Present: Dunn, Hunt, Williams, Graves, Armstrong, and Administrator Kueffner. 1. AGENDA M/S/P Graves/Williams - to approve the August 21, 1990 City Council agenda as presented. (Motion carried 5--0). 2. MINUTES: July 23, 1990 M/S/P Graves/Hunt - to approve the July 23, 1.990 City Council minutes as presented. (Motion carried 4-0-1 Abstain: Williams). MINUTES: August 7, 1990 M/S/P Graves/Hunt - to approve the August 7, 1990 City Council minutes as amended. (Motion carried 4--0-1 Abstain: Armstrong) 3. CLAIMS M/S/P Hunt/Williams - to approve the August 21, 1990 Claims #93672 thru #93719 as presented. (Motion carried 5-0). 4. REAPP REPORT Todd Williams reported REAPP has approached the Council. with their need for additional funds ($50,000 minimum, but desire $100,000) to fund a professionally guided public information campaign to oppose the proposed landfill in the Lake Elmo Park Reserve. Despite of their best efforts, they have learned they have not reached the public the way they intended to. REAPP feels the decision to site a landfill in the Park is a political decision and they need to try harder to influence that decision by rousing public support. This is done by demonstrations, sending out information to the public, and asking people to write their County Board Commissioners and legislators. Williams made an appeal to anyone in Lake Elmo who has public relations experience and who would volunteer to help direct this effort or volunteer to work on the effort, please get in touch with him, Dan Novak?or the City office. Cindy Zeher, new resident at 8890 15th St. N., stated she was uninformed of this landfill proposal. and agreed with REAPP that the community was not aware of the visual and noise impact of a landfill. LAKE ELMO CITY COUNCIL MINUTES AUGUST 21, 1.990 PAGE 2 Kirby and Susan Sampson, 8940 15th St. N., stated the general public they have polled are not award of the issues related to the proposed landfill. An information process is needed to inform the people how this would impact not only Lake Elmo, but all people that use the park facilities. Williams asked for the City Attorney's opinion on the definition of "use" of the current referendum funds. At the same time he would investigate with the Finance Director and Financial Consultants for any money possibilities. Williams volunteered to bring to the next meeting two different possible new referendum questions for Council consideration. With Council permission, he would consult with the City Attorney on proper wording. M/S/P Wil.lia.ms/Graves - to authorize Todd Williams to contact the City Attorney for proper wording on two different possible new referendum questions and clarification of "use" of current referendum funds, with all information brought- to the September 4th meeting for Council consideration. At the same time, he would work with the Finance Director and Financial Consultant invesigating financing possibilities. (Motion carried 5-0). Mayor Dunn noted the editorial on the landfill in the Stillwater Gazette of. August loth which would arouse the public to become proactive. Mayor Dunn asked about possible grants available for funding this information campaign. The Administrator responded she has looked into possible grants that would cover this and has not been able to find one, but will continue calling State and Federal agencies. 5. 1989 Audit Report & Recommendation Rob Tautges of Voto, Tautges, Redpath & Co. Rob Taugtes reported they have completed the 1989 City Audit Report. Tautges reviewed. (5) highlights of the manager's report and their recommendations. A copy of this report is on file in the City. M/S/P Williams/Graves - to accept the 1.989 Audit Report by Voto, Tautges, Redpath & Co. (Motion carried 5-0). When asked by the City Administrator if this motion meant the staff should implement the recommendations on the summary page 39, the following motion was made. M/S/P Armstrong/Williams - to request the Finance Director to attend a future meeting and go over the items listed in the summary and update the City Council on what has been accomplished and what should be set as policy. (Motion carried 5-0). The Finance Director presented a draft resolution Ordering Interfund Audit Adjustments. M/S/P Hunt/Graves - to adopt Resolution 90-30 Ordering Interfund Audit Adjustments. