LAKE ELMO CITY COUNCIL MINUTES
AUGUST 7, 1990
Mayor Dunn called the City Council meeting to order at 7:00 p.m. in
the City Council chambers. Present: Dunn, Hunt, Williams, Graves,
City Engineer harry Bohrer, City Attorney Knaak and Administrator
Kueffner. Absent: Councilwoman Armstrong.

4. REAPP REPORT
Todd Williams reported REAPP had a fantastic show of support for the
landfill fight at the Washington County Fair. Approx. 95% of the
people asked to sign did sign the petition and/or signed letters of
support. REAPP will be meeting Sunday to go over the results of the
fair.
5. PUBLIC INQUIRIES
Pat Ryan, 24th St. Court, now that 24th Street is extended to County
Road 17, he is requesting the City to look into erecting a stop sign
at 24th Street where it intersects 24th St. Court in order to slow
traffic.

City Engineer Bohrer explained 24th Street is the thru street and 24th
Street Court is the cul-de-sac to the south. Generally, stop signs
are to assign right-of-way, not to control speed. The street is still
under construction and speed limits signs have not been erected.
There will be a 30 mph speed limit because it is an urban residential
street. Unless there is a particular sight distance problem with the
intersection, Bohrer would recommend stopping the cul-de-sac traffic
and allowing the thru movement to continue through. Bohrer will look
at the situation to make sure there are no sight distance problems and
report back to the Council.
6. Metropolitan Airport Commission
Mark Ryan and Greg Aljberg, Metropolitan Airport Commission (MAC)
reviewed the Lake Elmo Airport Master Plan (Comprehensive Plan) which
was adopted in 1976.
Growth of aviation activity at Lake Elmo Airport has been much less
than forecasted in 1976 plan:

Environmental concerns, such as noise impact, groundwater
contamination, impact on wetlands; were discussed. Since this area is
planned only for residental growth and not industrial or commercial by
the City of Lake Elmo or the surrounding communities, the public asked,
what basis were their plans for expansion based upon. Mr. Ryan
responded the personal or recreational flying will continue to use
this airport. Councilman Williams, respectfully requested monitoring
air traffic on weekends versus weekdays, and add in the plan the
statement, "the surrounding communities have always been opposed to
the expansion plan proposed in 1976". As City Engineer for Lake Elmo,
Bohrer voiced the concern on surface water runnoff from the airport
into Downs Lake be addressed in the study. Mr. Ryan indcated these
concerns will be brought to their commissioners. Public comments
should be sent to: Commissioner Virginia Lanegran, Metropolitan
Airport Commission, 6040 28th Aveune S., Mpls., MN 55450.
7. PLANNING/LAND USE and ZONING:
A. Stephen & Elizabeth Johnson: Shoreland Permit for Driveway
2945 Lake Elmo Avenue
In his review letter, dated January 31, 1990, City Eng. Bohrer
suggested that the Shoreland Permit be granted providing the following
conditions were met: (1) Show proof of ownership to the 33' strip to
the satisfaction of the City Attorney. This has been demonstrated.
(See Attorney Knaak's letter dated July 20, 1990). (2) Have the strip
of land staked by a registered land surveyor. Bohrer stated this has
been done, (3) The design of the private storm sewer shall be approved

by the Engineer. Bohrer has not seen a design, but the applicant had
stated on the phone he would provide for the drainage by installing a
catch basin and a storm sewer that would drain the intersection of his
driveway on 30th Street and pipe the water southerly onto a low area
on the applicant's own property, and (4) Elevations need to be
verified and the need for a driveway culvert at 30th Street shall be
determined by the Engineer.
Councilman Williams voiced his concern that any drainage system would
become frozen and not operate as intended. Any fill put in will
increase the amount of spreading of water that normally collects there
and eventually spill over into the neighbor's property and threaten
their septic system. Williams asked this concern be addressed by the
City Engineer.
M/S/P Graves/Williams - to postpone consideration until the applicant
has provided the City Engineer with the design for a private storm
sewer for his approval and the engineer will determine the need for a
driveway culvert at 30th street. (Motion carried 4-0).
B. Joseph Kiesling: Shoreland Permit & Variance

