LAKE ELMO CITY COUNCIL MINUTES
OCTOBER 16, 1990

Mayor Dunn called the City Council meeting to order at 7:00 p.m, in
the Council Chambers. Present: Mayor Dunn, Hunt, Williams,
Armstrong, City Engineer Bohrer and Administrator Kueffner. Absent:
Councilman Graves
1. AGENDA
Add: 7. Letter from Deputy Kurtz regarding Speed Complaints, 9C.
Telephone System, 8A. Items out of the Comprehensive Plan: Lee Hunt

4. REAPP REPORT
Todd Williams reported at a. special meeting on Sunday REAPP made a
list of 40 action items which they would like to try to accomplish as
part of the public information campaign. A written summary of these
action items will be sent to the Council in the next Council packet
for discussion at the November 8th meeting.
5. CITY ENGINEER'S REPORT:
A. PUBLIC HEARING: Pass on Assessment for Lampert Street
Improvement to Wilmer & Harriett Arndt, 3315 Lampert Avenue
The Public Hearing notice was published in the St. Croix Valley Press
and the affected property owner was notified.
At the last meeting, Larry Bohrer brought to the Council's attention
the fact that the name of Wilmer and Harriet Arndt was inadvertently
left off the Lampert Avenue improvement roster. This public hearing
is to comply with state law to pass this assessment of $694.56 onto
the benef.itting property owner.
Mayor Dunn opened up the public hearing at 7:34 p.m. in the City
Council chambers.
Harriett Arndt, 3315 Lampert Avenue, stated her objection to the
assessment method used and felt the fair assessment method would be by
front footage.

Councilwoman Armstrong pointed out you are paying for access onto a
road, not for use of a yard or landscaping, that everyone along that
street uses equally. If it is any consolation, at tax time the larger
lots will pay their fair share.
Mayor Dunn closed the public hearing at 7:45 p.m.
M/S/P Hunt/Armstrong - to pass along the assessment of $694.56 for the
improvement of Lampert Avenue from 32nd to 33rd Street to Wilmer and
Harriett Arndt noting that the Arndt's name and address was
inadvertently left off of the original assessment roster, but that the
property so identified is included in Resolution 90-31 adopted by this
Council on October 2, 1.990. (Motion carried 4-0).
B. PUBLIC HEARING: Fire Protection
The Public Hearing notice was published in the St. Croix Valley Press
on October 3 and October 10, 1990.and all affected property owners
were notified.
At the last Council meeting, Council directed staff to call a public
hearing to discuss the addition of fire protection capabilities to the
public water supply system to be installed to the area affected by
Washington County Landfill No. 1.
Mayor Dunn opened up the public hearing at 7:46 p.m. in the City
Council chambers.
City Engineer, Larry Bohrer, reported the additional cost for fire
protection involves increasing all 4" pipe to 6" and all 6" pipe to 8"
size. It would also include the installation of approximately 22
hydrants with associated valves, pipes and fittings. The estimated
cost of fire protection improves is $66,000.00, number of: lots
benefitting 159, with the estimated cost per abutting lot $415.00.
James Tobin, 4180 Irvin Circle N., asked why the City is pursuing this
when at the last meeting no one voiced wanting fire protection?
A.rlyn Christ, 8928 36th St. N., asked what the Fire Chief thought of
fire protection.
Fire Chief Sachs responded that he has talked with fire fighters from
other cities and that installing a water system without including fire
protection wasn't a normal practice. He felt the distance of 1,000
ft. between fire hdyrants was sufficient. Sachs indicated he saw the
amount of people who will benefit from this even more than what was
stated.
Bohrer explained there is the direct benefit of having a fire hdyrant
near the house in the event of a fire and then there is the indirect
benefit to surrounding residents. They benefit because you can go a
much shorter distance to fill up the department's tankers and reduce
turnaround time.