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES AUGUST 21, 1.990 PAGE 3 6. Resolution No. 90-28: Adopting the Proposed Budget and Proposed Tax Levy for 1991 Finance Director, Marilyn Banister reported the proposed levy and budget have to be certified to the County by September lst. Our levy limit is $679,756 which is the amount of property taxes to be collected in 1991 to provide our city services. In addition to the General Fund tax levy, we have the Park Bond, the Landfill Referendum and the Equipment Certificate. Councilman Williams asked the Council to consider holding a referendum on a special levy ($50,000 is the minimum at this time, but would like to have $100,000) for a public information campaign aimed at influencing the county's decision on the landfill site. Based on the 4 to 1 vote for the last referendum, Williams noted the citizens of Lake Elmo want the City to do just about anything they can to fight this landfill. Williams explained there has never been a landfill stopped in Minnesota because of an EIS and ReAPP doesn't trust the process because the process has never protected a City like Lake Elmo. Councilwoman Armstrong stated she didn't think the referendum was needed because we get free publicity from the newspapers, we have great volunteers for the landfill fight and felt $50,000 was a gross amount of money. Armstrong indicated ReAPP and the City should concentrate their efforts on influencing the Washington County Commissioners, who will. eventually decide the fate of the landfill, not the public as a whole. She voiced her confidence in DPRA in putting together a good report to give to the County. Councilman Hunt reported he was aware the commissioner representing Lake Elmo is opposed to the landfill and found little outside support had been generated for the fight. Hunt felt the siting of a landfill would be a political decision and the way you influence that decision is to rouse the public because putting a landfill in the park is more than just a Lake Elmo issue. Mayor Dunn didn't think we needed high -paid professionals to come up with a "Catchy Phrase", but felt the City and ReAPP could make a concerted.effort to send out some type of informational sheet to every neighborhood. Dunn felt the EIS process would be the way to stop the landfill. Councilman Graves suggested the City and ReAPP consider a pamphlet similar to that produced for the first landfill referendum to further inform the public about the issues which would only cost a couple thousand dollars. Graves noted the Council must cut expenses by $80,000 out of the proposed budget for 1991. Even though he hadn't made up his mind to support the additional referendum, Graves indicated he didn't want the landfill. and it wouldn't hurt to have the additional funds in the total cost of the levy. LAKE ELMO CITY COUNCIL MINUTES AUGUST 21, 1.990 PAGE 4 M/S/P Hunt/Williams - to adopt Resolution 90-28, as amended below, approving the proposed 1991 tax levy and budget. (Motion carried 4-1:Armstrong: She felt this was an obscene amount of money and voiced her confidence in the attorney and engineer to find ways to stop this landfill.) The following sums of money are proposed to be levied for the current year, collectible in 1991, upon the taxable property in the City: General. Fund $679,756 Park Bond 70,000 Landfill Referendum 100,000 Equipment Certificate 50,000 Total Levy $899,756 7. Set date for 1.991. Budget Public Hearing The Finance Director suggested a public hearing on the proposed city budget and property taxes be held on Tuesday, November 20, 1990 at 7:30 p.m. A continuation hearing, if necessary, will be held on December 4th at 7:30 p.m. The property tax amounts below compare current city property taxes and the property taxes that would be collected in 1.991 if the budget now being considered is approved. 1990 Proposed 1991 Property Taxes Property Taxes 1991 Increase $822,930 $899,756 $76,826 9.34% M/S/P Graves/Williams - to hold the public hearing on the proposed 1991 City Budget and Property Taxes on Tuesday, November 20, 1990 at 7:30 p.m. at the Lake Elmo City Council chambers. A continuation hearing, if necessary, will be held on December 4, 1990 at 7:30 p.m. (Motion carried 5-0). The Budget Committee will. meet with the Finance Director before the budget comes before the Council. 