M/S/P Dunn/Graves - to bring back for Council consideration the
Shoreland Permit and Variance request of Joseph Kiesling. (Motion
carried 4-0).
At the July 21, 1990 meeting, the Council, on a 2-1 vote, approved the
variance request by Mr. Kiesling. Since then the City received a
letter from the DNR, dated August 7, 1.990, stating, based on their
review of the City's decision on the deck variance, they are appealing
the Council's decision under Section 301.060.C.2-Appeals of the City
of Lake Elmo Municipal Code based on reasons stated in correspondence
to the City and DNR Permit #88-6068.
The City Attorney noted the DNR has control of the shorela.nd district
and the local governing body is the enforcing agent to the Minnesota
Department of Natural Resources. The Council does not have the
authority to overrule the DNR, (State Statute takes precedence over
our City Code). Therefore, Attorney Knaak stated, since there was a
misunderstanding by the Council on DNR's authority, he suggested the
Council rescind the variance previously granted.
M/S/P Williams/Graves - to rescind the variance previously granted by
the Council to Joseph Kiesling for construction of a walkway based on
findings stated in July 17, 1990 City Council Minutes with the
addition to No. 7: The DNR has statutory authority to prohibit this
variance from being granted. (Motion carried 4-0).
C. Letter from Tim Mandel
The City received a letter from Tim Mandel, 2479 Lisbon Avenue, making
a formal complaint based on his observations that the home at 2461

was using his home as a duplex. The Council received a response from
the resident of 2461 Lisbon Avenue indicating that he has live -in -help
which will be finished in the next couple of weeks.
Since the live -in -help will be finished in a couple of weeks, the
Council asked the staff to follow-up after this two week period. The
Building Official indicated a second kitchen is not regulated by the
Uniform Building Code. He asked for clarification of "Live -In -Help".
8. CITY ENGINEER'S REPORT:
A. PUBLIC HEARING: Patch and Overlay of 31st,St.
Mayor Dunn opened up the Public Hearing at 8:56 p.m. in the City
Council Chambers. The public hearing notice was published in the St.
Croix Valley Press and all affected property owners were notified.
Larry Bohrer presented the feasibility report on 31st Street from CSAB
6 to TH 5 for Bituminous Patching and Overlay. 31st Street from
Stillwater Boulevard (CSAH 6) to TH 5 is a Municipal State Aid Street.
It generally consists of two 11 foot wide bituminous surface driving
lanes plus 4 foot wide gravel shoulders. In many places these
shoulders have become overgrown with vegetation. The 1989 traffic
counts on this street is 350 vehicles per day. The total project cost
is $39,480.00. If shoulders are not paved, estimated project cost is
$33,720.
Ted Sterbenk, 9141 31st St. N., and John Sandstrom, 9077 31st St.,
submitted a petition stating they were against the improvements
proposed because they do not feel the improvements are necessary at
this time. If anything is done, it should be a sealcoat. They noted
they do not have 3 or 4' shoulders.
Joan Moszer, 9095 31st St. N., stated she was against the project
before she heard the City Engineer's presentation. She was in favor
of the project and the $200 assessment.
Steve Chlebeck, 9018 31st St., stated he was against the project when
he got the public hearing notice. Now, that he heard there would only
be a $200 assessment, he would be in favor of the project.
William Hughes, 9038 31st St.N., stated he was in favor of this
project as long as it was MSA funded. If we can stay within the $200
assessment, he felt the City should do the project. He asked the
Engineer to look into a possible culvert.
Mayor Dunn closed the public hearing at 9:34 p.m.

and Overlay of 31st Street with shoulders from CSAH 6 to THS. (Motion
carried 4-0).

B. SW-1 Water Supply Conract
The Council reviewed the agreement for water service between the City
of Oakdale and City of Lake Elmo.
There was discussion on the following pages:
Page 1, 3rd Paragraph: Councilmen Graves and Williams suggested
adding wording: WHEREAS, the purpose of this Agreement is to
implement the terms of the June 26, 1990, Agreement, specifically
paragraphs II.E. and III.C. and is subordinate to that Agreement.
Page 1, 1. TERM OF CONTRACT: City Attorney Knaak explained,
originally, the term was 15 years and 30 years was strictly a
compromise.
Page 2, 3D. WATER SERVICE: " ...regulations and requirements of
Oakdale now in force or that may hereafter be adopted, in connection
with the use of water in Lake Elmo." The Council asked if these
requirements should be written out specifically; therefore, they would
not become burdensome in the future. Attorney Knaak felt the last
sentence clarified this. "This section, however, shall be limited
only to what use the water could be put to and in no way gives Oakdale
the right to dictate rules of operation of lake Elmo water system."
Page 3, 3E. WATER SERVICE: "If the meter reading is within 5% of the
actual water used..." The Council asked if there should be a more
accurate meter reading. Larry Bohrer found this 5% to be acceptable.
He stated the water used for flushing or firefighting would not be
monitored.
Page 4. 6B. RATES AND CHARGES: The meter will be read on or before the
5th day of each month, the bill will be mailed on or before the loth
day of each month with payments due on or before the 30th day of each
month. The Council questioned how this would affect our City because
we now send out quarterly water bills. Bohrer explained the Fund
starts out with a balance of $25,000. Oakdale considers us their,
single largest customer and Oakdale bills all customers monthly.
Page 5, 9. LIABILITY OF OAKDALE: Attorney Knaak noted the agreement
of June 26th does allocate those responsibilities and found this
acceptable.
Page 5, 10. INDEMNIFICATION: Councilman Williams suggested reciprocal
indemnification. Knaak preferred it noted there, but finds this
statement acceptable and it does not expose the City.
M/S/P Graves/Williams - to accept the additional wording to Page 1,
Paragraph 3 "and is subordinate to that agreement. (Motion carried
3-1: Hunt: He felt there was indemnificaton for Lake Elmo in the
underlying agreement and it was clearly stated that this agreement is
subordinate to the June 26, 1990 agreement.)
M/S/P Graves/Williams - to approve the Agreement for Water Service
between the City of Oakdale and City of Lake Elmo; including the
amendment. to Page 1 as stated in above motion. (Motion carried 4-0).