Janice Tripplet, 8040 Lake Jane Trail, was opposed to the fire
protection and indicated she would receive no benefit from lowered
insurance rates.
Richard Quinn, 8929 36th St. N., asked what will this do to our taxes
and to the water pressure. Quinn indicated he was opposed to fire
protection and was just interested in getting the water supply.
Joe Timmers, 1621 Sandhurst Dr., felt by installing larger pipes now
would cut expenses if the need arises in the future.
Ernie Cappra asked if Oakdale has agreed to supply Lake Elmo limited
fire protection. will they let us have an 8" main without fire
protection.
Bohrer explained the City approached the City of Oakdale with a
possible amendment to the agreement that allowed fire protection, and
they have passed that amendment.
Darryl Vosberg, 4101. Irish Ct. N., indicated he did not see any
benefit for fire protection if others are not allowed to hook up to
the water system.
Cherie Kaufland stated installing fire hydrants did nothing to lower
their fire insurance premiums because we have a volunteer fire
department.
Tim Zilles, 8890 36th St. N., asked if the City would ever get a
full-time fire department?
Dave DuFresne, 8968 36th St. N., voiced his interest in bringing safe
drinking water to the affected area and was opposed to fire
protection.
Thomas Janochoski, 8510 Lake Jane Trail, voiced his opposition to the
pipeline going down Lake Jane Trail.
Al Kund.e, 4171 Irvin Circle N., stated he was opposed to fire
protection. IIe talked to his insurance agent and there would be no
drop in his premium.
James Jennings, 8320 Lake Jane Trail, asked if they could stay away
from the trees when the pipeline goes done Lake Jane Trail.
Tom Huebsch, 4285 Ivy Ct. N., asked if he could hook up he if had
contaminated water..
Bohrer explained the only area that is planned to be hooked up to
water is the Lake Jane well Advisory Area. The counties did not say
the City can't allow people to hook up, but we have to make sure that
there's enough capacity left over so all of these areas can be served.
If there is capacity left over, we can allow extra hookups.

When the audience was asked by the Council for a show of hands in
favor of fire protection, four hands went up, two of which belonged to
Fire Chief Sachs and former Fire Chief Pott.
Mayor Dunn closed the public hearing at 8:41 p.m.
The Council noted they did not hear anyone hollering for fire
protection, but heard their primary concern was to get clean drinking
water to this area. The Council made it clear that our City Engineer
has stated on a number of occasions that consideration of fire
protection has no way delayed the installation of the drinking water
supply.
M/S/P Hunt/Armstrong - the public water supply in the Lake Jane Well
Advisory Area not be upgraded for fire protection. (Motion carried
4-0).
The City Administrator will notify the City of Oakdale of Council
action.
C. Street Light Request for CR 17 & 39th Street and Highway 5
and 39th Street
Larry Bohrer reported at the last Council meeting the Council received
a request from Lake Elmo State Bank to install a street light at the
intersection of 39th Street North and Lake Elmo Avenue and referred
this matter to the Engineer.
Bohrer explained he contacted Mark Mattson, Assistant County Engineer
and discussed the need to increase visibility at that intersection.
Based on that conversation the County will install a standard
cylindrical reflector on the existing stop sign post on 39th Street.
The County will also study whether large (2' x 3') advance street name
signs should be installed north and south of the intersection on Lake
Elmo Avenue.
NSP was contacted and stated there was no power readily available at
this intersection and the cost to extend power to that intersection
for a street light would be $2,500. Bohrer noted that in the past the
City has assumed the on -going operation and maintenance on all street
lights. The individual cost per month on a street light varies
between $9.75 up to $13.75 depending on the wattage of the light. The
City pays approx. $700/month for all the street lights.
Bohrer concluded the safety of the intersection would be enhanced by
adding the 360 deg, reflector on the stop sign and the erection of
advance signs and/or a street light.
The City Engineer was requested to get the price of the large street
name signs if the County doesn't want to put up signs.
D. Escrow Reduction: Packard Park 3rd Addition
Larry Bohrer reported the work on Packard Park 3rd Addition is
substantially completed. The Developer's Agreement allows partial