8. Resolution No. 90-29 Accepting General Obligation Bond Sale Marilyn Banister and Rusty Fifield reported. the City received good news from Moody's Investors Service Bonding Company that our credit rating has been increased from BAA to A. The upgrade in our bond rating is the result of (1) Lake Elmo has an above average wealth, (2) Lake Elmo has a lower debt burden; (3) Lake Elmo's tax base is increasing, and (4) Lake Elmo has the best Finance Director around. The Council received results of the bond sale which took place Tuesday afternoon with FBS Investment Services, Inc. being the low bidder. A draft resolution for the sale of G.O. Bonds was submitted for Council approval. LAKE ELMO CITY COUNCIL MINUTES AUGUST 21, 1990 PAGE 5 M/S/P Graves/Hunt - to adopt Resolution 90-29 Authorizing prescribing the form and details and providing the payment of $245,000 General Obligation Capital Notes, Series 1990A to the lowest bidder, FBS Investment Services, Inc. (Motion carried 5-0). 9. PLANNING/LAND USE AND ZONING: A. Petition from Residents Concerned with Speed and Traffic Control in Old Village Richard Acres submitted a petition signed by residents in the area requesting the city address traffic hazards on Lake Elmo Avenue N. Mr. Acres also submitted a letter recommending solutions to six road hazards identified on this petition. Captain Green and Deputy Kurtz reported they ran radar on Lake Elmo Avenue at different dates and times. (See Appendix A for traffic survey). Their radar survey did not support the traffic and speeding problem stated in Mr. Acree's letter. Capt. Green indicated this was a short survey, but was reflective of the typical speed limit the citizens travelling in this particular area on Lake Elmo Avenue. The common speed was 31.5 mph. Attorney Carl Blondin stated he had reviewed the letter and petition and offered the following comments: The statutes provide a change of speed zone if conditions on road warrant a lower speed. A request should be made to Commissioner of Transportation to authorize, upon the basis of traffic investigation, erection of appropriate signs designating what speed is reasonable and safe. He was unaware of any judges throwing out speeding cases on a regular basis. If there is such a situation, he would appreciate knowing about it and would inform thr Board of Judicial Conduct. As far as prosecution is concerned, the Deputies patrolling are very well trained, they present good cases, and he prosecutes them. As far as trials are concerned., he has lost 3 in the 6 years of prosecuting. The City Administrator informed the Council that on August 14th the Washington County Board passed a resolution at the request of Larry Bousquet asking MnDOT to do a speed study on Lake Elmo Avenue. This will take up to, and possibly over, 6 months for an answer. Dick Acres noted there were 162 signatures on the petition. (98% of the people they approached signed the petition.) Acres stated these people are concerned and fed up with people exceeding the speed limit or the speed limits as they stand. They encourage the City to write a letter to the Sheriff's Dept. and Judicial Office of Washington County telling them what level of enforcement they are looking for on these streets. In their opinion, a ticket should be given out at 35 mph in a 30 mph zone and a warning ticket from 31 to 34 mph. LAKE ELMO CITY COUNCIL MINUTES AUGUST 21, 1990 PAGE 6 Mr. Acree volunteered his services to take his letter and go with the City Administrator to Larry Bousquet and discuss each traffic hazard and eliminate items he cannot control. Acree wished to be contacted for any meetings and copied on all correspondence that deals with issue. The City Administrator will work with Mr. Acree and, Larry Bousquet and report back to the Council when the speed study is completed by MnDOT the first meeting of October or before. B. Comprehensive Plan Recommendation from Planning Commission Steve DeLapp, PZ Chair, presented the City Council the Planning Commission's recommended 1990 Comprehensive plan which is a summation of 5 years of work by the PZ, City Council and residents of our City. He noted the plan has some minor recommendations derived by the public hearing and technical comments from the Met Council's preliminary review. DeLapp recommended the City Council adopt the plan with the slight amendments and staff be authorized to make any minor non -policy housekeeping corrections before the final printing and distribution. Chairman DeLapp thanked Mary Kueffner for accepting the Mayor's charge for getting the job done, Planner Mike Black for respecting and caring for our City's values and putting together the ideas of many people into a single cohesive plan. He thanked the City Council for many hours of their personal consideration that led to this result. The Council reviewed Mike Black's comments addressing the major issues identifed by the Metropolitan Council in their letter