M/S/P Graves/Hunt - to direct the City Engineer to proceed with Phase
I which includes the field study and survey. (Motion carried 4-0.)
Bohrer will bring this information back to the Council for written
authorization.
When asked about the billing cycle, Bohrer indicated the County has
agreed to payment for engineering, subject to terms of the June 2.6th
agreement. They would not pay if there was not an agreement entered
into.
9. CITY ATTORNEY'S REPORT:
Councilman Williams requested the monthly litigation report be sent in
their regular City Council packets so they could have more time for
review. Attorney Knaak responded this could be done now because the
problem of litigation information being circulated is gone.
10. CITY COUNCIL REPORTS:
A. Council Workshop with Maintenance Department
and Fire Department: Lee Hunt
Councilman Hunt has contacted Dan Olinger and Dick Sachs about setting
up a tour through their departments for interested Council members.
The Council will submit their work schedule and the administrator will
co-ordinate tour dates with each department.
In regard to Chief Sach's request to repair the tele-squirt,
Councilman Hunt reported he and Mayor Dunn inspected the Tele-squirt
and found significant rust damage. They indicated this was an
appropriate repair request and there was money ($8000) in the reserve
fund for this repair.
M/S/P Hunt/Graves - to direct the Fire Dept. to proceed with the low
bid in the amount of $7880.00 from General Safety Equipment Corp. for
repair of the Tele-squirt. (Motion carried 4-0).
B. V.B.W.D. Tour - Follow -Up
Mayor Dunn updated the Council on the VBWD tour of July 23rd. The
VBWD asked the help from Cities to enforce clearing of culverts and
sedimentation fences be installed where needed when new development is
proposed. They suggested the Building Official talk to VBWD to get
their input on procedure for building permits.
C. Update on Temporary Asphalt Plant in Section 32
Mayor Dunn reported Oakdale has permitted Dan Dolan to lease land
temporarily to Valley Paving for an Asphalt Plant on the Brockman
property in Section 32. The contractor's prefered area for the asphalt
plant was at the Fleet Farm site, I-694 and Hyw 36, and it was not
allowed. Oakdale, nor MnDOT, realized Helmo Avenue was in Lake Elmo;
consequently, the City was not informed. The Council voiced their

