Building Official may, in writing, suspend or revoke a permit
issued under provisions of said Building Code whenever the permit is
issued in error or on the basis of incorrect information supplied, or
in violation of any ordinance or regulation or any of the provisions
of said Building Code.
502.150 VIOLATIONS AND'PENALTIES
The penalties described in the Uniform Building Code, 1985 Edition,
Section 205, as amended, shall be in keeping with Minnesota Statutes
609.033 to 609.034 which provides for a maximum fine of $700.00.

upon its passage and publication.

Re: Possible appeals
Dear Mayor Dunn and Council Members:
In April a Lake Elmo drunk driving case was dismissed by a
judge for lack of probable cause for a stop. Both the arresting
deputy and I were surprised at the judge's ruling. In some of
these cases it may be possible for the prosecutor to appeal the
case to the ;Minnesota Court of Appeals. However Lake Elmo has no
policy on when an appeal should be made by the prosecutor, if
ever. An appeal in a criminal case not only involves the extra
cost of preparing the appeal and having briefs printed, but will
often result in the prosecuting governmental entity (Lake Elmo in
our case) paying for the defendant's attorney's fees and costs of
appeal. Usually the cost of an appeal is too much to justify
making the appeal. In some cases, such as criminal nuisance or
zoning violations the cost of not appealing may be even more in
the longrun. As the Lake Elmo prosecutor I would like to see a
clear policy on appeals. In most criminal cases the rules of
criminal procedure require the prosecutor to file the appeal
within five days of the trial court judge's order. I will noc
commit the city to the cost of an appeal unless there is some
Bind of a guideline, and our present prosecution contract does
not address the issue of appeals anyway. I will be out of town
in early June, but would be free to address the council at its
July meeting if you so wish, In any case, I would want to know
when, if ever, you would iaant me as prosecuting attorney to
appeal a case.
Again, I emphasize that the cost of an appeal is seldom worth
the effort of making the appeal in criminal cases, and in the
case dismissed in April the city could have never made up the
cost of the appeal with a fine had we won the case. However you
may wish to establish some kind of strict guideline which would
involve the prosecutor getting a written order from the mayor or
someone else before initiating an appeal. If any of you wish to
telephone me and ask questions I would be happy to answer them
for you so you can decide for yourselves how the city should
handle these matters.

The Metropolitan Transit Commission (MTC) is in the process of reactivating its
bus shelter program. Due to budgetary constraints, the MTC's shelter
development program was suspended in 1982.
At present, the MTC maintains 628 passenger waiting shelters throughout the
metropolitan area. Federal funding is now available to assist in building an
additional 89 shelters. Local money must be used to fund 20% of the
construction costs of the shelter program and to fund ongoing maintenance
costs.
The MTC shelter policy encourages the construction of passenger waiting
shelters for bus stops which serve 40 or more boarding or transferring
passengers on a typical weekday, with special consideration given to bus stops
serving the elderly and the handicapped.
Under the MTC's shelter program, the MTC will pay the total cost of the
shelter installation if ridership is more than 40 passenger boardings per day. In
cases where ridership is less than 40 passengers per day, the MTC will consider
the shelter installation only if the community provides a portion of the local
capital and maintenance costs. Providing a concrete base pad upon which the
shelter could be placed, and agreeing to provide minor maintenance such as
cleaning, would be ways in which the community could provide this local capital
and maintenance cost sharing.
At this time, the MTC staff has not identified any new bus stop locations in
your community that have more than 40 passenger hoardings per day. We are,
however, encouraging you to contact us if you are aware of any sites that you
would like us to investigate further to determine if the site meets the
passenger boarding criteria in the MTC shelter policy. In addition, we would
encourage you to contact us if your city would be interested in participating in
a cost -sharing arrangement with the MTC for the construction and maintenance
of bus shelters at locations that do not have the minimum of 40 passenger
boardings per day. Also, please contact us whether your community would be
receptive to allowing advertising to be placed on MTC bus shelters as a means
of providing a funding source to offset a portion of the ongoing maintenance
costs of the shelters.