dated. June 27, 1990. The Council asked for verification of "pipe has a flowing full capacity of 2.15 MGD" and deletion of word "contiguous" to read as follows: "one acre of land suitable for an on site...". The Council also reviewed and concurred with the PZ motions (PZ meeting 7-9-90) addressing the individual requests made at the Public Hearing for changes in the Future Land Use Map. In regard to the PZ recommendation to amend the Future Land Use Map as it relates to land use along the freeway, (Limited Business Dist. W of Cty Rd. 19 to a 1/4 mile E of Cty Road 19 with the 1/2 mile bulge around Cty Rd 19 interchange and back 1/4 mile N along the Freeway), Williams favored bringing the east limit of Limited Business Dist. back to a 1/4 E of Cty Rd 19 because it would be more consistent with Woodbury's plan to the South. He did not agree with extension of this land use category for 1/2 mile N of Freeway around Cty. Road 19. Councilman Graves preferred seeing the 1/4 mile bulge to extend 1/2 mile N of Freeway and 1/4 mile on either side of Cty Road 19, but would support the Comp Plan. Councilwoman Armstrong felt the area covered by the Limited Business Dist would be more than adequate and would wait to see what comes in before we extend this land use further. A draft ordinance adopting the 1990 Comp Plan on a six-month interim basis was presented for Council approval. Councilmen Hunt and LAKE ELMO CITY COUNCIh MINUTES AUGUST 2.1, 1990 PAGE 7 Williams checked with the City Attorney and Planner and found the City ( did not have to adopt the Comp Plan only on an interim basis, but would receive comments until December 3, 1990 from surrounding local governments, school districts and metropolitan and/or state agencies to be considered for incorporation into the Plan. M/S/P Williams/Hunt - to adopt Ordinance 8038, as amended, adopting the 1990 Comprehensive Plan for Lake Elmo with the Future Land Use Map as shown in published draft with the exception of Limited Business Zone extending 1/4 mile North of I-94 from approx. 3/16 mile West of Cty Road 13 to approx. 1/4 mile East of Cty Rd 19 and authorize staff to make technical corrections as recommended by the PZ as noted in public record. (Motion carried 5-0). C. Residential Estates Recommendation from Planning Commission The Council received the proposed RE Ordinance that had been approved by the Planning Commission at their August 13th meeting. The Council reviewed the RE Ordinance including sections that are covered under other portions of the existing code. The Council was in agreement with the RE standards the PZ recommended. Council consensus on road standards were 24' paved roadway, 4' gravel shoulders with the option of a 4' wide blacktopped bikepath on one side. M/S/P Hunt/Armstrong - to direct the PZ to hold a Public Hearing on September 10, 1.990 on the basic Residential Estates Ordinance, (301.070D. 4. Residential Estates) and request the PZ review the question for a reasonable and safe biking and pedestrian walkway. (Motion carried 5--0). When asked if the Council would permit concept review by PZ on RE Developments before this Ordinance is published, the Council agreed to concept reviews, but directed the City staff to warn potential developers that the standards have not been set and they would be proceeding at their own risk. D. Street Light Request: Jane Court N. & Jane Circle N. The Council received a petition from Marilyn Benesch requesting a street light at the intersection of Jane Court N. and Jane Circle N. Larry Bohrer had reviewed the request and found the intersection is near the crest of: the hill and recommended the installation of a street light for safety enhancement. M/S/P Armstrong/Graves - to approve installation of a street light at the intersection of Jane Court N. and Jane Circle N.; subject to verification of 75% of affected residents signing petition as required by our City ordinance. (Motion carried 5-0). E. Site and Plan Review: Guardian Angels Church The Planning Commission reviewed the site plan for the proposed new Guardian Angels Church. The PZ recommended that the City Council approve the site and plans contingent upon the Council's approval of LAKE ELMO CITY COUNCIL MINUTES AUGUST 21, 1990 PAGE 8 the two variances, height of the bell tower and the size of the parking spaces, the church has requested. Since the PZ has recommended approval of the site and plan, the Church requested they be allowed to start digging and grading prior to the variance hearing scheduled for. September 18th. M/S/P