concern on possible road damage because there is no road restoration
agreement. They also requested investigaton of filling being done in
this area and the impact on the wetlands.
D. Joint Meeting with Planning Commission and City Council
The City Council called a workshop with the Planning Commission for
August 13, 1990 at 7:00 p.m, to work on the Comprehensive Plan and
Residential Estates and Freeway Business District Ordinances.
1.1. CITY ADMINISTRATOR'S REPORT:
A. Request from DPRA for Reconsideration of Increase
for Services
M/S/P Hunt/Williams - to bring back the request from DPRA for Council
consideration. (Motion carried 4-0).
At the July 21st meeting, the Council on a 2-1 vote denied the request
of DPRA for a rate incrase. The Council received a letter, dated July
31, 1990, from Robert Reid, DPRA, stating they find themselves making
this request of Lake Elmo because they didn't include a clause in the
contract as they normally do to pass on the cost of such salary
adjustments and took the position, based on information from Lake Elmo
and Washington County regarding the anticipated EIS schedule. As
indicated in their May 24th letter to Todd Williams, the adjustment in
their labor rates, if approved, would add only $2,937 to the total
proposed project cost of $98,098, including contingency raising the
total to $101.035. DPRA asked the City to reconsider this decision on
their request for approval to increase the labor rate charge in
accordance with their salary costs for staff working on the EIS review
project.
M/S/P Hunt/Williams - to grant DPRA. the adjustment in labor rates
retroactive to April 1, 1990 in the amount of $2,937 for staff working
on the EIS review for the Proposed Landfill Site in Lake Elmo.
(Motion carried 3-1: Graves: He felt 7% was a healthy increase
(includes cost of living and peformance and/or promotion increase) in
salary expense for all employees and should have been factored into
the contract. He appreciated the quality of work DPRA has provided
the City, but felt the Councl had a fiscal responsibility to our
residents.)
B. Request from Deputies for Oxygen Tank
Deputy Kurtz has asked the City to consider purchasing a portable
resuscitator/respirator (approx. $4700) to be carried with them in
their cars while they are on duty in Lake Elmo. The County does not
have funds available to purchase this equipment. The Finance Director
indicated the City is under budget for our police protection.
Since the deputies are usually the first responders to a medical
emergency and with communicable diseases growing at uncontrollable
levels, the Council believed this to be a good purchase and would
protect the health of our deputies.

M/S/P Williams/Hunt - to approve spending up to $700 for a portable
resuscitator/respirator for the deputies contracted in the City of
Lake Elmo. (Motion carried 4-0).
C. Lake Elmo Solid, Waste Advisory: Update on Review of
Organized Collection
The Council received a list of pros and cons on methods available for
waste abatement. The Council requested the Administrator investigate
what other cities the similar size of Lake Elmo (5,000-15,000
population) have done.
The City Administrator was directed to put together a proposal, which
should include goals, for organized collection, schedule a workshop
date, and send all information out to the Council and to the Solid
Waste Advisory Board before the workshop date.
D. Special Meeting for August 14, 1990
PCA,'s informational meeting on the public water supply
proposed for those residents in the Well Advisory Area
The MPCA will hold an informational meeting at City Hall, August 14th,
on the public water supply. A public hearing has been called for the
same evening to consider upgrading the system to enable us to provide
fire protection to those residents not only in the well advisory area,
but along the route of the pipe.
M/S/P Hunt/Williams - to call a Special City Council meeting for
August 14, 1.990, 7:00 p.m. City Hall for the public water supply
proposed for those residents in the Well Advisory Area and a public
hearing for fire protection. (Motion carried 4-0).
E. Speed Conditions on Lake Elmo Avenue
The City received a letter from Richard Acree, stating he is working
with a group of concerned citizens who would like to come before the
Council at their August 21st Council meeting. At this time they would
present their list of traffic problems in the Lake Elmo area and
corresponding solutions.
F. League of Minnesota Cities Planning Committee
The Council received a letter asking if any Council member would be
interested in becoming a member of the 1991 Conference Planning
Committee. Councilman Hunt indicated he would be interested.
The League of Minnesota Cities' regional meeting, hosted by the City
of Stillwater, will be held on Wednesday, September 12th, at Oak Glen
Country Club. Mayor Dunn and Councilmen Hunt and. Williams will be
attending. If any other Council members can attend, they are to let
the Administrator know.

G. General Election: Resolution 90-26
Designating Official Polling Places,
Election Judges and Wages
The Council received a list of residents who have agreed to be
election judges at the September 11, 1990 Primary and November 6, 1990
General Election. Last election we paid our election judges $3.75 per
hour and $4.25 per hour for head judges. (We must pay at least minimum
wage which is $3.95 per hour for 1990.) Staff recommended the
election judges' wages be set at $4.25 per hour and $5.00 per hour for
the head election judges. Based on this hourly rate, the prmiary
election will cost about $1100.00 in wages and the general election
will cost about $1500.00 for a total estimate of $2600. $3,000.00 for
wages was budgeted for these two elections.
M/S/P Graves/Williams - to set the wage of $4.25 per hour for the
election judges and $5.00 per hour for the head election judges for
the 1990 primary and general elections. (Motion carried 4-0).
The Council must designate the official polling places.
M/S/P Graves/Williams - to adopt Resolution 90-26 designating the Lake
Elmo Fire Hall, 3510 Laverne Avenue North as the official polling
place for Precinct I and Precinct II for the primary election to be
held September 11, 1990 and the General Election to be held November
6, 1990; and to approve the list of election judges, as presented,
contingent upon each judge attending the City's election judge
training session, as required by State Law. (Motion carried 4-0).