release of escrow as the work is completed. The only work remaining
is some cleanup and erosion repair is around the pond. The remaining
escrow is calculated as follows:
Original Escrow $155,000
Value of Work Completed-124,000
Remaining Escrow $ 31,000
Bohrer recommended that the escrow be released so that the remaining
balance is $31,000.
M/S/P Hunt/Armstrong - to reduce the amount of escrow to $31,000 for
improvements to Packard Park 3rd Addition based upon the
recommendation of the City Engineer in his memo dated October 12,
1990. (Motion carried 4-0).
E. Partial Payment No. 1. Patch and Overlay to Bituminous
Consulting & Contracting, Inc.
Larry Bohrer reported the work on the 1990 Patch and Overlay Project
is complete. In that regard, Bohrer prepared Partial Payment No. 1.,
in the amount of $34,050.69, and recommended its payment to Bituminous
Consulting and Contracting Company, Inc.
M/S/P Williams/Hunt - to approve Partial Payment No. 1., in the amount
of $34,050.69, to Bituminous Consulting and Contracting Company, Inc.
for the work on the 1990 Patch and Overlay Project based on the City
Engineer's recommendation. (Motion carried 4-0).
6. PLANNING/LAND USE & ZONING:
A. Recommendation from Planning Commission on Residential Estates
and Supporting Ordinances
RESIDENTIAL ESTATES ZONING ORDINANCE:
(4) Setback from Front Property Lines: Mayor Dunn personally favored
75 feet minimum, but the remaining Council favored 100 feet minimum.
(5) Frontage on Public Roadway: 150 feet minimum except 70 feet at the
end of cul-de-sacs. The Council noted this 150' requirement would
eliminate flag lots.
(8) Septic Drainfield Regulation:
The Council did not change the drainfield requirement. They directed
the PZ review the City Engineer's, Building Official's, City Planner's
rationale and come back with a recommendation for adequate septic
drainfield site.

Street Standards:
Mayor Dunn favored 28' minimum, City Eng, Fire Chief and Maintenance
Foreman favored 32', PZ favored 241, Planner favored 28', Council
suggested 24' with 4' shoulder for local streets and 32' wide for
collectors.
Bohrer explained all State Aid. Roads in Lake Elmo are classified as
Collectors.
M/S/P Hunt/Williams - to postpone consideration of supporting
ordinance for road standards for RE until the next Council meeting.
(Motion carried 4-0).
Suitable road standards for collector and interior classifications are
to be brought to next meeting by the staff.
Section 1602.060: D. Distance between driveways in Residential
Estates Zoning District. The minimum distance between curbs of
driveways at right-of-way line shall be 150 feet. Driveway access
limited to one per lot.

made for driveway separation for cul-de-sacs in Section 1602.070D.

Section 301.1.30 C 14 c, page 301-66, as stated. (Motion carried 4-0).
Signs: Section 505.315
Should read: 505.315 - Signs not permitted in Residential Zoning
Districts.
Subdivision identification monuments and permanent signage will not be
permitted in any residential subdivision platted after the adoption of
this ordinance.