Hunt/Graves - to grant Guardian Angels Church an Excavating Permit; contingent upon the Building Official's approval. (Motion carried 5-0). F. Other 1.0. CITY ENGINEER'S REPORT: A. Update from Water Meeting of August 14, 1990 At the informational meeting held August 14, the Council instructed the City Engineer to investigate the feasibility of using Ideal Avenue (CSAH 13) and TH 5 right-of-way instead of Lake Jane Trail. In his letter to the Council, dated August 17th, Larry Bohrer passed on information which he felt did not absolutely rule out an alternate route; however, Lake Jane Trail seemed the most feasible early on in the negotiations with the Counties and continues to be the most economical. The Council acknowledged receiving a letter from Thomas Janochoski, 8510 Lake Jane Trail, Lake Elmo. M/S/P Graves/Armstrong - to accept Larry Bohrer's letter of August 17th, recommending the Lake Jane Trail route relative to routing of the SW-1 water system and to have Larry Bohrer proceed with field survey and design. (Motion carried 5-0). The Council asked the City Engineer to show extra sensitivity to the neighborhoods in siting of the pipeline. B. Partial Payment to T.A. Schifsky, & Sons for 15th Street Improvements City Engineer, Larry Rohrer, submitted copies of. Estimate and Certificate No. 1 for the 15th Street MSA project in the amount of $86,369.90. This estimate covers the grading, culverts, and sand subbase portion of the work. Bohrer and the contractor have both signed the estimate thus agreeing to the value of the work completed. M/S/P Graves/Hunt - to approve Partial Payment No. 1 to T.A. Schifsky & Sons in the amount of $86,369.90 for work completed on 15th Street. (Motion carried 4-0-1 Abstain:Armstrong). OTHER: The City Administrator will be on vacation for one week, August 26-September 1, 1990. The 1989 and 1990 legislation shifts a significantly greater share of the burden of funding City government from State aids to property taxes. Property taxes are spread to property owners based on their relative proportion of value compared to all values within the City. A larger tax capacity value base reduces the individual tax burden on each property owner. The City of Lake Elmo has a net tax capacity value of $4,503,200 as of January 1, 1990. Based on the State Department of Revenue, the number of households is 2,037. This computes to a per household tax capacity value of $2,211. Tax capacity values per household of many City of Lake Elmo, Minnesota Management Report, Page 7 metropolitan communities is significantly higher. This means that those Cities with a higher tax base may levy equal amounts as cities with less tax capacity and burden homeowners less. The most likely method of increasing tax capacity values is the addition of commercial development. The City of Lake Elmo has been cautious in considering such development. City, County and School District tax levies are increasing because of State budget problems. The impact of increasing property taxes mandated by State actions on cities with low tax bases may be disastrous. We recommend that the City prepare plans to either 1) take actions to improve the tax capacity base of the City and/or 2) notify property owners of increasing tax burdens based on State legislative actions. The General and Special Revenue Funds of the City are maintained to account for the current operating and capital outlay expenditures common to all cities. A brief explanation of each major point is as follows: Sewer Section The Metro Council's comments included a request to clearly reference the City's Comprehensive Sanitary Sewer Plan. However, a simple reference was not adequate since the land use plan for the sewered area changed. I met with Larry Bohrer and together we rewrote the Public Sewer section and recalculated land use areas, flow rates, total flows, projected flows and population equivelant units. The new calculations based on the revised land use plan does not change the reserved capacity on the WONE interceptor for Lake Elmo of 458,000 gallons per day, equating to 6,000 population equivalent units of 75 gallons per person. Additional maps will be added to the Comprehensive Plan as necessary. The attached e. Public Sewer will replace the same section on p.42 of the Draft Comprehensive Plan. In addition, goals and policies will be added to the se&1ton on on -site septic systems (p.46): Goal: To assure proper functioning of on -site systems in order to avoid the need for a public sanitary sewer system. Policies: To