Present: Dunn, Hunt, Armstrong, Graves and Administrator Kueffner. Absent: Councilman Williams. 1. AGENDA Add: 3. Shoreland Permit: Gary Kimlinger, 9461 Jane Road N. M/S/P Hunt/Graves - to approve the July 23, 1990 Special City Council meeting agenda as amended. (Motion carried 4-0). 2. Request for a Rezoning to Ag and a C.U.P. to allow for a Golf Driving Range. Applicant: Ray Salus On July 17th a public hearing was held by the Council for a variance to lot size in Agricultural Zoning. The Council approved granting a variance for lot size in Ag Zoning based on Findings stated in the motion. (See cc 7-17-90 Minutes). The Council discussed prohibiting exterior lighting except on the east side of the office and the entrance driveway will be in accordance with the recommendation of Washington County, opposite of the new entrance to "The Forest". M/S/P Graves/Armstrong - to adopt Ordinance 8037, granting Raymond and Jane Salus, 404 Lake Elmo Avenue, a rezoning from Rural Residential. to Agricultural Zoning. (Motion carried 4-0). M/S/P Hunt/Graves - to adopt Resolution 90-25, Resolution granting a Conditional Use Permit to Raymond and Jane Salus, Country Air Golf Driving Range, for commercial recreation of a rural nature in the Agricultural Zoning District subject to the following conditions: (Motion carried 4-0). 1. Existing road frontage be left in its current rural condition with the addition of conifers such as blue spruce to provide additional screening of business; 2. To be consistent with the rural character, a variance will be granted to allow an unpaved driveway and parking lot; 3. Exterior lighting is prohibited except on the east side of the office, and said lighting shall not reflect off of the property; 4. A sign will be allowed by the entrance with a maximum of 2.0 sq.ft. using natural colors. Trees and shrubs shall be used to reduce the visibility of the sign from residential property across the street; LAKE ELMO CITY COUNCIL MINUTES JULY 23, 1990 PAGE 2 5. A berm shall be constructed to block the view of the cars and tee positions from residential property across County Road 17; 6. An office 45' x 30', one-story, is permitted; 7. Parking for a maximum of 35 cars is permitted; 8. Maximum hours of operation are 7 a.m. to Sunset; 9. Two rows of shrubs shall be planted in conifers with 8' x 8' spacing on the north, south, east sides of the range. Dead trees shall be replaced and trees shall attain an average height of at least 24" in 5 years; 10. The entrance driveway will be, in accordance with the recommendation and direction of Washington County; 11. A public address system will not be allowed; 1.2. No liquor license will be permitted. 3. Shoreland Permit: Gary Kimlinger, 9461 Jane Road N. Gary Kimlinger of 9461 Jane Road N. has requested a shoreland permit to construct a boathouse on his property. Building Official, Jim McNamara, reported, due to a emergency situation at Mr. Kimlinger's home (the lower level completely flooded due to a broken water line from his well), he is in need of a temporary storage area to store all the furniture and personal belongings affected by the flooding conditions. Molly Shodeen of the DNR has approved the request for a 20' x 12' boathouse to be used temporarily as a storage area because of the situation and the proposal does meet all requirements. M/S/P Armstrong/Hunt - to approve granting a Shoreland permit based on DNR approval to Gary Kimlinger, 9461 Jane Road N., to construct a 20' x 12' boathouse to be used temporarily as a storage area due to the emergency situation. (Motion carried 4-0). M/S/P Hunt/Graves - to adjourn the Special City Council meeting at 2:15 p.m. (Motion carried 4-0). ------------------- Ordinance 8037: Granting Raymond and Jane Salus, 404 Lake Elmo Avenue, a rezoning from Rural Residential to Agricultural Zoning. CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA RESOLUTION 90-25 A Resolution granting a Conditional Use Permit to Raymond and Jane Salus - Country Air Golf Driving Range for commercial recreation of a rural nature in the Agricultural Zoning District. WHEREAS, Raymond and Jane Salus, Country Air Golf Driving Range, have applied for a Conditional Use Permit for Commercial Recreation of a Rural Nature; and have submitted all required information and fees for the application for such permit on the parcel of land described as follows: SECT-36 TWP-029 RANG-21 PT NW1/4 OF SWI/4 EXC THE FOLLOWING. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKE ELMO, MINNESOTA, that a Conditional Use Permit for Commercial Recreation of a Rural Nature be granted to Raymond Salus and Jane Salus - Country Air Golf Driving Range, on the aforementioned property is hereby granted, subject to the following conditions: 1. This Conditional Use Permit may be rescinded, after a two week notice and a public hearing, if the City Council finds that the public health, safety, or welfare is jeopardized.