(Motion carried 4--0).
B. DeMontreville Park Access
Several months ago the Council directed the staff to notify residents
abutting, or in close proximity to, the area of the easement to
DeMontreville Park, the Ci.ty's intention to proceed with the
improvements and asked for input as to whether there would be a
preference for a bituminous covering rather than the gravel.
David VanLandschoot presented a memo to the Council/Parks Commission
stating the neighbors opposition to the walkway and requesting
abandonment of the walkway easement. He added they felt the easement
was ill. -conceived and considered this taking of the neighbor's land.
The Council asked that this petition for abandonment of walkway
easement signed by interested neighbors be presented to the Parks
Commission for their response.
Councilman Williams asked if the City insisted on having this easement
and walkway, what were their feelings of a gravel walkway versus a
bituminous walkway. A resident answered, "How would you like a
landfill in the Regional Park --that is how strong our opposition is to
the walkway."
M/S/P Willians/Hunt - to postpone consideration until a recommendation
is received from the Parks Commission on abandonment of walkway
easement in DeMontreville Highlands. (Motion carried 4-0).
OTHER:
Jim Nora, 5439 Highlands Trail, complained about the speeding in this
area and asked for visible speed signs. Nora alerted the City of an
open storm sewer behind his house the children in the neighborhood
have discovered.
The City Engineer and Foreman will be made aware of this open culvert.
Deputy Kurtz, noted there is a speeding problem throughout the City,
but will monitor the area.
C. Recommendation from Planning Commission on request to move
mobile home onto property located CR 15 and I94: Bob Mogren
Bob Mogren wishes to move a manufactured home as a residence for the
person that is the caretaker of their sod fields onto the property he
leases near County Road 15 and 1-94. The manufactured home will be
placed on an old house site among existing out -buildings and trees.
The caretaker has worked for Mogren Bros, for 15 years and has
prevented such vandalism as snowmobiles, three-wheelers, cars, and
parties from ruining the sod fields. The Planning Commission reviewed
this application and wished to enable Mr. Mogren to have a watchman on
his property. The PZ's concerns and recommendation is listed in their
October 8, 1990 minutes.

Jim McNamara, City's Building Official, .reported the mobile home has
proper state licenses on it and has a manufactured date of 7/7/77. The
house woud have to meet all existing building codes in effect.
McNamara pointed out a law was passed in 1982 that prohibits a
municipality from regulating maufactured homes built in conformance
with 327.31 to 327.53 that comply with all other zoning ordinances
promulgated pursuant to this section. It was the opinion of the City
Attorney we cannot prohibit this mobile home from being out on his
property because we have set no standards (size, foundation, roof
pitch,) in any of our zoning districts.
The Council indicated to Mr. Mogren they did not want to see the land.
use changed from Ag to commercial. As long as he wasn't selling
anything, they saw sod fields as an Ag use and Mr. Mogren would be
bound by the regulations in the RR Zoning District.
The City Administrator and Building Official will recommend amending
the code by setting standards for manufactured homes in all our zoning
districts in order to bring our code up in conformance with State Law.
7. Presentation by Washington County Sheriff's Department:
Deputy Jesse Kurtz
Washington County Deputy, Jesse Kurtz, provided a film of the County
SWAT Team which trains in the Lake Elmo Park Reserve. The FBI has the
Washington County Sheriff's SWAT Team train other departments
state-wide.
Jerry DuFriese of the Wash. Cty Canine Unit and his dog, Rommel gave a
demonstration on how with a single command a trained dog seeks out
narcotics. The Canine Unit has been in existence for approx. 8 years.
They train with St. Paul Police Dept Canine Unit in a 14 week program,
8 hours a day 5 days a week.
Deputy Kurtz provided a letter regarding speeding complaints by
Richard Acree on County Road 17 between 20th St North & Highway 5.
Inn response to Deputy Kurtz's letter, Dick Acree addressed the
following statements:
--"Two days after Deputy Kurtz made the offer for me to sit in the
squad car and run radar, an officer let he., sit in his vehicle for 1/2
hour to observe the read-out on the radar screen. When a car passed
them at 38 mph in a 30 mph zone, I asked why didn't you stop him. The
officer answered they don't give a ticket in a 30 mph zone unless you
go 40 mph or more. I brought this to the attention of Capt. Green,
who said the officer made a mistake and should have pulled him over.
This is the second officer that has told me they do not enforce the
speed limit unless they are travelling 40+ mph. The enforcement level
needs to be tightened up."
--"In regard to the comment by Capt. Green on the radar survey
that was conducted, I believe they did the best survey they could with
the men and equipment they had. Capt. Green agreed the survey was
faulty because of the points I brought out in my letter."