require each on -site system to be properly sited, designed, installed, inspected, and maintained. To require all on -site systems to meet or exceed the regulations of Minnesota Rules Chapter 7080, Individual Sewage Treatment Standards. To require assurance that the long term maintenance and operation of any private treatment system will be guaranteed. Population Household and Employment Forecast Attached are the Lake Elmo population, household and employment forecast for the years 2000 and 2010. Also included is a breakdown by the City's traffic assignment zones (TAZ). For your comparison I am also including a copy of the data sheet recieved from the Metropolitan Council in the System Statement. The City's population and household projections are slightly higher than those of the Metro Council. At the present time I am recommending that we use the same employment forecast of 1800 for the year 2010. However, I am recommending a higher employment allocation to TAZ 1034 (MUSA area). Other Comments The Metro Council staff also requested that we include as an appendix to the Plan a copy of the most recent Capital Improvement Program. Other "minor" comments made by the Metro Council staff can be either addressed when putting together the Final Draft Plan or will not be addressed and will be subject to further review during the formal comment period. e. Public Sewer Currently, sanitary sewer is available only in two small portions of Lake Elmo (See Map 19). Approximately one square mile located in the southwest corner of Lake Elmo is served by the Metropolitan Waste Control Commission WONE Interceptor. The other system is a privately owned and operated collection system and treatment plant serving Cimarron, a mobile home park, at the intersection of County Roads 70 and 17. The remaining residences and businesses rely on private on -site septic systems, some with joint drainfields designed under the 201 program. The WONE (Woodbury-Oakdale-Northdale-East Oakdale) Interceptor was constructed in 1968 and 1969 to replace several smaller facilities and provide service to projected growth areas. In 1971, the Metropolitan Waste Control Commission (MWCC) purchased this facility and now operates it as part of the Metropolitan sewer system. The function of the WONE is to provide metropolitan interceptor service for designated areas in Woodbury, Oakdale, Landfall, and Section 32 and part of Section 33, in Lake Elmo. The MUSA (Metropolitan Urban Services Area) covers approximately 470 gross acres in Lake Elmo. Only 375 acres in this area are available for development after excluding major right-of-ways, wetlands and a cemetery. A capacity of 458,000 gallons per day, equating to 6,000 population equivalent units of 75 gallons per person, has been reserved in the WONE Interceptor for Lake Elmo's use. Sanitary sewer service has been available since 1969 when the WONE Interceptor was completed. Presently, only two parcels of land in the City are connected to this facility because the sewer was extended only a few hundred feet into Lake Elmo in 1973. Map 11 shows the Metropolitan Urban Service Area (MUSA) line superimposed upon the Land Use Concept Plan for the area. The area within the MUSA line contains approximately 470 gross acres. Of this amount, only 377.5 acres are available for development excluding major rights -of -way and due to the wetlands which must be preserved for drainage control as required by the watershed districts and the drainage plan. A capacity of 458,000 gallons per day, equating to 6,000 population equivalent units of 75 gallons per person, has been reserved in the WONE interceptor for Lake Elmo's use. In 1973, approximately 935 feet of 15" reinforced concrete pipe sewer was constructed from the WONE Interceptor along the I-94 frontage road and into Lake Elmo. This pipe has a flowing full capacity of 2.15 MGD (3.3 cfs). Presently, only the ConnCo Shoe building and a seven unit rental housing tract are utilizing this sewer. This annual sewer flow is presently estimated to be 1.0 MG. ( The WONE Interceptor has a reserved capacity of 458,000 gallons per day (average daily flow) for Lake Elmo. Daily Flow 458,000 Oakdale's Comprehensive Sanitary Sewer Plan Update states that Oakdale Sewer District 13 is planned to be served by the WONE Interceptor through Lake Elmo. Part of the District 13 is temporarily connected to the Oakdale sewer system by means of lift stations. The permanent gravity connection to the Lake Elmo system is anticipated before the year 2000. In this