Dear Dick;
I'm writing in regards to our meeting last week at your station
about the work you would like performed on your Tele-Squrt.
Per our conversation that day I would propose the following.
Remove the existing steel runningboards, compartment floors and
chassis cab step enclosures and replace with newly fabricated
aluminum treadplate runningboards, compartment floors and cab
step enclosure to match the current ones.
While the old steps, floors and runningboards are removed we
would clean up any rusted areas exposed and prime and repaint to
match the existing paint.
Remove the existing steel treadplate rear face on the body and
replace with a new aluminum treadplate rear body face including,
a new aluminum treadplate compartment for the Tele-Squrt
communications equipment. We would remove and reuse the existing
light fixtures and other hardware where possible.
Remove the existing rear kick plates at the bottom of the rear
compartments and replace them with new aluminum treadplate
kickplates.
Add aluminum treadplate on the insides of the rear beavertails
from the runningboards to the top of the compartments, and from
the rear of the hosebed to the rear of the body, to provided a
scratch resistant surface when hose is pulled from the hosebed.
Remove the existing right side rear compartment doors and
replace with two flush mounted, vertically hinged compartment
doors to match the existing vertically hinged doors on the
apparatus. Doors shall be painted to match the apparatus body
and shall include stainless steel hinges and hardware and spring
type door holders. The door jambs for these new doors shall be
fabricated of polished stainless steel material.

Remove the existing rear seat back in the chassis cab and
install three recessed mask mounting brackets complete with
padded backrests on each side of the tank and with Ziamatic
walkaway mask brackets mounted in each backrest.
Install an aluminum treadplate floor in the crew cab from
directly behind the front seat to the rear wall of the cab.
Install a 4" wide, blue reflective stripe along both sides of
the apparatus body. Stripe to be IM Scotchlite reflective
material.
Install a used Q2B siren on the front fender of the chassis cab
with floor switches mounted one at the drivers and one at the i
officers floor area in the cab, and with a siren brake installed
on the electrical console.
The total cost for the above proposed work would be $7880.00,
and I would estimate that it would require about 1 1/2 weeks to
complete.

OUTLINE FOR LETTER TO M. KEUFFNER ABOUT ROAD
Problems:
1. Vehicles travel too fast on Lake Elmo Avenue N.
2. The S curve at 30th and Lake Elmo is especially hazardous
when exiting 2986 Lake Elmo due to inability to see traffic
coming South on Lake Elmo Ave., especially if they are travelling
faster than 25mph.
Existing_ situation:
1. 30 mph limit from HWY 5 to just past Pierre's pier, 45 MPH
limit from there to a point beyond 20th ST. (Tartan Park cutoff).
2. In 30 mph zone, traffic is allowed to travel at 39mph or
less without receiving citation. This fact was attested to
by two officers of the Sheriff's Department.
a. May be possible to verify by checking traffic
citation records over the past year or two.
b. The reasons given for this are:
1. it is too expensive to prosecute citations
at the lower level,
2. the judges throw the citations out of court,
3, the City of Lake Elmo does not pursue this
enforcement because it would have to send
a prosecuting attorney to each court
appearance.
3. There is a contract for 80 hours of Sheriff's support for
the City of Lake Elmo per week. This has been the status for
over 10 years. Maybe the population has grown enough during
that time to justify the cost of another officer for 40 hours
per week. It appears the Sheriff's Department has requested
just such an arrangement.
4. There is a lot of pedestrian traffic on Lake Elmo Avenue
North (walking, jogging, bicycles, skating, etc.)
5. Due to the attractive and interesting view of Lake Elmo
and it's activities, people driving on Lake Elmo Avenue are
simultaneously looking at the lake and traveling too fast.
This creates a tendency to weave on road and thus endangers
pedestrians.
Possible Solutions: f
1. Hire another deputy
2. Enforce speed limits strictly
3. Lower existing limits to 25 and 35 respectively
4. Build sidewalks and/or riding/jogging paths from the old
village to the Lake Elmo park. Also from 15th and 10th to the
park.
5. 3 way stop sign at 30th and Lake Elmo Avenue
a. Speed ruts (similar to those on Keats) to notify
of the upcoming stop signs on 30th.
I. The group agrees to pick up litter on a segment of state highwav selected in consultation with the Minnesota
Department of Transportation's (Mn/DOT) local office. Recommended length is two miles. At Mn/DOT's
discretion, certain highways may not be eligible 2.
The group shall review the safety training materials beforeeach pickup to alert participants to the hazards and
precautions of working on a highway right-of-way.
I The group shall pickup litter during- daylight hours only. Pickups may not be allowed at certain times such as on or ,
near holidays..
4. The group shall provide adequate supervision to partici
permitted, children eleven or younpants eighteen years of age or younger. Unless specifically

up the bags. Groups are encouraged to recycle appropriate materials for their own benefit.
S. Borrowed or unused supplies shall be returned to'the Mn/DOT office within one week

arising -out of the work to be done herein.
Any and all volunteers of the group or other persons while engaged in the performance of any work or service performed
under this agreement shall not be considered employees of the State, and any and all claims that may or might arise under .
the Worker's Compensation Act of Minnesota on behalf of said employees or other persons while so engaged, and any and
all claims made by any third party of the group's volunteers or other persons while so engaged on any of the work or .
services to be rendered shall in no way be the obligation or responsibility of the State.