--"There is electromechanical equipment available from the City of
New Brighton which counts volume and speed of vehicles. This would
gave a true answer of how much speeding is done without setting up a
visible squad car with one-way radar guns. I asked that you don't rely
on the speed survey of Wash. Cty because it is faulty."
Administrator Kueffner explained the County has passed a resolution
for a speed study, and we are awaiting these results. There are other
issues in Mr. Acree's letter that have not been addressed., such as the
suggestion of sidewalks. Kueffner stated she did not intend to neglect
anything and asked for direction from the Council on how to address
these issues. Mayor Dunn indicated the Administrator has done what
the Council has directed her to do and has responded adequately.
8. CITY COUNCIL REPORTS:
A. Items noted from the Comprehensive Plan: Lee Hunt
Because of the meeting running so late, Councilman Hunt withdrew this
item from the agenda.
Mayor Dunn reported the Lake Elmo Fire Department held a fantastic
Open House. Also on October 25th the Met. Council will address
Section 8 Housing.
9. CITY ADMINISTRATOR'S REPORT:
A. Letter from Washington County Auditor --Treasurer's Office
regarding property tax reduction request by David. Johnson
on building and property in Section 32
The City received a letter from the Washington County
Auditor --Treasurer regarding a request for a $10,000 tax abatement by
David Johnson, (ConnCo Shoes) Property Number 37032-3852. The City
must respond to this within 20 days of the issuance of the letter.
The Administrator reported she had talked to Ed Heivin and who wrote
and initiated the "Report of County Assessor's Investigation", who
stated that the words, "There is a high vacancy rate due to the
policies of Lake Elmo won't permit any other usages", were of the
applicant and not the conclusion of the assessor.
Mayor Dunn indicated she was appalled that any resident or corporation
of Lake Elmo would expect the general population to pick up the tab on
their taxes. In regard to the statement "the policies of Lake Elmo
won't permit any other usages", Mayor Dunn noted there are well over
150 allowed uses in the General Business Zoning District. She found it
hard to believe there wasn't anything that would be applicable for
this property. Dunn opposed the abatement and asked the City
Administrator to write a letter to Washington County indicating our
opposition.

Councilman Williams asked, "How common is it for commercial property
to be devalued? I see no evidence for any comparable property, so on
what basis dial the assessor come to the conclusion of the property
value to be reduced? What is the value of similarly sewered land in
Oakdale and Woodbury? This particular parcel is the only commercial
parcel in the entire city that has sewer already there." Williams felt
a letter should be sent to the County Assessor and County Board
objecting to the assessor's report. If this statement is
unchallenged., it will be considered a certified statement. The
statement is totally false.
Williams discussed this matter with the City Attorney, and he agrees
we should act very decisively in writing a letter to the County
Assessor insisting this statement be retracted or corrected after
proper investigation.
M/S/P Williams/Armstrong - to reject the request of David Johnson,
O.W.J. Inc., 7500 Hudson Blvd. Property Number 37032-3852 for
reduction in valuation of Real Estate and/or refund of taxes paid.
(Motion carried 4-0).
M/S/P Williams/Hunt - to direct the City staff to write a letter to
the County Assessor insisting the report of the County Assessor's
investigation be corrected. (Motion carried 4-0).
B. VBWD proposed revisions to Rules & Regulations
The Valley Branch Watershed District Board of Managers held a public
hearing on their Rules and Regulations. The Council commented on the
proposed changes to the District's rules and regulations. Attachment
A reflects the changes and additions made by the Council and City
Engineer.
M/S/P Williams/Hunt - to pass a resolution supporting the proposed
Rules and Regulations of VBWD including changes the City Council and
City Engineer have suggested and commend the VBWD on its forward
thinking in this matter. (Motion carried 4-0).
C. Budget Update
The Eire, Maintenance, Parks, and Administrative CIP's will be sent to
the Council for final discussion at their November 8th meeting in
preparation for the November 20th Budget Public Hearing.
D. Rental Property at 11194 33rd Street
The staff sent a letter to Doug Henning on September 26, 1990
demanding payment for rent owed to the City. As of today, we have not
heard from Mr. Henning. Mayor Dunn will stop at his place of business
to inform him if payment is not made, the City will proceed with legal
action to recover our loss and remove him from the building.

E. Telephone System
The Administrator distributed information on a new AT&T telephone
system for the City office. The Council will discuss this item at
their November Sth meeting.