regard, Oakdale has requested that this connection be considered in Lake Elmo's Comprehensive Sewer Plan. The sewer system layout is shown on Map —. The MWCC has made a preliminary determination that the WONE Interceptor can accommodate this additional flow from Oakdale at the Lake Elmo connection point and points downstream. If Lake Elmo agrees ( to provide this service, an inter -community agreement will be executed before contstruction would begin. Present flow from Lake Elmo into the WONE Interceptor is estimated by the MWCC at 1.0 MG per year (.0027 MGD). The following chart projects straight line growth from 1987 to 2000. Over 100 residences and businesses received new systems with cost sharing by the residents and State and Federal Governments. This effort was an important part of the City's involvement in the process of eliminating the small percentage of systems which did not meet City standards. Acree SUBJECT: Traffic Hazards in Lake Elmo Dear Mayor Dunn and Council Members; The purpose of this letter is to provide recommended solutions to the six (6) road hazards identified on the attached petition. It is requested that you review this letter, consider the recommendations and take action to correct these hazards. EXISTING SITUATION: The current speed limits on Lake Elmo Avenue North are 30mph from highway 5 to a point just south of Pierre's Pier, and 45mph from there to just beyond 20th Street. On 30th Street, there is a 35mph speed limit from the intersection of 30th and Lake Elmo Avenue North to Lisbon Avenue. In the 30mph zone on Lake Elmo Avenue North, traffic is allowed to travel at 39mph or less without receiving a citation. This fact was attested to by two officers from the Washington County Sheriff's Department. The reason given is that the County judges throw these cases out of court if contested by the offender because the City of Lake Elmo will not prosecute these cases due to the expense involved. There is currently a contract for 80 hours per week of Sheriff's support for the City of Lake Elmo. This contract has been the status for over 10 years. Maybe the situation in Lake Elmo has changed enough during this period to justify adding additional law enforcement personnel. There is a lot of pedestrian traffic on Lake Elmo Avenue North and 30th Street in the form of walking, jogging, bicycle riding, skate boarders, skating, etc. TRAFFIC HAZARDS AND RECOMMENDED SOLUTIONS; Please refer to the map attached regarding the following hazards. Hazard #1. Vehicles travel too fast on Lake Elmo Avenue North. Recommended Solutions: a. Lower existing speed limits on Lake Elmo Avenue North to 25mph and 30mph where the current speed limits are 30mph and 45mph, respectively. b. Secure funding to increase existing law enforcement effort. Do not accept the argument that there is not enough money. C. Enforce speed limits strictly. Do not allow any "gray" areas such as the current practice of not issuing citations unless violators exceed posted limits by more than 9mph. Mork to establish a reputation that speeding and reckless driving will not be tolerated in Lake Elmo. d. Pursue the construction of sidewalks and/or riding/jogging paths from the Old Village to the Lake Elmo Park Reserve. e. Install 3-way stop signs at the intersections of Lake Elmo Avenue North and 30th Street. Place speed ruts/rumble strips prior to these new signs to warn drivers of the need to stop. f. On Lake Elmo Avenue North, continue the white lines on the sides of the road that exist south of Pierre's Pier. This will warn drivers not to pass on the right, as is the current frequent practice. Hazard #2. Vehicles travel too fast on 30th Street where the speed limit is 35mph. Recommended Solutions: a. Lower existing 35mph speed limit on 30th Street to 25mph. b. Install signs and a pedestrian crossing for users of Reid Park. These signs should warn drivers of the park entrance and possible pedestrians. C. Replace the existing 35mph sign with a larger sign and one that is not faded out. Consider installing two signs, one on each side of the road for vehicles travelling west on 30th. d. Install rumble strips prior to the 35mph signs to make drivers aware of the need to slow down. e. Place the 35mph sign(s) farther east on 30th Street to give drivers more time to slow down before negotiating down the steep hill on that road. f. More frequent and stricter enforcement of speed limits. g. Install sidewalks for people to access Reid Park. Hazard r3. At the intersection of 30th and Lake Elmo Avenue North, there is an S-curve that is especially hazardous when vehicles are exiting 2986 Lake Elmo Avenue North onto Lake Elmo Avenue North. It is very difficult for drivers to see each other and this situation is aggravated when drivers are travelling South on Lake Elmo Avenue North at speeds in excess of 25mph during winter driving conditions. Recommended Solutions: a. Lower the speed limit in this area to 25mph. b. Install 3-way stop signs at this intersection with corresponding speed ruts on Lake Elmo Avenue N. c. More frequent and strict enforcement. Hazard #4. Near the address of 2119 Lake Elmo Avenue North, there is a hill and curve combination that leaves little time for drivers and pedestrians to react to each other. This situation is aggravated by vehicles using speeds in excess of 30mph. Recommended Solutions: a. Lower the speed limit in this area to 30mph. b. Install a 3-way stop sign at 20th and Lake Elmo Avenue North. C. Pursue more strict and frequent enforcement. Iiazard #5. At the intersection of Highway 5 and Lake Elmo Avenue North, across from the Chrysler dealership, it is difficult and hazardous for vehicles to exit from Lake Elmo Avenue North onto Highway 5 due to traffic volume and excessive speed by vehicles on Highway 5. Recommended Solution: a. Install a traffic light at this intersection. Hazard #6. At the intersection of Highway 5 and Klondike Avenue, there is a poor shoulder condition making it difficult for vehicles to exit Highway 5 onto Klondike. Recommended Solution: a. Install a right hand turn lane at the intersection of Highway 5 and Klondike Avenue. Hazard V . At the MTC bus stop on Highway 5 near the Lake Elmo Baptist church, there is insufficent safety provided for individuals using the bus service. Recommended Solution: a. Involve the Department of Transportation to resolve the problem in a manner suitable to provide adequate safety for pedestrians. SUMMARY: Attached is a petition signed by many residents of Lake Elmo that identifies six (6) road hazards in the Lake Elmo area. The City is asked to take action immediately to solve these problems. In those areas where the City does not have jurisdiction, the City is asked to approach the group(s) or organization(s) that do have jurisdiction and request that immediate action be taken to correct these hazards. The safety of the citizens of Lake Elmo and those transiting our community is at stake. Your consideration of this grave and urgent matter is of the highest priority. MINN99TA 40191 elanaaawo August 17, 1990 PAxe,enoe.006t Honorable Mayor and City Council Lake Elmo, Minnesota Re: Alternate Watenmain Route SW-1 Water System Lake Elmo, Minnesota Conunission No, 9150-000 Dear Mayor and Council: At the informational meeting held August 14, we were instructed to investigate the feasibility of using Ideal Avenue (CSAH 13) and TH 5 right-of-way Instead of Lake Jane TraiL We have not made a detailed investigation yet but thought we would pass on some of the Information gathered to date. Firstly, the alternate route would require a 6" diameter watermain just like Lake Jane Trail, I was concerned that the longer distance of the alternate route would require a larger size, but that Is not the case, The alternate route is considerably longer at 3,570 feet additional length. 6" watermahn was estimated at $13 per foot; therefore, the additional pipe cost for the longer route is estimated to be $460410. This cost could be justified if the alternate route saved a corresponding amount of restoration. This additional pipe cost represents 58% of the entire restoration allowance; therefore, we doubt if the alternate route could be shown to be cost effective, Secondly, the alternate route has its own construction difficulties. We know that the Ideal Avenue ditches are very steep and deep. Installing a watermain. In the ditches would be difficult and re-establishing those steep ditches would be worse. We know the County would not allow us to tear up the blacktop. We do not see any difficulties in the TH 5 right-of-way; however, we would have to cross an Amoco 10" petroleum pipeline twice, once on Ideal Avenue and once on TH 5. A contractor must take special precautions crossing pipelines. Lastly, the alternate route would not lend itself to future connections, if needed or desired. No one is advocating additional connections outside the service area at this time, but the Lake Jane Trail route would allow the City to consider hook-ups on a case by case basis if someone's well goes dry or becomes contaminated.
